Subject: Special Drive for reconciliation of BRC reg.

Attention of all the Exporters and Customs Brokers is invited to the subject mentioned above. 2 The scheme of duty drawback as incorporated in Chapter X of Customs Act 1962. Section 75 of the Customs Act 1962 read with Customs, Central Excise Duties and Service Tax Drawback Rules 2017, governs the scheme of drawback. As per rule 18 of the said rules, where the amount of drawback has been paid to an exporter but the sale proceeds in respect of such export goods have not been realized with in the time allowed under the Foreign Exchange Management Actt (FEMA), 1999 & Notification No. FEMA 23®2015/2015-RB dated January 12 ,2016(Foreign Exchange Management (Export of Goods & Services) Regulation, 2015 or as extended by the Reserve Bank of India (RBI) are to be recovered. 3 In this regard, an exercise was undertaken by Drawback Recovery Cell (DRC) of Export Commissionerate to ensure compliance and any outstanding recovery. A report was generated from ICES for the period of 01.04.2014 to 30.06.2020 and detailed scrutiny of the shipping bill wherein export proceeds (BRC) have not been realized was conducted between 12.02.2021 to 19.02.2021. 4. A total number of 31796 shipping bills were 4 Scrutinized corresponding to 488 IECs, out of which it was observed that 6804 shipping bills pertaining to 227 IECs were found as non-compliant. Individual letters were sent to the registered address of the Exporters, out of which 169 exporters have submitted their E-BRC or deposited the

outstanding drawback alongwith applicable interest. As on 21.06.2021, 58 Exporters (Annexure A) have not responded to the Demand Notice issued against them or have been found untraceable. Alerts have been inserted against these 58 Exporters in the ICES systems and necessary intimation was sent for submitting proof of receipt of forcign remittance on their registered address. However, no reply has been received from these exporters. 5. However, as a special measure and trade facilitation exercise and to resolve the matter, an opportunity is being given to the exporters to furnish E-BRC latest by 7th July, 2021.
