फा. सं. आई.बी.बी.आई./2026-27/िी.एन./आर.ई.िी.147.— भारतीय दिवाला और िोधन अक्षमता बोडड, दिवाला और िोधन अक्षमता संजिता, 2016 (2016 का 31) की धारा 240 के साथ परित धारा 196 की उपधारा (1) के खंड (न) द्वारा प्रित्त िजियों का प्रयोग करते हुए, भारतीय दिवाला और िोधन अक्षमता बोडड (पूवड-जनधाडररत दिवाला समाधान प्रदिया) जवजनयम, 2021 का और संिोधन करने के जलए जनम्नजलजखत जवजनयम बनाता िै, अथाडत्: - 1. (1) इन जवजनयमों का संजक्षप्त नाम भारतीय दिवाला और िोधन अक्षमता बोडड (पूवड-जनधाडररत दिवाला समाधान प्रदिया)( तीसरा संिोधन) जवजनयम, 2026 िै । (2). ये रािपत्र में प्रकािन की तारीख को प्रवृत्त िोंगे । 2. भारतीय दिवाला और िोधन अक्षमता बोडड (पूवड-जनधाडररत दिवाला समाधान प्रदिया) जवजनयम, 2021 (जिन्िें इसमें इसके पश्चात् मूल जवजनयम किा गया िै) के जवजनयम 2 के उप-जवजनयम (1) में, सं. 366] नई दिल्ली, मंगलवार, िून 2, 2026/ज् येष् ि 12, 1948

(क) उप-जवजनयम (3) में, “प्ररूप पी2 में” िब्िों के स्ट्थान पर, “ऐसे प्ररूप में, िो बोडड द्वारा अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । (ख) उप-जवजनयम (5) में, “प्ररूप पी3 में िोगा” िब्िों के स्ट्थान पर, “ऐसे प्ररूप में िोगा, िो बोडड द्वारा अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । (ग) उप-जवजनयम (7) में, “प्ररूप पी4 में िोगा” िब्िों के स्ट्थान पर “ऐसे प्ररूप में िोगा, िो बोडड द्वारा अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । 5. मूल जवजनयमों के जवजनयम 15 में, (क) “प्ररूप पी2” िब्िों के स्ट्थान पर “जवजनयम 14 में यथा-जनर्िडष्ट प्ररूप” िब्ि रखे िाएंगे। (ख) खंड (iii) और (vi) में, “प्ररूप पी5 में” िब्िों के स्ट्थान पर “ऐसे प्ररूप में, िो बोडड द्वारा अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । 6.

न पर “जवजनयम 14 में यथा-जनर्िडष्ट प्ररूप” िब्ि रखे िाएंगे। (ख) खंड (iii) और (vi) में, “प्ररूप पी5 में” िब्िों के स्ट्थान पर “ऐसे प्ररूप में, िो बोडड द्वारा अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । 6. मूल जवजनयमों के जवजनयम 16 में, (क) उप-जवजनयम (1) में “प्ररूप पी6 में की िाएगी” िब्िों के स्ट्थान पर “ऐसे प्ररूप में की िाएगी, िो बोडड द्वारा अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । (ख) उप-जवजनयम (2) में, “प्ररूप पी7 में िोगी” िब्िों के स्ट्थान पर “ऐसे प्ररूप में िोगी, िो बोडड द्वारा अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । 7. मूल जवजनयमों के जवजनयम 17 में, “प्ररूप पी8 में” िब्िों के स्ट्थान पर “ऐसे प्ररूप में िो बोडड द्वारा अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । 8. मूल जवजनयमों के जवजनयम 18 के स्ट्थान पर जनम्नजलजखत रखा िाएगा, अथाडत्:-

“18. आवेिक द्वारा िी िाने वाली िानकारी और िस्ट्तावेज़ । धारा 54ग की उपधारा (3) के प्रयोिनों के जलए, कारपोरेट आवेिक आवेिन के साथ जनम्नजलजखत िानकारी और िस्ट्तावेज़ प्रस्ट्तुत करेगा:- (1) यथाजस्ट्थजत, जनिेिकों या भागीिारों के बहुमत द्वारा की गई घोषणा की प्रजत ऐसे प्ररूप में, िो बोडड द्वारा अजधसूजचत दकया िाए । (2) धारा 54क के जनबंधनानुसार पूवड-जनधाडररत दिवाला समाधान प्रदिया आरंभ करने के जलए यथाजस्ट्थजत, घोषणा, जविेष संकल्प या संकल्प की प्रजत । (3) जवत्तीय लेनिारों से अनुमोिन का प्रमाण, िो संबद्ध पक्षकार निीं िैं, िो जवत्तीय ऋण के मूल्य में कम से कम इकावन प्रजतित का प्रजतजनजधत्व करते िैं। (4) दिवाला व्यावसाजयक के संबंध में जनम्नजलजखत ब्यौरेः

वत्तीय लेनिारों से अनुमोिन का प्रमाण, िो संबद्ध पक्षकार निीं िैं, िो जवत्तीय ऋण के मूल्य में कम से कम इकावन प्रजतित का प्रजतजनजधत्व करते िैं। (4) दिवाला व्यावसाजयक के संबंध में जनम्नजलजखत ब्यौरेः

3 (क) प्रस्ट्ताजवत समाधान व्यावसाजयक की ऐसे प्ररूप में, िो बोडड द्वारा अजधसूजचत दकया िाए, जलजखत सम्मजत । (ख) संजिता की धारा 54ख की उपधारा (1) के खंड (क) में जनर्िडष्ट समाधान व्यावसाजयक की ररपोटड िो ऐसे प्ररूप में तैयार की गई िो, िो बोडड द्वारा अजधसूजचत दकया िाए । (5) जपछले िो जवत्तीय वषों के जलए कारपोरेट ऋणी की संपरीजक्षत जवत्तीय जववरजणयां । (6) चालू जवत्तीय वषड के जलए अनंजतम जवत्तीय जववरजणयां, िो यथाजस्ट्थजत, जनिेिकों या भागीिारों द्वारा घोषणा दकए िाने की तारीख तक अद्यतन की गई िों । (7) ऐसा प्ररूप, िो बोडड द्वारा अजधसूजचत दकया गया िो और लेनिारों के प्रवगों के जलए चयजनत प्राजधकृत प्रजतजनजधयों द्वारा प्रस्ट्तुत दकया गया िो, ििां किीं भी लागू िो ।” 9. मूल जवजनयमों के जवजनयम 19 के उप-जवजनयम (2) के: (क) खंड (क) में, 'प्ररूप पी9 में' िब्िों के स्ट्थान पर 'ऐसे प्ररूप में, िो बोडड द्वारा अजधसूजचत दकया िाए' िब्ि रखे िाएंगे।
(ख) खंड (ख) में, 'प्ररूप पी2 में' िब्िों के स्ट्थान पर 'ऐसे प्ररूप में, िो बोडड द्वारा अजधसूजचत दकया िाए' िब्ि रखे िाएंगे। 10. मूल जवजनयमों के जवजनयम 20 में, - (क) उप-जवजनयम (1), (2) और (8) में, “प्ररूप पी10 में” िब्िों के स्ट्थान पर “ऐसे प्ररूप में, िो बोडड द्वारा अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । (ख) उप-जवजनयम (9) में, “प्ररूप पी10” िब्िों के स्ट्थान पर “ऐसा प्ररूप, िो उप-जवजनयम (8) के अधीन बोडड द्वारा अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । 11.

मूल जवजनयमों के जवजनयम 43 में, (क) उप-जवजनयम (1) में, “प्ररूप पी11 में” िब्िों के स्ट्थान पर, “ऐसे प्ररूप में, िो बोडड द्वारा अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । (ख) उप-जवजनयम (2) और (3) में, “प्ररूप पी11” िब्िों के स्ट्थान पर “ऐसा प्ररूप, िो बोडड द्वारा अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । 12. मूल जवजनयमों के जवजनयम 49 में, (क) उप-जवजनयम (1) में, “प्ररूप पी12 में” िब्िों के स्ट्थान पर “ऐसे प्ररूप में, िो बोडड द्वारा अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । (ख) उप-जवजनयम (4) में, “प्ररूप पी13 में” िब्िों के स्ट्थान पर “ऐसे प्ररूप में, िो बोडड द्वारा अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । 13. मूल जवजनयमों के जवजनयम 51 में, “प्ररूप पी14 में” िब्िों के स्ट्थान पर “ऐसे प्ररूप में, िो बोडड द्वारा अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । 14. मूल जवजनयमों में, जवजनयम 51 के पश्चात्, “अनुसूची” का लोप दकया िाएगा ।

NOTIFICATION New Delhi, the 1st June, 2026 Insolvency and Bankruptcy Board of India (Pre-Packaged Insolvency Resolution Process) (Third Amendment) Regulations, 2026

F. No. IBBI/2026-27/GN/REG147.— In exercise of the powers conferred by clause (t) of sub-section (1) 

of section 196 read with section 240 of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), the Insolvency and Bankruptcy Board of India hereby makes the following regulations to further amend the Insolvency and Bankruptcy Board of India (Pre-Packaged Insolvency Resolution Process) Regulations, 2021, namely: -

1. (1) These regulations may be called the Insolvency and Bankruptcy Board of India (Pre-Packaged Insolvency Resolution Process) (Third Amendment) Regulations, 2026.

(2) They shall come into force on the date of publication in the Official Gazette. 2.

(2) They shall come into force on the date of publication in the Official Gazette. 2. In the Insolvency and Bankruptcy Board of India (Pre-Packaged Insolvency Resolution Process) Regulations, 2021, (hereinafter referred to as ‘the principal regulations’), in regulation 2, in sub-regulation (1),
(a) in clause (h), for the words “a Form specified in the Schedule”, the words “such format as notified by the Board” shall be substituted. (b) clause (o) shall be omitted. 3. In the principal regulations, in sub-regulation (1) of regulation 7, for the words “Form P1”, the words “such format as notified by the Board” shall be substituted. 4. In the principal regulations, in regulation 14,
(a) in sub-regulation (3), for the words “Form P2”, the words “such format as notified by the Board” shall be substituted. (b) in sub-regulation (5), for the words “Form P3”, the words “such format as notified by the Board” shall be substituted. (c) in sub-regulation (7), for the words “Form P4”, the words “such format as notified by the Board” shall be substituted. 5. In the principal regulations, in regulation 15,

the written consent of the proposed resolution professional in such format as notified by the Board; (b)
the report of the resolution professional referred to in clause (a) of sub-section (1) of section 54B of the Code, prepared in such format as notified by the Board. (5) audited financial statements of the corporate debtor for the last two financial years; (6) provisional financial statements for the current financial year made up to the date of the declaration by the directors or partners, as the case may be; and (7) a format as notified by the Board and submitted by the authorised representatives selected for the classes of creditors, wherever applicable.”. 9.
