राUय सरकार, पा2रि=थितक0 संवेदी जोन के योजन के िलए, राजप म' अंितम अिधसूचना के काशन क0 तारीख से दो वष- क0 अविध के भीतर, =थानीय Kि7य8 के परामश- से और इस अिधसूचना म' दए गए अनुबंध8 का पालन करते ;ए, राUय सरकार के स/म ािधकारी के अनुमोदनाथ- एक आंचिलक महायोजना बनायेगी।

राU य सरकार 4ारा पा2रि=थितक0 संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना म' िविनPदC ट रीित से तथा ासंिगक क',ीय और राU य िविधय8 के अनु प तथा क',ीय सरकार 4ारा जारी दशािनदश8, यद कोई ह8, के अनुसार बनायी जाएगी।

3. आंचिलक महायोजना म' पा2रि=थितक0 और पया-वरणीय संबंधी सरोकार8 को शािमल करने के िलए इसे राU य सरकार
के िन(िलिखत िवभाग8 के परामश- से बनाया जायेगा,:--
i.
पया-वरण िवभाग;
ii.
वन और व+यजीव िवभाग;
iii.
कृिष और बागवानी िवभाग ;
iv.
भूिम राज=व और बंदोब=त िवभाग;
v.
oामीण िवकास िवभाग;
vi.
शहरी िवकास िवभाग;
vii.
नगरपािलका िवभाग;
viii.
पंचायती राज िवभाग;
ix.
पा2र-पय-टन सिहत पय-टन िवभाग;
x.
iसचाई और बाढ़ िनयंण िवभाग;
4.
जब तक इस अिधसूचना म' िविनPदL न हो, आंचिलक महायोजना म' वत-मान म' अनुमोदत भू-उपयोग,
अवसंरचना और %याकलाप8 पर कोई
ितबंध नह लगाया जाएगा तथा आचंिलक महायोजना म' सभी
अवसंरचनाa और %याकलाप8 म' सुधार क0 Kव=था क0 जाएगी िजससे क वे अिधक द/ और पया-वरण-
अनुकूल बन सक' ।

आंचिलक महायोजना म' वनरिहत और अव%िमत /े8 क0 बहाली, िवमान जल िनकाय8 के संर/ण, आवाह
/े8 के
बंधन, जल-संभर8 के
बंधन, भू-जल के
बंधन, मृदा और नमी के संर/ण, =थानीय जनता क0
आवJयकताa तथा पा2रि=थितक0 एवं पया-वरण के ऐसे अ+य पहलुa क0 Kव=था क0 जाएगी, िजन पर यान
देना आवJयक है।

आंचिलक महायोजना म' सभी िवमान पूजा = थल8, oामीण और शहरी बि=तय8, वन8 क0 ]ेिणय8 और क= म8,
कृिष /े8, ऊपजाऊ भूिम, उान8 एवं उान8 क0 तरह के ह2रत /े8, बागवानी /े8, बगीच8, झील8 और अ+य
जल िनकाय8 क0 सीमा का सहायक मानिच8 के साथ िनधा-रण कया जाएगा।

इस योजना से संबंिधत सहायक मानिच म' िवमान और
=तािवत भू-उपयोग क0 िवशेषताa का Fयौरा दया
जाएगा।
8.
आंचिलक महायोजना म' पा2रि=थितक0 संवेदी जोन म' होने वाले िवकास को िविनयिमत कया जाएगा तथा इस
अिधसूचना म' यथा िविनPदLा
ितिषg एवं िविनयिमत और बढ़ावा दए गए %याकलाप8 का पालन कया
जाएगा। इसम' =थानीय जनता क0 आजीिवका क0 सुर/ा के कए पा2रि=थितक0-अनुकूल िवकास का भी सुिनSय
एवं संवध-न कया जायेगा ।
9.
आंचिलक महायोजना /ेीय िवकास योजना क0 सह-कािलक होगी ।
10. अनुमोदत आंचिलक महायोजना, िनगरानी सिमित के िलए एक संदभ- द=तावेज होगी। ताक वह िनगरानी के
अपने कत-K8 का इस अिधसूचना के उपबंध8 के अनुसार िनवह-न कर सके ।

उपबंध8 4ारा =थानीय िनवािसय8 क0 िन(िलिखत आवासीय जAरत8 को पूरा करने के िलए अनुात कया जाएगा:-
(i) िवमान सड़क8 को चौड़ा करना, उ+ह' सुदृढ करना तथा नई सड़क8 का िनमा-ण करना;
(ii) बुिनयादी ढांच8 और नाग2रक सुिवधाa का िनमा-ण और नवीकरण;
(iii)
दूषण उdप\ न करने वाले लघु उोग;
(iv) oामीण उोग8 सिहत कुटीर उोग;
(v) पा2रि=थितक0 पय-टन म' सहायक सुिवधा भRडार और गृह वास सिहत =थानीय सुिवधाएं; और
(vi) बढ़ावा दए गए और पैरा-4 म' वBणत %याकलाप :
(ग) परंतु यह भी क राUय सरकार के
ासंिगक िनयम8 के अनुपालन के िबना तथा िविनयम8 एवं /ेीय शहरी िनयोजन
अिधिनयम के अधीन स/म
ािधकारी के पूव- अनुमोदन के िबना तथा संिवधान के अनुNछेद 244 के उपबंध8 अथवा तdसमय
वृ5 िविध, िजसके अंतग-त अनुसूिचत जनजाित और अ+य परंपरागत वन िनवासी (वन अिधकार8 क0 मा+यता) अिधिनयम,
2006 (2007 का 2) भी है, का अनुपालन कए िबना वािणिUयक या औोिगक िवकास %याकलाप8 के िलए जनजातीय
भूिम का
योग अनुात नह होगा:
(घ) परंतु यह भी क पा2रि= थितक0 संवेदी जोन के अंतग-त आने वाली भूिम के अिभलेख8 म' ;ई कसी ु2ट को, िनगरानी
सिमित के िवचार
ाI करने के पSात्, राUय सरकार 4ारा
dयेक मामले म' एक बार सुधारा जाएगा और उ7 ु2ट को

(1) िनगरानी सिमित इस अिधसूचना के उपबंध8 के अनुपालन क0 िनगरानी करेगी।
(2) िनगरानी सिमित का काय-काल तीन वष- या राUय सरकार 4ारा नई सिमित का पुनग-ठन कए जाने तक होगा
और इसके बाद िनगरानी सिमित राUय सरकार 4ारा ग2ठत क0 जाएगी।
(3) िनगरानी सिमित वा=तिवक िविशL दशाa के आधार पर उन %याकलाप8 क0 संवी/ा करेगी जो भारत सरकार
के तdकालीन पया-वरण एवं वन मंालय क0 अिधसूचना संXया का. आ. 1533 (अ), तारीख 14 िसत
बर, 2006 क0
अनुसूची और पा2रि=थितक0 संवेदी जोन के अ+तग-त आते हH। इनम' वे %याकलाप शािमल नह हH जो इस अिधसूचना
के पैरा 4 म' दी गई सारणी म' यथा िविनPदL हH तथा िज+हे के+, सरकार के पया-वरण, वन और जलवायु प2रवत-न
मंालय को उ7 अिधसूचना के उपबंध8 के अधीन पूव- पया-वरण =वीकृित के िलए भेजा गया है।

S.O. 772(E).—In supersession of Ministry’s draft notification S.O. 3546 (E), dated 30th December, 2015, the
following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred
by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the
Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the
Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby
given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from
the date on which copies of the Gazette containing this notification are made available to the public;
Any person interested in making any objections or suggestions on the proposal contained in the Draft
Notification may forward the same in writing for consideration of the Central Government within the period so specified
to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jor Bagh Road,

Draft Notification
WHEREAS, the Mehao Wildlife Sanctuary (herein after referred to as the Sanctuary) lies between 95o50’ and
96o30’ east longitude and 28o03’ and 28o15’ North latitude and is situated in Lower Dibang Valley District in the eastern
part of the Arunachal Pradesh state and is about 1.0 kilometer close to the Roing, the district headquarters of Lower
Dibang Valley;
AND WHEREAS, the altitude of the Sanctuary varies from 400 meters above mean sea level (MAMSL) at
southern boundary rising to northern boundary which follows a ridge touching peaks 3110, 3568,3560, 3003 and 2997
MAMSL. The Sanctuary comprises of smaller hills of varying heights running north-south with slopes varying from 55o
to 70o. The valleys are narrow along the rivers and streams. It is interspersed with small flat land at different alleviations
which provide shelter to wildlife. The three natural water bodies namely Mehao lake, mini Mehao lake and Sally lake
add significance to the Sanctuary;
AND WHEREAS, the Sanctuary considering its ecological, floral, faunal and natural significance was notified
vide No. FOR.85/77/27-397-40 dated October 18, 1980 and came into existence on October 10, 1986 vide Gazzette
Notification No.FOR.85/77. It is spread over an area of 281.50 square kilometers and administered under Divisional
Forest Officer, Mehao Wildlife Sanctuary Division, headquarter at Roing;

AND WHEREAS, the Sanctuary is represented by various forest types like tropical evergreen forest, tropical
semi-green forest, sub-tropical evergreen forest, temperate broad leaves forest, temperate conifer forest, wet temperate
forest and bamboo forest;
AND WHEREAS, the Sanctuary conserves the floral and faunal biodiversity and supports 138 species of fauna,
36 species of flora, 137 important avifaunal species and 31 species of amphibians and reptiles. The 36 species of flora
include Terminalia myriocarpa (Hollock), Terminalia bellerica, Altingia exelsa (Jutli), Abizzia lucida, Canarium
strictum (Dhuna), Largerstromia munitecarpa, Daubanga grandifolia (Khokan), Michelia champaka (Tita champa),
Dillenia indica (Outenga), Castanopsis indica, Bischofia javanica, Alianthus grandis (Borpat), Kydia calycina, Bombax
ciba (Simul), Schima wallichi, Streospermum chelonoides, Eleocarpus aristatus, Canarium strictum (Dhuna), Tetramelis
nudifera (Bhelu), Alnus nepalensis, Castanopsis indica, Betula alnoides, Tsuga dumosa (Hemlock), Abies densa (Abies),
Pinus wallichiana (Blue pine), Taxus baccata (Indian yew), Rhododendron sp., Magnolia sp., Ficus sp., Clerodendrum
colebrokianum (Naphaphu), Zanthozylum sp., Panax zingsang (Zingsang), Maesa indica, Costus specious, Solanum
khasianum and Dendrocalamus hamiltonii (Kako);
AND WHEREAS, the Sanctuary supports 138 faunal species majorly including Manis pentadactyla (Chinese
Pangolin), Talpa leucura (White-tailed mole), Crocidura attenuate (Grey shrew), Tupaia belangeri (Tree shrew),
Marcoglossus sobrinus (Long-tongued hill fruit bat), Nycticebus coucang (Slow loris), Macaca assamensis (Assamese
macaque), Trachypitchcus pipeatus (Capped langur), Cuon alpines (Wild dog), Ursus thibetanus (Asiatic black bear),
Martes flavigula (Yellow throated martin), Lutra lutra (Common otter), Viverra zibetha (Large Indian civet),
Paradoxurus hermaphrodites (Common palm civet), Herpestes edwardsii (Grey mongoose), Felis chaus (Jungle cat),
Prionailurus bengalensi (Leopard cat), Pardofelis marmorata (Marbled cat), Panthera pardus (Leopard), Panthera tigris
(Tiger), Elephas maximus (Elephant), Sus scrofa (wild pig), Muntiacus muntjak (Barking deer), Naemorhedus
sumatraensis (Himalayan serow), Ratufa bicolor (Malayan giant squirrel), Callosciurus pygerythrus (Hoary-bellied
squirrel), Dremomys lokriah (Orange-bellied Himalayan squirrel), Petaurista petaurista (Common flying squirrel),
Bandicota indica (Large bandicoot rat) and Hystrix brachyuran (Chinese porcupine);
AND WHEREAS, the Sanctuary is astonishing rich in avifauna and supports 137 bird species. The important
ones are Lophura leucomelanos (Kalij pheasant), Picus flavinucha (Greater yellow nape woodpecker), Megalaima
lineate (Lineated barbet), Halcyon coromanda (Ruddy kingfisher), Centropus bengalensis (Lesser coucal), Otus
spilocephalus (Mountain scopes owl), Ducula badia (Mountain imperial pigeon), Chalcophaps indica (Emerald dove),
Spilornis cheela (Crested serpent eagle), Cissa chinensis (Green magpie), Dicrurus remifer (Lesser racket-tailed drongo),
Chaimarrornis leucocephalus (White-capped water redstart), Sitta castanea (Chestnut-bellied nuthatch), Prinia
hodgsonii (Grey-breasted prinia), Phylloscopus trochiloides (Greenish leaf warbler), Garrulax pectoralis (Greater-
necklace laughing thrush), Xiphirhynchus superciliaris (Slender-billed scimitar babbler), Minla ignotincta (Red-tailed
minla), Alcippe rufogularis (Rufous-throated fulvetta), Yuhina castaniceps (Straited yuhina), Paradoxornis gularis
(Grey-headed parrotbill), Arachnothera magna (Streaked spider hunter), Dendronanthus indicus (Forest wagtail), Anthus
rufulus (Paddy field pipit) and Lonchura punctulata (Scaly-breasted munia);
AND WHEREAS, the Sanctuary conserve and support 31 important species of amphibians and reptiles. The reptiles are Pyxidea mouhoti (Keelbox turtle), Gekko gecko (Tockay), Ptyctolaemus gularis (Blue throated forest lizard), Mubaya carinata (Common sunskink), Takydromus sexlineatus (Asian long tailed grass lizard), Varanus bengalensis (Monitor lizard), Typhlops diardi (Diard’s blind snake), Python molurus bivittatus (Burmese python), Coeloganthus radius (Copperhead snake), Pareas monticola (Assam snail eater), Ptyas korros (Indo-chinese rat snake), Dendrolaphis pictus (Painted bronzeback), Boiga gokool (Eastern gamma), Ophiophagus hannah (King cobra) and Trimerusurus yunanensis (Green pit viper). The amphibians are Duttaphrynus melanostictus (Common toad), Hyla annectans (Indian hylid frog), Microhyla ornate (Ornamental pigmy frog), Amolops assamensis (Assamese cascade frog) and Rhacophorus maximus (Large tree frog). It also supports eight fish species including Anguilla bengalensis (Long fin eel), Salmastoma bacaila (Large razor belly minnow), Danio aequipinnatus (Dorikana), Barilius barna (Barna braila), Punticus sarana (Chiniputhi), Chagunius chagunio (Kentahputhi), Labeo pangisia (Silghoria), Tor tor (Tor mahseer), Tor putitora (Golden Mahseer), Gara gotyla (Gara) and Wallago attu (Borali);
AND WHEREAS, the Sanctuary also conserves, protect and provides shelter to one endangered species, clouderd leopard, and one threatened species, Hoolock gibbon; AND WHEREAS, the Sanctuary is home to a variety of flora, fauna and avifauna, and provides protection to endangered species of wildlife endemic. Hence, it is necessary to conserve and protect the area around the Sanctuary from ecological and environmental point of view to protect and propagate the biodiversity therein and its environment;
NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area of 46.49 square kilometers with uniform 0.5 kilometers extent in all directions around the boundary of Mehao Wildlife Sanctuary in the state of Arunachal Pradesh as Mehao Wildlife sanctuary Eco-Sensitive Zone (herein after referred to as the Eco-Sensitive Zone), details of which are as under, namely :-

1.
Extent and Boundaries of Eco-Sensitive Zone :-
(1) The Eco-Sensitive Zone shall be 46.49 square kilometers with uniform 0.5 kilometers extent in all directions
around the boundary of the Mehao Wildlife Sanctuary;
(2) The boundary description of the Eco-Sensitive Zone around the Mehao Wildlife Sanctuary is appended as
Annexure-I;
(3) Geo-coordinates of the Mehao Wildlife Sanctuary and its Eco-Sensitive Zone in terms of Global Positioning
System coordinates is appended as Annexure-II;
(4) The list of villages falling under the Mehao Wildlife Sanctuary ESZ along with Geo-coordinates is appended as
Annexure-III;
(5) The Google earth map of Eco-Sensitive Zone is appended as Annexure-IV;
(6) Map of the Mehao Wildlife Sanctuary Eco-Sensitive Zone along with Geo-coordinates.
2.
Zonal Master Plan for the Eco-Sensitive Zone :-
1.
The State Government shall, for the purpose of effective management of the Eco-Sensitive Zone, prepare a
Zonal Master Plan within a period of two years from the date of publication of Final Notification in the
Official Gazette, in consultation with local people and adhering to the stipulations given in this Notification
for approval of Competent Authority in the State Government.
2.
The Zonal Master Plan for Eco-Sensitive Zone shall be prepared by the State Government in such manner
as is specified in this Notification and also in consonance with the relevant Central and State laws and the
guidelines issued by the Central Government, if any.
3.
The Zonal Master Plan shall be prepared in consultation with the following State Departments for
integrating the ecological and environmental considerations into the proposed plan:
i.
Environment Department
ii.
Forest and Wildlife Department
iii.
Agriculture & Horticulture Department
iv.
Land Revenue and Settlement Department
v.
Rural Development Department
vi.
Urban Development Department
vii.
Municipal Department
viii.
Panchayati Raj Department
ix.
Tourism including Eco-tourism Department
x.
Irrigation and Flood Control Department
4.
The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and
activities, unless so specified in this Notification and the Zonal Master Plan shall factor in improvement of
all infrastructure and activities to be more efficient and eco-friendly.
5.
The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing
water bodies, management of catchment areas, watershed management, groundwater management, soil and
moisture conservation, needs of the local community and such other aspects of the ecology and
environment that need attention.
6.
The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements,
types and kinds of forests, agricultural areas, fertile lands, green area such as park and like places,
horticultural areas, orchards, lakes and other water bodies.
7.
The Zonal Master Plan shall be supported by maps giving details of existing and proposed land use features.
8.
The Zonal Master Plan shall regulate development in Eco-Sensitive Zone and adhere to prohibited,
regulated activities listed in Table and also ensure and promote the eco-friendly development for livelihood
security of local communities.
9.
The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
10.
The Zonal Master Plan so approved shall be the reference document for the State and District level Eco-
Sensitive Zone Monitoring Committee for carrying out its functions of monitoring in accordance with the
provisions of this Notification.
19 3. Measures to be taken by State Government :- The State Government shall take the following measures for giving effect to the provisions of this Notification, namely :-
- Landuse:
(a) Forests, horticulture areas, agricultural areas, and open spaces earmarked for recreational purposes in the Eco-
Sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial
activities.
(b) Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-Sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as: (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution;
(iv) Cottage industries including village industries;
(v) Convenience stores and local amenities supporting Eco-tourism including home stay; and
(vi) Promoted activities and activities given under para 4.
(c) Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
(d) Provided also that any error appearing in the land records within the Eco-Sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: (e) Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (f) Provided also that there shall be no consequential reduction in the green area such as forest area and agriculture area. Efforts shall be made to reforest the unused, denuded or unproductive agricultural areas with afforestation and habitat and biodiversity restoration activities. - Natural water bodies:
The catchment areas of all natural rivers/channels/springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan. The strict guidelines shall be drawn up by the State Government to prohibit development activities at or near these areas. - Tourism/ Eco-tourism:
(a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-Sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The activities of Eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1.0 km from the boundary of the Mehao Wildlife Sanctuary or up to the extent of the ESZ whichever is nearer. However, beyond the distance of 1.0 km from the boundary of the Sanctuary till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) All new tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the Eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on Eco-tourism;

(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities
shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and
recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment
construction is permitted within ESZ area.
4. Natural Heritage: All sites of valuable natural heritage in the Eco-Sensitive Zone, such as the gene pool
reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be
identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the
Zonal Master Plan.
5. Man-made heritage sites: Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be indentified in the Eco-Sensitive Zone and heritage conservation plan for
their conservation shall be prepared as a part of the Zonal Master Plan.
6. Noise pollution: Prevention and control of noise pollution in the Eco-Sensitive Zone shall be complied with in
accordance with Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act,
1986 and amendments thereto.
7. Air pollution: Prevention and control of air pollution in the Eco-Sensitive Zone shall be complied with in
accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules
made thereunder and amendments thereto.
8. Discharge of effluents: Discharge of treated effluent in Eco-Sensitive Zone shall be in accordance with the
provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental
(Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more
stringent.
9. Solid wastes: Disposal and management of solid wastes shall be as under:-
(a) The solid waste disposal and management in Eco-Sensitive Zone shall be carried out in accordance with
the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of
Environment, Forests and Climate Change vide Notification number S.O. 1357 (E), dated 8th April, 2016
as amended from time to time and the relevant rules notified by the State Government;
(b)
Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing
rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.
10. Bio-medical waste: Bio-medical waste management shall be as under:
(a) TheBio-medical waste disposal in the Eco-Sensitive Zone shall be carried out in accordance with the Bio-
Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March,
2016 as amended from time to time.
(b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the
existing rules and regulations using identified technologies may be allowed within the Eco-Sensitive Zone.
11. Plastic Waste Management: The plastic waste management in the Eco-Sensitive Zone shall be carried out as
per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the
Ministry of Environment, Forest and Climate Change vide Notification number G.S.R. 340(E), dated the 18th March,
2016, as amended from time to time.
12. Construction and Demolition Waste Management: The management of construction and demolition waste in
the Eco-Sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste
Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate
Change vide Notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
13. E-Waste Management: The E-Waste management in the Eco-Sensitive Zone shall be carried out as per the
provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of
Environment, Forest and Climate Change, as amended from time to time.
14. Vehicular traffic: The vehicular movement of traffic shall be regulated in a habitat friendly manner and
specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master
plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall
monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
15. Vehicular Pollution: The prevention and control of vehicular pollution shall be complied with in accordance
with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc.

16. Industrial Units:
(i) On or after the publication of this Notification in the Official Gazette, no new polluting industries shall be
allowed to be set up within the Eco-Sensitive Zone.
(ii) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines
issued by Central Pollution Control Board in February 2016, unless so specified in this Notification. In addition,
non-polluting cottage industries shall be promoted.
17. Protection of Hill Slopes: The protection of hill slopes shall be as under:
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
18. The Central Government and the State Government shall specify other additional measures, if it considers
necessary, in giving effect to the provisions of this Notification.
4.
List of activities prohibited or to be regulated within the Eco-Sensitive Zone:
All activities in the Eco-Sensitive Zone shall be governed by the provisions of the Environment (Protection)
Act, 1986 (29 of 1986) and the rules made thereunder including the Coastal Regulation Zone (CRZ), 2011 and
the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest
(Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act
1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below,

activities.
(b) Provided that, beyond 1.0 km from the boundary of the Protected Area or up
to the extent of Eco-Sensitive Zone whichever is nearer, all new tourist activities
or expansion of existing activities shall be in conformity with the Tourism / Eco-
tourism Master Plan and guidelines as applicable.

Establishment of large-scale
commercial livestock and poultry
farms by firms, corporate, companies

11.
Construction activities
(a) No new commercial construction of any kind shall be permitted within 1.0 km
from the boundary of the Protected Area or up to extent of the Eco-Sensitive

their land for their use including the activities listed in sub-paragraph (1) of
paragraph 3 as per building byelaws to meet the residential needs of the local
residents such as:
(i)
Widening and strengthening of existing roads and construction of new
roads;
(ii)
Construction and renovation of infrastructure and civic amenities;
(iii) Small scale industries not causing pollution termed as per Classification
done by Central Pollution Control Board of February 2016;
(iv) Cottage industries including village industries; convenience stores and local
amenities supporting Eco-tourism including home stays; and
(v)
Promoted activities listed in this Notification.
(c) Provided that the construction activity related to small scale industries not
causing pollution shall be regulated and kept at the minimum, with the prior
permission from the competent authority as per applicable rules and regulations,
if any.
(d) Beyond 1.0 km it shall be regulated as per the Zonal Master Plan.
12.
Small scale non-polluting industries
Non-polluting industries as per classification of industries issued by the Central
Pollution Control Board in February 2016 and non-hazardous, small-scale and
service industry, agriculture, floriculture, horticulture or agro-based industry
producing products from indigenous materials from the Eco-Sensitive Zone shall
be permitted by the competent Authority.
13.
Felling of Trees
(a) There shall be no felling of trees on the forest or Government or revenue or
private lands without prior permission of the competent authority in the State
Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the
concerned Central or State Act and the rules made thereunder.
14.
Collection of Forest produce or Non-

6.
Terms of Reference.-
(1)
The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2)
The tenure of the Committee shall be three years or till the constitution of the new committee by the State
Government and subsequently the Monitoring Committee would be constituted by the State Government.
(3)
The activities that are covered in the Schedule to the Notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in
the Eco-Sensitive Zone, except the prohibited activities as specified in column(3) of the table under paragraph
4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and
referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior
environmental clearances under the provisions of the said Notification.
(4)
The activities that are not covered in the Schedule to the Notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 but are
falling in the Eco-Sensitive Zone, except the prohibited activities as specified in column (3) of the table under
paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific
conditions and referred to the concerned regulatory authorities.
(5)
The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned work in-
charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986
against any person who contravenes the provisions of this Notification.
(6)
The Monitoring Committee may invite representatives or experts from concerned Departments, representatives
from industry associations or concerned stakeholders to assist in its deliberations depending on the
requirements on issue to issue basis.
(7)
The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of
every year by 30th June of that year to the Chief Wildlife Warden in the State Ministry of Environment, Forest
and Climate Change as per pro forma appended at Annexure VI.
(8)
The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this Notification.
8.
The provisions of this Notification are subject to the orders, if any, passed or to be passed by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal.
