Subject: Final list of sampled and non-sampled responding exporters in the sunset

review of the anti-GXPSLQJGXWLHVLQIRUFHRQWKHLPSRUWVRI³-XWH3URGXFWV´ Jute Yarn/twine, Sacking cloth, Sacking bag and Hessian Fabric) originating in or exported from Bangladesh and Nepal.

1. The Authority had informed regarding the sampled list of responding producers/ exporters in the captioned investigation and sought comments on the same. The proposed list was SODFHGRQ'*75¶Vwebsite.

2. Various comments received on the proposed sampling have been examined and the clarifications on relevant comments are provided here under for benefit of all concerned.

a) The Authority has adopted stratified and purposive sampling methodology as was adopted in the original investigation.

b) In the said methodology, the Authority has selected responding exporters for sample amongst the highest, middle and lower band of export volumes to India of different type of jute products.

c) Along with the criteria of responding exporters from the three categories of volumes as above, it has been ensured that there is complete coverage of different PCNs as well.

d) In the original investigation where there were a large number of exporter responses,
in many responses the data was grossly deficient for various reasons including the capacity constraint on data compilation and its presentation.

e) The Authority at that time also had resorted to sampling post the receipt of responses to ensure that sample of exporters chosen are not only sufficiently reasonable on representativeness but also to ensure choice of EQRs which are complete and are of higher quality.

f) Since the situation over past years has by and large remained the same the Authority has retained the same methodology.

4. The Authority KDVGLVFORVHGWKURXJK'*75¶VZHEVLWHOLVWRIDOOLQWHUHVWHGSDUWLHVLQWKH subject investigation identifying interested parties who have filed EQRs. Hence the responding exporters who have filed EQRs and have not been selected in the sample automatically fall under the non-sampled category.

5. One of the interested parties has stated that the Authority has delayed sample selection beyond the time prescribed by it. The Authority notes that many interested parties had sought extension on few occasions to file their various submissions. The Authority does not consider this argument as justified as on the one hand various interested parties (primarily exporters) sought extensions and at the same time exporters are raising concerns regarding delay in sampling. It should be well appreciated that if timelines got impacted for filing of EQR/deciding PCNs due to global pandemic, the impact on sampling is consequential.

a) The Government of Bangladesh and some consulting firms have requested to include some additional exporters as well in the sample. It is clarified that globally the sampling size is in fact largely below 1% of the total responses filed by the exporters. In this present case the sampled exporters constitute more than 35% of the total responses which is well above the global practice.

b) Some exporters have requested inclusion in the sampled list citing reasons of their participation or their exports being of higher than other sampled exporters. It is clarified that since exporters in three bands i.e. high, medium and low quantum of exports covering all PCNs are part of the sample, non-inclusion of any cooperating exporter should not be construed as unjustified since the measure for non-sampled category is the weighted average margin of sampled category only. The Authority has not merely restricted the sample selection to highest exports but has covered the universe of cooperating exporters over a continuum of quantum and PCN coverage.

7. Requests have been received from few interested parties for further extension of time for submitting the necessary documents for online desk verification. In this regard it is clarified that the Authority has already provided sufficient extensions and had through its last communication dated 24th December 2021 hosted on DGT5¶V website intimated to begin the aforementioned verification from 10th January 2022.

8. However keeping in view the said requests the Authority is once again granting relief to all the interested parties to file verification documents by 19th January 2022 so as to begin the online verification by 20th January 2022 for which the schedules/modalities will be intimated separately.

9. It may be noted that failure to submit the information will lead to declaration of such a party as non-cooperative and the same will be placed in the residual category.
