ाप ाप ाप ाप अिधसूचना अिधसूचना अिधसूचना अिधसूचना असम के िडIूगढ़ और ितनसुकया िसिवल िजल% म@ िथत देKहग पटकई वयजीव अभयारLय (ड9यूएलएस) को एफआरड9यू.34/2003/पीटी/6 दनांक 19 जून, 2004 को घोिषत कया गया था; िडगबोई संभाग का े8फल 87.12 वग कलोमीटर और िडIूगढ़ संभाग का 24.07 वग कलोमीटर कुल िमलाकर 111.19 वग कलोमीटर े8 को कवर करने वाले िवRमान रज़व वन% के भाग शािमल ह; िजसम@ िडगबोई संभाग म@ ऊपरी देKहग (पिVम खंड) रज़व वन का 56.6950 वग कलोमीटर े8 डीरोक रज़व वन का 30.4255 वग कलोमीटर े8 और िडIूगढ़ संभाग म@ जेपोर रज़व वन का 24.07 वग कलोमीटर े8 शािमल ह;। डीरोक नदी डीरोक रज़व वन के दि णी भाग से बहती है और बड]Kहग नदी ऊपरी देKहग (पिVम खंड) रज़व वन और जेपोर रज़व वन के बीच से बहती है;

मुख जाित (लॉक िग9बन (िबमोपेिथकस लॉक लॉक) है भारत म@ पाया जाने वाला एकमा8 पिVमी वानर है, जो वयजीव (संर ण) अिधिनयम 1972 क अनुसूची-I जाित है और वय जीवजतु और वन*पित,1973 क लु= ाय जाितय% के अंतराfीय ?ापार कव@शन के तहत लु= ाय जाितय% संबंधी परिशA-1 म@ भी शािमल है। वयजीव अभयारLय भी एिशयाई हाथी का मुख पयावास है, िजनक 2011 म@ अनुमािनत संgया 204 और यह असम म@ उ"र म@ ऊपरी देKहग (पिVम खंड) रज़व वन और दि ण म@ जेपोर रज़व वन के साथ जुड़ा (आ है। इसके अलावा, यह दि ण पूव सीमा पर अणाचल देश के वन% के जुड़ाव को बनाए रखता है और महiवपूण गिलयारा दान करता है। इस अभयारLय से अिधकतर अणाचल देश के वन% से िडगबोई वन संभाग के अंतगत वन% म@ हाथी और अय जंगली पशु जैसे बाघ आद का वास होता है। यह े8 एिशयाई हाथी के महiवपूण गिलयार% म@ से एक माना जाता है; और, और, और, और, यहां कुल 43 *तनधारी अिभिलिखत कए गए ह; देKहग पटकई वयजीव अभयारLय और आस-पास के वन% म@, भारत म@ कसी भी *थान पर सबसे अिधक, 17 मांसाहारी जाितयाँ कैमरा म@ ली गई ह;। यह दुिनया क पहला थान है जहां तवीर% से एक भू-दृ>य म@ िबिलय% क 7 जाितय% क पुिA क है। भू-दृ>य म@ संकटाप *तनधारय% क पाँच जाितयां बाघ, जंगली कु"ा, हाथी, lलॉक िग9बन और गंगेटक डॉिफन ह; संकटाप प ी लॉग-िबड िगm (गंभीर संकटाप), nहाइट Kवoड वुड-डक और pेटर pेटर एडजुट@ट *टॉक ह;। िवq *तर पर गंभीर 4प से संकटाप वृ % क

उपधारा (1) तथा धारा 3 क उपधारा (2) एवं उपधारा (3) के खंड (v) और खंड (xiv) !ारा द" शि$य% का योग करते (ए, असम राय म@ देKहग पटकई वयजीव अभयारLय क सीमा के चार% ओर शूय कलोमीटर से 7.5 कलोमीटर तक िवतारत े8 को देKहग पटकई वयजीव अभयारLय पारिथितक संवेदी जोन (िजसे इसम@ इसके प> चात् पारि*थितक

संवेदी जोन कहा गया है) के 4प म@ अिधसूिचत करती है, िजसका िववरण िन ानुसार है, अथात् :-

खोज और िKलग के िलए एक सेट उपा उपा उपा उपाबंध बंध बंध बंध-I म@ िनधारत कया गया है। इसके अितर$, संरि त े8 का पूव] और दि णी भाग अणाचल देश से सटा (आ है और अंतर-राय सीमा बनाता है। (3) पारिथितक संवेदी जोन क सीमा का वणन उपाबंध उपाबंध उपाबंध उपाबंध-IIIIIIII के 4प म@ संल है। (4) पारिथितक संवेदी जोन क सीमा के संरि त े8 का मानिच8 उपाबंध उपाबंध उपाबंध उपाबंध-III III III IIIक और और और और उपाबंध उपाबंध उपाबंध उपाबंध-III III III IIIख म@ है। (5) पारिथितक -संवेदी जोन और संरि त े8 क सीमा के भू-िनदशांक% क सूची मश: उपाबंध उपाबंध उपाबंध उपाबंध- IV IV IV IV म@ है। (6) पारिथितक संवेदी जोन के अंतगत कोई pाम नह ह;। 2. पारिथितक पारिथितक पारिथितक पारिथितक संवेदी संवेदी संवेदी संवेदी जोन जोन जोन जोन केकेकेके िलए िलए िलए िलए आंचिलक आंचिलक आंचिलक आंचिलक महायोजना महायोजना महायोजना महायोजना.–(1) राय सरकार, पारिथितक संवेदी जोन के योजन के िलए, राजप8 म@ अंितम अिधसूचना के काशन क तारीख से दो वष क अविध के भीतर, थानीय ?ि$य% के परामश से और इस अिधसूचना म@ दए गए अनुबंध% का पालन करते (ए, राय सरकार के स म ािधकारी के अनुमोदनाथ एक आंचिलक महायोजना बनायेगी। (2) रा य सरकार !ारा पारिथितक संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना म@ िविनFद6 ट रीित से तथा ासंिगक क@ ीय और रा य िविधय% के अनु4प तथा क@ीय सरकार !ारा जारी दशा िनदश%, यद कोई ह%, के अनुसार बनायी जाएगी । (3)
आंचिलक महायोजना म@ पारिथितक और पयावरण संबंधी सरोकार% को शािमल करने के िलए इसे रा य सरकार के िन िलिखत िवभाग% के परामश से बनाया जाएगा, अथात्:- (i) पयावरण, (ii) वन और वयजीव, (iii) कृिष, (iv) राज* व, (v) शहरी िवकास, (vi) पयटन, (vii) pामीण िवकास,
(viii) Kसचाई और बाढ़ िनयं8ण, (ix) नगरपािलका,
(x) पंचायती राज, (xi) लोक िन माण िव भाग, (xii) राजमाग, और (xiii) आसाम राय दूषण िनयं8ण बोड।

जब तक इस अिधसूचना म@ िविनFदA न हो, आंचिलक महायोजना म@ वतमान म@ अनुमोदत भू-उपयोग, अवसंरचना और याकलाप% पर कोई ितबंध नह लगाया जाएगा तथा आचंिलक महायोजना म@ सभी अवसंरचना_ और याकलाप% म@ सुधार करके उहे अिधक द और पारिथितक -अनुकूल बनाने क ?वथा क जाएगी।
(5) आंचिलक महायोजना म@ वनरिहत और अव िमत े8% के सुधार, िवRमान जल िनकाय% के संर ण, आवाह े8% के

बंधन, जल-संभर% के बंधन, भू-जल के बंधन, मृदा और नमी के संर ण, थानीय जनता क आव>यकता_ तथा पारिथितक एवं पयावरण के ऐसे अय पहलु_ क ?वथा क जाएगी िजन पर uयान दया जाना आव>यक है।

आंचिलक महायोजना म@ सभी िवRमान पूजा * थल%, pाम% एवं शहरी बितय%, वन% क wेिणय% एवं क* म%, कृिष

े8%, ऊपजाऊ भूिम, उRान% एवं उRान% क तरह के हरत े8%, बागवानी े8%, बगीच%, झील% और अय जल िनकाय% क

सीमा का सहायक मानिच8 के साथ िनधारण कया जाएगा और तािवत भू- उपयोग क िवशेषता_ का 9यौरा भी दया जाएगा। (7) आंचिलक महायोजना म@ पारिथितक संवेदी जोन म@ होने वाले िवकास का िविनयमन कया जाएगा और सारणी म@ यथासूचीबm ितिषm एवं िविनयिमत याकलाप% का पालन कया जाएगा। इसम@ * थानीय जनता क आजीिवका क सुर ा के िलए पारिथितक -अनुकूल िवकास का भी सुिनVय एवं संवधन कया जाएगा।
(8) आंचिलक महायोजना, े8ीय िवकास योजना क सह-कािलक होगी । (9) अनुमोदत आंचिलक महायोजना, मानीटरी सिमित के िलए एक संदभ दतावेज होगी ताक वह इस अिधसूचना के उपबंध% के अनुसार मानीटरी के अपने कत?% का िनवहन कर सके । 3. राय राय राय राय सरकार सरकार सरकार सरकार ारा ारा ारा ारा कए कए कए कए जाने जाने जाने जाने वाले वाले वाले वाले उपाय उपाय उपाय उपाय.- राय सरकार इस अिधसूचना के उपबंध% को भावी बनाने के िलए िन िलिखत उपाय करेगी, अथात्:- (1) भूभूभूभू-उपयोग. उपयोग. उपयोग. उपयोग.– (क) पारिथितक -संवेदी जोन म@ वन%, बागवानी े8%, कृिष े8%, मनोरंजन के िलए िचिहत उRान% और खुले थान% का वृहद वािणियक या आवासीय परसर% या औRोिगक याकलाप% के िलए योग या संपरवतन अनुात नह कया जाएगा: परंतु पारिथितक संवेदी जोन के भीतर भाग (क) म@ िविनFदA योजन से िभ योजन के िलए कृिष और अय भूिम का संपरवतन, मानीटरी सिमित क िसफारश पर और स म ािधकारी के पूव अनुमोदन से े8ीय नगर योजना अिधिनयम तथा यथा लागू केीय सरकार एवं राय सरकार के अय िनयम% एवं िविनयम% के अधीन तथा इस अिधसूचना के उपबंध% के अनुसार *थानीय िनवािसय% क िन िलिखत आवासीय ज4रत% को पूरा करने के िलए अनुात कया जाएगा:- (i) िवRमान सड़क% को चौड़ा करना, उह@ सुदृढ करना और नई सड़क% का संिनमाण करना; (ii) बुिनयादी ढांच% और नागरक सुिवधा_ का संिनमाण और नवीकरण; (iii) दूषण उiप न करने वाले लघु उRोग;
(iv) कुटीर उRोग एवं pाम उRोग; पारिथितक पयटन म@ सहायक सुिवधा भLडार, थानीय सुिवधाएं तथा pह वास; और
(v) बढ़ावा दए गए पैराpाफ 4 म@ उिलिखत याकलाप; परंतु यह भी क े8ीय शहरी िनयोजन अिधिनयम के अधीन स म ािधकारी के पूव अनुमोदन के िबना तथा राय सरकार के अय िनयम% एवं िविनयम% एवं संिवधान के अनुDछेद 244 के उपबंध% तथा तiसमय वृ" िविध, िजसके अंतगत अनुसूिचत जनजाित और अय परंपरागत वन िनवासी (वन अिधकार% क मायता) अिधिनयम, 2006 (2007 का 2) भी आता है, का अनुपालन कए िबना वािणियक या औRोिगक िवकास याकलाप% के िलए जनजातीय भूिम का योग अनुात नह होगा:
परंतु यह भी क पारि थितक संवेदी जोन के अंतगत आने वाली भूिम के अिभलेख% म@ (ई कसी 8ुट को, मानीटरी सिमित के िवचार ा= करने के पVात्, राय सरकार !ारा iयेक मामले म@ एक बार सुधारा जाएगा और उ$ 8ुट को सुधारने क

सूचना क@ ीय सरकार के पयावरण, वन और जलवायु परवतन मं8ालय को दी जाएगी:

5 परंतु यह भी क उपयु$ 8ुट को सुधारने म@, इस उप-पैरा म@ यथा-उपबंिधत के िसवाय, कसी भी दशा म@ भू-उपयोग का परवतन शािमल नह होगा।
(ख) अनु युक् त या अनुi पादक कृिष े8% म@ पुन: वनीकरण तथा पयावास% और जैव- िविवधता क बहाली के यास कए जाएंगे।
(2) ाकृितक जल ोत ाकृितक जल ोत ाकृितक जल ोत ाकृितक जल ोत.- आंचिलक महायोजना म@ सभी ाकृितक जल ोत% के आवाह े8% क पहचान करके उनके संर ण और बहाली क योजना सिt मिलत क जाएगी और रा य सरकार !ारा करके इस रीित से बनाए जागे क उसम@ इन े8% या इनके आसपास के े8% के िलए हािनकारक िवकास याकलाप% को ितिषm कया गया हो। (3) पयटन/पारिथितक पयटन. पयटन/पारिथितक पयटन. पयटन/पारिथितक पयटन. पयटन/पारिथितक पयटन.– (क) पारिथितक संवेदी जोन म@ सभी नए पारिथितक पयटन याकलाप या िवRमान पयटन याकलाप% का िवतार पारिथितक संवेदी जोन सtबंधी पयटन महायोजना के अनुसार अनुात होगा ।

(ख) पारिथितक पयटन महायोजना राय सरकार के पयावरण और वन िवभाग के परामश से पयटन िवभाग !ारा बनायी जाएगी ।
(ग) पयटन महायोजना आंचिलक महायोजना का घटक होगी । (घ) पारिथितक पयटन संबंधी याकलाप िनt नानुसार िविनयिमत कए जाएंगे, अथात् :- (i) वयजीव अभयारLय क सीमा से 1 कलोमीटर के भीतर या पारि*थितक संवेदी जोन क सीमा तक, इनम@ जो भी अिधक िनकट हो, कसी होटल या रजॉट का नया सि`माण अनुात नह कया जाएगा:

तथािप, पारिथितक पयटन सुिवधा_ के िलए वयजीव अभयारLय क सीमा से 1 कलोमीटर क दूरी से परे पारिथितक संवेदी जोन क सीमा तक पूव परभािषत और अभीिहत े8% म@ पयटन महायोजना के अनुसार, नए होटल% और रजॉट क थापना अनुात होगी; (ii) पारिथितक संवेदी जोन के अदर सभी नए पयटन या-कलाप% या िवRमान पयटन याकलाप% का िवतार, केीय सरकार के पयावरण, वन और जलवायु परवतन मं8ालय !ारा जारी दशािनदश% तथा पारिथितक पयटन पर बल देने वाले राfीय ?ा संर ण ािधकरण !ारा जारी पारिथितक पयटन संबंधी दशािनदश% (समय-समय पर यथा-संशोिधत) के अनुसार होगा; (iii) आंचिलक महायोजना का अनुमोदन होने तक, पयटन के िवकास और िवRमान पयटन याकलाप% के िवतार को वा*तिवक *थल-िविशA संवी ा तथा मानीटरी सिमित क िसफारश के आधार पर संबंिधत िविनयामक

ािधकरण% !ारा अनुात कया जाएगा और पारिथितक संवेदी जोन म@ कसी नए होटल/रसोट या वािणियक ितान का संि`माण अनुात नह होगा । (4) ाकृितक िवरासत ाकृितक िवरासत ाकृितक िवरासत ाकृितक िवरासत.– पारिथितक संवेदी जोन के अंतगत आने वाले ब(मूय ाकृितक िवरासत के सभी *थल% जैसे क जीन पूल रजव े8, शैल संरचना, जल पात, झरने, दर, उपवन, गुफाएं, *थल, वनपथ, रोहण माग, उi पात आद क

5. पाइपलाइन सुिवधा_ और दबाव स@सर, रमोट कंोड मोटराइड वाव और पंप के िलए रमोट शट ऑफ सुिवधाएं जैसी सुिवधा_ क थापना सिहत अय सभी अपेि त मामल% म@ रसाव का पता लगाने के िलए पयवे ी िनयं8ण तथा डाटा ाि= णाली (एससीएडीए) थािपत क जानी है। 6. ऑयल इंिडया िलिमटेड (ओआईएल)/ओएनजीसी या अय ऐसी यो$ा एज@िसय% !ारा तेल िबखराव को रोकने सtबधी आकिमक योजना और उसे बंद करने के िलए उपशमन उपाय% संबंधी अनुमोदत मानक चालन या (एसओपी) क एक ित भेजी जाती है। 7. अनुमोदत एसओपी के अनुसार, जैव-उपचार ौRोिगक /अय णािलय% के !ारा थल को उसक सामाय िथित म@ लाने सिहत अचानक (ए तेल िबखराव के कारण आसपास के वातावरण पर पड़ने वाले भाव को सीिमत करने के िलए उिचत उपाय अपनाए जाने ह;। 8. एसओपी म@ िनFदA दशािनदश% के अनुसार तेल िबखराव क घटना_ से भावी तरीके से िनपटने के िलए ऑपरेशन क5मय% को पया= 4प से िशि त कया जाना है। 9. दुघटना/अय घटना_ के कारण होने वाली पयावरणीय ित से बचने के िलए खुदाई के दौरान 9लो ि व@शन पmित (बीओपी) उiपादन सुिवधा_ म@ वाव% क ?वथा सुिनिVत क जाती है। 10. वचािलत बंदी कारीवाइयां आरंभ करने के िलए सभी सुिवधा_ म@ आपातकालीन बंदी णाली क ?वथा होनी चािहए। 11. गैस क गित को यूनतम कया जाना चािहए और गैस क अपरहाय लपट% के िलए सव"म अंतरराfीय पmितया अपनायी जानी चािहए । 12. ऑयल इंिडया िलिमटेड (ओआईएल)/ओएनजीसी या अय ऐसी यो$ा एजेिसय% !ारा पयावरण भाव मूयांकन अिधसूचना, 2006, वन (संर ण) अिधिनयम, 1980, वयजीव (संर ण) अिधिनयम, 1972 और असम वन िविनयमन, 1891 म@ यथा िनधारत सभी शत का पालन कया जाना है।

NOTIFICATION New Delhi, the 30th May, 2019 S.O. 1915(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the Public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Aliganj, New Delhi-110003, or send it to the e-mail address of the Ministry at esz- mef@nic.in

Draft Notification WHEREAS, Dehing Patkai Wildlife Sanctuary (WLS) located at Dibrugarh and Tinsukia Civil Districts, Assam was declared on 19th June, 2004 vide no. FRW.34/2003/Pt/6; consisting of part of the existing Reserved Forests covering 87.12 square kilometers area of Digboi Division and 24.07 square kilometers of Dibrugarh Division totaling 111.19 square kilometers consisting of parts of Upper Dehing (West Block) Reserved Forest having an area of 56.6950 square kilometers, Dirok Reserved Forest having an area of 30.4255 square kilometers in Digboi Division and parts of Jeypur Reserved Forest having an area of 24.07 square kilometers in Dibrugarh Division. The Dirok River runs from the Southern part of the Dirok Reserved Forest and the Buridehing River runs between the Upper Dehing (West Block) Reserved Forest and Jeypore Reserved Forest; AND WHEREAS, the Dehing Patkai Wildlife Sanctuary is one of the prime habitats of primates, elephants and a few critically endangered species of animals and birds. The flagship species of the Dehing Patkai Wildlife Sanctuary is Hoolock gibbon (Bimopethicus hoolock hoolock), the only Western ape found in India, being a Schedule-I species of Wild Life (Protection) Act 1972 and also Appendix-1 of Endangered Species under Convention on International Trade in Endangered Species of Wild Fauna and Flora, 1973. The Wildlife Sanctuaries is also the prime habitat of Asiatic Elephant having an estimated population of 204 in 2011, and is connected with the Upper Dehing Reserved Forest (West Block) on the North and Jeypore Reserved Forest on the South in Assam. Also, forests of Arunachal Pradesh on the South East border maintain the connectivity of the forests and serve as an important corridor. The elephants and other wild animals like tiger etc. migrate to the forests under Digboi Forest Division from the forests of Arunachal Pradesh mostly through this Sanctuary. This is considered to be one of the vital corridors of Asian elephant in the region; AND WHEREAS, a total of 43 mammals have been recorded here; 17 carnivore species have been camera-trapped in the Dehing Patkai Wild Life Sanctuary and in the adjoining forests, the highest of any site in India. It is the first site in the world where photographs have confirmed 7 species of cats coexisting within one landscape. The five endangered mammal species in this landscape are the tiger, wild dog, elephant, hoolock gibbon and Gangetic dolphin; the endangered birds are the long-billed vulture (Critically endangered), white winged wood-duck and Greater Adjutant Stork. The globally critically endangered tree species Vatica lanceaefolia (Morhal) is among the plants of conservation importance; AND WHEREAS, some of the common birds found in the forests are the Great White Billed Heron, Lesser Adjutant Stork, White Winged Wood Duck, Slender Billed Vulture, and White Cheeked Hill Partridge. Primate census carried out during 2009 recorded 2359 nos. of primate. This includes 256 nos. of Hoolock gibbon under the Digboi Forest Division. Moreover, it is a breeding ground of different species of reptiles and invertebrates. The Dehing Patkai Wildlife Sanctuary is classified as Assam Valley Tropical wet evergreen Forests. The evergreen forest cover has helped the primates for their livelihood. The protected area is significant for three tier tree canopy. The top canopy is formed by Dipterocarpus retusus and Shorea assamica forests. The middle storey is dominated by Messua ferrea and Vatica lanceafolia. Other species found in this canopy are Terminalia chebula, Syzigium cuminii, Sapium baccatum, Dysoxylum binectariferum, Terminalia belerica, etc. The undergrowth comprises of woody shrubs like Myrsine capitellata, Osbeckia spp. Laportea crenulata, Shrubs like Phrynium placentarim, Alpinia allughas, etc are also found. Climbers are numerous and found profusely. Common among them are Thumbergia grandiflora, Bauhinia vahlii etc.; AND WHEREAS, the protected area is located in the Digboi region in the foothills of Patkai Range and consists of upper tertiary rocks with Tipam sand stone which is characterized by oil and coal deposits. The alluvial deposits of the Dehing River are characterized by its coarse nature, reddish colour, sandy clay. The soil is acidic in nature with considerable depth. The pH value is 5.5. The altitude ranges from about
350 - 1000 ft. above mean sea level. The Sanctuary area falls under humid zone, which is characterized by high precipitation. High humidity and heavy rainfall are significant features of evergreen forests in this region. Rainy season starts from the month of March. Heavy down pour takes place during the months of May, June, July and August. The amount of rainfall flattens toward the end of the rainy season. Although, there are some amount of rain practically in every month except November, December and January. 3640 millimeters of rain was recorded at Jeypore in 1999 which is the maximum quantity of rainfall recorded so far in this region; AND WHEREAS, Bio-geographically, the Dehing Patkai Wildlife Sanctuary falls under the North- East Brahmaputra valley provinces 9 (A), and constitutes an important part of the Evergreen Rain Forests of

21 India. The protected area is having immense research, recreational and educational values and it is necessary to conserve and protect the area surrounding the Wildlife Sanctuary; AND WHEREAS, it is necessary to conserve and protect the areas, the extent and boundaries of Dehing Patkai Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent varying from Zero kilometer to 7.5 kilometers around the boundary of Dehing Patkai Sanctuary in the State of Assam as the Dehing Patkai Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco- sensitive Zone) details of which are as under, namely:-

Extent and boundaries of Eco-sensitive Zone. - (1) The extent of Eco-sensitive Zone varies from Zero kilometer to 7.5 kilometers around the Dehing Patkai Sanctuary. The area of the Eco-sensitive Zone is 215.82 square kilometers.
(2) The extent of the Eco-sensitive Zone ranges from Zero kilometers to 7.5 kilometers from the boundary of the Wildlife sanctuary due to the presence of oil and natural gas in the immediate vicinity of the sanctuary boundary, and existence of many oil wells and drilling sites in the present and prospective drilling sites in the future, in view of which a set of measures for safe oil and natural gas exploration and drilling have been prescribed in Annexure-I. Additionally, the eastern and southern part of the protected area is adjoining Arunachal Pradesh and makes the inter-state boundary. (3) The boundary description of the Eco-sensitive Zone is appended at Annexure-II.
(4) The map of the Protected Area demarcating the Eco-sensitive Zone boundary is at Annexure-IIIA and Annexure-IIIB. (5) List of geo co-ordinates of the boundary of the Protected Area and the Eco-sensitive Zone is at
Annexure-IV.
(6) There are no villages falling within the Eco-sensitive Zone.
Zonal Master Plan for the Eco-sensitive Zone. – (1) The State Government shall, for the purposes of effective management of the Eco-sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following of the State Government Departments, for integrating environmental and ecological considerations into the said plan:- (i) Environment,
(ii) Forest and Wildlife,
(iii) Agriculture,
(iv) Revenue,
(v) Urban Development,
(vi) Tourism,
(vii) Rural Development, (viii) Irrigation and Flood Control,
(ix) Municipal,
(x) Panchayati Raj
(xi) Public Works Department, (xii) Highways, and

(xiii) Assam State Pollution Control Board. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forest, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in table and also ensure and promote eco-friendly development for the security of local communities livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), above within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities given under paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities; (2) Natural water bodies. - The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be

23 drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism or Eco-tourism. - (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by the Department of Tourism in consultation with State Departments of Environment and Forest.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within 1 kilometer from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer:

Provided that beyond the distance of 1 kilometer from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco- tourism; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within Eco-sensitive Zone area.
(4) Natural Heritage. - All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites. - Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. (6) Noise pollution. - Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act.
(7) Air pollution. - Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder.
(8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes. - Disposal and Management of solid wastes shall be as under:- (a) The solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. (b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone.

(10) Bio-medical waste. - Bio Medical Waste Management shall be as under:- (a) The bio medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the
28th March, 2016. (b) Safe and Environmentally Sound Management (ESM) of Bio-Medical Waste Management in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management. - The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340 (E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management. - The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317 (E), dated the 29th March, 2016, as amended from time to time. (13) E-waste. - The E-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution. - Prevention and control of Vehicular Pollution shall be incompliance with applicable laws and efforts to be made for use of cleaner fuel.
(16) Industrial units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the Guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes: The protection of hill slopes shall be as under:- (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) Construction shall not be permitted on existing steep hill slopes or slopes with a high degree of erosion. (18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:-

(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities: (b) The mining operations shall be carried out in accordance with the order of the Hon'ble Supreme Court dated the 4th August 2008 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P. (C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P. (C) No.435 of 2012.
Setting of industries causing pollution (Water, Air, Soil, Noise, etc).

New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:
Provided that non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition the non-polluting cottage industries shall be promoted.
So specified in this notification. In addition, non-polluting cottage industries shall be promoted. 3. Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per the applicable laws. 4. Commercial use of firewood. Prohibited (except as otherwise provided) as per the applicable laws. 5. Use or production or processing of any hazardous substances.
Prohibited (except as otherwise provided) as per the applicable laws. 6. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per the applicable laws. 7. Setting up of new saw mills.

No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone. B. Regulated Activities

Commercial establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or up to the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for Eco-tourism activities: Provided that, beyond one kilometer from the boundary of the protected Area or up to the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. 9. Construction activities (a) New commercial construction of any kind shall not be permitted within one kilometre from the boundary of the Protected Area or up to extent of the Eco-sensitive Zone whoever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building by e- laws to meet the residential needs of the local residents: Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b)Beyond one kilometre it shall be regulated as per the Zonal Master Plan. 10. Small scale non-polluting industries.

Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non -hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro based industry production products from indigenous materials from the Eco- sensitive Zone shall be permitted by the competent Authority. 11. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under. 12. Collection of Forest produce or Non-Timber Forest Produce. Regulated as per the applicable laws. 13. Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable laws. Underground cabling may be promoted. 14. Widening and strengthening of existing roads and construction of new roads.
Taking measures of mitigation, as per the applicable laws, rules and regulation and available guidelines. 15. Undertaking other activities related to tourism like over flying the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc. Regulated as per the applicable laws. 16. Protection of hill slopes and river banks.
Regulated as per the applicable laws. 17. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws. 18. Discharge of treated waste water or effluents in natural water bodies or land area.

The discharge of treated waste water/effluents shall be avoided to enter into the water bodies and efforts to be made for recycle and reuse of treated waste water. No establishment of new wood based industry shall be permitted within the limits of Eco-sensitive Zone: Provided that new wood based industry may be set up in the Eco-sensitive using 100% imported wood stock. 23. Terms of Reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site- specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment, Forest and Climate Change number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per Performa given in Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

29 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

ANNEXURE-I MEASURES FOR SAFE OIL AND NATURAL GAS EXPLORATION AND DRILLING IN AND AROUND ESZ- GUIDELINES FOR USER AGENCIES

Biodiversity Impact Assessment study to be conducted around the Protected Area, the notified Eco- sensitive Zone area, and any area falling in Indo-Burma Biodiversity Hotspot and Notified Indian Bird Area (IBA) in the 10 kilometer vicinity of the Protected Area. The study has to be undertaken through agencies of repute safe guard the environment and the wildlife habitats around the Protected Area, covering important flora and fauna, terrestrial as well as aquatic and also covering flagship species such as Gangetic Dolphin, Asiatic Elephant, Rhino, Tiger, Leopard, Asiatic Wild Buffalo, Eastern Swamp Deer, etc.
Operating Well plinths in the vicinity of the National Park and Wildlife Sanctuaries are to be covered with 10 ft high barricade around them and ‘Safety Zone’ to be created at radius of 7.5 meter from the barricade by providing Chain Link Fencing/ Power fencing and indigenous fruit trees and others local forest species to be planted in the aid area, in order to prevent injuries to wildlife.
Rights of forests dwellers to be protected as prescribed under Schedule Tribes and Other Traditional Forest and Dwellers (Recognition of Forest Rights) Acts, 2006 or FRA, 2006.
Oil India Limited (OIL)/ ONCG or other such user agencies to have to conduct Oil Spill Risk Assessment for all onshore facilities around the National Park and Wildlife Sanctuary and plan for necessary modification of existing facilities or installation of new facilities which are found to be potentially hazard to Oil spills.
Supervisory Control and Data Acquisition System (SCADA) to be installed for leak detection of the Pipeline facilities and all other required cases including installing of facilities like sensors, Remote Controlled Motorised calves and Remote Shut Off facilities for pumps etc.
Oil Limited Only (OIL)/ ONGC or other such user agencies to submit a copy of approved Standard Operating Procedure (SOP) for restricting Oil Spillage Contingency Plan and mitigation measures for arrest the same.
Appropriate measures to be adopted to restrict impacts or surroundings due to accidental Oil Spillages including restoration of sight to its normalcy with Bio-remediation technology/others, as per approved SOP.
Operation personnel are to be trained adequately for effective handling of Oil Spill incidents as per guidelines specified in SOP.
Erection of Blow Prevention System (BOP) during drilling phase and valves in Production facilities to be ensured in order to avoid environmental damages due to accident/ other incidents.
An emergency shutdown system should be in place in all facilities to initiate automatic shutdown actions.
Gas flaring has to be minimized and best international practices to be adopted for flaring of gases which are un-avoidable.
Oil India Limited (OIL)/ ONGC or other such user agencies have to comply with all stipulated conditions as framed under Environmental Impact Assessment Notification, 2006, Forest (Conservation) Act, 1980. Wildlife (Protection) Act, 1972 and the Assam Forest Regulation, 1891.

13. Oil India Limited (OIL) /ONGC or other such user agencies have to strictly comply with the conditions stipulated in Air (Prevention and Control of Pollution) Act, 1981 and the Water (Prevention and Control of Pollution) Act, 1974. 14. Precautionary measures to be taken to avoid contamination of surface water.
15. Noise levels for sensitive areas to be restricted to limit as prescribed by the State Pollution Control Board.
16. Fire Fighting arrangements are to be kept standby on 24x7 basis to meet the eventualities I case so arises.
17. Regular interaction to be established with local Rangers/ DFOs for day to day E&P activities around the area. 18. The directions of the local Monitoring Committee of the notified the Eco-sensitive Zone shall be adhered to.
19. All expenses in the implementation of these Guidelines to be borne by the Oil India Limited (OIL)/ ONGC or other such user agencies.
