Sub :- Appointment of Nodal Officer for applying to licence under section 65 of the Customs Act, 1962 for manufacturing or other operations undertaken in Customs Bonded Warehouse

regarding.

Attention of all importers, exporters, bonders and all stake holders is invited to the Board Circular no 38/2018 Customs dated 18.10.2018 prescribing the manner of application and procedure to be followed under section 65 of the Customs Act, 1962, for manufacturing other operations in the bonded warehouse. The salient feature of the changes are :

1. A single and decentralised authority (jurisdictional commissioner of
   Customs) for granting approval to licence and other approvals.
2. No geographical limitations on where units can be setup.
3. Import of capital goods without payment of duty.
4. Resultant goods can be exported or cleared for domestic consumption. In case of exports no duties payable on imported inputs or on the exported goods (Zero rated).
5. Duty payment required only when the imported goods or the resultant goods are cleared to domestic tariff area (DTA).
6. No limit on export or domestic clearance.
7. No mandatory minimum NFE threshold or export obligation.
8. A single digitalized account has been prescribed for encouraging compliance and regulatory consistency.
