िवभाग 1 ;ी सतबीर शमा िविनKद अ/धकारी एमआईडीसी-एसईजेड, पुणे। एज(डा आइटम नंबर 01: िदनांक 11.12.2024 को आयो-जत 28 व0 बैठक के कायवृN क$ पुि। िवचार-िवमश के बाद, सिम/त ने िदनांक 11.12.2024 को आयो-जत 28 व0 अनुमोदन सिम/त क$ बैठक के कायवृN क$ पुि क$। एज(डा िवषय 9 02: िदनांक 11.12.2024 को आयो-जत 28 व0 बैठक के कायवृN हेतु क$ गई कायवाई क$ Oरपोट । िवचार-िवमश के बाद, सिम/त ने 11.12.2024 को आयो-जत अनुमोदन सिम/त क$ 28 व0 बैठक के संदभ मे क$ गयी कायवाई क$ Oरपोट को नोट िकया। एज(डा आइटम नंबर 03: िवो लिमटेड (डेवलपर) Pारा 8तुत सामQी क$ सूची के अनुमोदन के लए आवेदन। अ/धकृत पOरचालन के लए आवRयक सामQी क$ सूची के अनुमोदन के लए मेसस िवो लिमटेड (डेवलपर) का 8ताव एसईजेड िनयम , 2006 के िनयम 12(2) के अनुसार अनुमोदन सिम/त के सम रखा गया। िवचार-िवमश के बाद, सिम/त ने डेवलपर के 8ताव को 8थिगत कर िदया और उSह( िपछले पांच वषU के लए व8तुओं और सेवाओं के लए उपयोिगता Oरपोट 8तुत करने का िनदIश िदया। डेवलपर ने सिम/त को पुराने पूंजीगत सामानV को बदलने क$ अपनी योजनाओं के बारे म( भी बताया। पOरणाम8वWप, सिम/त ने डेवलपर को बदले जाने वाले सामानV क$ िव8तृत सूची, साथ ही खरीदे जाने वाले 8तािवत नए सामान और सेवाओं क$ सूची दान करने का िनदIश िदया। इसके अलावा, डेवलपर से आवेदन म( नई सामिQयV और सेवाओं को शािमल करने का औ/चXय बताने के लए कहा गया। एज(डा आइटम नंबर 04 : मेसस िवो लिमटेड यूिनट – II के दशन क$ िनगरानी िवचार-िवमश के बाद, सिम/त ने एसईजेड िनयम, 2006 के िनयम 54 के अनुसार, चौथे Zलॉक अव/ध के पहले वष अथात िवN वष 2023-24 के लए यूिनट के परफॉम\स को नोट िकया।

यूिनट ने चौथे Zलॉक अव/ध के पहले वष अथात िवN वष 2023-24 म( संचयी आधार पर 2005.15 करोड़ ^पये के अनुमािनत िनयात के मुकाबले 1833.72 करोड़ ^पये का िनयात हा-सल िकया है। यूिनट ने िवN वष 2023-24 म( संचयी आधार सकाराXमक एन.एफ.ई 1831.82 करोड़ ^पये हा-सल िकया है। यूिनट ने 3408 कमचाOरयV (पु^ष-2215, मिहला-1193) को रोजगार िदया है। सिम/त ने यह भी पाया िक यूिनट ने भारतीय ^पये म( ा_ भुगतान के बदले डीटीए म( सेवाएं दान क$ ह`, जैसा िक नीचे बताया गया है: वष डीटीए िब9ी आईएनआर म(, राश करोड़V म( 2023-24 37.1016 चूंिक यूिनट को िवदेशी मुaा के बजाय भारतीय ^पये म( भुगतान ा_ हुआ है, इस लए अनुमोदन सिम/त ने एसईजेड अ/धिनयम, 2005 क$ धारा 2 (जेड) (iii) के ावधान का उbंघन करने के लए कारण बताओ नोिटस जारी करने का िनदIश िदया। इकाई को िनदIशत िकया गया है िक वह APR को APR फॉम के ाWप के अनुसार सही अमॉटाइजेशन मूJय के साथ संशो/धत करे। अ&य को धSयवाद dापन के साथ बैठक समा_ हुई।

After deliberation, the Committee confirmed the minutes of the 28th Unit Approval Committee meeting held on 11.12.2024. Agenda Item No. 02: Action taken report for the Minutes of the 28th meeting held on 11.12.2024 After deliberation, the Committee has noted the Action taken report for the meeting held on 11.12.2024. Agenda Item No.03: Application for List of Material required for Authorized Operations submitted by M/s. Wipro Limited Developer. The proposal of the M/s. Wipro Ltd. (Developer) for approval of the list of material required for authorized operations was placed before the Approval Committee in terms of Rule 12(2) of SEZ Rules, 2006. After deliberation, the Committee deferred the Developer's proposal and directed them to submit a Utilization Report for Goods and Services for the past five years. The Developer also informed the Committee of their plans to replace old capital goods. Consequently, the Committee instructed the Developer to provide a detailed list of the goods to be replaced,The previously when this was purchased with plotting on map along with the proposed new goods and services to be procured. Where this installed with plotting on map.Furthermore, the Developer was asked to justify the inclusion of new materials and services in the application. Agenda Item No.04: Monitoring of Performance of M/s Wipro Ltd (Unit-II) After deliberation, the committee noted the performance of the unit-II for 1st year of 4th Block Period i.e. FY 2023-24, in terms of Rule 54 of SEZ Rules, 2006. The Unit has achieved export revenue of Rs. 1833.72 Crores as against projected export of Rs. 2005.15 Crores on cumulative basis. The unit has achieved positive NFE of Rs. 1831.82 Crores in 1st year of 5th block period on cumulative basis. The unit has achieved employment of 3408 employees (Men- 2215, Women- 1193) The committee also observed that the unit has made services in DTA against the payments received in INR as detailed below:

Year Value in Cr. 2023-24 37.1016 Since providing of “Services” in DTA against payment received in INR does not qualify as ‘Services’ as per definition given in Section 2(z) of the SEZ Act, 2005, The unit has made violation of various provision of SEZ Act / Rules and under Foreign Trade (Development and Regulation) Act, 1992. As the Unit has received payment in INR instead of Foreign Currency, the Approval Committee directed to issue a SCN for contravening the provision of Section 2(z)(iii) of SEZ Act, 2005. The unit was directed to revise their APR with correct amortization value as per the format of APR form. Meeting ended with a vote of thanks to the Chair.
