Subject: Anti-dumping investigation concerning imports of “Natural Mica Pearl

Industries Pigments excluding cosmetic grade” originating in or export from China PR. Initiated on 09.05.2020, vide notification no. 6/8/2020-DGTR. (http://www.dgtr.gov.in/sites/default/files/MICA-initiation-English.pdf).
Reference aforecited subject. Through email dated 19.05.2020, copy of non-confidential version (NCV) of petition filed by the domestic industry regarding aforecited investigation was circulated to all interested parties. The list of interested parties is also hosted on DGTR’s website. Through email dated 22.05.2020 all interested parties were advised to exchange the NCV submissions/responses filed by them amongst each other as physical access to public file is not feasible due to the current pandemic environment (Covid-19). The last date to file response by way of submission/questionnaire response to the initiation was 8th July 2020. However on request of certain interested parties, the Authority was extended the same till 18.07.2020. Please note that no further extension will be granted.

The information and supportive evidence on criteria mentioned in para 8 of the Annexure 1 to AD Rules be provided by such claimants. The interested parties may file response in English both CV/NCV copies through email to adg11-dgtr@gov.in and dir15- dgtr@gov.in and preserve the worksheets related to the questionnaire. Annexure

The Designated Authority reserves the right to call for any information at any time during the investigation in addition to the questionnaire response filed by the interested parties.

• The information submitted in this questionnaire must be certified by the Chief Executive of your company as accurate, complete and presenting a true and fair view of the accounts and other data to the best of his knowledge and belief.

The information furnished is subject to verification. Willingness to offer yourself for any verification by the Authority may be stated. All the working documents may be preserved for such verification.

In case you wish to appoint a person/firm to represent your interests, you may please issue a proper authorization in favor of such person/firm.

If no response is received within the extended time line, it would be presumed that you have no comments to offer. Attention is specifically drawn to the Anti-Dumping Rules, which authorize the Designated Authority to record its findings on the basis of facts available to it in case of non-cooperation from the interested parties.

Confidential Information: The answer to the questionnaire must be submitted in two versions: one confidential version and another non-confidential version; for the latter the inclusion of a non-confidential summary will be required, allowing for a reasonable understanding of the information and/or supporting documents deemed confidential. For those cases where the submittal of this summary is not possible, such circumstance must be convincingly explained. An interested party supplying information must ensure that all the information supplied is clearly marked either “confidential” or “non-confidential” at the top of each page. Information supplied without any mark shall be treated as non-confidential and the Designated Authority shall be at liberty to allow the other interested parties to inspect any such non-confidential information. Confidential information must be accompanied by a non- confidential summary or, if it is not susceptible to summarization, a statement of the reasons why summarization is not possible. However, if the Designated Authority is satisfied that the request for confidentiality is not warranted, or the supplier of the information is either unwilling to make the information public or to authorize its disclosure in a generalized or summary form, the Designated Authority may disregard such information.

As per Rule 6(6) of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995 “the Designated Authority may allow an interested party or its representative to present the information relevant to the investigation orally but such oral information shall be taken into consideration by the Designated Authority only when it is subsequently reproduced in writing.”
