पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् अजधसूचना नई दिल्ली, 5 अगस्ट्त 2020 का.आ. 2632(अ).— प्रारुप अजधसूचना भारत के रािपत्र, असाधारण में भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 4322 (अ), तारीख 28 नवम्बर, 2019, द्वारा प्रकाजित की गई थी जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करने वाले रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थे; और, उि प्रारूप अजधसूचना को अन्तर्वाष्ट करने वाली रािपत्र की प्रजतर्ां िनता को तारीख 29 नवम्बर, 2019, को उपलब्ध करा िी गई थी; और, प्रारुप अजधसूचना के उत्तर में व्यजिर्ों और पणधाररर्ों से कोई भी आक्षेप और सुझाव प्राप्त नहीं हुए; और, कृष्णा वन्र्िीव अभर्ारण्र् आंध्र प्रिेि सरकार के वन्र्िीव (संरक्षण) अजधजनर्म, 1972 की धारा 26 (क) के अधीन िी.ओ.एमएस.सं.79 पर्ाावरण, वन, जवज्ञान और प्रौद्योजगकी (एफ ओ आर-III), तारीख 27.06.1998 को घोजित दकर्ा गर्ा। अभर्ारण्र् का कुल क्षेत्रफल 194.81 वगा दकलोमीटर है जिसमें नचुगूंटा खंड-II ररज़वा वन (आर एफ) सं. 2333] नई दिल्ली, बृहस्ट् पजतवार, अगस्ट् त 6, 2020/श्रावण 15, 1942

8.7548 वगा दकलोमीटर है जिसमें दक 15°- 42” से 16°-00” उत्तर और 80°- 46” से 81°- 08” पूवा के बीच में
अभर्ारण्र् क्षेत्र के िो रािस्ट्व जिलें, अथाात् कृष्णा और गुंटूर िाजमल है;
और, कृष्णा वन्र्िीव अभर्ारण्र् के वनस्ट्पजत और िीविंतु में जवजिष्ट पाररजस्ट्थजतकी प्रणाली का गठन दकर्ा गर्ा
है, िो कृष्णा एस्ट्टुरीन क्षेत्र में जवद्यमान ज्वारीर् वन (मैंग्रोव) की जविेिता है; निी के दकनारे के साथ मैंग्रोव कृष्णा डेल्टा
कॉम्पलैक्स में जिला पर्ाावास बनाते है; मैंग्रोव लवण टोल्रेंट वन पाररजस्ट्थजतकी–प्रणाली है िो मुख्र् रूप से जवश्व के
उष्णकरटबंधीर् और उपोष्णकरटबंधीर् अंतज्वााररर् क्षेत्रों में पाए िाते हैं, जिनमें जवजिष्ट िैजवक और भू- वैज्ञाजनक
जविेिताएं हैं और वे न केवल अत्र्जधक संवेिी और उत्पािक क्षेत्र हैं, बजल्क झींगा, िेल और दफन मछली आदि के जलए
नसारी क्षेत्र के रूप में भी कार्ा करते हैं। मैंग्रोव वन में होने वाली वनस्ट्पजत और िीविंतु में लवणता की जवजभन्न जडग्री को
सहन करने की जविेि क्षमता होती है; अनुकूल जस्ट्थजतर्ों में मैंग्रोव सघन वनों का व्यापक उत्पािन पारर-प्रणाली बनाते हैं।
वह एक िूसरे से संबंजधत पौधों और पिुओं की कई प्रिाजतर्ों के जलए वास कर रहे हैं; अभर्ारण्र् में पौधों और पिुओं की
जवजभन्न प्रिाजतर्ों के बीच अंतर-संबंध अध्र्र्न के जलए रूजच का जविर् है;
और, अन्र् प्रिाजतर्ों के साथ ज्वारीर् वन (मैंग्रोव वन) मुख्र् प्रकार के वन एजवकेजनर्ा ऑदफदकनाजलस,
एजवकेजनर्ा मरीना, एजवकेजनर्ा अल्बा, राहीिोफोरा कोन्िुगाटा, एक्सोकररर्ा एग्लोचा, लुजमन्टिेरा रेकेमोसा, एगेकेरेस
कोरजनकुलातम, एकेंथुस इल्लीदकफोजलउस, दिप्स रोक्बुरजघइना, बरूगुइरा कोंिुगाटा, कारपा मोलेकेंजसस, डालबेरजगर्ा
जस्ट्पनोसा, डेरीस उलीगनोसा, ए केंथुस इजलदकफोजलउस, सेसुजवर्म पोरटुलाकुस्ट्रम, सुआडा नुडीफलोरा, सुआडा
मोनोजवका, साजलकोर्नार्ा ब्रोइएट, मार्ररर्ो स्ट्टाच्र्ा आदि है; अभर्ारण्र् में मुख्र् िीविंतु ग्रेट िेस्ट्टेड ग्रेब, छोटा ग्रेब,

स्ट्वाल्लोव, रोज़ी पास्ट्टोर, ग्रे हेडेड मैना, लाल वेंटेड बुलबुल, जचतकबरा बाब्बलेर, लािा बुस वाबालर, असह्य वरन वाबालर,
ब्राउन लैफ वाबालर, रेड स्ट्टाटा, जवजचत्र चाट, पपाल िकरखोर, सफेिी पेजलकन, बांकर, स्ट्पून जबल्ल, रीसस बंिर, पोंड और
ग्रीन मेंढक, री मेंढक, हाउस गेक्को, वाल्ल जछपकली, गोल्डन जछपकली, धारीधार कैल बैक, ओजलव कैलबैक, कोबरा,
रूस्ट्सेलस वाइपर, हॉक नोसड सी सााँप, हॉक्सजबल सी, एस्ट्टुरीन मगरमच्छ, आदि उपलब्ध है; और अभर्ारण्र् में ओजलव
ररडले कछुआ भी प्रिनन करते हैं और जपछले तीन विों से अभर्ारण्र् में समुद्री कछुआ (ओजलव ररडले) का संरक्षण
महत्त्वपूणा दिर्ाकलाप बन गर्ा है;
और, कृष्णा वन्र्िीव अभर्ारण्र् और के चारों ओर के क्षेत्र को, जिसका जवस्ट्तार और सीमाऐं इस अजधसूचना के
पैरा 1 में जवजनर्िाष्ट हैं, पर्ाावरण की िृजष्ट से पाररजस्ट्थजतकी संवेिी िोन के रूप में सुरजक्षत और संरजक्षत करना और उि
पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों के वगो के प्रचालन और प्रसंस्ट्करण करने को प्रजतजिद्ध करना आवश्र्क है;
अतः, इसजलए, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत
पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खंड
(xiv) और उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, आंध्र प्रिेि राज्र् के कृष्णा और गुंटूर जिला के कृष्णा
वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर 1.0 दकलोमीटर से 2.90 दकलोमीटर तक जवस्ट् ताररत क्षेत्र कृष्णा वन्र्िीव
अभर्ारण्र् को पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके पश् चात् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा है) के रूप में
अजधसूजचत करती है, जिसके जववरण जनम्नानुसार है, अथाात् :-

- पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार और उसकी सीमाएं- (1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार कृष्णा वन्र्िीव
अभर्ारण्र् की सीमा के चारों ओर 1.0 दकलोमीटर तक जवस्ट्तृत है, िब तक दक उत्तरी सीमा पर एक वबंिु सवेक्षण स्ट्टेिन
11 और 12 के बीच है, िहां नचुगुंटा ररज़वा वन खंड पाररजस्ट्थजतकी संवेिी िोन में िाजमल है; िहां जवस्ट्तार 2.90
दकलोमीटर है और पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल 175.33 वगा दकलोमीटर है।
(2)
पाररजस्ट्थजतकी संवेिी िोन और कृष्णा वन्र्िीव अभर्ारण्र् की सीमा का जववरण उपाबंध I के रुप में उपाबद्ध है। (3)
सीमा जववरण और अक्षांि और िेिांतर के साथ पाररजस्ट्थजतकी संवेिी िोन को सीमांदकत करते हुए कृष्णा वन्र्िीव अभर्ारण्र् के मानजचत्र उपाबंध-IIक, उपाबंध-IIख और उपाबंध-IIग के रूप में उपाबद्ध है। (4)
पाररजस्ट्थजतकी संवेिी िोन और कृष्णा वन्र्िीव अभर्ारण्र् की सीमा के भू-जनिेिांकों की सूची
उपाबंध III की सारणी क और सारणी ख में िी गई है। (5)
मुख्र् वबंिुओं के भू जनिेिांकों के साथ प्रस्ट्ताजवत पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाले ग्रामों की सूची उपाबंध-IV के रूप में उपाबद्ध है। - पाररजस्ट्थजतकी संवेिी िोन के जलए आंचजलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों
के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से
और राज्र् के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसूचना में दिए गए अनुबंधों का पालन करते हुए आंचजलक
महार्ोिना तैर्ार करेगी।
(2)
राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत से िो इस अजधसूचना में जवजनर्िाष् ट दकए गए हैं के अनुसार तथा सुसंगत केंद्रीर् और राज् र् जवजधर्ों के अनुरुप और केंद्रीर् सरकार द्वारा िारी मागाजनिेिों, र्दि कोई हों, द्वारा तैर्ार होगी । (3)
आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करने के जलए राज् र् सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार होगी, अथाात्:- (i) पर्ाावरण; (ii) वन और वन्र्िीव;
(iii) कृजि; (iv) रािस्ट् व; (v) िहरी जवकास; (vi) पर्ाटन; (vii) ग्रामीण जवकास;
(viii) वसंचाई और बाढ़ जनर्ंत्रण, (ix) नगरपाजलका प्रिासन; (x) सड़कें और इमारतें; (xi) आंध्र प्रिेि राज्र् प्रिूिण जनर्ंत्रण बोडा;

बंिरगाह;
(xiii)
मत्स्ट्र्;
(xiv)
इंडस्ट्रीि;
(xv)
एपीटीआरएएनएससीओ;
(xvi)
रेलवे;
(xvii)
पंचार्ती राि; और
(xviii) लोक जन मााण जव भाग।
(4)
आंचजलक महार्ोिना अनुमोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दिर्ाकलापों पर कोई जनबंधन
अजधरोजपत नहीं करेगी िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िाष् ट न हो और आचंजलक
महार्ोिना सभी अवसंरचना और दिर्ाकलापों में िो अजधक िक्षता और पाररजस्ट्थजतकी अनुकूल हों का
संवधान करेगी ।
(5)
आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह
क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, िल संभर प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की
आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण से संबंजधत ऐसे अन्र् पहलुओं, जिन पर ध्र्ान िेना
आवश्र्क है, के जलए उपबंध होंगे ।
(6)
आंचजलक महार्ोिना जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेिताओं के ब्र्ौरों से अनुसमर्थात
मानजचत्र के साथ सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों,
कृजि क्षेत्रों, ऊपिाऊ भूजम, हररत क्षेत्र िैसे उद्यान और उसी प्रकार के स्ट् थान, उद्यान कृजि क्षेत्र,
फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभ्र्कंन करेगी।
(7)
आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करेगी और सारणी में
सूचीबद्ध पैरा 4 में प्रजतजिद्ध और जवजनर्जमत दिर्ाकलापों का अनुपालन करेगी और स्ट् थानीर् समुिार्ों
की िीजवका को सुरजक्षत करने के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजित और उसकी
अजभवृजद्ध भी करेगी।
(8)
आंचजलक महार्ोिना प्रािेजिक जवकास र्ोिना की सह-जवस्ट्तारी होगी ।
(9)
इस प्रकार अनुमोदित आंचजलक महार्ोिना इस अजधसूचना के उपबंधों के अनुसार मानीटरी के अपने
कार्ों को करने के जलए मानीटर सजमजत के जलए एक संिभा िस्ट्तावेि तैर्ार करेगी ।
3. राज्र् सरकार द्वारा दकए िाने वाले उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करने के जलए
जनम्नजलजखत उपार् करेगी, अथाात्:-
(1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंिन के प्रर्ोिनों के
जलए जचजन्हत दकए गए पाकों और खुले स्ट्थानों का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक संबद्ध जवकास दिर्ाकलापों के
जलए उपर्ोग र्ा संपररवतान नहीं होगा:
परंतु र्ह दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भाग (क) में जवजनर्िाष्ट प्रर्ोिनों से जभन्न प्रर्ोिन के जलए कृजि
और अन्र् भूजम का संपररवतान मानीटरी सजमजत की जसफाररि पर और र्था लागू और क्षेत्रीर् नगर र्ोिना अजधजनर्म और
केन्द्रीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से, और इस

अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करने के जलए अनुज्ञात
दकर्ा िाएगा, िैसे:-
(i)
जवद्यमान सड़कों को चौड़ा करना और उन्हें सुिृढ़ करना तथा नई सड़कों का संजनमााण;
(ii)
बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;
(iii)
प्रिूिण उत्पन्न न करने वाले लघु उद्योग;
(iv)
कुटीर उद्योगों जिनके अंतगात ग्रामीण उद्योग भी हैं; सुजवधािनक भण्डार और स्ट्थानीर् सुजवधाएं सहार्क
पाररजस्ट्थजतकी पर्ाटन जिसके अन्तगात गृह वास सजम्मजलत है; और
(v)
पैरा 4 के अधीन दिए गए संवर्धात दिर्ाकलाप:
परंतु र्ह और दक प्रािेजिक नगर र्ोिना अजधजनर्म और राज्र् सरकार के अन्र् जनर्मों और जवजनर्मों के अधीन
सक्षम प्राजधकारी के पूवा अनुमोिन और संजवधान के अनुच्छेि 244 के उपबंधों र्ा तत्समर् प्रवृत्त जवजध के उपबंधों के
अनुपालन के जबना, जिसके अन्तगात अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता)
अजधजनर्म, 2006 (2007 का 2) भी है, वाजणजज्र्क र्ा औद्योजगक जवकास दिर्ाकलापों के जलए िनिातीर् भूजम का
उपर्ोग अनुज्ञात नहीं होगा:
परंतु र्ह और भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भू-अजभलेखों में उपसंिात कोई गलती, मानीटरी
सजमजत के जवचार प्राप्त करने के पिात् राज्र् सरकार द्वारा प्रत्र्ेक मामले में एक बार ठीक होगी और उि गलती के सुधार
की सूचना केंद्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी:
परंतु र्ह और भी दक गलती के संिोधन में इस उप पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा में
भू-उपर्ोग का पररवतान सजम्मजलत नहीं होगा;
(ख) वनीकरण तथा वास िीणोद्धार दिर्ाकलापों सजहत अप्रर्ुक् त र्ा अनुत् पािक कृजि क्षेत्रों में पुन: वनीकरण
करने के प्रर्ास दकए िाएंगे।
(2) प्राकृजतक िल स्रोतों.- आचंजलक महार्ोिना में सभी प्राकृजतक िल स्रोतों के आवाह क्षेत्रों की पहचान की
िाएगी और उनके संरक्षण और नवीकरण के जलए र्ोिना सजम् मजलत होगी और राज् र् सरकार द्वारा ऐसे क्षेत्रों पर र्ा उनके
जनकट जवकास दिर्ाकलाप प्रजतजिद्ध करने के बारे में िो ऐसे क्षेत्रों के जलए अजहतकर हो ऐसी रीजत से मागाििाक जसद्धांत
तैर्ार दकए िाएंगे ।
(3) पर्ाटन र्ा पाररजस्ट्थजतकी पर्ाटन.- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन
दिर्ाकलाप र्ा जवद्यमान पर्ाटन दिर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी संवेिी िोन के
जलए होगा।
(ख) पर्ाटन महार्ोिना राज्र् पर्ाटन जवभाग द्वारा राज्र् पर्ाावरण और वन जवभाग के परामिा से तैर्ार होगी।
(ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना के एक घटक के रूप में होगी।
(घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िाएगी।
(ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दिर्ाकलाप जनम्नानुसार जवजनर्जमत होंगे:-
(i)
संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें
िो भी जनकट है, नर्े वाजणजज्र्क होटल और सैरगाह के सजन्नमााण अनुज्ञात नहीं होंगे:

परंतु, र्ह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर की िूरी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक
होटलों और ररिॉटा का स्ट्थापना केवल पूवा पररभाजित और नामजनर्िाष्ट क्षेत्रों में पर्ाटन महार्ोिना के अनुसार
पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए ही अनुज्ञात होगा;
(ii)
पाररजस्ट्थजतकी संवेिी िोन के भीतर नए पर्ाटन दिर्ाकलापों र्ा जवद्यमान पर्ाटन दिर्ाकलापों का
जवस्ट्तार केंद्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् के मागाििाक जसद्धांतों के द्वारा
तथा राष् रीर् व् र्ाघ्र संरक्षण प्राजधकरण, द्वारा िारी पाररजस्ट्थजतकी–पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और
पाररजस्ट्थजतकी-जवकास पर बल िेते हुए (समर्-समर् पर र्था संिोजधत) िारी मागाििाक जसद्धांतों के
अनुसार होगा;
(iii)
आंचजलक महार्ोिना का अनुमोिन दकए िाने तक, पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन
दिर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्िाष्ट संवीक्षा और मानीटरी सजमजत की जसफाररि पर
आधाररत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन
के भीतर दकसी नर्े होटल र्ा ररसोटा र्ा वाजणजज्र्क स्ट्थापना का संजनमााण अनुज्ञात नहीं दकर्ा िार्ेगा ।
(4) नैसर्गाक जवरासत.- पाररजस्ट्थजतकी संवेिी िोन में महत्वपूणा नैसर्गाक जवरासत के सभी स्ट्थलों िैसे िीन कोि
आरजक्षत क्षेत्र, िैल जवरचनाएं, िल प्रपातों, झरनों, घाटी मागों, उपवनों, गुफाएं, स्ट्थलों, भ्रमण, अश्वरोहण, प्रपातों आदि
की पहचान की िाएगी और जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रुप में परररक्षण और संरक्षण के
जलए तैर्ार की िाएगी ।
(5) मानव जनर्मात जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, जिल्प-तथ्र्, ऐजतहाजसक,
स्ट्थापत्र्, सौंिर्ापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और उपक्षेत्रों की पहचान और उनके संरक्षण के जलए जवरासत
र्ोिना आंचजलक महार्ोिना के भाग के रुप में तैर्ार की िाएगी।
(6) ध् वजन प्रिूिण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रिूिण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 में
जनर्त उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रिूिण के जनर्ंत्रण और जनवारण का अनुपालन दकर्ा
िाएगा।
(7) वार्ु प्रिूिण.- पाररजस्ट्थजतकी संवेिी िोन में, वार्ु प्रिूिण के जनवारण और जनर्ंत्रण का वार्ु (प्रिूिण जनवारण
और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार अनुपालन
दकर्ा िाएगा।
(8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सारण, साधारण मानकों
के उपबंधों के अनुसार पर्ाावरणीर् अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आने वाले पर्ाावरणीर्
प्रिूिण के जनस्ट्सारण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक कठोर हो, के उपबंधों
के अनुसार होगा।
(9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकर्ा िाएगा:-
(क)
पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन
और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1357(अ), तारीख 8 अप्रैल, 2016 द्वारा
प्रकाजित ठोस अपजिष्ट प्रबंधन जनर्म, 2016, के उपबंधों के अनुसार दकर्ा िाएगा। अकाबाजनक पिाथो
का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से
दकर्ा िाएगा;
(ख)
पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों (ईएसएम) का उपर्ोग करते हुए जवद्यमान जनर्मों
और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा िा
सकेगा।

(10) िैव जचदकत्सा अपजिष् ट.- िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:-
(क)
पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और
िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016, द्वारा
प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
(ख)
पाररजस्ट्थजतकी संविी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों
के अनुरूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।
(11) प्लाजस्ट्टक अपजिष्ट प्रबंधन.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट प्रबंधन का जनपटान भारत
सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सा.का.जन
340(अ), तारीख 18 माचा, 2016, द्वारा प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा
िाएगा।
(12) जनमााण और जवध्वंस अपजिष्ट प्रबंधन.- पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिष्ट प्रबंधन
का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना
सं.सां.का.जन 317(अ), तारीख 29 माचा, 2016, द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंधन जनर्म, 2016 के उपबंधों के
अनुसार दकर्ा िाएगा ।
(13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन
और िलवार्ु पररवतान मंत्रालर् द्वारा, समर्-समर् पर र्थासंिोजधत, प्रकाजित ई–अपजिष्ट प्रबंधन जनर्म, 2016, के
उपबंधों के अनुसार दकर्ा िाएगा।
(14) र्ानीर् र्ातार्ात.- र्ातार्ात की र्ानीर् गजतजवजधर्ां आवास के अनुकूल जवजनर्जमत होंगी और इस संबंध में
आंचजलक महार्ोिना में जविेि उपबंध सजम्मजलत दकए िाएंगे और आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार
के सक्षम प्राजधकारी द्वारा अनुमोदित होने तक, मानीटरी सजमजत सुसंगत अजधजनर्मों और उसके अधीन बनाए गए जनर्मों
और जवजनर्मों के अनुसार र्ानीर् दिर्ाकलापों के अनुपालन को मानीटर करेगी ।
(15) र्ानीर् प्रिूिण.- लागू जवजधर्ों के अनुपालन में र्ानीर् प्रिूिण का जनवारण और जनर्ंत्रण दकर्ा िाएगा और
स्ट्वच्छक ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे।
(16) औद्योजगक ईकाइर्ां.- (i) रािपत्र में इस अजधसूचना के प्रकािन पर र्ा उसके पिात पाररजस्ट्थजतकी संवेिी
िोन के भीतर दकसी नए प्रिूिण करने वाले उद्योगों की स्ट्थापना अनुज्ञात नहीं की िाएंगी ।
(ii)
केन्द्रीर् प्रिूिण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी मागाििाक जसद्धांतों में उद्योगों के वगीकरण
के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाष्ट न हो; पाररजस्ट्थजतकी संवेिी िोन के भीतर
केवल गैर- प्रिूिणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रिूिणकारी उद्योगों
को बढ़ावा दिर्ा िाएगा।
(17) पहाड़ी ढलानों को संरक्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार होगा:-
(क)
आंचजलक महार्ोिना पहाड़ी ढलानों पर क्षेत्रों का संकेत होगा िहां दकसी भी संजनमााण की अनुमजत
नहीं िी िाएगी;

(ख)
कटाव के एक उच्च जडग्री के साथ जवद्यमान खड़ी पहाड़ी ढलानों र्ा ढलानों पर दकसी भी संजनमााण की
अनुमजत नहीं िी िाएगी ।
- पाररजस्ट्थजतकी संवेिी िोन में प्रजतजिद्ध और जवजनर्जमत दकए िाने वाले दिर्ाकलापों की सूची.- पाररजस्ट्थजतकी संवेिी िोन में सभी दिर्ाकलाप पर्ाावरण अजधजनर्म के उपबंधों और उसके अधीन बनाए गए जनर्मों जिसके अन्तगात तटीर् जवजनर्मन िोन अजधसूचना 2011 और पर्ाावरणीर् समाघात जनधाारण अजधसूचना, 2006 और अन्र् लागू जवजधर्ों के जिसमें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53) सजम्मजलत हैं और दकर्े गर्े संिोधनों द्वारा िाजसत होंगे और नीचे िी गई सारणी में जवजनर्िाष्ट रीजत में जवजनर्जमत होंगे, अथाात् :- सारणी िम सं.

जनिी उपर्ोग के जलए मकानों के संजनमााण र्ा मरम्मत के जलए
धरती को खोिना और मकान बनाने के जलए िेिी टाइल्स र्ा ईंटों
का जनमााण करना भी सजम्मजलत है, के जसवार् सभी प्रकार के नए
और जवद्यमान खनन (लघु और वृहत खजनि), पत्थर की खानें और
उनकों तोड़ने की इकाइर्ां तत्काल प्रभाव से प्रजतजिद्ध होगी।
(ख)
खनन प्रचालन, माननीर् उच्चतम न्र्ार्ालर् की ररट र्ाजचका
(जसजवल) सं. 1995 का 202 टी.एन. गौडाबमान जथरुमूलपाि
बनाम भारत संघ के मामले में आिेि तारीख 4 अगस्ट्त ,2006
और ररट र्ाजचका (सी) सं. 2012 का 435 गोवा फाउंडेिन बनाम
भारत संघ के मामले में तारीख 21 अप्रैल ,2014 के आिेि के
अनुसरण में प्रचालन होगा ।

प्रिूिण (िल, वार्ु, मृिा, ध्वजन आदि) उत्पन करने वाले उद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रिूिणकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नहीं होगी: परन्तु र्ह दक केन्द्रीर् प्रिूिण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 में िारी मागा ििाक जसद्धान्तों में उद्योगों के वगीकरण के अनुसार िब तक दक अजधसूचना में ऐसा जवजनर्िाष्ट न हों, पाररजस्ट्थजतकी संवेिी िोन के भीतर गैर-प्रिूिणकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि गैर-प्रिूिणकारी कुटीर उद्यागों को बढ़ावा दिर्ा िाएगा। 3. बृहत िल जवद्युत पररर्ोिना की स्ट्थापना । लागू जवजधर्ों के अनुसार प्रजतजिद्ध (अन् र्था उपबंजधत के जसवार्) होंगे । 4.
दकसी पररसंकटमर् पिाथों का उपर्ोग र्ा उत्पािन र्ा प्रसंस्ट्करण। लागू जवजधर्ों के अनुसार प्रजतजिद्ध (अन् र्था उपबंजधत के जसवार्) होंगे । 5.
प्राकृजतक िल जनकार्ों र्ा क्षेत्र भूजम में अनुपचाररत बजहस्रााव का जनस्ट्सारण । लागू जवजधर्ों के अनुसार प्रजतजिद्ध (अन् र्था उपबंजधत के जसवार्) होंगे । 6.
नई आरा जमलों की स्ट्थापना।
पाररजस्ट्थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा जमलों का
जवस्ट् तार अनुज्ञात नहीं होगा ।
7.
ईंट भट्टों की स्ट्थापना करना। लागू जवजधर्ों के अनुसार प्रजतजिद्ध (अन् र्था उपबंजधत के जसवार्) होंगे ।
9 ख. जवजनर्जमत दिर्ाकलाप 8.
वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना । पाररजस्ट्थजतकी पर्ाटन दिर्ाकलापों लघु अस्ट्थार्ी संरचनाओं के जसवार् संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट है, नए वाजणजज्र्क होटल और ररसोटों को अनुज्ञात नहीं दकर्ा िाएगा: परंतु र्ह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के परे र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक इनमें से िो भी जनकट हो सभी नए पर्ाटन दिर्ाकलाप र्ा जवद्यमान दिर्ाकलाप का जवस्ट्तार पर्ाटन महार्ोिना और र्था लागू मागाििी जसद्धांतों के अनुरुप होगा। 9.
संजनमााण दिर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट हो, दकसी भी प्रकार के नर्े वाजणजज्र्क संजनमााण की अनुज्ञा नहीं होगी:
परंतु र्ह दक स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत
आवश्र्कताओं को पूरा करने के जलए, पैरा 3 के उप पैरा (1) में सूचीबद्ध
दिर्ाकलापों सजहत अपने प्रर्ोग के जलए, अपनी भूजम में भवन उप-
जवजधर्ों के अनुसार, संजनमााण करने की अनुज्ञा होगी, िैसे:-
परंतु र्ह दक गैर–प्रिूिणकारी लघु उद्योगों से संबंजधत संजनमााण
दिर्ाकलाप लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम
प्राजधकारी की पूवा अनुमजत से जवजनर्जमत दकए िाएंगे और वे न्र्ूनतम
होंगे ।
(ख) एक दकलोमीटर क्षेत्र से परे र्े आंचजलक महार्ोिना के अनुसार
जवजनर्जमत होंगे ।
10.
प्रिूिण उत्पन्न न करने वाले लघु उद्योग । फरवरी, 2016 में केन्द्रीर् प्रिूिण जनर्ंत्रण बोडा द्वारा िारी उद्योगों में वगीकरण के अनुसार गैर-प्रिूिणकारी उद्योग और अपररसंकटमर् में, लघु और सेवा उद्योग, कृजि, पुष्प कृजि, उद्यान कृजि र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्री से उत्पािों को उत्पन्न करने वाले कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे। 11.
वृक्षों की कटाई । (क) राज्र् सरकार में सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन, सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर र्ा वनों में वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत केंद्रीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंध के अनुसार जवजनर्जमत होगे । 12.
वन उत्पािों र्ा गैर काष् ठ वन उत्पािों का संग्रहण। लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे । 13.
जवद्युत और संचार टावरों का पररजनमााण और केबलों के जबछाए िाने और अन्र् बुजनर्ािी ढांचे । लागू जवजधर्ों के अधीन जवजनर्जमत होंगे । (भूजमगत केबल के जबछाए िाने को बढ़ावा दिर्ा िाएगा)। 14.
नागररक सुख सुजवधाओं सजहत अवसंरचनाएं । न्र्ूनीकरण उपार्ों को लागू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाना । 15.
जवद्यमान सड़कों को चौड़ा करना और उन्हें सुिृढ करना तथा नवीन सड़कों का संजनमााण । न्र्ूनीकरण उपार्ों को लागू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाना। 16.
पर्ाटन से संबंजधत अन्र् दिर्ाकलाप िैसे लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे ।

गमा वार्ु गुब्बारें, हेलीकाप्टर, ड्रोन,
माइिोलाइटस आदि द्वारा पाररजस्ट्थजतकी
संवेिी िोन क्षेत्र के ऊपर से उड़ना िैसे
दिर्ाकलाप करना।
17.
पहाड़ी ढालों और निी तटों का संरक्षण । लागू जवजधर्ों के अधीन जवजनर्जमत होंगे । 18.
राजत्र में र्ाजनक र्ातार्ात का संचलन । लागू जवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होंगे । 19.
स्ट्थानीर् समुिार्ों द्वारा चल रही कृजि और बागवानी प्रथाओं के साथ िुग्धिाला, िुग्घ उद्योग, कृजि और मछली पालन । स्ट्थानीर् लोगों के उपर्ोग के जलए लागू जवजधर्ों के अधीन अनुज्ञात होंगे । 20.
फमो, कंपजनर्ों द्वारा बड़े पैमाने पर वाजणजज्र्क पिुओं और पोल्री फामों की स्ट्थापना । स्ट्थानीर् आवश्र्कताओं को पूरा करने के जलए लागू जवजधर्ों के अधीन जवजनर्जमत (अन्र्था प्रिान दकए गए) होंगे । 21.
प्राकृजतक िल जनकार्ों र्ा सतही क्षेत्र में उपचाररत बजहस्रााव का जनस्ट्तारण । िल जनकार्ों में उपचाररत अपजिष्ट िल र्ा बजहस्रााव के जनस्ट्सारण से बचा िाएगा और उपचाररत अपजिष्ट िल के पुन:चिण और पुन:उपर्ोग के जलए प्रर्ास दकए िाएंगे। अन्र्था लागू जवजधर्ों के अनुसार उपचाररत बजहस्रााव के पुनचािण/प्रवाह के जनवाहन को जवजनर्जमत दकर्ा िाएगा। 22.
सतही और भूिल का वाजणजज्र्क प्रर्ोग एवं जनष्किाण । लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे । 23.
ठोस अपजिष्ट एवं प्रबन्धन। लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे । 24.

5. पाररजस्ट्थजतकी संवेिी िोन की अजधसूचना की मानीटरी के जलए मानीटरी सजमजत- केंद्रीर् सरकार, पर्ाावरण (संरक्षण)
अजधजनर्म, 1986 की धारा 3 की उपधारा (3) के अधीन इस अजधसूचना के उपबंधों की प्रभावी मानीटरी के जलए
मानीटरी सजमजत का गठन करती है, िो जनम्नजलजखत से जमलकर बनेगी अथाात्:-

- जनिेि–जनबंधन:- (1) मानीटरी सजमजत इस अजधसूचना के उपबंधों के अनुपालन को मानीटर करेगी।
(2)
मानीटरी सजमजत का कार्ाकाल तीन विा तक र्ा राज्र् सरकार द्वारा नई सजमजत के पुन: गठन तक के जलए होगा और तत्पिात मानीटरी सजमजत राज्र् सरकार द्वारा गरठत की िाएगी। (3)
ऐसे दिर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533 (अ), तारीख 14 जसतम्बर, 2006 की अनुसूची में सजम्मजलत हैं, और िो पाररजस्ट्थजतकी संवेिी िोन में आते हैं, जसवार् इसके िो पैरा 4 के अधीन सारणी में र्था जवजनर्िाष्ट प्रजतजिद्ध दिर्ाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त के जलए केद्रींर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को जनर्िाष्ट दकर्ा िाएगा। (4)
इस अजधसूचना के पैरा 4 के अधीन सारणी में र्था जवजनर्िाष्ट प्रजतजिद्ध दिर्ाकलापों के जसवार्, भारत सरकार के तत् कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अजधसूचना के अनुसूची के अधीन ऐसे अनुसूची में दिर्ाकलापों, जिन्हें सजम्मजलत नहीं दकर्ा गर्ा है, परंतु पाररजस्ट्थजतकी संवेिी िोन में आते हैं, ऐसे दिर्ाकलापों की वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं पर आधाररत जनगरानी सजमजत द्वारा संवीक्षा की िाएगी और उसे संबद्ध जवजनर्ामक प्राजधकरणों को जनर्िाष्ट दकर्ा िाएगा ।

मानीटरी सजमजत का सिस्ट्र्-सजचव र्ा संबद्ध उपार्ुि ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लंघन करता है, पर्ाावरण अजधजनर्म, की धारा 19 के अधीन पररवाि फाइल करने के जलए सक्षम होगा।

मानीटरी सजमजत मुद्दा िर मुद्दा के आधार पर अपेक्षाओं पर जनभार रहते हुए संबद्ध जवभागों के
प्रजतजनजधर्ों र्ा जविेिज्ञों, औद्योजगक संगमों र्ा संबद्ध पणधाररर्ों के प्रजतजनजधर्ों को अपने जवचार-
जवमिा में सहार्ता के जलए आमंजत्रत कर सकेगी ।

मानीटरी सजमजत प्रत्र्ेक विा की 31 माचा तक के अपने दिर्ाकलापों की वार्िाक कारावाई ररपोटा राज् र् के
मुख् र् वन् र्िीव वाडान को उपाबंध V के अनुसार प्रोफामाा उक् त विा के 30 िून तक प्रस्ट्तुत करेगी ।

केन्द्रीर् सरकार का पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् मानीटरी सजमजत को अपने कृत्र्ों के
प्रभावी जनवाहन के जलए समर्-समर् पर ऐसे जनिेि िे सकेगा, िो वह ठीक समझे ।
7. अजतररि उपार् - इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए केंद्रीर् सरकार और राज् र् सरकार, अजतररक् त
उपार्, र्दि कोई हों, जवजनर्िाष् ट कर सकेंगी।
8. उच्चतम न्र्ार्ालर्, आदि के आिेि- इस अजधसूचना के उपबंध भारत के माननीर् उच्चतम न्र्ार्ालर् र्ा उच्च न्र्ार्ालर्

S.O. 2632(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide
notification of the Government of India in the Ministry of Environment, Forest and Climate Change number
S.O. 4322 (E), dated the 28th November, 2019, inviting objections and suggestions from all persons likely to be
affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said
notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the
public on the 29th November, 2019;
AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response
to the draft notification;
AND WHEREAS, Krishna Wildlife Sanctuary was declared under section 26(A) of Wildlife (Protection)
Act, 1972 vide G.O.Ms.No.79 Environment, Forests, Science and Technology (For-III), dated the 27th June, 1998 of
the Government of Andhra Pradesh; the total area of the Sanctuary is 194.81 square kilometers of which Nachugunta
Block – II Reserved Forest (RF) of 8.7548 square kilometers is to be included in the Sanctuary area covering two
Revenue districts, namely Krishna and Guntur in between 150 42” to 160 00” North and 800 46” to 810 08” East;
AND WHEREAS, the flora and fauna of Krishna Wildlife Sanctuary constitute a unique eco-system
characterised by tidal forest (Mangrove) existing in the Krishna estuarine area; the mangroves with rivulet estuaries
form a district habitat in the Krishna delta complex; the Mangroves are the salt tolerant forest eco-system found
mainly in the tropical and sub-tropical intertidal regions of the world, having specific biological and geological
characteristics and they are not only highly sensitive and productive zones, but also act as nursery grounds for shrimp
shale, fin-fish, etc; the flora and fauna occurring in the Mangrove forest have the special ability to tolerate various
degrees of salinity; under favorable conditions the mangroves form an extensive productive eco-system of dense
forests and also act as shelter belts and they are abode for a number of species of plants and animals associated with
each other; and the inter-relationship between various species of plants and the animals in the Sanctuary is a matter of
interest for study;
AND WHEREAS, the main type of forest is tidal forest (Mangrove Forest) with constituting species of
Avicenia officianalis, Avicenia marina, Avicenia alba, Rhizophora conjugate, Exocaria agallocha, Lumintzera
racemosa, Aegiceras corniculatum, Acanthus illicifolius, Criops roxburghiana, Bruguiera conjugate, Carapa
moleccensis, Dalbergia spinosa, Derris ulignosa, A canthus ilicifolius, Sesuvium portulacustrum, Suaeda nudiflora,
Suaeda monovica, Salicornia brachiate, Myrio stachya, etc ; the major fauna available in the Sanctuary are great
crested grebe, little grebe, Indian shag, little cormorant, purple heron, pond heron, large egret, cattle egret, Indian roof
heron, night heron, chestnut bittern, yellow bittern, glossy ibis, spotted billed duck, mallard, shoveller, red-crested
pochard, tufted duck, comb duck, black winged kite, Indian moorhen, coot or common coot, pheasant tiled jacana,
black winged stilt, red wattled lapwing, golden plover, large sand plover, ringed plover, common sandpiper, pintail
snipe, Jack snipe, little stint, little tern, blue rock pigeon, ringdove, pied crested cuckoo, Indian cuckoo, pied
kingfisher, swallow, rosy pastor, grey headed myna, red vented bulbul, spotted babbler, large bush warbler, ashy wren
warbler, brown leaf warbler, red start, pied bush chat, purple sunbird, white pelican, darter, spoon bill, rhesus monkey,
pond or green frog, tree frog, house gecko, wall lizard, garden lizard, striped keel back, olive keel back, cobra, Russels
viper, hook nosed sea snake, hawksbill sea, estuarine crocodile, etc.; and Olive Ridley turtles are also breeding in the
Sanctuary and the conservation of sea turtles (Olive Ridley) has become an important activity in the Sanctuary for the
last three years;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are
specified in paragraph 1, around the Krishna Wildlife Sanctuary as Eco-sensitive Zone from ecological,
environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and
processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of
sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in
this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection)
Rules, 1986, the Central Government hereby notifies an area to an extent of 1.0 kilometre to 2.90 kilometres around
the boundary of Krishna Wildlife Sanctuary, in Krishna and Guntur districts in the State of Andhra Pradesh as the
Krishna Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone)
details of which are as under, namely: -

- Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 1.0
kilometre uniform around the boundary of Krishna Wildlife Sanctuary except at one point on the northern
boundary i.e. between survey stations 11 and 12, where Nachugunta Reserve Forest Block is included in the Eco-
sensitive Zone, where the extent is 2.90 kilometers; and the area of the Eco-sensitive Zone is 175.33 square
kilometers.
(2) The boundary description of Krishna Wildlife Sanctuary and its Eco-sensitive Zone is appended in
Annexure-I. (3) The maps of the Krishna Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB and Annexure-IIC. (4) Lists of geo-coordinates of the boundary of Krishna Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure III. (5) The list of villages falling in the proposed Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV. - Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco-
sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification for approval of the competent authority in the State.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner
as is specified in this notification and also in consonance with the relevant Central and State laws and the
guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State
Government, for integrating the ecological and environmental considerations into the said plan:-
(i)
Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal Administration;
(x) Roads & Buildings;
(xi) Andhra Pradesh State Pollution Control Board;
(xii) Ports;
(xiii) Fisheries;
(xiv) Industries;
(xv) APTRANSCO;
(xvi) Railway; (xvii) Panchayati Raj; and (xviii) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture

conservation, needs of local community and such other aspects of the ecology and environment that need
attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements,
types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places,
horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and
proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and
regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development
for security of local communities’ livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for
carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.- The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for
recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or
residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purposes other than that specified
in clause (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the
Monitoring Committee, and with the prior approval of the competent authority under Regional Town
Planning Act and other rules and regulations of Central Government or State Government as applicable and
vide provisions of this notification, to meet the residential needs of the local residents and for activities such
as -
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting
eco-tourism including home stay; and
(v) promoted activities given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial
development activities without the prior approval of the competent authority under Regional Town Planning
Act and other rules and regulations of the State Government and without compliance of the provisions of
article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and
Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be
corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case
and the correction of said error shall be intimated to the Central Government in the Ministry of Environment,
Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case except as
provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat
restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their
conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be
drawn up by the State Government in such a manner as to prohibit development activities at or near these
areas which are detrimental to such areas.
(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities
within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the
State Departments of Environment and Forests.

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive
Zone.
(e) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary
of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected area till
the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed
only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone
shall be in accordance with the guidelines issued by the Central Government in the Ministry of
Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National
Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-
education and eco-development;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism
activities shall be permitted by the concerned regulatory authorities based on the actual site specific
scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial
establishment construction shall be permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool
reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall
be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a
part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation
plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in
accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the
Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in
accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and
the rules made thereunder.
(8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the General Standards for Discharge of Environmental Pollutants covered under the
Environment Act and the rules made thereunder or standards stipulated by State Government whichever is
more stringent.
(9) Solid wastes.- Disposal and management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance
with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April,
2016; the inorganic material may be disposed in an environmental acceptable manner at site identified
outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing
rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.
(10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:-
(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the
Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March,
2016.
(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing
rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.

(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as
per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in
the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the
18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste management in
the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste
Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and
Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time
to time.
(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of
the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of
Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and
specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the
Zonal Master plan is prepared and approved by the competent authority in the State Government, the
Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the
rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable
laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting
industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of
Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so
specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive
Zone shall be governed by the provisions of the Environment Act and the rules made thereunder including the
Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable
laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the
Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner
specified in the Table below, namely:-

structures for eco-tourism activities:
Provided that, beyond one kilometer from the boundary
of the protected area or upto the extent of Eco-sensitive
Zone, whichever is nearer, all new tourist activities or
expansion of existing activities shall be in conformity
with the Tourism Master Plan and guidelines as
applicable.
9.
Construction activities.
(a) New commercial construction of any kind shall not
be permitted within one kilometer from the
boundary of the protected area or upto extent of the
Eco-sensitive Zone, whichever is nearer:
Provided that, local people shall be permitted to
undertake construction in their land for their use
including the activities mentioned in sub-paragraph
(1) of paragraph 3 as per building bye-laws to meet
the residential needs of the local residents:
Provided further that the construction activity
related to small scale industries not causing
pollution shall be regulated and kept at the
minimum, with the prior permission from the
competent authority as per applicable rules and
regulations, if any.
(b) Beyond one kilometer it shall be regulated as per
the Zonal Master Plan.
10.
Small scale nonpolluting industries.
Nonpolluting industries as per classification of
industries issued by the Central Pollution Control Board
in February, 2016 and non-hazardous, small-scale and

service industry, agriculture, floriculture, horticulture or
agro-based

11.

5. Monitoring Committee for Monitoring Eco-sensitive Zone Notification.- For effective monitoring of the
provisions of this notification, under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the
Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:-

6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this
notification.
(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new
Monitoring Committee by the State Government and subsequently the Monitoring Committee shall be
constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling
in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4
thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and
referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior
environmental clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are
falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph
4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and
referred to the concerned regulatory authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be
competent to file complaints under section 19 of the Environment Act, against any person who contravenes
the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments,
representatives from industry associations or concerned stakeholders to assist in its deliberations depending
on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of
every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at
Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional measures.- The Central Government and State Government may specify additional measures, if any,
for giving effect to provisions of this notification.
8. Supreme Court, etc. Orders.- The provisions of this notification shall be subject to the orders, if any passed or to
be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.

THE KRISHNA WILDLIFE SANCTUARY
L to K:
The Eco-sensitive Zone boundary starts at Station ‘L’ (Lat: 15.87130 – Long: 80.76450), in
Kothapalem Reserve Forest on the bank of Bay of Bengal 1 kilometer away from the Sanctuary
boundary and runs parallel in westerly direction till it reaches point ‘K’ (Lat: 15.93440 – Long:
80.81770) near Kothapalem village.
K to J:
Then, the Eco-sensitive Zone boundary traverses in south easterly direction to station ‘J’ (Lat:
15.88710 – Long: 80.83400) near Mollagunta village.
J to I:
Then the Eco-sensitive Zone boundary traverses in westerly direction to station ‘I’ (Lat: 15.87980 –
Long: 80.86920) near Mrutunjayapalem village.
I to H:
Then the boundary line traverses from ‘I’ in southerly direction till it reaches station ‘H’ (Lat:
15.80400 – Long: 80.84450) near Lankavanidibba Village.
H to G:
Then the boundary line traverses from ‘H’ in southerly direction till it reaches station ‘G’ (Lat:
15.76980 – Long: 80.83980) near the Bank of River Krishna, where it turns eastwards to cross river
Krishna.
G to F:
Then the boundary line crosses river Krishna enters into Krishna District and joins station ‘F’ (Lat:
15.78960 – Long: 80.86700) near the Elichetladibba Village and runs parallel to the sanctuary
boundary in north – easterly direction.
F to E:
Then the boundary line crosses Nadiperu (An arm of river Krishna) and enters into Nachugunta
Island and joins station ‘E’ (Lat: 15.78940 – Long: 80.88740) near the Nachugunta Village and joins
the south – west corner of Nachugunta Block-II.
E to D:
Then the boundary line runs along the boundary line of Nachugunta R.F. Block-II encircling the
hole block and reaches the north – eastern corner of the block and runs parallel at a distance of 1KM
from the sanctuary boundary and crosses Ballaleru (another arm of river Krishna) and enters into
station ‘D’ (Lat: 15.86920 – Long: 80.96920) near Etimoga village.
D to C:
Then the Eco-sensitive Zone boundary line runs in north – eastern direction 1KM parallel to the
sanctuary boundary line and joins station ‘C’ (Lat: 15.89620 – Long: 80.01620) near
Sangameswaram village.
C to B:
Then the Eco-sensitive Zone boundary line runs in north – eastern direction 1KM parallel to the
sanctuary boundary line and joins station ‘B’ (Lat: 15.93750 – Long: 80.06960) near
Subhadrapuram village.
B to A:
Then the Eco-sensitive Zone boundary line runs in north – eastern direction 1 kilometre parallel to
the sanctuary boundary line and joins station ‘A’ (Lat: 15.99360 – Long: 80.08810) near
Hamsaladeevi village. Then the Eco-sensitive Zone boundary line reaches river Krishna the first
arm and crosses the river and follows the eastern bund of river Krishna till it reaches Bay of Bengal.
31 Then the Eco-sensitive Zone boundary line traverses 1KM parallel to the sanctuary boundary in Bay of Bengal all along the Seaward side of the Sanctuary, encircling it and joins the starting point station ‘L’ (Lat: 15.87130 – Long: 80.76450) in Guntur District and closes.
