(1) इन जवजनयमों का संजक्षप्त नाम भारतीय दिवाला और िोधन अक्षमता बोडड (कारपोरेट व्यजियों के जलए दिवाला समाधान प्रदिया) (तीसरा संिोधन) जवजनयम, 2025 िै ।
(2) ये 1 िून 2025 को प्रवृत्त िोंगे ।
2. भारतीय दिवाला और िोधन अक्षमता बोडड (कारपोरेट व्यजियों के जलए दिवाला समाधान प्रदिया) जवजनयमन, 2016 में, जवजनयम 40ख के स्ट्थान पर, जनम्नजलजखत जवजनयम रखा िाएगा, अथाडत्:-

“40ख. प्ररूपों का फाइल दकया िाना

(1) यथाजस्ट्थजत, अंतठरम समाधान व्यावसाजयक या समाधान व्यावसाजयक, नीचे िी गई सारणी में प्रत्येक प्ररूप के सामने अनुबंजधत समय-सीमा के अनुसार प्ररूपों के संलग्नकों सजित, बोडड के दकसी इलैक्ट्रॉजनक प्लेटफामड पर प्ररूप फाइल करेगा:-
प्ररूप समयावजध और पठरजध दकसके द्वारा फाइल दकया िाना िै समय-सीमा (1) (2) (3) (4) सी.पी.-1 सी.आई.आर.पी. के प्रारंभ से लेनिारों की सजमजत के गिन तक: इसके अंतगडत आई.आर.पी., सी.डी. और आवेिक के ब्यौरे, ए.ए.(न्यायजनणाडयक प्राजधकारी) द्वारा आवेिन का प्रजतग्रिण, सावडिजनक उद्घोषणा, प्राजधकृत प्रजतजनजधयों के ब्यौरे, सी.डी. के प्रबंधतंत्र का कायड-ग्रिण, िावों की प्राजप्त और सत्यापन, लेनिारों की सजमजत का गिन आदि आते िैं । आई.आर.पी. लेनिारों की सजमजत के गिन के संबंध में न्यायजनणाडयक प्राजधकारी को ठरपोटड फाइल करने के पश्चात्, आगामी मास के 10वें दिन या उससे पूवड सी.पी.-2 लेनिारों की सजमजत के गिन से आर.एफ.आर.पी. िारी दकए िाने तक: इसके अंतगडत आर.पी. के ब्यौरे, रजिस्ट्टीकृत मूल्यांकनकताडओं के ब्यौरे, आई.एम. में ब्यौरे, रूजच की अजभव्यजि, आर.एफ.आर.पी. और उसका उपांतरण, आदि भी िैं । आर.पी. आर.एफ.आर.पी.

र.पी. िारी दकए िाने तक: इसके अंतगडत आर.पी. के ब्यौरे, रजिस्ट्टीकृत मूल्यांकनकताडओं के ब्यौरे, आई.एम. में ब्यौरे, रूजच की अजभव्यजि, आर.एफ.आर.पी. और उसका उपांतरण, आदि भी िैं । आर.पी. आर.एफ.आर.पी. िारी दकए िाने के पश्चात् आगामी मास के 10वें दिन या उससे पूवड सी.पी.-3क न्यायजनणाडयक प्राजधकरण के समक्ष फाइल की गई समाधान योिना/समापन/ बन्ि करने संबंधी आवेिन के ब्यौरे: इसके अंतगडत समाधान आवेिकों के ब्यौरे, प्राप्त की गई समाधान योिनाओं के ब्यौरे, लेनिारों की सजमजत द्वारा समाधान योिनाओं को अनुमोदित या अस्ट्वीकार करने के ब्यौरे, समाधान योिना के अनुमोिन के जलए न्यायजनणाडयक प्राजधकारी के समक्ष फाइल दकए गए आवेिन के ब्यौरे, समापन कायडवािी आरंभ करने के ब्यौरे (यदि लागू िोता िै), आदि भी िैं आर.पी. न्यायजनणाडयक प्राजधकारी के समक्ष आवेिन फाइल करने के पश्चात् आगमी मास के 10वें दिन या उससे पूवड सी.पी.-3ख न्यायजनणाडयक प्राजधकरण द्वारा समाधान योिना/समापन/ बन्ि करने का अनुमोिन: इसके अंतगडत न्यायजनणाडयक प्राजधकारी द्वारा अनुमोदित समाधान योिना या समापन आिेि या बन्ि करने के आिेि के ब्यौरे, आदि भी िैं
आर. पी. न्यायजनणाडयक प्राजधकारी द्वारा आवेिन का जनपटारा करने के सात दिन के भीतर सी.पी.-4 न्यायजनणाडयक प्राजधकारी को ठरपोटड दकए गए पठरविडनीय संव्यविार: इसके अंतगडत पठरविडनीय संव्यविारों (अजधमानी, न्यून-मूल्यांदकत, अजतिय उधार, कपटपूणड) के ब्यौरे, अंतर्नडजित रकमें, न्यायजनणाडयक प्राजधकारी को ठरपोटड करने की तारीख, आवेिन पर न्यायजनणाडयक प्राजधकारी का आिेि (यदि कोई िै), आदि भी िैं आर.पी. न्यायजनणाडयक प्राजधकारी के समक्ष आवेिन फाइल करने या न्यायजनणाडयक प्राजधकारी द्वारा आवेिन का जनपाटारा दकए िाने के पश्चात् आगमी मास के 10वें दिन या उससे पूवड

3 सी.पी.-5 माजसकी: इसके अंतगडत सी.आई.आर.पी. की अद्यतन प्राजस्ट्थजत, लेनिारों की सजमजत की आयोजित बैिकों के ब्यौरे, मुकिमेबाजी की अद्यतन जस्ट्थजत, उपगत व्ययों के ब्यौरे, जवलंब के जलए कारण (यदि कोई िैं), आदि भी िैं आई.आर.पी./ आर.पी. जपछले मास के जलए प्रत्येक मास के 10वें दिन या उससे पूवड । (2) बोडड, उप-जवजनयम (1) में जनर्िडष्ट प्ररूप इलैक्ट्रॉजनक प्लेटफामड पर उपलब्ध कराएगा और उन्िें समय-समय पर उपांतठरत कर सकेगा । (3) यथाजस्ट्थजत, अंतठरम समाधान व्यावसाजयक या समाधान व्यावसाजयक यि सुजनजश्चत करेगा दक इस जवजनयम के अधीन फाइल दकए गए प्ररूप और उनके संलग्नक सिी और पूणड िैं । (4) इस जवजनयम के अधीन, दकसी प्ररूप को, चािे सुधार, अद्यतन करने या अन्यथा, प्रस्ट्तुत दकए िाने की जनयत तारीख के पश्चात् फाइल करने पर, बोडड द्वारा इस संबंध में पठरपत्र के माध्यम से अजधसूजचत की िाने वाली तारीख से, जवलंब के प्रत्येक कलैंडर मास के जलए प्रजत प्ररूप पांच सौ रुपए की फीस संलग्न की िाएगी । (5) यथाजस्ट्थजत, अंतठरम समाधान व्यावसाजयक या समाधान व्यावसाजयक, ऐसी दकसी कारडवाई के जलए िायी िोगा िो बोडड संजिता या उसके अधीन बनाए गए दकसी जवजनयम के अधीन उजचत समझे, कर सकेगा जिसके अंतगडत –

(i) अपेजक्षत िानकारी और अजभलेख सजित प्ररूप फाइल करने में असफल रिने,

(ii) दकसी प्ररूप में या उसके साथ फाइल की गई गलत या अपूणड िानकारी या अजभलेख,

(iii) प्ररूप फाइल करने में जवलंब,

के अंतगडत –

(i) अपेजक्षत िानकारी और अजभलेख सजित प्ररूप फाइल करने में असफल रिने,

(ii) दकसी प्ररूप में या उसके साथ फाइल की गई गलत या अपूणड िानकारी या अजभलेख,

(iii) प्ररूप फाइल करने में जवलंब, के कारण असाइनमेंट के जलए प्राजधकार-पत्र िारी करने या उसका नवीकरण करने से इनकार करना भी िै ।”

NOTIFICATION New Delhi, the 19th May, 2025 Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) (Third Amendment) Regulations, 2025. No. IBBI/2025-26/GN/REG126.— In exercise of the powers conferred by clause (t) of sub- section (1) of section 196 read with section 240 of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), the Insolvency and Bankruptcy Board of India hereby makes the following regulations to further amend the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) Regulations, 2016, namely:-

1. (1) These regulations may be called the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) (Third Amendment) Regulations, 2025. (2) They shall come into force on 1st June, 2025.
2. In the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) Regulations, 2016, for regulation 40B, the following regulation shall be substituted, namely: -

(1) The interim resolution professional or resolution professional, as the case may be, shall file the Forms, along with the enclosures thereto, on an electronic platform of the Board, as per the timelines stipulated against each form, in the table below:- Form Period covered and scope To be filed by Timeline (1) (2) (3) (4) CP-1 From commencement of CIRP till constitution of CoC: This includes details of IRP, CD, and the Applicant, admission of application by AA (Adjudicating Authority), public announcement, details of Authorised Representatives, taking over management of the CD, receipt and verification of claims, constitution of CoC, etc. IRP On or before the 10th day of the subsequent month, after filing the report on constitution of CoC to AA CP-2 From constitution of CoC till issue of RFRP: This includes details of RP, details of registered valuers, details in IM, expression of interest, RFRP and modification thereof, etc.

oC to AA CP-2 From constitution of CoC till issue of RFRP: This includes details of RP, details of registered valuers, details in IM, expression of interest, RFRP and modification thereof, etc. RP On or before the 10th day of the subsequent month, after issuance of RFRP CP-3A Details of resolution plan / liquidation / closure application filed with AA: This includes details of the resolution applicants, details of approval or rejection of resolution plans by CoC, details of application filed with AA for approval of resolution plan, details of initiation of liquidation (if applicable), etc. RP On or before the 10th day of the subsequent month, after filing application with AA CP-3B Approval of resolution plan / liquidation / closure by AA: This includes details of the resolution plan approved by the AA or liquidation order or closure order, etc. RP Within 7 days of disposal of application by AA CP-4 Avoidance transactions reported to AA: This includes details of the avoidance transactions (preferential, undervalued, extortionate credit, fraudulent), underlying amounts, date of reporting to AA, order of AA on the application (if any), etc. RP On or before the 10th day of the subsequent month, after filing of application(s) with AA or disposal of application(s) by AA CP-5 Monthly: This includes updates on the status of CIRP, details of CoC meetings held, updates on litigations, details of expenses incurred, reasons for delay (if any), etc. IRP/RP On or before the 10th of every month for the preceding month.

(2) The Board shall make available the Forms referred in sub-regulation (1) on the electronic platform and may modify them from time to time. (3) The interim resolution professional or resolution professional, as the case may be, shall ensure that the Forms and its enclosures filed under this regulation are accurate and complete. (4) The filing of a Form under this regulation after the due date of submission, whether by correction, updation or otherwise, shall be accompanied by a fee of five hundred rupees per Form for each calendar month of delay from a date to be notified through circular by the Board in this regard. (5) The interim resolution professional or resolution professional, as the case may be, shall be liable to any action which the Board may take as deemed fit under the Code or any regulation made thereunder, including refusal to issue or renew Authorisation for Assignment, for-

5 (i) failure to file a Form along with requisite information and records; (ii) inaccurate or incomplete information or records filed in or along with a Form;
