Sub: Suspicion of fraud in fishery products from India

Madam/ Sir,

This is to bring to your notice that EU has reported two cases of undeclared addition of water in frozen shrimps imported from India.

  • The summary of matter is as follows: - .

  • i. Two cases of undeclared addition of water in frozen shrimps imported from India.

  • ii. This product normally presents water content of 77.6 g/100 g, protein content of 19.6 g/100 g and thus a water/protein ratio of 4.0. However, analysis detected water content of 80.9 g/100 g, protein content of 18.39 g/100 g and water-protein ratio of 4.4. The label indicated shrimp content of 85% while only 81% was determined.

  • ili. The second lot of cooked peeled cocktail shrimps showed water content of 87.4 g/100 g, protein content of 11.54 g/100 g and water/protein ratio of 7.6. The label indicated shrimp content of 80% while 71.3% was measured.

  • iv. In both cases, the added water was neither indicated on the label within the name of the product nor in the list of ingredients, leading to an infringement to Regulation (EU) No 1169/20112. Article 7(1)(a) of that Regulation provides that food information must not be misleading, amongst others, as to the characteristics of the food including, as to its composition and quantity (EU Regulation 1169/2011 is attached for reference).

  • v. These breaches confer an economic advantage and are therefore suspected of fraud. The EC has asked the competent authorities of India to conduct unannounced investigations with verification of machinery sizing and product labelling.

  • EU has requested Indian Authorities to undertake appropriate measures to ensure that such situations do not arise again, and that India does not lose its reputation in the market. In this regard, all the field offices are requested to undertake appropriate measures to ensure such issues do not recur, and alert the trade to comply with the concerned EU regulation in the interest of trade.
