Subject: Guidelines for export of items suspected to be
covered under SCOMET (Special Chemicals, Organisms, Materials, Equipment, and Technologies) at Export Commissionerate, Air Cargo Complex, Mumbai. Export of dual-use items, including software and technologies, having potential civilian / industrial as well as military applications are regulated and covered under the SCOMET (Special Chemicals, Organisms, Materials, Equipment, and Technologies) list. It is our National Export Control List of dual use items munitions and nuclear related items, including software and technology and is aligned to the control lists of the all the multilateral export control regimes and conventions. 2. Meeting the SCOMET (Special Chemicals, Organisms, Materials, Equipment and Technologies) requirements is essential to permit exports. The trade in the past has represented that they intend to meet all statutory requirements including the SCOMET requirements. However, the difference of opinion on whether the item falls in the Appendix 3 [List of SCOMET Items] to Schedule-2 of ITC (HS) Classification of Export and Import items, leads to payment of demurrage charges as the clarification on the matter may take time and the export cargo may get stuck in the export warehouse. 3. In this regard, a “Help Desk” has been created at Export Shed, ACC to provide necessary help in SCOMET compliance.

As Customs officers stationed in the Export Commissionerate are not vested with the authority to issue advance rulings based on prior declarations, the Help Desk serves as a facilitative mechanism to offer necessary guidance and relevant inputs to both exporters and the proper officer, thereby enabling an informed and timely decision on the issuance of LEO. Also, Considering the representations received from the Trade as well as field formations in respect of challenges being faced in the matter of appropriate determination of SCOMET items, CBIC has issued Instruction No. 26/2025-Customs dated 14.08.2025 regarding Guidelines for export of items suspected to be covered under SCOMET. The guidelines are as follows: i. In terms of provisions of Foreign Trade Policy 2023 read with Handbook of Procedures, 2023, related to SCOMET, DGFT has constituted an Inter-Ministerial Working Group (IMWG). IMWG’s

mandate relates to licensing recommendations, strategic risk assessment, and technical classification under SCOMET. In case of any ambiguity regarding coverage of any particular item under SCOMET, the final determination is made by the SCOMET Cell at DGFT in consultation with the Technical Authorities concerned under the aegis of the IMWG.

In case of any suspected SCOMET item, field formations are advised to refer to the said repository. iii. In case, no suitable clarification is available in the said repository and no determination can be made with the resources available with the customs officer or with the information provided by the exporter, the matter, with the prior written approval of concerned Commissioner of Customs may be referred to the Single Nodal Point for Strategic Controls in CBIC i.e. Customs-III Section in Customs Policy Wing. The reference must be accompanied with all the technical documents such as technical drawings, product specifications, end-user and end- use details, along with sample images, and a brief note on the issue.

Engineer (CE) Certificate for SCOMET Classification and export clearance as far as the Foreign Trade Policy, 2023 is concerned as already informed vide Board's letter of even number dated 13.03.2025. 5. It is recommended that before initiating exports, exporter must check their items against the SCOMET List available on the DGFT website under Appendix 3 to Schedule 2 of ITC (HS) Classification. The list is categorized from Category 0 to Category 9, based on the nature of the item to be exported. In case, the item to be exported falls under the list, export authorization for the same must be issued from the DGFT. Once the license is issued, details must be provided to the Customs authorities at the time of export through ICEGAE. This will avoid the unnecessary delay at the time of clearance.
