Subject: Implementation of the Sea Cargo Manifest and Transshipment Regulations - Filing of Allowed for Shipment Request (ASR) and Cargo Summary Notification (CSN) declarations-reg.

Kind attention is invited of all the shipping lines/agents, Exporters, Customs brokers, custodians and all the stakeholders to the ICES advisory No. 40/2020 dated 19.10.2020 issued by DGoS, ICES on the above mentioned subject, reference is also invited to the CBIC Circular No. 43/2020- Customs dated 30.09.2020 mentioning therein the procedural compliance requirements along with the implementation plan for filing of mandatory SCMTR related declarations in respect of various stakeholders. For reference, a summarised workflow under SCMTR and the role played by each stakeholder is again enclosed in Annexure-I. The Annexure A of the above circular provides for mandatory filing of different declarations in new format in a phased manner with given timelines. In consonance with the same, the Allowed for Shipment Request (ASR) message will be the first declaration becoming mandatory for transhippers of export cargo at all ICDs w.e.f. 22.10.2020. Various aspects of ASR message as per the requirement of regulations are detailed as below.

The regulations mandate that the transhipper, i.e. person/entity responsible for the movement of the import/export goods within India, would be registered in the category of Authorised Transhipper (ATP). The ATP is required to file the ASR for every shipping bill when ready for departure from the Customs location (i.e. ICD/CFS) during inland movement of the cargo. As per the workflow, online filing of container-wise stuffing message (SF) by the Custodian precedes the ASR declaration by ATP. Therefore, the SF message will also be made mandatory for all the ICDs w.e.f. 22.10.2020. In this regard, reference is invited to the ICES Advisory No. 28/2020 dt 07.08.2020 outlining the detailed process for filing online stuffing message by the Custodians as per the workflow envisaged under the regulations. The option to approve the container wise SF report has been added in the PREV_OFF role. The same is required to be used by the officer to approve the SF report filed by the Custodian. The facility for filing SF messages by the Custodians has been made live for all the inland Customs locations and as aforesaid, it will be made mandatory on 22.10.2020 at all ICDs. Some ICD Custodians have already started filing them but many others are yet to start. Currently, both the options - new Container wise stuffing approval and the old Shipping Bill wise Stuffing Report option are co-existing. The old shipping bill wise stuffing report will be disabled and only new option will remain once

the online SF and ASR become mandatory from 22.10.2020. Once the container wise SF report is approved by the officer for every container of a Shipping Bill, the ATP would then file the ASR for every shipping bill when ready for departure from the Customs location (i.e. ICD/CFS) during inland movement of the cargo. It may happen that the Custodian would also act as a transhipper. In that case, both the messages (SF and ASR) will be filed by the same entity, provided they are registered as ACU as well as ATP under the SCMTR. 3. On the imports side, as envisaged in the CBIC’s Circular, the authorized carriers (ASC/ASA or ANC) will be expected to file Cargo Summary Notification for Entry of Goods (Message Type – SCE) for at least the FCL cargo from 23.10.2020 at all major ports. Facility to file CSN and other sea manifest messages like SAM, SAA etc. is already available in Production (live) environment and some Shipping Lines have indeed started parallel filing. The email id for sending all the SCMTR messages is scmtr.prod@icegate.gov.in. The Custodian messages (SF/ST and AT/DT) can however be filed directly through the MTFP. 4. System will enable other declarations also under the SCMTR regulations to go live as per the implementation plan envisaged in Annexure A of the aforesaid CBIC Circular. The next message to become mandatory from 01.11.2020 would be the Sea Arrival Manifest (SAM) for FCL Cargo by the ASC/ASA. 5. Difficulties, if any, may be brought to the notice of officers in team.ices@icegate.gov.in.
