पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् अजधसूचना नई दिल्ली, 18 अक् तूबर, 2021 का.आ. 4373(अ).—प्रारुप अजधसूचना भारत के रािपत्र, असाधारण, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान, मंत्रालर् की अजधसूचना सं. का.आ. 653 (अ), तारीख 11 फरवरी, 2020, द्वारा प्रकाजित की गई थी जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करने वाली रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थे; और, उि प्रारूप अजधसूचना को अन्तर्वाष्ट करने वाली रािपत्र की प्रजतर्ां िनता को तारीख 11 फरवरी, 2020, को उपलब्ध करा िी गई थी; और, पूवोि प्रारुप अजधसूचना के प्रजतउत्तर में व्यजिर्ों और पणधाररर्ों से कोई आक्षेप और सुझाव प्राप्त नहीं हुए; और, नागािुानसागर श्रीिैलम बाघ ररज़वा (एनएसटीआर) आंध्र प्रिेि के नाल्लमारा पवातमाला (पूवी घाटों की िाखा) में जस्ट्थत है। कोर और बफर के साथ बाघ ररज़वा का कुल क्षेत्रफल 3727.82 वगा दकलोमीटर है िो आंध्र प्रिेि के प्रकािम, कुरनूल और गुंटूर जिलों में फैला है। बाघ ररज़वा के क्षेत्र का गठन िो वन्र्िीव अभर्ारण्र् अथाात् रािीव गांधी वन्र्िीव अभर्ारण्र् और गुंडला ब्रह्मेश्वरम् वन्र्िीव अभर्ारण्र् (िीबीएम) करते हैं। राज्र् के जद्वभािन के बाि, नागािुानसागर श्रीिैलम बाघ ररज़वा कृष्णा निी द्वारा िो भागों में जवभाजित हो गर्ा है। आंध्र प्रिेि में नागािुानसागर श्रीिैलम बाघ ररज़वा निी के िजक्षणी भाग में है और तेलंगाना राज्र् में अम्राबाि बाघ ररज़वा उत्तरी भाग में है। इस अजधसूचना में पाररजस्ट्थजतकी संवेिी िोन आंध्र प्रिेि के नागािुानसागर श्रीिैलम बाघ ररिवा के संबंध में है; सं. 4022] नई दिल्ली, बृहस्ट् पजतवार, अक् तूबर 21, 2021/आज‍ वन 29, 1943

THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, नागािुानसागर श्रीिैलम बाघ ररज़वा (एनएसटीआर), आंध्र प्रिेि में िजक्षणी पूवी घाटों के नाल्लमारा पवातमाला में िैव जवजवधता, लुप्तप्रार् वनस्ट्पजतर्ों और इससे संबंजधत िीविन्तु के जलए वास स्ट्थान है। र्ह बाघ ररज़वा िक्कन पठार (6डी, 6ई) की जवजिष्ट भौजतक और िैजवक जविेषताओं का प्रतीक है। बाघ ररज़वा का अजधकांि भाग पठारों,
पवात-श्रेणी, घारटर्ों/िरों और गहरी घारटर्ों के साथ पहाडी है िो बांस और घास कीकम उपि के साथ उष्णकरटबंधीर् जमजश्रत िुष्क पणापाती वनों का आश्रर् प्रिान करता है। िो अभर्ारण्र् अथाात्, रािीव गांधी वन्र्िीव अभर्ारण्र् और गुंडला ब्रह्मेश्वरम् अभर्ारण्र् बाघ ररज़वा बनाते हैं। वन्र्िीव (संरक्षण) अजधजनर्म, 1972 की धारा 26क िी.ओ. एमएस. सं. 84 ईएफएस एवं टी (फॉर-III) जवभाग, तारीख 27 िून, 1998 को रािीव गांधी वन्र्िीव अभर्ारण्र् को अंजतम अजधसूचना के जलए िारी दकर्ा गर्ा है। वन्र्िीव (संरक्षण) अजधजनर्म, 1972 की धारा 26ए िी.ओ. एमएस. सं. 81 ईएफएस एवं टी (फॉर-III) जवभाग, तारीख 27 िून, 1998 को गुंडला ब्रह्मेश्वरम् अभर्ारण्र् को अंजतम अजधसूचना के जलए िारी दकर्ा गर्ा है; और, नागािुानसागर श्रीिैलम बाघ ररज़वा जवजिष्ट िक्कन पठार (6डी, 6ई) की वनस्ट्पजत और िीविन्तु की प्रिाजतर्ों को ििााता है। अभर्ारण्र्ों में पहाडी क्षेत्र के साथ पठारों, पवात-श्रेणी, िरों और गहरी घारटर्ों की जवजिष्टता है, िो बांस और घास कीकम उपि के साथ उष्णकरटबंधीर् जमजश्रत िुष्क पणापाती और आर्द्ा पणापाती वनों का आश्रर् प्रिान करती है। संरजक्षत क्षेत्र वृक्षों, झाजडर्ों, िडी-बूरटर्ों और पवातारोजहर्ों से र्ुि समृद्ध वनस्ट्पजत जवजवधता से संपन्न है। औषधीर् पौधों की 353 प्रिाजतर्ों के साथ घास की 29 प्रिाजतर्ों और 149 पररवारों के लगभग 1521 एंजिर्ोस्ट्पमा टक्सा को प्रलेजखत दकर्ा गर्ा है। र्हां सबसे मुख्र् वृक्ष टर्मानजलर्ा टोमेंटोसा, एनोगाइसस लैरटफोजलर्ा, क्लोरोजक्सलीन स्ट्वेटेजनर्ा, हाडाजवदकर्ा जबनाटा, पेटरोकापास मासुाजपर्म, लैजनआ ग्ांजडस, बोसवेजलर्ा सेराटा, डालबरजिर्ा पैजनकुलाटा, जज़जज़फ़स ज़ाइलोपाइरस, लेगरोस्ट्रोइजमर्ा परजवफ्लोरा, टर्मानाजलर्ा अिुान, आदि पाए िाते हैं। र्हां नाल्लमालाई में जसफा कुछ स्ट्थाजनक पौधे िैसे एंड्रोग्ादफस नल्लमालर्ाना, एररओलेना लुशिंगटनी, क्रोटलाररर्ा मिुरेंजसस वर्. कुरनूजलर्ा, जडजक्लप्टेरा बेडडोजम और प्रेमा हैजमल्टनी, आदि पाए िाते हैं; और, रािीव गांधी वन्र्िीव अभर्ारण्र् और गुंडला ब्रह्मेश्वरम् वन्र्िीव अभर्ारण्र् पिुओं, पजक्षर्ों, कीडे- मकोडों, सरीसृपों और उभर्चरों की बृहत् जवजवधता को आश्रर् प्रिान करता है। संरजक्षत क्षेत्र में कई चररसमेकरट पिुओं िैसे बाघ (पेन्थेरा रटगररस), तेंिुआ (पेन्थेरा प्रड्यूस), रीछ (मेलसास अरजसनस), िंगली कुत्ता (कुओन अजल्पनस), जसर्ार (केजनस ऑररउस), रतेल (मेजल्लवोरा केपेंजसस), साही (जहस्ट्रीक्स स्ट्पा), जविाल जगलहरी (रतुफा इंजडका), माउस जडर्र (मोजस्ट्चओला स्ट्पा), चौशसंगा मृग (टेरासेरस क्वाजड्रकोर्नास), सांभर (रुसा र्ूनीक्लोर), जचत्तीिार जहरण (एजक्सस एजक्सस), नीलगार् (बोसेलाफुस रागोकेमेलुस) और बनैला सूअर (सस स्ट्क्रोफ़ा) का वास है। इस बाघ ररज़वा में िीविन्तु प्रिाजतर्ों में स्ट्तनधारी की 50 प्रिाजतर्ााँ, पजक्षर्ों की 200 प्रिाजतर्ााँ, सरीसृपों की 54 प्रिाजतर्ााँ, उभर्चरों की 18 प्रिाजतर्ााँ, मछजलर्ों की 5 प्रिाजतर्ााँ, जततजलर्ों की 84 प्रिाजतर्ााँ, मोथ की 57 प्रिाजतर्ााँ, कोजलर्प्रेन भृंग की 45 प्रिाजतर्ााँ, डैमस्ट्लेफ्लेइस् की 30 प्रिाजतर्ााँ, आदि प्रलेजखत हैं। बाघ ररज़वा में पिुओं, पजक्षर्ों, सरीसृपों, उभर्चरों, कीडे-मकोडों की बृहत् जवजवधता की उपजस्ट्थजत इस भू-िृ‍र् की िैव-जवजवधता का प्रमाण है; और, नागािुानसागर श्रीिैलम बाघ ररज़वा प्रार्द्वीप भारत के िक्कन पठार में जवजभन्न वनस्ट्पजतर्ों और िीविन्तुओं के साथ िैव जवजवधता का भंडार है। बाघ ररज़वा की स्ट्थलाकृजत जवजभन्न छोटे-बडे वासों के साथ जवजभन्न प्रकार के िंगली पिुओं को आश्रर् िेने में सक्षम बनाती है; और, राष्ट्रीर् उद्यानों और वन्र्िीव अभर्ारण्र्ों के आसपास पाररजस्ट्थजतकी संवेिी ज़ोन की घोषणा के जलए राष्ट्रीर् वन्र्िीव बोडा के द्वारा जनणार् जलर्ा गर्ा है। आंध्र प्रिेि सरकार ने अभर्ारण्र् के अंतगात और आदिवाजसर्ों और अन्र्ों को निी से प्राप्त होने वाली सुजवधाओं और अन्र् बाहरी जवकास दक्रर्ाकलापों के संबंध में आंध्र प्रिेि सरकार के मेमो सं. 11747/एफओआर-11(2)12006, ईएफएस एवं टी (एफओआर-III) जवभाग, तारीख 13 माचा, 2012 के द्वारा प्राकृजतक वातावरण में वन्र्िीवों की सुरक्षा व बचाव को ध्र्ान में रखते हुए संबंजधत जिला कलेक्टरों की अध्र्क्षता में सम्बद्ध जवभागों के परामिा से संरजक्षत क्षेत्रों के चारों ओर पाररजस्ट्थजतकी संवेिी ज़ोन की पहचान करने के जनिेि िारी दकए हैं। तिनुसार, कुनूाल, प्रकािम और गुंटूर जिलों के जिला कलेक्टरों और जिला मजिस्ट्रेटों द्वारा रािीव गांधी वन्र्िीव अभर्ारण्र् और अभर्ारण्र् के बफर क्षेत्र के चारों ओर पाररजस्ट्थजतकी संवेिी ज़ोन की घोषणा के जलए बैठक बुलाई गई थी। बैठक में र्ह चचाा की गई थी दक बफ़र ज़ोन क्षेत्र बाघ ररज़वा के जलए अच्छा आघात अविोषक के रूप में कार्ा करता है और वन्र्िीवों को आश्रर् प्रिान करता है िो मूल क्षेत्र से बाहर चले िाते हैं। बाघ ररज़वा को बेहतर सुरक्षा प्रिान करने और मूल क्षेत्र पर िबाव को कम करने और अजतररि सुरक्षा प्रिान करने के जलए बाघ ररज़वा के चारों ओर पाररजस्ट्थजतकी संवेिी ज़ोन प्रस्ट्ताजवत दकर्ा गर्ा है। िहां भी बाघ ररज़वा की रािस्ट्व भूजम से समीप "ररज़वा वन" नहीं हैं, उन्हें पाररजस्ट्थजतकी संवेिी

[भागII—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 ज़ोन के रूप में प्रस्ट्ताजवत दकर्ा गर्ा है। इसजलए, नागािुानसागर श्रीिैलम बाघ ररज़वा के आसपास पाररजस्ट्थजतकी संवेिी ज़ोन की आव‍र्कता है; और, नागािुानसागर श्रीिैलम बाघ ररज़वा के अंतगात चार वन संभाग अथाात्, अतामाकुर, मरकापुर, जगद्िुरुर और नंिर्ाल वन्र्िीव संभाग आते हैं। नागािुानसागर श्रीिैलम बाघ ररज़वा के पाररजस्ट्थजतकी संवेिी ज़ोन का कुछ भाग कृजष क्षेत्र है। र्ह कृजष भूजम सामान्र् रूप से पट्टा भूजम है और वैध रूप से रहने वालों द्वारा उपर्ोग में लार्ा िाता है। मुख्र् कृजष फसलें मक्का, मूंगफली, सूरिमुखी, जमचा, कपास, धान आदि हैं। पाररजस्ट्थजतकी संवेिी ज़ोन में जस्ट्थत कृजष क्षेत्र में िाकाहारी िानवर िैसे जहरण और िंगली सूअर और इनकी खोि में मांसाहारी िानवर अजधक िेखे िाते हैं।इस क्षेत्र को पाररजस्ट्थजतकी संवेिी ज़ोन घोजषत करने पर, वन्र्िीवों और इसके वास को अजतररि सुरक्षा जमलती है। ग्ामीणों जविेषतः उन दकसानों की आिीजवका दक्रर्ाकलाप, जिनकी भूजम पाररजस्ट्थजतकी संवेिी ज़ोन के अंतगात आती हैं, प्रभाजवत नहीं होंगे क्र्ोंदक वन क्षेत्र के बाहर रािस्ट्व भूजम में चल रही कृजष प्रथाओं और अन्र् पारंपररक आिीजवका दक्रर्ाकलापों के जलए कोई प्रजतबंध नहीं है; और, नागािुानसागर श्रीिैलम बाघ ररज़वा के चारों ओर के क्षेत्र को, जिसका जवस्ट्तार और सीमाएं पाररजस्ट्थजतकी पर्ाावरणीर् से पाररजस्ट्थजतकी संवेिी िोन के रूप में पैरा 1 में जवजनर्िाष्ट हैं, िैव जवजवजधता की िृजष्ट सुरजक्षत और संरजक्षत करना और उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों के वगों के प्रचालन और प्रसंस्ट्करण करने को प्रजतजषद्ध करना आव‍र्क है; अतः, अब, केन्र्द्ीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जिसे इस अजधसूचना में इसके पश्चात् पर्ाावरण अजधजनर्म कहा गर्ा है) की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, आंध्र प्रिेि राज्र् के जिला प्रकािम, कुरनूल और गुंटूर में नागािुानसागर श्रीिैलम बाघ ररज़वा की सीमा के चारों ओर 0 (िून्र्) से 26 दकलोमीटर जवस्ट्ताररत क्षेत्र को नागािुानसागर श्रीिैलम बाघ ररज़वा पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके प‍ चात् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा है) के रूप में अजधसूजचत करती है, जिसका जववरण जनम्नानुसार है, अथाात् :-

पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार और सीमाएं.- (1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार नागािुानसागर श्रीिैलम बाघ ररज़वा की सीमा के चारों ओर 0 (िून्र्) से 26 दकलोमीटर की िूरी तक है और पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल 2149.68 वगा दकलोमीटर है। (कृष्णा निी और तेलंगाना के साथ अंतरराज्र्ीर् सीमा के कारण पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार िून्र् है।) (2) नागािुानसागर श्रीिैलम बाघ ररज़वा और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का वणान उपाबंध-I के रूप में संलग्न है। (3) सीमा जववरण और अक्षांि और िेिांतर के साथ पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करते हुए नागािुानसागर श्रीिैलम बाघ ररज़वा के मानजचत्र उपाबंध-IIक, उपाबंध-IIख और उपाबंध-IIग के रूप में संलग्न है। (4) पाररजस्ट्थजतकी संवेिी िोन और नागािुानसागर श्रीिैलम बाघ ररज़वा की सीमा के भू-जनिेिांकों की सूची उपाबंध-III के सारणी क और सारणी ख में िी गई है। (5) मुख्र् शबंिुओं के भू-जनिेिांकों के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाले ग्ामों की सूची उपाबंध-IV के रूप में संलग्न है।
पाररजस्ट्थजतकी संवेिी िोन के जलए आंचजलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो वषा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्र् के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसूचना में दिए गए अनुबंधों का पालन करते हुए आंचजलक महार्ोिना तैर्ार करेगी और राज्र् में सक्षम प्राजधकारी द्वारा जवजधवत अनुमोदित दकर्ा िाएगा। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत से िो इस अजधसूचना में जवजनर्िाष् ट दकए गए हैं, के अनुसार तथा सुसंगत केंर्द्ीर् और राज् र् जवजधर्ों के अनुरुप और केंर्द्ीर् सरकार द्वारा िारी मागाजनिेिों, र्दि कोई हों, द्वारा तैर्ार होगी । (3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करने के जलए राज् र् सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार होगी:-

(i) पर्ाावरण; (ii) वन और वन्र्िीव; (iii) पर्ाटन; (iv) आदिवासी कल्र्ाण; (v) कृजष; (vi) शसंचाई और बाढ़ जनर्ंत्रण; (vii) पंचार्ती राि; (viii) रािस्ट्व; (ix) ग्ामीण और िहरी जवकास; (x) उद्योग; (xi) नगरपाजलका; (xii) आंध्र प्रिेि के पारेषण जनगम (एपीटीआरएएनएससीओ); (xiii) आंध्र प्रिेि राज्र् प्रिूषण जनर्ंत्रण बोडा; और (xiv) लोक जन मााण जव भाग। (4) आंचजलक महार्ोिना अनुमोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िाष् ट न हो और आचंजलक महार्ोिना सभी अवसंरचना और दक्रर्ाकलापों में, िो अजधक िक्षता और पाररजस्ट्थजतकी अनुकूल हों, का संवधान करेगी ।
(5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की आव‍र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण से संबंजधत ऐसे अन्र् पहलुओं, जिन पर ध्र्ान िेना आव‍र्क है, के जलए उपबंध होंगे । (6) आंचजलक महार्ोिना जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेषताओं के ब्र्ौरों से अनुसमर्थात मानजचत्र के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्ामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, कृजष क्षेत्रों, ऊपिाऊ भूजम, हररत क्षेत्र िैसे उद्यान और उसी प्रकार के स्ट् थान, उद्यान कृजष क्षेत्र, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभर्ांकन करेगी।
(7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करने के जलए प्रदकर्ा प्रिान की िाएगी और सारणी में सूचीबद्ध पैरा-4 में प्रजतजषद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन करेगी और स्ट् थानीर् समुिार्ों की िीजवका को सुरजक्षत करने के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजश्चत और उसकी अजभवृजद्ध भी करेगी।
(8) आंचजलक महार्ोिना प्रािेजिक जवकास र्ोिना की सह जवस्ट्तारी होगी । (9) राज्र् सरकार द्वारा अनुमोदित आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक संिभा िस्ट्तावेि होगी तादक वह इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपने कताव्यों का जनवाहन कर सके। 3. राज्र् सरकार द्वारा दकए िाने वाले उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करने के जलए जनम्नजलजखत उपार् करेगी, अथाात्:- (1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजष क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए जचजन्हत दकए गए पाकों और खुले स्ट्थानों का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक संबद्ध जवकास दक्रर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नहीं होगा: परंतु पाररजस्ट्थजतकी संवेिी िोन के भीतर खंड (क) में जवजनर्िाष्ट प्रर्ोिनों से जभन्न प्रर्ोिनों के जलए कृजष और अन्र् भूजम का संपररवतान जनगरानी सजमजत की जसफाररि पर और र्था लागू और क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्र्द्ीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से, और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आव‍र्कताओं को पूरा करने के जलए अनुज्ञात दकर्ा िाएगा, िैसे-

[भागII—खण् ड 3(ii)] 5 (i) जवद्यमान सडकों को चौडा करना और उन्हें सुिृढ़ करना तथा नई सडकों का संजनमााण; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रिूषण उत्पन्न न करने वाले लघु उद्योग; (iv) कुटीर उद्योगों जिनके अंतगात ग्ामीण उद्योग भी हैं; सुजवधािनक भण्डार और स्ट्थानीर् सुजवधाएं सहार्क पाररजस्ट्थजतकी पर्ाटन जिसके अन्तगात गृह वास सजम्मजलत है; और (v) पैरा 4 में दिए गए संवर्धात दक्रर्ाकलाप:

परंतु र्ह और दक प्रािेजिक नगर र्ोिना अजधजनर्म और राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन और संजवधान के अनुच्छेि 244 के उपबंधों र्ा तत्समर् प्रवृत्त जवजध के उपबंधों के अनुपालन के जबना, जिसके अधीन अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी है, वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनुज्ञात नहीं होगा:
परंतु र्ह और भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भू-अजभलेखों में उपसंिात कोई गलती, जनगरानी सजमजत के जवचार प्राप्त करने के पश्चात् राज्र् सरकार द्वारा प्रत्र्ेक मामले में एक बार ठीक होगी और उि गलती के सुधार की सूचना केंर्द्ीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी:
परंतु र्ह और भी दक गलती के सुधार में इस उप पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा में भू-उपर्ोग का पररवतान सजम्मजलत नहीं होगा।
(ख) वनीकरण तथा वास िीणोद्धार दक्रर्ाकलापों सजहत अनप्रर्ुक् त र्ा अनुत् पािक कृजष क्षेत्रों में पुन: वनीकरण करने के प्रर्ास दकए िाएंगे। (2) प्राकृजतक िल स्रोत.- आचंजलक महार्ोिना में सभी प्राकृजतक झरनों के आवाह क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण के जलए र्ोिना सजम् मजलत होगी और राज् र् सरकार द्वारा ऐसे क्षेत्रों पर र्ा उनके जनकट जवकास दक्रर्ाकलाप प्रजतजषद्ध करने के बारे में िो ऐसे क्षेत्रों के जलए अजहतकर हो ऐसी रीजत से मागाििाक जसद्धांत तैर्ार दकए िाएंगे। (3) पर्ाटन र्ा पाररजस्ट्थजतकी पर्ाटन.- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी संवेिी िोन के जलए होगा।
(ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना राज्र् पर्ाटन जवभाग द्वारा राज्र् पर्ाावरण और वन जवभाग के परामिा से तैर्ार होगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना के एक घटक के रूप में होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िाएगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनम्नानुसार जवजनर्जमत होंगे, अथाात्:- (i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट है, नर्े वाजणजज्र्क होटल और ररिॉटा के सजन्नमााण अनुज्ञात नहीं होंगे:

परंतु, र्ह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर की िूरी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक होटलों और ररिॉटा का स्ट्थापना केवल पूवा पररभाजषत और नामजनर्िाष्ट क्षेत्रों में पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए ही अनुज्ञात होगा; (ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार केंर्द्ीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् के मागाििाक जसद्धांतों के द्वारा तथा राष् रीर् ा र्ाघ्र स संरक्षण प्राजधकरण, द्वारा िारी पाररजस्ट्थजतकी–पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेते हुए (समर्- समर् पर र्था संिोजधत) िारी मागाििाक जसद्धांतों के अनुसार होगा;

(iii) आंचजलक महार्ोिना का अनुमोिन दकए िाने तक, पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्िाष्ट संवीक्षा और जनगरानी सजमजत की जसफाररि पर आधाररत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए होटल र्ा ररसोटा र्ा वाजणजज्र्क स्ट्थापना का संजनमााण अनुज्ञात नहीं दकर्ा िार्ेगा । (4) नैसर्गाक जवरासत.- पाररजस्ट्थजतकी संवेिी िोन में महत्वपूणा नैसर्गाक जवरासत के सभी स्ट्थलों िैसे िीन कोि आरजक्षत क्षेत्र, िैल जवरचनाएं, िल प्रपातों, झरनों, घाटी मागों, उपवनों, गुफाएं, स्ट्थलों, भ्रमण, अश्वरोहण, प्रपातों आदि की पहचान की िाएगी और जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रुप में परररक्षण और संरक्षण के जलए तैर्ार की िाएगी । (5) मानव जनर्मात जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, जिल्प-तथ्र्, ऐजतहाजसक, स्ट्थापत्र्, सौंिर्ापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और उपक्षेत्रों पहचान और उनके संरक्षण के जलए जवरासत र्ोिना आंचजलक महार्ोिना के भाग के रुप में तैर्ार की िाएगी।
(6) ध् वजन प्रिूषण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रिूषण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 में जनर्त उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रिूषण के जनर्ंत्रण और जनवारण का अनुपालन दकर्ा िाएगा।
(7) वार्ु प्रिूषण.- पाररजस्ट्थजतकी संवेिी िोन में, वार्ु प्रिूषण के जनवारण और जनर्ंत्रण का वार्ु (प्रिूषण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार अनुपालन दकर्ा िाएगा।
(8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सरण, साधारण मानकों के उपबंधों के अनुसार पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आने वाले पर्ाावरणीर् प्रिूषण के जनस्ट्सरण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक कठोर हो, के उपबंधों के अनुसार होगा। (9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1357(अ), तारीख 8 अप्रैल, 2016 के द्वारा प्रकाजित ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा। (10) िैव जचदकत्सा अपजिष् ट.- िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा.- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016, के द्वारा प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा;
(ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा। (11) प्लाजस्ट्टक अपजिष्ट प्रबंधन.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (12) जनमााण और जवध्वंस अपजिष्ट प्रबंधन.- पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सां.का.जन 317(अ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा । (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत द्वारा प्रकाजित ई–अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

[भागII—खण् ड 3(ii)] 7 (14) र्ानीर् र्ातार्ात.- र्ातार्ात की र्ानीर् गजतजवजधर्ां आवास के अनुकूल जवजनर्जमत होंगी और इस संबंध में आंचजलक महार्ोिना में जविेष उपबंध सजम्मजलत दकए िाएंगे और आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित होने तक, जनगरानी सजमजत सुसंगत अजधजनर्मों और उसके अधीन बनाए गए जनर्मों और जवजनर्मों के अनुसार र्ानीर् दक्रर्ाकलापों के अनुपालन को जनगरानी करेगी। (15) र्ानीर् प्रिूषण.- लागू जवजधर्ों के अनुपालन में वाहन प्रिूषण का जनवारण और जनर्ंत्रण दकर्ा िाएगा और स्ट्वच्छक ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ां.- (क) रािपत्र में इस अजधसूचना के प्रकािन पर र्ा उसके पश्चात् पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिूजषत उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी।
(ख) केन्र्द्ीर् प्रिूषण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी समर्-समर् पर र्था संिोजधत मागाििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गैर-प्रिूषणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रिूषणकारी उद्योगों को बढ़ावा दिर्ा िाएगा। (17) पहाडी ढलानों को संरक्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार होगा:- (क) आंचजलक महार्ोिना पहाडी ढलानों पर क्षेत्रों का संकेत होगा िहां दकसी भी संजनमााण की अनुज्ञा नहीं िी िाएगी; (ख) कटाव के एक उच्च जडग्ी के साथ जवद्यमान खडी पहाडी ढलानों र्ा ढलानों पर दकसी भी संजनमााण की अनुज्ञा नहीं िी िाएगी । 4. पाररजस्ट्थजतकी संवेिी िोन में प्रजतजषद्ध और जवजनर्जमत दकए िाने वाले दक्रर्ाकलापों की सूची.- पाररजस्ट्थजतकी संवेिी िोन में सभी दक्रर्ाकलाप पर्ाावरण अजधजनर्म के उपबंधों और उसके अधीन बनाए गए जनर्मों जिसके अन्तगात तटीर् जवजनर्मन िोन, 2011 और पर्ाावरणीर् समाघात जनधाारण अजधसूचना, 2006 और अन्र् लागू जवजधर्ों के जिसमें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) सजम्मजलत हैं और दकर्े गर्े संिोधनों द्वारा िाजसत होंगे और नीचे िी गई सारणी में जवजनर्िाष्ट रीजत में जवजनर्जमत होंगे, अथाात् :- सारणी क्रम सं. वाजणजज्र्क खनन, पत्थर उत्खनन और अपघषाण इकाइर्ां ।
(क) पाररजस्ट्थजतकी संवेिी िोन के भीतर वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेलू आव‍र्कताओं जिसमें मकानों के संजनमााण र्ा मरम्मत के जलए धरती को खोिना सजम्मजलत है, के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनि), पत्थर उत्खनन और अपघषाण इकाइर्ां तत्काल प्रभाव से प्रजतजषद्ध होंगी; (ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) सं. 202 में टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले में माननीर् उच्चतम न्र्ार्ालर् के आिेि 4 अगस्ट्त, 2006 और 2012 की ररट र्ाजचका (जसजवल) सं. 435 में गोवा फाउंडेिन बनाम भारत संघ के मामले में तारीख 21 अप्रैल, 2014 के आिेि के अनुसरण में होगा । 2.

प्रिूषण (िल, वार्ु, मृिा, ध्वजन, आदि) उत्पन्न करने वाले उद्योगों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रिूषणकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नहीं होगी: परन्तु, केन्र्द्ीर् प्रिूषण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी समर्-समर् पर र्था संिोजधत मागाििाक जसद्धान्तों में

उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना में ऐसा जवजनर्िाष्ट न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गैर- प्रिूषणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि गैर-प्रिूषणकारी कुटीर उद्यागों को बढ़ावा दिर्ा िाएगा। 3. बृहत िल जवद्युत पररर्ोिना की स्ट्थापना । प्रजतजषद्ध।

दकसी पररसंकटमर् पिाथा का उपर्ोग र्ा उत्पािन र्ा प्रसंस्ट्करण। प्रजतजषद्ध।
5.

प्राकृजतक िल जनकार्ों र्ा क्षेत्र भूजम में अनुपचाररत बजहस्रााव का जनस्ट्सरण । प्रजतजषद्ध।
6.

नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई आरा जमलों की स्ट्थापना और जवद्यमान आरा जमलों का जवस्ट् तार अनुज्ञात नहीं होगा।
7.

ईंट भट्टों की स्ट्थापना करना। प्रजतजषद्ध।
8.

िलावन लकडी का वाजणजज्र्क उपर्ोग। प्रजतजषद्ध। आ. जवजनर्जमत दक्रर्ाकलाप 9.

वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना । पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों लघु अस्ट्थार्ी संरचनाओं के जसवार् संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट है, नए वाजणजज्र्क होटल और ररसोटों को अनुज्ञात नहीं दकर्ा िाएगा: परंतु, र्ह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के परे र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक इनमें से, िो भी जनकट हो सभी नए पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान दक्रर्ाकलाप का जवस्ट्तार पर्ाटन महार्ोिना और र्था लागू मागाििी जसद्धांतों के अनुरुप होगा। 10.

संजनमााण दक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट हो, दकसी भी प्रकार के नर्े वाजणजज्र्क संजनमााण की अनुज्ञा नहीं होगी: परंतु र्ह दक स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत आव‍र्कताओं को पूरा करने के जलए, पैरा 3 के उप पैरा (1) में सूचीबद्ध दक्रर्ाकलापों सजहत अपने उपर्ोग के जलए, अपनी भूजम में भवन उप-जवजधर्ों के अनुसार, संजनमााण करने की अनुज्ञा होगी: परंतु र्ह दक गैर–प्रिूषणकारी लघु उद्योगों से संबंजधत संजनमााण दक्रर्ाकलाप लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत से जवजनर्जमत दकए िाएंगे और वे न्र्ूनतम होंगे ।
(ख) एक दकलोमीटर क्षेत्र से परे र्े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे । 11.

प्रिूषण उत्पन्न न करने वाले लघु उद्योग। फरवरी, 2016 में केन्र्द्ीर् प्रिूषण जनर्ंत्रण बोडा द्वारा िारी उद्योगों में वगीकरण के अनुसार समर्-समर् पर र्था संिोजधत गैर- प्रिूषणकारी उद्योग और अपररसंकटमर् में, लघु और सेवा उद्योग, कृजष, पुष्प कृजष, उद्यान कृजष र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्ी से उत्पािों को उत्पन्न करने वाले कृजष आधाररत उद्योग

[भागII—खण् ड 3(ii)] 9 सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे। 12.

वृक्षों की कटाई। (क) राज्र् सरकार में सक्षम प्राजधकारी की पूवा अनुज्ञा के जबना वन, सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर र्ा वनों में वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत केंर्द्ीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंध के अनुसार जवजनर्जमत होगे । 13.

नागररक सुख सुजवधाओं सजहत अवसंरचनाएं । न्र्ूनीकरण उपार्ों को लागू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाएगा । 16.

जवद्यमान सडकों को चौडा करना और उन्हें सुिृढ़ करना तथा नवीन सडकों का संजनमााण । न्र्ूनीकरण उपार्ों को लागू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाएगा । 17.

पर्ाटन से संबंजधत अन्र् दक्रर्ाकलाप िैसे गमा वार्ु गुब्बारें, हेलीकॉप्टर, ड्रोन, माइक्रोलाइटस, आदि द्वारा पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से उडना िैसे दक्रर्ाकलाप करना। 18.

पहाडी ढालों और निी तटों का संरक्षण । 19.

राजत्र में र्ाजनक र्ातार्ात का संचलन । लागू जवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होंगे । 20.

स्ट्थानीर् समुिार्ों द्वारा चल रही कृजष और बागवानी प्रथाओं के साथ िुग्धिाला, िुग्घ उद्योग, कृजष और मछली पालन । स्ट्थानीर् लोगों के उपर्ोग के जलए लागू जवजधर्ों के अधीन अनुज्ञात होंगे । 21.

फमों, जनगम और कंपजनर्ों द्वारा बडे पैमाने पर वाजणजज्र्क पिुओं और कुक्कुट फामों की स्ट्थापना । स्ट्थानीर् आव‍र्कताओं को पूरा करने के जलए लागू जवजधर्ों के अधीन जवजनर्जमत (अन्र्था प्रिान दकए गए) होंगे । 22.

जवचाराथा-जवषर्.- (1) जनगरानी सजमजत इस अजधसूचना के उपबंधों के अनुपालन को जनगरानी करेगी।
(2) जनगरानी सजमजत का कार्ाकाल अगले आिेि होने तक दकर्ा िाएगा, परंतु र्ह दक सजमजत के गैर-सरकारी सिस्ट्र्ों को समर्-समर् पर राज्र् सरकार द्वारा नामजनर्िाष्ट दकर्ा िाएगा। (3) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533 (अ), तारीख 14 जसतम्बर, 2006 की अनुसूची में सजम्मजलत हैं, और िो पाररजस्ट्थजतकी संवेिी िोन में आते हैं, जसवार् इसके िो पैरा 4 के अधीन सारणी में र्था जवजनर्िाष्ट प्रजतजषद्ध दक्रर्ाकलापों के, जनगरानी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त के जलए केंर्द्ीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को जनर्िाष्ट दकर्ा िाएगा। (4) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533 (अ) तारीख 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत नहीं है, और िो पाररजस्ट्थजतकी संवेिी िोन में आते हैं, जसवार् इसके पैरा 4 के अधीन सारणी में र्थाजवर्नाष्ट प्रजतजषद्ध दक्रलाकलापों के जनगरानी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे संबद्ध जवजनर्ामक प्राजधकरणों को जनर्िाष्ट दकर्ा िाएगा।
(5) जनगरानी सजमजत का सिस्ट्र्-सजचव र्ा संबद्ध उपार्ुि ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लंघन करता है, पर्ाावरण अजधजनर्म की धारा 19 के अधीन पररवाि फाइल करने के जलए सक्षम होगा। (6) जनगरानी सजमजत मुद्दा िर मुद्दा के आधार पर अपेक्षाओं पर जनभार रहते हुए संबद्ध जवभागों के प्रजतजनजधर्ों र्ा जविेषज्ञों, औद्योजगक संगमों र्ा संबद्ध पणधाररर्ों के प्रजतजनजधर्ों को अपने जवचार-जवमिा में सहार्ता के जलए आमंजत्रत कर सकेगी । (7) जनगरानी सजमजत प्रत्र्ेक वषा की 31 माचा तक के अपने दक्रर्ाकलापों की वार्षाक कारावाई ररपोटा राज् र् के मुख् र् वन् र्िीव वाडान को उपाबंध-V में संलग्न प्रोफामाा में उक् त वषा के 30 िून तक प्रस्ट्तुत करेगी । (8) केन्र्द्ीर् सरकार का पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् जनगरानी सजमजत को अपने कृत्र्ों के प्रभावी जनवाहन के जलए ऐसे जनिेि िे सकेगा, िो वह ठीक समझे ।
अजतररक् त उपार्.- इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए केंर्द्ीर् सरकार और राज् र् सरकार, अजतररक् त उपार्, र्दि कोई हों, जवजनर्िाष् ट कर सकेंगी।

[भागII—खण्‍ड 3(ii)] भारत‍का‍राजपत्र‍:‍असाधारण 23 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 18th October, 2021 S.O. 4373(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O.653 (E), dated the 11th February, 2020, inviting objections and suggestions from all persons likely to be affected thereby within a period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 11th February, 2020; AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response to the draft notification; AND WHEREAS, Nagarjunasagar Srisailam Tiger Reserve (NSTR) is located in the Nallamara hill ranges (offshoot of Eastern Ghats) of Andhra Pradesh. The total area of the Tiger Reserve with core and buffer is 3727.82 square kilometres spread over Prakasam, Kurnool and Guntur Districts of Andhra Pradesh. The Tiger Reserve is constituted by two Wildlife Sanctuaries namely, Rajiv Gandhi Wildlife Sanctuary and Gundla Brahmeswaram Wildlife Sanctuary (GBM). After State bifurcation, Nagarjunasagar Srisailam Tiger Reserve has also been divided into two halves separated by river Krishna. The southern side of river is Nagarjunasagar Srisailam Tiger Reserve in Andhra Pradesh and the northern side is Amrabad Tiger Reserve in Telangana State. The Eco-sensitive Zone in this notification is in respect of the Nagarjunasagar Srisailam Tiger Reserve of Andhra Pradesh; AND WHEREAS, Nagarjunasagar Srisailam Tiger Reserve, in the Nallamara ranges of southern Eastern Ghats in Andhra Pradesh is an abode for biodiversity, endangered flora and its associated fauna. This Tiger Reserve epitomises typical physical and biological features of Deccan plateau (6D, 6E). Most of the Tiger Reserve is hilly with plateaus, ridges, gorges and deep valleys which support tropical mixed dry deciduous forests with an under growth of bamboo and grass. Two Sanctuaries viz, Rajiv Gandhi Wildlife Sanctuary and Gundla Brahmeswaram Sanctuary form the Tiger Reserve. The final notification has been issued for Rajiv Gandhi Wildlife Sanctuary under section 26A of the Wildlife (Protection) Act, 1972 vide G.O. Ms. No. 84 EFS&T (For-III) dept., dated the 27th June, 1998. The final notification for Gundla Brahmeswaram Wildlife Sanctuary was issued under section 26A of the Wildlife (Protection) Act, 1972 vide G.O.Ms. No.81, EFS&T (For-III), dated the 27th June, 1998; AND WHEREAS, Nagarjunasagar Srisailam Tiger Reserve epitomises a typical Deccan Plateau (6D, 6E) species of flora and fauna. The Sanctuaries are characterised by hilly terrain with plateaus, ridges, gorges and deep valleys which support tropical mixed dry deciduous and moist deciduous forests with an under growth of bamboo and grass. The protected area is endowed with a rich floral diversity comprising of trees, shrubs, herbs and climbers. Around 1521 angiosperm taxa of 149 families and 29 species of grass along with 353 species of medicinal plants have been documented. The most predominant trees found here are Terminalia tomentosa, Anogeissus latifolia, Chloroxylon swietenia, Hardwickia binata, Pterocarpus marsupium, Lannea grandis, Boswellia serrata, Dalbergia paniculata, Zizyphus xylopyrus, Lagerstroemia parviflora, Terminalia arjuna, etc. There are certain endemic plants found only in Nallamalais like Andrographis nallamalayana, Eriolaena lushingtonii, Crotalaria madurensis var. kurnoolia, Dicliptera beddomei and Premna hamiltonii, etc; AND WHEREAS, Rajiv Gandhi Wildlife Sanctuary and Gundla Brahmeswaram Wildlife Sanctuary support a wide variety of animals, birds, insects, reptiles and amphibians. The protected areas are the home to many charismatic animals like tiger (Panthera tigris), leopard (Panthera pardus), sloth bear (Melursus ursinus), wild dog (Cuon alpinus), jackal (Canis aureus), ratel (Mellivora capensis), porcupine (Hystrix sp.), giant squirrel (Ratufa indica), mouse deer (Moschiola sp.), four horned antelope (Tetracerus quadricornis), sambar (Rusa unicolor), spotted deer (Axis axis), nilgai (Boselaphus tragocamelus) and wild boar (Sus scrofa). The faunal species documented in this Tiger Reserve are 50 species of mammal, 200 species of birds, 54 species of reptiles, 18 species of amphibians, 5 species of fishes, 84 species of butterflies, 57 species of moths, 45 species of coleopteran beetles, 30 species of damselflies, etc. The presence of wide variety of animals, birds, reptiles, amphibians, insects in the Tiger Reserve is a testimony to the bio-diversity of this landscape;
AND WHEREAS, Nagarjunasagar Srisailam Tiger Reserve is a repository of biodiversity with varied flora and fauna in Deccan plateau of peninsular India. The topography of the Tiger Reserve enables the occurrence of varied micro and macro habitats to shelter variety of wild animals; AND WHEREAS, the National Board for Wildlife has taken decision for declaration of Eco-sensitive Zones around National Parks and Wildlife Sanctuaries. The Government of Andhra Pradesh have issued instructions to identify Eco-sensitive Zones around the protected areas in consultation with the line Departments under the Chairmanship of concerned District Collectors keeping in view the safety, security of wildlife in its natural environment within the Sanctuary and the river hood opportunities of the tribals and others, and other development

activities outside vide Government of Andhra Pradesh Memo No. 11747/For- 11(2)12006, EFS&T (For-III) Dept, dated the 13th March, 2012. Accordingly meetings were convened by the District Collectors and District Magistrates of Kurnool, Prakasam and Guntur Districts for declaration of Eco-sensitive Zone all round the Rajiv Gandhi Wildlife Sanctuary and buffer area of the Sanctuary. It was discussed in the meetings that the Buffer Zone area acts as a good shock absorber for the Tiger Reserve and support wildlife that disperse out from the core area. In order to provide better protection to the Tiger Reserve and to minimise the pressure on the core area and to provide additional protection, Eco-sensitive Zone has been proposed all around the Tiger Reserve; wherever there are no "Reserve Forests" adjoining the Tiger Reserve, revenue lands have been proposed as Eco-sensitive Zone. Hence, there is a need of Eco-sensitive Zone around the Nagarjunasagar Srisailam Tiger Reserve; AND WHEREAS, the Nagarjunasagar Srisailam Tiger Reserve is falling in four forest divisions viz, Atmakur, Markapur, Giddarur and Nandyal wildlife divisions. Some parts of the Eco-sensitive Zone of the Tiger Reserve are agricultural fields. These agricultural lands are patta lands in general and are legally enjoyed by the occupants. The main agricultural crops are maize, groundnut, sunflower, chillies, cotton, paddy, etc. The agricultural fields located in the Eco-sensitive Zone are frequented by the herbivores like deer and wild boar and carnivores follow in search of these animals. On declaration of this area as Eco-sensitive Zone, there will be additional protection to the Wildlife and its habitat. Livelihood activities of the villagers especially farmers, whose lands are falling in the Eco- sensitive Zone will not be affected as there are no restrictions for the ongoing agricultural practices and other traditional livelihood activities in the revenue lands outside the forest area; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1, around the Nagarjunasagar Srisailam Tiger Reserve as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0 (zero) to 26 kilometres around the boundary of Nagarjunasagar Srisailam Tiger Reserve, in Prakasam, Kurnool and Guntur Districts in the State of Andhra Pradesh as the Nagarjunasagar Srisailam Tiger Reserve Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: -

Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 0 (zero) to 26 kilometres around the boundary of Nagarjunasagar Srisailam Tiger Reserve and the area of the Eco-sensitive Zone is 2149.68 square kilometres. (Zero extent of Eco-sensitive Zone is due to Krishna River and interstate boundary with Telangana). (2) The boundary description of Nagarjunasagar Srisailam Tiger Reserve and its Eco-sensitive Zone is appended in Annexure-I. (3) The maps of the Nagarjunasagar Srisailam Tiger Reserve demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB and Annexure- IIC. (4) Lists of geo-coordinates of the boundary of Nagarjunasagar Srisailam Tiger Reserve and Eco-sensitive Zone are given in Table A and Table B of Annexure-III. (5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV.
Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco- sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification and get it duly approved by the competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife;

[भागII—खण्‍ड 3(ii)] 25 (iii) Tourism; (iv) Tribal Welfare; (v) Agriculture;
(vi) Irrigation and Flood Control;
(vii) Panchayati Raj; (viii) Revenue; (ix) Rural and Urban Development; (x) Industries; (xi) Municipal; (xii) Transmission Corporation Of Andhra Pradesh (APTRANSCO); (xiii) Andhra Pradesh State Pollution Control Board; and (xiv) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall provide mechanism for regulating developmental activities in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved by the State Government shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified in clause (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as- (i)
widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the

[भागII—खण्‍ड 3(ii)] 27 Environment Act and the rules made thereunder or standards stipulated by the State Government, whichever is more stringent. (9) Solid wastes.- Disposal and management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-medical waste.– Bio-medical waste management shall be as under:- (a) the Bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act and the rules made thereunder including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the

Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE

Setting of industries causing pollution (water, air, soil, noise, etc.). New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted: Provided that non-polluting industries shall be allowed within the Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition the non-polluting cottage industries shall be promoted.

Establishment of major hydro-electric project. Prohibited. 4.
Use or production or processing of any hazardous substances. Prohibited. 5.
Discharge of untreated effluents in natural water bodies or land area. Prohibited. 6.
Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone. 7.
Setting up of brick kilns. Prohibited. 8.
Commercial use of firewood. Prohibited. B. Regulated Activities 9.
Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities: Provided that, beyond one kilometer from the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. 10.
Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the

No. (1) Activity (2) Description (3) protected area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents: Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
11.
Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent authority. 12.
Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 13.
Collection of Forest Produce or Non- Timber Forest Produce. Regulated as per the applicable laws. 14.
Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws (underground cabling may be promoted).

Infrastructure including civic amenities. Taking measures of mitigation as per the applicable laws, rules and regulations and available guidelines. 16.
Widening and strengthening of existing roads and construction of new roads. Taking measures of mitigation as per the applicable laws, rules and regulations and available guidelines.
17.
Undertaking other activities related to tourism like flying over the Eco-sensitive Zone area by hot air balloon, helicopter, drones, microlites, etc. 18.
Protection of hill slopes and river banks. 19.
Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
20.
Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted as per the applicable laws for use of locals. 21.
Establishment of large-scale commercial livestock and poultry farms by firms, Regulated (except otherwise provided) as per the applicable laws except for meeting local needs.

Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the
31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended as Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

Then the line runs towards north west direction in zigzag manner along the western boundary of compartment Nos. 649, 650, 651, 653 and 652 in Velgode RF of Velgode Range till it reaches the northern corner of compartment 652 and further proceeds towards south and eastern directions in a zigzag manner with a width of 100 Mts. along the northern boundary of compartment Nos. 653, 656 of Velgode Range and Compt. Nos. 697, 698, 700, 701 of Bairluty Range. Thence it moves in north east direction along the western boundary of compartment No.747 and meets point ‘B’ on Kurnool-Guntur road at the north–west corner of compartment No.747. GPS co-ordinates of Station ‘B’ is 15.86642 N, 78.69979E. Thence, the boundary line runs towards north – west direction in a Zigzag manner with a width of 100 Mts outside R.F boundary of Guvvalakunta ‘C’ R.F of Nagaluty Range along the western boundary of compartment Nos.748, 749, 750, 832, 833, 834, 835 and meets the Northern corner of Compartment No. 835. Thence the boundary line runs towards Western direction in Zig – Zag manner with a width of 100 meters from the notified buffer of NSTR and along the Southern boundary of Compartment Nos. 816, 821, 822, 823, 824 and meets Station ‘C’ as shown on map which is on the south west corner of Compartment No.824, Guvvalakuntla-B RF, Atmakur Range. The GPS co-ordinates of Station ‘C’ is 15.97570N, 78.50460E.
Thence the boundary runs in northern direction in zigzag manner along the western boundary of compartment Nos.824, 797, 793, 794 in Nandikotkur RF of Atmakur Range and reaches point ‘D’ as shown in the map which is on the northwest corner of compartment No.794. The GPS reading of station ‘D’ is 16.05913N, 78.49756E. (D to E):-The Eco-sensitive Zone boundary from D to E runs along the central line (Mid line) of river Krishna which is inter State boundary between Andhra Pradesh and Telangana i.e., the boundary between Rajiv Gandhi Wildlife Sanctuary of Nagarjunasagar Srisailam Tiger Reserve, Andhra Pradesh on the southern side and Amrabad Tiger Reserve of Telangana State on the northern side of river Krishna.
The Eco-sensitive Zone boundary moves along mid of River Krishna from point ‘D’ in zig-zag manner in Srisailam, G.V Palli and V.P South Ranges and touches the Nagarjunasagar reservoir and further proceeds in north eastern direction along the mid of river Krishna till it reaches point ‘E’ i.e., one Km from the northern part of compartment No.88 of Tummarkota RF of V.P South Range. The GPS coordinates of station ‘E’ is 16.61847N, 79.46114E.
(E to G):Thence the Eco-sensitive Zone boundary line runs from point E towards southern direction in zigzag manner with a width of ‘1’Km from Rajiv Gandhi Wildlife Sanctuary boundary and along the eastern boundary of compartment No.88, then turns towards west and further south and moves at a distance of 1 km from the eastern boundary of Compartment No.87 and meets station ‘F’ as shown in the map. The GPS coordinates of station ‘F’ is 16.52433N, 79.44743E.
Thence the Eco sensitive Zone runs from point F towards Western direction in a zigzag manner with a width of ‘1’ Km from Rajiv Gandhi Wildlife Sanctuary boundary south of compartment Nos.87, 86 and 85. Then, turns towards south west 1km from the north east corner of compartment No.83 of Pasuvemula RF, V.P South Range. Thence the eco-sensitive zone boundary line runs towards south and moves in a zig–zag manner with a width of ‘1’ Km from Rajiv Gandhi Wildlife Sanctuary boundary on the east of compartment Nos.83, 77, 75, 70 and 69 of Kandlagunta RF and compartment Nos.68 and 67 of Gangulagunta RF of V.P South Range till it touches the western boundary of compartment No.64. Then it turns towards north east, passes along the western boundary of compartment No.64 which is notified buffer of NSTR. Thence it turns south and moves in various directions along the north west boundary of compartment No.64, western, northern and eastern boundaries of compartment No.63 and meets station ‘G’ which is located on District boundary of Guntur and Prakasam Districts as depicted in the map. The GPS coordinates of station ‘G’ is 16.23081N, 79.33778E.
(G to I): Thence the Eco-sensitive Zone boundary line starts from station ‘G’ in Markapur Division of Prakasam District and runs towards Southern direction in zig–zag manner along the notified buffer of NSTR and the eastern boundary of compartment Nos.200, 199, 185, 182 of Markapur RF compartment Nos. 174, 169 of ENB-XI RF, compartment 168, 167, 175 of EN Block X RF in Y.Palem Range and turns towards south and moves along the southern boundary of compartment Nos.175 and 166. Thence the boundary line runs towards south and moves in a zigzag manner with a width of ‘5’ Kms from Rajiv Gandhi Wildlife Sanctuary boundary and touches the point on the western boundary of compartment No.160 of Y. Palem RF in Y. Palem Range. Thence it moves in north east direction along the notified buffer touching the western boundary of compartment Nos.160 and 161 and moves towards south east direction in zigzag manner along the boundaries of compartment Nos.162 and 163, turns towards west and moves along boundary of compartment Nos.164, 165 and 159 of Y. Palem RF and reaches point ‘H’ on the south west corner of compartment No.159 of notified buffer. The GPS coordinates of ‘H’ is 15.97874 N, 79.26384E.

GPS coordinates of point ‘I’ is 15.88992 N, 79.04887E (I to K): Then, the Eco-sensitive Zone boundary line runs from point ‘I’ in eastern direction along the northern boundary of compartment No.54 in Cumbum R.F. of Dornal Range and moves further towards eastern direction in zig–zag manner along the northern boundary of compartment No. 55 and 56 in Cumbum RF of Dornal Range and Compartment Nos.315,316,317 & 318 in ENB V RF of Markapur Range and meets the point ‘J’ on the north east corner of compt no 318.
