STANDING ORDER No. : 51/2016
Subject: Removal of mandatory warehousing requirements for EOUs, STPIs, EHTPs etc. - by virtue of amending notification No. 44/2016- Cus dated 29.07.2016 in Notification No. 52/2003-Customs dated 31.03.2003.
Attention of all officers and concerned staff is invited to the Notification No. 44/2016 Custom dated 29.07.2016 and Circular No. 35/2016 dated 29.07.2016 issued by Central Board of Excise and Customs, Department of Revenue, Ministry of Finance, New Delhi and Public Notice No.111/2016 dated 19.08.2016 (JNCH) issued by this office on above subject matter. Keeping in view the changes that have been brought, the following procedure shall henceforth be followed in respect of import of goods by Export Oriented Units (EOUs), Electronics Technology Park Units (EHTPs), Software Technology Park Units (STPIs) and Bio-Technology Park Units (hereinafter referred to as “units”):- (1) The Units are no longer required to compulsorily file Bill of Entry for Warehouse. In other words, the Bill of Entry shall be filed for home consumption, instead of warehousing Bill of Entry. (2) Henceforth, the procedure of filing of Ex-bond Shipping Bill for transfer of goods to Units after import of goods shall not be required. (3) A new procurement certificate (P.C) register will now be maintained in the EOU Section and the warehoused goods register (warehousing bond register) shall not be required to be maintained. (4) Procurement Certificate (P.C) will be defaced by A.O/Supt., in the EOU section.
(5) Since the bills of entry will be filed for home consumption, the imported goods are liable to be opened and examined at the docks, as per the prescribed examination norms/order. The Standing order No.18/2005 dated 31.03.2005 stands amended to above extent. (6) The above instructions are brought to the notice of all the officers, concerned and field formations for information, guidance and strict compliance.
(7) Difficulties faced, if any, in implementation of this standing order may be brought to the notice of this office.
