MINUTES OF THE 31st EXPERT COMMITTEE MEETING HELD UNDER THE CHAIRMANSHIP OF SHRI A. K. MEHTA, ADDITIONAL SECRETARY FOR THE DECLARATION OF ECO-SENSITIVE ZONE (ESZ) AROUND THE WILDLIFE SANCTUARIES/NATIONAL PARKS DURING 13-14 SEPTEMBER 2018 IN THE MINISTRY OF ENVIRONMENT, FOREST & CLIMATE CHANGE

The 31st Meeting of Expert Committee for Eco Sensitive Zone was held under the Chairmanship of Shri Arun Kumar Mehta, Additional Secretary during 13-14, September, 2018 in the Ministry of Environment, Forest & Climate Change, Indira Paryavaran Bhawan, New Delhi. List of participants is annexed.

Day 1: (13 September, 2018)

At the outset, the Chairman welcomed the Members and the participants from Assam, Arunachal Pradesh, Chhattisgarh, Jharkhand, Karnataka, Madhya Pradesh, Meghalaya and the expert members. After brief introduction of the participants Chairman invited states to present their proposals as per Agenda.

Following 14 proposals listed in the Agenda were considered for discussion on Day 1. The representatives of respective State Governments presented their ESZ proposals for consideration of the Expert Committee:

Discussion on the ESZ Proposals

ASSAM

4.1 Eco-sensitive Zone around Hollongapar Gibbon Sanctuary Shri M K Yadava, APCCF, Department of Forest, Assam apprised the Committee about the proposal. It has informed that the draft Notification was published on 7.5.2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows:

Area of PA : 20.98 sq. km Proposed ESZ area : 264.62 sq. km
Proposed Extent : Zero Km to 22.54 km

The Sanctuary is having heterogeneous landscapes which are an integral part of a critical elephant corridor along with Disai and Disai Valley reserved forests. The Sanctuary is home to a variety of flora, fauna and avifauna, and provides protection to rare and endangered species. The zero ESZ is due to the oil exploration sites at the Western site.

No comments were received from the stakeholders/public. After detailed discussions, the Committee recommended for the finalization of draft Notification.

4.2 Eco-sensitive Zone around Dibru Saikhowa National Park

Shri M K Yadava, APCCF, Department of Forest, Assam apprised the Committee about the proposal. It has informed that the draft Re-Notification was published on 21.05.2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows: Area of PA : 340 sq. km Proposed ESZ area : 658.251 sq. km
Proposed Extent : Zero Km to 8.7 km

The National Park is a unique geo-morphological structure created by the river Brahmaputra and its tributaries, and the water channels. The protected area is forming the transition zone of two major biodiversity hotspots.

During discussion, it was mentioned that NBWL has already approved 8 oil exploration sites in side PA but there is no Oil exploration site inside proposed ESZ.

However, Horizontal Boring outside PA is going on in some of the locations. It was also informed by the representative of Government of Assam that there is no oil spill inside the ESZ area. Comments received from the stakeholders/public were discussed. The Committee suggested providing the details about the Oil drilling sites around the National Park. Also, the Committee suggested that the ground water quality study on impact of horizontal drilling to be provided by the State Government After detailed discussions, the Committee deferred the proposal.

4.3 Eco-sensitive Zone around Borajan Padumoni Sanctuary
Shri M K Yadava, APCCF, Department of Forest, Assam apprised the Committee about the proposal. The draft Notification is yet to be published. It was mentioned that the sanctuary supports primate populations especially Hollock Gibbons and important primates like Slow Loris, Pig tailed Macaque, Assamese Macaque and other animals like shrew, Chinese Pangolin, Jackal, Leopard Cat, Leopard including about 83 species of Forest drilling birds. The sanctuary has the principal categories of fauna which inter alia include 24 species of mammals.

It was further elaborated that the Sanctuary has three distinct segments of forest patches Bherjan, Borajan and Padumoni situated in Tinsukia District and
three separate sanctuaries are notified by the State as one PA and proposed for zero ESZ. After detailed deliberation, state agreed to send revised proposal with separate ESZ for three sanctuaries as ESZ-1, ESZ-2 & ESZ-3.

ARUNACHAL PRADESH

4.4 Eco-sensitive Zone around Kamlang WLS

Shri Umesh Kumar, Government of Arunachal Pradesh apprised the Committee about the proposal. It has informed that the draft Notification was published on 21.05.2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows:

Area of PA : 783.0 sq. km Proposed ESZ area : 117.0 sq. km

       Proposed Extent 

: Zero Km to 5 km

The Sanctuary has varied flora and fauna including different tree species, mammals, species of reptiles, amphibians, aquatic species and 105 avifauna species. The sanctuary has various types of forest areas including tropical, temperate and Alpine forest.

No comments were received from the stakeholders/public. It is a tiger reserve. but it has not followed the NTCA guidelines to include the buffer in the ESZ. In south there is Namdhapa Tiger reserve.

The Committee discussed to make a common ESZ proposal but the state Government mentioned about the difficulties involved in notifying it. The Committee suggested to increase extent from Zero at the reserved forest site and to provide justification for the Zero extent from Namdapha Tiger Reserve. After detailed discussions, the Committee suggested to submit the revised proposal including reserve forest and giving proper justification on the ESZ extent. .

4.5 Eco-sensitive Zone around Mouling National Park

Shri. Umesh Kumar, Government of Arunachal Pradesh apprised the Committee about the proposal. It has informed that the draft Notification was published on 24.05.2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows: Area of PA : 483 sq. km Proposed ESZ area : 252 sq. km

       Proposed Extent 

: 0.5 Km to 5.6 km

The PA area covers a part of Eastern Himalayan Biodiversity Hotspot and form the western part of the Dihang-Dibang Biosphere Reserve. It has various types of forest areas including tropical and semi evergreen sub-tropical broad leaved forest and sub temperate broad leaved forest.

Comments received from the stakeholders/public were discussed in the meeting. After detailed discussions, the Committee recommended for the finalization of draft Notification. CHHATTISGARH 4.6 Eco-sensitive Zone around Achanakmar Tiger Reserve Shri. J.A.C.S Rao, APCCF (Wildlife), Government of Chhattisgarh apprised the Committee about the proposal. It was informed that the draft Notification was published on 16th April, 2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows: Area of PA : 914.017 sq. km Proposed ESZ area : 438.951 sq. km
Proposed Extent : 0 to 8.49 km

It was mentioned that the Achanakmar Wildlife Sanctuary is situated in the Lormi Tehsil of Mungeli district in the state of Chhattisgarh and the sanctuary is an important habitat for a variety of flora and fauna including mammals, birds, amphibians, reptiles, fish, varieties of butterflies and insects.

The sanctuary recorded various endangered and threatened species including Gudmar (Gymnema sylvestris) Hadjod (Cissus quadrangularis, Satpuda leopard gecko (Eublepharis hardwickii), Pangolin (Manis crassicaudata), Chausingha or Four horned antelope (Tetracerus quadricornis), Indian Wild Dog (Cuon alpines) etc. It has a strong potential for re-colonization of tigers and there are more than 20 tigers recorded from the sanctuary. On the justification of zero ESZ extent, the state informed that zero ESZ in North-West direction is due to adjoining interstate border of Madhya Pradesh and one small compartment in southern direction of the sanctuary is due to non- availability of forest/village land.
The Committee urged to extend the ESZ toward Boramdev forest reserve to which the state explained that this tiger reserve is already connected to Boramdev National Park and Kanha Tiger Reserve of Madhya Pradesh through a corridor.
No comments received from the stakeholders/public. The Committee asked the state to restrict number of members in the Monitoring Committee up to ten. After detailed deliberation, the Committee recommended the draft Notification for finalisation subject to submission of good quality maps with hatching of ESZ Area and change in monitoring Committee.

4.7. Eco-sensitive Zone around Kanger Valley National Park Shri. J A C S Rao, APCCF (Wildlife), Government of Chhattisgarh apprised the Committee about the proposal. The draft Notification was published on 16th April, 2018. The salient features of the draft Eco-sensitive Zone (ESZ) are as follows: Area of PA : 200 sq. km Proposed ESZ area : 166 sq. km

  Proposed Extent 

: 0 to 6.6 km
It was mentioned that Kanger Valley National Park is situated in Darbha Taluka/Tehsil of Bastar district in the state of Chhattisgarh. The protected area is known for the rich flora and fauna including mammals, birds, amphibians, reptiles, fishes, varieties of butterflies and insects. The famous Kutumsar Caves, having beautiful pillars of Stalactite and Column of Stalagmite, blind fishes in it having circadian rhythms, Dandak Caves, Tirthgarh waterfall are important abode of special kind of biodiversity.
Important endemic species recorded from the sanctuary are Indian Giant Squirrel (Ratufa indica), Malabar Whistling Thrush (Myiophonus horsfieldii), Rufous- tailed Lark (Ammomanes phoenicurus), Fungoid Frog (Hydrophylax malabaricus), Spotted Rock Gecko (Hemidactylus maculatus), Clouded Ground Gecko (Geckoella nebulosa), Green Pit Viper (Trimeresurus gramineus) etc. This national park is home of state bird-Common Hill Myna (Gracula religiosa). No comments were received from the stakeholders/public. It was mentioned that Zero extent towards south-eastern side is due to interstate boundary with Odisha. After detailed deliberation, the Committee recommended the draft

Notification for finalisation on submission of quality of map with hatching of ESZ area.

JHARKHAND

4.8 Eco-sensitive Zone around Udwa Lake Bird Sanctuary

Shri. Dileep Kumar Yadav, Government of Jharkhand apprised the Committee about the proposal. It has informed that the draft Notification was published on 08.02.2018.The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows: Area of PA : 783.0 sq. km Proposed ESZ area : 117.0 sq. km

       Proposed Extent 

: Zero Km to 5 km

The Sanctuary mainly comprises of two large water bodies namely Pataura Jheel and Barhel Jheel. Both the Pataura Jheel and Barhel Jheel are connected by the narrow canal with the river Ganges. The Udhwa lake is rich in algae phytoplankton and aquatic macrophytes. The lake serves as an ideal habitat for the survival, nesting and roosting. The sanctuary has an excellent blend of avifauna ranging from swamp, woodland, hillock as well as yearly migrants.

No comments were received from the stakeholders/public. State Government sought to exempt some of the activities from the draft Notification e.g. movement of vehicular traffic at night due to the presence of National highway passing through the protected area. It was discussed that inputs would be sought from WL Division of this Ministry. It was proposed that DFO Territorial to be included as member of the Monitoring Committee and Divisional Forest Officer-In charge of the PA to be Member Secretary of the Monitoring Committee. After detailed discussions, the Committee recommended the finalization of draft Notification with above said changes.

4.9 Eco-sensitive Zone around Palkot Sanctuary

Shri. Dileep Kumar Yadav, Government of Jharkhand apprised the Committee about the proposal. It has informed that the draft Notification was published on 21.02.2018.The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows: Area of PA : 183.18 sq. km Proposed ESZ area : 1287.16 sq. km
Proposed Extent : 350 m to 5 km

The Sanctuary has a wide range of biodiversity. It is located in Deccan Plateau province of Chhotanagpur Plateau (6D) Biogeographic zone. Some of the most endangered species like Leopard, mouse deer, python, pangolin, etc. are found in the PA. Protected Area intercepts rainfall and help recharge ground water

aquifers. The Protected Area is home to diverse types of forests-Northern Indian Moist Deciduous Forest, Moist & Dry Peninsular Sal Forest, Northern Dry Mixed Deciduous Forest, Aegle Forest.

No comments were received from the stakeholders/public. The Committee suggested to revise the village list. In final Notification 90 enclave also to be included. State Government sought to exempt some of the activities from the draft Notification e.g. movement of vehicular traffic at night due to the presence of National Highway passing through the protected area. It was discussed that inputs would be sought from WL Division of this Ministry. It was proposed that DFO territorial to be included as Member of the Monitoring Committee and Divisional Forest Officer-In charge of the PA to be Member Secretary of the Monitoring Committee. After detailed discussions, the Committee recommended the finalization of draft Notification with above said changes.

4.10 Eco-sensitive Zone around Gautam Buddha Sanctuary

Shri. Dileep Kumar Yadav, Government of Jharkhand apprised the Committee about the proposal. It has informed that the draft Notification was published on 21.02.2018.The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows:

Area of PA : 121.224 sq. km Proposed ESZ area : 327.59 sq. km
Proposed Extent : Zero km to 5 km

The Sanctuary has wide range of Biodiversity. There are more than 100 species of plants and 75 species of birds belonging to 44 families, 13 mammalian species belonging 10 families are found abundantly in the sanctuary area. The sanctuary is a hotspot of endangered Egyptian Vulture neophron percnopterus and home of migratory Asian Elephant (Elephus maximus) along with hyena, sloth bear, wild boar etc. The Protected Area lies in the catchments of Bukar river system and other perennial nalas.

No comments were received from the stakeholders/public. State Government sought to exempt some of the activities from the draft Notification e.g. movement of vehicular traffic at night due to the presence of National Highway passing through the Protected Area. It was discussed that inputs would be sought from WL Division of this Ministry. DFO territorial to be included as member of the Monitoring Committee and Divisional Forest Officer-In charge PA to be Member Secretary of the Monitoring Committee After detailed discussions, the Committee recommended the finalization of draft Notification with above said changes.

4.11 Eco-sensitive Zone around Lawalong Sanctuary

Shri. Dileep Kumar Yadav, DFO Wildlife Division Hazaribhag, Government of Jharkhand apprised the Committee about the proposal. It has informed that the draft

Notification was published on 21.02.2018.The salient features of the draft Eco- Sensitive Zone (ESZ) are as follows: Area of PA : 121.224 sq. km Proposed ESZ area : 327.59 sq. km
Proposed Extent : Zero km to 5 km

The sanctuary has unique floral and faunal biodiversity and a landscape which forms a natural laboratory of evolution with undisturbed natural biome with natural protective barriers. It support the gene pool of Citrus spp. specially the Citrus indica Tanaka and other related cultivars like C. latipes Tanaka, C. reticulate Blanco, C. aurantifolia Swingle, C. grandis Osbeck, C. Jambhiri Lushington and C. limon Burm. The Protected Area is hoome to Hoolock gibbon- the only ape found in India. It is also the catchment area of several streams

KARNATAKA

4.12 Report of Carrying capacity of Western Ghats region of Karnataka

    As per the Hon‟ble NGT order dated 15.02.2016, the Ministry of Environment, 

Forest and Climate Change re-constituted the Expert Committee to assess the Carrying Capacity of Western Ghats region of Karnataka under the Chairmanship of Director General, Indian council for Forestry Research and Education (ICFRE). To fulfil the requirements of the NGT this Ministry need to submit the report to the Hob‟ble NGT and the State Government of Karnataka.
The report prepared by the Expert Committee on carrying Capacity of Western Ghats region of Karnataka State was received by this Ministry on 25 July, 2018. It was circulated among the Members of the ESZ Expert Committee for inputs.
Dr. M. D. Subharh Chandara, Consultant apprised the Committee about the report and made an elaborate presentation on the findings and recommendations. The Committee appreciated the efforts put by the experts and the work done by the team. During discussion it was mentioned that out of 11 experts in the Committee five (5) of them are from the Departments of the state Government of Karnataka. The representative of Government of Karnataka mentioned that another round of discussion on the different issues included in the report would be required. Based on

elaborate discussion it was decided to consider it in the next ESZ Expert Committee meeting in the Ministry.

MADHYA PRADESH 4.13 Eco-sensitive Zone around Priyadarsini Pench National Park

Shri. Vikram Singh Panhar, Government of Madhya Pradesh apprised the Committee about the proposal. It has informed that the draft Notification was published on 21.05.2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows: Area of PA : 1179.63 sq. km Proposed ESZ area : 1180.63 sq. km
Proposed Extent : Zero km to 27 km

The Pench Tiger Reserve has its importance in the natural history of central India.The reserve has wide variety of flora and fauna. The wetlands of Pench Tiger Reserve are of great significance in the context of conservation of avian fauna, as it not only provides suitable habitat for the residential birds; but also provide wintering grounds for many waterfowls. Representative of Government of M.P informed that the ESZ area 1180.63 sq.km was wrongly written in draft Notification.

Comments received from the stakeholders/public were discussed. The Committee suggested to submit core and buffer area separately and update the ESZ area along with the list of villages present in the ESZ Area. State Government sought to exempt some of the activities from the draft Notification e.g. movement of vehicular traffic at night due to the presence of National Highway /Sate High way passing through the Protected Area.

After detailed discussions, the Committee recommended for the finalization of draft Notification subject to submission of core and buffer area separately and updating the ESZ area along with the list of villages present in the ESZ Area along with a revised map.

MEGHALAYA

4.14 Eco-sensitive Zone around Nokrek National Park

Shri. H. C. Chaudhry, Government of Meghalaya apprised the Committee about the proposal. It has informed that the draft Notification was published on 07.05.2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows:

Area of PA : 47.48 sq. km Proposed ESZ area : 271.48 sq. km
Proposed Extent : 2.0 km to 8.0 km

Representative of the State Government mentioned that there are anomalies in the proposal and state Government is working on it. A fresh proposal would be submitted to this Ministry for republication and the process may take about 6 months. Accordingly, sought deferment of the proposal.
5. Based on the draft Notifications, comments received from stakeholder/public, presentations made on the proposals and detailed discussions on each proposal the Expert Committee took the following decisions:

During the discussion, it was emphasized that (i) good quality Maps to be provided showing the ESZ area with proper hatching (ii) the Monitoring Committee should not have more than ten Members and representative of MOEF &CC in the Monitoring Committee may be omitted.

Discussion on the ESZ Proposals

ODISHA

8.1. Eco-sensitive Zone around Badrama and Khalasuni Wildlife Sanctuary

Shr. Sanath Kumar, DFO Banva (WL-Division), Government of Odisha apprised the Committee about the proposal. The draft Notification was published on 11th May 2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows: Area of PA : 304 & 116 sq. km
Proposed ESZ area : 1413.96 sq. km

       Proposed Extent 

: 7 Km to 11 Km

It was mentioned that the Badrama Wildlife Sanctuary is located in Sambalpur and Deogarh Districts while Khalasuni Wildlife Sanctuary in Sambalpur District of Odisha. The sanctuaries are the important sites in Odisha for in-situ conservation of wildlife species like Leopard, Sloth Bear, Sambar deer, Spotted Deer, Wild Dog, Indian Pangolin, Langur, Giant Squirrel, Bison, Flying Squirrel, Mouse Deer. It also offers large tract of carrying capacity for the survival of Asian Elephants. Comments/objections and suggestions received from persons and stakeholders in response to the draft Notification were duly considered. On the comments of Wild Orissa regarding Elephant Corridor, State representative mentioned that the corridor cannot be prepared at this stage due to heavy biotic pressure and non-availability of suitable forest area for the formation of corridors outside the protected area. The state representative informed that public consultation was held with 330 villages situated in ESZ area. It has also mentioned that one kilo meter in para 4 of the draft notification need to be corrected After detailed deliberation, the Committee recommended the draft Notification for finalisation subject to submission of detailed boundary description, scientific name of flora and Fauna and improved quality of maps demarcating ESZ area with hatching.

RAJASTHAN

8.2. Eco-sensitive Zone around Bandh Baretha Wildlife Sanctuary

Shri. K. C. Meena, CCF (Wildlife), Forest Dept. of Rajasthan apprised the Committee about the proposal. The draft re-Notification was published on 31st May 2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows:

      Area of PA 

: 204.16 sq. km Proposed ESZ area : 173.92 sq. km
Proposed Extent : 0.025 km to 1 km It was mentioned that the Bandh Baretha Wildlife Sanctuary is located about 45 kilometres from Bharatpur, 76 kilometres from Fatehpur Sikri in Bharatpur District Rajasthan. The sanctuary has varied habitat with diversified fauna and flora which include Indian Wild Boar Caracal, Jungle Cat, Spotted Deer, Indian Fox, Blue Bull/Nilgai, Indian Hare, Hedge Hog Jackal, etc. While, Striped Hyena, Indian Pangolin were the endangered and near threatened species of the sanctuary etc. The Members of the Expert Committee discussed to include wetlands situated toward southern side of the sanctuary in ESZ area. The MoEF & CC informed the Committee that wetland conservation issue has already been addressed under the provisions of Wetland Notification. The Committee also enquired about the reason for keeping lower limit of ESZ at 25 meters and discussed to reveal if there is any court case regarding mining in the area is pending in Court. The state Government representative could not elaborate on the Court case during the meeting. Comments/objections and suggestions received from persons and stakeholders in response to the draft Notification were duly considered. Further the

Committee advised the state to reduce the number of Members in Monitoring Committee and submit good quality maps showing ESZ area with hatching and submitting detailed list of species with biodiversity values. After detailed deliberation, the Committee recommended for finalization of the proposal subject to submission of the status of court case and revision of the Monitoring Committee.

TAMILNADU

8.3 Eco-sensitive Zone around Chitrangudi Bird Sanctuary Shri. Sanjay K Srivastava, Government of Tamil Nadu apprised the Committee about the proposal. It has informed that the draft Notification was published on 24.05.2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows:

Area of PA : 0.4763 sq. Km
Proposed ESZ area : 4.7972 sq. km
Proposed Extent : 0.08 Km to 1.88 km

      The sanctuary is a biggest resident for variety of floral and faunal diversity and 

has species richness of nearly threatened species such as Pelican, Painted stork, Eurasian Spoon bill, White ibis etc.

Comments received from the stakeholders/public were discussed. After detailed deliberation, the Committee recommended for the finalization of draft Notification subject to revision of the Monitoring Committee as per the Draft Notification and submission of improved maps showing ESZ area with hatching.

8.4 Eco-sensitive Zone around Karaivetti Bird Sanctuary

Shri Sanjay K Srivastava, Government of Tamil Nadu apprised the Committee about the proposal. It has informed that the draft Notification was published on 24.05.2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows:

Area of PA : 4.53715 sq. km Proposed ESZ area : 5.519 sq. km

       Proposed Extent 

: 0.105 Km to 0.891 km

The sanctuary is basically an irrigation tank. It is one of the most important fresh water feeding ground for migratory water birds. The sanctuary has good diversity of flora and fauna. Some examples are Open billed stork, White Ibis, Black Ibis, Darter, Spot billed pelican, Cormoran, Grey Pelican, Little egret, Grey heron, Indian Palm Squirrel, Indian Grey Mongoose etc.

8.5 Eco-sensitive Zone around Udhayamarthandapuram Birds sanctuary

Shri Sanjay K Srivastava, Government of Tamil Nadu apprised the Committee about the proposal. It has informed that the draft Notification was published on 19.06.2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows:

Area of PA : 0.453 sq. km Proposed ESZ area : 2.213 sq. km

       Proposed Extent 

: 0.50 Km (uniform)

The sanctuary is basically an irrigation tank that is used for storing water for agriculture. It is an important roosting site for local migrants and resident water bird. The sanctuary is also a feeding and wintering ground for long distant migrant water birds such as ducks and waders. It supports the largest congregation of open billed Stork (> 5,000) & oriental Ibis and support natural fertilizer (guano) for the paddy fields and development of community based ecotourism in the area

No comments were received from the stakeholders/public. After detailed discussions, the Committee recommended the finalization of draft Notification subject to subject to revision of the Monitoring Committee as per the Draft Notification and submission of improved maps showing ESZ area with hatching.

8.6 Eco-sensitive Zone around Koonthankulam Bird Sanctuary

Shri Sanjay K Srivastava, Government of Tamil Nadu apprised the Committee about the proposal. It has informed that the draft Notification was published on 18.06.2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows: Area of PA : 1.2933 sq. km Proposed ESZ area : 9.74 sq. km

       Proposed Extent 

: 0.34 Km to 1.5 km

The Koonthankulam wetlands, being linked to the Manimuthar irrigation canal, receive regular water supply for cultivation of paddy by the local farmers. Many large water birds, especially the Painted Stork and Grey Pelicans have been annually nesting around Koonthankulam.Thesanctuary has good diversity of flora and fauna, the common floral species include Thuthi (Abutilon indicum (L.) Sweet), Kuruvel (Acacia nilotica (L.) Delile), Kuppaimeni Acalypha indica L.), Nayuruvi (Achyranthes aspera L.) etc. The sanctuary has many rare species which include Great Cormorant

(Phalacrocorax carbo), Purple Heron (Ardea cinerea), Comb Duck (Sarkidiornis melanotos), Northern Shoveller (Anas clypeata), and Common Teal etc.

Comments received from the stakeholders/public were discussed. After detailed deliberation, the Committee recommended for the finalization of draft Notification subject to submission of improved maps showing ESZ area with hatching.

TRIPURA 8.7 Eco-sensitive Zone around Gumuti Wildlife Sanctuary
Shri. Shailendra Singh, CCF & RC, Government of Tripura apprised the Committee about the proposal. It has informed that the draft Notification was published on 31.05.2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows: Area of PA : 389.54 sq. km Proposed ESZ area : 58.91 sq. km

       Proposed Extent 

: Zero km to 1.2 km

The Sanctuary has a wide range of biodiversity. Large varieties of the herbs, shrubs, climber and tree species found in the sanctuary have medicinal value. Major tree species, occurring in association, found in the sanctuary comprising of moist deciduous and semi evergreen forest. The sanctuary supports about 66 tree species, 74 herbs and shrub species, 30 species of climbers, 14 species of epiphytes, and 7 species of bamboo. the Sanctuary supports conservation and protection of 43 rare and endangered floral species including Artocarpus lakoocha (Deua chamal), Ailanthus exelsa (Jal tungi), Accacia nilotica (Babul), Alstonia scolaris (Chatim), Albizia stipulate (Seta sirish) etc.

No comments were received from the stakeholders/public. After detailed discussions, the Committee recommended for the finalization of draft Notification on submission of justification for 30 meters ESZ in the south and changing Ecology Expert in the Monitoring Committee from Tripura.

UTTAR PRADESH

8.8 Eco-sensitive Zone around Vijay Sagar Bird Sanctuary

Shri. S. K. Awasthi, CCF (WL), Government of Uttar Pradesh apprised the Committee about the proposal. The draft Notification was published on 16th April 2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows:

It was mentioned that the Vijay Sagar Bird Sanctuary is located in District Mahoba of Uttar Pradesh. The sanctuary is the home of 200 species of migratory birds. The sanctuary is an open habitat for important bird species including Red Crested Pochard, Brahmi duck, Whistling teal, Pintail, Comb duck, Goose, Painted stork, White ibis, Egret, Kingfisher etc. Other important fauna recorded from the sanctuary are Hyena (Hyaena hyaena), Indian fox (Vulpes bengalensis), Jackal (Canis aureus) and Neelgai (Boselaphus tragocamelus) etc.
No comments were received from the stakeholders/public. The Committee asked the state to remove the representative of MoEF &CC from the proposed monitoring Committee. After deliberation, the Committee recommended the draft Notification for finalisation. 8.9. Eco-sensitive Zone around National Chambal Sanctuary

Shri. S.K. Awasthi, CCF (WL), Government of Uttar Pradeshapprised the Committee about the proposal. The draft Notification was published on 16th April 2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows:

       Area of PA 

: 2073 sq. km Proposed ESZ area : 239.41 sq. km

       Proposed Extent 

: 1.0 km uniform

It was mentioned that the National Chambal Sanctuary is located Agra District of Uttar Pradesh. The Chambal River is one of the longest river with nearly 1800 km length and passes across 03 states viz, Rajasthan, MP & UP out of which 177 km long river falls under the National Chambal Sanctuary.
The sanctuary is important habitat of two species of crocodiles and 9 species of turtles which are critically endangered. Other major species found in the sanctuary are Gangetic dolphins, Skimmers, Nilgai, Wild boar, Porcupine, Black-naped hare, Indian fox, Golden Jackal, Hyena, Indian Wolf, Gharial etc. and around 380 bird species including Comb duck, Lesser whistling teal, Black-necked, Herons-Grey, Purple, Ergets-Large, Cormorants-Great, Indian Shag, Cattle, Darter, Sarus crane etc. There are more than 20 other Protected Areas scattered around the Chambal sanctuary. The Committee suggested the state to co-ordinate with other states for annual Meetings. The state representative informed that deliberations are underway with other states and suggestion will be considered after receiving a proposal from Madhya Pradesh. The experts also asked to include deep pools and ravines adjoining the sanctuary for better protection of unique species in the sanctuary.
The state illustrated that water pollution was not much severe within the sanctuary as compared to outside and the water bodies are being protected under Wetland rules. The Committee also asked the state to improve the quality of Notification by submission of scientific names, rectification in monitoring Committee and spelling mistakes found in the draft Notification.

No comments were received from the stakeholders/public. After detailed deliberation, the Committee recommended for finalisation of the draft Notification after taking into consideration of Madhya Pradesh‟s view on the Management Plan.

8.10. Eco-sensitive Zone around Soor Sarovar Bird Sanctuary

Shri. S.K. Awasthi, CCF (WL), Government of Uttar Pradeshapprised the Committee about the proposal. The draft Notification was published on 24th April 2018. The salient features of the draft Eco-sensitive Zone (ESZ) are as follows:

       Area of PA 

: 8.0 sq. km Proposed ESZ area : 18.17 sq. km
Proposed Extent : 1.0 km uniform It was mentioned that the Soor Sarovar Bird Sanctuary is located about 20 km from the District Head quarter Agra in District Agra of Uttar Pradesh. The sanctuary is also called as „ketham‟ lake.
The sanctuary has more than 180 bird species are recorded from the sanctuary. Comb duck, Spot billed duck, Lesser whistling teal, Storks-painted, Openbill, Black-necked, Herons Grey, Purple and Night, Ergets etc. are the major species found in the sanctuary. The protected area has also recorded large number of fauna including Hog Deer, Hyena, Spotted deer, Porcupine, Indian pangolin, Jackal, Wild Boar, Jungle Cat, Mongoose, Monkey, Nilgai etc.
No comments were received from the stakeholders/public. The Committee sought clarification on actual area of the sanctuary. The state representative informed that final area of bird sanctuary will be updated after confirmation. After detailed deliberation, the Committee deferred the proposal.

UTTAR KHAND

8.11 Eco-sensitive Zone around Rajaji National Park Shri Dhananjay, Government of Uttarakhand apprised the Committee about the proposal. It has informed that the draft Notification was published on 21.05.2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows: Area of PA : 1075.17sq. km Proposed ESZ area : 372.18 sq. km
Proposed Extent : Zero km to 10 km

The National Park is also rich in the diversity of fauna with nearly 23 species of mammals and 315 avifauna species of birds found in the National Park. The park is surrounded by big cities like Dehradun, Haridwar and Rishikesh and many small and medium human habitations, industrial areas and commercial establishments like group housing, ashrams, hotels and resorts all around. Rajaji National Park is surrounded by Dehradun Forest Division, Lansdowne Forest Division, Hardwar Forest Division, Narendra Nagar Forest Division and Shivalik Forest Division of Uttar

Pradesh. A number of wildlife corridors exist between Rajaji National Park and these forest divisions.

The representative of the state Government mentioned that the Eco sensitive Zone is extended from 1 km to 20 km in the districts of Haridwar and Pauri-Garhwal. The Committee suggested to provide justification for the extent from zero km to 20 km at some places and to provide revised ESZ area as per NTCA guidelines. Comments received from the stakeholders/public were discussed. Details of public consultation brief along with date were provided and mentioned that there are 21 enclosure villages inside the ESZ.

After detailed discussions, the Committee recommended the finalization of draft Notification subject to submission of justification for extending ESZ upto 20 Km, revising ESZ area as per NTCA guidelines and providing details of the enclosure villages.

8.12 Eco-sensitive Zone around Gangotri National Park

Shri Dhananjay Mohan, APCCF (WL), Government of Uttarakhand apprised the Committee about the proposal. It has informed that the draft Notification was published on 16.04.2018. The salient features of the draft Eco-Sensitive Zone (ESZ) are as follows: Area of PA : 2390.02 sq. km Proposed ESZ area : 1103.08 sq. km
Proposed Extent : Zero km to 10 km

The National Park is home to many endangered species of flora and fauna. Some of the endangered species found in the National Park are Musk Deer (Moschus sp.), Himalayan Thar (Hemitragus jemlahicus), Blue Sheep (Pseudois nayaur), Serow (Capricornis sp.), Snow Leopard (Panthera uncia), Himalayan Brown Bear (Ursus arctos isabellinus), Himalayan Black Bear (Ursus thibetanus laniger etc. The National Park is surrounded by northern temperate dry deciduous and coniferous forest which supports a large bio-diversity. The increasing human habitation, ongoing developmental projects, and mining activities around the National Park need to be controlled in view of long term wildlife conservation.

No comments were received from the stakeholders/public. The Committee suggested providing the justification of given ESZ area. The state Government has requested to shift “Establishment of major hydroelectric project” and Setting of saw mills from prohibited activity to regulated activity. Regarding establishment of hydropower project Committee mentioned that it is under the purview of the Ministry of Water Resources, River Development and Ganga Rejuvenation (MoWRD& GR). The Committee did not agree on the establishment of saw mills in the Eco-Sensitive zones.

Based on further deliberation, the Committee recommended for finalization of draft Notification incorporating a foot note “Establishment of major hydroelectric projects in ESZ area of Gangotri National Park would be as per recommendation of Ministry of Water Resources, River Development and Ganga Rejuvenation and due consideration”. After detailed discussions, the Committee recommended the finalization of draft Notification.

8.13 Draft Zonal Master Plan for Doon Valley Notification, Uttrarakhand

Shri A K Srivastava, VC, MDDA, Government of Uttarakhand apprised the Committee about the proposal. It has informed that the draft Notification was published on 01/02/1989 under Environment Protection Act 1986. There are three Authorities in the region (i) Doon Ghati Special Area Development Authority (SADA), (ii) Haridwar development Authority (HAD) and (iii) Mussorie Dehradun Development Authority (MDDA) looking after the Master plan. The salient features of the draft Master Plan of MDDA follow rrestrictions as per Notification and include the following:

I. Location of Industries II. Mining Operations III. Tourism- It should be as per Tourism Development Plan (TDP). IV. Grazing- As per the plan to be prepared by the State Government. V. Land Use- As per Master Plan of development and Land Use Plan of the entire area, to be prepared by the State Government and approved by the Union Ministry of Environment & Forests.

The state government representative also appraised the Legal status of Master Plan:

I. By order dated 15/06/2018 in PIL No. 97/2016 Shri S.C. Ghildiyal vs Uttarakhand State Hon‟ble High Court of Uttarakhand has set aside the Notification of Master Plan 2025 on the grounds of non-approval of Master Plan by Ministry of Environment & Forest in compliance with Notification 56 dated 01/02/1989.
II. SLP No. 15847/2018 is filed by Uttarakhand State in Hon‟ble Supreme Court. III. Above order has been stayed by the order of Hon‟ble Supreme Court dated 10/07/2018.
During discussion, it was mentioned that comments/inputs to be provided by the Town and Country Planning and other Members of the Committee. Also, the Committee suggested that Master Plan prepared by all three Authorities to be considered in the next ESZ Expert Committee meeting and the Uttarakhand Government was requested to send the remaining two Plans for the consideration of the Committee. The Committee deferred the proposal.

MAHARASHTRA

8.14 Zonal Master Plan of Matheran Eco-Sensitive Zone As per the recent court order High Court of Bombay, this Ministry supposed to approve the Master Plan of the Matheran Eco-sensitive zone within two months.The state Government informed that Matheran Eco-Sensitive Zone (MESZ) was notified on 4th February 2003.
The representatives of the state explained that the zone is a popular hill station and it is part of Mumbai Metropolitan Region (MMR). The total area of MESZ is 214.73 Sq Km. The state informed that the demarcation of the ESZ area was made on the basis of contiguous forest zone mentioned in the regional plan for MMR and the ZMP is prepared to restore the denuded area and management of watershed, soil, moisture, catchment areas etc. The following observations were made by the Ministry on the ZMP submitted by the State: i. The geo-coordinates on the map need to be incorporated for better demarcation on ESZ boundary;
ii. Land use map of 2003 along with the present land use map to be submitted;
iii. Details of man-made and natural Heritages sites found within the Matheran Eco-Sensitive Zone as identified by the Heritage Committee need to be included; iv. Copy of the tourism Master Plan along with the carrying capacity study to be submitted by the state to MoEF&CC. In addition, some of the Members mentioned that the copy of the ZMP was not received on time for providing inputs in this Meeting. After detailed deliberation, the Committee deferred the proposal and decided to hold another meeting for further discussion. The Committee asked the state to revise the ZMP based on above observations.
