Please Note For information of exporters, Norms Committee - IV handles all cases pertaining to fixation/ratification of norms for Export Products falling under ITC (HS) Chapter 27, 28, 31 to 38, 44 to 49, 68 to 71 .Communications in respect of cases/pertaining to NC- IV may be sent to email address:
nc4.dgft@nic.in I. The Norms Committee has taken decision only with respect to technical aspect/wastage norms. While redeeming the applications, RAs should check that the applicant has fulfilled all requirements as prescribed in policy/procedure including those in Policy Circulars issued from time to time or any other provisions under FTP/HBP for EODC. II. Wherever the Committee has fixed Norms, the concerned RA may ensure that AA is issued on the wastages/consumption as ratified by the Committee or as per wastages claimed in the application, whichever is less. III. Meeting No. NC/4/MEET/Mar/202526/20 dated 27/03/2026 of Norms Committee - IV for the year 2025-26 was held on 27/03/2026 under the Chairmanship of Shri Rakesh Kumar,Additional DGFT to consider the following applications for ratification of norms in respect of advance authorizations under Duty Exemption Scheme (Chapter-4) of Foreign Trade Policy 2023. In this regard, comments were sought from RA Mumbai specifically on the request for “change of norms category” and compliance with the mandatory pre-import condition attached to the authorization. RA Mumbai, after examination of the export and import statements submitted by the firm, reported that exports had been effected prior to import of inputs, thereby violating the pre-import condition stipulated under the relevant provisions governing Advance Authorization issued under Para 4.07A of HBP. 8 The Committee further examined the technical data and wastage details furnished by the applicant and observed that: The norms had not been correctly claimed under the self-ratification scheme; • Excess benefits appeared to have been availed by the firm; and • The Chartered Engineer failed to exercise due diligence while certifying Appendix 4E in support of the wastage claimed. • Accordingly, considering the violations of the conditions of the authorization and the non-compliance with the provisions of FTP and HBP, the Committee decided to reject the application for fixation of norms.Further, the Committee recommended the following consequential actions: That a special audit shall be conducted by RA Mumbai, and the audit report, along with detailed findings, shall be forwarded to NC-4 for examination and further necessary action. • RA Mumbai shall also examine the role and conduct of the Chartered Accountant/Chartered Engineer in the matter and initiate appropriate action, wherever warranted, under the relevant provisions of the FTP/HBP, FTDR Act, 1992 and rules framed thereunder. • RA Mumbai may additionally undertake review of the applicant’s Status Holder Certificate and AEO status in accordance with the applicable provisions of FTP 2023, HBP 2023 and the relevant customs/AEO guidelines. • The case stands rejected.
