Cancellation of Registration- reg.

It has come to the notice that many registered entities including exporters and fishing vessels are not renewing their registration within the prescribed time. They are not even renewing it within the next due date of renewal ie; two years from the date of expiry of validity also. Instructions have been given to the registering offices earlier also that the cancellation of registration of the entities that has not renewed the registration should be initiated without any delay. However, many such entities are still holding registration under MPEDA as the concerned RD/SRD has not cancelled the registrations.

The cancellation of registration of an entity is presently done based on the request of the entity on voluntary basis or due to change in the jurisdiction of the office. The other option available in the online module is called de-registration which is resorted after issuing show cause notice as per MPEDA Rules.

This has been examined in detail and accordingly it has been decided to rename the options for cancellation of registration as
(A) "Cancellation on request" in cases of (i) voluntary basis or (ii) due to change in jurisdiction of RD and; (B) "Cancellation without request" in cases of non renewal, non export, violation of Act & Rule etc as per the provisions of MPEDA Act & Rules.

In case the owner of the entity is coming forward for re-registration of the entity which was cancelled due to non renewal of registration the RD/SRD may re-register the entity linking the old registration certificate and issue a new certificate of registration with the old number. All the registering authorities delegated with the power under MPEDA Act & Rules are directed to immediately take necessary actions for cancellation of those entities which have not renewed their registration within prescribed time.
