PART III—Section 4 प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY भारतीय दिवाला और िोधन अक्षमता बोडड अजधसूचना नई दिल्ली, 28 िनवरी, 2025 भारतीय दिवाला और िोधन अक्षमता बोडड (स्ट्वैजछिक समापन प्रदिया) (संिोधन) जवजनयम, 2025 फा. सं. आई.बी.बी.आई./2024-25/िी.एन./आर.ई.िी.120.—भारतीय दिवाला और िोधन अक्षमता बोडड, दिवाला और िोधन अक्षमता संजिता, 2016 (2016 का 31) की धारा 240 के साथ पठित धारा 196 की उपधारा (1) के खंड (न) द्वारा प्रित्त िजियों का प्रयोग करते हुए, भारतीय दिवाला और िोधन अक्षमता बोडड (स्ट्वैजछिक समापन प्रदिया) जवजनयम, 2017 का और संिोधन करने के जलए जनम्नजलजखत जवजनयम बनाता िै, अथाडत्: - 1.
(1) इन जवजनयमों का संजक्षप्त नाम भारतीय दिवाला और िोधन अक्षमता बोडड (स्ट्वैजछिक समापन प्रदिया) (संिोधन) जवजनयम, 2025 िै ।
(2) ये रािपत्र में उनके प्रकािन की तारीख को प्रवृत्त िोंगे । 2. भारतीय दिवाला और िोधन अक्षमता बोडड (स्ट्वैजछिक समापन प्रदिया) जवजनयम, 2017 (जिन्िें इसमें इसके पश्चात् “मूल जवजनयम” किा गया िै) के जवजनयम 33 का लोप दकया िाएगा । 3. मूल जवजनयमों के जवजनयम 39 में, उप-जवजनयम (1) के स्ट्थान पर जनम्नजलजखत उप-जवजनयम रखा िाएगा, अथाडत्:- सं. 81] नई दिल्ली, बुधवार, िनवरी 29, 2025/माघ 9, 1946

THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] “(1) बोडड दकसी अनुसूजचत बैंक के पास एक खाता रखेगा और उसका प्रचालन करेगा जिसे कारपोरेट स्ट्वैजछिक समापन खाता किा िाएगा ।” 4. मूल जवजनयम में, जवजनयम 41 के पश्चात्, जनम्नजलजखत जवजनयम अंतःस्ट्थाजपत दकया िाएगा, अथाडत्:-

“41क. प्ररूपों का फाइल दकया िाना (1) पठरसमापक, नीचे िी गई सारणी में प्रत्येक प्ररूप के सामने अनुबंजधत समय-सीमा के अनुसार, प्ररूपों के संलग्नकों सजित, बोडड के दकसी इलैक्ट्रॉजनक प्लेटफामड पर प्ररूप फाइल करेगा:—
सारणी प्ररूप सं. समयावजध और पठरजध समय-सीमा (1) (2) (3) वी.एल.1 इसके अंतगडत कारपोरेट व्यजि के ब्यौरे, स्ट्वैजछिक समापन प्रदिया के ब्यौरे आदि आते िैं । लोक उद्घोषणा के पश्चात् िूसरे मास के 10वें दिन या उससे पूवड । वी.एल.2 प्रदिया में हुए जवलंब के कारणों सजित अंििाजययों की बैिकों के ब्यौरे, पठरसमापक के प्रजतस्ट्थापन के ब्यौरे(यदि कोई िैं), आदि । अंििाजययों की बैिक या पठरसमापक के प्रजतस्ट्थापन के पश्चात्, आगामी मास के 10वें दिन या उससे पूवड । वी.एल.3 जवघटन आवेिन के ब्यौरे, अिावाकृत आगमों के ब्यौरे, जितधारकों से की गई वसूली और उन्िें दकए गए जवतरण के ब्यौरे, लंजबत मुकिमेबाजी, कपट या दिवाजलया िोने का पता लगने(यदि कोई िैं) के ब्यौरे न्यायजनणाडयक प्राजधकारी को कारपोरेट व्यजि का जवघटन आवेिन या स्ट्वैजछिक समापन प्रदिया के जलए प्रत्यािरण/ जनलंबन आवेिन प्रस्ट्तुत करने के पश्चात्, आगामी मास के 10वें दिन या उससे पूवड ।
वी.एल.4 जवघटन के आिेि के ब्यौरे: इसके अंतगडत आगमों,

का जवघटन आवेिन या स्ट्वैजछिक समापन प्रदिया के जलए प्रत्यािरण/ जनलंबन आवेिन प्रस्ट्तुत करने के पश्चात्, आगामी मास के 10वें दिन या उससे पूवड ।
वी.एल.4 जवघटन के आिेि के ब्यौरे: इसके अंतगडत आगमों, प्राजप्तयों और संिायों के जवतरण के ब्यौरे, आदि आते
िैं ।
कारपोरेट व्यजि के जवघटन के जलए या स्ट्वैजछिक समापन प्रदिया के प्रत्यािरण/जनलंबन के जलए आिेि पाठरत दकए िाने के 14वें दिन या उससे पूवड । (2) पठरसमापक यि सुजनजश्चत करेगा दक इस जवजनयम के अधीन फाइल दकए गए प्ररूप और उनके संलग्नक सिी और
पूणड िैं । (3) इस जवजनयम के अधीन, दकसी प्ररूप को, चािे सुधार, अद्यतन करने या अन्यथा, प्रस्ट्तुत दकए िाने की जनयत तारीख के पश्चात् फाइल करने पर, बोडड द्वारा यथा-अजधसूजचत तारीख के पश्चात्, जवलंब के प्रत्येक कलैंडर मास के जलए प्रजत प्ररूप पांच सौ रुपए की फीस संलग्न की िाएगी । (4) पठरसमापक, ऐसी दकसी कारडवाई के जलए िायी िोगा िो बोडड संजिता या उसके अधीन बनाए गए दकसी जवजनयम के अधीन उजचत समझे, कर सकेगा जिसके अंतगडत – (i) अपेजक्षत िानकारी और अजभलेख सजित प्ररूप फाइल करने में असफल रिने, (ii) दकसी प्ररूप में या उसके साथ फाइल की गई गलत या अपूणड िानकारी या अजभलेख,

(iii) प्ररूप फाइल करने में जवलंब, के कारण असाइनमेंट के जलए प्राजधकार-पत्र िारी करने या उसका नवीकरण करने से इनकार करना भी िै ।”
5. मूल जवजनयमों की अनुसूची I के प्ररूप ि में, सारणी ख के स्ट्थान पर जनम्नजलजखत सारणी रखी िाएगी, अथाडत्:—

कारण असाइनमेंट के जलए प्राजधकार-पत्र िारी करने या उसका नवीकरण करने से इनकार करना भी िै ।”
5. मूल जवजनयमों की अनुसूची I के प्ररूप ि में, सारणी ख के स्ट्थान पर जनम्नजलजखत सारणी रखी िाएगी, अथाडत्:—

INSOLVENCY AND BANKRUPTCY BOARD OF INDIA NOTIFICATION New Delhi, the 28th January, 2025 Insolvency and Bankruptcy Board of India (Voluntary Liquidation Process) (Amendment) Regulations, 2025.

F. No. IBBI/2024-25/GN/REG120.—In exercise of the powers conferred by clause (t) of sub-section (1) of section 196 read with section 240 of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), the Insolvency and Bankruptcy Board of India hereby makes the following regulations to further amend the Insolvency and Bankruptcy Board of India (Voluntary Liquidation Process) Regulations, 2017, namely: - 1.(1) These Regulations may be called the Insolvency and Bankruptcy Board of India (Voluntary Liquidation Process) (Amendment) Regulations, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Insolvency and Bankruptcy Board of India (Voluntary Liquidation Process) Regulations, 2017 (hereinafter referred to as ‘the principal regulations’), regulation 33 shall be omitted. 3. In the principal regulations, in regulation 39, for sub-regulation (1), the following sub-regulation shall be substituted, namely:-

In the principal regulations, after regulation 41, the following regulation shall be inserted, namely: - “41A. Filing of Forms. (1) The liquidator shall file the Forms, along with the enclosures thereto, on an electronic platform of the Board, as per the timelines stipulated against each Form, in the table below: - TABLE Form No. Period Covered and Scope Timeline VL 1 This includes details of the corporate person, details of the voluntary liquidation process, etc. On or before the 10th day of the second month after the public announcement. VL 2 Details of the meetings of contributories with the reasons for delay in the process, details of replacement of liquidator (if any), etc. On or before the 10th day of the subsequent month, after the meeting of contributories or replacement of liquidator. VL 3 Details of dissolution application, details of unclaimed
proceeds, details of realisation and distribution made to stakeholders, details of pending litigations, detection of fraud or insolvency (if any), etc.

VL 4 Details of order for dissolution: This includes details of the distribution of proceeds, receipts and payments, etc. On or before the 14th day of passing of the order for dissolution of the corporate person, or withdrawal / suspension of the voluntary liquidation process. (2) The liquidator shall ensure that the Forms and its enclosures filed under this regulation are accurate and complete. (3) The filing of a Form under this regulation after the due date of submission, whether by correction, updation or otherwise, shall be accompanied by a fee of five hundred rupees per Form for each calendar month of delay after the date notified by the Board. (4) The liquidator shall be liable to any action which the Board may take as deemed fit under the Code or any regulation made thereunder, including refusal to issue or renew Authorisation for Assignment, for - (i) failure to file a Form along with requisite information and records; (ii) inaccurate or incomplete information or records filed in or along with a Form; (iii) delay in filing the Form.” 5.
