अधिसूचना नई दिल्ली, 9 अगस्ट् त, 2024 का.आ. 3243(अ).—प्रारुप अजधसूचना भारत के रािपत्र, असाधारण, अजधसूचना संखर्ांक का.आ. 4893 (अ), तारीख 10 नवम्बर, 2023 द्वारा प्रकाजित की गई थी, जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करने वाली रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थे; और, उि प्रारूप अजधसूचना को अंतर्वाष्ट करने वाली रािपत्र की प्रजतर्ां िनता को तारीख 11 नवम्बर, 2023 को उपलब्ध करा िी गई थी; और, उि प्रारुप अजधसूचना के उत्तर में व्यजिर्ों और पणधाररर्ों से कोई आक्षेप और सुझाव प्राप्त नहीं हुए थे; और, कमलांग बाघ ररज़वा, 783 वगा दकलोमीटर क्षेत्रफल में फैला हुआ है और र्ह अरुणाचल प्रिेि के लोजहत जिले में जस्ट्थत है; सं. 3089] नई दिल्ली, िुक्रवार, अगस्ट् त 9, 2024/ श्रावण 18, 1946

और, नमिफा राष्ट्रीर् उद्यान और बाघ ररिवा 2230.245 वगा दकलोमीटर के क्षेत्रफल में फैला हुआ है, जिसमें से 1985.235 वगा दकलोमीटर कोर है और 245 वगा दकलोमीटर बफर िोन है, और र्ह भारत के उत्तर पूवी भाग में अरूणाचल प्रिेि के चांगलांग जिले में जस्ट्थत है।
और, कमलांग वन्र्िीव अभर्ारण्र् को अजधसूचना संखर्ा सीडब्ल्र्ूएल/डी/58/88/3175-3250, तारीख 18 अक्टूबर, 1989 के द्वारा वन्र्िीव अभर्ारण्र् के रूप में अजधसूजचत दकर्ा गर्ा था और इसे अजधसूचना सं. सीडब्ल्र्ूएल/डी/159/2014/680-1781 द्वारा तारीख 6 जसतंबर, 2016 से बाघ ररज़वा की प्रजस्ट्थजत प्रिान की गई थी और नमिफा को अजधसूचना संखर्ा सीएलडब्ल्र्ू/8/83/5284-5360 द्वारा राष्ट्रीर् उद्यान अजधसूजचत दकर्ा गर्ा था और इसे अजधसूचना सं. एनओ एफओआर 482/डी-4/84 तारीख फरवरी 1987 द्वारा बाघ ररज़वा घोजित दकर्ा गर्ा था; और, कमलांग वन्र्िीव अभर्ारण्र् को नमिफा राष्ट्रीर् उद्यान, िो बाघ ररज़वा भी है, का जवस्ट्तार करके उसमें िोडा गर्ा है और र्ह िैव जवजवधता की िृजष्ट से समृद्ध है िो जवजभन्न वनस्ट्पजत और िीविन्तुओं के जवकास के जलए आििा रूप से उपर्ुि है;
और, नमिफा राष्ट्रीर् उद्यान जवश्व का एकमात्र ऐसा संरजक्षत क्षेत्र है जिसमें बडी जबल्ली की 4 प्रिाजतर्ां - िैसे तेंिुआ, बाघ, स्नो-लैपडा और लमजचत् ता जनवास करती हैं। र्ह पूवी जहमालर्न िैव-जवजवधता हॉटस्ट्पॉट में आने वाला सबसे बडा संरजक्षत क्षेत्र है। क्षेत्रफल की िृजष्ट से र्ह भारत में तीसरा सबसे बडा राष्ट्रीर् उद्यान है। र्ह क्षेत्र जवस्ट्तृत जडप्टेरोकापा वनों के जलए भी िाना िाता है जिसमें ऑर्काड, फना और जलर्ानास प्रचुरता में पार्े िाते है और र्ह एजिर्ा के अंजतम सुिूर वन क्षेत्रों में आता है। और, कमलांग और नमिफा बाघ ररज़वा में और इसके आस-पास मुखर् वनस्ट्पजत प्रिाजतर्ां िैसे दक जडप्रोकापास मैक्रोकारपस (होलोग), िोररर्ा असाजमका (साल), एलल्टंजगर्ा एक्सेल (िटली), मोरास लेजवगाता (बोला), जडलेजनर्ा इंजडका (आउटेंगा), टर्मानजलर्ा मेररर्ोकारपा (होलॉक), टूना जसजलएटा, जसनामोमम सीसीडोडाफन्ना, कास्ट्टानोजप्सस इंजडका (जहगोरी), कैनाररर्म रेसीजनफेरम, डुबांगा ग्रैंडफोजलर्ा (खोकान), जडक्सॉजक्सलोन हैजमल्टोजन (बंिरडीमा), दक्रप्टोमोररर्ा पेजनस्ट्र्ाटा, एलेकापास िेजनटरस (रुद्राक्ष), एसर ओब्लांगम (जहमालर्ी मेपल), अरुजडनग्राजमनी फोजलर्ा (बांस आर्काड), आदि पार्ी िाती हैं; और, कमलांग और नामिाफा टाइगर ररिवा 60 से अजधक पिु प्रिाजतर्ों का मैजनस पेंटाडेक्टाइला (चीनी पैंगोजलन), कैपररकोरजनस थार (जहमालर्ी सीरो), जनजक्टसबस कूकांग (स्ट्लो लोररस), मकाका असामेंजसस (असजमर्ा मकाक), रेचीजपचकस जपपेटस (कैप्ड लंगूर), कुओन अल्पाइन (िंगली कुत्ता), उसास जथबेटानस (एजिर्ाई काला भालू), लुत्रा लुत्रा (सामान्र् ऊिजबलाव), जप्रर्ोनेलुरस बेंगालेंजसस (तेंिुआ जबल्ली), पाडोफेजलस मामोराटा (संगमरमर वाली जबल्ली), पैंथेरा पाडास (तेंिुआ), पैंथेरा टाइजग्रस (बाघ), पैंथेरा अनजसर्ा (जहम तेंिुआ), मोस्ट्कस फोकस (काला कस्ट्तूरी मृग), मोस्ट्कस क्राइसोगास्ट्टर (जहमालर्ी कस्ट्तूरी जहरण), मुंरटर्ाकस मुंटिैक (बार्किंग जहरण), नेमोरहेडस सुमात्रैजन्सस (जहमालर्ी सीरो), रतुफा बाइकलर (मलार्न जविाल जगलहरी), कैलोजसर्ुरस पार्गेरीथ्रस (होएरी-बेजलइड जगलहरी), ड्रेमोजमस लोकररर्ा (नारंगी पेट वाली जहमालर्ी जगलहरी), पेटौररस्ट्टा पेटौररस्ट्टा (कॉमन फ्लाइह जगलहरी), बैंजडकोटा इंजडका (लािा बैंजडकूट रैट) और जहजस्ट्रक्स ब्रैच्र्ुरन (चाइजनस पाकुापाइन) आदि का समथान करते हैं और, नामिाफा टाइगर ररज़वा सजप्रर्ा जहमालर्न, पीनस मकुासी िैसी िुलाभ पुष्प प्रिाजतर्ों का संरक्षण, संरक्षण और आश्रर् प्रिान करता है; िुलाभ िीव-िंतु प्रिाजतर्ााँ िैसे कुओरा मौहोटी, हेलाक्टोस मलार्नस, मेलोगेल एसपीपी, मुस्ट्टेला फ्लेजवगुला, एओजनक्स जसनेररर्ा, जप्रनोडोन पार्डाकोलर; खतरनाक प्रिाजतर्ों िैसे दक जबस्ट्वामॉर्ोप्टेरस जबस्ट्वासी, ऐलुरस फुलगेंस, जप्रर्ोजनलुरस जववररनस, पैंथेरा रटजग्रस, पैंथेरा अनदकर्ा, एलेफस मैजक्समस, हुलॉक हुलॉक, एजक्सस पोरजसनस, मोस्ट्चस फस्ट्कस, मोस्ट्चस क्राइसोगास्ट्टर, हैड्रोजमस ह्र्ूमेई, मैजनस पेंटाडैक्टाइला और खतरे वाली प्रिाजतर्ां िैसे राकोफोरस नामिाफेजन्सस, ओटर (लुररना एसपीपी); आदि है;

और, कमलांग बाघ ररज़वा एक िुलाभ पुष्प प्रिाजत, साइलौम नुडम, और एक लुप्तप्रार् िीव प्रिाजत, हूलॉक जगब्बन का संरक्षण, सुरक्षा और आश्रर् भी प्रिान करता है;

और, कमलांग बाघ ररज़वा और नमिफा बाघ ररज़वा के क्षेत्र, जवस्ट्तार और सीमाओं, जिन्हें पैरा 1 में पाररजस्ट्थजतकी, पर्ाावरणीर् और िैव जवजवजधता की िृजष्ट से पाररजस्ट्थजतकी संवेिी िोन के रूप में जवजनर्िाष्ट दकर्ा गर्ा हैं, को सुरजक्षत और संरजक्षत करना और उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों की श्रेणीर्ों के प्रचालन और प्रदक्रर्ाओं को प्रजतजिद्ध करना आवश्र्क है; अतः अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इसमें इसके पश्चात् पर्ाावरण अजधजनर्म कहा गर्ा है) की धारा 3 की उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, अरुणाचल प्रिेि राज्र् के कमलांग बाघ ररज़वा और नमिफा बाघ ररज़वा की सीमा के चारों ओर 0 (िून्र्) दकलोमीटर से 11.92 दकलोमीटर तक जवस्ट्तृत क्षेत्र को कमलांग बाघ ररज़वा और नमिफा बाघ ररज़वा पाररजस्ट्थजतकी संवेिी िोन (जिसे इसके पश्चात् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा है) के रूप में अजधसूजचत करती है, जिसका जववरण पैरा 1 में जवजनर्िाष्ट है, पर्ाावरण गुणवत्ता के संरक्षण और सुधार तथा पर्ाावरणीर् जनवारण, जनर्ंत्रण और उपिमन के प्रर्ोिन के जलए और जनम्नजलजखत उपार् करती है, अथाात्:-
1. पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार और सीमाएं.-(1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार कमलांग बाघ ररज़वा और नमिफा बाघ ररज़वा की सीमा के चारों ओर 0 से 11.92 दकलोमीटर तक होगा। इस पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल 450.39 वगा दकलोमीटर है। जवजभन्न दििाओं में पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार जनम्न रूप से हैः- दििाएं जवस्ट्तार (दकलोमीटर में) उत्तर 1 दकलोमीटर उत्तर -पूवा 1 दकलोमीटर पूवा 0 (इंडो-म्र्ांमार सीमा) िजक्षण-पूवा 1 दकलोमीटर िजक्षण 0 (इंडो-म्र्ांमार सीमा) िजक्षण –पजश्चम 1 दकलोमीटर पजश्चम 11.92 दकलोमीटर उत्तर - पजश्चम 1 दकलोमीटर

रटप्पणः नमिफा राष्ट्रीर् उद्यान और बाघ ररिवा के पूवी और िजक्षणी दििा में िून्र् पाररजस्ट्थजतकी संवेिी िोन को प्रस्ट्ताजवत दकर्ा गर्ा है चूंदक र्ह सीमा भारत-म्र्ांमार अंतरााष्ट्रीर् सीमा से सटी हुई है।
(2) कमलांग टाइगर ररिवा और नामिाफा टाइगर ररिवा के आसपास के पाररजस्ट्थजतकी संवेिी िोन के साथ-साथ कमलांग और नामिाफा टाइगर ररिवा का सीमा जववरण उपाबंध-I के रूप में संलग्न है।

(3) सीमा जववरण और भू-जनिेिांक के साथ इस पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करते हुए कमलांग बाघ ररज़वा और नमिफा बाघ ररज़वा के मानजचत्रों को उपाबंध–IIक, उपाबंध–IIख और उपाबंध–IIग के रूप में संलग्न दकर्ा गर्ा है। (4) कमलांग बाघ ररज़वा और नमिफा बाघ ररज़वा और उसके पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू-जनिेिांकों की सूची उपाबंध-III की सारणी क, सारणी ख और सारणी ग में िी गई है। (5) पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाले ग्रामों की सूची, उनके मुखर् लबंिुओं के भू-जनिेिांकों सजहत उपाबंध-IV के रूप में संलग्न है। 2. पाररजस्ट्थजतकी संवेिी िोन के जलए आंचजलक महार्ोिना.–(1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रभावी प्रबंधन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और आंचजलक महार्ोिना तैर्ार करेगी और इस अजधसूचना में िी गई ितों का राज्र् सरकार में सक्षम प्राजधकारी के अनुमोिन से पालन करती रहेगी। (2) पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना राज्र् सरकार द्वारा ऐसी रीजत से िो इस अजधसूचना में जवजनर्िाष् ट की गई हैं तथा सुसंगत केंद्रीर् और राज्र् जवजधर्ों के अनुरूप तथा केंद्रीर् सरकार द्वारा िारी दकर्े गर्े मागाििाक जसद्धांतों, र्दि कोई हो, के अनुसार तैर्ार होगी। (3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् संबंधी बातों को समाकजलत करने के जलए, राज्र् सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार होगी, अथाात्:- (i) पर्ाावरण; (ii) वन और वन्र्िीव;
(iii) कृजि; (iv) रािस्ट्व; (v) िहरी जवकास; (vi) पर्ाटन; (vii) ग्रामीण जवकास; (viii) लसंचाई और बाढ़ जनर्ंत्रण; (ix) नगरपाजलका; (x) प्रिूिण जनर्ंत्रण बोडा; (xi) पंचार्ती राि; और (xii) लोक जनमााण जवभाग। (4) आंचजलक महार्ोिना अनुमोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबिंधन अजधरोजपत नहीं करेगी, िब तक इस अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो तथा आंचजलक महार्ोिना, सभी अवसंरचनाओं और दक्रर्ाकलापों में िो अजधक िक्षता और पाररजस्ट्थजतकी-अनुकूल हो, का संवधान करेगी।
(5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भू-िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी एवं पर्ाावरण के ऐसे अन्र् पहलुओं, जिन पर ध्र्ान दिर्ा िाना आवश्र्क है के जलए उपबंध होंगे।

(6) आंचजलक महार्ोिना, जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेिताओं के ब्र्ौरे से अनुसमर्थात मानजचत्र के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों के प्रकार तथा दकस्ट् म, कृजि क्षेत्रों, ऊपिाऊ भूजम, िैसे उद्यानों एवं उद्यानों की तरह के हररत क्षेत्रों, उद्यान कृजि क्षेत्रों, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का सीमांकन करेगी। (7) आंचजलक महार्ोिना, पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करेगी और पैराग्राफ 4 में सूचीबद्ध सारणी में प्रजतजिद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन करेगी और स्ट् थानीर् समुिार्ों की आिीजवका को सुरजक्षत करने के जलए पाररजस्ट्थजतकी-अनुकूल जवकास को भी सुजनजश्चत और अजभवृजद्ध करेगी।
(8) आंचजलक महार्ोिना, प्रािेजिक जवकास र्ोिना की सह-जवस्ट्तारी होगी । (9) र्था अनुमोदित आंचजलक महार्ोिना, मानीटरी सजमजत के जलए एक जनिेि िस्ट्तावेि होगा जिससे वह इस अजधसूचना के उपबंधों के अनुसार मानीटरी के अपने कार्ो को कार्ााजन्वत कर सके । (10) पाररजस्ट्थजतकी संवेिी िोन के जलए आंचजलक महार्ोिना तैर्ार होने तक, सभी नए जनमााण और अन्र् जवकासात्मक दक्रर्ाकलापों को मानीटरी सजमजत को जनर्िाष्ट दकर्ा िाएगा। 3. राज्र् सरकार द्वारा दकए िाने वाले उपार्.- राज्र् सरकार, इस अजधसूचना के उपबंधों को प्रभावी करने के जलए जनम्नजलजखत उपार् करेगी, अथाात्:- (1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के जलए जचजन्हत उद्यानों और खुले स्ट्थानों का वृहि वाजणजज्र्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा संपररवतान नहीं होगा: परंतु पाररजस्ट्थजतकी संवेिी िोन के भीतर, ऊपर भाग (क), में जवजनर्िाष्ट प्रर्ोिनों से जभन्न के जलए, कृजि और अन्र् भूजम के संपररवतान को मानीटरी सजमजत की जसफाररि पर और प्रािेजिक नगर र्ोिना अजधजनर्म तथा र्था लागू केन्द्रीर् सरकार और राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से तथा इस अजधसूचना के उपबंधों के द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करने के जलए अनुज्ञात दकर्ा िाएगा, िैसे:- (i) जवद्यमान सडकों को चौडा करना, और उन्हें सुिृढ़ करना तथा नई सडकों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का जनमााण और नवीकरण; (iii) प्रिूिण उत्पन्न न करने वाले लघु उद्योग;
(iv) कुटीर उद्योग जिनके अंतगात ग्राम उद्योग भी है; पाररजस्ट्थजतकी पर्ाटन में सहार्क सुजवधा भण्डार और स्ट्थानीर् सुजवधाएं जिसके अंतगात गृह वास भी हैं; और
(v) पैरा-4 में दिए गए संवर्धात दक्रर्ाकलाप: परंतु र्ह और दक प्रािेजिक िहरी र्ोिना अजधजनर्म के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन तथा राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों और संजवधान के अनुच्छेि 244 तथा तत्समर् प्रवृत्त जवजध के उपबंधों, जिसके अंतगात अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी है, का अनुपालन दकए जबना, वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनुज्ञात नहीं होगा।

परंतु र्ह भी दक पाररजस्ट् थजतकी संवेिी िोन के भीतर भूजम के अजभलेखों में उपसंिात दकसी त्रुरट को, मानीटरी सजमजत के जवचार प्राप्त करने के पश्चात्, राज्र् सरकार द्वारा प्रत्र्ेक मामले में एक बार सुधारा िाएगा और उि त्रुरट को सुधारे िाने की सूचना केंद्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी:

परंतु र्ह भी दक उपर्ुाि त्रुरट को सुधारने में, इस उपपैरा के अधीन र्था उपबंजधत के जसवार्, दकसी भी ििा में भू-उपर्ोग का पररवतान सजम्मजलत नहीं होगा।
(ख) अनुप्रर्ुि र्ा अनुत् पािक कृजि क्षेत्रों में वनीकरण तथा पर्ाावासों की बहाली के दक्रर्ाकलापों के द्वारा पुन: वनीकरण के प्रर्ास दकए िाएंगे।
(2) प्राकृजतक िल स्रोत.- आंचजलक महार्ोिना में सभी प्राकृजतक िलस्त्रोतों के िलग्रहण क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और पुनरुज्जीवन की र्ोिना सजम् मजलत की िाएगी और राज्र् सरकार द्वारा ऐसे क्षेत्रों में र्ा उनके जनकट जवकास दक्रर्ाकलापों प्रजतजिद्ध करने के बारे में िो ऐसे क्षेत्रों के जलए अजहतकर हो, ऐसी रीजत में मागाििाक जसद्धांत तैर्ार दकए िाएंगे। (3) पर्ाटन र्ा पाररजस्ट्थजतकी पर्ाटन.– (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी संवेिी िोन के जलए होगा;
(ख) र्ह पर्ाटन महार्ोिना, राज्र् सरकार के पर्ाावरण और वन जवभाग के परामिा से पर्ाटन जवभाग द्वारा तैर्ार की िाएगी;
(ग) पर्ाटन महार्ोिना, आंचजलक महार्ोिना का ही एक घटक होगी; (घ) पर्ाटन महार्ोिना, पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के अध्र्र्न के आधार पर तैर्ार की िाएगी; (ङ) पाररजस्ट्थजतकी-पर्ाटन संबंधी दक्रर्ाकलाप जनम् नानुसार जवजनर्जमत दकए िाएंगे, अथाात्:- (i) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार द्वारा िारी मागाििाक जसद्धांतों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट् थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेने वाले राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण (समर्-समर् पर र्था संिोजधत) द्वारा िारी पाररजस्ट्थजतकी-पर्ाटन संबंधी मागाििाक जसद्धांतों के अनुसरण में होगा; (ii) आंचजलक महार्ोिना तैर्ार होने और अनुमोिन होने तक, पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजनर्िाष्ट संवीक्षा तथा मानीटरी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा। (4) नैसर्गाक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन में बहुमूल्र् नैसर्गाक जवरासत के सभी स्ट्थलों, िैसे दक िीन कोि आरजक्षत क्षेत्र, िैल जवरचनाए, िल प्रपात, झरने, धारा मागो, उपवन, गुफाएं, स्ट्थल, वनपथ, अश्वरोहण मागा, उत्प्रपात आदि की पहचान की िाएगी और उनके सुरक्षा और संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना भी तैर्ार की िाएगी। (5) मानव जनर्मात जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना भी तैर्ार की िाएगी।
(6) ध् वजन प्रिूिण.- ध्वजन प्रिूिण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 के उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रिूिण के जनवारण और जनर्ंत्रण के जलए पालन दकर्ा िाएगा ।
(7) वार्ु प्रिूिण.- पाररजस्ट्थजतकी संवेिी िोन में, वार्ु प्रिूिण का जनवारण और जनर्ंत्रण, वार्ु (प्रिूिण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और तद्धीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा ।
(8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सारण, िल (प्रिूिण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) तथा तद्धीन बनाए गए जनर्मों, के उपबंधों के अनुसार दकर्ा िाएगा।

(9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान और प्रबन्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपटान और प्रबंधन, ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण- अनुकूल रीजत से दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा। (10) िैव जचदकत्सा अपजिष्ट.- िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान, िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा।
(ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा। (11) प्लाजस्ट्टक अपजिष्ट का प्रबंधन.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट का प्रबंधन, प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के अनुसार दकर्ा िाएगा। (12) संजनमााण और जवध्वंस अपजिष्ट का प्रबंधन.- पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिष्ट प्रबंधन, संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट का प्रबंधन, ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) र्ानीर् गजतजवजधर्ां.- र्ातार्ात की र्ानीर् गजतजवजधर्ां पर्ाावास-अनुकूल रीजत से जवजनर्जमत की िाएगी और इस संबंध में आंचजलक महार्ोिना में जविेि उपबंध दकए िाएंगे और आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी से अनुमोदित होने तक, मानीटरी सजमजत सुसंगत अजधजनर्मों और तद्धीन बनाए गए जनर्मों एवं जवजनर्मों के अनुसार र्ानीर् गजतजवजधर्ों के अनुपालन को मानीटर करेगी। (15) र्ानीर् प्रिूिण.- र्ानीर् प्रिूिण का जनवारण और जनर्ंत्रण लागू जवजधर्ों के अनुपालन में दकर्ा िाएगा और सीएनिी, एलपीिी आदि िैसे स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ां.- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए प्रिूिणकारी उद्योग की स्ट्थापना अनुज्ञात नहीं होगी। (ख) केन्द्रीर् प्रिूिण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी समर्-समर् पर र्था संिोजधत मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर- प्रिूिणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रिूिणकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा। (17) पहाडी ढलानों का संरक्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना में पहाडी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनमें दकसी भी जनमााण की अनुज्ञा नहीं होगी। (ख) जिन ढलानों र्ा जवद्यमान खडी पहाडी ढलानों में अत्र्जधक भू-क्षरण होता है उनमें दकसी भी जनमााण की अनुज्ञा नहीं होगी। 4. पाररजस्ट्थजतकी संवेिी िोन के भीतर प्रजतजिद्ध र्ा जवजनर्जमत दकए िाने वाले दक्रर्ाकलापों की सूची- पाररजस्ट्थजतकी संवेिी िोन में सभी दक्रर्ाकलाप, पर्ाावरण (संरक्षण) अजधजनर्म के उपबंधों और तद्धीन बनाए गए जनर्मों और

पर्ाावरण, वन और भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना, संखर्ांक 1533 (अ), तारीख 14 जसतंबर, 2006 और ऐसी रीजत में तत्समर् प्रवृत जवजधर्ों के उपबंधों द्वारा िाजसत होंगे और समर्-समर् पर र्था संिोजधत नीचे िी गई सारणी में जवजनर्िाष्ट दकए गए है, अथाात्:-

(क) पाररजस्ट्थजतकी संवेिी िोन के भीतर वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेलू आवश्र्कताओं, जिसमें मकानों के जनमााण र्ा मरम्मत के जलए धरती को खोिना सजम्मजलत है, के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनि), पत्थर उत्खनन और अपघिाण इकाइर्ां तत्काल प्रभाव से प्रजतजिद्ध होंगी; (ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) सं. 202 में टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले में माननीर् उच्चतम न्र्ार्ालर् के आिेि और 2012 की ररट र्ाजचका (जसजवल) सं. 435 में गोवा फाउंडेिन बनाम भारत संघ के मामले में आिेि का अनुपालन होगा और 2003 के आईए सं. 1000 का जनणार् तारीख 03-06-2022 और तत्पश्चात आईए सं. 131377 का जनणार् तारीख 26-04-2023 और 28-04-2023 को हुआ, के अनुसरण में दकए िाऐंगे। 2. प्रिूिण (िल, वार्ु, मृिा, ध्वजन, आदि) उत्पन्न करने वाले उद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रिूिणकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नहीं होगीः परन्तु र्ह दक केन्द्रीर् प्रिूिण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में ऐसा जवजनर्िाष्ट न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गैर-प्रिूिणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि गैर-प्रिूिणकारी कुटीर उद्यागों को बढ़ावा दिर्ा िाएगा। 3. बृहत िल जवद्युत पररर्ोिनाओं की स्ट्थापना । प्रजतजिद्ध।
4. दकसी पररसंकटमर् पिाथा का उपर्ोग र्ा उत्पािन र्ा प्रस्ट्संकरण । प्रजतजिद्ध।
5. नैसर्गाक िल जनकार्ों र्ा भूजम क्षेत्र में अनुपचाररत बजहस्रावों का जनस्ट्सारण । प्रजतजिद्ध।

नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा जमलों के जवस्ट्तार की अनुज्ञा नहीं होगी ।
7. ईंट भट्टों की स्ट्थापना। प्रजतजिद्ध। 8. पर्ाटन से संबंजधत अन्र् दक्रर्ाकलाप िैसे गमा वार्ु, गुब्बारें, हेलीकॉप्टर, ड्रोन, माइक्रोलाइटस्, आदि द्वारा
पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से उडना िैसे दक्रर्ाकलाप करना। लागू जवजधर्ों के अनुसार जवजनर्जमत। ख.जवजनर्जमत दक्रर्ाकलाप 9. होटलों और ररसोटों की वाजणजज्र्क स्ट्थापना । पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हेतु लघु अस्ट्थार्ी संरचनाओं के जनमााण के जसवार्, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के
भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना अनुज्ञात नहीं होगी: परन्तु र्ह, दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, पर्ाटन महार्ोिना और लागू दििाजनिेिों की अनुरुपता से इनमें िो भी अजधक जनकट हो, सभी नए पर्ाटन दक्रर्ाकलाप करने र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार होगा। 10. जनमााणकारी दक्रर्ाकलाप । संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक िो भी जनकट हो, दकसी भी प्रकार का नर्ा वाजणजज्र्क संजनमााण अनुज्ञात नहीं दकर्ा िाएगा: परन्तु र्ह, दक स्ट् थानीर् लोगों को पैरा 3 के उप पैरा (1) में वर्णात दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम में स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने जलए संजनमााण करने की अनुमजत भवन उपजवजधर्ों के अनुसार िी िाएगी: परन्तु र्ह और दक ऐसे लघु उद्योगों िो प्रिूिण उत् पन् न नहीं करते हैं, से संबंजधत संजनमााण दक्रर्ाकलाप जवजनर्जमत दकए िाएंगे और लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत से ही न् र्ूनतम पर रखे िाएंगे। एक दकलोमीटर से परे आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे । 11. गैर प्रिूिणकारी लघु उद्योग। फरवरी, 2016 में, केन्द्रीर् प्रिूिण जनर्ंत्रण बोडा द्वारा िारी, उद्योगों के वगीकरण के अनुसार गैर-प्रिूिणकारी उद्योग और अपररसंकटमर्, लघु और सेवा उद्योग, कृजि, पुष्प कृजि, बागवानी र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्री से उत्पािों को उत्पन्न करने वाले कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे। 12. वृक्षों की कटाई । (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनुज्ञा के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं हो सकेगी ।

(ख) वृक्षों की कटाई संबंजधत केंद्रीर् र्ा राज्र् अजधजनर्म र्ा तद्धीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी । 13. वन उत्पािों और गैर काष्ठ वन उत्पािों का संग्रहण । लागू जवजधर्ों के अधीन जवजनर्जमत होगा । 14. जवद्युत और संचार टॉवर लगाने, तार-जबछाने तथा अन्र् बुजनर्ािी ढांचे की व्यवस्ट्था । लागू जवजधर्ों के अधीन जवजनर्जमत होगा और भूजमगत केबल जबछाने को बढ़ावा दिर्ा िाएगा। 15. नागररक सुजवधाओं सजहत बुजनर्ािी ढांचा। लागू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक जसद्धांतों के अनुसार िमन उपार् दकए िाएंगे।
16. जवद्यमान सडकों को चौडा करना, उन्हें सुिृढ बनाना और नई सडकों का जनमााण। लागू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक जसद्धांतों के अनुसार िमन उपार् दकए िाएंगे।
17. पहाडी ढलानों और निी तटों का संरक्षण । लागू जवजधर्ों के अनुसार जवजनर्जमत होगा । 18. राजत्र में र्ाजनक र्ातार्ात का संचलन । लागू जवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होगा । 19. स्ट्थानीर् समुिार्ों द्वारा अपनार्ी िा रही वतामान कृजि और बागवानी पद्धजतर्ों के साथ िुग्धिाला, िुग्ध उत्पािन, िल कृजि और मत्स्ट्र् पालन। स्ट्थानीर् िनता के उपर्ोग के जलए लागू जवजधर्ों के अनुसार अनुज्ञात होंगे। 20. फमों, कारपोरेट और कंपजनर्ों द्वारा बडे पैमाने पर वाजणजज्र्क पिुधन संपिा और कुक्कुट फामों की स्ट्थापना । स्ट्थानीर् आवश्र्कताओं को पूरा करने के जसवार् लागू जवजधर्ों के अनुसार जवजनर्जमत (जसवार् अन्र्था के उपबंजधत) होंगे । 21. प्राकृजतक िल जनकार्ों र्ा भू क्षेत्र में उपचाररत अपजिष्ट िल/बजहस्रााव का जनस्ट्सारण । िल जनकार्ों में उपचाररत अपजिष्ट िल/बजहस्रााव के जनस्ट्सारण से बचा िाएगा और उपचाररत अपजिष्ट िल के पुनचाक्रण और पुन:उपर्ोग के प्रर्ास दकए िाएंगे अन्र्था उपचाररत अपजिष्ट िल/बजहस्रााव का जनस्ट्सारण लागू जवजधर्ों के अनुसार जवजनर्जमत दकर्ा िाएगा। 22. सतही और भूिल का वाजणजज्र्क जनष्किाण । लागू जवजधर्ों के अनुसार जवजनर्जमत होगा । 23. कृजि और अन्र् उपर्ोग के जलए खुले कुंआ, बोर कुंआ, आदि । जवजनर्जमत और सम्बद्ध प्राजधकारी द्वारा दक्रर्ाकलापों की सखती से मानीटरी की िाएगी। 24. ठोस अपजिष् ट का प्रबंधन। लागू जवजधर्ों के अनुसार जवजनर्जमत होगा । 25. जविेिी प्रिाजतर्ों को लाना। लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे । 26. पाररजस्ट्थजतकी पर्ाटन। लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे । 27. पोजलथीन बैगों का उपर्ोग । लागू जवजधर्ों के अनुसार जवजनर्जमत होगा । 28. वाजणजज्र्क संकेत बोडा और लागू जवजधर्ों के अनुसार जवजनर्जमत होगा ।

  1. मानीटरी सजमजत.- केन्द्रीर् सरकार, मानीटरी सजमजत के नाम से ज्ञात एक सजमजत का गठन करेगी, िो जनम्नजलजखत से जमलकर बनेगी, अथाात:- (i) उपार्ुि, चांगलांग र्ा लोजहत जिला, अरुणाचल प्रिेि सरकार अध् र्क्ष, पिेन; (ii) सिस्ट्र् सजचव, अरुणाचल प्रिेि राज्र् प्रिूिण जनर्ंत्रण बोडा, ईटानगर सिस्ट्र्, पिेन; (iii) वन्र्िीव संरक्षण (जवरासत संरक्षण सजहत) के क्षेत्र में काम करने वाले गैर-सरकारी संगठन का एक प्रजतजनजध जिसे प्रत्र्ेक तीन विा में समर्-समर् पर राज्र् सरकार द्वारा नामजनर्िाष्ट दकर्ा िाएगा। सिस्ट्र्; (iv) राज्र् के प्रजतजष्ठत संस्ट्थान र्ा जवश्वजवद्यालर् से िैव जवजवधता सजहत पाररजस्ट्थजतकी और पर्ाावरण के क्षेत्र में एक जविेिज्ञ जिसे प्रत्र्ेक तीन विा में समर्-समर् पर राज्र् सरकार द्वारा नामजनर्िाष्ट दकर्ा िाएगा। सिस्ट्र्; (v) उप जनिेिक, िहरी जवकास जवभाग, चांगलांग र्ा लोजहत जिला सिस्ट्र्, पिेन; (vi) कार्ाकारी अजभर्ंता, ग्रामीण कार्ा जवभाग, चांगलांग र्ा लोजहत जिला सिस्ट्र्, पिेन; (vii) कार्ाकारी अजभर्ंता, सावािजनक स्ट्वास्ट््र् इंिीजनर्ररंग जवभाग, चांगलांग र्ा लोजहत जिला सिस्ट्र्, पिेन; (viii) वन संरक्षक और क्षेत्र जनिेिक, नामिाफा राष्ट्रीर् उद्यान और टाइगर ररिवा, जमर्ाओ सिस्ट्र् सजचव, होर्डिंग। ग.संवर्धात दक्रर्ाकलाप

और प्रभागीर् वन अजधकारी, कमलांग वन्र्िीव अभर्ारण्र् प्रभाग, वाकरो पिेन; 6. मानीटरी सजमजत के जनबंधन और कार्ा:- (1) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संखर्ांक का.आ. 1553 (अ), तारीख 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत है, और िो पाररजस्ट्थजतकी संवेिी िोन में आते है, जसवार् इसके पैरा 4 के अधीन सारणी में र्थाजवजनर्िाष्ट प्रजतजिद्ध दक्रर्ाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त के जलए र्थाजस्ट्थजत, केंद्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् र्ा राज्र् पर्ाावरण समाघात जनधाारण प्राजधकरण को जनर्िाष्ट दकर्ा िाएगा। (2) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संखर्ांक का.आ. 1533 (अ), तारीख 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत नहीं है और िो पाररजस्ट्थजतकी संवेिी िोन में आते है जसवार् इसके पैरा 4 के अधीन सारणी में र्थाजवजनर्िाष्ट प्रजतजिद्ध दक्रर्ाकलापों के, मानीटरी सजमती द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे संबद्ध जवजनर्ामक प्राजधकरण को जनर्िाष्ट दकर्ा िाएगा। (3) मानीटरी सजमजत के सिस्ट्र्-सजचव र्ा संबद्ध कलेक्टर र्ा संबद्ध उप वन संरक्षक, पर्ाावरण (संरक्षण) अजधजनर्म की धारा 19 के अधीन इस अजधसूचना के उपबंधों का उल्लंघन करने वाले दकसी भी व्यजि के जवरुद्ध जिकार्त ििा करने के जलए सक्षम होंगे।
(4) मामले िर मामले के आधार पर, मानीटरी सजमजत, संबद्ध जवभागों के प्रजतजनजधर्ों र्ा जविेिज्ञों, औद्योजगक संगमो र्ा संबंद्ध पणधाररर्ों के प्रजतजनजधर्ों को अपने जवचार-जवमिा में सहार्ता के जलए आमंजत्रत कर सकती है।
(5) मानीटरी सजमजत, उपाबंध-V में संलग्न प्रोफामाा के अनुसार प्रत्र्ेक विा 31 माचा तक के अपने दक्रर्ाकलापों की वार्िाक कारावाई ररपोटा उस विा के 30 िून तक राज्र् के मुखर् वन्र्िीव वाडान को प्रस्ट्तुत करेगी। (6) केन्द्रीर् सरकार, पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् में मानीटरी सजमजत को अपने कृत्र्ों के प्रभावी जनवाहन के जलए ऐसे जनिेि िे सकेगी िो वह ठीक समझे। 7. अजतररक् त उपार्:- इस अजधसूचना के उपबंधों को प्रभाव िेने के जलए केंद्रीर् सरकार और संघ राज्र्क्षेत्र सरकार अजतररक् त उपार्, र्दि कोई हों, जवजनर्िाष् ट कर सकेंगी।

उपाबंध-I सारणी कः कमलांग बाघ ररज़वा की सीमा का जववरण नामः कमलांग बाघ ररज़वा क्षेत्रः 783.0 वगा दकलोमीटर सीमा, जनम्नवत है-

उत्तर इसकी सीमा रेखा िी आर 777414 जस्ट्थत लबंिु ‘ए’ िो की तवा और लांग निी का संगम स्ट्थल है, से प्रारंभ होकर लांग निी के िाजहने तट के साथ-साथ धारा के जवपरीत, इसके िी आर 001356 जस्ट्थत स्रोत तक िाती है, इसके बाि र्ह 90° के कोण पर एक कृजत्रम रेखा के साथ-साथ 700 मीटर तक चलकर िी आर 006356 जस्ट्थत ररि 3912 तक िाती है। दफर र्ह िजक्षण दििा की ओर ररि के सहारे-सहारे चलते हुए चोटी 3936.3948 को स्ट्पिा करती है। इसके बाि र्ह पूवा दििा की ओर ररि के सहारे-सहारे िी आर 044333 जस्ट्थत तवा नाला के स्रोत तक िाती है। इसके बाि तवा नाला के िाजहने तट के सहारे-सहारे लाती निी के साथ होने वाले इसके संगम, जिसे जबन्िु ‘बी’ कह सकते है, तक िाती है। पूवा इसके बाि, र्ह लबंिु ‘बी’ से लगभग 300 मीटर लती निी के प्रजतप्रवाह के साथ-साथ इसके स्रोत तक िाती है िो दक चांगलांग औऱ लोजहत जिलों की सीमा पर 4131 मीटर उन्नतांि के पूवा में है। िजक्षण इसके बाि, र्ह सीमा रेखा िी आर 766127 में तवाई बराई के स्रोत तक पजश्चम की ओर चांगलांग औऱ लोजहत की अंतर जिला सीमा से होते हुए िाती है। पजश्चम इसके बाि र्ह तवाई बराई के बार्ै तट के साथ-साथ धारा की दििा में िी आर 745218 पर होने वाले कमलांग निी के साथ इसके संगम तक िाती है; दफर इसके बाि कमलांग निी के बााँर्े तट के साथ-साथ धारा की दििा में िी आर 726225 पर इसकी सहार्क निी जसना बराई के साथ होने वाले इसके संगम तक िाती है, इसके बाि लगभग 340° का कोण बनाते हुए एक कृजत्रम रेखा के सहारे-सहारे र्ह है 200 मीटर की िूरी चलकर िी आर 748260 पर जस्ट्थत इसकी सहार्क निी लाई के उद्गम स्ट्थल तक िाती है। दफर लगभग 20° के कोण पर एक कृजत्रम रेखा बनाते हुए र्ह है 350 मीटर तक िी आर 778267 तक तवा की सहार्क निी के उद्गम स्ट्थल तक िाती है; दफर उस सहार्क निी के बार्ै दकनारे के साथ-साथ िी आर 809307 जस्ट्थत तवा निी के संगम तक िाती है। दफर र्ह तवा निी के बार्ैं तक के साथ-साथ धारा की दििा में प्रभाजवत लबंिु ‘ए’ पर होने वाले लांग निी के संगम तक िाकर समाप्त हो िाती है।

सारणी खः नमिफा बाघ ररज़वा के पाररजस्ट्थजतकी संवेिी िोन की सीमा का जववरण उत्तरः- चम्पाई बम के पूवी जिखर से, जतरप और लोजहत जिलों के बीच की सीमा रेखा के साथ-साथ अथाात वह ररि िो कमलांग और दिर्ून नदिर्ों की पनधाराओं को जवभाजित करता है साथ-साथ िफा बम से होते हुए भारत-बमाा की अंतराष्ट्रीर् सीमा रेखा तक, लोजहत निी के उद्गम स्ट्थल के जनकट, िाती है। पूवा- उपरोि लबंिु िजक्षण से इंडो-बमाा अंतराष्ट्रीर् सीमा के साथ-साथ जतलुंग हका के स्रोत लबंिु 12533 तक िाती है, इसके बाि र्ह धारा प्रवाह की दििा में बेनाम धारा प्रवाह के संगम से लगभग आधे मील से िीउन निी सजहत संगम तक िाती है। इसके बाि धारा प्रवाह के जवपरीत इसके स्त्रोत तक िाती है। इसके बाि पटकोई श्रेणी में जग्रड जनिेि एनएस 38, 783 में लबंिु 6472 के श्रेणी सजहत उत्तर पजश्चमी दििा में िाती है। िजक्षण- उपरोि लबंिु जग्रड जनिेि एनएस 380 780 पजश्चम से भारत-बमाा अंतराष्ट्रीर् सीमा के साथ-साथ दकसी बेनाम धारा प्रवाह के स्रोत तक िाती है िा दक पटकोई पहाडी श्रेणी के जग्रड सन्िभा एनएस 975 750 ए.टी. पर जस्ट्थत लबंिु 4557 पर पडता है। पजश्चम- दफर र्ह उपर्ुाि स्रोत से धारा की दििा में चलते हुए नामफुक निी के साथ होने वाले इसके संगम तक िाती है, दफर धारा की दििा में र्ह नामफुख निी के साथ-साथ चलते हुए कोर वाइवा हका निी के साथ होने वाले इसके संगम तक चलती है। दफर मुखर् कोर वाइवा की धारा की जवपरीत दििा में र्ह इसके उत्तर पजश्चमी चैनल के संगम तक िाती है िो की तेंग बम के उत्तर लगभग 1 मील िो फलािंग पर जस्ट्थत इसके स्रोत से जनकलती है। इसके बाि काई चैनल की धारा के जवपरीत दििा में इसके स्रोत तक िाती है। दफर पजश्चम दििा में नैनान और कुमचाई हका पनधाराओं को जवभाजित करने वाले ररि के साथ-साथ अवनान बम तक िाती हैं। दफर र्ह ररि को पार करते हुए पेन हका स्रोत से नैनोन बम तक िाती है। दफर र्ह पेन हका की धारा के साथ-साथ जविर्नगर रोड तक चलती है। दफर र्ह पूरब की ओर जमआओं-जविर्नगर सडक के साथ-साथ पाजतप हका तक िाती है।दफर धारा की दििा में पाजतप हका के साथ-साथ नोआ दिलहंग र्ा दिर्ुन निी के साथ होने वाले संगम तक िाती है िो दक जग्रड का एक लबंिु है उसके बाि नोआ दिलहंग र्ा दिर्ुन निी के पजश्चमी तट के साथ-साथ जग्रड रेफरेन्स एन एस 070 971 लबंिु पर जस्ट्थत है। उसके बाि र्ह नोआ-दिलहंग र्ा दिर्ुन निी के पार दकसी बेनाम धारा, िो दक उत्तर में ग्रेड रेफरेन्स एन एस 140 028 पर जस्ट्थत लबंिु 6490 से जनकलती है, के साथ होने वाले संगम तक िाती है। उसके बाि र्ह धारा के जवपरीत इसके स्रोत तक िाती है। इसके बाि र्ह पजश्चम दििा में ‘फुटपाथ’ के रूप में िुपुाँग आन तक जबर्ररंग 2778 पर, तब तक चलती है िब तक दक र्ह सीधी रेखा के रूप में नमिफा निी से निी जमल िाती है, िो दक निोंग हका के स्रोत के जबर्ररंग 290° पर जस्ट्थत है। इसके बाि र्ह है निोंग हका की धारा के साथ- साथ तब तक चलती है िब तक दक र्ह पकान-नमिफा फुटपाथ से नहीं जमल िाती है। इसके बाि र्ह पजश्चम में पकान- नमिफा फुटपाथ के सहारे सहारे लोंग काई पनधारा तक िाती है। दफर र्ह उत्तर पजश्चम दििा में एक सीधी रेखा के रूप में नाम सो सोरप धारा के 325° जबर्ररंग से िेबान निी के साथ होने वाले इसके संगम तक िाती है इसके बाि र्ह िेबांग निी की धारा के जवपरीत दकसी बेनाम धारा के संगम तक िाती है िो की रेफरेन्स एन एम 905,104 पर पडता है िो की चम्पट बम के नीचे ग्रेड रेफरेन्स एन एम 901,158 पर जस्ट्थत अपने स्रोत से जनकलती है, इसके बाि र्ह उत्तर की दििा में सीधे चलकर प्रारंजभक लबंिु से जमल िाती है।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 9th August, 2024 S.O. 3243(E).— WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide number S.O. 4893(E), dated the 10th November, 2023, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 10th November, 2023; AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the said draft notification; AND WHEREAS, the Kamlang Tiger Reserve is spread over an area of 783 square kilometers and is located in the Lohit District in Arunachal Pradesh; AND WHEREAS, the Namdapha National Park and Tiger Reserve is spread over an area of 2230.245 square kilometer out of which 1985.235 square kilometer is core and 245 square kilometers is buffer zone, located in the Changlang district of Arunachal Pradesh in the North Eastern part of India; AND WHEREAS, the Kamlang Wildlife Sanctuary was notified as Wildlife Sanctuary vide notification number CWL//D/58/88/3175-3250 dated the 18th October, 1989 and was given the status of Tiger Reserve from the 6th September,2016 vide notification number CWL/D/159/2014/680-1781 and the Namdapha was notified as national park vide notification number CLW/8/83/5284-5360 and was declared as tiger reserve vide notification number NO FOR 482/D-4/84 dated February, 1987; AND WHEREAS, the Kamlang Wildlife Sanctuary has been added to the extension of Namdapha National Park, also a tiger reserve and holds a rich biodiversity ideally suited for the growth of various floral and faunal form; AND WHEREAS, the Namdapha National Park is the only protected area in the world which harbours four big cat species like leopard, tiger, snow-leopard and clouded-leopard and it is the largest protected area in the Eastern Himalayan Biodiversity Hotspot and in terms of area it is the 3rd largest National Park in India and the area is also known for the extensive dipterocarp forests, profusion of orchids, ferns and lianas among the last great remote wilderness areas of Asia; AND WHEREAS, the major floral species found in and around Kamlang and Namdapha Tiger Reserve are Diptrocarpus macrocarpus (Hollong), Shorea assamica (Sal), Altingia excela (Jutli), Moras levigata (Bola), Dillenia indica (Outenga), Terminalia myriocarpa (Hollock), Toona ciliata, Cinnamomum cecidodaphnnae, Castanopsis indica (Higori), Canarium resiniferum, Duabanga grandifolia (Khokan), Dixoxylon hamiltonii (Banderdima), Cryptomeria penicyata, Eleocarpus genitrus (Rudraksh), Acer oblongum (Himalayan maple), Arudinagramini folia (Bamboo orchid )etc.;
AND WHEREAS, the Kamlang and Namdapha Tiger Reserves supports more than sixty faunal species, including Manis pentadactyla (Chinese Pangolin), Capricornis thar (Himalayan serow), Nycticebus coucang (Slow loris), Macaca assamensis (Assamese macaque), Trachypitchcus pipeatus (Capped langur), Cuon alpines (Wild Dog), Ursus thibetanus (Asiatic black bear), Lutra lutra (Common otter), Prionailurus bengalensis (Leopard cat), Pardofelis marmorata (Marbled cat), Panthera pardus (Leopard), Panthera tigris (Tiger), Panthera uncia (Snow leopard), Moschus focus (Black musk deer), Moschus chrysogaster (Himalayan musk deer), Muntiacus muntjak (Barking deer), Naemorhedus sumatraensis (Himalayan serow), Ratufa bicolor (Malayan giant squirrel), Callosciurus pygerythrus (Hoary-bellied squirrel), Dremomys lokriah (Orange bellied Himalayan squirrel), Petaurista petaurista (Common flying squirrel), Bandicota indica (Large bandicoot rat) and Hystrix brachyuran (Chinese porcupine) etc.; AND WHEREAS, the Namdapha Tiger Reserve conserves, protect and provides shelter to rare floral species such as Sapria himalayana, Pinus merkusii, rare faunal species such as Cuora mouhotii, Helarctos malayanus, Melogale species, Mustela flavigula, Aonyx cinerea, Prinodon pardicolor, endangered species such as Biswamoyopterus biswasi, Ailurus fulgens, Prionailurus viverrinus, Panthera tigris, Panthera uncia, Elephus maximus, Hoolock hoolock, Axis porcinus, Moschus fuscus, Moschus chrysogaster, Hadromys humei, Manis pentadactyla and threatened species such as Rhacophorus namdaphaensis, Otter (Lutrinae species);
AND WHEREAS, the Kamlang Tiger Reserve also conserves, protect and provides shelter to one rare floral species, Psiloum nudum, and one endangered faunal species, Hoolock Gibbon;

AND WHEREAS, it is necessary to conserve and protect the area, extent and boundaries of Kamlang Tiger Reserve and Namdapha Tiger Reserve which are specified in paragraph 1 as Eco-sensitive Zone from ecological,

environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to extent ranging from zero to 11.92 kilometres around the boundary of Kamlang Tiger Reserve and Namdapha Tiger Reserve, in the State of Arunachal Pradesh as the Kamlang Tiger Reserve and Namdapha Tiger Reserve Eco-sensitive Zone (hereafter in this notification referred to as the Eco- sensitive Zone) details of which are specified in paragraph 1 , for the purpose of protecting and improving the quality of environment and preventing, controlling and abating environmental pollutions and takes the following measures, namely:-

  1. Extent and boundaries of Eco-sensitive Zone– (1) The Eco-sensitive Zone shall be to the extent of 0 to 11.92 kilometres cover an area of 450.39 square kilometers around the boundary of Kamlang Tiger Reserve and Namdapha Tiger Reserve The extent of Eco-sensitive Zone in different directions is as follows:-

Note: Zero Eco-sensitive Zone has been proposed in Eastern and Southern direction of Namdapha National Park and Tiger Reserve as the boundary is contiguous with Indo-Myanmar International Boundary. (2) The boundary description of Kamlang and Namdapha Tiger Reserves along with the Eco-sensitive Zone around Kamlang Tiger Reserve and Namdapha Tiger Reserve is appended as Annexure-I. (3) The maps of the Kamlang Tiger Reserve and Namdapha Tiger Reserve demarcating Eco-sensitive Zone along with boundary details and geo-coordinates are appended as Annexure-IIA, Annexure-IIB and Annexure-IIC.
(4) Lists of geo coordinates of the boundary of Kamlang Tiger Reserve and Namdapha Tiger Reserve and its Eco- sensitive Zone are given in Table A, Table B and Table C appended as Annexure-III. (5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV. 2. Zonal Master Plan for Eco-sensitive Zone (1) The State Government shall, for the purpose of effective management of the Eco-sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State Government. (2) The Zonal Master Plan for the Eco-Sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan, namely; – (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue;. (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipality; (x) Pollution Control Board; (xi) Panchayati Raj; and (xii) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks and it’s like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local community’s livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. (10) Until the preparation of the Zonal Master Plan for the Eco-Sensitive Zone, all new construction and other developmental activities shall be referred to the Monitoring Committee. 3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely: - (1) Land use .- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State government as applicable and vide provisions of this notification, to meet the residential needs of local residents and for activities such as :- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries, convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given in paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies .- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism .- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone; 2) the Tourism Master Plan shall be prepared by the Department of Tourism in consultation with the Departments of Environment and Forests of the State Government; 3) the Tourism Master Plan shall form a component of the Zonal Master Plan; 4) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone; 5) the activities of eco-tourism shall be regulated as under, namely: - i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; ii) until the Zonal Master Plan is prepared and approved, development for tourism and expansion of existing tourism activities shall be permitted by the regulatory authorities concerned based on the actual site-specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage .- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites .- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-Sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution .- Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000. (7) Air pollution .- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under. (8) Discharge of effluents .- The discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made there under. (9) Solid wastes .- Disposal and management of solid wastes shall be as under :- (a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016. The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. (b) Safe and environmentally sound management of solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone
(10) Bio-medical waste .– Bio medical waste management shall be as under:

(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016. (b) Safe and environmentally sound management of bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 . (12) Construction and demolition waste management .- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016. (13) E-waste.- The e- waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016. (14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be complied with in accordance with applicable laws and efforts to be made for use of cleaner fuel such as CNG, LPG, etc. (16) Industrial units .– a) No new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.
b) Only non-polluting industries shall be allowed within the Eco-sensitive zone as per classification of Industries in the Guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted. (17) Protection of hill slopes .- The protection of hill slopes shall be as under:-
a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
b) Construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone .- All activities in the Eco- sensitive Zone shall be governed by the provisions of the Environment Act, and the rules made thereunder and notification of the Government of India , in the erstwhile Ministry of Environment and Forest, vide number 1533(E), dated the 14th September, 2006 and laws for the time being in force in the manner and as amended from time to time specified in the Table below, namely:- TABLE S.   1. Commercial mining, stone quarrying and crushing units. (a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses within Eco-sensitive Zone; (b) The mining operations shall be carried out in accordance with the order (s) of the Hon’ble Supreme Court in the matter of T.N. Godavarman Thirumulpad Vs. UoI in W.P.(C) No.202 of 1995 and Goa Foundation Vs. UoI in W.P.(C) No.435 of 2012 and IA No. 1000 of 2003 judgment dated 03.06.2022 and subsequent IA No. 131377 of 2022 judgment dated 26.04.2023 and 28.04.2023.

  1. Setting of industries causing pollution (Water, Air, Soil, Noise, etc.). New industries and expansion of existing polluting industries in the Eco- sensitive Zone shall not be permitted:
    Provided that, non-polluting industries shall be allowed within Eco- sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted.
  2. Establishment of major hydroelectric project. Prohibited.
  3. Use or production or processing of any hazardous substance. Prohibited.
  4. Discharge of untreated effluents in natural water bodies or land area. Prohibited.
  5. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.
  6. Setting up of brick kilns. Prohibited.
  7. Undertaking other activities related to tourism like over flying over the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc. Regulated as per the applicable laws. B. Regulated Activities
  8. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of Eco- sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:
    Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.
  9. Construction activities. New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub- paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents: Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any and beyond one kilometer it shall be regulated as per the Zonal Master Plan.
  10. Small scale non-polluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority.
  11. Felling of trees. (a) There shall be no felling of trees in the forest or Government or

revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder . 13. Collection of Forest Produce or Non-Timber Forest Produce. Regulated under applicable laws. 14. Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws and underground cabling may be promoted.

  1. Infrastructure including civic amenities. Shall be done with mitigation measures, as per the applicable laws, rules , regulations and available guidelines.

  2. Widening and strengthening of existing roads and construction of new roads. Shall be done with mitigation measures, as per the applicable laws, rules , regulations and available guidelines.

  3. Protection of hill slopes and river banks. Regulated as per the applicable laws.

  4. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.

  5. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted as per the applicable laws for use of locals.

  6. Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies. Regulated (except otherwise provided), as per the applicable laws except for meeting local needs.

  7. Discharge of treated waste water or effluents in natural water bodies or land area. The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water, otherwise, the discharge of treated waste water or effluent shall be regulated as per the applicable laws.

  8. Commercial extraction of surface and ground water. Regulated under applicable laws.

  9. Open well, bore well, etc. for agriculture or other usage. Regulated and the activity should be strictly monitored by the appropriate authority.

  10. Solid waste management. Regulated as per the applicable laws.

  11. Introduction of exotic species. Regulated as per the applicable laws.

  12. Eco-tourism. Regulated as per the applicable laws.

  13. Use of polythene bags. Regulated as per the applicable laws.

  14. Commercial sign boards and hoardings. Regulated as per the applicable laws. C. Promoted Activities

  1. Monitoring Committee .- There shall be a committee to be known as Monitoring Committee constituted by the Central Government which shall comprise of the following persons , namely: - (i)
    Deputy Commissioner, Changlang or Lohit District, Government of Arunachal Pradesh – Chairman, ex Officio; (ii)
    Member Secretary, Arunachal Pradesh State Pollution Control Board, Itanagar – Member, ex Officio; (iii)
    A representative of Non-Governmental Organisation working in the field of Wildlife Conservation (including heritage conservation) to be nominated by the State Government from time to time every three years – Member; (iv)
    An expert in the field of Ecology and Environment including Biodiversity from reputed Institution or University of the State to be nominated by the State Government from time to time every three years – Member; (v)
    Deputy Director, Urban Development Department, Changlang or Lohit District – Member, ex Officio; (vi)
    Executive Engineer, Rural works Department, Changlang or Lohit District – Member, ex Officio; (vii)

Executive Engineer, Public Health Engineering Department, Changlang or Lohit District – Member, ex Officio; (viii)

Conservator of Forests and Field Director, Namdapha National Park and Tiger Reserve, Miao and Divisional Forest Officer, Kamlang Wildlife Sanctuary Division, Wakro Member-Secretary,ex Officio. 6. Terms and Functions of the Monitoring Committee .- (1) The Monitoring Committee shall, based on the actual site- specific conditions scrutinise, the activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State 29. Rain water harvesting. Shall be actively promoted. 30. Organic farming. 31. Adoption of green technology for all activities. 32. Cottage industries including village artisans, etc. 33. Use of renewable energy and fuels. Bio-gas, solar light, etc. shall be actively promoted.
34. Agro-forestry. 35. Plantation of horticulture and herbals. 36. Use of eco-friendly transport. 37. Skill development. 38. Restoration of degraded land or forests or habitat. 39. Environmental awareness.

Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification. (2) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-Sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.
(4) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the state as per pro-forma appended at Annexure-V. (6) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Orders, Supreme Court, etc.:- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.

The boundary of buffer area starts from a point 1 km inside the southwest corner of Kamlang WLS (TR) at geo coordinates 27o39’13.108" N and 96o26'6.400" E, from thence, the boundary goes northwards 1 km parallel to reserve boundary passing through the point at geo – coordinates 27o44’27.244"N and 96o24’28.174”E. up to the point at geo- coordinates 27o53’52.998"N and 96o28'10.351"E. Thence, the boundary goes eastwards passing through the point at geo-coordinates 27°50"26.862"N and 96°35’1.165” E, upto to the point 27° 47’ 3. 304"N and 96°45'50.782" Thence, southwards passing through the point at geo - coordinates 27o41'58.164” N and 96°45’5.407” E upto the point 27°37'56.165"N and 96o49’36.606"E. Thence, east wards for 1 km where it meets the southeast corner of the reserve. NORTH: From the summit of Champai Bum east along the boundary between Tirap and Lohit Districts. i.e the ridge dividing the watershed of Kamlang and Diyun rivers to the Indo-Burma International boundary near the source of the Lati River through Dapha Bum.

EAST: From the above point south along the Indo-Burma International Boundary to the source of Tilung Hka. Point 12533, thence downstream to its confluence with Diyun River for about half a mile to the confluence of a nameless stream. Thence, upstream to its source, thence in north westerly direction along the ridge to pint 6472 at grid reference NS 38, 783 at Patkoi range.

SOUTH: From the above point grid reference NS 380 780 West along the Indo Burma international Boundary to the source of nameless stream that originate from its source at point 4557 at grid reference NS 975 750 AT Patkoi range.

WEST : From the above source thence downstream to its confluence with Namphuk River, thence downstream along Namphuk River to the confluence of Korvaiwa Hka, thence upstream of main Korvaiwa to the confluence of its north- western channel which originates from its source at about 1 mile 2 furlongs north of Teng Bum, thence upstream of thi channel to its source, thence in a westerly direction along the ridge dividing the watershed of Nanon and Kumchai Hka, to Aonaon Bum, thence across the ridge to the source of M’Pen Hka to Nanon Bum. Thence downstream along M’Pem Hka to Mioa-Vijayanagar Road.
