पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय अिधसूचना नई ᳰद᭨ली, 9 िसत᭥बर, 2016 का.आ. 2907(अ).—िन᳜िलिखत ᮧाᱨप अिधसूचना, िजसे के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पᳯठत उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, जारी करने का ᮧ᭭ताव करती है, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) कᳱ अपेᭃानुसार, जनसाधारण कᳱ जानकारी के िलए ᮧकािशत कᳱ जाती है; िजनके उससे ᮧभािवत होने कᳱ संभावना है, ; और यह सूचना दी जाती है ᳰक उᲦ ᮧाᱨप अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना वाले भारत के राजपᮢ कᳱ ᮧितयां जनसाधारण को उपल᭣ध करा दी जाती हᱹ, साठ ᳰदन कᳱ अविध कᳱ समाि᳙ पर या उसके प᳟ात् िवचार ᳰकया जाएगा ; ऐसा कोई ᳞िᲦ, जो ᮧाᱨप अिधसूचना मᱶ अंतᳶव᳥ ᮧ᭭तावᲂ के संबंध मᱶ कोई आᭃेप या सुझाव देने मᱶ िहतब᳍ है, इस ᮧकार िविन᳸द᳥ अविध के भीतर, के᭠ᮤीय सरकार ᳇ारा िवचार ᳰकए जाने के िलए, आᭃेप या सुझाव सिचव, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय, इंᳰदरा पयाᭅवरण भवन, जोर बाग रोड, अलीगंज, नई ᳰद᭨ली-110003 या ई-मेल पते: esz-mef@nic.in पर िलिखत ᱨप मᱶ भेज सकेगा ।
ᮧाᱨप अिधसूचना

असम रा᭔य के सोिनतपुर िजले के उᱫरी भाग मᱶ अवि᭭थत सोनाई- ᱨपाई व᭠यजीव अभयार᭛य अᱨणाचल ᮧदेश के पूवᱮ पादिगᳯर के साथ ि᭭थत है और 220 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ फैला ᱟआ है; और, इस अभयार᭛य मᱶ वन᭭पित और जीवज᭠तु कᳱ समृ᳍ जैिवकᳱय मह᭜व का ᮧितिनिध᭜व है ;

और, सोनाई ᱨपाई व᭠यजीव अभयार᭛य मᱶ आरिᭃत वनᲂ के अंतगᭅत पूवᭅ मᱶ जैसे- चारदौर, बलीपारा, नदौर, बीसवनाथ, बेहली और नमेरी रा᳦ीय उ᳒ान और पि᳟म मᱶ रोवता आरिᭃत वन एकमाᮢ पाᳯरि᭭थितक इकाई का महᱬवपूणᭅ घटक है; और, सोनाई ᱨपाई व᭠यजीव अभयार᭛य नामेरी रा᳦ीय उ᳒ान के साथ सोिनतपुर कामᱶग हाथी आरिᭃत के साथ- साथ ᮩहमपुᮢ के उᱫर तट पर महᱬवपूणᭅ संरिᭃत ᭃेᮢᲂ मᱶ से एक है और अभयार᭛य महा-शाकभᭃी के संरᭃण के िलए जाना जाता है जैसे- एᳲशयन हाथी, जंगली भैसा के साथ साथ कई मांसाहारी शािमल है जैसे – तᱶदुआ;

और, सोनाई-ᱨपाई व᭠यजीव अभयार᭛य का भू–भाग अभयार᭛य के उᱫरी भाग को छोडकर अिधकांश समतल है जहां भू – भाग ᮓमश: वधᭅमान ढाल के साथ तरंिगत होकर उᱫर कᳱ ओर जाता है। यहॉ पर चार बारहमासी नᳰदयां अथाᭅत् दोलसीरी, गभाᱨ, गेलगेली और बेलसीरी है िजसमᱶ वषाᭅ ऋतु के दौरान कई भील (आᮤᭅ भूिम) भी िव᭭ताᳯरत होती है और िमᲵी सू᭯म रेत के साथ िचकनी िमᲵी मᱶ अिधकतर ᮧकृित᭭थ होती है और आरिᭃत के अिधक भाग मᱶ सु᭭प᳥ है ᳰक भागर िनमाᭅण मᱶ िशलाखंड, बᳯटया और कंकड है और यह उᱫरी भाग मᱶ ᮧमुख है ;

और, सोनाई - ᱨपाई व᭠यजीव अभयार᭛य के अंतगᭅत वनᲂ मᱶ उ᭬णकᳳटबंधी सदाबहार, अधᭅसदाबहार बᱶत झाडी के साथ आᮤᭅ पणᭅपाती वन और नᳰदयᲂ के साथ खुले घासभूिम कᳱ संकᳱणᭅ पᲵी और उ᳒ान के घास भूिम का कुल ᭃेᮢ 10% से कम है जबᳰक ᭃेᮢ मᱶ ᮧमुख अधᭅसदाबहार और आᮤᭅ पणᭅपाती ᮧजाितयॉ और आरिᭃत के अंतगᭅत वनो के ᮧकार उपल᭣ध हᱹ, जैसे- असम घाटी उ᭬णकᳯटबंधीय सदाबहार वन, उप –िहमालय लाइट जलोढ, अधᭅ सदाबहार वन, पूवᱮ जलोढ मा᭟यिमक अधᭅ सदाबहार वन, बेत झाडी, कम जलोढ सवाना वुडलᱹड, पूवᱮ होलॉक वन, पूवᱮ मौसमी दलदल वन, पूवᱮ दी᭨लेिनया दलदल वन और पूवᱮ आᮤᭅ जलोढ घासभूिम है; और, सोनाई - ᱨपाई व᭠यजीव अभयार᭛य मᱶ मांसभᭃी और महा-शाकभᭃी कᳱ समृ᭟द िविवधता कᳱ ᮧित᳧ा है और अभयार᭛य के मु᭎य परभᭃी मᱶ तᱶदुआ और जंगली कुᱫा है और अतीत मᱶ बाघ कᳱ उपि᭭थत को ᮧितवेᳰदत ᳰकया गया था और महा-शाकभᭃी जैसे- एिशयन हाथी और भारतीय गौर अिधकांश अ᭒छी सं᭎या मᱶ पाए जाते है और अ᭠य ᮧजाितयᲂ मᱶ सांभर, काकड, पाढा, िहमालय ᳰᮓ᭭टलेस साही, क᭭तूरा, मुसंग काला भालू और रीछ अिभिलिखत है; और, सोनाई-ᱨपाई व᭠यजीव अभयार᭛य, मᱶ पᭃी जीव कᳱ िविवध ᮧजाितयां और ᳯरजवᭅ मᱶ ᳰदखाई देने वाली कुछ दुलᭅभ और संकटाप᳖ पᭃी ᮧजाितयᲂ मे सि᭥मिलत जैसे वाइट ᳲवगड वुडबᱫख, ᮕे धनेश, ओᳯरयट पाइड धनेश, वरथड धनेश, और बंगाल फलोᳯरकन ᮧा᳙ करता है । सरसृपो, उभयचरᲂ और अ᭠य अकशेᱨकᳱ कᳱ िविवधता बराबर ᮧभावशाली है;

और, सोनाई- ᱨपाई व᭠य जीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ हᱹ, पयाᭅवरण कᳱ दृि᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष᳍ करना आव᭫यक है ; अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, असम रा᭔य मᱶ सोनाई- ᱨपाई व᭠य जीव अभयार᭛य कᳱ सीमा से चारᲂ ओर 5.0 ᳰकलोमीटर तक के िव᭭ ताᳯरत ᭃेᮢ को सोनाई- ᱨपाई व᭠यजीव अभयार᭛य पाᳯरि᭭ थितकᳱय संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया है) के ᱨप मᱶ अिधसूिचत करती है, िजसका िववरण िन᳜ानुसार है, अथाᭅत् :--

1. पाᳯरि᭭थितक संवेदी जोन का िव᭭तार और उसकᳱ सीमाएं-1. सोनाई- ᱨपाई व᭠यजीव अभयार᭛य कᳱ पि᳟मी, दिᭃणी और पूवᱮ ᳰदशा के इदᭅ िगदᭅ 5.0 ᳰकलोमीटर तक के िव᭭तार का होगा, व᭠यजीव अभयार᭛य कᳱ उᱫरी सीमा असम और अᱨणाचल ᮧदेश के अंत:रा᭔य सीमा के बीच है । पाᳯरि᭭थितक संवेदी जोन के अंतगᭅत आने वाली ᮕामᲂ कᳱ सूची उपाबंध I मᱶ दी गई है । सोनाई-ᱨपाई व᭠यजीव अभयार᭛य के िनदᱷशांक उपाबंध I क मᱶ ᳰदए गए है |
2. सोनाई-ᱨपाई व᭠यजीव अभयार᭛य कᳱ सीमा के साथ साथ िब᭠दुᲐ के जीपीएस िनदᱷशांक उपाबंध II के ᱨप मᱶ उपाब᳍ है |
3. पाᳯरि᭭ थितक संवेदी जोन का मानिचᮢ के साथ सीमा के ᭣यौरे और अᭃांश तथा देशांतर उपाबंध III के ᱨप मᱶ उपाब᳍ है ।
4. पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से, इस अिधसूचना मᱶ संल᭏ न अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी । (2) आंचिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
   (3) पाᳯरि᭭ थितक संवेदी जोन के िलए आंचिलक महायोजना, रा᭔ य सरकार ᳇ारा इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप मᱶ ऐसी रीित मᱶ तथा सुसंगत कᱶᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य मᱶ भी तथा कᱶᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷश, यᳰद कोई हᲂ, ᳇ारा तैयार होगी । (4) आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक िवचारᲂ को समाकिलत करने के िलए रा᭔ य सरकार के सभी संब᳍ िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत्:-- (i) पयाᭅवरण; (ii) वन;
   (iii) शहरी िवकास; (iv) पयᭅटन; (v) नगरपािलका; (vi) राज᭭ व;
   (vii) कृिष;
   (viii) असम रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ; (ix) ᳲसचाई; और
   (x) लोक िनमाᭅण िवभाग । (5)
   आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।
   (6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान देना आव᭫यक है, के िलए उपबंध हᲂगे । (7)
   आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोधान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।

आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करने के िलए, पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।
(9) असम रा᭔य सरकार अपनी अिधकाᳯरता के अधीन ᭃेᮢ के िलए आंचिलक महायोजना पृथक् ᱨप से तैयार करेगी। 3. रा᭔य सरकार ᳇ारा ᳰकए जाने वाले उपाय -- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत्:- (1) भू-उपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा:
परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन ᮓम सं0 13, 25, 33, 39 और 40 के सामने सूचीब᳍ ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी अिधभोग के िलए पाᳯरि᭭ थितक अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद ; (ii) िव᳒मान सड़कᲂ को चौड़ा करना और सुदृढ़ बनाना; (iii) ᮧदूषण काᳯरत न करने वाले लघु उ᳒ोग;
(iv) वषाᭅ जल संचयन; और (v) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग, सुिवधा भंडार और ᭭ थानीय सुिवधाएं भी हᱹ। परंतु यह और ᳰक जनजातीय भूिम का उपयोग रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए अनु᭄ात नहᱭ होगा :
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को देनी होगी ।
परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा ।
परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयुᲦ या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोतᲂ - आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष᳍ करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे । (3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप पयᭅटन महायोजना के अनुसार हᲂगे जो ᳰक आंचिलक महायोजना के भाग ᱨप मᱶ होगी ।
(ख) पयᭅटन महायोजना पयᭅटन िवभाग, रा᭔य सरकार के राज᭭ व और वन िवभाग के परामशᭅ से तैयार होगी ।
(ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-

(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶᮤ सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िस᳍ांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िस᳍ांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व देते ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(ii) पाᳯरि᭭थितक अनुकूल पयᭅटक ᳰᮓयाकलापᲂ के संबंध मᱶ अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय सोनाई-ᱨपाई व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर भीतर होटल और ᳯरसोटᲄ का नया संिनमाᭅण अनु᭄ात नहᱭ होगा ; (iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा । (4) नैसᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । (5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदूषण - पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदूषण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग, या असम रा᭔य सरकार के ᮧदूषण िनयंᮢण बोडᭅ, वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।
(7) वायु ᮧदूषण - पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदूषण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग, या असम रा᭔य सरकार के ᮧदूषण िनयंᮢण बोडᭅ,वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण -पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, जल (ᮧदूषण िनवारण तथा िनयंᮢण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा । (9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा - (i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख
8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ; (ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा ।

(10) जैव िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना िज.एस. आर 343 (अ)
तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा । (11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होने तक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी । (12) औ᳒ोिगक इकाईयां –
(क) ᮧ᭭ तािव त पाᳯरि᭭थितक संवेदी जोन मᱶ िव िध के अनुसार ᭭ थािप त िव ᳒मान का᭬ ठ आधाᳯर त उ᳒ोगᲂ के िस वाए नए का᭬ ठ आधाᳯर त उ᳒ोगᲂ कᳱ ᭭ थापना को अनु᭄ात नहᱭ ᳰक या जाएगा । (ख) जल, वायु, मृदा, ᭟ विन ᮧदूषण काᳯर त करने वाले ᳰक सी नए उ᳒ोग कᳱ ᮧ᭭ तािव त पाᳯरि᭭थितक संवेदी जोन मᱶ ᭭ थापना को अनु᭄ात नहᱭ ᳰक या जाएगा । 4. पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧितिष᳍ और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सूची - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ और त᳍ीन बनाए गए िनयमᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत् :-- सारणी ᮓम सं. ᳰᮓयाकलाप टीका-ᳯट᭡पणी (1) (2) (3) ᮧितिष᳍ ᳰᮓयाकलाप
(1) वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़ने कᳱ इकाइयां ।
(क) सभी नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर कᳱ खानᱶ और उनको तोड़ने कᳱ इकाइयां वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ िजसमᱶ िनजी उपयोग के िलए मकानᲂ के संिनमाᭅण या मर᭥ मत के िलए भूिम को खोदना और मकान बनाने के िलए देशी टाइ᭨ स या ᲊटᲂ का िनमाᭅण करना भी सि᭥ मिलत है, के िसवाय नहᱭ हᲂगी ; (ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदेश तारीख 4 अग᭭त 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदेश के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।
(2) आरा मीलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा मीलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(3) ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । (4) जल या वायु या मृदा या ᭟ विन ᮧदूषण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना ।
पाᳯरि᭭थितक संवेदी जोन के भीतर नए और िव᳒मान ᮧदूषण काᳯरत करने वाले का िव᭭ तार अनु᭄ात नहᱭ होगा । (5) नई बृहत जल िव᳒ुत पᳯरयोजनाᲐ कᳱ ᭭थापना । (6) जलावन लकड़ी का वािणि᭔यक उपयोग । (7) मोबाईल टावरᲂ कᳱ ᭭थापना।

(8) बडे पैमाने पर ᮕीन हाउसᲂ और अ᭠य वािणि᭔यक कृिष और उ᳒ान कृिष, उ᳒म कᳱ ᭭थापना। लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । तथािप ᭭थानीय ᳰकसानᲂ ᳇ारा छोटे पैमाने पर पहल लागू िविधयᲂ के अनुसार लागू कᳱ जा सकेगी । (9) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । (10) नए या िव᳒ामान भᲵᲂ कᳱ ᭭थापना । (11) गोला बाᱨद िडपो/ᭃेपण/ गोलाबारी ᭃेᮢ कᳱ ᭭थापना ।

(12) बडे वािणि᭔यक पशुधन/कु᭍कुट/फामᲃ/ खूंᳯटयᲂ (पशु िशिवर या िवदेशी पशुᲐ वाले फामᲃ कᳱ ᭭थापना । िविनयिमत ᳰᮓयाकलाप (13) होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना । पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक इनमᱶ जो भी िनकट है, नये वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगे।

परंतु, जहाँ पाᳯरि᭭थितक संवेदी जोन का िव᭭तार एक ᳰकलोमीटर से ᭔यादा है वहाँ, एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटक ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलाप का िव᭭तार पयᭅटन महायोजना और रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण के अनुसार होगा। (14) पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा रा᭬ ᮝीय उ᳒ान ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

(15) संिनमाᭅण ᳰᮓयाकलाप।
(क) संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक इनमᱶ जो भी िनकट है, के भीतर ᳰकसी भी ᮧकार का नया वािणि᭔ यक संिनमाᭅण अनु᭄ात नहᱭ होगा: परंतु ᭭ थानीय ᭪ यि᭍ तयᲂ को अपने आवासीय उपयोग, िजसके अंतगᭅत पैरा 3 के उपपैरा (1) मᱶ सूचीब᳍ ᳰᮓयाकलाप भी हᱹ, के िलए अपनी भूिम पर संिनमाᭅण करने कᳱ अनुमित होगी । ऐसे लघु उ᳒ोगᲂ जो ᮧदूषण उ᭜ प᭠ न नहᱭ करते हᱹ, से संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही ᭠ यूनतम पर रखे जाएंगे ।
पर᭠तु, जहाँ एक ᳰकलोमीटर से आगे और पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक वा᭭ तिवक ᭭ थानीय आव᭫ यकताᲐ के िलए संिनमाᭅण कᳱ अनु᭄ा दी जाएगी और अ᭠ य वािणि᭔ यक संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनुᱨप हᲂगे।
(16) ᮝेᳲ᭠चग ᮕाउंड । नए ᮝेᳲ᭠ चग ᮕाउंड कᳱ ᭭ थापना ᮧितिष᳍ है । पुराने ᮝेᳲ᭠ चग ᮕाउंड को लागू िविधयᲂ के अनुसार िविनयिमत ᳰकया जाएगा ।
(17) ᮧाकृितक जल िनकायᲂ मᱶ बिह᮲ाᭅव और ठोस अपिश᭬ ट का िन᭭सारण । (18) वायु और यािनक ᮧदूषण । (19) ᭟ विन ᮧदूषण ।

(20) भूिमगत जल का िन᭬ कषᭅण। (21) वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
(ग) आरिᭃत वनᲂ और संरिᭃत वनᲂ कᳱ दशा कायᭅयोजना मᱶ ᳰदए गए िववरण का अनुसरण ᳰकया जाएगा ।
(22) ᮧवासी चारवाहे।
(23) ᭡लाि᭭टक बैगᲂ का उपयोग/᳞यन । (24) िव᳒ुत लाईनᲂ का इ᭠सुलेशन भूिमगत केबल डालने का संवधᭅन ᳰकया जाएगा। सभी िव᳒मान िव᳒ुत लाईनᱶ जो पाᳯरि᭭थितक संवेदी जोन से होकर गुजरती हᱹ, को आंचिलक महायोजना के अधीन िविहत समय सूची मᱶ पयाᭅ᳙ ᱨप से इ᭠सुलेट ᳰकया जाएगा। (25) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदृढ करना । यथा लागू उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपायᲂ के साथ ᳰकया जाएगा । (26) होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड़ लगाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । पाᳯरि᭭ थितक संवेदी जोन के भीतर व᭠ यजीव के मु᭍ त संचरण के िलए, होटल या अ᭠ य वािणि᭔ यक ᭭ थापना अपनी संपिᱫयᲂ को कंटीले तार से घेराबंदी नहᱭ करᱶगे और कोई भी घेराबंदी 1 मीटर से ऊंची नहᱭ होगी । इस अनुबंध का पालन न करने वाले ᳰकसी िव᳒मान घेराबंदी को आंचिलक महायोजना मᱶ वᳶणत समय- सीमाᲐ के अनुसार उपांतᳯरत ᳰकया जाएगा । (27) कृिष ᮧणािलयᲂ मᱶ ᮧबल पᳯरवतᭅन
(28) ᮧाकृितक जल संसाधनᲂ का वािणि᭔यक उपयोग, िजसके अंतगᭅत भू-जल संचयन भी है । (29) रािᮢ मᱶ यािनक पᳯरवहन का संचलन । (30) िवदेशी ᮧजाितयᲂ का ᮧारंभ । (31) साइनबोडᭅ और होᳺडग । (32) पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । कोई संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अधीन तब तक अनु᭄ात नहᱭ ᳰकया जाएगा जब तक 1 से 10 से अिधक पहाड़ी ढलानᲂ पर और ᳰकसी नदी के तटᲂ से 100 मीटर तक और ᮧाकृितक नाले को बनाने कᳱ कारᭅवाई नहᱭ कर ली जाए ।
(33) ᮧदूषण काᳯरत न करने वाले लघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन से गैर ᮧदूषण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत देशीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग और जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते हᱹ, अनु᭄ात ᳰकए जाएंगे ।
(34) ठोस अपिश᳥ ᮧबंधन । (35) पाᳯरि᭭थितक-पयᭅटन । संवᳶधत ᳰᮓयाकलाप (36) ᭭थानीय समुदायᲂ ᳇ारा चलाई जा रहे कृिष और बागवानी ᳞वसायᲂ के साथ पशुपालन, पशुपालन कृिष, जल कृिष और मछली पालन।
सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।

(37) जैिवक खेती । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । (38) सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना ।
सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । (39) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर भी हᱹ । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । (40) वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
(41) नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । (42) कृिष वािनकᳱ । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । (43) कौशल िवकास । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । (44) पयाᭅवरणीय जागᱧकता । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । (45) समुदाय ᮧकृित भंडार। सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । 5. मानीटरी सिमित- (1) कᱶᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :-

1. संब᳍ िजला कले᭍टर - अ᭟यᭃ ;
2. पाᳯरि᭭ थितक और पयाᭅवरण के ᭃेᮢ मᱶ एक िवशेष᭄, जो तीन वषᭅ कᳱ अविध के िलए असम सरकार ᳇ारा नामिन᳸द᭬ ट ᳰकया जाए – सद᭭ य;
3. गैर सरकारी संगठन (पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाला िजसके अंतगᭅत िवरासत संरᭃण भी है) का एक ᮧितिनिध जो तीन वषᭅ कᳱ अविध के िलए रा᭔य सरकार ᳇ारा नामिन᳸द᳥ ᳰकया जाए – सद᭭ य;
4. ᭃेᮢीय अिधकारी, असम रा᭔य ᮧदूषण िनयंᮢण बोडᭅ – सद᭭ य;
5. रा᭔य जैव-िविवधता बोडᭅ का सद᭭य

-सद᭭य; 6. संब᳍ ᮧभागीय वन अिधकारी ᭃेᮢीय – सद᭭ य सिचव । 6. िनदᱷश िनबंधन
(1) मानीटरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी । (2) मानीटरी सिमित का कायᭅकाल तीन (3) वषᭅ का होगा। (3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन सारणी के ᭭ त᭥ भ (3) मᱶ िविन᳸द᭬ ट ᮧितिष᳍ गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।
(4) इस अिधसूचना के पैरा 4 के अधीन सारणी के ᭭ त᭥ भ (3) मᱶ यथा िविन᳸द᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं᭎यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया है, परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते हᱹ, ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब᳍ िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।

(5) मानीटरी सिमित का सद᭭य-सिचव या संब᳍ कल᭍टर या संबंिधत उ᳒ान का भारसाधक, ऐसे ᳞िᲦ के िवᱧ᳍, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता है, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा । (6) मानीटरी सिमित मु᳎ᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब᳍ पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी । (7) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मु᭎य व᭠य जीव वाडᭅन को उपाबंध IV मᱶ उपबंिधत ᱨप मᱶ उ᭍ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी । (8) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदेश दे सकेगा, जो वह ठीक समझे । 7.
इस अिधसूचना के उपबंधᲂ को ᮧभाव देने के िलए कᱶᮤीय सरकार और रा᭔ य सरकार अितᳯर᭍ त उपाय, यᳰद कोई हᲂ, िविन᳸द᭬ ट कर सकᱶगे ।

AND WHEREAS, the flora and fauna represent rich biological significance of this Sanctuary; And whereas, the Sonai-Rupai Wildlife Sanctuary forms an important component of a single ecological unit comprising of reserve forests such as Charduar, Balipara, Naduar, Biswanath, Behali and Nameri National Park in the east and Rowta reserve forest in the west; AND WHEREAS, Sonai-Rupai Wildlife Sanctuary together with Nameri National Parks is part of Sonitpur Kameng Elephant Reserve as well as one of the important protected areas on the North Bank of the Brahmaputra and the sanctuary is known for conservation of mega-herbivores such as Asian Elephant,
Indian Bison as well as several carnivores including leopard; And whereas, the terrain of Sonai-Rupai Wildlife Sanctuary is largely plain except the northern side of the sanctuary where the terrain is undulating with slope increasing gradually towards the north. here are four perennial rivers namely, Dolsiri, Gabharu, Gelgeli and Belsiri and during the rainy season, several bheels (wetlands) also come into existence and the soils are mostly composed of clay loam with fine sand and the Bhabar formation consisting of boulders, cobbles and gravels is noticeable in most part of the reserve and it prominent in the northern part; AND WHEREAS, the Sonai-Rupai Wildlife Sanctuary forests comprise of tropical evergreen, semi- evergreen, moist deciduous forests with cane brakes and narrow strips of open grassland along rivers and grassland comprise less than 10% of the total area of the park while the semi-evergreen and moist deciduous species dominate the area and the forest types available within the reserve are: Assam Valley Tropical Evergreen Forests, Sub Himalayan Light Alluvial Semi- Ever- green Forests, Eastern Alluvial Secondary Semi Evergreen Forests, Cane Brakes, Low Alluvial Savanna Woodland, Eastern Hollock Forests, Eastern Seasonal Swamp Forests, Eastern Dillenia Swamp Forests and Eastern Wet Alluvial Grassland;
AND WHEREAS, the Sonai-Rupai Wildlife Sanctuary boasts of rich diversity of carnivores and mega- herbivores and the main predators of the sanctuary are leopard and wild dog and in the past tiger presence was reported and the mega herbivores like Asian elephant and Indian Gaur do occur at fairly good numbers and the other species recorded are sambar, barking deer, hog deer, Himalayan Crestless porcupine, Large Indian Civet, Small Indian Civet, Black bear and Sloth bear; AND WHEREAS, the Sonai-Rupai Wildlife Sanctuary also possess diverse species of avifauna and some of the rare and endangered bird species sighted in the reserve includes white winged wood duck, Great Hornbill, Oriental Pied Hornbill, Wreathed Hornbill and Bengal Florican. Equally impressive is the diversity of reptiles, amphibians and other invertebrates;

AND WHEREAS, it is necessary to conserve and protect the area surrounding the protected area of Sonai Rupai Wildlife Sanctuary as Eco-Sensitive Zone from ecological, environmental and biodiversity point of view; NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby
notifies an area with an extent upto 5.0 kilo mts. around the boundary of Sonai Rupai Wildlife Sanctuary in the State of Assam as the Sonai Rupai Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone shall be of an extent upto 5.0 km around the western, southern and eastern side of the Sonai Rupai Wildlife Sanctuary, Northern boundary of Wildlife Sanctuary is the Interstate border between Assam and Arunachal Pradesh. The list of villages falling in the in Eco-Sensitive Zone is given at Annexure-I. Co-ordinates of Sonai Rupai Wildlife Sanctuary is given at Annexure-I A.
2. The GPS Co-ordinates of points along the boundary of Sonai Rupai Wildlife Sanctuary are given at Annexure-II. 3. The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-III. 2.
Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The said Plan shall be approved by the Competent Authority in the State Government. (3) The said Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The said Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment;
(ii) Forest;
(iii) Urban Development; (iv) Tourism;
(v) Municipal;
(vi) Revenue; (vii) Agriculture; (viii) Assam State Pollution Control Board; (ix) Irrigation; and (x) Public Works Department. (5)
The said Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The said Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention.

(7) The said Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green areas, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The said Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco- friendly development for livelihood security of local communities. (9)
The State Government of Assam shall prepare separate Zonal Master Plans for area under their jurisdiction. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1)
Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities at serial numbers 13, 25, 33, 39 and 40 in column (2) of the table in paragraph 4, namely:- (i)
Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities; (ii)
widening and strengthening of existing roads and construction of new roads; (iii)
small scale industries not causing pollution; (iv)
rainwater harvesting; and
(v)
cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance to the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change. Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2)
Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3)
Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by the Department of Tourism, in consultation with Department of Forests and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i)
all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;

(ii)
new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Sonai Rupai Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities; (iii)
till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4)
Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, arte facts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Assam State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder. (7)
Air pollution.- The Environment Department of the State Government or Assam State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco- sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under.
(8) Discharge of effluents.- The discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made there under. (9)
Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non- biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco- sensitive Zone. (10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time. (11)
Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the law.

(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted.
4.
List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the table below, namely:-

Union of India in Writ Petition (Civil) No.202 of 1995 and order of the Hon’ble Supreme Court, dated the 21st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.435 of 2012. 2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws. 4. Setting up of industries causing water or air or soil or noise pollution. No new or expansion of polluting industries in the Eco- sensitive Zone shall be permitted.
5. Establishment of new major thermal and hydro-electric projects. applicable laws. 6. Commercial use of firewood. applicable laws. 7. Setting up of mobile communication towers. applicable laws. 8. Establishment of large scale green houses and other commercial agriculture/horticultural ventures. applicable laws. However initiatives on small scale by local farmers may be permitted as per applicable laws. 9. Discharge of untreated effluents and solid waste in natural water bodies or land area. applicable laws. 10. Establishment of new or expansion of existing brick kilns. applicable laws. 11. Establishment of ammunition depot/dump/firing range. applicable laws. 12. Establishment of large scale commercial live stock/poultry farms/khuties (cattle camps) or farms with exotic animals. applicable laws. Regulated Activities 13. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area

or the boundary of Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities.
However, beyond one kilometer and upto the extent of the Eco-sensitive Zone all new tourism activities or expansion of existing activities would in conformity with the Tourism Master Plan. 14.

Undertaking activities related to tourism like over-flying the national park area by aircraft, hot air balloons. Regulated under applicable laws. 15. Construction activities.

(a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the protected area or the boundary of Eco-sensitive Zone whichever is nearer. Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3. Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum with the prior permission from the competent authority as per applicable rules and regulations, if any. Further, beyond one kilometer upto the extent of Eco- sensitive Zone construction for bone fide local needs shall be allowed and other construction activities shall be regulated as per Zonal Master Plan.
16. Trenching ground. Establishing of new trenching ground is prohibited. Old trenching grounds are to be regulated under applicable laws. 17. Discharge of treated effluents and solid waste in natural water bodies or land area. 18. Air and vehicular pollution. 19. Noise pollution. 20. Extraction of ground water. 21. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government;
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder. (c) In case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed. 22. Migratory graziers. Regulated under applicable laws and as per Zonal Master Plan.
23. Use/disposal of plastic bags.
24. Insulation of electric lines. Promote underground cabling. All existing electric lines passing through the Eco-sensitive Zone shall be adequately insulated in the time frame prescribed under the Zonal Master Plan.
25. Widening and strengthening of existing roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.

5.  Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for 
   

effective monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely: i) Concerned district Collector

        - Chairman 

ii) An expert in the area of ecology and environment

-Member to be nominated by the Government of Assam
for a period of three years.
iii) One representatives of non-Governmental Organisation
-Member (working in the field of environment including heritage 26. Fencing of existing premises of hotels and lodges. In order to allow free movement of wildlife, hotels or other commercial establishments within the Eco-sensitive Zone shall not fence their properties with barbed wire and no fence shall be higher than 1 meter. Any existing fence not complying with this stipulation shall be modified as per the time lines mentioned in the Zonal Master Plan. 27. Drastic change of agriculture system. 28. Commercial use of natural water resource including ground water harvesting. 29. Movement of vehicular traffic at night. 30. Introduction of exotic species. 31. Sign Board and hoardings. 32. Protection of hill slopes and river banks. No construction activity unless otherwise permitted under the Zonal Master Plan shall be undertaken on the hill with slopes more than 1 to 10 and also upto 100 meters from the banks of any river, and natural nallah. 33. Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro- based industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.

Terms of Reference.- (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Committee shall be three years. (3) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 but are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned district Collector or the concerned park in-charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6)
The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per pro forma given in Annexure IV. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7.
The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
