बोराइल व यजीव अभयारD य, जो िसचर नगर से 25 कलोमीटर क दूरी पर अवि,थत, असम के कKछार िजले और दीमा हसाओ िजल' के भारतीय उप े1 और भारत चीन उप े1 के मNय प!रवतO जोन क बोराइल पवत Pृंखला पर ि,थत है और दि णी ओर से चाय बगान' से िघरा *आ है, 326.25 वग कलोमीटर के े1 म; फैला *आ है; और, बोराइल व यजीव अभयारD य असम के बरक घाटी म; व यजीव के िलए समृN द जैव- िविवधता और पयावास के साथ संरि त े1 भी है ;

और, बोराइल व यजीव अभयारD य म; 19 , तनधा!रय' क जाितय' ,8 नर वानर' क जाितय', 250 प ीजीव क जाितय', 23 उभयचरो क जाितय' और 43 सरीसृप' क जाितय' का संभरण होता है, जो X यापक दुलभ, असुरि त और संकटाप न जाितयां ह5 ; और, बोराइल व यजीव अभयारD य क जैव- िविवधता के अंतगत 81 वृ ' क जाितयां और 8 बांस' क जाितयां और कई जडी- बू!टय' एवं झाि़डय' क जाितयां ह5;

और, बोराइल व यजीव अभयारD य के चार' ओर के े1 को, िजसका िव,तार और सीमाएं इस अिधसूचना के पैरा 1 म; िविनAद= ह5, पयावरण क दृि= से पा!रि,थितक संवेदी जोन के प म; सुरि त और संरि त करना तथा उ& पा!रि,थितक संवेदी जोन म; उ]ोग' या उ]ोग' के वग^ के चालन तथा सं,करण करने को ितिष@ करना आव`यक है ;

अतः, अब, केीय सरकार, पयावरण (संर ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प!ठत पयावरण (संर ण) अिधिनयम, 1986 (1986 का 29) क धारा 3 क उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) #ारा द$ शि&य' का योग करते *ए, असम म; बोराइल व यजीव अभयारD य क सीमा से चार' ओर 0.5 कलोमीटर से 6 कलोमीटर तक के िव, ता!रत े1 को बोराइल व यजीव अभयारD य पा!रि, थितकय संवेदी जोन (िजसे इसम; इसके प` चात् पा!रि, थितक संवेदी जोन कहा गया है) के प म; अिधसूिचत करती है, िजसका िववरण िन ानुसार है, अथात्:- 1.

(3) पा!रि, थितक संवेदी जोन के िलए आंचिलक महायोजना, राe य सरकार #ारा इस अिधसूचना म; िविनAदh ट प म; ऐसी रीित म; तथा सुसंगत क; ीय और राe य िविधय' के सामंज, य म; भी तथा क; ीय सरकार #ारा जारी मागिनदjश, यद कोई ह', #ारा तैयार होगी । (4) आंचिलक महायोजना, पयावरणीय और पा!रि,थितक िवचार' को समाकिलत करने के िलए राe य सरकार के सभी संब@ िवभाग' के परामश से तैयार होगी, अथात्:-- (i) पयावरण; (ii) वन;
(iii) शहरी िवकास; (iv) पयटन; (v) नगरपािलका;

(vi) राज, व;
(vii) कृिष;
(viii) असम राe य दूषण िनयं1ण बोड; (ix) nसचाई; और
(x) लोक िनमाण िवभाग । (5)
आंचिलक महायोजना अनुमोदत िव]मान भू-उपयोग, अवसंरचना और oयाकलाप' पर कोई िनबpधन अिधरोिपत नहq करेगी जब तक क इस अिधसूचना म; िविनAदh ट न हो और आचंिलक महायोजना सभी अवसंरचना और oयाकलाप' म; और अिधक द ता और पा!रि,थितक अनुकूलता का संवधन करेगी ।
(6) आंचिलक महायोजना म; अनाKछादत े1' के जीण^@ार, िव]मान जल िनकाय' के संर ण, आवाह े1' के बंधन, जल-संभर' के बंधन, भूतल जल के बंधन, मृदा और नमी संर ण, ,थानीय समुदाय' क आवयकताr तथा पा!रि,थितक और पयावरण से संबंिधत ऐसे अय पहलूr, िजन पर Nयान देना आवयक है, के िलए उपबंध ह'गे । (7)
आंचिलक महायोजना सभी िव]मान पूजा , थल', sाम' और नगरीय बंदोब,त', वन' के कार और क, म', कृिष

े1', ऊपजाऊ भूिम, ह!रत े1 जैसे उ]ान और उसी कार के , थान, उ]ान कृिष े1, फलोधान, झील' और अय जल िनकाय' का अuयंकन करेगी । (8)
आंचिलक महायोजना , थानीय समुदाय' क जीवकोपाजन को सुिनि` चत करने के िलए, पा!रि,थितक संवेदी जोन म; िवकास को पा!रि,थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।
3. राय राय राय राय सरकार सरकार सरकार सरकार ारा ारा ारा ारा कए कए कए कए जाने जाने जाने जाने वाले वाले वाले वाले उपाय उपाय उपाय उपाय -------- राeय सरकार इस अिधसूचना के उपबंध' को भावी करने के िलए िन िलिखत उपाय करेगी, अथात्:- (1) भूभूभूभू-उपयोग उपयोग उपयोग उपयोग - पा!रि, थितक संवेदी जोन म; वन', उ]ान-कृिष े1', कृिष े1', आमोद- मोद के योजन के िलए िचिहत कए गए पाकv और खुले ,थान' का वािणिeयक और औ]ोिगक संब@ िवकास oयाकलाप' के िलए उपयोग या संप!रवतन नहq होगा:
परंतु पा!रि,थितक संवेदी जोन के भीतर कृिष भूिम का संप!रवतन मानीटरी सिमित क िसफा!रश पर और राeय सरकार के पूव अनुमोदन से, ,थानीय िनवािसय' क आवासीय जरत' को पूरा करने के िलए और पैरा 4 क सारणी के ,तंभ (2) के अधीन oम सं. 13, 20, 31, 32 और 33 के सामने सूचीब@ oयाकलाप' को पूरा करने के िलए अनुxात ह'गे, अथात्:-
(i) पा!रि, थितक अनुकूल पयटन oयाकलाप' के िलए पयटक' के अ, थायी अिधभोग के िलए पा!रि, थितक अनुकूल आरामगाह जैसे ट;ट, लकड़ी के मकान आद ; (ii) िव]मान सड़क' को चौड़ा करना और सुदृढ़ बनाना; (iii) कुटीर उ]ोग, िजसके अंतगत sामीण उ]ोग, सुिवधा भंडार और , थानीय सुिवधाएं भी ह5; (iv) वषा जल संचयन; और (v) दूषण का!रत न करने वाले लघु उ]ोग।
परंतु यह और क जनजातीय भूिम का उपयोग राeय सरकार के पूव अनुमोदन और संिवधान के अनुK छेद 244 या त|समय वृ$ िविध के उपबंध' के अनुपालन के िबना, िजसके अंतगत अनुसूिचत जनजाित और अय परंपरागत वन िनवासी (वन अिधकार' क मायता) अिधिनयम, 2006 (2007 का 2) भी है, वािणिeयक या उ]ोग िवकास oयाकलाप' के िलए अनुxात नहq होगा :

परंतु यह और भी क पा!रि, थितक संवेदी जोन के भीतर भू-अिभलेख' म; उपसंजात कोई 1ु!ट, मानीटरी सिमित के िवचार ा7 करने के प8ात् राeय सरकार #ारा |येक मामले म; एक बार संशोिधत होगी और उ& 1ु!ट के संशोधन क सूचना केीय सरकार के पयावरण, वन और जलवायु प!रवतन मं1ालय को देनी होगी ।
परंतु यह और भी क उपयु& 1ु!ट का संशोधन म; इस उप पैरा के अधीन यथा उपबंिधत के िसवाय कसी भी दशा म; भू-उपयोग का प!रवतन सि}मिलत नहq होगा ।
परंतु यह और भी क िजससे ह!रत े1 म; जैसे वन े1, कृिष े1 आद म; कोई पा!रणािमक कटौती नहq होगी और अन युg त या अनु| पादक कृिष े1' म; पुन: वनीकरण करने के यास कए जाएंगे ।
(2) ाकृितक जल ोत ाकृितक जल ोत ाकृितक जल ोत ाकृितक जल ोत - आचंिलक महायोजना म; सभी ाकृितक जल ~ोत' क पहचान क जाएगी और उनके संर ण और पुनभूतकरण के िलए योजना सि} मिलत होगी और राe य सरकार #ारा ऐसे े1' पर या उनके िनकट िवकास oयाकलाप ितिष@ करने के िलए ऐसी रीित से मागिनदjश तैयार कए जाएंगे । (3) पयटन पयटन पयटन पयटन – (क) पा!रि,थितक संवेदी जोन के भीतर पयटन संबंधी oयाकलाप पयटन महायोजना के अनुसार ह'गे जो क आंचिलक महायोजना के भाग के प म; होगी ।

(ख) पयटन महायोजना पयटन िवभाग, राeय सरकार के राज, व और वन िवभाग के परामश से तैयार होगी ।
(ग) पयटन संबंधी oयाकलाप िन} निलिखत के अधीन िविनयिमत ह'गे, अथात् :- (i) पा!रि,थितक संवेदी जोन के भीतर सभी नए पयटन oयाकलाप' या िव]मान पयटन oयाकलाप' का िव,तार क; सरकार के पयावरण, वन और जलवायु प!रवतन मं1ालय के मागदशक िस@ांत' के #ारा तथा राh ीय X या संर ण ािधकरण, #ारा जारी पा!रि,थितक पयटन (समय-समय पर यथा संशोिधत) मागदशक िस@ांत' के अनुसार, पा!रि,थितक पयटन, पा!रि,थितक िश ा और पा!रि,थितक िवकास को मह|व देते *ए पा!रि,थितक संवेदी जोन क वहन मता के अNययन पर आधा!रत होगा;
(ii) पा!रि,थितक अनुकूल पयटक oयाकलाप' के संबंध म; अ,थायी अिधभोग के िलए वास सुिवधा के िसवाय बोराइल वयजीव अभयारDय क सीमा से एक कलोमीटर भीतर होटल और !रसोटv का नया संिनमाण अनुxात नहq होगा ; (iii) आंचिलक महायोजना का अनुमोदन कए जाने तक, पयटन के िलए िवकास और िव]मान पयटन oयाकलाप' के िव,तार को वा,तिवक ,थल िविनAद= संवी ा तथा मानीटरी सिमित क िसफा!रश पर आधा!रत संबंिधत िविनयामक ािधकरण' #ारा अनुxात कया होगा । (4) नैस#गक नैस#गक नैस#गक नैस#गक िवरासत िवरासत िवरासत िवरासत -------- पा!रि,थितक संवेदी जोन म; मह|वपूण नैस<गक िवरासत के सभी ,थल' जैसे सभी जीन कोश आरि त े1, शैल िवरचनाएं, जल पात', झरन', घाटी मागv, उपवन', गुफाएं, ,थल', मण, अरोहण, पातो आद क पहचान क जाएगी और उह; संरि त कया जाएगा तथा उनक सुर ा और संर ा के िलए इस अिधसूचना के अंितम काशन क तारीख से छह मास के भीतर, उपयु& योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । (5) मानव िन#मत िव मानव िन#मत िव मानव िन#मत िव मानव िन#मत िवरासत थ रासत थ रासत थ रासत थल ल ल ल - पा!रि, थितक संवेदी जोन म; भवन', संरचनाr, िशप-त य, ऐितहािसक, कला|मक और सां,कृितक मह|व के े1' क पहचान करनी होगी और इस अिधसूचना के अंितम काशन क तारीख से छह माह के भीतर उनके संर ण क योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना म; सि}मिलत क जाएगी ।
(6) % व % व % व % विन दूषण िन दूषण िन दूषण िन दूषण - पा!रि,थितक संवेदी जोन म; N विन दूषण के िनयं1ण के िलए राe य सरकार का पयावरण िवभाग, वायु ( दूषण िनवारण और िनयं1ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम' के उपबंध' के अनुसरण म; मागदशक िस@ांत और िविनयम तैयार करेगा ।

(7) वायु वायु वायु वायु दूषण दूषण दूषण दूषण - पा!रि,थितक संवेदी जोन म;, वायु दूषण के िनयं1ण के िलए राeय सरकार का पयावरण िवभाग, वायु ( दूषण िनवारण और िनयं1ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम' के उपबंध' के अनुसरण म; मागदशक िस@ांत और िविनयम तैयार करेगा ।
(8) बिहाव बिहाव बिहाव बिहाव का का का का िनसारण िनसारण िनसारण िनसारण - पा!रि,थितक संवेदी जोन म; उपचा!रत बिह~ाव का िन,सारण, जल ( दूषण िनवारण तथा िनयं1ण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयम' के उपबंध' के अनुसार होगा । (9) ठोस ठोस ठोस ठोस अपिश- अपिश- अपिश- अपिश- -------- ठोस अपिश=' का िनपटान िन िलिखत प म; होगा - (i) पा!रि,थितक संवेदी जोन म; ठोस अपिश=' का िनपटान भारत सरकार के त|कालीन पयावरण और वन मं1ालय क समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 908(अ), तारीख 25 िसतंबर, 2000 नगरपािलक ठोस अपिश= ( बंध और हथालन) िनयम, 2000 के उपबंध' के अनुसार कया जाएगा ; (ii) ,थानीय ािधकरण जैव िन ीकरणीय और अजैव िन ीकरणीय संघटक' म; ठोस अपिश=' के संपृथन के िलए योजनाएं तैयार कर;गे ;
(iii) जैव िन ीकरणीय सामsी को अिधमानतः खाद बनाकर या कृिम खेती के माNयम से पुनःचoत कया जाएगा ;
(iv) अकाबिनक सामsी का िनपटान पा!रि,थितक संवेदी जोन के बाहर पहचान कए गए , थल पर कसी पयावरणीय ,वीकृत रीित म; होगा और पा!रि,थितक संवेदी जोन म; ठोस अपिशh ट' को जलाना या भh मीकरण अनुxात नहq होगा ।

(क) सभी नए और िवमान खनन (लघु और वृहत खिनज), प थर क खान और उनको तोड़ने क इकाइयां वातिवक थानीय िनवािसय क घरेलू आवयकता

िजसम िनजी उपयोग के िलए मकान के संिनमा$ण या मर% मत के िलए भूिम को खोदना और मकान बनाने के िलए देशी टाइ+ स या ,ट का िनमा$ण करना भी सि% मिलत है, के िसवाय नह1 हगी ;

(ख) खनन सं23याएं, माननीय उ4तम 5यायालय क 6रट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबम$न िथ9मूलपाद बनाम भारत सरकार के मामले म आदेश तारीख 4 अगत 2006 और 6रट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले म तारीख 21 अ<ैल, 2014 के अंत6रम आदेश के अनुसरण म सव$दा <चालन होगा ।

आरा मील क थापना । पा6रिथितक संवेदी जोन के भीतर नई और िवमान आरा मील का िव तार अनु@ात नह1 होगा ।

ऐसे उोग क थापना, िजसके अंतग$त नवीन तेल और गैस पय$वेHण भी है, िजनसे जल या वायु या मृदा या Jविन <दूषण होता है।
पा6रिथितक संवेदी जोन के भीतर 2कसी नए और <दूषण का6रत करने वाले िवमान उोग का िव तार अनु@ात नह1 होगा । (5)

NOTIFICATION New Delhi, the 8th April, 2016 S.O. 1364(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forests and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Aliganj, New Delhi-110003, or send it to the e-mail address of the Ministry at esz- mef@nic.in Draft Notification Whereas, the Borail Wildlife Sanctuary situated in the Borail Hill Range on the transitional zone between Indian sub-region and Indo-Chinese sub region in Cachar District and Dima Hasao Districts of Assam located 25 kilometre away from Silchar town and surrounded by tea gardens from the Southern side is spread over an area of 326.25 square kilometres. And Whereas, the Borail Wildlife Sanctuary is the only protected area in the Barak valley of Assam with rich biodiversity and habitat for wildlife; And Whereas, the Borail Wildlife Sanctuary supports 19 species of mammals, 8 species of primates, 250 species of avifauna, 23 species of amphibians and 43 species of reptiles which are globally rare, vulnerable, and endangered species; And Whereas, the biodiversity of Borail Wildlife Sanctuary comprises of 81 species of trees and 8 species of bamboo and several species of herbs and shrubs; And Whereas, the national park has immense research, recreational and educational values and it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of Borail Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
Now, Therefore, in exercise of the powers conferred by sub- section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby
notifies an area to an extent varying from 0.5 kilometre to 6 kilometres around the boundaries of Borail Wildlife Sanctuary in the State of Assam as Eco-sensitive Zone of Borail Wildlife Sanctuary(herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-

Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone shall be with a peripheral area of 309.16 square kilometres with an extent varying from 0.5 kilometre to 6 kilometres around the boundaries of Borail Wildlife Sanctuary.

The boundary details of Borail Wildlife Sanctuary and its Eco-sensitive Zone are given in
Annexure-I. (2) The GPS coordinates of Borail Wildlife Sanctuary and its Eco-sensitive Zone along with latitudes and longitudes are given in Annexure-I A. (3) The map of the Eco-sensitive Zone, latitudes and longitudes along with GPS coordinates is appended as Annexure-II.
(4) The list of villages falling in Eco-sensitive Zone is appended as Annexure-III.

Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of publication of the final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2)
The Zonal Master Plan for the Eco-sensitive Zone shall be approved by the competent authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The said Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i)
Environment,
(ii)
Forest,
(iii)
Urban Development,
(iv)
Tourism,
(v)
Municipal,
(vi)
Revenue, (vii)
Agriculture, (viii) Assam State Pollution Control Board, (ix)
Irrigation, and (x)
Public Works Department. for integrating environmental and ecological considerations into it.
(5)
The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and Eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development for livelihood security of local communities.

Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities specified against serial numbers 13, 22, 31,32 and 33 in column (2) of the table in paragraph 4, namely:- (i)
Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco- friendly tourism activities;

(ii)
Widening and strengthening of existing roads and construction of new roads; (iii)
Small scale industries not causing pollution; (iv)
Rainwater harvesting; and
(v)
Cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per the Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by the Department of Tourism, in consultation with the Department of Forests and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i)
all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change with emphasis on Eco-tourism, Eco-education and Eco-development and based on carrying capacity study of the Eco-sensitive Zone; (ii)
new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Borail Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities: (iii)
till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool Project areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and projectd and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Assam State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder.

(7) Air pollution.- The Environment Department of the State Government or Assam State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- No discharge of untreated effluent shall be permitted. The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made thereunder. (9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non- biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco- sensitive Zone. (10) Bio-medical waste.- The Bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time. (11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Industrial units.- (a)
No establishment of new wood based industries within the proposed Eco- sensitive Zone shall be permitted except the existing wood based industries set up as per the law. (b)
No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted.
4.
List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the table below, namely:-

(b) The mining operations shall strictly be in accordance with the interim orders of the Hon’ble

Supreme Court dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. Union of India in Writ Petition (Civil) No.202 of 1995 and order of the Hon’ble Supreme Court dated the 21st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.435 of 2012. 2. Setting up of saw mills and new wood based industry. No new or expansion of existing saw mills and new wood based industry shall be permitted within the Eco-sensitive Zone.
3. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws. 4. Setting up of industries including new oil and gas exploration causing water or air or soil or noise pollution. No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted.
5. Establishment of major thermal and hydro-electric projects.

Undertaking activities related to tourism like over-flying the national park area by aircraft, hot-air balloons. applicable laws. 8. Rearing of cattle by free grazing. applicable laws. Regulated Activities 12. Fishing.
Regulated under applicable laws. 13. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area except for accommodation for temporary occupation of tourists related to eco- friendly tourism activities. However, beyond one kilometer and upto the extent of the Eco-sensitive Zone all new tourism activities or expansion of existing activities would in conformity with the Tourism Master Plan.
14. Construction activities.

(a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the protected area: Provided that, local people shall be permitted to undertake construction in their land for residential use including the activities listed in sub-paragraph (1) of paragraph 3:

Provided further that the construction activity

related to small scale industries not causing pollution shall be regulated and kept at the minimum with the prior permission from the competent authority as per applicable rules and regulations, if any.
(b) beyond one kilometre upto the extent of Eco sensitive Zone, construction for bona fide local needs shall be permitted and other construction activities shall be regulated as per the Zonal Master Plan.
15. Air and vehicular pollution. 16. Noise pollution.
17. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government;
(b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made there under; (c) in case of Project Forests and Protected Forests the Working Plan prescriptions shall be followed. 18. Discharge of treated effluents and solid waste in natural water bodies or land area. 19. Insulation of electric lines. Promote underground cabling.
20. Widening and strengthening of existing roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable. 21. Fencing of existing premises of hotels and lodges.

Sign boards and hoardings. 23. Movement of vehicular traffic at night. Regulated for commercial vehicles as per the Zonal Master Plan and the applicable laws. 24. Drastic change of agriculture systems or land use pattern. 25. Commercial water resources including ground water harvesting. (a) The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land; (b) extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned regulatory authority; (c) no sale of surface water or ground water shall be permitted;
(d) steps shall be taken to prevent contamination or pollution of water from any source including agriculture. 26. Collection of Forest produce. 27. Pan Jhum.

Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone falling in the State of Assam, which shall comprise of the following, namely:- (i) The Deputy Commissioner, Cachar

(ii) Representative of Principal Secretary (N), North Cachar Hills
Autonomous Council, Haflong

                                 —Member

(iii) The Divisional Forest Officer, Karimganj Division

       —Member

(iv) The Division of Forest Officer, Dima Hasao (West) Forest Division —Member (v) The Regional Ex Eng, RLO, Pollution Control Board, Silchar —Member (vi) The Deputy Chief Engineer, N.F. Railways, Silchar

     —Member

(vii) The Executive Engineer, N.H. Division, Silchar

                  —Member

(viii) The District Transportation Officer, Cachar

     —Member

(ix) The District Agriculture Officer, Cachar

     —Member

(x) The District Veterinary Officer, Cachar

     —Member

(xi) The District Fisheries Development Officer, Cachar

     —Member

(xii) The General Manager, DICC, Cachar

     —Member

(xiii) One expert in the area of ecology and environment to be nominated by
the State Government for a period of one year —Member Promoted Activities 28. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture.
Shall be actively promoted. 29. Organic farming including use of Bio Fertilizer. Shall be actively promoted. 30. Adoption of green technology for all activities. Shall be actively promoted. 31. Cottage industries including village artisans. Shall be actively promoted. 32. Rain water harvesting Shall be actively promoted. 33. Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro- based industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.
34. Use of renewable energy sources. Shall be actively promoted.

(xiv) One representative of Non-Governmental Organisation (working in the
field of environment and heritage conservation) to be nominated by the
State Government for a period of one year —Member (xv) The Divisional Forest Officer, Cachar Division

                —Member-Secretary

Terms of Reference. — (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (3) The activities that are not covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (4) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned Park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (5)
The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (6) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-IV. (7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 6.
The Central Government and State Government may specify additional measures, if any, for giving effect to the provisions of this notification.
