Attention of the trade, Courier Companies and Custom Brokers is invited to the Public Notice No.25/2016 dated 23.12.2016 on “Implementation of Express Cargo Clearance System (ECCS) at Courier Temminal, Sahar, Mumbai” and Public Notice No.29/2017 dated 29.03.2017 notifying the implementation of the second phase of ECCS on a pilot basis. . In this regard attention of all concerned is drawn to the provisions of Courier Imports and Exports (Electronic Declaration tad Processing) Regulations, 2010, which, under

Sub-Regulation (3) - of Regulations 5 specifically piovides that: “(3) The Authorised Courier or his agent who has passed the examination referred to in regilation for regulation i9 of the Customs House Agents Licensing Regulations, 2004 shall’ ~ make entry of goods imported by him, inan electronic declaration, by ‘presenting to the proper Officer the Courier Bill af Entry-XI (CBEX1D) for documents in Form B or the Courier Bill of Entry-KI (CBE-XU) for free gifts and samples in Form C or the Courier Bill of Entry-XHI (CBE-XILD) for low value dutiable consignments in Form D or the Courier Bill of Entry-XIV (CBE-XIV) for other duiable consignments in Form E.” On the other hand Courier Imports and Exports (Clearance) Regulations, 1998 under the proviso to Sub-Regulation (3) of Regulation 5 provides that “Provided that the Authorised Courier, or his agent who has passed the examination referred to in regulation 8 or regulation 19 of the Customs House Agents Licensing Regulations, 2004 or the consignee or a Customs House Agent on behalf of the consignee, may file a bill of entry in the form prescribed in the Bill of Entry (Forms) Regulations, 1976 for clearance af any of the imported goods". Since Courier Imports and Exports (Electronic Déeclaration and Processing)’ Regulations, 2010, do not provide for presentation of Bills of Entry by “the consignee or a
