ाप ाप ाप ाप अिधसूचना अिधसूचना अिधसूचना अिधसूचना िडQू साइखोवा राSीय उTान असम म" िडQूगढ़ और ितनसुकया िसिवल िजल6 म", 340.0 वग कलोमीटर .े म" फैला है और इसे असम सरकार क अिधसूचना सं. एफआरडCयू.21/90/171 दनांक 05.03.1999 को राSीय उTान के प म" अिधसूिचत कया गया है। यह .े एक ही पा0रि;थितक इकाई है जो मूल प से उ3र म" QYपु एवं िसयांग नदी, पूव* म" लोिहत एवं देबंग, दि.ण-पूव* म" अनंत नाला और दि.ण म" डांगोरी एवं िडQू नदी का बाढ़ का मैदान है;

THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, और, और, और, यह राSीय उTान QYपु नदी, इसक सहायक नदय6 और िवशेषकर QYपु नदी के जल-माग* 2ारा िन?मत एक अि2तीय भू-आकृित िव]ान संरचना का ितिनिध^व करता है, जो क इंडो-जेने0टक डॉिफ़न का मह^वपूण* पयावास है; और और और और, िडQू साइखोवा राSीय उTान, जैव- भौगोिलक दृिJ से “उ3री पूवa भारत–Qहमपु घाटी जैव- भौगोिलक ांत” (9ए) का ितिनिध^व करता है। दो मुख जैव िविवधता ;थल6 का अंतरण ;थल होने के कारण यहां वन;पित और जीवजंतुb क चुरता है, जो िविवध कार के जीवजंतुb के िलए सहायक है जो यहां क .ेीय, जलीय और वान;पितक पा0रि;थितक के िलए अनुकूल हE; और, और, और, और, यह राSीय उTान आcयजनक &प से समृd वन;पित का सहायक है िजनम" 28 वृ. जाितयां, 26 झाड़ी जाितयां, 2 परजीवी पौध6 क जाितयां, 17 घास जाितयां, 16 जलीय पौध6 क जाितयां, 3 दलदलीय पौध6 क

जाितयां, 4 पवतारोिहय6 और ;कEड(स क जाितयां, 5 ब"त क जाितयां, 13 ऑNकड क जाितयां और 6 संकटापl औषधीय पौध6 क जाितयां शािमल हE; और, और, और, और, इस राSीय उTान म" अनेक पशु-पि.य6 के पयावास हE। यहां के मुmय .े म" 10 ऑडर और 19 प0रवार6 से संबंिधत 36 ;तनधारी जाितयां और 27 जेनरा अिभिलिखत हE, िजनम" से 12 अनुसूची-I म" शािमल हE। इस उTान म" मौजूद मुmय ;तनधारी जाितय6 म" से एक जाित व(य घोड़6 क है। इस राSीय उTान म" कछुb क 11 जाितय6, दो मॉिनटर िछपकिलय6 सिहत िछपकली क 9 जाितय6, उभयचर6 क 18 जाितय6, मछिलय6 क 104 जाितय6, सांप6 क 23 िविभl जाितय6 और िततिलय6 क 104 जाितय6 के अित0र5 जलचर6 क लगभग 500 जाितय6 के आpय ;थल हE। यह .े वासी पि.य6 को भी आक?षत करता है और िविभl कार के जलीय और ;थलीय पि.य6 के िलए एक खाTाl भूिम है; और, और, और, और, सदa के मौसम म" सूख जाने वाले नदी तट के रेतीले भाग (चापोरीस) जलोढ़ घासभूिम के िवकास म" सहायक हE जो न केवल अ^यिधक संकटापl बंगाल qलो0रकन के िलए उ^कृJ पयावास हE, बिक िडQू-डंगोरी हाथी कॉ0रडोर म" हािथय6 के िलए वासन माग* का और बाघ6 के अ&णाचल देश राrय म" जाने हेतु सुरि.त माग* का भी काम करते है; और, और, और, और, िडQू-साइखोवा रा@ sीय उTान म" िविभl कार क वन;पित, जीवज(तु और प.ी पाए जाते हE। यह ;थािनक व(यजीव6 क दुलभ और लुFाय जाितय6 को संर.ण देता है। अतः इस राSीय उTान के चार6 ओर के .े को पा0रि;थितक और पयावरण क दृि@ ट से संरि.त और सुरि.त करना आवG यक है, ताक यहां क जैव-िविवधता और इसके पयावरण का संर.ण और संवधन हो सके; अतः अतः अतः अतः, अब, के()ीय सरकार, पयावरण (संर.ण) अिधिनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प0ठत पयावरण (संर.ण) अिधिनयम, 1986 (1986 का 29) क उपधारा (1) तथा धारा 3 क उपधारा (2) एवं उपधारा (3) के खंड (v) और खंड (xiv) 2ारा द3 शि5य6 का योग करते 9ए, असम राrय म" िडQू-साइखोवा रा@ sीय उTान क सीमा के चार6 ओर 658.251 वग* कलोमीटर .े, िजसक सीमा 0.0 कलोमीटर (उTान सीमा के अ^यिधक िनकट तेल और ाकृितक गैस क मौजूदगी के कारण) से 8.7 कलोमीटर तक िव; ता0रत .े को िडQू-साइखोवा रा@ sीय उTान पा0रि;थितक संवेदी जोन (िजसे इसम" इसके पG चात् पा0रि;थितक संवेदी जोन कहा गया है) के प म" अिधसूिचत करती है, िजसका िववरण िन#ानुसार है, अथा*त् :—

(3) अिधकतम एवं (यूनतम अ.ांश और देशांतर के साथ पा0रि;थितक संवेदी जोन क सीमा एवं िव;तार का मानिच इस अिधसूचना के उपाबंध उपाबंध उपाबंध उपाबंध IIIIIIII के &प म" संलx है| (4) अिधकतम एवं (यूनतम अ.ांश और देशांतर के साथ पा0रि;थितक संवेदी जोन क सीमा के भू-उपयोग एवं

राrय सरकार, पा0रि;थितक संवेदी जोन के योजन के िलए राजप म" अंितम अिधसूचना के काशन क तारीख से दो वष* क अविध के भीतर, ;थानीय Iि5य6 के परामश* से और इस अिधसूचना म" दए गए अनुबंध6 का पालन करते 9ए राrय सरकार के स.म ािधकारी के अनुमोदनाथ* एक आंचिलक महायोजना बनायेगी।
पा0रि;थितक संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना म" िविनNद@ ट रीित से राr य सरकार 2ारा ासंिगक क")ीय और राr य िविधय6 तथा क")ीय सरकार 2ारा जारी माग*िनदyश6, यद कोई ह6, के अनुप बनायी जाएगी।
आंचिलक महायोजना म" पा0रि;थितक और पयावरणीय संबंधी सरोकार6 को शािमल करने के िलए इसे राr य सरकार के िन#िलिखत िवभाग6 के परामश से बनाया जायेगा,:— i. पयावरण िवभाग; ii. वन और व(यजीव िवभाग;
iii. कृिष और बागवानी िवभाग ; iv. भूिम राज;व और बंदोब;त िवभाग; v. zामीण िवकास िवभाग; vi. शहरी िवकास िवभाग; vii. नगरपािलका िवभाग; viii. पंचायती राज िवभाग; ix. पा0र-पयटन सिहत पयटन िवभाग;
x. |सचाई और बाढ़ िनयंण िवभाग; xi. राज;व िवभाग; xii. लोक िनमाण िवभाग; xiii. असम राrय दूषण िनयंण बोड*।
जब तक इस अिधसूचना म" िविनNदJ न हो, आंचिलक महायोजना म" वतमान म" अनुमोदत भू-उपयोग, अवसंरचना और याकलाप6 पर कोई ितबंध नह} लगाया जाएगा तथा आचंिलक महायोजना म" सभी अवसंरचनाb और याकलाप6 को अिधक द. और पयावरण अनुकूल बनाने क Iव;था क जाएगी।
आंचिलक महायोजना म" वन-रिहत और अव िमत .े6 के सुधार, िवTमान जल िनकाय6 के संर.ण, आवाह .े6 के बंधन, जल-संभर6 के बंधन, भू-जल के बंधन, मृदा और नमी के संर.ण, ;थानीय जनता क आवGयकताb तथा पा0रि;थितक एवं पया*वरण के ऐसे अ(य पहलुb क Iव;था क जाएगी िजन पर ~यान देना आवGयक है।
आंचिलक महायोजना म" सभी िवTमान पूजा ; थल6, zामीण एवं शहरी बि;तय6, वन6 क pेिणय6 एवं क; म6, कृिष .े6, ऊपजाऊ भूिम, उTान6 एवं उTान6 क तरह के ह0रत .े6, बागवानी .े6, बगीच6, झील6 और अ(य जल िनकाय6 क सीमा का सहायक मानिच6 के साथ िनधा*रण कया जाएगा।
इस योजना से संबंिधत मानिच म" िवTमान और ;तािवत भूिम के उपयोग क िवशेषताb का Cयौरा दया जाएगा।

8. आंचिलक महायोजना म" पा0रि;थितक संवेदी जोन म" होने वाले िवकास को िविनयिमत कया जाएगा तथा सारणी म" यथासूचीबd ितिषd एवं िविनयिमत याकलाप6 का पालन कया जाएगा। इसम" ;थानीय जनता क आजीिवका क सुर.ा के िलए पा0रि;थितक -अनुकूल िवकास को भी सुिनिcत तथा संव?धत कया जाएगा ।
9. आंचिलक महायोजना .ेीय िवकास योजना क सह-कािलक होगी । 10. अनुमोदत आंचिलक महायोजना, िनगरानी सिमित के िलए एक संदभ* द;तावेज होगी ताक वह इस अिधसूचना के उपबंध6 के अनुसार िनगरानी के अपने कतI6 का िनवहन कर सके । 3. राय राय राय राय सरकार सरकार सरकार सरकार ारा ारा ारा ारा कए कए कए कए जाने जाने जाने जाने वाले वाले वाले वाले उपाय उपाय उपाय उपाय:—राrय सरकार इस अिधसूचना के उपबंध6 को भावी बनाने के िलए िन#िलिखत उपाय करेगी, अथा*त् :—

भूभूभूभू-उपयोग उपयोग उपयोग उपयोग: (क) पा0रि;थितक संवेदी जोन म" वन6, बागवानी .े6, कृिष .े6, उTान6 तथा आमोद-मोद के योजन के िलए िचि(हत कए गए खुले ;थान6 का बड़े वािणिrयक या आवासीय प0रसर6 या औTोिगक याकलाप6 के िलए उपयोग या संप0रवतन नह} कया जाएगा:
(ख) परंतु पा0रि;थितक संवेदी जोन के भीतर भाग (क) म" िविनNदJ योजन से िभl योजन के िलए कृिष और अ(य भूिम का संप0रवतन, िनगरानी सिमित क िसफा0रश पर और स.म ािधकारी के पूव* अनुमोदन से .ेीय नगर योजना अिधिनयम तथा यथा लागू के()ीय/राrय सरकार के अ(य िनयम6 तथा िविनयम6 के अधीन तथा इस अिधसूचना के उपबंध6 2ारा ;थानीय िनवािसय6 क िन#िलिखत आवासीय जरत6 को पूरा करने के िलए अनु]ात कया जाएगा:— (i) िवTमान सड़क6 को चौड़ा करना और उ(ह" सुदृढ करना तथा नई सड़क6 का िनमाण; (ii) बुिनयादी ढांच6 और नाग0रक सुिवधाb का िनमाण और नवीकरण; (iii) दूषण उ^पl न करने वाले लघु उTोग; (iv) zामीण उTोग तथा कुटीर उTोग;
(v) सुिवधा भडार, गृह वास तथा पा0रि;थितक पयटन म" सहायक ;थानीय सुिवधाएं; और
(vi) बढ़ावा दए गए और पैरा-4 म" व?णत याकलाप : (ग) परंतु यह भी क राrय सरकार के ासंिगक िनयम6 तथा िविनयम6 एवं .ेीय शहरी िनयोजन अिधिनयम के अधीन स.म ािधकारी के पूव अनुमोदन के िबना तथा संिवधान के अनुLछेद 244 के उपबंध6 अथवा त^समय वृ3 िविध, िजसके अंतग*त अनुसूिचत जनजाित और अ(य परंपरागत वन िनवासी (वन अिधकार6 क मा(यता) अिधिनयम, 2006 (2007 का 2) भी है, के अनुपालन के िबना वािणिrयक या औTोिगक िवकास याकलाप6 के िलए जनजातीय भूिम का योग अनु]ात नह} होगा । (घ) परंतु यह भी क पा0रि; थितक संवेदी जोन के भीतर क भूिम के अिभलेख6 म" उ^पl कसी ु0ट क , िनगरानी सिमित के िवचार ाF करने के पcात्, राrय सरकार 2ारा ^येक मामले म" एक बार शुिd क जाएगी और उ5 ु0ट के शुिdकरण क

सूचना क")ीय सरकार के पयावरण, वन और जलवायु प0रवतन मंालय को दी जाएगी ।
(ड़) परंतु यह भी क उपयु5 ु0ट के शुिdकरण म", इस उप-पैरा म" यथा उपबंिधत के िसवाय, कसी भी दशा म" भू-उपयोग का प0रवतन सिमिलत नह} होगा ।
(च) परंतु यह भी क वन .े और कृिष .े जैसे ह0रत .े म" कोई पा0रणामी कमी नह} क जाएगी और अनुयु त या अनु^ पादक कृिष .े6 म" पुन: वनीकरण करने तथा पया*वास6 एवं जैव िविवधता क बहाली के यास कए जाएंगे ।
2. ाकृितक जल ोत ाकृितक जल ोत ाकृितक जल ोत ाकृितक जल ोत—सभी ाकृितक जल ोत6, नदय6/चैनल6/जलमाग के आवाह .े6 क पहचान क जाएगी और आचंिलक महायोजना म" उनके संर.ण और बहाली क योजना सि मिलत क जाएगी । इन .े6 म" या आसपास के .े6 म" ितिषd िवकास याकलाप6 के िलए राrय सरकार 2ारा सmत दशािनदyश बनाए जाएंगे।

5 3. पयट पयट पयट पयटन/पारिथितक पयटन न/पारिथितक पयटन न/पारिथितक पयटन न/पारिथितक पयटन:
(क) पा0रि;थितक संवेदी जोन के भीतर सभी नए पा0रि;थितक पयटन याकलाप या िवTमान पयटन याकलाप6 का िव;तार पा0रि;थितक संवेदी जोन संबंधी पय*टन महायोजना के अनुसार होगा ।

(ख) पा0रि;थितक पयटन महायोजना राrय पयटन िवभाग 2ारा राrय के पयावरण और वन िवभाग के परामश से तैयार होगी ।
(ग) पयटन महायोजना आंचिलक महायोजना का एक घटक होगी । (घ) पा0रि;थितक पयटन संबंधी याकलाप िन#ानुसार िविनयिमत ह6गे,:— (i) राSीय उTान क सीमा से 1.0 कलोमीटर के भीतर या पा0रि;थितक संवेदी जोन क सीमा तक, इसम" जो भी िनकट हो, कसी होटल या 0रसोट* का नया संिlमाण अनु]ात नह} कया जाएगा । तथािप, राSीय उTान क सीमा से 1.0 कलोमीटर क दूरी से परे पा0रि;थितक संवेदी जोन क सीमा तक नए होटल6 और 0रसोट क ;थापना पयटन महायोजना के अनुसार पा0रि;थितक पयटन सुिवधाb के िलए पूव प0रभािषत एवं अभीिहत .े6 म" अनु]ात क जाएगी। (ii) पा0रि;थितक संवेदी जोन के अ(दर सभी नए पयटन या-कलाप या िवTमान पयटन याकलाप6 का िव;तार के()ीय सरकार, पयावरण, वन और जलवायु प0रवतन मंालय 2ारा जारी मागदशa िसdांत6 तथा पा0रि;थितक पयटन पर बल देने वाले राSीय Iा संर.ण ािधकरण 2ारा जारी पा0रि;थितक पयटन मागदशa िसdांत6 के अनुसार होगा । (iii) आंचिलक महायोजना का अनुमोदन कए जाने तक, पयटन के िवकास तथा िवTमान पयटन याकलाप6 के िव;तार को वा;तिवक ;थल िविनNदJ संवी.ा तथा िनगरानी सिमित क िसफा0रश के आधार पर संबंिधत िविनयामक ािधकरण6 2ारा अनु]ात कया जाएगा और पा0रि;थितक संवेदी जोन म" कसी नये होटल/0रसाट* या वािणिrयक ितान का संिlमाण अनु]ात नह} होगा । 4. ाकृितक ाकृितक ाकृितक ाकृितक िवरासत िवरासत िवरासत िवरासत – पा0रि;थितक संवेदी जोन म" ब9मूय ाकृितक िवरासत के सभी ;थल6 जैसे क सभी जीन पूल 0रजव .े, शैल संरचना, जल पात, झरने, दरy, उपवन, गुफाएं, ;थल, वनपथ, रोहण माग*, उ^पात आद क पहचान क

जाएगी तथा उनक सुर.ा एवं संर.ण के िलए िवरासत संर.ण योजना बनायी जाएगी जो आंचिलक महायोजना का भाग होगी । 5. मानव िन!मत िवरासत थ मानव िन!मत िवरासत थ मानव िन!मत िवरासत थ मानव िन!मत िवरासत थल ल ल ल - पा0रि;थितक संवेदी जोन म" भवन6, संरचनाb, कृिम .े6, ऐितहािसक, कला^मक और सां;कृितक मह^व के .े6 क पहचान क जाएगी और उनके संर.ण के िलए िवरासत संर.ण योजना बनायी जाएगी जो आंचिलक महायोजना का भाग होगी।

िन दूषण िन दूषण िन दूषण — पा0रि;थितक संवेदी जोन म" ~ विन दूषण का िनवारण और िनयंण, पयावरण (संर.ण) अिधिनयम, 1986 के अधीन बनाए गए ~विन दूषण (िविनयमन और िनयंण) िनयम, 2000 के अनुसार कया जाएगा ।
7. वायु वायु वायु वायु दूषण दूषण दूषण दूषण — पा0रि;थितक संवेदी जोन म", वायु दूषण का िनवारण एवं िनयंण, वायु (दूषण िनवारण और िनयंण) अिधिनयम, 1981 (1981 का 14) के उपबंधो और उसके अधीन बनाए गए िनयम6 के अनुसार कया जाएगा ।

सभी नए पयटन याकलाप या िव2मान याकलाप का िवतार पयटन
महायोजना और लागू दशािनदQश के अनु'प होगा। 10.
फम^, कॉप\रेट, कंपिनय Oारा बड़े पैमाने पर वािणियक पशुधन संपदा और कु_कुट फाम^ क थापना । लागू िविधय के अधीन िविनयिमत होगा । 11.
संिनमाण याकलाप । (क) संरिVत VेM क सीमा से 1.0 कलोमीटर के भीतर या पा)रिथितक संवेदी जोन क सीमा तक, इनम जो भी अिधक िनकट हो, कसी भी #कार का नया वािणियक संिनमाण अनु@ात नहA कया जाएगा:

(ख) परंतु थानीय िनवािसय क आवास सबधी िनaिलिखत आवयकता को पूरा करने के िलए थानीय लोग को, पैरा 3 के उप पैरा (1) म सूचीब& याकलाप सिहत अपने #योग के िलए, अपनी भूिम म भवन उप-िविधय के अनुसार संिनमाण करने क अनुमित दी जाएगी जैसे क :— (i) िव2मान सड़क को चौड़ा करना और उह सुदृढ करना और नई सड़क

का संिनमाण; (ii) बुिनयादी ढांच और नाग)रक सुिवधा का संिनमाण और नवीकरण; (iii) फरवरी, 2016 म कLीय #दूषण िनयंMण बोड Oारा कए गए वगRकरण के अनुसार गैर- #दूषणकारी लघु उ2ोग; (iv) cामीण उ2ोग सिहत कुटीर उ2ोग, सुिवधा भdडार और cह वास सिहत पा)रिथितक पयटन म सहायक थानीय सुिवधाएं; और
(v) इस अिधसूचना म सूचीब& #ो"साहन दए गए याकलाप । (ग) परतु लागू िनयम और िविनयम , यद कोई ह , के अनुसार सVम #ािधकारी क पूव अनुमित से ऐसे लघु उ2ोग , जो #दूषण उ"प; नहA करते ह?, से संबंिधत संिनमाण याकलाप िविनयिमत कए जाएंगे और वे यूनतम ह गे ।

वृV क कटाई । (क) राय सरकार के सVम #ािधकारी क पूव अनुमित के िबना वन या सरकारी या राजव या िनजी भूिम पर वृV क कटाई नहA होगी । (ख) वृV क कटाई कLीय या संबंिधत राय के अिधिनयम या उसके अधीन बनाए गए िनयम के उपबंध के अनुसार िविनयिमत होगी । 14.

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 21st May, 2018 S.O. 2029(E).—In supersession of Ministry’s draft notification S.O. 1363 (E), dated 8th April, 2016, the following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Aliganj, New Delhi-110003, or send it to the e-mail address of the Ministry at esz-mef@nic.in. Draft Notification WHEREAS, the Dibru-Saikhowa National Park located at Dibrugarh and Tinsukia Civil Districts, Assam is spread over an area of 340.0 Square kilometers and notified vide Government of Assam Notification No. FRW.21/90/171 dated 05.03.1999 as a National Park. The area is a single ecological unit which is basically a flood plain of the River Brahmaputra and Siang in the North, Lohit and Debang in the East, the Ananta Nala to the South-East and the Dangori and Dibru River in the South; AND WHEREAS, the National Park represents a unique geo-morphological structure created by the river Brahmaputra and its tributaries, and the water channels, especially the Brahmaputra, forming an important habitat for the Indo-Genetic Dolphins; AND WHEREAS, biogeographically, the Dibru-Saikhowa National park represents the “North Eastern India- Brahmaputra Velly Bio-geographical Province” (9A), having rich in flora and fauna being the transition zone of two major biodiversity hot spots, which supports diverse fauna well adopted to life in terrestrial, aquatic and arboreal ecosystems; And Whereas, the National Park supports astonishingly rich flora including 28 tree species, 26 species of shrubs, 2 species of parasitic plants, 17 species of grasses, 16 species of aquatic plants, 3 species of marshy plants, 4 species of climbers and scandens, 5 species of canes, 13 species of orchids, and 6 threatened medicinal plant species;

And Whereas, the National Park is a habitat for many animals and birds with a total of 36 species of mammals belonging to 10 orders and 19 families and 27 genera are recorded in the core, out of which 12 belonged to Schedule-I. Feral horses are one of the prime mammal species available in the park. The National Park supports 11 species of turtles, 9 species of lizard including two species of monitor Lizards, 18 species of amphibian, 104 species of fish, 23 different species of snakes and 104 species of butterflies besides having a huge number, about 500 species, of avifauna. The area also attracts Migratory birds and is a feeding ground for a variety of aquatic and terrestrial birds; AND WHEREAS, winter dried up river beds as well as the river sandbars (Chapories) serve for the development of Alluvial grassland which are not only an excellent habitat for the critically endangered Bengal Florican, but also serve as migration route for the elephants in the Dibru-Dangori Elephant Corridor, and provide safe passage to tigers to Arunachal Pradesh state; AND WHEREAS, the Dibru-Saikhowa National Park is home to a variety of flora, fauna and avifauna, and provides protection to rare and endangered species of wildlife endemic. Hence, it is necessary to conserve and protect the area around the National Park from ecological and environmental point of view to protect and propagate the biodiversity therein and its environment; NOW THEREFORE, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub- rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area of 658.251 Sq. Km with an extent varying from 0.0 Km (being presence of oil and natural gas in the immediate vicinity of the Park boundary) to 8.7 Km from the boundary of the Dibru-Saikhowa National Park in the State of Assam as the Eco-Sensitive Zone (hereinafter referred to as the Eco-Sensitive Zone), details of which are as under:- 1. Extent and boundaries of Eco-Sensitive Zone:- (1)
The area of Eco-Sensitive Zone is 658.251 Sq km. The extent of Eco-Sensitive Zone varies from 0.0 Km (being presence of oil and natural gas in the immediate vicinity of the Park boundary) to 8.7 Km from the boundary of the National Park.
(2) The boundary description of the Eco-Sensitive Zone is given in Annexure I. (3) Map of Eco-Sensitive Zone boundary together with its latitudes and longitudes of extremes and extent is appended to this notification as Annexure II. (4) Land use and land cover map of Eco-Sensitive Zone boundary together with its latitudes and longitudes of extremes and extent is appended to this notification as Annexure III. (5) The coordinates of the Dibru-Saikhowa National Park and its Eco-Sensitive Zone with its latitudes and longitudes, appended as Annexure IV.

The list of villages falling within Eco-Sensitive Zone is appended as Annexure V. (7) Measures for Safe Oil and Natural Gas Exploration and Drilling in and around ESZ-Guidelines for User Agencies as Annexure VI. 2.
Zonal Master Plan for the Eco-Sensitive Zone:-
1.
The State Government shall, for the purpose of effective management of the Eco-Sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of publication of Final Notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this Notification for approval of Competent Authority in the State Government. 2.
The Zonal Master Plan for Eco-Sensitive Zone shall be prepared by the State Government in such manner as is specified in this Notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
3.
The Zonal Master Plan shall be prepared in consultation with the following State Departments for integrating the ecological and environmental considerations into the proposed plan: i. Environment Department; ii. Forest and Wildlife Department; iii. Agriculture & Horticulture Department; iv. Land Revenue and Settlement Department; v. Rural Development Department; vi. Urban development Department;

21 vii. Municipal Department; viii. Panchayati Raj Department; ix. Tourism including Eco-tourism Department; x. Irrigation and Flood Control Department; xi. Revenue Department; xii. Public Works Department; xiii. Assam State Pollution Control Board. 4.
The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this Notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
5.
The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of the local community and such other aspects of the ecology and environment that need attention. 6.
The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area such as park and like places, horticultural areas, orchards, lakes and other water bodies.
7.
The Zonal Master Plan shall be supported by maps giving details of existing and proposed land use features. 8.
The Zonal Master Plan shall regulate development in Eco-Sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote the eco-friendly development for livelihood security of local communities. 9.
The Zonal Master Plan shall be co-terminus with the Regional Development Plan. 10.
The Zonal Master Plan so approved shall be the reference document for the State and District level Eco- Sensitive Zone Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this Notification. 3. Measures to be taken by State Government:- The State Government shall take the following measures for giving effect to the provisions of this Notification, namely:

Landuse: (a) Forests, horticulture areas, agricultural areas, and open spaces earmarked for recreational purposes in the Eco- Sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities.
(b) Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-Sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as: (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution;
(iv) Cottage industries including village industries;
(v) Convenience stores and local amenities supporting eco-tourism including home stay; and
(vi) Promoted activities and activities given under para 4.
(c) Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

(d) Provided also that any error appearing in the land records within the Eco-Sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: (e) Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (f) Provided also that there shall be no consequential reduction in the green area such as forest area and agriculture area. Efforts shall be made to reforest the unused, denuded or unproductive agricultural areas with afforestation and habitat and biodiversity restoration activities. 2. Natural water bodies:
The catchment areas of all natural rivers/channels/springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan. The strict guidelines shall be drawn up by the State Government to prohibit development activities at or near these areas. 3. Tourism/ Eco-tourism:
(a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-Sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The activities of eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1.0 km from the boundary of the National park or up to the extent of the ESZ whichever is nearer. However, beyond the distance of 1.0 km from the boundary of the National park till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) All new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism; (iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within ESZ area.
4. Natural Heritage: All sites of valuable natural heritage in the Eco-Sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
5. Man-made heritage sites: Buildings, structures, artifacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-Sensitive Zone and heritage conservation plan for their conservation shall be prepared as a part of the Zonal Master Plan. 6. Noise pollution: Prevention and control of noise pollution in the Eco-Sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 (29 of 1986) and amendments thereto. 7. Air pollution: Prevention and control of air pollution in the Eco-Sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto. 8. Discharge of effluents: Discharge of treated effluent in Eco-Sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent. 9. Solid wastes: Disposal and management of solid wastes shall be as under:-

23 (a) The solid waste disposal and management in Eco-Sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and Climate Change vide Notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time and the relevant rules notified by the state Government;
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. 10. Bio-medical waste: Bio-medical waste management shall be as under: (a) The bio-medical waste disposal in the Eco-Sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time. (b) Safe and Environmentally Sound Management (ESM) of bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-Sensitive Zone. 11. Plastic Waste Management: The plastic waste management in the Eco-Sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. 12. Construction and Demolition Waste Management: The management of construction and demolition waste in the Eco-Sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. 13. E-waste Management: The e- waste management in the Eco-Sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. 14. Vehicular traffic: The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. 15. Vehicular Pollution: The prevention and control of vehicular pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc. 16. Industrial Units:
(i) On or after the publication of this Notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-Sensitive Zone. (ii) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this Notification. In addition, non-polluting cottage industries shall be promoted.
17. Protection of Hill Slopes:
The protection of hill slopes shall be as under: (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted. 18.
The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this Notification. 4.
List of activities prohibited or to be regulated within the Eco-Sensitive Zone:
All activities in the Eco-Sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:-

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T. N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012. 2.
Setting of industries including new oil and gas exploration causing pollution (Water, Air, Soil, Noise, etc.). (a) No new industries and expansion of existing polluting industries in the Eco-Sensitive Zone shall be permitted.
(b) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in Feb 2016, unless so specified in this Notification. In addition, non-polluting cottage industries shall be promoted.
3.
Establishment of major thermal and major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws. 4.
Use or production or processing of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws. 5.
Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws. 6.
Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-Sensitive Zone. 7.
Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws. 8.
Commercial use of fire wood. Prohibited (except as otherwise provided) as per applicable laws. B. Regulated Activities 9.
Commercial establishment of hotels and resorts. (a) No new commercial hotels and resorts shall be permitted within 1.0 km of the boundary of the Protected Area or up to the extent of Eco- Sensitive Zone, whichever is nearer, except for small temporary structures for Eco-tourism activities.
(b) Provided that, beyond 1.0 km from the boundary of the Protected Area or up to the extent of Eco-Sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism / Eco-tourism Master Plan and guidelines as applicable. 10.
Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies . Regulated under applicable laws. 11.
Construction activities. (a) No new commercial construction of any kind shall be permitted

25 within 1.0 km from the boundary of the Protected Area or up to extent of the Eco-Sensitive Zone whichever is nearer: (b) Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as: (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and
(v) Promoted activities listed in this Notification. (c) Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (d) Beyond 1.0 km it shall be regulated as per the Zonal Master Plan.
12.
Small scale non-polluting industries. Non-polluting industries as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-Sensitive Zone shall be permitted by the competent Authority. 13.
Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 14.
Collection of Forest produce or Non-Timber Forest Produce (NTFP). Regulated under applicable laws. 15.
Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable law.
Underground cabling may be promoted.

Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines. 17.
Widening and strengthening of existing roads and construction of new roads. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
18.
Under taking other activities related to tourism like over flying the Eco-Sensitive Zone area by hot air balloon, Microlites, helicopter, drones etc. Regulated under applicable law. 19.
Protection of Hill Slopes and river banks. Regulated under applicable laws.

Monitoring Committee:- In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco- sensitive Zone, which shall comprise of, namely:-

Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.

Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted under applicable laws for use of locals. 22.
Discharge of treated waste water/effluents in natural water bodies or land area. The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws. 23.
Commercial extraction of surface and ground water. Regulated under applicable law. 24.
Open well, borewell etc. for agriculture or other usage. Regulated and the activity should be strictly monitored by the appropriate authority. 25.
Use of plastic bags. Use of polythene bags are permitted within the Eco-Sensitive Zone. However, based on specific requirement, it shall be regulated under applicable laws. 26.
Introduction of exotic species. Regulated under applicable laws.
27.
Eco-tourism. Regulated under applicable laws. 28.
Commercial sign boards and hoardings. Regulated under applicable laws. C. Promoted Activities 29.
Rain water harvesting. Shall be actively promoted. 30.
Organic farming. 31.
Adoption of green technology for all activities. 32.
Cottage industries including village artisans etc. 33.

Terms of Reference:- (1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification. (2) The tenure of the Committee shall be three years or till the constitution of the new committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government. (3) The activities that are covered in the Schedule to the Notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-Sensitive Zone, except the prohibited activities as specified in column(3) of the table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said Notification. (4) The activities that are not covered in the Schedule to the Notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 but are falling in the Eco-Sensitive Zone, except the prohibited activities as specified in column (3) of the table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned work in- charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this Notification. (6)
The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the State Ministry of Environment, Forest and Climate Change as per pro forma appended at Annexure VII. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this Notification.

ANNEXURE-VI Measures for Safe Oil and Natural Gas Exploration and Drilling in and around ESZ-Guidelines for User Agencies 1. Biodiversity Impact Assessment study to be conducted around the Protected Area, the notified Eco-Senstitive Zone area, and any area falling in Indo-Burma Biodiversity Hotspot and Notified Indian Bird Area (IBA) in the 10 km visinity of the Protected Area. The study has to be undertaken through agencies of repute to safe guard the environment and the wildlife habitats around the Protected Area, covering important flora and fauna, terrestrial as well as aquatic and also covering flagship species such as Gangetic Dolphin, Asiatic Elephant, Rhino, Tiger, Leopard, Asiatic Wild Buffalo, Eastern Swamp Deer, etc. 2. Operating Well plinths in the vicinity of the National Park and Wildlife Sanctuaries are to be covered with
10 ft high barricade around them and ‘Safety Zone’ to be created at radius of 7.5 meters from the barricade by providing Chain Link Fencing/ Power fencing and indigenous fruit trees and other local forest species to be planted in the said area, in order to prevent injuries to wildlife. 3. Rights of forest dwellers to be protected as prescribed under Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 or FRA, 2006. 4. Oil India Limited (OIL)/ ONGC or other such user agencies have to conduct Oil Spill Risk Assessment for all onshore facilities around the National Park and Wildlife Sanctuary and plan for necessary modification of existing facilities or installation of new facilities which are found to be potentially hazard to Oil spills. 5. Supervisory Control and Data Acquisition Systems (SCADA) to be installed for leak detection of the Pipeline facilities and all other required cases including installation of facilities like pressure sensors, Remote Controlled Motorised valves and Remote Shut Off facilities for pumps etc. 6. Oil India Limited (OIL)/ ONGC or other such user agencies to submit a copy of approved Standard Operating Procedure (SOP) for restricting Oil Spillage Contingency plan and mitigation measures for arrest the same. 7. Appropriate measures to be adopted to restrict impacts on surroundings due to accidental Oil Spillages including restoration of site to its normalcy with Bio-remediation technology/others, as per approved SOP. 8. Operation personnel are to be trained adequately for effective handling of Oil Spill incidents as per guidelines specified in SOP. 9. Erection of Blow Prevention System (BOP) during drilling phase and valves in Production facilities to be ensured in order to avoid environmental damages due to accident/ other incidents. 10. An emergency shutdown system should be in place in all facilities to initiate automatic shutdown actions. 11. Gas flaring has to be minimized and best international practices to be adopted for flaring of gases which are un-avoidable. 12. Oil India Limited (OIL)/ ONGC or other such user agencies have to comply with all stipulated conditions as framed under Environment Impact Assessment Notification, 2006, Forest (Conservation) Act,1980, Wildlife (Protection) Act,1972 and the Assam Forest Regulation, 1891. 13. Oil India Limited (OIL)/ ONGC or other such user agencies have to strictly comply with the conditions stipulated in Air (Prevention and Control of Pollution) Act, 1981 and the Water (Prevention and Control of Pollution) Act, 1974. 14. Precautionary measures to be taken to avoid contamination of surface water. 15. Noise levels for the sensitive areas to be restricted to limit as prescribed by the State Pollution Control Board. 16. Fire Fighting arrangement are to be kept standby on 24x7 basis to meet the eventualities in case so arises. 17. Regular interaction to be established with local Rangers/ DFOs for day to day E&P activities around the area. 18. The directions of the local Monitoring Committee of the notified Eco-Sensitive Zone shall be adhered to. 19. All expenses in the implementation of these Guidelines to be borne by the Oil India Limited (OIL)/ ONGC or other such user agencies.
