AGENDA NOTE FOR CONSIDERATION OF THE APPROVAL COMMITTEE

a) Proposal:
Applications submitted by the units for change in vendors for cafeteria are to be placed before UAC for approval. b) Specific issue : In terms of Instruction No. 95 dated 11.06.2019 proposals submitted by the units for setting up/regularization of cafeteria, are placed before UAC for approval. It is observed that in case of change of vendor for cafeteria of units the proposals are being placed before UAC for approval. As per para 4 of Instruction No. 95 “UACs are directed to consider requests of units where units intend to create facilities such as cafeteria, crèche, gymnasium and similar facilities in the premises of the unit for the exclusive use of such units”. As per provisions of Rule 11(5) “The Developer may, with the prior approval of the Approval Committee grant on lease land or built up space, for creating facilities as such canteen, public telephone booths, first aid centres, crèche and such other facilities as may be required for the exclusive use of the Unit.”. In case of units, the cafeteria/breakout is not leased out to the vendors. The occupier/owner of the cafeteria premises is the unit itself. The vendors are appointed only for getting in food and serving to the employees. It is seen that when there is only change of vendor without leasing/change in ownership of the cafeteria, such proposals have to be placed before UAC for approval is not provided in the Instruction nor covered in the provisions of Rule 11(5) of the SEZ Rules, 2006. c) Proposal for consideration

: Approval Committee may like to consider if the applications submitted by the units intimating change of vendor for cafeteria is required to be placed before UAC for approval, or the same can be taken on record only.
