फा. सं. आई.बी.बी.आई./2026-27/िी.एन./आर.ई.िी.146.—भारतीय दिवाला और िोधन अक्षमता बोडड, दिवाला और िोधन अक्षमता संजिता, 2016 (2016 का 31) की धारा 240 के साथ पटित धारा 196, 210, 213, 214 और 215 द्वारा प्रित्त िजियों का प्रयोग करते हुए, भारतीय दिवाला और िोधन अक्षमता बोडड (इनफॉरमेिन यूटिजलिी) जवजनयम, 2017 का और संिोधन करने के जलए जनम्नजलजखत जवजनयम बनाता िै, अथाडत्: -

1. (1) इन जवजनयमों का संजक्षप्त नाम भारतीय दिवाला और िोधन अक्षमता बोडड (इनफॉरमेिन यूटिजलिी) (संिोधन) जवजनयम, 2026 िै ।

(2) ये रािपत्र में उनके प्रकािन की तारीख को प्रवृत्त िोंगे । 2. भारतीय दिवाला और िोधन अक्षमता बोडड (इनफॉरमेिन यूटिजलिी) जवजनयम, 2017 (जिन्िें इसमें इसके पश्चात् ‘मूल जवजनयम’ किा गया िै) के जवजनयम 2 में,

(i) उप-जवजनयम (1) में - (क) खंड (िक) में, “अनुसूची के प्ररूप घ में” िब्िों के स्ट्थान पर “ऐसे प्ररूप में, िो बोडड द्वारा पटरपत्र के माध्यम से सं. 365] नई दिल्ली, मंगलवार, िून 2, 2026/ज् येष् ि 12, 1948

“(िख) “जववाि की सूचना” से ऐसे प्ररूप में, िो बोडड द्वारा पटरपत्र के माध्यम से अजधसूजचत दकया िाए, िारी दकए गए चूक के प्रमाणन की जस्ट्थजत अजभप्रेत िै;” (ग) खंड (त) का लोप दकया िाएगा । (ii) उप-जवजनयम (2) के पश्चात्, जनम्नजलजखत स्ट्पष्टीकरण अंतःस्ट्थाजपत दकया िाएगा, अथाडत्:- “स्ट्पष्टीकरणः इन जवजनयमों के प्रयोिनाथड, िब तक दक संिभड से अन्यथा अपेजक्षत न िो, ‘ऋणी’ पि के प्रजत जनिेि में ‘कारपोरेि ऋणी’ िाजमल िोगा ।” 3. मूल जवजनयमों के जवजनयम 4 में, (क) उप-जवजनयम (1) में, “अनुसूची के प्ररूप क में” िब्िों के स्ट्थान पर “ऐसे प्ररूप में, िो बोडड द्वारा पटरपत्र के माध्यम से अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । (ख) उप-जवजनयम (2) में, “अनुसूची के प्ररूप क में” िब्िों के स्ट्थान पर “ऐसे प्ररूप में, िो बोडड द्वारा पटरपत्र के माध्यम से अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । 4. मूल जवजनयमों के जवजनयम 5 के उप-जवजनयम (4) के खंड (ङ) में, “अनुसूची के प्ररूप ख में” िब्िों के स्ट्थान पर “ऐसे प्ररूप में, िो बोडड द्वारा पटरपत्र के माध्यम से अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । 5.

मूल जवजनयमों के जवजनयम 5 के उप-जवजनयम (4) के खंड (ङ) में, “अनुसूची के प्ररूप ख में” िब्िों के स्ट्थान पर “ऐसे प्ररूप में, िो बोडड द्वारा पटरपत्र के माध्यम से अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । 5. मूल जवजनयमों के जवजनयम 15 के उप-जवजनयम (3) के खंड (खक) में, -

(क) मि (ii) में, अंत में आने वाले “और” िब्ि का लोप दकया िाएगा; (ख) मि (iii) में, अंत में आने वाले “।” जवराम जचह्न के स्ट्थान पर “;और” िब्ि और जचह्न रखे िाएंगे ।

(ग) मि (iii) के पश्चात्, जनम्नजलजखत मि अंतःस्ट्थाजपत की िाएगी, अथाडत्:-

“(iv) जववाि की सूचना का िारी दकया िाना ।” 6. मूल जवजनयमों के जवजनयम 20 के उप-जवजनयम (1) में “अनुसूची के प्ररूप ग में” िब्िों के स्ट्थान पर “ऐसे प्ररूप में, िो बोडड द्वारा पटरपत्र के माध्यम से अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । 7. मूल जवजनयमों के जवजनयम 21 में,

(i) उप-जवजनयम (2) के खंड (ग) के उप—खंड (iii) में, - (क) “अनुसूची के प्ररूप ग में” िब्िों के स्ट्थान पर “ऐसे प्ररूप में, िो बोडड द्वारा पटरपत्र के माध्यम से अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । (ख) मि (क) के स्ट्थान पर जनम्नजलजखत रखी िाएगी, अथाडत्:-

“(क) ऐसे जवत्तीय लेनिार द्वारा, िो संजिता की धारा 3 के खंड (14) में यथा-पटरभाजित एक जवत्तीय
संस्ट्था िै;” (ii) उप-जवजनयम (3) के स्ट्थान पर जनम्नजलजखत रखा िाएगा, अथाडत्:- “(3) उप-जवजनयम (2) के अधीन प्रदिया के पूरा िोने पर, इनफॉरमेिन यूटिजलिी चूक की िानकारी के प्रमाणन की

संस्ट्था िै;” (ii) उप-जवजनयम (3) के स्ट्थान पर जनम्नजलजखत रखा िाएगा, अथाडत्:- “(3) उप-जवजनयम (2) के अधीन प्रदिया के पूरा िोने पर, इनफॉरमेिन यूटिजलिी चूक की िानकारी के प्रमाणन की

3 जस्ट्थजत नीचे िी गई सारणी में उपिर्िडत रूप में अजभजलजखत करेगीः सारणी िम सं. ऋणी का प्रत्युत्तर जस्ट्थजत िारी दकए िाने वाले अजभलेख की प्रकृजत (1) (2) (3) (4) 1 (क) ऋणी चूक की सूचना की पुजष्ट करता िै
या ऋणी तीन अनुस्ट्मारकों के पश्चात् भी कोई प्रत्युत्तर निीं िेता िै प्रमाजणत चूक का अजभलेख 2 ऋणी चूक की सूचना को जववादित करता िै जववादित जववाि की सूचना

परन्तु संजिता की धारा 3 के खंड (14) में यथा-पटरभाजित जवत्तीय संस्ट्था की ििा में, िब कोई ऋणी चूक की रकम के एक भाग को जववादित करता िै या ऐसा जववाि कोई गैर-जवत्तीय िानकारी की बाबत िै तब इनफॉरमेिन यूटिजलिी अजववादित चूक रकम की बाबत प्रमाणन की जस्ट्थजत को ‘प्रमाजणत’ के रूप में लेखबद्ध करेगा ।” (iii) उप-जवजनयम (4) में,
(क) “यथाजस्ट्थजत, सारणी 1 या सारणी 2 के स्ट्तंभ (4) में यथा-उपिर्िडत सुसंगत रंग को” िब्िों का लोप दकया िाएगा;
(ख) “अनुसूची के प्ररूप घ में चूक का अजभलेख” िब्िों के स्ट्थान पर “ऊपर सारणी के स्ट्तंभ (4) में यथा-उपिर्िडत चूक का अजभलेख या जववाि की सूचना, ऐसे प्ररूप में, िैसा बोडड द्वारा पटरपत्र के माध्यम से अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । 8.

(ii) उप-जवजनयम (1) में “अनुसूची के प्ररूप घ में” िब्िों के स्ट्थान पर “ऐसे प्ररूप में, िो बोडड द्वारा पटरपत्र के माध्यम से अजधसूजचत दकया िाए” िब्ि रखे िाएंगे ।

उप-जवजनयम (3) में, (क) “भारतीय टरिवड बैंक अजधजनयम, 1934 की िूसरी अनुसूची में सजममजलत बैंक” िब्िों के स्ट्थान पर “संजिता की धारा 3 के खंड (14) में यथा-पटरभाजित जवत्तीय संस्ट्थाएं” िब्ि रखे िाएंगे ।
(ख) “ ‘जववादित’ रूप में प्रमाणन की प्राजस्ट्थजत वाली चूक का अजभलेख” िब्िों के स्ट्थान पर “जववाि की सूचना” िब्ि रखे िाएंगे । 9. मूल जवजनयमों के जवजनयम 27 के उप-जवजनयम (1) में “अनुसूची के प्ररूप ग में” िब्िों के स्ट्थान पर “ऐसे प्ररूप में, िो बोडड द्वारा पटरपत्र के माध्यम से अजधसूजचत दकया िाए” िब्ि रखे िाएंगे । 10. मूल जवजनयमों में, जवजनयम 42 के पश्चात् “अनुसूची” का लोप दकया िाएगा । रजव जमत्तल, अध्यक्ष [जवज्ञापन-III/4/असा./135/2026-27] टिप्पण: भारतीय दिवाला और िोधन अक्षमता बोडड (इनफॉरमेिन यूटिजलिी) जवजनयम, 2017, भारत के रािपत्र, असाधारण, भाग 3, खंड 4, सं. 129 में तारीख 31 माचड, 2017 को अजधसूचना सं. आई.बी.बी.आई./2016- 17/िी.एन./आर.ई.िी.009, तारीख 31 माचड, 2017 द्वारा प्रकाजित दकए गए थे और उनमें अंजतम संिोधन भारत के रािपत्र, असाधारण, भाग 3, खंड 4, सं. 616 में तारीख 13 अगस्ट्त, 2024 को अजधसूचना सं.

F. No. IBBI/2026-27/GN/REG146.— In exercise of the powers conferred by sections 196, 210, 213, 214, 215 read with section 240 of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), the Insolvency and Bankruptcy Board of India hereby makes the following regulations further to amend the Insolvency and Bankruptcy Board of India (Information Utilities) Regulations, 2017, namely:-

1. (1) These regulations may be called the Insolvency and Bankruptcy Board of India (Information Utilities) (Amendment) Regulations, 2026. (2) They shall come into force on the date of their publication in the Official Gazette.

In the Insolvency and Bankruptcy Board of India (Information Utilities) Regulations, 2017, (hereinafter referred to as ‘the principal regulations’), in regulation 2, (i) in sub-regulation (1)- (a) in clause (la), for the words “Form D of the Schedule”, the words “such format as notified by the Board through circular” shall be substituted. (b) after clause (la), the following clause shall be inserted, namely:-

“(lb) “Information of dispute” means the status of authentication of default issued in such format as notified by the Board through circular;”
(c) clause (p) shall be omitted. (ii) after sub-regulation (2), the following explanation shall be inserted, namely:- “Explanation: For the purpose of these regulations, unless the context otherwise requires, reference to the term ‘debtor’ shall include ‘corporate debtor’.” 3. In the principal regulations, in regulation 4,
(a) in sub-regulation (1), for the words “Form A of the Schedule”, the words “such format as notified by the Board through circular” shall be substituted. In the principal regulations, in regulation 21,
(i) in sub-regulation (2), in clause (c), in sub-clause (iii), - (a) for the words “Form C of the Schedule”, the words “such format as notified by the Board through circular” shall be substituted. (b) for item (A), the following shall be substituted, namely:—

5 “(A) by a financial creditor, which is a financial institution as defined in clause (14) of section 3 of the Code;” (ii) for sub-regulation (3) the following shall be substituted, namely:— “(3) On completion of the process under sub-regulation (2), the information utility shall record the status of authentication of information of default as indicated in the table below:

In the principal regulations, in regulation 27, in sub-regulation (1) for the words “Form C of the Schedule”, the words “such format as notified by the Board through circular” shall be substituted. 10. In the principal regulations, “SCHEDULE” after regulation 42 shall be omitted.
