The Principal Commissioner of Customs, Mumbai Zone-I vide Order-in-Appeal No. 02/2019/VJ/JNCH dated 15.05.2019 issued vide FJNo. S/V-30- Misc-49/2017-18 CCO M-II (E cell) exonerated Sh. Ratnesh Masih, Superintendent of Customs (P) from all charges by setting aside the Order-in-Original No. 21/2018/UT/JNCH dated 26.03.2018 vide F. No. S/11-Gen-240/2018-19 Vig (JNCH).

2. Thus, upon change in vigilance status and ppening of the sealed cover kept by the DPC held on 01.06.2015 for the vacancy year 2015+16, Shri Ratnesh Masih is notionally promoted to the post of Superintendent of Customs (Preventive) on regular basis with a deemed date w.e.f. 01.06.2015. On promotion as Superintendent of Customs (P) w.e.f, 01.06.2015, Sh. Ratnesh Masih shall be plated below Sh. Sushil Kumar Gautam (S. No. 1635) and above his immediate junior Sh. Vinay Kumar Singh (S. No, 1636) in the Final Common Seniority List of Superintendents (P) of Mumbai & Goa Customs for the period 2014-17 issued vide Circular No. 36/2023 dated 25.04.2023.

3. On promotion as Superintendent of Customs (P) w.e.f 01.06.2015, Shri Ratnesh Masih shall be entitled for arrears of pay and allowances, in terms of DOP&T’s No.22011/4/91-Estt.(A) dated 14.09.1992, as he has been, exonerated from all charges levelled against him.

4. The pay jiand other allowances of Shri Ratnesh Masih in the grade of Superintendent(#) shall be granted only from the deemed date of promotion i.e. w.e.f. 01.06.2015. Thé officer concerned may exercise option under FR 22(I)(a)(1) for fixation of his pay in the higher grade within one month from issuance of this order. Such option onc@ exercised shall be treated as final.

5. This orde} is subject to the final outcome of the SLP No.30621/2011 (Jarnail Singh & Ors Vs|Lachhmi Narain Gupta & Ors) pending before the Hon’ble Supreme Court of India, and / or any relevant pending case in Hon’ble Tribunal / Hon‘ble High Courts/ Hon’ble/Supreme Court of India and / or any direction of the Ministry pursuant to any judicial order.

Pillai shall be placed below Smt. Priya Rajeev (S. No. 326) and above his immediate junior Sh. Kizhuveetil Shashikumar R. (S.
