पययावरण, वन और जलवययु पररवतान मंत्रयलय ऄधधसूचनय नइ ददल्ली, 2 जनवरी, 2018 (पेनुधसलय नरधसम् हय व‍ यजीव ऄ्‍ ययर‍ य, अंध्र प्रदेश) कय.अ. 36(ऄ).— ऄधधसूचनय कय धनम्नधलधखत प्रयरूप, धजसे के‍रीय सरकयर, पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 29) की धयरय 3 की ईपधयरय (2) के खंड (v) और खंड (xiv) तथय ईपधयरय (3) के सयथ परित ईपधयरय (1) द्वयरय प्रदत्त शधियों कय प्रयोग करते हुए, जयरी करने कय प्रस्तयव करती है, पययावरण (संरक्षण) धनयम, 1986 के धनयम 5 के ईपधनयम (3) की ऄपेक्षयनुसयर, जनसयधयरण की जयनकयरी के धलए, प्रकयधशत है; धजनके ईससे प्रभयधवत होने की संभयवनय है, और यह है दक ईि प्रयरूप ऄधधसूचनय पर, ईस तयरीख से, धजसको आस ऄधधसूचनय को ऄंतर्ववष् ट करने वयले भयरत के रयजपत्र की प्रधतययं जनसयधयरण को ईपलब्ध करय दी जयती हैं, सयि ददन की ऄवधध की समयधि पर यय ईसके पश् चयत् धवचयर दकयय जयएगय ; ऐसय कोइ व्यधि, जो प्रयरूप ऄधधसूचनय में ऄंतर्ववष्ट प्रस्तयवों के संबंध में कोइ यय सुझयव देने है, वह आस प्रकयर धवधनर्ददष्ट ऄवधध के भीतर, के‍रीय सरकयर द्वयरय धवचयर दकए जयने के धलए, यय सुझयव सधचव, पययावरण, वन और जलवययु पररवतान मंत्रयलय, आंददरय पययावरण भवन, जोर बयग रोड, ऄलीगंज, नइ ददल्ली-110003 यय इ-मेल esz-mef@nic.in पर धलधखत रूप में भेज सकतय है ।
प्रयरूप ऄधधसूचनय और, पेनुधसलय नरधसम्हय व‍यजीव ऄभययर‍य 1030.85 वगा दकलोमीटर क्षेत्र में फैलय हुअ है। जो अंध्र प्रदेश रयज्य के दो रयजस्व धजलों (एसपीएसअर नेल्लोर और कडपय) में धस्थत है। पेनुधसलय नरधसम्हय व‍यजीव ऄभययर‍य "बडवेल- एसपीएसअर नेल्लोर सड़क" के नयम से धवददत दो महत्वपूणा पहयड़ी दरों के बीच धस्थत है जो दक दधक्षण में रपूर-धचतवेल सड़क मयगा, पूवा में पोडयलयकूर सोमयधसलय मयगा, दधक्षण में कडयपय रयजमपेट मयगा और पधिम में धसद्धवतम बडवेल मयगा पर ईत्तर से होकर गुजरतय है। यह ऄभययर‍य तीन वन मंडलों ऄथयात् गुंटूर, कुरनूल और व‍यजीव प्रबंधन मंडल धतरुपधत तथय चयर वन संभयगों ऄथयात् नेल्लोर, रयजमपेट, कडपय और प्रोद्दयत्तूर में फैलय हुअ है;

THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, पेनुधसलय नरधसम्हय व‍यजीव ऄभययर‍य 14.161530 और 14.677480 ऄक्षयंश और 78.984510 और 79.629500 देशयंतर के बीच धस्थत है। ऄभययर‍य में दो बड़े जल धनकयय ऄथयात्, कंडलेरू जलयशय और सोमयधसलय जलयशय शयधमल हैं; और, पेनुधसलय नरधसम्हय व‍यजीव ऄभययर‍य को अंध्र प्रदेश सरकयर के ददनयंक 15.09.1997 के इ.एफ एंड एसटी (III के धलए) जी ओ एम एस सं. 106 के द्वयरय व‍यजीव (संरक्षण) ऄधधधनयम 1972 (1972 कय केंरीय ऄधधधनयम 53) की धयरय 18 के ईपयबंध के तहत व‍यजीव ऄभययर‍य घोधषत दकयय गयय थय; और, यह ऄभययर‍य ऄन‍वेधषत जैव धवधवधतय, धवशेष रुप से लुिप्रयय हो चुकी वनस्पधतयों और ईनसे सम्बद्ध जीवज‍तुओं के धलए समृद्ध अवयसीय क्षेत्र है। यह ऄभययर‍य धवधवध प्रकयर की वनस्पधत और जीवज‍तुओं कय अश्रय स्थल है तथय भू-रुपयत्मकतय के मोजेक से ऄलंकृत है। आसके ऄधधकयंश क्षेत्र पहयड़ी हैं धजसमें पियर, चट्टयनें, घयरटययं और गहरी घयरटययं हैं, धजनमें शुष्क पणापयती वन पयये जयते हैं और घयस कम ईगती है। आसके असपयस शुष्क कयंटेदयर और शुष्क सदयबहयर वन हैं; और, नेल्लोर, रयजमपेटय, कडपय और प्रोद्दयत्तूर संभयगों के वनों में मुख्य रूप से बेहतर शुष्क पणापयती प्रकयर के वन पयए जयते हैं। सवयाधधक सयमय‍य प्रजयधतययं पेटरोकयपास सैंटयधलनस, एनोजीसस लेरटफोधलयय, टर्वमनधलयय टोमेंटोसय, पेटरोकयपास मयसूाधपयम, हयडाधवक आधबनटय, क्लोरोधक्जलोन स्वेएटेधनअ, लैधनयय ग्रैंधडस, बोसवेधलयय सयरयाटय, डयल्बर्वगयय पॅधनकुलटय, धजआजफस जीलॉपीरस, लेगरस्रॉमीयय पर्ववफ्लोरय अदद, हैं; और, ऄभययर‍य की स्थलयकृधत ऐसी है जो धवधभन्न सूक्ष्म और दीघा पययावयसों धजनमें धवधवध जीवज‍तुओं को अश्रय धमलतय है के ऄधस्तत्व को सक्षम बनयती है। उपरी पियरों, मध्य में उंचे पहयड़ी ढलयनों के सयथ असपयस के शुष्क क्षेत्रों, ऄसंख्य पहयड़ी धयरयओं, घयरटयों और गहरी घयरटयों, चट्टयन-अश्रयों, वन भूधम, बयंस के वनों कय कयरण यहयं व‍यजीवों की धवधवध प्रजयधतययाँ रहती हैं। भू-भौगोधलक वगीकरण के ऄनुसयर, यह क्षेत्र आंडो-मलययन क्षेत्र (सीअइएस-गयंगेय ईप-क्षेत्र) के ऄंतगात अतय है और भयरतीय जीवज‍तुओं जैसे दक कयलय धहरन (एधनलेटोप सर्ववकरपय) और चौससगय मृग (टेरयसरस क्वैधडकोररन) अदद कय मूल अवयस है; और, प्रमुख प्रजयधतयों में पेंथेरय (पेंथेरय पदास), जंगली कुत्तय (लयआकयकोन धपक्टस) अदद जैसी प्रजयधतययं हैं। आस क्षेत्र की प्रमुख प्रजयधतयों कय ऄ‍य ईदयहरण चमगयदड़ है; ऄतः, ऄब, के‍रीय सरकयर, पययावरण (संरक्षण) धनयम, 1986 के धनयम 5 के ईपधनयम (3)
पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 29) की उ धयरय (1) तथय धयरय 3 उ (2) व उ (3) के खंड (v) और खंड (xiv) द्वयरय प्रदत्त शधियों कय प्रयोग करते हुए, अंध्र प्रदेश रयज्य में पेनुधसलय नरधसम्हय व‍यजीव ऄभययर‍य की सीमय के चयरों ओर 2 से 5 दकलोमीटर तक धवस् तयररत क्षेत्र को पेनुधसलय नरधसम्हय व‍यजीव ऄभययर‍य पयररधस्थधतकी संवेदी जोन (धजसे आसमें आसके पश् चयत् पयररधस्थधतकी संवेदी जोन कहय गयय है) के रूप में ऄधधसूधचत करती है, धजसकय धववरण धनम्नयनुसयर है, ऄथयात् :--

पयररधस्थधतक संवेदी जोन कय धवस्तयर और सीमय.- (1) पयररधस्थधतकी संवेदी जोन कय धवस्तयर पेनुधसलय नरधसम्हय व‍यजीव ऄभययर‍य के चयरों ओर 2 दकलोमीटर से 5 दकलोमीटर तक होगय। पयररधस्थधतकी संवेदी जोन कय क्षेत्रफल 775.59 वगा दकलोमीटर होगय। (2) पयररधस्थधतकी संवेदी जोन सीमय के सयथ संरधक्षत क्षेत्र कय मयनधचत्र ईपयबंध I में ददयय गयय है और संरधक्षत क्षेत्र की सीमय और पयररधस्थधतकी संवेदी जोन के भू-धनदेशयंकों की सूची क्रमशः ईपयबंध I (क) और (ख) में दी गइ है।
(3) पयररधस्थधतकी संवेदी जोन की सीमय कय धववरण ईपयबंध II के रुप में संलग्न है| (4) मुख्य सबदुओं के भू-धनदेशयंकों के सयथ पयररधस्थधतकी संवेदी जोन के ऄंतगात अने वयले ग्रयमों की सूची ईपयबंध III के रुप में संलग्न है ।
पयररधस्थधतकी संवेदी जोन के धलए अंचधलक महययोजनय :–
(1) रयज्य सरकयर, पयररधस्थधतकी संवेदी जोन के प्रभयवी प्रबंधन के प्रयोजन के धलए रयजपत्र में ऄंधतम ऄधधसूचनय के प्रकयशन की तयरीख से दो वषा की ऄवधध के भीतर, स्थयनीय व्यधियों के परयमशा से और आस ऄधधसूचनय में ददए गए ऄनुबंधों कय पयलन करते हुए रयज्य सरकयर के सक्षम प्रयधधकयरी के ऄनुमोदनयथा एक अंचधलक महययोजनय तैययर करेगी ।

(2) रयज् य सरकयर पयररधस्थधतकी संवेदी जोन के धलए अचंधलक महययोजनय आस ऄधधसूचनय में धवधनर्ददष्टयनुसयर प्रयसंधगक केंरीय और रयज् य धवधधयों तथय केंरीय सरकयर द्वयरय जयरी मयगाधनदे , यदद कोइ हों, तैययर
। (3) पयररधस्थधतकी और पययावरणीय संबंधी सरोकयरों को ईि योजनय में समयकधलत करने के धलए रयज् य सरकयर के धनम्नधलधखत धवभयगों के परयमशा से अंचधलक महययोजनय तैययर की जययेगी:-- (i) पययावरण; (ii) वन;
(iii) शहरी धवकयस ; (iv) पयरर-पयाटन ह ; (v) नगरपयधलकय और शहरी धवकयस; (vi) लोक धन मयाण धव भयग; (vii) रयजस्व; (viii) रयज्य प्रदूषण धनयंत्रण बोडा; (ix) ग्रयमीण धवकयस;
(x) ससचयइ और बयढ़ धनयंत्रण; तथय (xi) पंचययती रयज, (4) ब व ह , अंचधलक महययोजनय व ऄनुमोददत भू-ईपयोग, ऄवसंरचनय और दक्रययकलयपों पर कोइ ब नहीं अचंधलक महययोजनय सभी ऄवसंरचनय और दक्रययकलयपों को ऄधधक दक्ष और पययावरण ऄनुकूल बनयने व ।
(5) अंचधलक महययोजनय में ऄनयच्छयददत और ऄवक्रधमत क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकययों के संरक्षण, अवयह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भू-जल के प्रबंधन, मृदय और नमी संरक्षण, स्थयनीय की अवश्यकतयओं तथय पयररधस्थधत व पययावरण ऐसे ऄ‍य पह ओं, धजन पर ध्ययन देनय अवश्यक है, व
। (6) अंचधलक महययोजनय सभी धवद्यमयन पूजय स् थलों, ग्रयमीण और ह ब , वनों की श्रेधणयों और दकस् मों, कृधष क्षेत्रों, उपजयउ भूधम, उ व उ ह हररत क्षे , ब व , ब , और ऄ‍य जल धनकययों , सहययक मयनधचत्रों के सयथ, । ब ह
मयनधचत्र में धवद्यमयन और प्रस्तयधवत भूधम के ईपयोग की धवशेषतयओं ।
(7) ह के ऄंतगात वे व व सयरणी
सूचीबद्ध , व तथय
व - व को तथय संवर्वधत जययेगय ।
(8) अंचधलक महययोजनय क्षेत्रीय धवकयस योजनय के सह-कयधलक (को-टर्वमनस) होगी। (9) अंचधलक महययोजनय, धनगरयनी सधमधत भा दस्तयवेज होगी धजसमें नय ईपबंधों के ऄनुसरण में ईसके धनगरयनी संबंधी व्यों के धनवहान कय धववरण होगय । 3. रयज्य सरकयर द्वयरय दकए जयने वयले ईपयय:- रयज्य सरकयर आस ऄधधसूचनय के ईपबंधों को प्रभयवी बनयने के धलए धनम्नधलधखत ईपयय करेगी, ऄथयात् :-- (1) भू-ईपयोग: (क) पयररधस्थधतकी संवेदी जोन में वनों, बयगवयनी क्षेत्रों, कृधष क्षेत्रों, ईद्ययनों तथय अमोद-प्रमोद के प्रयोजन के धलए धचध‍हत दकए गए खुले स्थयनों कय बड़े वयधणधज्यक और अवयसीय पररसरों संबंधी औद्योधगक दक्रययकलयपों के धलए ईपयोग यय संपररवतान नहीं दकयय जयएगय:

(ख) बशते दक पयररधस्थधतकी संवेदी जोन के भीतर भयग (क) में धवधनर्ददष्ट प्रयोजन से धभन्न प्रयोजन के धलए कृधष और ऄ‍य भूधम कय संपररवतान, मयनीटरी सधमधत की धसफयररश पर और यथय लयगू और क्षेत्रीय नगर योजनय ऄधधधनयम तथय के‍रीय/रयज्य सरकयर के ऄ‍य धनयमों तथय धवधनयमों के ऄधीन सक्षम प्रयधधकयरी के पूवा ऄनुमोदन से, तथय आस ऄधधसूचनय के ईपबंधों द्वयरय स्थयनीय धनवयधसयों की धनम्नधलधखत अवयसीय जरूरतों को पूरय करने के धलए ऄनुज्ञयत दकयय जयएगय, जैसे :- (i) धवद्यमयन सड़कों को चौड़य करनय, ई‍हें सुदृढ़ करनय तथय नइ सड़कों कय धनमयाण करनय; (ii) बुधनययदी ढयंचों और नयगररक सुधवधयओं कय धनमयाण और नवीकरण; (iii) प्रदूषण ईत्पन्न न करने वयले लघु ईद्योग; (iv) ग्रयमीण उ गों सधहत कुटीर ईद्योग; सुधवधय भ‍डयर और गृह वयस सधहत स्थयनीय सुधवधयएं जो पयररधस्थधतकी पयाटन में सहययक हैं; और
(v) बढ़यवय ददए गए और पैरय-4 में वर्वणत दक्रययकलयप : (ग) बशते यह भी दक ह व ब रयज्य सरकयर के व व ब तथय संधवधयन के ऄनुच्छेद 244 के ईपबंधों तथय तत्समय प्रवृत्त धवधध, धजसके ऄंतगात ऄनुसूधचत जनजयधत और ऄ‍य परंपरयगत वन धनवयसी (वन ऄधधकयरों की मय‍यतय) ऄधधधनयम, 2006 (2007 कय 2) भी है, के ऄनुपयलन के धबनय वयधणधज्यक यय धवकयस दक्रययकलयपों के धलए जनजयतीय भूधम ह ह ।
(घ) बशते यह भी दक पयररधस् थधतकी संवेदी जोन के भीतर की भूधम के ऄधभलेखों में ईत्पन्न दकसी त्रुरट की, धनगरयनी सधमधत के धवचयर प्रयि करने के पियत्, रयज्य सरकयर द्वयरय प्रत्येक मयमले में एक बयर शुधद्ध की जयएगी और ईि त्रुरट के शुधद्धकरण की सूचनय केंरीय सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय को दी जयएगी ।
(ड़) बशते यह भी दक ईपयुाि त्रुरट के शुधद्धकरण में, आस ईप-पैरय में यथय ईपबंधधत के धसवयय, दकसी भी दशय में भू-ईपयोग कय पररवतान सधम्मधलत नहीं होगय ।
(च) ऄनुप्रयुक् त यय ऄनुत् पयदक कृधष क्षेत्रों में पुन: वनीकरण करने के तथय पययावयसों एवं जैव धवधवधतय की बहयली के प्रययस दकए जयएंगे ।
(2) प्रयकृधतक जल स्रोत -- सभी प्रयकृधतक जल स्रोतों/जलमयगों/नददयों के जलयगम क्षेत्रों की पहचयन की जयएगी और अचंधलक महययोजनय में ईनके संरक्षण और बहयली की योजनय सधम् मधलत की जयएगी ।
(3) पयाटन/पयररधस्थधतकी पयाटन:
(क) पयररधस्थधतकी संवेदी जोन के भीतर सभी नए पयररधस्थधतकी पयाटन दक्रययकलयप यय धवद्यमयन पयाटन दक्रययकलयपों कय धवस्तयर पयररधस्थधतकी संवेदी जोन संबंधी पयाटन महययोजनय के ऄनुसयर होगय ।
(ख) पयररधस्थधतकी पयाटन महययोजनय पयाटन धवभयग द्वयरय रयज्य के पययावरण और वन धवभयग के परयमशा से तैययर होगी ।
(ग) पयाटन महययोजनय अंचधलक महययोजनय कय एक घटक होगी । (घ) पयररधस्थधतकी पयाटन संबंधी दक्रययकलयप धनम्नयनुसयर धवधनयधमत होंगे,:- (i) व‍यजीव ऄभययर‍य की सीमय से 1 दकलोमीटर के भीतर यय पयररधस्थधतकी संवेदी जोन की सीमय तक, आसमें जो भी धनकट हो, दकसी होटल यय ररसोटा कय नयय संधन्नमयाण ऄनुज्ञयत नहीं दकयय जयएगय । तथयधप, व‍यजीव ऄभययर‍य की सीमय से 1 दकलोमीटर की दूरी से परे पयररधस्थधतकी संवेदी जोन की सीमय तक नए होटलों और ररसोटों की स्थयपनय पयाटन महययोजनय के ऄनुसयर पयररधस्थधतकी पयाटन सुधवधयओं के धलए पूवा पररभयधषत एवं ऄभीधहत क्षेत्रों में ऄनुज्ञयत की जयएगी। (ii) पयररधस्थधतकी संवेदी जोन के ऄ‍दर सभी नए पयाटन दक्रयय-कलयप यय धवद्यमयन पयाटन दक्रययकलयपों कय धवस्तयर के‍रीय सरकयर, पययावरण, वन और जलवययु पररवतान मंत्रयलय द्वयरय जयरी मयगादशी धसद्धयंतों तथय पयररधस्थधतकी पयाटन पर बल देते हुए रयष्ट्रीय बयघ संरक्षण प्रयधधकरण द्वयरय जयरी पयररधस्थधतकी पयाटन संबंधी मयगादशी धसद्धयंतों (समय-समय पर यथय संशोधधत) के ऄनुसयर होगय ।

II (ii) 5 (iii) अंचधलक महययोजनय कय ऄनुमोदन दकए जयने तक, पयाटन के धवकयस तथय धवद्यमयन पयाटन दक्रययकलयपों के धवस्तयर को वयस्तधवक स्थल धवधनर्ददष्ट संवीक्षय तथय धनगरयनी सधमधत की धसफयररश के अधयर पर संबंधधत धवधनययमक प्रयधधकरणों द्वयरय ऄनुज्ञयत दकयय जयएगय और पयररधस्थधतकी संवेदी जोन के भीतर दकसी नये होटल/ररसयटा यय वयधणधज्यक प्रधतष्ठयन कय संधन्नमयाण ऄनुज्ञयत नहीं होगय । (4) धवरयसत – पयररधस्थधत संवेदी जोन में ब धवरयसत के सभी स्थलों जैसे सभी जीन
व क्षेत्र, शैल , जल प्रपयत, झर , , ईपवन, गुफयएं, स्थल, व , ह , उ पयत अदद की पहचयन की जयएगी तथय उ व के धलए धवरयसत संरक्षण योजनय ब जो अंचधलक महययोजनय कय भयग हो । (5) मयनव धनर्वमत धवरयसत स् थल - पयररधस्थधतकी संवेदी जोन में भवनों, संरचनयओं, , ऐधतहयधसक, कलयत्मक और सयंस्कृधतक महत्व के क्षेत्रों की पहचयन की जयएगी और उ संरक्षण के धलए धवरयसत संरक्षण योजनय बनययी जय गी जो अंचधलक महययोजनय कय भयग होगी।
(6) ध् वधन प्रदूषण – अंध्र प्रदेश रयज् य सरकयर कय पययावरण धवभयग यय रयज् य प्रदूषण धनयंत्रण बोडा, व ( ) , 1986 ब ध्वधन प्रदूषण (धवधनयमन और धनयंत्रण) धनयम, 2000 के उ ब ऄनुसयर पयररधस्थत
संवेदी जोन में ध् वधन प्रदूषण के धनयंत्रण ब धवधनयमों को करेगय ।
(7) वययु प्रदूषण - पयररधस्थधत संवेदी जोन में, वययु प्रदूषण कय धनवयरण एवं धनयंत्रण, वययु (प्रदूषण धनवयरण और धनयंत्रण) ऄधधधनयम, 1981 (1981 कय 14) उ ब धों और ईसके ऄधीन बनयए गए धनयमों के ऄनुसयर ।
(8) बधहस्रयव कय धनस्सयरण - पयररधस्थधत संवेदी जोन में ईपचयररत बधहस्रयवों कय धनस्सयरण, पययावरण (संरक्षण) ऄधधधनयम, 1986 और ईसके ऄधीन बनयए गए धनयमों के ऄ‍तगात पययावरणीय प्रदूषण के धनस्सयरण संबंधी सयधयरण मयनकों यय रयज्य सरकयर द्वयरय धनयत मयनकों के ऄनुसयर । (9) िोस ऄपधशष्ट - िोस ऄपधशष्टों कय धनपटयन और प्रबंधन धनम्नधलधखत रूप में होगय - (क) पयररधस्थधत संवेदी जोन में िोस ऄपधशष्ट कय धनपटयन ब भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की समय-समय पर यथय संशोधधत ऄधधसूचनय सं. कय.अ. 1357( ), 8 ऄप्रैल, 2016 ह
िोस ऄपधशष्ट प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय। - व

ऄनुसयर दकयय जयएगय।

(13) इ–ऄपधशष्ट:- पयररधस्थधत संवेदी जोन में इ–ऄपधशष्ट प्रबंध , भयरत सरकयर पययावरण, वन और जलवययु पररवतान मंत्रयलय द्वयरय प्रकयधशत इ–ऄपधशष्ट प्रबंध धनयम, 2016 – के ईपबंधों के ऄनुसयर दकयय जयएगय। (14) व ह - : - व ह - अवयस-ऄनुकूल धवधनयधमत और आस संबंध में अंचधलक महययोजनय में धवशेष ईपबंध दकए जयएंगे अंचधलक महययोजनय के तैययर होने और
ऄनुमोददत तक, सधमधत उ ह ब धनयमों व धवधनयमों के ऄनुसयर व ह व ह के ऄनुपयलन करेगी। (15) वयहन जधनत प्रदूषण:- वयहन जधनत प्रदूषण की रोकथयम और धनयंत्रण लयगू धवधधयों के ऄनुसयर दकयय जयएगय। स्वच्छतर ईंधन जैसे दक सीएनजी, एलपीजी अदद के प्रयोग के प्रययस दकए जयएंगे । (16) औद्योधगक आकयआययं: - (i) सरकयरी रयजपत्र में आस ऄधधसूचनय के प्रकयशन की तयरीख को यय ईसके बयद पयररधस्थधतकी संवेदी जोन के भीतर दकसी नए प्रदूषणकयरी ईद्योग की स्थयपनय ऄनुज्ञयत नहीं की जययेगी।
(ii) जब तक आस ऄधधसूचनय में धवधनर्ददष्ट न हो, पयररधस्थधतकी संवेदी जोन में केंरीय प्रदूषण धनयंत्रण बोडा द्वयरय फरवरी, 2016 में जयरी ददशयधनदेशों में दकए गए ईद्योगों के वगीकरण के ऄनुसयर केवल गैर प्रदूषणकयरी ईद्योगों की स्थयपनय ऄनुज्ञयत की जययेगी। आसके ऄधतररि, गैर-प्रदूषणकयरी कुटीर ईद्योगों को बढ़यवय ददयय जययेगय। (17) पहयड़ी ढलयनों कय संरक्षण: - पहयड़ी ढलयनों कय संरक्षण धनम्नयनुसयर दकयय जययेगय: (क) अंचधलक महययोजनय में पहयड़ी ढलयनों के ईन क्षेत्रों को दशयायय जयएगय धजनमें दकसी भी संधनमयाण की ऄनुमधत नहीं होगी । (ख) धजन धवद्यमयन खड़ी पहयड़ी ढलयनों यय ढलयनों में ऄत्यधधक भू-क्षरण होतय है, ईनमें कोइ भी संधनमयाण ऄनुज्ञयत नहीं दकयय जययेगय । (18) के‍र सरकयर और रयज्य सरकयर, अवश्यक , आस ऄधधसूचनय के उ ब को प्रभयवी ब , ऄ‍य ईपयय वधनर्ददष्ट क । 4. पयररधस्थधतकी संवेदी जोन में प्रधतधषद्ध यय धवधनयधमत दकए जयने वयले यय संवर्वधत दक्रययकलयपों की सूची - पयररधस्थधतकी संवेदी जोन में सभी दक्रययकलयप पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 29) के ईपबंधों और तटीय धवधनयमन जोन (सीअरजेड), 2011 और पययावरणीय प्रभयव अकलन (इअइए ) ऄधधसूचनय, 2006 और वन (संरक्षण) ऄधधधनयम, 1980 (1980 69), भयरतीय वन ऄधधधनयम, 1927 (1927 16), व‍यजीव (संरक्षण) ऄधधधनयम, 1972 (1972

कुटीर ईद्योगों को ह जयएगय। 3.
बृहत तयप एवं वृहद जल धवद्युत पररयोजनयओं की स् थयपनय । लयगू धवधधयों के ऄनुसयर प्रधतधषद्ध (ऄ‍ यथय ईपबंधधत के धसवयय) होंगे । 4.
दकसी खतरनयक पदयथा कय योग यय ईत्पयदन यय प्रस्संकरण । लयगू धवधधयों के ऄनुसयर प्रधतधषद्ध ( ईपबंधधत के धसवयय) होंगे । 5.

व लोगों को, पैरय 3 के ईप पैरय (1) में सूचीबद्ध दक्रययकलयपों सधहत योग के धलए, भूधम में भवन ईप-धवधधयों के ऄनुसयर संधनमयाण करने की ऄनुमधत दी जयएगी जैसे दक :- (i) धवद्यमयन सड़कों को चौड़य करनय, ई‍हें सुदृढ करनय और नइ सड़कों कय संधनमयाण; (ii) बुधनययदी ढयंचों और नयगररक सुधवधयओं कय संधनमयाण और नवीकरण; (iii) फरवरी, 2016 में केंरीय प्रदूषण धनयंत्रण बोडा द्वयरय दकए गए वगीकरण के ऄनुसयर गैर- प्रदूषणकयरी लघु ईद्योग; (iv) कुटीर ईद्योग, धजनके ऄंतगात ग्रयमीण ईद्योग भी हैं; सुधवधय भ‍डयर और पयररधस्थधतकी पयाटन में सहययक स्थयनीय सुधवधयएं धजनमें ऄंतगात गृह अवयस भी ह ; और
(v) आस ऄधधसूचनय में सूचीबद्ध प्रोत्सयधहत दक्रययकलयप ।

(ख) बशते दक लयगू धनयमों और धवधनयमों, यदद कोइ हों, के ऄनुसयर सक्षम प्रयधधकयरी की पूवा ऄनुमधत से ऐसे लघु ईद्योगों, जो प्रदूषण ईत्पन्न नहीं करते हैं, से संबंधधत संधनमयाण दक्रययकलयप धवधनयधमत दकए जयएंगे और व ‍यूनतम
होंगे ।
(ग) एक दकलोमीटर से अगे ये अंचधलक महययोजनय के ऄनुसयर धवधनयधमत होंगे । 12.
वृक्षों की कटयइ । (क) रयज्य सरकयर के सक्षम प्रयधधकयरी की पूवा ऄनुमधत के धबनय वन भूधम यय सरकयरी यय रयजस्व यय धनजी भूधम पर वृक्षों की कटयइ नहीं होगी । (ख) वृक्षों की कटयइ केंरीय यय संबंधधत रयज्य के ऄधधधनयम यय ई के ऄधीन बनयए गए धनयमों के ईपबंधों के ऄनुसयर धवधनयधमत होगी । 13.
फमों, कॉपोरेट, कंपधनयों द्वयरय बड़े पैमयने पर वयधणधज्यक पशुधन संपदय और मुगीपयलन फयमों की स्थयपनय। लयगू धवधधयों के ऄधीन धवधनयधमत होगय । 14.
वन ईत्पयदों और गैर कयष्ठ वन ईत्पयदों (एनटीएफपी) कय संग्रहण । 15.
धवद्युत और संचयर टॉवर लगयने, और तयर- धबछयने एवं ऄ‍य बुधनययदी ढयंचे की व्यवस्थय । लयगू धवधधयों के ऄधीन धवधनयधमत होगय । भूधमगत केबल धबछयने को बढ़यवय ददयय जयएगय। 16.
नयगररक सुधवधयओं सधहत बुधनययदी ढयंचय। लयगू धवधधयों, धनयमों और धवधनयमों तथय जूदय ददशयधनदेशों के ऄनुसयर ईपशमन ईपययों के सयथ दकयय जययेगय।

धवद्यमयन सड़कों को चौड़य करनय, ई‍हें सुदृढ
ब और नइ सड़कों कय धनमयाण । लयगू धवधधयों, धनयमों और धवधनयमों तथय जूदय ददशयधनदेशों के ऄनुसयर ईपशमन ईपययों के सयथ दकयय जययेगय। 18.
पयाटन से संबंधधत ऄ‍य दक्रययकलयप जैसे दक पयररधस्थधतकी संवेदी जोन क्षेत्र के उपर से गमा वययु के गुब्बयरे, हेलीकयप्टर, ड्रोन,
मयआक्रोलयआट्स अदद ईड़यनय। 19.
पवातीय ढ़लयनों और नदी तटों कय संरक्षण । 20.
रयधत्र में वयहन ययतयययत कय संचलन । लयगू धवधधयों के ऄधीन वयधणधज्यक प्रयोजन के धलए धवधनयधमत होगय । 21.
प्रयकृधतक जल धनकययों यय भू क्षेत्र में ईपचयररत/ऄपधशष्ट जल/बधहस्रयाव कय धनस्सयरण । जल धनकययों में ईपचयररत ऄपधशष्ट जल/बधहस्रयव के धनस्सयरण से बचय जयएगय। ईपचयररत ऄपधशष्ट जल के पुनचाक्रण और पुन:ईपयोग के प्रययस दकए जयएंगे ऄ‍यथय ईपचयररत ऄपधशष्ट जल/ बधहस्रयव कय धनस्सयरण लयगू धवधधयों के ऄनुसयर धवधनयधमत दकयय जयएगय। 22.
वयधणधज्यक ईपयोग और सतही तथय भूजल कय धनष्कषाण ।

गैर प्रदूषणकयरी लघु ईद्योग । फरवरी, 2016 में के‍रीय प्रदूषण बोडा द्वयरय जयरी ईद्योगों के वगीकरण के ऄनुसयर गैर-प्रदूषणकयरी ईद्योग तथय खतरे से रधहत लघु और सेवय ईद्योग, कृधष, पुष्प कृधष, बयगबयनी यय पयररधस्थधतकी संवेदी जोन से ईत्पयद बनयने वयले कृधष अधयररत ईद्योग को सक्षम प्रयधधकयरी से ऄनुमधत लेनी होगी। 30.

धवचयरयथा धवषय :-
(1) धनगरयनी सधमधत आस ऄधधसूचनय के ईपबंधों के ऄनुपयलन की धनगरयनी करेगी। (2) धनगरयनी सधमधत कय कययाकयल तीन वषा यय रयज्य सरकयर द्वयरय नइ सधमधत कय पुन: गिन दकए जयने तक होगय और बयद में धनगरयनी सधमधत रयज्य सरकयर द्वयरय गरित की जयएगी।
(3) धनगरयनी सधमधत ईन दक्रययकलय को ऄनुज्ञयत नह करेगी जो भयरत सरकयर के तत्कयलीन पययावरण और वन मंत्रयलय की ऄधधसूचनयओं ऄथयात् पययावरण प्रभयव मूल्ययंकन , 2006 .कय.अ.1533 (ऄ), तयरीख
14 धसतंबर, 2006 और तटीय धवधनयम जोन, 2011 .कय.अ 19 (ऄ), तयरीख 6 जनवरी, 2011 तथय आनमें दकए गए पररवती संशोधनों की ऄनुसूची के ऄंतगात अते हैं और जो पयररधस्थधतकी संवेदी जोन की सीमय में भी अते हैं धजनमें आस ऄधधसूचनय के पैरय-4 में दी गइ सयरणी में यथयधवधनर्ददष्ट प्रधतधषद्ध दक्रययकलयप भी शयधमल ह । व श्वेत श्रेणी के ईद्योगों को ही के‍रीय प्रदूषण धनयंत्रण बोडा द्वयरय ‘’ईद्योगों के वगीकरण, 2016’’ के धलए जयरी मयगादशी धसद्धयंतों में धवधनर्ददष्ट मयनय जयएगय।
(4) वे दक्रययकलयप, जो भयरत सरकयर के तत्कयलीन पययावरण और वन मंत्रयलय की ऄधधसूचनय सं. कय.अ. 1533(ऄ), तयरीख 14 धसतंबर, 2006 और कय.अ. 19 (ऄ), तयरीख 6 जनवरी, 2011 की ऄ सूची के ऄंतगात नहीं अते हैं और जो पयररधस्थधतकी संवेदी जोन की सीमय में अते हैं, ईनकी, आस ऄधधसूचनय के पैरय-4 में दी गइ सयरणी में यथय धवधनर्ददष्ट प्रधतधषद्ध दक्रययकलय के धसवयय, वयस्तधवक स्थल–धवधशष्ट दशयओं के अधयर पर धनगरयनी सधमधत द्वयरय संवीक्षय की जयएगी और ई‍हें संबंधधत धवधनययमक प्रयधधकरणों को भेजय जयएगय। (5) धनगरयनी सधमधत कय सदस्य-सधचव यय ब
ऐसे व्यधि के धवरुद्ध, जो आस ऄधधसूचनय के दकसी ईपबंध कय ईल्लंघन करतय है, पययावरण (संरक्षण) ऄधधधनयम, 1986 की धयरय 19 के ऄधीन करने के धलए सक्षम होगय । (6) धनगरयनी सधमधत प्रत्येक मयमले में अवश्यकतयओं के अधयर पर संबंधधत धवभयगों के प्रधतधनधधयों यय धवशेषज्ञों, औद्योधगक संघों के प्रधतधनधधयों यय संबंधधत पक्षों को व ऄपने धवचयर-धवमशा में सहययतय के धलए अमंधत्रत कर सकेगी। (7) धनगरयनी सधमधत प्रत्येक वषा 31 मयचा की धस्थधत के ऄनुसयर ऄपनी वयर्वषक कयरावयइ ररपोटा रयज्य के पययावरण, वन और जलवययु पररवतान मंत्रयलय व‍यजीव वयडान को, ईपयबंध IV में ददए गए प्रपत्र के ऄनुसयर, ईस वषा की
30 जून तक प्रस्तुत करेगी । (8) के‍रीय सरकयर कय पययावरण, वन और जलवययु पररवतान मंत्रयलय धनगरयनी सधमधत को ईसके कृत्यों के प्रभयवी धनवाहन के धलए ऐसे धनदेश दे सकेगय जो वह उ समझे ।
आस ऄधधसूचनय के ईपबंधों को प्रभयवी बनयने के धलए केंरीय सरकयर और रयज् य सरकयर, ऄधतररक् त ईपयय, यदद कोइ हों, धवधनर्ददष् ट कर सकेगी ।

II (ii) 21 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 2nd January, 2018 (Penusila Narasimha Wildlife Sanctuary, Andhra Pradesh) S.O. 36(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Aliganj, New Delhi-110003, or send it to the e-mail address of the Ministry at esz-mef@nic.in. Draft Notification WHEREAS, the Penusila Narasimha Wildlife Sanctuary spreading over an area of 1030.85 Sq. kms is located in two revenue districts (SPSR Nellore and Kadapa) in the State of Andhra Pradesh. The Penusila Narasimha Wildlife Sanctuary is located between two important hill passes known as ―Badvel – SPSR Nellore road‖ passing on the North, Rapur – Chitvel road passing on the South, Podalakur-Somasila road on the East, Kadapa – Rajampet road on the South and Sidhavatam – Badvel road on the West. This sanctuary spreads in three forest circles viz. Guntur, Kurnool and Wildlife Management Circle, Tirupathi, four forest divisions viz. Nellore, Rajampet, Kadapa and Proddatur.
AND WHEREAS, the Penusila Narasimha Wildlife Sanctuary lies between 14.161530 and 14.677480 Latitudes and 78.984510 and 79.629500 Longitudes. Two big water bodies viz., the Kandaleru Reservoir and Somasila Reservoir are included in the sanctuary.
AND WHEREAS, the Penusila Narasimha Wildlife Sanctuary had been declared as Wildlife Sanctuary under the provision of Section 18 of Wildlife (Protection) Act, 1972 ( Central Act 53 of 1972) vide Govt., of Andhra Pradesh E.F&S.T (For III) G.O M.s. No. 106 dated 15.09.1997. AND WHEREAS, this sanctuary is a domain of rich habitat for unexplored bio- diversity, especially many endangered flora and its associated fauna. The sanctuary is ornamented with mosaic of geo-morphological features supporting variety of flora & fauna. Most of the sanctuary possess hilly terrain with plateaus, ridges, gorges and deep valleys which support dry deciduous forests with an under growth of grasses. Dry thorny and dry evergreen forests surround the fringe. AND WHEREAS, the forests of Nellore, Rajampeta, Kadapa and Proddatur divisions are comprised of mainly superior dry deciduous types. The most common species occurring are Pterocarpus santalinus, Anogeissus latifolia, Terminalia tomentosa, Pterocarpus marsupium, Hardwick iabinata, Chloroxylon swietenia, Lannea grandis, Boswellia serrata, Dalbergia paniculata, Zizyphus xylopyrus, Lagerstroemia parviflora, etc., AND WHEREAS, the topography of the sanctuary enables the occurrence of varied micro & macro habitats to shelter variety of fauna. The upper plateaus, dry tracts of fringe areas with lofty hill slopes in the centre, numerous hill streams, valleys and deep gorges, rock shelters, wood lands, bamboo forests contribute to the existence of a variety of wildlife species. Under the Zoogeographic classification of this area comes under Indo-Malayan region (Cis-Gangetic sub-region)-native to the true Indian fauna like the Black buck (Antilope cervicapra) and four horned antelope (Tetracerus quadricornis); AND WHEREAS, among the most obvious keystone species are top predators like Panther (Panthera pardus), Wild Dog (Lycaon pictus), etc. Bats are another example of keystone species of this area. NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent varying from 2 kilometres to 5 kilometres around the boundary of Penusila Narasimha Wildlife Sanctuary in the State of Andhra Pradesh as the Penusila Narasimha Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco- sensitive Zone) details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone.-(1) The extent of Eco-sensitive Zone varies from 2 kilometres to 5 kilometres around the Penusila Narasimha Wildlife Sanctuary. The area of the Eco-Sensitive Zone is 775.59 square kilometers.

(2) The map of the Protected Area demarcating the Eco-sensitive Zone boundary is at Annexure I and the list of geo co- ordinates of the boundary of the Protected Area and the Eco-Sensitive Zone is at Annexure I (A) and (B) respectively. (3) The boundary description of the Eco Sensitive Zone is appended at Annexure II. (4) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure III.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of effective management of the Eco-Sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of publication of Final Notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this Notification for approval of Competent Authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments for integrating the ecological and environmental considerations into the said plan: (i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism including eco-tourism;
(v) Municipal and urban development; (vi) Public Works Department; (vii) Revenue; (viii) State Pollution Control Board; (ix) Rural Development; (x) Irrigation and Flood Control; and
(xi) Panchayati Rajण ्
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area such as park and like places, horticultural areas, orchards, lakes and other water bodies. The Zonal Master Plan shall be supported by maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Landuse.-
(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco- sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities.
(b) Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of

II (ii) 23 Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as: (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) Promoted activities and given under para 4.
(c) Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
(d) Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: (e) Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (f) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat and biodiversity restoration activities. (2) Natural Springs.- The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism/Eco-Tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco- Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The activities of eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism; (iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within ESZ area.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. (6) Noise pollution.- The Environment Department of the State Government or Andhra Pradesh State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto.

(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes. - Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (10) Bio-medical waste.- Bio-medical waste management shall be as under: (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time. (b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular Pollution.- Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc. (16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes: The protection of hill slopes shall be as under: (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification. 4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:-

Setting of industries including new oil and gas exploration causing pollution (Water, Air, Soil, Noise, etc.) No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted.
Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.
3.
Establishment of major thermal and major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws. 4.
Use or production or processing of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws. 5.
Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws 6.
Setting of new saw mills and wood based industries. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone. 7.
Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws. 8.
Use of plastic bags. Prohibited (except as otherwise provided) as per applicable laws. 9.
Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws B. Regulated activities 10.
Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities.
Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and

guidelines as applicable. 11.
Construction activities (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco- sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of the local residents such as: (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016;
(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and
(v) Promoted activities listed in this Notification. (b) Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (c) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
12.
Felling of Trees (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 13.
Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies. Regulated as per applicable laws 14.
Collection of Forest produce or Non- Timber Forest Produce (NTFP). Regulated under applicable laws. 15.
Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws. Underground cabling may be promoted. 16.

5. Monitoring Committee.- In exercise of the powers conferred by sub-section (3) of section 3 (1) of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes the Monitoring Committee, for effective monitoring of the Eco Sensitive Zone, which shall comprise of, namely:- (i) Collector, Kadappa YSR District- Chairperson; (ii) An expert in the area of ecology and environment to be nominated by the State Government- Member; (iii) Divisional Forest Officer (WL), Proddatur- Member; (iv) One representative of non-Governmental Organisation (working in the field of environment
including heritage conservation) to be nominated by the State Government- Member; (v) Senior Town Planner of the Area- Member; (vi) Representative from Andhra Pradesh State Pollution Control Board-
Member; (vii) An expert in Biodiversity to be nominated by the State Government- Member; (viii) Deputy Conservator of Forests (In charge of the Sanctuary)

Member Secretary.

Terms of Reference.-
(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government. (3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notifications of the Government of India in the erstwhile Ministry of Environment and Forests namely Environmental Impact Assessment, 2006 vide S.O. 1533 (E), dated the 14th September, 2006, and Coastal Regulation Zone, 2011 vide S.O. No. 19(E) dated 6th January, 2011 and subsequent amendments therein, and are falling in the Eco-sensitive Zone, including the prohibited activities as specified in the Table under paragraph 4 thereof. Only white categories of industries shall be considered as specified in the guidelines issued by the CPCB for ―classification of Industries, 2016‖.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and S.O. 19 (E) dated
6th January, 2011 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State under intimation to this Ministry as per proforma appended at Annexure IV. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

II (ii) 35 Annexure II Boundary Description of Eco Sensitive Zone of Penusila Narasimha Wildlife Sanctuary, Andhra Pradesh The boundary of the eco-sensitive zone of Sri Penusila Narasimha Wildlife Sanctuary starts at Station No. 1 located at North-West corner and it runs along the boundary of eco-sensitive zone of Sri Penusila Narasimha Wildlife Sanctuary passing through four divisions viz., Proddatur, SPSR Nellore, Rajampet and YSR Kadapa as detailed here- under. North (Part I): The eco-sensitive zone boundary line starts from Station No. 1 of Proddatur division as shown on the map. The GPS reading of Station No. 1 is 14.687220N & 079.144100E and runs towards East direction upto Station No. 5 in Proddatur Division. The GPS reading of Station No. 5 is 14.617860N & 079.189820E.
North (Part II): The eco-sensitive zone boundary line starts at Station No. 5 in SPSR Nellore division in the North with GPS reading 14.617860N & 079.189820E and runs towards North direction upto Station No. 7 along the district boundary between YSR Kadapa and SPSR Nellore, which is also the division boundary. Thence the boundary runs from Station No. 7 towards East and reaches Station No. 9 in the North-East corner. East: The eco-sensitive zone boundary runs from Station No. 9 whose GPS reading is 14.619530N & 079.305320E and proceeds towards South direction upto Station No. 18 in SPSR Nellore division. The GPS readings of Station No.18 are 14.268010N & 079.609140E.
South (Part I): The eco-sensitive zone boundary leaves Station No. 18 and proceeds towards west upto Station No. 24 whose GPS is 14.126570N & 079.443420E. Finally meets the district boundary of YSR Kadapa at Station No. 24, which is also the division boundary of Rajampet division. South (Part II): The eco-sensitive zone boundary line enters Rajampeta in the South direction at Station No. 24 and runs along the District boundary. Thence the boundary runs along the South-West direction, and finally meets the YSR Kadapa division between Stations 30 and 31. South (Part III): The boundary line of the eco-sensitive zone enters YSR Kadapa division between Station Nos. 30 and 31 and proceeds towards Western direction upto Station No. 33 GPS reading is 14.305680N & 079.043350E. West: The eco-sensitive zone boundary line starts at Station No. 33 in the Western direction, runs towards North direction. The boundary line runs in the Northern direction and reaches the station No.45. The eco-sensitive zone boundary line ends at station No. 45 in Proddatur division whose GPS reading is 14.683980N & 079.117840E and meets Station No. 1 by closing the boundary.
