िडDू-साइखोवा राF Gीय उHान, असम के िडDूगढ़ और ितनसुकया िसिवल िजले म: 340 वग कलोमीटर के े0 म: फैला )आ है और यह एकल पा रि+थितक इकाई है, जो मूल प से बहापु0 और उ#र म: िसयांग, लोिहत और पूव म: देवांग नदय& तथा दि ण- पूव म: अनंतनाला और दि ण म: डांगोरी और िडDू नदी का बाढ का मैदान है; और, इस अभयारRय म: वन+पित और जीवजंतु के चुर जैिवक महTव का ितिनिधUव है; और, िडDू साइखोवा राVीय उHान एक पा रि+थितक इकाई है जो मूल प से बहापु0 और उ#र म: िसयांग, लोिहत और पूव म: देवांग नदय& तथा दि ण- पूव म: अनंतनाला और दि ण म: डांगोरी और िडDू नदी का बाढ का मैदान है। िडDू

साइखोवा राVीय उHान कई पशुW और पि य& के िलए वास–+थान है । Xोड म: कुल +तनधा रय& क 36 जाितय& के 10 वग और 19 जाितय& और 27 जेनेरा को दज कया गया है। राVीय उHान म: +तनधा रय& क 36 जाितय& म: से 12 सूची- I म: है, 11 कछुW क जाितयॉ, 9 िछपकली क जाित म: 2 मॉनीटर िछपकिलयां शािमल, 18 उभयचर& क जाितयॉ, 104 मछिलय& क जाितयॉ, 23 िभ[ सांप& क जाितयां और 104 िततिलय& क जाितय& के अलावा 500 प ी जीवजंतु क

जाितयां उपि+थत है;

े0 पि य& म: वासी प ी और जलीय एवं +थलीय पि य& क िविवधता के िलए पोषक मैदान भी आक;षत करता है। उHान म: मु]य +तनधा रय& जाितय& म: से एक जंगली घोड़ो मौजूद ह4; और और और और, िडDू साइखोवा, जैव- भौगोिलक दृि< से “उ#री पूव_ भारत–Dहमपु0 घाटी जैव- भौगोिलक ांत” (9ए), का ितिनिधUव करता है, दो मुख जैव िविवधता त6 +थान के जोन प रवतन म: वन+पित और जीवजंतु चुर है, जो जीवजंतु क

िविवधता का संभरण करता है और े0ीय, जलीय और वृ वासी पा रि+थितक तं0 म: जीव को अपनाते है; और, राVीय उHान Dहमपु0 नदी म: गैर- आबादी "ीप है और उ#र पूव_ े0 म: भू-आकृित–वै`ािनक का अदतीय आधार है; और और और और, जल चैनल इंडो-जेने टक डॉलफन के िलए महTवपूण वास +थान बनाता है,जो राVीय उHान के पा रि+थितक संवेदी जोन क Dहमपु0 नदी म: मुडती है; और, सद_ म: शुिFकत नदयां भी बालू िभि# (चापो रस) जलोढ चरागाह के िवकास के िलए आवaयक है जो संकटाप[ बंगाल फलो रकन िववेिचत पि य& के िलए उUकृ< वास +थान है िडDू-डांगोरी हाथी गिलयारे म: हािथय& के िलए वसन माग आवaयक है;
और, यह माना जाता है क पूव_ अणाचल देश वन के िडDू साइखोवा राVीय उHान से घासभूिम "ारा बाघ& का संचलन होता है, जो े0 म: बाघ संचलन का िवकास करता है; और, इस े0 का प र र ण और संर ण करना आवa यक है तथा िज सके िव+ तार और सीमाW को इस अिध सूचना के पैरा 1 म: िडDू-साइखोवा राF Gीय उHान के चार& ओर पा रि+थितक संवेदी जोन के eप म: िव िन @द F ट क या गया है और पयावरण क दृिF ट से उHोग& या उHोग& के वग को तथा उनक संX याW और X याW को उf त पा रि+थितक संवेदी जोन म: ितिष ? करना आवa यक है ;

अतः, इसिलए, केीय सरकार, पयावरण (संर ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प ठत
पयावरण (संर ण) अिधिनयम, 1986 (1986 का 29) क धारा 3 क उपधारा (3) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (1) "ारा द# शि%य& का योग करते )ए, असम राg य म: िडDू-साइखोवा राF Gीय उHान क सीमा से 9.144 कलोमीटर तक के िव+ तार तक के े0 को िडDू-साइखोवा राF Gीय उHान पा रि+थितक संवेदी जोन (िजसे इसम: इसके पa चात् पा रि+थितक संवेदी जोन कहा गया है) के प म: अिधसूिचत करती है, िजसका िववरण िन ानुसार है, अथात् :-

पार पार पार पारिथितक िथितक िथितक िथितक संवेदी संवेदी संवेदी संवेदी जोन जोन जोन जोन केकेकेके िलए िलए िलए िलए आंचिलक आंचिलक आंचिलक आंचिलक महायोजना महायोजना महायोजना महायोजना–(1) राgय सरकार, पा रि+ थितक संवेदी जोन के योजन के िलए राजप0 म: इस अिधसूचना के अंितम काशन क तारीख से दो वष क अविध के भीतर, +थानीय 9ि%य& के परामश से, इस अिधसूचना म: संलp न अनुबंध& के सामंज+ य से आंचिलक महायोजना तैयार करेगी । (2) आंचिलक महायोजना राg य सरकार म: स म ािधकारी "ारा अनुमोदत होगी ।
(3) पा रि+ थितक संवेदी जोन के िलए आंचिलक महायोजना, राg य सरकार "ारा इस अिधसूचना म: िविन@दF ट प म: ऐसी रीित म: तथा सुसंगत क: ीय और राg य िविधय& के सामंज+ य म: भी तथा क: ीय सरकार "ारा जारी मागिनदrश, यद कोई हो, "ारा तैयार होगी । (4)
आंचिलक महायोजना, इसम: पयावरणीय और पा रि+थितक िवचार& को समाकिलत करने के िलए राg य के सभी संब? िवभाग& के परामश से तैयार होगी, अथात्:-- (i) पयावरण ; (ii) वन ;
(iii) नगर िवकास ; (iv) पयटन ; (v) नगरपािलक ; (vi) राज+ व ;
(vii) कृिष ;
(viii) असम राg य दूषण िनयं0ण बोड ; (ix) mसचाई; और (x) लोक िनमाण िवभाग । (5)
महायोजना अनुमोदत िवHमान भू-उपयोग, अवसंरचनाU मक और Xयाकलाप& पर कोई िनबuधन अिधरोिपत नहv करेगी जब तक क इस अिधसूचना म: िविन@द< न ह& और आचंिलक महायोजना म: सभी अवसंरचना Xयाकलाप& म: द ता और पा रि+थितक अनुकूलता का संवधन करेगी ।
(6) आंचिलक महायोजना म: अनाwछादत े0& के जीणx?ार, िवHमान जल िनकाय& के संर ण, आवाह े0& के बंधन, जल-संभर& के बंधन, भूतल जल के बंधन, मृदा और नमी संर ण, +थानीय समुदाय& क आवaयकताW तथा पा रि+थितक और पयावरण से संबंिधत ऐसे अय पहलूW, िजन पर yयान देना आवaयक है, के िलए उपबंध ह&गे । (7) आंचिलक महायोजना सभी िवHमान एवं +तािवत पूजा + थल&, lाम& और नगरीय बंदोब+त&, वन& के कार और क+ म&, कृिष े0&, ऊपजाऊ भूिम, ह रत े0 जैसे उHान और उसी कार के + थान, उHान कृिष े0, आ@कड&, झील& और अय जल िनकाय& का अ|यंकन करेगी । (8)
आंचिलक महायोजना पा रि+ थितक संवेदी जोन म: िवकास के पा रि+ थितक अनुकूल िवकास और + थानीय समुदाय& क आजीिवका को सुिनिa चत करते )ए िविनयिमत होगी ।
(9) असम राgय सरकार उसके े0ािधकार के े0& के िलए पृथक् आंचिलक महायोजना तैयार करेगी।

परंतु पा रि+थितक संवेदी जोन के भीतर कृिष भूिम का संप रवतन, पैरा 4 के अधीन मानीटरी सिमित क िसफा रश पर और राgय सरकार के पूव अनुमोदन से, +थानीय िनवािसय& क आवासीय जरत& को पूरा करने के िलए और पैरा 4 क

सारणी के +तंभ (2) के अधीन Xम सं. 9, 21, 31, 35 और 36 के सामने सूचीब? Xयाकलाप& को पूरा करने के िलए अनुात ह&गे, अथात् :- (i) पा रि+थितक अनुकूल पयटन Xयाकलाप& के िलए पयटक& के अ+थायी आवासन के िलए पा रि+थितक अनुकूल आरामगाह जैसे ट:ट, लकड़ी के मकान आद ; (ii) िवHमान सड़क& को चौड़ा और सुदृढ़ बनाना ; (iii) दूषण का रत न करने वाले लघु उHोग ; (iv) कुटीर उHोग, िजसके अंतगत lामीण उHोग, सुिवधा भंडार और + थानीय सुख-सुिवधाएं ह4; और (v) वषा जल संचयन। परंतु यह और भी क राgय सरकार के पूव अनुमोदन तथा संिवधान के अनुwछेद 244 और तUसमय वृ# िविध के उपबंध& के अनुपालन के िबना, िजसके अंतगत अनुसूिचत जनजाित और अय परंपरागत वन िनवासी (वन अिधकार& क मायता) अिधिनयम, 2006 (2007 का 2) भी है, वािणिgयक या उHोग िवकास Xयाकलाप& के िलए जनजातीय भूिम का उपयोग अनुात नहv होगा :
परंतु यह और भी क पा रि+ थितक संवेदी जोन के भीतर भू-अिभलेख& म: उपसंजात कोई 0ु ट मानीटरी सिमित के िवचार ा6 करने के प7ात् राgय सरकार "ारा Uयेक मामले म: संशोिधत होगी और उ% 0ु ट के संशोधन क केीय सरकार के पयावरण, वन और जलवायु प रवतन मं0ालय को सूचना देनी होगी ।
परंतु यह और भी क उपयु% 0ु ट के संशोधन म: इस उप पैरा के अधीन यथा उपबंिधत के िसवाय कसी भी दशा म: भू-उपयोग का प रवतन सिमिलत नहv होगा :
परंतु यह और भी क ह रत े0 जैसे वन े0, कृिष े0 आद म: कोई पा रणािमक कटौती नहv होगी और अयुf त या अनुU पादक कृिष े0& म: पुन: वनीकरण करने के यास कए जाएंगे ।
(2) ाकृितक जल ाकृितक जल ाकृितक जल ाकृितक जल-ोत ोत ोत ोत -आंचिलक महायोजना म: सभी ाकृितक जल ोत& क पहचान क जाएगी और उनके संर ण और पुननवीकरण के िलए योजना सि मिलत होगी और राg य सरकार "ारा ऐसे े0& पर या उनके िनकट िवकास Xयाकलाप ितिष? करने के िलए ऐसी रीित से मागिनदrश तैयार कए जाएंगे । (3) पयटन पयटन पयटन पयटन – (क) पा रि+थितक संवेदी जोन के भीतर पयटन संबंधी Xयाकलाप, पयटन महायोजना के अनुसार ह&गे, जो आंचिलक महायोजना का भाग प ह&गे ।

(ख) पयटन महायोजना पयटन िवभाग, राgय सरकार के राज+ व और वन िवभाग के परामश से तैयार होगी ।
(ग) पयटन संबंधी Xयाकलाप िन निलिखत के अधीन िविनयिमत ह&गे, अथात् :- (i) पा रि+थितक संवेदी जोन के भीतर सभी नए पयटन Xयाकलाप& या िवHमान पयटन Xयाकलाप& का िव+तार केीय सरकार के पयावरण, वन और जलवायु प रवतन मं0ालय के मागदशक िस?ांत& के "ारा तथा राF Gीय या संर ण ािधकरण के पा रि+थितक पयटन मागदशक "ारा जारी (समय-समय पर यथा संशोिधत) िस?ांत& के अनुसार, पा रि+थितक पयटन, पा रि+थितक िश ा और पा रि+थितक िवकास को महUव देते )ए पा रि+थितक संवेदी जोन क वहन मता के अyययन पर आधा रत होगा; (ii) पा रि+थितक अनुकूल पयटक Xयाकलाप& के संबंध म: अ+थायी अिधभोग के िलए वास सुिवधा के िसवाय िडDू– साइखोवा क सीमा से एक कलोमीटर भीतर होटल और रसोट} का नया संिनमाण अनु`ात नहv होगा;

परंतु संरि त े0 क सीमा से एक कलोमीटर क दूरी से परे पा रि+थितक संवेदी जोन क सीमा तक नए होटल और रसोट क +थापना पयटन महायोजना के अनुसार पा रि+थितक पयटन सुिवधा के िलए पूव प रभािषत और िविन@द< +थान म: ही अनुात कया जाएगा । (iii) आंचिलक महायोजना का अनुमोदन कए जाने तक, पयटन के िलए िवकास और िवHमान पयटन Xयाकलाप& के िव+तार को वा+तिवक +थल िविन@द< संवी ा तथा मानीटरी सिमित क िसफा रश पर आधा रत संबंिधत िविनयामक ािधका रय& "ारा अनुात कया होगा । (4) नैस#गक नैस#गक नैस#गक नैस#गक िवरासत िवरासत िवरासत िवरासत - पा रि+थितक संवेदी जोन म: महUवपूण नैस;गक िवरासत के सभी +थल& जैसे सभी जीन कोश आरि त

े0, शैल िवरचनाएं, जल पात&, झरन&, घाटी माग}, उपवन&, गुफाएं, +थल&, मण, अरोहण, पातो आद क पहचान क जाएगी और उह: संरि त कया जाएगा तथा उनक सुर ा और संर ा के िलए इस अिधसूचना के अंितम काशन क

तारीख से छह मास के भीतर, उपयु% योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । (5) मानव िन#मत िवरासत थ मानव िन#मत िवरासत थ मानव िन#मत िवरासत थ मानव िन#मत िवरासत थल ल ल ल - पा रि+ थितक संवेदी जोन म: भवन&, संरचनाW, िशप-त य, ऐितहािसक, कलाUमक और सां+कृितक महUव के े0& क पहचान करनी होगी और इस अिधसूचना के अंितम काशन क तारीख से छह माह के भीतर उनके संर ण क योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना म: सिमिलत क जाएगी ।
(6) % व % व % व % विन दूषण िन दूषण िन दूषण िन दूषण - पा रि+थितक संवेदी जोन म: y विन दूषण के िनयं0ण के िलए राg य सरकार का पयावरण िवभाग, वायु (दूषण िनवारण और िनयं0ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम& के उपबंध& के अनुसरण म: मागदशक िस?ांत और िविनयम तैयार करेगा ।
(7) वायु वायु वायु वायु दूषण दूषण दूषण दूषण - पा रि+थितक संवेदी जोन म:, वायु दूषण के िनयं0ण के िलए राgय सरकार का पयावरण िवभाग, वायु (दूषण िनवारण और िनयं0ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम& के उपबंध& के अनुसरण म: मागदशक िस?ांत और िविनयम तैयार करेगा ।
(8) बिहाव बिहाव बिहाव बिहाव का का का का िनसारण िनसारण िनसारण िनसारण - पा रि+थितक संवेदी जोन म: उपचा रत बिहाव का िन+सारण जल (दूषण िनवारण तथा िनयं0ण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयम& के उपबंध& के अनुसार होगा । (9) ठोस ठोस ठोस ठोस अपिश- अपिश- अपिश- अपिश- - ठोस अपिश<& का िनपटान िन िलिखत प म: होगा - (i) पा रि+थितक संवेदी जोन म: ठोस अपिश<& का िनपटान भारत सरकार के तUकालीन पयावरण और वन मं0ालय क समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 908(अ), तारीख 25 िसतंबर, 2000 को कािशत नगरपािलक ठोस अपिश< (बंध और हथालन) िनयम, 2000 के उपबंध& के अनुसार कया जाएगा ; (ii) +थानीय ािधकरण जैव िन ीकरणीय और अजैव िन ीकरणीय संघटक& म: ठोस अपिश<& के संपृथन के िलए योजनाएं तैयार कर:गे ;
(iii) जैव िन ीकरणीय सामlी को अिधमानतः खाद बनाकर या कृिम खेती के माyयम से पुनःचXत कया जाएगा ;
(iv) अकाबिनक सामlी का िनपटान पा रि+थितक संवेदी जोन के बाहर पहचान कए गए + थल पर कसी पयावरणीय +वीकृत रीित म: होगा और पा रि+थितक संवेदी जोन म: ठोस अपिशF ट& को जलाना या भF मीकरण अनु`ात नहv होगा ।
(10) जैव िचक/ सी जैव िचक/ सी जैव िचक/ सी जैव िचक/ सीय अपिश1 ट य अपिश1 ट य अपिश1 ट य अपिश1 ट- पा रि+थितक संवेदी जोन म: जैव िचकUसीय अपिश<& का िनपटान भारत सरकार के तUकालीन पयावरण और वन मं0ालय क समय-समय पर यथासंशोिधत अिधसूचना सं.का.आ.630 (अ) तारीख 20 जुलाई, 1998 "ारा कािशत जैव िचकUसीय अपिश< (बंध और हथालन) िनयम, 1998 के उपबंध& के अनुसार कया जाएगा ।

(11) यानीय यानीय यानीय यानीय परवहन परवहन परवहन परवहन - प रवहन क यानीय गितिविधयां आवास के अनुकूल िविनयिमत ह&गी और इस संबंध म: आंचिलक महायोजना म: िवशेष उपबंध सिमिलत कए जाएंगे और आंचिलक महायोजना के तैयार होने और राgय सरकार के स म ािधकारी "ारा अनुमोदत होने तक, मानीटरी सिमित सुसंगत अिधिनयम& और वृ# िनयम& और इसके अyयधीन बनाए गए िविनयम& के अधीन यानीय गितिविधय& के अनुपालन को मानीटर करेगी ।

(क) +तािवत पा रि+थितक संवेदी जोन के भीतर नए का आधा रत उHोग& का +थापना िविध के अनुसार +थािपत िवHमान का आधा रत उHोग के िसवाय अनु`ात नहv कए जाएंगे ।

(ख) +तािवत पा रि+थितक संवेदी जोन के भीतर जल, वायु, मृदा, yविन दूषण के कोई नए उHोग क +थापना अनु`ात नहv होगी ।

NOTIFICATION New Delhi, the 8th April, 2016 S.O. 1363(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of
sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Aliganj, New Delhi-110003, or send it to the e-mail address of the Ministry at: - esz- mef@nic.in. Draft Notification WHEREAS, the Dibru-Saikhowa National Park located Dibrugarh and Tinsukia Civil District, Assam is spread over an area of 340 square kilometers and the area is a single ecological unit which is basically a flood plain of the River Brahmaputra and Siang in the North, Lohit and Debang in the east, the Ananta Nala to the south east and the Dangori and Dibru River in the south; AND WHEREAS, the flora and fauna represent rich biological significance of this sanctuary;

AND WHEREAS, the Dibru - Saikhowa National Park is a single ecological unit which is basically a flood plain of the River Brahmaputra and Siang in the North, Lohit and Debang in the east, the Ananta Nala to the south east and the Dangori and Dibru River in the south. Dibru-Saikhowa National Park is the habitat for many animals and birds. A total of 36 species of Mammals belonging to 10 orders and 19 families and 27 genera are recorded in the core. Out of 36 species of mammals 12 belonged to schedule- I . 11 species of

turtles, 9 species of lizard including two monitor Lizards, 18 amphibian species, 104 species of fish, 23 different species of snakes and 104 species of butterflies are present in the National Park besides having about 500 species of avifauna;

The area also attracts birds including Migratory birds and is a feeding ground for a variety of aquatic and terrestrial birds. Feral horses are one of the prime mammal species available in the park; AND WHEREAS, the Bio-geographically, Dibru-Saikhowa represents the “ North Eastern India – Brahmaputra Velly Biogeographically province” (9A), having rich in Flora and Fauna being the transition Zone of two major biodiversity hot spot, which supports fauna is as diverse and adopted to life in terristorial,
aquatic and arboreal ecosystem; AND WHEREAS, the National park is an uninhabited island in river Brahmaputra and an unic geo- morphological base in North Eastern Region; AND WHEREAS, the water channel form an important habitat for the Indo-Genetic Dolphin which move in the proposed Eco- sensitive Zone of the National Park specially in the river Brahmaputra; AND WHEREAS, in winter dried up river beds as well as the sandbar (Chapories ) serve for the development of alluvial grassland which are an excellent habitat for the critically endangered Bengal Florican birds, as well as the Sandbar (Chapories) served as migration route for the elephants in the Dibru- Dangori Elephant Corridor; AND WHEREAS, it is postulated that the movement of tigers from Dibru-Saikhowa National Park to Eastern Arunachal Pradesh Forest has taken place through grassland which develop the tiger movement in the area; AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification surrounding the protected area of Dibru-Saikhowa National Park as Eco-Sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone. NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent upto 9.144 kilometres. around the boundary of Dibru-Saikhowa National Park in the State of Assam as the Dibru - Saikhowa National Park Eco-sensitive Zone (herein after referred to as the Eco- sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone:- (1) The Eco-sensitive Zone shall be an extent upto
9.144 kilometres around the Dibru-Saikhowa National Park and the list of villages falling in the in Eco-sensitive Zone are given at Annexure-I and the GPS Co-ordinates of points along the boundary of Dibru-Saikhowa National Park are given at Annexure-II. (2) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-III. 2.
Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2)
The said Master Plan shall be approved by the competent authority in the State Government. (3) The said Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The said Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment,
(ii) Forest,
(iii) Urban Development,
(iv) Tourism,
(v) Municipal,
(vi) Revenue,

(vii) Agriculture, (viii) Assam State Pollution Control Board, (ix) Irrigation, and (x) Public Works Department. (5)
The said Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The said Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention. (7) The said Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The said Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco- friendly development for livelihood security of local communities. (9)
The State Government of Assam shall prepare separate Zonal Master Plans for area under their jurisdiction. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1)
Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 9,21,31,35 and 36 in column (2) of the table in paragraph 4, namely:- (i)
Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco- friendly tourism activities; (ii)
Widening and strengthening of existing roads and construction of new roads; (iii)
Small scale industries not causing pollution; (iv)
Rainwater harvesting; and
(v)
Cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2)
Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3)
Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by the department of Tourism, in consultation with the department of Forests and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i)
all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone; (ii)
new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Dibru-Saikhowa National Park except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities: Provided that beyond the distance of one kilometre from the boundary of the protected areas till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre- defined and designated areas for Eco-tourism facilities as per Tourism Master Plan; (iii)
till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4)
Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, arte facts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Assam State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco- sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder. (7)
Air pollution.- The Environment Department of the State Government or Assam State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco- sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made thereunder. (9)
Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non- biodegradable components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco- sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time. (11)
Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the law. (b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted.
4.
List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the table below, namely:-

(b) The mining operations shall strictly be in accordance with the orders of the Hon’ble Supreme Court, dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. Union of India in Writ Petition (Civil) No.202 of 1995 and order of the Hon’ble Supreme Court, dated the 21st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.435 of 2012. 2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws. 4. Setting up of industries causing water or air or soil or noise pollution. No new or expansion of polluting industries in the Eco- sensitive Zone shall be permitted.
5. Establishment of new major thermal and hydro-electric projects. Prohibited (except as otherwise provided) as per applicable laws. 6. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws. 7. Establishment new oil, Gas & Mineral explosion including drilling/mineral Gas survey etc. Prohibited (except as otherwise provided) as per applicable laws. 8. Discharge of untreated effluents and solid waste in natural water bodies or Prohibited (except as otherwise provided) as per applicable

land area. laws. Regulated Activities
9. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area or the boundary of Eco-sensitive Zone whichever is nearer except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities.
However, beyond one kilometer and upto the extent of the Eco-sensitive Zone all new tourism activities or expansion of existing activities shall be permitted in conformity with the Tourism Master Plan. 10.

Undertaking activities related to tourism like over-flying the national park area by aircraft, hot-air balloons. Regulated under applicable laws. 11. Construction activities.

(a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the protected area or the boundary of Eco-sensitive Zone whichever is nearer. Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3:
(b) Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (c) Further, beyond one kilometer upto the extent of Eco- sensitive Zone construction for bone fide local needs shall be allowed and other construction activities shall be regulated as per the Zonal Master Plan.
12. Trenching ground. Establishing of new trenching ground is prohibited. Old trenching grounds are to be regulated under applicable laws. 13. Discharge of treated effluents and solid waste in natural water bodies or land area. 14. Air and vehicular pollution. 15. Noise pollution.
16. Extraction of ground water. 17. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government;
(b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder. (c) in case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed. 18. Migratory graziers. Regulated under applicable laws and as per Zonal Master Plan.
19. Setting up of mobile communication towers. 20. Insulation of electric lines. Promote underground cabling. All existing electric lines passing through the Eco-sensitive Zone shall be adequately insulated in the time frame prescribed under the Zonal Master Plan.

 Monitoring Committee-  The Central Government hereby constitutes a Monitoring Committee, for

effective monitoring of the Eco-sensitive Zone, which shall comprise of the followingm namely: (i) Deputy Commissioner, Tinsukia

(ii) Representative of Dy. Commissioner, Dibrugarh

Member (iii) An expert in the area of ecology and environment

Member to be nominated by the Government of Assam
for a period of one year.
(iv) Chair person of Tinsukia & Doom Dooma Municipality

(v) One representatives of non-Governmental Organisation

Member (working in the field of environment including heritage
conservation) to be nominated by the Government of
Assam for a period of one year. 21. Widening and strengthening of existing roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable. 22. Fencing of existing premises of hotels and lodges. In order to allow free movement of wildlife, hotels or other commercial establishments within the Eco-sensitive Zone shall not fence their properties with barbed wire and no fence shall be higher than 1 meter. Any existing fence not complying with this stipulation shall be modified as per the time lines mentioned in the Zonal Master Plan. 23. Use/disposal of plastic bags. 24. Collection of Non-timber forest products. 25. Drastic change of agriculture system.

Commercial use of natural water resource including ground water harvesting. 26. Movement of vehicular traffic at night. 27. Introduction of exotic species. 28. Sign board and hoardings. 29. Protection of hill slopes and river banks. No construction activity unless otherwise permitted under the Zonal Master Plan shall be undertaken on the hill with slopes more than 1 to 10 and also upto 100 meters from the banks of any river, and natural nallah. 30. Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro- based industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.
Promoted Activities 31. On going agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.
Shall be actively promoted. 32. Organic farming. Shall be actively promoted. 33. Adoption of green technology for all activities. Shall be actively promoted. 34. Cottage industries including village artisans. Shall be actively promoted. 35. Rain water harvesting. Shall be actively promoted. 36. Use of renewable energy sources. Shall be actively promoted.

Terms of Reference.- (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006 but are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned park in-charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6)
The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden in the State as per pro forma given in Annexure IV. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7.
The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. The provisions of this notification are subject to the orders, if any, passed or to be passed by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
