These Regulations stipulate for advance notice by authorised carriers for goods arriving in or being exported out of India through gateway seaports and further movement between Customs stations. They stipulate the obligations, roles and responsibilities for the various stakeholders involved in movement of imported/export goods. 3.

Advisories & FAQs on Registration and Application Process for all Stakeholders. Message Implementation. Guide for filing of Messages/Manifests with the Customs under SCMTR by different stakeholders is available on ICEGATE website under the Sea Cargo and Manifest Regulations link. 4 It is informed that the Directorate General of Systems has taken several

measures for handling the trade and all stakeholders for a smooth transition to the SCMTR regime. Directorate General of Systems have issued various guidelines related the registration process and filing requirements under the SCMTR for different stakeholders such as Shipping lines, Steamer Agents, Shipping Agents, Transhippers, NVOCC, Consolidators, Terminal Operators, Custodians, Freight Forwarders etc., who are integral to the implementation of the said regulations. These guidelines can be found at the following link https://www.icegate.gov.in/SeaManifestRegulation.html. 5. As per Regulation 2(c) Authorised Carrier means an Authorised Sea Carrier, Authorised Train Operator or a Custodian registered under Regulation 3 of the SCMTR. Regulation 3 of the SCMTR mandates that any person who is required to deliver arrival manifest or Departure manifest shall apply to the Jurisdictional Commissioner of Customs for Registration.

Regulation 4, 5 and 7 mandate that the authorized carrier shall deliver the arrival or Departure Manifest, as applicable, electronically. 6. Public Notice No 71/2020 dated 22.10.2020 and Public Notice No. 74/2020 dated 11.11.2020 issued by Mumbai Customs, Zone-1 detail the requirement of registration of various stakeholders (ASC, ASA, ANC and ATP) & messages/manifests they would be required to file with Customs under SCMTR along with the timelines and process to be followed in this regard. In this regard, vide Public Notice No. 74/2020 dated 11.11.2020, it was informed to all the stakeholders such as ASC/ASA Authorized Sea Carriers /Sea Agents like Shipping Lines/Shipping Agents, ANC- Other Notified Carriers like Freight Forwarders, NVOCCs and ATP-Authorized Carriers for Inland Movement-Transhippers were mandatorily required to register themselves under SCMTR, 2018 and were required to adhere to the timelines as mentioned in the Annexure-A to the Public Notice No. 74/2020 dt. 11.11.2020 for mandatory filing of different declarations in the new format in a phased manner as preseribed under Regulation 15(1), of SCMTR. However, it has been noticed that none of the stakeholders have filed any manifest (SAM/SDM/SEI/SDN) under the SCMTR so far.

Further, necessary Bond requirements (like National Container Bond by ASC/ASA, National Transhipment Bond by ATP) for successful filing of messages/manifests is also pending compliance by several stakeholders. It is brought to notice of all concerned that necessary Bond requirements & messages/mani fests, as mandated, should be filed immediately with 2

Since several entities (ASC, ASA, ACU, ANC, ATP) who were mandated to register under SCMTR, were not registered, a list of ASC, ASA, ACU, ANC provided by the Directorate of Systems, CBIC was cross checked by the Mumbai Zone-I EDI staff by calling and emailing on the listed contact details provided against these stakeholders. The list of such entities who were cross-verified and found to be either not answering the call, phone not reachable or having invalid contact details. This list is enclosed as Annexure –I Ito this public notice. All the entities who have not yet registered are directed to immediately register themselves under SCMTR failing which they shall not be able to discharge their functions under the said regulations. It may also adversely affect the import/export trade.

As per ICES advisories and Annexure A to Circular No 43/2020-Customs dated 30 September 2020 further circulated among trade vide Public Notice No. 74/2020 dt. 11.11.2020, different stakeholders (ASC, ASA, ANC, ATP) as mentioned in Annexure-II have taken registration at INBOM 1 port. These stakeholders already registered were required to adhere to the timelines as mentioned in the Annexure- A to the Public Notice No. 74/2020 dt. 11.11.2020 for mandatory filing of different declarations in the new format in a phased manner as prescribed under Regulation 15(1), of SCMTR. However, it has been noticed that none of these 34 stakeholders have filed any manifest (SAM/SDM/SEI/SDN) under the SCMTR so far.
9. Attention is invited to Regulation 13 which provides for imposition of penalty for contravention of any provisions of SCMTR. All stakeholders are therefore directed to take immediate steps for Registration and for filing of messages/manifests as mandated under SCMTR latest by 22.02.2021 failing which penal action as prescribed under Regulation 13 which provides for imposition of penalty for contravention of any provisions of SCMTR would be initiated against the concerned stakeholders not adhering to the provisions of SCMTR.
