पयाावरण, वन और जलवायु पररवतान मंत्रालय ऄजधसूचना नइ ददल् ली, 21 जसतम् बर, 2021 का.अ. 3922(ऄ).—प्रारुप ऄजधसूचना भारत के राजपत्र, ऄसाधारण में भारत सरकार के पयाावरण, वन और जलवायु पररवतान, मंत्रालय की ऄजधसूचना सं. का.अ. 173 (ऄ), तारीख 9 जनवरी, 2020, द्वारा प्रकाजित की गइ थी जजसमें ऐसे सभी व्यजियों से, जजनकी ईससे प्रभाजवत होने की संभावना थी, ईस तारीख से, जजसको ईि ऄजधसूचना को ऄन्तर्ववष्ट करने वाले राजपत्र की प्रजतयां जनता को ईपलब्ध करा दी गइ थीं, साठ ददन की ऄवजध के भीतर अक्षेप और सुझाव अमंजत्रत दकए गए थे; और, ईि प्रारूप ऄजधसूचना को ऄन्तर्ववष्ट करने वाले राजपत्र की प्रजतयां जनता को तारीख 10 जनवरी, 2020 को ईपलब्ध करा दी गइ थी; और, पूवोि प्रारुप ऄजधसूचना के प्रत्युतर में व्यजियों और पणधाररयों से प्राप्त अक्षेपों और सुझावों पर केन्रीय सरकार द्वारा जवचार दकया गया था; और, कोररगा वन्यजीव ऄभयारण्य अंध्र प्रदेि के पूवी गोदावरी जजले में पूवी तट में काकीनाडा से लगभग पांच दकलोमीटर दूर बंगाल की खाडी के गोदावरी नदी के मुहाने के क्षेत्र में जस्ट्थत है। ऄभयारण्य ईत्तर ऄक्षांि 16o30’से 17o और पूवा देिांतर 82o14’ से 82o23’ के बीच जस्ट्थत है। यह क्षेत्र जी. ओ. एमएस. सं. 484 वन और ग्रामीण जवकास (फोर. III) जवभाग, तारीख 5 जुलाइ, 1978 के माध्यम से 1978 में वन्यजीव (संरक्षण) ऄजधजनयम,1972 की धारा 18 के ऄधीन “कोररगा वन्यजीव ऄभयारण्य” घोजित दकया गया था और पूवा गोदावरी जजला राजपत्र सं. 8, तारीख 22 ऄगस्ट्त, 1978 सं. 3598] नइ ददल्ली, बुधवार, जसतम् बर 22, 2021/ भार 31, 1943 No. 3598] NEW DELHI, WEDNESDAY, SEPTEMBER 22, 2021/BHADRA 31, 1943 सी.जी.-डी.एल.-अ.-25092021-229958 CG-DL-E-25092021-229958 527319/2021/ESZ 765

और जी.ओ. एमएस. सं. 45, पयाावरण, वन, जवज्ञान और प्रौद्योजगकी जवभाग (फोर. III) तारीख 21 ऄप्रैल, 1998 के
माध्यम से वन्यजीव (संरक्षण) ऄजधजनयम, 1972 (1972 के 53) से 1998 में की धारा 26-ए के ऄधीन ऄजधसूजचत दकया
गया था और पूवा गोदावरी जजला राजपत्र में संदभा सं. सी5/मइ/126/97 तारीख 16 मइ, 1998 में ऄजधसूजचत दकया गया
था। जनम्न तीन ररज़वा वनों: (i) कोररगा ररज़वा वन; (ii) कोररगा एक्सटेंिन ररज़वा वन; और (iii) भैरवपालेम ररज़वा वन से
युि आस ऄभयारण्य का कुल क्षेत्रफल 235.70 वगा दकलोमीटर है;
और, कोररगा वन्यजीव ऄभयारण्य के क्षेत्र में काकीनाडा-खाडी को छोडकर, एस्ट्टुरीन दलदली भूजम की जविेिता
है। गर्वमयों के दौरान ऄभयारण्य का पजिमी भाग पूवी भाग की तुलना में ईच्च स्ट्तर के कारण पूरी तरह से जलमग्न नहीं
होता है और सूख जाता है। पूवी और ईत्तरी क्षेत्र पूरी तरह से दलदली भूजम और जनचले स्ट्तर पर हैं, यह पूरे विा भर में
जलमग्न हो जाता है। ऄभयारण्य का पूरा क्षेत्र गोदावरी नदी की एस्ट्टुरीन प्रणाली की मैंग्रोव वनस्ट्पजत के साथ जघरा हुअ है,
जजसमें कोररगा, गादेरू और नील्लारेवु नददयााँ सजम्मजलत हैं, जो समुर में िाजमल होने से पहले गोदावरी नदी की िाखाएाँ
हैं;
और, कोररगा वन्यजीव ऄभयारण्य की मुख्य वनस्ट्पजत तामाररक्स रौपी (पजलवेलु), जाआलोकापुास ग्रेनातम
(सेनुगा), जहजबस्ट्कस रटजलयाकेईस (ऄट्टाकानारा), थेस्ट्पेजसया पॉपुल्नेअआड्स (गंगुरावी), डालबेरजगया जस्ट्पनोसा
(जचल्ल्लगा), केसाजल्पजनया दिस्ट्टा (राजचस), डेर्ररस राआफोजलयाटा (नाल्ला थीगा), सोन्नेरारटया एपेटाला (कल्लगा),
ऄजवकेजन्नया ऄल्बा (आलावा माडा), ऄजवकेजन्नया मररना (टेल्ला माडा), ऄजवकेजन्नया ऑदफजसनाजलस (नाल्ला माडा),
बरूगुआरा जसल्लजिका (ईरूदु), बरूगुआरा जजम्नोर्ररजहजा (कंदरगा), केररओपस डेकांरा तोगरा), राआजोफोरा एजपकुलता
(पोन्ना), लुजम्नटजेरा राकेमोसा जवल्ड (थंडुगा), जस्ट्कदफफोरा हाआिोफयल्लाकेया (नारा थंडुगा), एजजकेरास कोर्वनकुलातुम
(गुजगगलाम), सरकोलोबस कैररनाटस (बालाबोड्डी थीगा), ल्पोमोआया जवओलाकेया (टेल्लाटेगा), क्लेरोडेंिरूम आनमे
(जपल्सगी), एकेंथुस आजलजसफोजलयस (एजल्लची), सुएडा मैरररटमा (आलाकुरा), एक्सकेकररऄ एगल्लोचा (रटल्ला),
मायररओस्ट्टाचया जवघरटऄना (ढाब्बा गद्दी), अदद हैं;
और, कोररगा वन्यजीव ऄभयारण्य दफल्िग कैट और उदजबलाव के जलए एक सुंदर वास भूजम है। डगोंगस और डॉजल्फन समुर
के दकनारे से ऄभयारण्य में कभी-कभार अते हैं। क्षेत्र में लोमजडयों और रीसस बंदरों की महत्वपूणा जनसंख्या का भी वास है।
होप द्वीप में ओजलव ररडले कछुओं का भी प्रजनन है और आस तरह से ऄभयारण्य जपछले तीन विों के जलए समुरी कछुए
(ओजलव ररडले) के संरक्षण में महत्वपूणा स्ट्थल प्रदान करता है। ऄभयारण्य पजक्षयों के जलए महत्वपूणा वास भी है और यहााँ
पक्षी की 234 से ऄजधक प्रजाजतयााँ िाजमल हैं जजसमें ऄभयारण्य में ब्लैक-हेडेड गूल (लासा ररडीबंडस), सामान्य सैंड पाआपर
(ररगा हाआपोलेकस), रेड िंक (ररगा टोटानस), जलरटल एग्रेट (एग्रेटा गाजेटा), कैटल एगरेट (बबल्कस आजबस), ग्रे हेरॉन
(ऄदेया जसनेररया), आंजडयन रीफ हेरोन (एग्रेटा गूलाररस), ओपन जबल स्ट्टॉक (एनास्ट्टोमस ऑजसरटटन्स) पाआड ककगदफिर
(सेरेल रजडस) और छोटे नीले ककगदफिर (एलेडो एरटजथस) अदद पाए जाते हैं। आसजलए, कोररगा वन्यजीव ऄभयारण्य के
असपास पाररजस्ट्थजतकी संवेदी ज़ोन की अवश्यकता है;
और, काकीनाडा िहर की भजवष्य की जवकास अवश्यकताओं को ध्यान में रखते हुए, काकीनाडा बंदरगाह की
वतामान दियाकलापों और ऄभयारण्य के असपास बसने वाले ग्रामीणों के जलए मछली पालन प्राथजमक अजीजवका
दियाकलाप है। यह तय दकया गया दक, पूवी भाग की ओर पाररजस्ट्थजतकी संवेदी ज़ोन की चौडाइ (ऄथाात् समुरी-भाग)
500 मीटर से 5 दकलोमीटर वतामान बंदरगाह सीमाओं को छोडकर, ईत्तरी सीमा की ओर 50 मीटर, दजक्षण भाग की ओर
11.5 दकलोमीटर तक और कोररगा वन्यजीव ऄभयारण्य की सीमा रेखा से 50 मीटर की पजिमी सीमा (ऄथाात् काकीनाडा
िहर) की ओर तक सीजमत है, वन्य पिुओं की सुरक्षा के जलए जजसमें दफल्िग जबल्ली, उदजबलाव और जविेि रूप से ओजलव
ररडले कछुए और पजक्षयों की जवजवधता भी सजम्मजलत है के जलए घोजित दकया जाना है;
और, कोररगा वन्यजीव ऄभयारण्य के चारों ओर के क्षेत्र को, जजसका जवस्ट्तार और सीमाएं पाररजस्ट्थजतकी पयाावरणीय
से पाररजस्ट्थजतकी संवेदी जोन के रूप में पैरा 1 में जवजनर्ददष्ट हैं, जैव जवजवजधता की दृजष्ट सुरजक्षत और संरजक्षत करना और

[भागII—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3 ईि पाररजस्ट्थजतकी संवेदी जोन में ईद्योगों या ईद्योगों के वगों के प्रचालन और प्रसंस्ट्करण करने को प्रजतजिद्ध करना अवश्यक है; ऄतः, ऄब, केन्रीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के साथ परठत पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) (जजसे आस ऄजधसूचना में आसके पिात पयाावरण ऄजधजनयम कहा गया है) की धारा 3 की ईपधारा (1) और ईपधारा (2) के खंड (v) और खंड (xiv) तथा ईपधारा (3) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, अंध्र प्रदेि राज्य के जजला पूवा गोदावरी में कोररगा वन्यजीव ऄभयारण्य की सीमा के चारों ओर 50 मीटर से 11.5 दकलोमीटर जवस्ट्ताररत क्षेत्र को कोररगा वन्यजीव ऄभयारण्य पाररजस्ट्थजतकी संवेदी जोन (जजसे आसमें आसके पश् चात् पाररजस्ट्थजतकी संवेदी जोन कहा गया है) के रूप में ऄजधसूजचत करती है, जजसका जववरण जनम्नानुसार है, ऄथाात् :-
- पाररजस्ट्थजतकी संवेदी जोन का जवस्ट्तार और सीमाएं.-(1) पाररजस्ट्थजतकी संवेदी जोन का जवस्ट्तार कोररगा वन्यजीव ऄभयारण्य की सीमा के चारों ओर 50 मीटर से 11.5 दकलोमीटर की दूरी तक जवस्ट्तृत है और पाररजस्ट्थजतकी संवेदी जोन का क्षेत्रफल 177.30 वगा दकलोमीटर है। (2) कोररगा वन्यजीव ऄभयारण्य और आसके पाररजस्ट्थजतकी संवेदी जोन की सीमा का जववरण ईपाबंध-I के रूप में संलग्न है। (3) सीमा जववरण और ऄक्षांि और देिांतर के साथ पाररजस्ट्थजतकी संवेदी जोन को सीमांदकत करते हुए कोररगा वन्यजीव ऄभयारण्य के मानजचत्र ईपाबंध- IIक और ईपाबंध- IIख के रूप में संलग्न है। (4) कोररगा वन्यजीव ऄभयारण्य और पाररजस्ट्थजतकी संवेदी जोन की सीमा के भू-जनदेिांकों की सूची ईपाबंध-III की सारणी क और सारणी ख में दी गइ है। (5) कोररगा वन्यजीव ऄभयारण्य के पाररजस्ट्थजतकी संवेदी जोन में कोइ ग्राम नहीं है।
- पाररजस्ट्थजतकी संवेदी जोन के जलए अंचजलक महायोजना– (1) राज्य सरकार, पाररजस्ट्थजतकी संवेदी जोन के प्रयोजनों के
जलए राजपत्र में आस ऄजधसूचना के प्रकािन की तारीख से दो विा की ऄवजध के भीतर, स्ट्थानीय व्यजियों के परामिा से और
आस ऄजधसूचना में ददए गए ऄनुबंधों का पालन करते हुए अंचजलक महायोजना तैयार करेगी और राज्य में सक्षम प्राजधकारी
द्वारा जवजधवत ऄनुमोददत करवाएगी।
(2) राज्य सरकार द्वारा पाररजस्ट्थजतकी संवेदी जोन के जलए अचंजलक महायोजना ऐसी रीजत से जो आस ऄजधसूचना में
जवजनर्ददष् ट दकए गए हैं, के ऄनुसार तथा सुसंगत केंरीय और राज् य जवजधयों के ऄनुरुप और केंरीय सरकार द्वारा जारी
मागाजनदेिों, यदद कोइ हों, द्वारा तैयार होगी ।
(3) अंचजलक महायोजना, ईि योजना में पाररजस्ट्थजतकी और पयाावरणीय बातों को समाकजलत करने के जलए राज् य
सरकार के जनम्नजलजखत जवभागों के परामिा से तैयार होगी:-
(i)
पयाावरण;
(ii)
वन और वन्यजीव;
(iii) कृजि; (iv) राजस्ट्व; (v) िहरी जवकास; (vi) पयाटन; (vii) ग्रामीण जवकास; (viii) ल्सचाइ और बाढ़ जनयंत्रण; (ix) नगरपाजलका; (x) पंचायती राज; 527319/2021/ESZ 767

(xi)
अंध्र प्रदेि राज्य प्रदूिण जनयंत्रण बोडा; और
(xii)
लोक जन मााण जव भाग।
(4) अंचजलक महायोजना ऄनुमोददत जवद्यमान भू-ईपयोग, ऄवसंरचना और दियाकलापों पर कोइ जनबंधन ऄजधरोजपत
नहीं करेगी जब तक दक आस ऄजधसूचना में आस प्रकार जवजनर्ददष् ट न हो और अचंजलक महायोजना सभी ऄवसंरचना और
दियाकलापों में, जो ऄजधक दक्षता और पाररजस्ट्थजतकी ऄनुकूल हों, का संवधान करेगी ।
(5) अंचजलक महायोजना में ऄनाच्छाददत क्षेत्रों के जीणोद्धार, जवद्यमान जल जनकायों के संरक्षण, अवाह क्षेत्रों के प्रबंधन,
जल-संभरों के प्रबंधन, भूतल जल के प्रबंधन, मृदा और नमी संरक्षण, स्ट्थानीय समुदायों की अवश्यकताओं तथा
पाररजस्ट्थजतकी और पयाावरण से संबंजधत ऐसे ऄन्य पहलुओं, जजन पर ध्यान देना अवश्यक है, के जलए ईपबंध होंगे ।
(6) अंचजलक महायोजना जवद्यमान और प्रस्ट्ताजवत भूजम ईपयोग जविेिताओं के ब्यौरों से ऄनुसमर्वथत मानजचत्र के साथ
सभी जवद्यमान पूजा स्ट् थलों, ग्रामों और नगरीय बजस्ट्तयों, वनों के प्रकार और दकस्ट् मों, कृजि क्षेत्रों, उपजाउ भूजम, हररत क्षेत्र
जैसे ईद्यान और ईसी प्रकार के स्ट् थान, ईद्यान कृजि क्षेत्र, फलोईद्यान, झीलों और ऄन्य जल जनकायों का ऄभ्यंकन करेगी।
(7) अंचजलक महायोजना में पाररजस्ट्थजतकी संवेदी जोन में जवकासात्मक दियाकलापों को जवजनयजमत करने के जलए प्रदिया
प्रदान की जाएगी और सारणी में यथासूचीबद्ध पैराग्राफ 4 में प्रजतजिद्ध एवं जवजनयजमत दियाकलापों का पालन दकया
जाएगा। आसमें स्ट् थानीय जनता की अजीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-ऄनुकूल जवकास का भी सुजनिय एवं
संवधान दकया जाएगा।
(8) अंचजलक महायोजना प्रादेजिक जवकास योजना की सह-जवस्ट्तारी होगी ।
(9) राज्य सरकार द्वारा ऄनुमोददत अंचजलक महायोजना, मानीटरी सजमजत के जलए एक संदभा दस्ट्तावेज होगी तादक वह
आस ऄजधसूचना के ईपबंधों के ऄनुसार मानीटरी के ऄपने कताव्यों का जनवाहन कर सके।
3. राज्य सरकार द्वारा दकए जाने वाले ईपाय.- राज्य सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी करने के जलए
जनम्नजलजखत ईपाय करेगी, ऄथाात्:-
(1) भू-ईपयोग.– (क) पाररजस्ट्थजतकी संवेदी जोन में वनों, ईद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंजन के प्रयोजनों के जलए
जचजन्हत दकए गए पाकों और खुले स्ट्थानों का वाजणजज्यक या अवासीय या औद्योजगक संबद्ध जवकास दियाकलापों के जलए
ईपयोग या संपररवतान नहीं होगा:
परंतु यह दक पाररजस्ट्थजतकी संवेदी जोन के भीतर भाग (क) में जवजनर्ददष्ट प्रयोजनों से जभन्न प्रयोजनों के जलए कृजि
और ऄन्य भूजम का संपररवतान मानीटरी सजमजत की जसफाररि पर और यथा लागू और क्षेत्रीय नगर योजना ऄजधजनयम और
केन्रीय सरकार या राज्य सरकार के ऄन्य जनयमों तथा जवजनयमों के ऄधीन सक्षम प्राजधकारी के पूवा ऄनुमोदन से, और आस
ऄजधसूचना के ईपबंधों द्वारा स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय अवश्यकताओं को पूरा करने के जलए ऄनुज्ञात
दकया जाएगा, जैसे-
(i) जवद्यमान सडकों को चौडा करना और ईन्हें सुदृढ़ करना तथा नइ सडकों का संजनमााण;
(ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;
(iii) प्रदूिण ईत्पन्न न करने वाले लघु ईद्योग;
(iv) कुटीर ईद्योगों जजनके ऄंतगात ग्रामीण ईद्योग भी हैं; सुजवधाजनक भण्डार और स्ट्थानीय सुजवधाएं सहायक
पाररजस्ट्थजतकी पयाटन जजसके ऄन्तगात गृह वास सजम्मजलत है; और
(v) पैरा 4 के ऄधीन ददए गए संवर्वधत दियाकलाप:

परंतु यह और दक प्रादेजिक नगर योजना ऄजधजनयम और राज्य सरकार के ऄन्य जनयमों और जवजनयमों के ऄधीन
सक्षम प्राजधकारी के पूवा ऄनुमोदन और संजवधान के ऄनुच्छेद 244 के ईपबंधों या तत्समय प्रवृत्त जवजध के ईपबंधों के
ऄनुपालन के जबना, जजसके ऄंतगात ऄनुसूजचत जनजाजत और ऄन्य परंपरागत वन जनवासी (वन ऄजधकारों की मान्यता)
ऄजधजनयम, 2006 (2007 का 2) भी है, वाजणजज्यक या औद्योजगक जवकास दियाकलापों के जलए जनजातीय भूजम का
ईपयोग ऄनुज्ञात नहीं होगा:
परंतु यह और भी दक पाररजस्ट्थजतकी संवेदी जोन के भीतर भू-ऄजभलेखों में ईपसंजात कोइ गलती, मानीटरी सजमजत के
जवचार प्राप्त करने के पिात् राज्य सरकार द्वारा प्रत्येक मामले में एक बार ठीक होगी और ईि गलती के सुधार की सूचना
केंरीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय को दी जाएगी:
परंतु यह और भी दक गलती के सुधार में आस ईप पैरा के ऄधीन यथा ईपबंजधत के जसवाय दकसी भी दिा में भू-ईपयोग
का पररवतान सजम्मजलत नहीं होगा।
(ख) वनीकरण तथा वास जीणोद्धार दियाकलापों सजहत ऄनप्रयुक् त या ऄनुत् पादक कृजि क्षेत्रों में पुन: वनीकरण करने के
प्रयास दकए जाएंगे।
(2) प्राकृजतक जल स्रोत.- अचंजलक महायोजना में सभी प्राकृजतक झरनों के अवाह क्षेत्रों की पहचान की जाएगी और ईनके
संरक्षण और नवीकरण के जलए योजना सजम् मजलत होगी और राज् य सरकार द्वारा ऐसे क्षेत्रों पर या ईनके जनकट जवकास
दियाकलाप प्रजतजिद्ध करने के बारे में जो ऐसे क्षेत्रों के जलए ऄजहतकर हो ऐसी रीजत से मागादिाक जसद्धांत तैयार दकए
जाएंगे।
(3) पयाटन या पाररजस्ट्थजतकी पयाटन.- (क) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पाररजस्ट्थजतकी पयाटन
दियाकलाप या जवद्यमान पयाटन दियाकलापों का जवस्ट्तार पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन के
जलए होगा।
(ख) पाररजस्ट्थजतकी पयाटन महायोजना राज्य पयाटन जवभाग द्वारा राज्य पयाावरण और वन जवभाग के परामिा से तैयार
होगी।
(ग) पयाटन महायोजना अंचजलक महायोजना के एक घटक के रूप में होगी।
(घ) पयाटन महायोजना पाररजस्ट्थजतकी संवेदी जोन की वहन क्षमता के अधार पर तैयार की जाएगी।
(ङ) पाररजस्ट्थजतकी पयाटन संबंधी दियाकलाप जनम्नानुसार जवजनयजमत होंगे, ऄथाात्:-
(i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट
है, नये वाजणजज्यक होटल और ररजॉटा के सजन्नमााण ऄनुज्ञात नहीं होंगे:
परंतु, यह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर की दूरी से परे पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक होटलों और ररजॉटा का स्ट्थापन केवल पूवा पररभाजित और नामजनर्ददष्ट क्षेत्रों में पयाटन महायोजना के ऄनुसार पाररजस्ट्थजतकी पयाटन सुजवधाओं के जलए ही ऄनुज्ञात होगा; (ii) पाररजस्ट्थजतकी संवेदी जोन के भीतर सभी नए पयाटन दियाकलापों या जवद्यमान पयाटन दियाकलापों का जवस्ट्तार केंरीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय के मागादिाक जसद्धांतों के द्वारा तथा राष् रीय ा याघ्र स संरक्षण प्राजधकरण, द्वारा जारी पाररजस्ट्थजतकी–पयाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल देते हुए (समय- समय पर यथासंिोजधत) जारी मागादिाक जसद्धांतों के ऄनुसार होगा; (iii) अंचजलक महायोजना का ऄनुमोदन दकए जाने तक, पयाटन के जलए जवकास और जवद्यमान पयाटन दियाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्ददष्ट संवीक्षा और मानीटरी सजमजत की जसफाररि पर अधाररत संबंजधत जवजनयामक प्राजधकरणों द्वारा ऄनुज्ञात दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन के भीतर दकसी नये होटल या ररसोटा या वाजणजज्यक स्ट्थापन का संजनमााण ऄनुज्ञात नहीं दकया जायेगा । 527319/2021/ESZ 769

(4) नैसर्वगक जवरासत.- पाररजस्ट्थजतकी संवेदी जोन में महत्वपूणा नैसर्वगक जवरासत के सभी स्ट्थलों जैसे जीन कोि अरजक्षत
क्षेत्र, िैल जवरचनाएं, जल प्रपातों, झरनों, घाटी मागों, ईपवनों, गुफाएं, स्ट्थलों, भ्रमण, ऄश्वरोहण, प्रपातों अदद की
पहचान की जाएगी और जवरासत संरक्षण योजना अंचजलक महायोजना के भाग के रुप में परररक्षण और संरक्षण के जलए
तैयार की जाएगी ।
(5) मानव जनर्वमत जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेदी जोन में भवनों, संरचनाओं, जिल्प-तथ्य, ऐजतहाजसक, स्ट्थापत्य,
सौंदयापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और ईपक्षेत्रों पहचान और ईनके संरक्षण के जलए जवरासत योजना अंचजलक
महायोजना के भाग के रुप में तैयार की जाएगी।
(6) ध् वजन प्रदूिण.- पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदूिण (जवजनयमन और जनयंत्रण) जनयम, 2000 में जनयत
ईपबंधों के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन में ध्वजन प्रदूिण के जनयंत्रण और जनवारण का ऄनुपालन दकया जाएगा।
(7) वायु प्रदूिण.- पाररजस्ट्थजतकी संवेदी जोन में, वायु प्रदूिण के जनवारण और जनयंत्रण का वायु (प्रदूिण जनवारण और
जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) और ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार ऄनुपालन दकया
जाएगा।
(8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेदी जोन में ईपचाररत बजहस्राव का जनस्ट्सारण, साधारण मानकों के ईपबंधों
के ऄनुसार पयाावरण ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों के ऄधीन अने वाले पयाावरणीय प्रदूिण के जनस्ट्सरण
के जलए साधारण मानकों या राज्य सरकार द्वारा जनयत मानकों, जो भी ऄजधक कठोर हो, के ईपबंधों के ऄनुसार होगा।
(9) ठोस ऄपजिष्ट.- ठोस ऄपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकया जाएगा:-
(क) पाररजस्ट्थजतकी संवेदी जोन में ठोस ऄपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पयाावरण, वन और जलवायु
पररवतान मंत्रालय की ऄजधसूचना सं. का.अ. 1357(ऄ), तारीख 8 ऄप्रैल, 2016 के द्वारा प्रकाजित ठोस ऄपजिष्ट प्रबंधन
जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा; ऄकाबाजनक पदाथो का जनपटान पाररजस्ट्थजतकी संवेदी जोन से बाहर
जचजन्हत दकए गए स्ट्थानों पर पयाावरण-ऄनुकूल रीजत से दकया जाएगा;
(ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों का ईपयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप
ठोस ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रबंधन ऄनुज्ञात दकया जा सकेगा।
(10) जैव जचदकत्सा ऄपजिष् ट.- जैव जचदकत्सा ऄपजिष् ट का प्रबंधन जनम्नानुसार दकया जाएगा.-
(क) पाररजस्ट्थजतकी संवेदी जोन में जैव जचदकत्सा ऄपजिष्ट का जनपटान भारत सरकार के पयाावरण, वन और जलवायु
पररवतान मंत्रालय की ऄजधसूचना सं.सा.का.जन 343 (ऄ), तारीख 28 माचा, 2016, के द्वारा प्रकाजित जैव जचदकत्सा
ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा;
(ख) पाररजस्ट्थजतकी संवेदी जोन में मान्य प्रौद्योजगदकयों का ईपयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप
जैव-जचदकत्सा ऄपजिष्ट का सुरजक्षत और पयाावरण-ऄनुकूल प्रबंधन ऄनुज्ञात दकया जा सकेगा।
(11) प्लाजस्ट्टक ऄपजिष्ट प्रबंधन.- पाररजस्ट्थजतकी संवेदी जोन में प्लाजस्ट्टक ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के
पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना सं.सा.का.जन 340(ऄ),
तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक ऄपजिष्ट प्रबंध जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।
(12) जनमााण और जवध्वंस ऄपजिष्ट प्रबंधन.- पाररजस्ट्थजतकी संवेदी जोन में संजनमााण और जवध्वंस ऄपजिष्ट प्रबंधन का
जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत ऄजधसूचना
सं.सां.का.जन 317(ऄ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनयम, 2016 के ईपबंधों के
ऄनुसार दकया जाएगा ।

(13) इ–ऄपजिष्ट.- पाररजस्ट्थजतकी संवेदी जोन में इ–ऄपजिष्ट प्रबंधन का जनपटान भारत सरकार के पयाावरण, वन और
जलवायु पररवतान मंत्रालय की समय-समय पर यथासंिोजधत द्वारा प्रकाजित इ–ऄपजिष्ट प्रबंध जनयम, 2016 के ईपबंधों के
ऄनुसार दकया जाएगा।
(14) यानीय यातायात.- यातायात की यानीय गजतजवजधयां अवास के ऄनुकूल जवजनयजमत होंगी और आस संबंध में
अंचजलक महायोजना में जविेि ईपबंध सजम्मजलत दकए जाएंगे और अंचजलक महायोजना के तैयार होने और राज्य सरकार
के सक्षम प्राजधकारी द्वारा ऄनुमोददत होने तक, मानीटरी सजमजत सुसंगत ऄजधजनयमों और ईसके ऄधीन बनाए गए जनयमों
और जवजनयमों के ऄनुसार यानीय दियाकलापों के ऄनुपालन को मानीटर करेगी।
(15) यानीय प्रदूिण.- लागू जवजधयों के ऄनुपालन में वाहन प्रदूिण का जनवारण और जनयंत्रण दकया जाएगा और स्ट्वच्छक
ईंधन के ईपयोग के जलए प्रयास दकए जाएंगे।
(16) औद्योजगक इकाआयां.- (क) राजपत्र में आस ऄजधसूचना के प्रकािन पर या ईसके पिात पाररजस्ट्थजतकी संवेदी जोन के
भीतर कोइ नए प्रदूजित ईद्योगों की स्ट्थापना की ऄनुज्ञा नहीं दी जाएगी।
(ख) केन्रीय प्रदूिण जनयंत्रण बोडा द्वारा फरवरी, 2016 में जारी समय-समय पर यथासंिोजधत मागादिाक जसद्धान्तों में
ईद्योगों के वगीकरण के ऄनुसार, जब तक दक ऄजधसूचना में आस प्रकार जवजनर्ददष्ट न हो, पाररजस्ट्थजतकी संवेदी जोन के भीतर
केवल गैर-प्रदूिणकारी ईद्योगों को ऄनुज्ञात दकया जाएगा और आसके ऄजतररि, गैर प्रदूिणकारी ईद्योगों को बढ़ावा ददया
जाएगा।
(17) पहाडी ढलानों को संरक्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार होगा:-
(क) अंचजलक महायोजना पहाडी ढलानों पर क्षेत्रों का संकेत होगा जहां दकसी भी संजनमााण की ऄनुज्ञा नहीं दी जाएगी;
(ख) कटाव के एक ईच्च जडग्री के साथ जवद्यमान खडी पहाडी ढलानों या ढलानों पर दकसी भी संजनमााण की ऄनुज्ञा नहीं दी
जाएगी ।
4. पाररजस्ट्थजतकी संवेदी जोन में प्रजतजिद्ध और जवजनयजमत दकए जाने वाले दियाकलापों की सूची.- पाररजस्ट्थजतकी संवेदी
जोन में सभी दियाकलाप पयाावरण ऄजधजनयम के ईपबंधों और ईसके ऄधीन बनाए गए जनयमों जजसके ऄन्तगात तटीय
जवजनयमन जोन, 2011 और पयाावरणीय समाघात जनधाारण ऄजधसूचना, 2006 और ऄन्य लागू जवजधयों के जजसमें वन
(संरक्षण) ऄजधजनयम, 1980 (1980 का 69), भारतीय वन ऄजधजनयम, 1927 (1927 का 16), वन्यजीव (संरक्षण)
ऄजधजनयम, 1972 (1972 का 53) सजम्मजलत हैं और दकये गये संिोधनों द्वारा िाजसत होंगे और नीचे दी गइ सारणी में

परंतु यह दक केन्रीय प्रदूिण जनयंत्रण बोडा द्वारा फरवरी, 2016 में
जारी समय-समय पर यथासंिोजधत मागादिाक जसद्धान्तों में ईद्योगों
के वगीकरण के ऄनुसार, जब तक दक ऄजधसूचना में ऐसा जवजनर्ददष्ट
न हों, पाररजस्ट्थजतकी संवेदी जोन के भीतर गैर-प्रदूिणकारी ईद्योगों
को ऄनुज्ञात दकया जाएगा और आसके ऄजतररि गैर-प्रदूिणकारी
कुटीर ईद्यागों को बढ़ावा ददया जाएगा।

8.
वाजणजज्यक होटलों और ररसोटों की स्ट्थापना । पाररजस्ट्थजतकी पयाटन दियाकलापों लघु ऄस्ट्थायी संरचनाओं के जसवाय संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट है, नए वाजणजज्यक होटल और ररसोटों को ऄनुज्ञात नहीं दकया जाएगा: परंतु, यह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के परे या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक आनमें से, जो भी जनकट हो सभी नए पयाटन दियाकलाप या जवद्यमान दियाकलाप का जवस्ट्तार पयाटन महायोजना और यथा लागू मागादिी जसद्धांतों के ऄनुरुप होगा। 9. संजनमााण दियाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक, आनमें जो भी जनकट हो, दकसी भी प्रकार के नये वाजणजज्यक संजनमााण की ऄनुज्ञा नहीं होगी: परंतु यह दक स्ट्थानीय लोगों को ऄपनी अवास सम्बन्धी जनम्नजलजखत अवश्यकताओं को पूरा करने के जलए, पैरा 3 के ईप पैरा (1) में सूचीबद्ध दियाकलापों सजहत ऄपने ईपयोग के जलए, ऄपनी भूजम में भवन ईप-जवजधयों के ऄनुसार, संजनमााण करने की ऄनुज्ञा होगी: परंतु यह दक, गैर–प्रदूिणकारी लघु ईद्योगों से संबंजधत संजनमााण 527319/2021/ESZ 772

न्यूनतम होंगे ।
(ख) एक दकलोमीटर क्षेत्र से परे ये अंचजलक महायोजना के ऄनुसार
जवजनयजमत होंगे ।
10.
प्रदूिण ईत्पन्न न करने वाले लघु ईद्योग। फरवरी, 2016 में केन्रीय प्रदूिण जनयंत्रण बोडा द्वारा जारी ईद्योगों में वगीकरण के ऄनुसार समय-समय पर यथासंिोजधत गैर- प्रदूिणकारी ईद्योग और ऄपररसंकटमय में, लघु और सेवा ईद्योग, कृजि, पुष्प कृजि, ईद्यान कृजि या पाररजस्ट्थजतकी संवेदी जोन से देिी सामग्री से ईत्पादों को ईत्पन्न करने वाले कृजि अधाररत ईद्योग सक्षम प्राजधकारी द्वारा ऄनुज्ञात होंगे। 11.
वृक्षों की कटाइ। (क) राज्य सरकार में सक्षम प्राजधकारी की पूवा ऄनुज्ञा के जबना वन, सरकारी या राजस्ट्व या जनजी भूजम पर या वनों में वृक्षों की कटाइ नहीं होगी । (ख) वृक्षों की कटाइ संबंजधत केंरीय या राज्य ऄजधजनयम या ईसके ऄधीन बनाए गए जनयमों के ईपबंध के ऄनुसार जवजनयजमत होगे । 12.
वन ईत्पादों या गैर काष् ठ वन ईत्पादों का संग्रहण । लागू जवजधयों के ऄनुसार जवजनयजमत होंगे । 13.
जवद्युत और संचार टावरों का पररजनमााण और केबलों के जबछाए जाने और ऄन्य बुजनयादी ढांचे । लागू जवजधयों के ऄधीन जवजनयजमत होंगे (भूजमगत केबल के जबछाए जाने को बढ़ावा ददया जा सकेगा)। 14.
नागररक सुख सुजवधाओं सजहत ऄवसंरचनाएं । न्यूनीकरण ईपायों को लागू जवजधयों, जनयमों, जवजनयमनों और ईपलब्ध मागादिाक जसद्धांतों के ऄनुसार दकया जाना । 15.
जवद्यमान सडकों को चौडा करना और ईन्हें सुदृढ़ करना तथा नवीन सडकों का संजनमााण । न्यूनीकरण ईपायों को लागू जवजधयों, जनयमों, जवजनयमनों और ईपलब्ध मागादिाक जसद्धांतों के ऄनुसार दकया जाएगा । 16.
पयाटन से संबंजधत ऄन्य दियाकलाप जैसे गमा वायु गुब्बारें, हेलीकॉप्टर, िोन, माआिोलाआटस, अदद द्वारा पाररजस्ट्थजतकी संवेदी जोन क्षेत्र के उपर से ईडना जैसे दियाकलाप करना। 17.
पहाडी ढालों और नदी तटों का संरक्षण । 18.
राजत्र में याजनक यातायात का संचलन । लागू जवजधयों के ऄधीन वाजणजज्यक प्रयोजन के जलए जवजनयजमत होंगे । 19.
स्ट्थानीय समुदायों द्वारा चल रही कृजि और बागवानी प्रथाओं के साथ दुगधिाला, दुगघ ईद्योग, कृजि और मछली पालन । स्ट्थानीय लोगों के ईपयोग के जलए लागू जवजधयों के ऄधीन ऄनुज्ञात होंगे । 20.

- जवचाराथा जविय.- (1) मानीटरी सजमजत आस ऄजधसूचना के ईपबंधों के ऄनुपालन को मानीटर करेगी।
(2) मानीटरी सजमजत का कायाकाल ऄगले अदेि होने तक दकया जाएगा, परंतु यह दक सजमजत के गैर-सरकारी सदस्ट्यों को समय-समय पर राज्य सरकार द्वारा नामजनर्ददष्ट दकया जाएगा। (3) ईन दियाकलापों की, जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक का.अ. 1533 (ऄ), तारीख 14 जसतम्बर, 2006 की ऄनुसूची में सजम्मजलत हैं, और जो पाररजस्ट्थजतकी संवेदी जोन में अते हैं, जसवाय आसके जो पैरा 4 के ऄधीन सारणी में यथा जवजनर्ददष्ट प्रजतजिद्ध दियाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवीक्षा की जाएगी और ईि ऄजधसूचना के ईपबंधों के ऄधीन पूवा पयाावरण ऄनापजत्त के जलए केरींय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय को जनर्ददष्ट दकया जाएगा। (4) ईन दियाकलापों की, जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्यांक
का.अ. 1533(ऄ) तारीख 14 जसतंबर, 2006 की ऄनुसूची में सजम्मजलत नहीं है, और जो पाररजस्ट्थजतकी संवेदी जोन में अते हैं, जसवाय आसके पैरा 4 के ऄधीन सारणी में यथाजवर्वनष्ट प्रजतजिद्ध दिलाकलापों के मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवीक्षा की जाएगी और ईसे संबंद्ध जवजनयामक प्राजधकरणों को जनर्ददष्ट दकया जाएगा।
(5) मानीटरी सजमजत का सदस्ट्य-सजचव या संबद्ध ईपायुि ऐसे व्यजि के जवरूद्ध, जो आस ऄजधसूचना के दकसी ईपबंध का ईल्लंघन करता है, पयाावरण ऄजधजनयम की धारा 19 के ऄधीन पररवाद फाआल करने के जलए सक्षम होगा। 527319/2021/ESZ 775

(6) मानीटरी सजमजत मुद्दा दर मुद्दा के अधार पर ऄपेक्षाओं पर जनभार रहते हुए संबद्ध जवभागों के प्रजतजनजधयों या
जविेिज्ञों, औद्योजगक संगमों या संबद्ध पणधाररयों के प्रजतजनजधयों को ऄपने जवचार-जवमिा में सहायता के जलए अमंजत्रत
कर सकेगी ।
(7) मानीटरी सजमजत प्रत्येक विा की 31 माचा तक के ऄपने दियाकलापों की वार्विक कारावाइ ररपोटा राज् य के मुख् य
वन् यजीव वाडान को ईपाबंध-IV में संलग्न प्रोफामाा में ईक् त विा के 30 जून तक प्रस्ट्तुत करेगी ।
(8) केन्रीय सरकार का पयाावरण, वन और जलवायु पररवतान मंत्रालय मानीटरी सजमजत को ऄपने कृत्यों के प्रभावी जनवाहन
के जलए ऐसे जनदेि दे सकेगा, जो वह ठीक समझे ।
7. ऄजतररक् त ईपाय.- आस ऄजधसूचना के ईपबंधों को प्रभावी बनाने के जलए केंरीय सरकार और राज् य सरकार, ऄजतररक् त
ईपाय, यदद कोइ हों, जवजनर्ददष् ट कर सकेंगी।
8. ईच्चतम न्यायालय, के अदेि अदद.- आस ऄजधसूचना के ईपबंध भारत के माननीय ईच्चतम न्यायालय या ईच्च न्यायालय
या राष् रीय हररत ऄजधकरण द्वारा पाररत दकए गए या पाररत दकए जाने वाले अदेि, यदद कोइ हो, के ऄध्यधीन होंगे।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE
NOTIFICATION
New Delhi, the 21st September, 2021
S.O. 3922(E).— WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide
notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O.
173(E), dated the 9th January, 2020, inviting objections and suggestions from all persons likely to be affected thereby
within a period of sixty days from the date on which copies of the Gazette containing the said notification were made
available to the public;
AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the
public on the 10th January, 2020;
AND WHEREAS, objections and suggestions received from persons and stakeholders in response to the
aforesaid draft notification were duly considered by the Central Government;
AND WHEREAS, the Coringa Wildlife Sanctuary is located in the Godavari river estuarine area of Bay of
Bengal about five kilometers from Kakinada in the East coast in East Godavari District of Andhra Pradesh. The
Sanctuary lies between 16o 30‟ to 17o North latitude and 82o14‟ to 82o23‟ East longitude. This area was declared as
“Coringa Wildlife Sanctuary” under section 18 of the Wildlife (Protection) Act, 1972 in 1978 through G.O. Ms.
No. 484 Forests and Rural Development (For. III) Department, dated 5th July, 1978, and was notified in the East
Godavari District Gazette No. 8, dated the 22nd August, 1978 and under section 26-A of Wildlife (Protection) Act,
1972 (53 of 1972) in 1998 through G.O. Ms. No. 45, Environment, Forests, Science and Technology Department (For.
III) dated the 21st April, 1998 and was notified in the East Godavari District Gazette vide Ref. No. C5/May/126/97
dated the 16th May, 1998. The total area of Sanctuary is comprising of following three Reserved Forests: (i) Coringa
Reserved Forests; (ii) Coringa extension Reserved Forests; and (iii) Bhyravapalem Reserve Forest extending over an
area of 235.70 square kilometers;
AND WHEREAS, the area of Coringa Wildlife Sanctuary is characterised by estuarine marshy land, except
the Kakinada- Bay. During summer the western part of the Sanctuary does not get totally submerged under high tide
due to higher level than eastern side. The eastern and northern areas are totally marshy land and low lying, it gets
inundated throughout the year. The entire area of Sanctuary is interspersed with mangrove vegetation of the Godavari
river estuarine system, consisting of Coringa, Gaderu and Nilarava rivers, which are branches of the river Godavari;

AND WHEREAS, the major floras of the Coringa Wildlife Sanctuary are Tamarix troupii (palivelu),
Xylocarpus granatum (senuga), Hibiscus tiliaceus (attakanara), Thespesia populneoides (ganguravi), Dalbergia
spinosa (chillinga), Caesalpinia crista (rachis), Derris trifoliata (nalla theega), Sonneratia apetala (kalinga),
Avicennia alba (elava mada), Avicennia marina (tella mada), Avicennia officinalis (nalla mada), Bruguiera cylindrica
(urudu), Bruguiera gymnorrhiza (kandriga), Ceriops decandra (togara), Rhizophora apiculata (ponna), Lumnitzera
racemosa Willd (thanduga), Scyphiphora hydrophyllacea (nara thanduga), Aegiceras corniculatum (guggilam),
Sarcolobus carinatus (balaboddi theega), Ipomoea violacea (tellateega), Clerodendrum inerme (pisingi), Acanthus
ilicifolius (allichi), Suaeda maritima (elakura), Excoecaria agallocha (tilla), Myriostachya wightiana (dhabba gaddi),
etc;
AND WHEREAS, Coringa Wildlife Sanctuary is a beautiful home ground for fishing cats and smooth
coated otters. Dugongs and dolphins are rare visitors of the Sanctuary moving from the sea-side. Significant
population of foxes and Rhesus macaques have also inhabitant in the area. Olive Ridley turtles are also breeding in the
Hope Island and thus the Sanctuary provides vital sites in conservation of Sea Turtles (Olive Ridley). The Sanctuary is
also an important habitat for the birds and more than 234 species of bird including black-headed gull (Larus
ridibundus), common sand piper (Tringa hypoleucas), red shank (Tringa totanus), little egret (Egretta garzetta), cattle
egret (Bablcus ibis), grey heron (Ardea cinerea), western reef heron (Egretta gularis), open billed stork (Anastomus
oscitans), pied kingfisher (Ceryle rudis), black capped kingfisher (Halcyon pileata) and small blue kingfisher (Alcedo
atthis), etc., are found in the Sanctuary. Hence, there is a need of Eco-sensitive Zone around the Coringa Wildlife
Sanctuary;
AND WHEREAS, considering the future development needs of Kakinada city, present activities of
Kakinada port and the primary livelihood activity (i.e. fishing) for the villagers settling around the Sanctuary, it was
decided that, width of Eco-sensitive Zone towards eastern side (i.e., sea-side) 500 meters to 5 kilometers excluding
present port limits, 50 meters towards northern boundary, upto 11.5 kilometers towards southern side and restricted to
50 meters from the boundary line of Coringa Wildlife Sanctuary towards western side (i.e. Kakinda city) has to be
declared for the safety of the wild animals including fishing cat, otters and especially olive Ridley turtles, and also
variety of birds;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are
specified in paragraph 1, around the Coringa Wildlife Sanctuary as Eco-sensitive Zone from ecological,
environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and
processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of
sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in
this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection)
Rules, 1986, the Central Government hereby notifies an area to an extent varying from 50 meters to 11.5 kilometres
around the boundary of Coringa Wildlife Sanctuary, in East Godavari district in the State of Andhra Pradesh as the
Coringa Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone)
details of which are as under, namely: -
- Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 50 meters to
11.5 kilometres around the boundary of Coringa Wildlife Sanctuary and the area of the Eco-sensitive Zone is
177.30 square kilometres.
(2) The boundary description of Coringa Wildlife Sanctuary and its Eco-sensitive Zone is appended as Annexure-I. (3) The maps of the Coringa Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA and Annexure-IIB. (4) Lists of geo-coordinates of the boundary of Coringa Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure-III. (5) No villages are falling in the Eco-sensitive Zone of Coringa Wildlife Sanctuary. - Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco- sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification and get it duly approved by the competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. 527319/2021/ESZ 782

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State
Government, for integrating the ecological and environmental considerations into the said plan:-
(i)
Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Andhra Pradesh State Pollution Control Board; and
(xii) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and
activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all
infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture
conservation, needs of local community and such other aspects of the ecology and environment that need
attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements,
types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places,
horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and
proposed land use features.
(7) The Zonal Master Plan shall provide mechanism for regulating developmental activities in Eco-sensitive
Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and
promote eco-friendly development for security of local communities‟ livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved by the State Government shall be the reference document for the
Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this
notification.
3. Measures to be taken by State Government.- The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for
recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or
residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purposes other than that specified
in clause (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the
Monitoring Committee, and with the prior approval of the competent authority under Regional Town
Planning Act and other rules and regulations of the Central Government or State Government as applicable
and vide provisions of this notification, to meet the residential needs of the local residents and for activities
such as-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting
eco-tourism including home stay; and
(v) promoted activities given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial
development activities without the prior approval of the competent authority under Regional Town Planning

Act and other rules and regulations of the State Government and without compliance of the provisions of
article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and
Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be
corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case
and the correction of said error shall be intimated to the Central Government in the Ministry of Environment,
Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as
provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat
restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their
conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be
drawn up by the State Government in such a manner as to prohibit development activities at or near these
areas which are detrimental to such areas.
(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities
within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the
State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive
Zone.
(e) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary
of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected area till
the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed
only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone
shall be in accordance with the guidelines issued by the Central Government in the Ministry of
Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National
Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-
education and eco-development;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism
activities shall be permitted by the concerned regulatory authorities based on the actual site specific
scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial
establishment construction shall be permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool
reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall
be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a
part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation
plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in
accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the
Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in
accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and
the rules made thereunder.

(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the General Standards for Discharge of Environmental Pollutants covered under the
Environment Act and the rules made thereunder or standards stipulated by the State Government, whichever
is more stringent.
(9) Solid wastes.- Disposal and management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance
with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April,
2016; the inorganic material may be disposed in an environmental acceptable manner at site identified
outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and
regulations using identified technologies may be allowed within Eco-sensitive Zone.
(10) Bio-Medical Waste.– Bio-medical waste management shall be as under:-
(a) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-
Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March,
2016;
(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing
rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as
per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in
the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the
18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste management in
the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste
Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and
Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time
to time.
(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of
the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of
Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and
specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the
Zonal Master plan is prepared and approved by the competent authority in the State Government, the
Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the
rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be in compliance with applicable
laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting
industries shall be permitted to be set up within the Eco-sensitive Zone.
(b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of
Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended
from time to time, unless so specified in this notification, and in addition, the non-polluting cottage
industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive
Zone shall be governed by the provisions of the Environment Act and the rules made thereunder including the

Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable
laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the
Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner
specified in the Table below, namely:-

Setting of industries causing pollution
(water, air, soil, Noise, etc.).
New industries and expansion of existing polluting industries
in the Eco-sensitive Zone shall not be permitted:
Provided that non-polluting industries shall be allowed
within the Eco-sensitive Zone as per classification of
Industries in the guidelines issued by the Central Pollution
Control Board in February, 2016, as amended from time to
time, unless so specified in this notification and in addition
the non-polluting cottage industries shall be promoted.
3.
Establishment of major hydro-electric
project.
Prohibited.
4.
Use or production or processing of any
hazardous substances.
Prohibited.
5.
Discharge of untreated effluents in
natural water bodies or land area.
Prohibited.
6.
Setting up of new saw mills.
New or expansion of existing saw mills shall not be permitted
within the Eco-sensitive Zone.
7.
Setting up of brick kilns.
Prohibited.
B. Regulated Activities
8.
Commercial establishment of hotels and
resorts.
No new commercial hotels and resorts shall be permitted
within one kilometer of the boundary of the protected area or
upto the extent of Eco-sensitive Zone, whichever is nearer,
except for small temporary structures for eco-tourism
activities:
Provided that, beyond one kilometer from the boundary of the
protected area or upto the extent of Eco-sensitive Zone,
whichever is nearer, all new tourist activities or expansion of
existing activities shall be in conformity with the Tourism
Master Plan and guidelines as applicable.
9.
Construction activities.
(a) New commercial construction of any kind shall not be
permitted within one kilometer from the boundary of the

protected area or upto extent of the Eco-sensitive Zone,
whichever is nearer:
Provided that, local people shall be permitted to
undertake construction in their land for their use
including the activities mentioned in sub-paragraph (1)
of paragraph 3 as per building bye-laws to meet the
residential needs of the local residents:
Provided further that the construction activity related to
small scale industries not causing pollution shall be
regulated and kept at the minimum, with the prior
permission from the competent authority as per
applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the
Zonal Master Plan.
10.
Small scale non polluting industries.
Non polluting industries as per classification of industries
issued by the Central Pollution Control Board in February,
2016 as amended from time to time, and non-hazardous,
small-scale and service industry, agriculture, floriculture,
horticulture or agro-based industry producing products from
indigenous materials from the Eco-sensitive Zone shall be
permitted by the competent authority.
11.
Felling of trees.
(a) There shall be no felling of trees in the forest or
Government or revenue or private lands without prior
permission of the competent authority in the State
Government.
(b) The felling of trees shall be regulated in accordance with
the provisions of the concerned Central or State Act and
the rules made thereunder.
12.
Collection of Forest produce or Non-
Timber Forest produce.

- Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the State Government from time to time. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended as Annexure IV. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
- Additional measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
- Orders of Supreme Court, etc.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon‟ble Supreme Court of India or High Court or the National Green Tribunal.
