• SUB: Drawback liquidation drive by Custom from 15th September, 2016 to 31st October, 2016 _

• 1. It is brought to the notice of all Exporter, Customs House Agents and the trade that a number of drawback claims are pending at ICD Mulund, Mumbai due to the reason that necessary information required ue finalize the claim has been furnished by the exporters and their claims are considered deficient on account of such information required from them. It is observed that claims are pending for one reason or more reason as follows:; (i) In case of the brand rates claims “ Brand rate” fixation letters have not been received from the jurisdictional Central Excise Authorities;

• (ii) | Replies have not been filed to the queries raised to exporters; (iii) Test reports of the sample drawn at the time export have not been produced;

• (iv) EGM has not been filed or error has occurred in the Export General Manifest (FGM) filed by the shipping lines.

• 2. In case of online processing of drawback claims, there is no inbuilt mechanism in the EDI system to inform the exporters individually regarding the deficiencies in their drawback claims . However, touch screen facility (Information kiosks) have been installed at the ICDMulund and exporter can check status of their claims at these counters. Status of the drawback claims can also be ascertained from the NIC Service Centre/ICEGATE/ Drawback section at ICD -Mulund. The exportersare advised to check the status of their claims and pursue the queries raised and the produce the documents demanded to that their claims can be processed.
• 3. In case of the Brand Rate pendency, the exporters are advised to contact the concerned Central Excise Authority before whom their application for fixation of Brand Rate of Drawback is pending and request them to decide the Brand Rate quickly. The exporters whose Brand Rate applications have been rejected by the concerned Central Excise Authority are requested to inform the Drawback section at ICD Mulund, Mumbai accordingly. If no reply is received within 1 month, it will be presumed that the brand rate application has been rejected by Central Excise Authority.
• 4. In some of the claims, EGM errorg is shown against the pending shipping bills. The responsibility of filing the correct EGM rests with the shipping lines/steamer Agents. The error in EGM filing occurs at times because the consolidators give wrong details to the shipping lines/steamer

• S. Where pendency is for want of the Test report, the concerned officials are directed to pursue cases with the Dy. CC laboratory or with the concerned laboratory, to get expedited the Test Reports for finalization of claims.

6. To facilitate the drawback clearance, the Drawback Section at ICD Mulund is observing “Drawback Pendency Clearance Drive” from 15" September, 2016 to 31st October, 2016 Shri S. Veeramuthu, Dy. Commissioner has been nominated as the nodal officer for pendency liquidation drive. In case ef any information is required in respect of the pending drawback claims, the exporters are advised to contact the Nodal Officer Shri S. Veeramuthu, Dy. Commissioner in his office at ICD Mulund, Mumbai or contact him on phone 022-25635788, Fax 022-25639729. Exporters may mail their queries to email address icd_mulund@yahoo.com.
