Sub: Valuation of imported Second hand (Old & Used) Machinery - reg. Trade Attention of all Importers, Customs Brokers and the Members of the is invited to the Public Notice No. 38/2021 dated 22.06.2021 and 29/2022 dated 23.07.2022 issued in light of the CBIC Circular No 07/2020 dated 05.02.2020 regarding the valuation of Second Hand Machine. 2. For the purpose of valuation of second hand machinery, the guidelines made in CBIC Circular No 07/2020 dated 05.02.2020 issued vide F.No 467/34/2006-Cus.V by the Central Board of Indirect Taxes and Customs be referred as extracted below:

• (a) All imports of second hand machinery/used capital goods shall be ordinarily accompanied by an inspection/appraisement report issued by an overseas Chartered Engineer or equivalent, prepared upon examination of the goods at the place of sale.

• (b) The report of the overseas chartered engineer or equivalent should be as per the Form A annexed to the Circular No, 07/2020, dated 05/02/2020.

(c) In the event of the Importer failing to procure an overseas report of inspection/appraisement of the goods, he may have the goods inspected by any one of the Chartered Engineers empanelled locally by the respective Custom Houses. Importers of old and used second hand machinery at Air Cargo Complex, Mumbai may avail the services of any of the above Chartered Engineers/Inspection and Certification Agencies. It is clarified that the choice of the Chartered Engineers /Inspection and Certification Agencies shall totally rest with the importer. 4. The procedure of inspection of the second hand machinery by the local Chartered Engineers shall be as follows: j. importers should appoint any of the listed local Chartered Engineers (CE)/Inspection and Certification Agencies and intimate the AC/DC (Import ii, Thereafter,Shed) accordingly.the local CE should seek an appointment from the concerned iii. AC/DCOn receivingfor inspection, such request, the concerned AC/DC will allocate an Appraising Officer /Superintendent who will supervise the entire inspection process iv. conductedReport generatedby the bylocal theCE, local CE, should be countersigned by the concerned [Import Shed Appraising Officer/Superintendent who had supervised the v. inspectionIt is mandatoryprocess.to all appointed Chartered Engineers to forward their report (Examination /Valuation) on the designated email of the Department for the purpose of record. The designated email ID will be intimated shortly. J: It may be noted that the assessing group shall only accept those local Chartered Engineer's Certificates which have been attested by the Import Shed's Appraising Officer or Superintendent, as the case may be. 6. relevant documents and the NIDB data indicating the values of similar goods would be examined by the Assessing Officer and decide whether the declared value can be accepted as transaction value or the declared value merits to be rejected in terms of Rule 12 of the Customs Valuation (Determination of Value of Imported Goods) Rules, 2007 (CVR 2007) and re-determine the value, in terms of the said CVR, 2007. ts Above procedure should be strictly followed by all importers.
