फा. सं. आई.बी.बी.आई./2025-26/िी.एन./आर.ई.िी.133.—भारतीय दिवाला और िोधन अक्षमता बोडड, दिवाला और िोधन अक्षमता संजिता, 2016 (2016 का 31) की धारा 240 के साथ पठित धारा 196 की उपधारा (1) के खंड (न) द्वारा प्रित्त िजियों का प्रयोग करते हुए, भारतीय दिवाला और िोधन अक्षमता बोडड (कारपोरेट व्यजियों के जलए दिवाला समाधान प्रदिया) जवजनयमन, 2016 का और संिोधन करने के जलए जनम्नजलजखत जवजनयमन बनाता िै, अथाडत्: - 1.
(1) इन जवजनयमों का संजक्षप्त नाम भारतीय दिवाला और िोधन अक्षमता बोडड (कारपोरेट व्यजियों के जलए दिवाला समाधान प्रदिया) (सातवां संिोधन) जवजनयम, 2025 िै ।
(2) ये रािपत्र में प्रकािन की तारीख को प्रवृत्त िोंगे ।

THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 2. भारतीय दिवाला और िोधन अक्षमता बोडड (कारपोरेट व्यजियों के जलए दिवाला समाधान प्रदिया) जवजनयमन, 2016 के जवजनयम 38 में, उप-जवजनयम (3) के पश्चात्, जनम्नजलजखत उप-जवजनयम अंतःस्ट्थाजपत दकया िाएगा, अथाडत्:- “(3क) प्रत्येक समाधान योिना में जनम्नजलजखत सजम्मजलत िोंगेः (क) फायिाग्रािी स्ट्वाजमत्व संबंधी एक जववरणी, ऐसे प्ररूप में, जिसे इस संबंध में बोडड द्वारा पठरपत्र के माध्यम से अजधसूजचत की िाने वाली तारीख से जनर्िडष्ट दकया िाएगा, जिसके अंतगडत ऐसे सभी नैसर्गडक व्यजियों के जववरण सजम्मजलत िोंगे, जिनका अंततोगत्वा समाधान आवेिक पर स्ट्वाजमत्व या जनयंत्रण िै, तथा प्रत्येक मध्यवती इकाई की िेयरधाठरता संरचना और अजधकाठरता सजित; और (ख) बोडड द्वारा जवजनर्िडष्ट प्ररूप में, इस बारे में एक िपथपत्र दक समाधान आवेिक धारा 32क के फायिे का पात्र िै/निीं िै।”

NOTIFICATION New Delhi, the 22nd December, 2025 Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons)
(Seventh Amendment) Regulations, 2025.

F. No. IBBI/2025-26/GN/REG133.— In exercise of the powers conferred by clause (t) of sub- section (1) of section 196 read with section 240 of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), the Insolvency and Bankruptcy Board of India hereby makes the following regulations to further amend the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) Regulations, 2016, namely:-

1. (1) These regulations may be called the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) (Seventh Amendment) Regulations, 2025. (2) They shall come into force on the date of their publication in the Official Gazette.

In the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) Regulations, 2016, in regulation 38, after sub-regulation (3), the following sub-regulation shall be inserted, namely:- “(3A) Every resolution plan shall include: (a) a statement of beneficial-ownership, in a format to be notified through circular by the Board, covering details of all natural persons who ultimately owns or controls the resolution applicant, together with the shareholding structure and jurisdiction of each intermediate entity; and (b) an affidavit, in a format specified by the Board, that the resolution applicant is eligible/not eligible for the benefit of section 32A.”
