भारतीय दिवाला और िोधन अक्षमता बोडड अजधसूचना नई दिल्ली, 1 िून, 2026 भारतीय दिवाला और िोधन अक्षमता बोडड (जनरीक्षण और अन्वेषण) (संिोधन) जवजनयम, 2026

फा. सं. आई.बी.बी.आई./2026-27/िी.एन./आर.ई.िी.145.—भारतीय दिवाला और िोधन अक्षमता बोडड, दिवाला और िोधन अक्षमता संजिता, 2016 (2016 का 31) की धारा 240 के साथ पठित धारा 196 द्वारा प्रित्त िजियों का प्रयोग करते हुए, भारतीय दिवाला और िोधन अक्षमता बोडड (जनरीक्षण और अन्वेषण) जवजनयम, 2017 का और संिोधन करने के जलए जनम्नजलजखत जवजनयम बनाता िै, अथाडत्: -

1. (1) इन जवजनयमों का संजक्षप्त नाम भारतीय दिवाला और िोधन अक्षमता बोडड (जनरीक्षण और अन्वेषण) (संिोधन) जवजनयम, 2026 िै ।

(2) ये रािपत्र में उनके प्रकािन की तारीख को प्रवृत्त िोंगे । 2. भारतीय दिवाला और िोधन अक्षमता बोडड (जनरीक्षण और अन्वेषण) जवजनयम, 2017 (जिन्िें इसमें इसके पश्चात् मूल जवजनयम किा गया िै) के जवजनयम 2 के उप-जवजनयम (1) के :- सं. 364] नई दिल्ली, मंगलवार, िून 2, 2026/ज् येष् ि 12, 1948

THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (i) खंड (ग) में, “बोडड द्वारा संजिता की धारा 220(1) के अधीन गठित पूणडकाजलक सिस्ट्य(सिस्ट्यों) की एक सजमजत अजभप्रेत िै” िब्िों के स्ट्थान पर “ऐसी सजमजत अजभप्रेत िै जिसमें संजिता की धारा 220 की उपधारा (1) के अधीन यथा-उपबंजधत एक या उससे अजधक व्यजि िाजमल िों” िब्ि रखे िाएंगे । (ii) खंड (ग) के परन्तुक में, “पूणडकाजलक सिस्ट्य” िब्िों और जचह्नों के स्ट्थान पर “व्यजि” िब्ि रखा िाएगा । (iii) खंड (ञ) में, “से दिवाला वृजत्तक अजभकरण, दिवाला वृजत्तक, दिवाला वृजत्तक इकाई या सूचना उपयोजगता अजभप्रेत िै” िब्िों और जचह्नों के स्ट्थान पर “का विी अथड िोगा िो संजिता की धारा 3 के खंड (31क) में दिया गया िै” िब्ि रखे िाएंगे । 3. मूल जवजनयमों के जवजनयम 13 के उप-जवजनयम (3) के खंड (ग) में, “कोई भी कारडवाई” िब्िों के पश्चात् “या जनिेि” िब्ि अंतःस्ट्थाजपत दकए िाएंगे । 4. मूल जवजनयमों के जवजनयम 14 के उप-जवजनयम (1) में, “कोई जनिेि िारी दकया गया िै” िब्िों से पूवड “अनुिासनात्मक सजमजत द्वारा” िब्ि अंतःस्ट्थाजपत दकए िाएंगे । 5. मूल जवजनयमों के जवजनयम 14 के उप-जवजनयम (3) में “प्ररूप क” िब्िों के स्ट्थान पर “ऐसे प्ररूप में, िो बोडड द्वारा अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । 6. मूल जवजनयमों में, अध्याय 5 के पश्चात्, प्ररूप क का लोप दकया िाएगा ।

3 INSOLVENCY AND BANKRUPTCY BOARD OF INDIA
NOTIFICATION New Delhi, the 1st June, 2026 Insolvency and Bankruptcy Board of India (Inspection and Investigation) (Amendment) Regulations, 2026

F. No. IBBI/2026-27/GN/REG145.— In exercise of the powers conferred by section 196 read with section 240 of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), the Insolvency and Bankruptcy Board of India hereby makes the following regulations to further amend the Insolvency and Bankruptcy Board of India (Inspection and Investigation) Regulations, 2017, namely:-

1. (1) These regulations may be called the Insolvency and Bankruptcy Board of India (Inspection and Investigation) (Amendment) Regulations, 2026.
   (2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Insolvency and Bankruptcy Board of India (Inspection and Investigation) Regulations, 2017, (hereinafter referred to as ‘the principal regulations’), in sub-regulation (1) of regulation 2:-
(i) In clause (c), for the words “of whole time member(s) constituted by the Board” the words “consisting of one or more persons as provided” shall be substituted.
(ii) In the proviso to clause (c), for the words and the marks “whole time member(s)” the word and the marks “person(s)” shall be substituted.
(iii) In clause (j), for the words “means insolvency professional agency, insolvency professional, insolvency professional entity or information utility” the words, marks and numerical “shall have the same meaning as assigned in clause (31A) of section 3 of the Code” shall be substituted.
3. In the principal regulations, in clause (c) of sub-regulation (3) of regulation 13, after the words “any of the actions” the words “or directions” shall be inserted.
4. In the principal regulations, in sub-regulation (1) of regulation 14, after the words “direction has been issued” the words “by the Disciplinary Committee” shall be inserted.
5. In the principal regulations, in sub-regulation (3) of regulation 14, for the words “Form A” the words “such format as notified by the Board” shall be substituted.
