पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय अिधसूचना नई ᳰद᭨ली, 25 जुलाई, 2016 का.आ. 2639(अ).—िन᳜िलिखत अिधसूचना का ᮧाᱧप, िजसे के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पᳯठत उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, जारी करने का ᮧ᭭ताव करती है, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) कᳱ अपेᭃानुसार, जनसाधारण, िजनके उससे ᮧभािवत होने कᳱ संभावना है, कᳱ जानकारी के िलए, ᮧकािशत कᳱ जाती है ; और यह सूचना दी जाती है ᳰक उᲦ ᮧाᱨप अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना को अंतᳶव᭬ ट करने वाले भारत के राजपᮢ कᳱ ᮧितयां जनसाधारण को उपल᭣ध करा दी जाती हᱹ, साठ ᳰदन कᳱ अविध कᳱ समाि᳙ पर या उसके प᭫ चात् िवचार ᳰकया जाएगा ; ऐसा कोई ᳞िᲦ, जो ᮧाᱨप अिधसूचना मᱶ अंतᳶव᳥ ᮧ᭭तावᲂ के संबंध मᱶ कोई आᭃेप या सुझाव देने मᱶ िहतब᳍ है, इस ᮧकार िविन᳸द᳥ अविध के भीतर, के᭠ᮤीय सरकार ᳇ारा िवचार ᳰकए जाने के िलए, आᭃेप या सुझाव सिचव, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय, इंᳰदरा पयाᭅवरण भवन, जोर बाग रोड, अलीगंज, नई ᳰद᭨ली-110003 या ई-मेल पते: esz-mef@nic.in पर िलिखत ᱨप मᱶ भेज सकेगा ।
ᮧाᱨप अिधसूचना ईगल ने᭭ट व᭠यजीव अभयार᭛य, अᱨणाचल ᮧदेश के पि᳟म कमᱶग िजले मᱶ अवि᭭थत है और वह 217 वगᭅ ᳰकलोमीटर फैला ᱟआ है| ᭃेᮢ मᱶ सि᭥मिलत वन कᳱ ᳞ापक ᳰक᭭म उ᭬णकᳯटबंधी और उप-सदाहᳯरत, उपो᭬ण कᳯटबंधी चौडे पᱫᲂ वाला वन तथा उपशीतो᭬ण चौडे पᱫे वाला वन है ।
और, यह अभयार᭛ य ᮧचुर वन᭭पित और जीवजंतु के जैिवक मह᭜ व का ᮧितिनिध ᭜ व करता है। और, मु᭎ य वृᭃ ᮧजाितयᲂ मᱶ टेरमीनािलया माइᳯरयोकारपा, अ᭨ टी निजया ए᭍ सेलसा, सी᭠ नामोमुम ᭭ पा, मगनोिलया ᭭ पा, कानाᳯरयम ᭭ ᮝीट᭍ टम, टेरमीनािलया बे᭨ लेरीका, बै᭥ बे᭍ स, साईबा, का᭭ टानोपसीस इंिडकम, मेसुआ फेराᭅ, फोबे गोलपरेनसीस, और बांस ᮧजाितयᲂ मᱶ डेनᮟोकलामस हमीलटो᭠ नी, पसेउडो᭭ᮝाकयम, पोलीमोरᳰफयम, नड मᱶ कालामस, फलोरीबुनदस, सी फलागेलयम, आᳰद सि᭥म िलत है।

और, कुछ मु᭎ य ᭭ तनधारी ᮧजाितयᲂ मᱶ इलेकस म᭍ सीमस, पᱶथर टाइगरीस, पᱶथरा परदेस, िनयोफेलीस ने बुलासा, उरसस, थीबेटनस, अलीउरस, फलगेनस्, ᮝैकहापीथेसस पीलेट, सेरबस यूिनकोलर, मुनᳯटयाकस मुनटजक, नैमोमेदस गोरल, कौन अलपेिनस आᳰद सि᭥म िलत है। बृहत पᭃी जीवजंतु के अंतगᭅत बेबलर, चील, फलाईकैचर, जंगली मुगᱮ, कौिड᭨ ला, लाᳰफग ᮣश, मीिवट, नाइटर, नुथाचस् आᳰद है। सरीसृप जीवजंतु मᱶ ᭔ यादातर मᱶढक बुफो ᭭ पा दुᲵाफाइरनस ᭭ पा, हएला ᭭ पा, मेगोफाइरस ᭭ ᭡ पा, आᳰद और सरीसृपो मᱶ िछपकली – कलोटेस ᭭ पा, जपलुरा ᭭ पा , हेमीदा᭍ टायलस ᭭ पा, वारानस ᭭ पा, ि᭭क᭠ स इयोटरोफᳱस ᭭ पा, लाइगासोमा ᭭ पा, सांपो मᱶ रामफोटाइफाइलापस ᭭ पा, पाइथन ᭭ पा, अिहयाटु᭨ ला ᭭ पा, अमᳰफयासमा ᭭ पा, कछुआ कौरा ᭭ पा, पंगशौरा ᭭ पा पाए जाते है। जलीय िनकायो मᱶ िव िभ ᭠ न मछिलयᲂ दािनयᲂ ᭭ पा, बरीिलयस ᭭ पा, सेमीपलाटस ᭭ पा, पुनᳯटयस ᭭ पा, टोर स᭡ पा,चागुिनयस ᭭ पा, गराᭅ ᭭ पा,िलयोमाचेिलयस ᭭ पा, गलयपटोथोरेक् ᭭ पा आᳰद का वास ᭭ थान है। और, ईगल ने᭭ट व᭠यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ हᱹ, पयाᭅवरण कᳱ दृि᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष᳍ करना आव᭫यक है; अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उप धारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, अᱨणाचल ᮧदेश रा᭔य मᱶ ईगल ने᭭ट व᭠यजीव अभयार᭛य कᳱ सीमा से 500 मीटर तक के िव᭭ ताᳯरत ᭃेᮢ को ईगल ने᭭ट व᭠यजीव अभयार᭛य पाᳯरि᭭थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭थितक संवेदी जोन कहा गया है) के ᱨप मᱶ अिधसूिचत करती है, िजसका िववरण िन᳜ानुसार है, अथाᭅत् :--

1. पाᳯरि᭭थितक संवेदी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) पाᳯरि᭭थितक संवेदी जोन का िव᭭तार ईगल ने᭭ट व᭠यजीव अभयार᭛य के उᱫर पूवᱮ और उᱫर पि᳟म भाग के चारो और 100 मीटर तथा संरिᭃत ᭃेᮢ कᳱ दिᭃणी सीमा के चारो ओर 500 मीटर के िव᭭तार के साथ 23.12 वगᭅ ᳰकलोमीटर के ᭃेᮢ तक होगा। (2) पाᳯरि᭭थितक संवेदी जोन के भीतर आने वाले तीन ᮕामᲂ कᳱ सूची उपाबंध I के ᱨप मᱶ उपाब᳍ है । ईगल ने᭭ट व᭠यजीव अभयार᭛य और पाᳯरि᭭थितक संवेदी जोन के जीपीएस िनदᱷशांक िब᭠दु उपाबंध II के ᱨप मᱶ उपाब᳍ है | (3) पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा के साथ उसका मानिच ᮢ और इसके अᭃांश और देशा᭠तर उपाबंध III के ᱨप मᱶ उपाब᳍ है |
2. पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧयोजनᲂ के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से, और इस अिधसूचना मᱶ ᳰदए गए अनुबंधᲂ का पालन करते ᱟए आंचिलक महायोजना तैयार करेगी । (2) आचंिलक महायोजना का अनुमोदन रा᭔य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा ᳰकया जाएगा | (3) पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना रा᭔य सरकार ᳇ारा ऐसी रीित जैसा इस अिधसूचना मᱶ िविन᳸द᳥ है और सुसंगत के᭠ᮤीय और रा᭔य िविधयᲂ तथा के᭠ᮤीय सरकार ᳇ारा जारी मागᭅदशᭅक िस᳍ांतᲂ, यᳰद कोई हो, के अनुᱨप भी तैयार कᳱ जाएगी | (4) आंचिलक महायोजना सभी संब᳍ रा᭔य िव भागᲂ के साथ परामशᭅ से पयाᭅवरणीय और पाᳯरि᭭थितक िवचारणᲂ को उसमᱶ एकᳱकृत करने के िलए तैयार कᳱ जाएगी,अथाᭅत्:-- (i) पयाᭅवरण ; (ii) वन ;
   (iii) नगर िवकास ; (iv) पयᭅटन ; (v) नगरपािलक ; (vi) राज᭭ व ;
   (vii) कृिष ;
   (viii) अᱨणाचल ᮧदेश रा᭔य ᮧदूषण िनयंᮢण बोडᭅ ;

(ix) ᳲसचाई; (x) लोक िनमाᭅण िवभाग; (5)
आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान देना आव᭫यक है, के िलए उपबंध हᲂगे । (7)
आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोधान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी । (8)
आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करने के िलए, पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जाने वाले उपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :- (1) भू-उपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन के अधीन मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद सं0 12, 23, 34, 40 और 41 के सामने सूचीब᳍ ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭थितक अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद ; (ii) िव᳒मान सड़कᲂ को चौड़ा और सुदृढ़ करना ; (iii) ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग; (iv) वषाᭅ जल संचय ; और (v) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग, सुिवधा भंडार और ᭭थानीय सुिवधाएं सि᭥मिलत हᱹ | परंतु यह और ᳰक जनजातीय भूिम का उपयोग रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए अनु᭄ात नहᱭ होगा :
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना कᱶᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को देनी होगी ।
परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा ।
परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु᭍ त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।

(2) ᮧाकृितक जल ᮲ोतᲂ - आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष᳍ करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे । (3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप पयᭅटन महायोजना के अनुसार हᲂगे जो ᳰक आंचिलक महायोजना के भाग ᱨप मᱶ होगी ।
(ख) पयᭅटन महायोजना पयᭅटन िवभाग ᳇ारा रा᭔ य सरकार के वन और पयाᭅवरण िवभाग के परामशᭅ से तैयार कᳱ जाएगी ।
(ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :- (i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶᮤ सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िस᳍ांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िस᳍ांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व देते ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(ii) पयᭅटकᲂ के अ᭭ थायी िनवास के िलए आवासन के िसवाय पाᳯरि᭭थितक संवेदी जोन के भीतर होटल और ᳯरसोटᭅ के नए संिनमाᭅण ईगल ने᭭ट व᭠यजीव अभयार᭛य कᳱ सीमा के 1 ᳰकलोमीटर के भीतर अनु᭄ात नहᱭ हᲂगे । (iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकाᳯरयᲂ ᳇ारा अनु᭄ात ᳰकया होगा । (4) नैसᳶगक िवरासत - पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । (5) मानव-िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदूषण - पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदूषण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या अᱨणाचल ᮧदेश रा᭔य ᮧदूषण िनयंᮢण बोडᭅ, वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।
(7) वायु ᮧदूषण - पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदूषण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग या अᱨणाचल ᮧदेश रा᭔य ᮧदूषण िनयंᮢण बोडᭅ, वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण - पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण जल (ᮧदूषण िनवारण तथा िनयंᮢण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा । (9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा - (i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ; (ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;

(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ
होगा ।
(10) जैव िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना जी.एस.आर 343 (अ) तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा । (11) यानीय यातायात - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होने तक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर
करेगी । (12) औ᳒ोिगक इकाईयां-
(क) ᮧ᭭ तािव त पाᳯरि᭭थितक संवेदी जोन मᱶ िव िध के अनुसार ᭭ थािप त िव ᳒मान का᭬ ठ आधाᳯर त उ᳒ोगᲂ के िस वाए नए का᭬ ठ आधाᳯर त उ᳒ोगᲂ कᳱ ᭭ थापना को अनु᭄ात नहᱭ ᳰक या जाएगा । (ख) जल, वायु, मृदा, ᭟ विन ᮧदूषण काᳯर त करने वाले ᳰक सी नए उ᳒ोग कᳱ ᮧ᭭ तािव त पाᳯरि᭭थितक संवेदी जोन मᱶ ᭭ थापना को अनु᭄ात नहᱭ ᳰक या जाएगा । 4. पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧितिष᳍ और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सूची - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत् :-

(क) सभी नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर उ᭜खनन और उनको तोड़ने कᳱ इकाइयां ᮧितिष᳍ हᱹ, िसवाय िनवािसयᲂ कᳱ वा᭭तिवक घरेलू आव᭫यकताᲐ के नहᱭ हᲂगी, िजसके अंतगᭅत गृहᲂ के संिनमाᭅण या मर᭥ मत के िलए िमᲵी कᳱ खुदाई और ᭪ यि᭍ तक उपभोग के िलए गृहᲂ के िनमाᭅण के िलए देशी टाइलᲂ या ᲊटᲂ का संिनमाᭅण भी है । (ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदेश तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदेश के अनुसरण मᱶ सवᭅदा ᮧचालन होगा । (2)
आरा मीलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा मीलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(3)
ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠यथा उपबंिधत के िसवाय) । (4)
जल या वायु या मृदा या ᭟ विन ᮧदूषण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नए और िव᳒मान ᮧदूषण काᳯरत करने वाले का िव᭭ तार अनु᭄ात नहᱭ होगा । (5)
नई बृहत ताप और जल िव᳒ुत पᳯरयोजना कᳱ ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) ।

जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । (7)

ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । (10) नᳰदयᲂ का िवषाᲦᳱकरण । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । (11) िव᭭फोटकᲂ का उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । िविनयिमत ᳰᮓयाकलाप (12) होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना । पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक इनमᱶ जो भी िनकट है, नये वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगे। परंतु, जहाँ पाᳯरि᭭थितक संवेदी जोन का िव᭭तार एक ᳰकलोमीटर से ᭔यादा है वहाँ, एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटक ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलाप का िव᭭तार पयᭅटन महायोजना के अनुसार होगा। (13) संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर तक या पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक इनमᱶ जो भी िनकट है, के भीतर ᳰकसी भी ᮧकार का नया वािणि᭔ यक संिनमाᭅण अनु᭄ात नहᱭ होगा:
परंतु ᭭ थानीय ᭪ यि᭍ तयᲂ को उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण िजसके अंतगᭅत पैरा 3 के उपपैरा (1) मᱶ सूचीब᳍ ᳰᮓयाकलाप भी हᱹ, को करने के िलए अनु᭄ात ᳰकया जाएगा । (ख) परंतु यह और ᳰक ᮧदूषण काᳯरत न करने वाले लघु उ᳒ोगᲂ से संबंिधत संिनमाᭅण कायᭅकलापᲂ को लागू िनयमᲂ और िविनयमᲂ के अनुसार, यᳰद कोई हᲂ तो, सᭃम ᮧिधकारी कᳱ पूवᭅ अनु᭄ा से ᭠यूनतम रखा जाएगा।
(ग) एक ᳰकलोमीटर से आगे और पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक वा᭭ तिवक ᭭ थानीय आव᭫ यकताᲐ के िलए संिनमाᭅण कᳱ अनु᭄ा दी जाएगी और अ᭠ य वािणि᭔ यक संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनुᱨप हᲂगे। (14) ᮝेᳲ᭠चग ᮕाउंड । नए ᮝेᳲ᭠ चग ᮕाउंड कᳱ ᭭ थापना ᮧितिष᳍ है । पुराने ᮝेᳲ᭠ चग ᮕाउंड को लागू िविधयᲂ के अनुसार िविनयिमत ᳰकया जाएगा ।
(15) ᮧाकृितक जल िनकायᲂ मᱶ बिह᮲ाᭅव और ठोस अपिश᭬ ट का िन᭭सारण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । (16) वायु और यािनक ᮧदूषण । (17) ᭟ विन ᮧदूषण । (18) भूिमगत जल का िन᭬ कषᭅण। (19) वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
(ग) आरिᭃत वनᲂ और संरिᭃत वनᲂ कᳱ दशा कायᭅयोजना मᱶ ᳰदए गए िववरण का अनुसरण ᳰकया जाएगा ।

(20) ᮧवासी चरागाही। (21) िव᳒मान ᭭थापना। (22) िव᳒ुत लाइनᲂ का रोधन।
भूिमगत लाईनो को िबछाने का संवधᭅन करना । पाᳯरि᭭थितक संवेदी जोन से गुजरने वाली सभी िव᳒मान िव᳒ुत लाइनᲂ को आंचिलक महायोजना के अधीन िविहत समय-सीमा मᱶ पयाᭅ᭡ त ᱨप से रोिधत ᳰकया जाएगा ।
(23) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदृढ़ करना।
उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपाय यथा लागू अनुसार हᲂगे । (24) होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना । लागू िविधयᲂ के अधीन िविनयिमत होगा ।
वन् यजीव के मु᭍ त संचलन को अनु᭄ात करने के िलए पाᳯरि᭭थितक संवेदी जोन के भीतर होटलᲂ या अ᭠ य वािणि᭔ यक ᭭ थापन अपनी पᳯरसंपि᭜ तयᲂ मᱶ काटेदार से बाड नहᱭ लगाएंगे और कोई भी बाड़ एक मीटर से ऊंची नहᱭ होगी । कोई िव᳒मान बाड़, जो इस उपदशᭅ का अनुपालन नहᱭ करती है, को आंचिलक महायोजना मᱶ वᳶणत समय-सीमा के अनुसार उपांतᳯरत ᳰकया जाएगा । (25) लोक अिधकार । (26) लघु चारे का संᮕहण । (27) सभी मागᲃ और िव᳒मान सड़कᲂ का उसी ᮧकार बने रहना।
(28) कृिष ᮧणािलयᲂ मᱶ आमूल पᳯरवतᭅन । (29) ᮧाकृितक जल संसाधनᲂ का वािणि᭔ यक उपयोग, िजसके अंतगᭅत भू-जल संचयन भी है । (30) रािᮢ मᱶ यािनक यातायात का संचलन । (31) िवदेशी ᮧजाितयᲂ को लाना । (32) वािणि᭔ यक साइनबोडᭅ और होᳺडग । (33) पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । 1 से 10 से अिधक ढाल वाली पहािड़यᲂ और साथ ही ᳰकसी नदी और अ᭠य ᮧाकृितक नाले के तट से 100 मीटर तक कोई नए संिनमाᭅण ᳰᮓयाकलाप को तब तक अनु᭄ात नहᱭ ᳰकया जाएगा जब तक ᳰक आंचिलक महायोजना के अधीन अ᭠यथा अनुमित ᮧदान न ᳰक गई हो। (34) ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग । पाᳯरि᭭थितक संवेदी जोन से गैर ᮧदूषण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष, पु᭬ प कृिष, उ᳒ान कृिष या कृिष आधाᳯरत देशीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग और जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते हᱹ, को अनु᭄ात ᳰकया जाएगा ।
(35) ठोस अपिश᳥ ᮧबंधन । (36) पाᳯरि᭭थितक-पयᭅटन । संवᳶधत ᳰᮓयाकलाप (37) डेयᳯरयᲂ, डेयरी फाᳺमग, जल कृिष और म᭜ ᭭ य पालन के साथ ᭭ थानीय समुदायᲂ ᳇ारा चालू कृिष और कृिष उ᳒ान प᳍ितयां । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । (38) जैिवक कृिष । (39) सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । (40) वषाᭅ जल संचयन ।

(41) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी हᱹ। (42) नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । (43) कृिष वािनकᳱ । (44) पयाᭅवरणीय जागᱧकता ।

5. मानीटरी सिमित- (1) कᱶᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी तीन साल के िलए एक मानीटरी सिमित का गठन करती है जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :- (i)

उपायुᲦ, पि᳟म कमᱶग अ᭟यᭃ (ii)

पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ मᱶ अᱧणाचल ᮧदेश सरकार ᳇ारा तीन वषᭅ कᳱ अविध के िलए नामिन᳸द᭬ ट ᳰकया जाने वाला एक िवशेष᭄ सद᭭य (iii)
गैर सरकारी संगठन का (पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले िजसके अंतगᭅत िवरासत संरᭃण भी है) भारत सरकार ᳇ारा तीन वषᭅ कᳱ अविध के िलए नामिन᳸द᳥ ᳰकया जाने वाला एक ᮧितिनिध सदस्य (iv)
कायᭅपालक इंजीिनयर, अᱨणाचल ᮧदेश ᮧदूषण िनयंᮢण बोडᭅ सद᭭य (v)

(2) पाᳯरि᭭थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी । (3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष᳍ गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।
(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं᭎यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया है, परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते हᱹ, ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब᳍ िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(5) मानीटरी सिमित का सद᭭य-सिचव या संब᳍ उपायु᭍ त, ऐसे ᳞िᲦ के िवᱨ᳍, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता है, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा । (6) मानीटरी सिमित मु᳎ा दर मु᳎ा के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब᳍ पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी । (7) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ रा᭔ य के मु᭎ य व᭠ यजीव वाडᭅन को अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ उपाबंध IV पर उपाब᳍ ᱨप िवधान के अनुसार उ᭍ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।

(8) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदेश दे सकेगा, जो वह ठीक समझे । 6.
इस अिधसूचना के उपबंधᲂ को ᮧभाव देने के िलए कᱶᮤीय सरकार और रा᭔ य सरकार अितᳯर᭍ त उपाय, यᳰद कोई हᲂ, िविन᳸द᭬ ट कर सकᱶगे ।

NOTIFICATION New Delhi, the 25th July, 2016 S.O. 2639(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Aliganj, New Delhi-110003, or send it to the e-mail address of the Ministry at: esz-mef@nic.in. Draft Notification WHEREAS, the Eagle Nest Wildlife Sanctuary located in West Kameng District, Arunachal Pradesh is spread over an area of 217 Sq. Kms. The broad forest type of the area are tropical and semi evergreen, sub-tropical broad leaved forest and sub temperate broad- leaved forest. AND WHEREAS, the flora and fauna represent rich biological significance of this Sanctuary.
AND WHEREAS, the major tree species includes Terminalia myriocarpa, Altingia excelsa, Cinnamomum Spp. Magnolia spp., Canarium strituctum, Terminalia bellerica, Bambax ceiba, Castanopsis indicam, Mesua ferrea, Phoebe goalparensis,. Bamboo species as Dendrocalamus hamiltonii, Pseudostrachyum polymorphum. Canes as Calamus floribundus, C. flagellum.
AND WHEREAS, some of the major mammal species include Elephus maximus, Panther tigris, Panthera pardus, Neofelis nebulosa, Ursus thibetanus, Aliurs fulgens, Trachypithecus pileatus, Cervus unicolor, Muntiacus muntjak, Naemorhedus goral, Cuon alpines etc. The bird fauna largely comprise of- Babblers, Eagles, Flycatchers, Junglefowl, Kingfishers, Laughingthrushs, Minvits, Nighters, Nuthatchs etc. The herpetofauna broadly consists of frogs as- Bufo sp., Duttaphrynus sp., Hyla sp., Megophyrus sp., etc and reptiles as Lizards- Calotes sp., Japalura sp., Hemidactylus sp., Varanus sp. Skinks as- Eutrophis sp., Lygosoma sp., Snakes as – Ramphotyphlops sp., Python sp., Ahaetulla sp., Amphiesma sp., Bungarus sp., Naja sp., Ophiophagus sp., Tortoises as- Cuora sp., Pangshura sp., The aquatic bodies harbors various fishes as Danio sp., Barilius sp., Semiplotus sp., Puntius sp., Tor spp., Chagunius sp., Garra sp., Noemacheilus sp., Glyptothorax sp. AND WHEREAS, it is necessary to conserve and protect the area surrounding the protected area of Eagle Nest Wildlife Sanctuary as Eco-Sensitive Zone from ecological, environmental and biodiversity point of view. NOW THEREFORE, in exercise of the power conferred by sub - section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent upto 500 metres around the boundary of Eagle Nest Wildlife Sanctuary in the State of Arunachal Pradesh as the Eagle Nest
Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-

Extent and Boundaries of Eco-sensitive Zone.- (1) The Eco-Sensitive Zone shall be of 23.12 Sq. Kms with
an extent upto 500 meters around the Southern boundary of the Protected Area and 100 meters around the North-Eastern and North-West part of the Protected Area.
(2) The list of villages falling in Eco-Sensitive Zone are given at Annexure-I. The GPS Co-ordinates of points along the boundary of Eagle Nest WLS and co-ordinates of Eco-sensitive Zone are given at Annexure-II. (3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-III. 2.
Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2)
The said Plan shall be approved by the Competent Authority in the State Government. (3) The said Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The said Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment,
(ii) Forest,
(iii) Urban Development,
(iv) Tourism,
(v) Municipal,
(vi) Revenue, (vii) Agriculture, (viii) Arunachal Pradesh State Pollution Control Board, (ix) Irrigation, (x) Public Works Department. (5)
The said Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The said Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention. (7) The said Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The said Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development for livelihood security of local communities. (9)
The State Government of Arunachal Pradesh shall prepare separate Zonal Master Plans for area under their jurisdiction.

Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1)
Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 12, 23, 34, 40 and 41 in column (2) of the Table in paragraph 4, namely:- (i)
Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco- friendly tourism activities, (ii)
Widening and strengthening of existing roads. (iii)
Small scale industries not causing pollution,
(iv)
Rainwater harvesting, and
(v)
Cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution of India or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2)
Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3)
Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i)
all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate Change with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;

(ii)
new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Eagle Nest Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities: (iii)
till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4)
Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Arunachal Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made there under. (7)
Air pollution.- The Environment Department of the State Government or Arunachal Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made there under. (9)
Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco- sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone. (10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the
28th March, 2016, as amended from time to time. (11)
Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made there under.

(12) Industrial Units: (a) No establishment of new wood based Industries within the proposed Eco- sensitive zone shall be permitted except the existing wood based Industries set up as per the Law. (b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco- sensitive zone shall be permitted.
4.
List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:-

(b) The mining operations shall strictly be in accordance with the orders of the Hon’ble Supreme Court dated 04 August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and order of the Hon’ble Supreme Court dated 21 April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012. 2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws. 4. Setting up of industries causing water or air or soil or noise pollution. No new or expansion of polluting industries in the Eco- sensitive Zone shall be permitted.
5. Establishment of new major thermal and hydro-electric projects.
Prohibited (except as otherwise provided) as per applicable laws. 6. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws. 7. Use of plastic bags. Prohibited (except as otherwise provided) as per applicable laws. 8. Undertaking activities related to tourism like over-flying the National Park Area by aircraft, hot-air balloons. Prohibited (except as otherwise provided) as per applicable laws. 9 Discharge of untreated effluents and solid waste in natural water bodies or land area.

Prohibited (except as otherwise provided) as per applicable laws. 10. River Poisioning. Prohibited. 11 Use of explosives. Prohibited (except as otherwise provided) as per applicable laws.

Regulated Activities 12 Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or up to the boundary of the Eco-sensitive Zone whichever

is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities.
Provided that, beyond one kilometer or up to the extent of the Eco-sensitive Zone, all new tourism activities or expansion of existing activities shall be in conformity with the Tourism Master Plan.

13 Construction activities.

(a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of protected area or up to the boundary of the Eco-sensitive Zone whichever is nearer. Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3:
(b) Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per the applicable rules and regulations, if any. (c) Beyond one kilometer upto the extent of Eco-Sensitive Zone, construction for bone fide local needs shall be allowed and other construction activities shall be regulated as per the Zonal Master Plan. 14 Trenching ground. Establishing of new trenching ground is prohibited. Old trenching grounds are to be regulated under applicable laws. 15 Discharge of treated effluents and solid waste in natural water bodies or land area. Regulated under applicable laws. 16 Air and Vehicular Pollution.
17 Noise pollution.

18 Extraction of ground water. 19 Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government;
(b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder. (c) in case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed. 20 Migratory graziers. Regulated under applicable laws and as per Zonal Master Plan.

21 Existing establishments.

22 Insulation of electric lines. Promote underground cabling. All existing electric lines passing through the ESZ shall be adequately insulated in the time frame prescribed under the Zonal Master Plan.
23 Widening and strengthening of existing roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable. 24 Fencing of existing premises of hotels and lodges. In order to allow free movement of wildlife, hotels or other commercial establishments within the ESZ shall not fence their properties with barbed wire and no fence shall be higher than 1 meter. Any existing fence not complying with this stipulation shall be modified as per the time lines

5.  Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee for three years, for 
   

effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-

i) Deputy Commissioner, West Kameng

• Chairman ii) An expert in the area of ecology and environment
  -Member

to be nominated by the Government of Arunachal Pradesh for a period of three year.

iii) One representatives of Non-governmental Organisation
-Member

(working in the field of environment including heritage

conservation) to be nominated by the Government of

India for a period of three year. iv) Executive Engineer, Arunachal Pradesh Pollution Control Board
-Member v) District Veterinary Officer (West Kameng ) -Member vi) District Agriculture Officer (West Kameng)

Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro- based industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.
35 Solid Waste Management.
36 Eco-Tourism. Promoted Activities 37 On going agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries . Shall be actively promoted. 38 Organic farming. 39 Adoption of green technology for all activities. 40 Rain water harvesting. 41 Cottage industries including village artisans. 42 Use of renewable energy sources. 43 Agro Forestry. 44 Environmental Awareness.

(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph 4 thereof, shall be scrutinised by the MC based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006 butare falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4 thereof, shall be scrutinized by the MC based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (5) The Member Secretary of the Monitoring Committee or the concerned Collector or the concerned park in- charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6)
The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the State as per pro forma given in Annexure IV.
