No. Date- DRAFr PUBLIC NOTICE NO. / 2024-25 Sub: Procedure for the export clearance of Human Remains/Human Dead Body at Air Cargo Complex, Sahar, Mumbai – Reg. 1. Attention of the trade and all concerned is invited to this laid down procedure for easy, predictable and prompt Customs clearance of Human Remains and Human Dead Body. At present there is no recorded procedure prescribed by the Air Cargo Complex for clearance of human remains and dead body with due dignity, which may have a potential of difference in opinion in procedure to be followed. 2. At present Shipping bills are filed through ICEGATE and sometimes manually. Following documents are also submitted for clearance of human remains/ dead bodies: a. b. C. d. Checklist for the shipping bill. Death Certificate/Post Mortem report issued by the authorized/competent medical authority, mentioning the cause of death or a true copy thereof with proper translation in English Language. Embalming certificate and Sealing certificate issued by an authorized agency stating that the dead body or human remains have embalmed and placed in a hermetically sealed (airtight and waterprooD casket. In case of cremated and un-cremated remains, the cremated ashes shall be placed in hermetically sealed urn or a similar container. In case of un-cremated remains, it should be placed in hermetically sealed zine or tin lined wooden packing case. NOC from local police station/municipality for the transportation of Human Remains/Human Dead Body. NOC from the respective Consulate / Embassy / High Commission for the transportation of Human Remains/Human Dead Body of the deceased from India to that country. Cancelled copy of passport of deceased person. For the export clearance of Human Ashes, Cremation Certificate issued by the crematorium, Official death Certificate & Consular mortuary certificate issued by the consular officer are required in addition to the above documents. e. f. g. h. 3. In case, destination countries require any other document or certificate, the person filing the shipping bill also submits such other documents, of his own.
In order to further simplify the process and to ensure due priority in clearance of human remains and dead bodies while according due dignity, the following procedure is prescribed
Shipping Bill for such cases shall be filed through ICEGATE/ ICES. In case there is any issue in the functioning of ICEGATE/ ICES, the DC/ AC, shed shall give permission for manual shipping bill based on the written request from the person or CB responsible for clearance, Documents as mentioned in second para above, which are being submitted at present, shall continue to be submitted with shipping bill. The clearance of human remains and dead bodies shall get the first priority, and it is clarified, that clearance of humans remains and dead body shall get priority over clearance of any other goods. It would be the endeavour of the Custom Officer, responsible for clearance to clear such cargo within 30 minutes and the DC/ AC, shed shall ensure prompt clearance. The DC/ AC E&T section shall assign officers for above clearance in the monthly rotation order. In case the assigned officer is not available due to any reason, the DC/ AC, shed shall appoint any other officer for this purpose. It is essential for all the officers that while clearance and compliances of the law? sensitivity involved must be acknowledged and honoured. In case any shipping bill requires, appraisement and the appraising officer (AO) is not present on account of non-working hour of the AO, the DC/ AC shed, shall order for manual appraisement, if required, by the assigned Officer. Difficulty if any, faced in the implementation of this Public Notice may be brought to the notice of the Commissioner (Export) through e-mail on commr-cus4mum3@nic.in. 6. Action to be taken in terms of decision conveyed in this Public Notice should be considered as Standing Order for the purpose of officers.
