और, अभयारCय का मुQय भाग छोटी पहािड़य& से तरंगी और ढंका )आ है जो अि"तीय वयजीव िनवास के साथ अि"तीय भू-आकृित िवVान सुिवधा के िलए है । अमचांग वयजीव अभयारCय पशुI और पौध& क जाितय& क 9ापक िविवधता के िलए समृ? और िविवध पा रि+थितक आवास& म: से एक का ितिनिधXव करता है । वयजीव अभयारCय म: मुQय पशुI म: )लांक उतक, चीन साल, सूरज-भगत, असिमया लघु पु[छ वानर, केपड लंगूर, लजीला वानर, त:दुआ, हाथी, सांभर, मुंजक, गौर आद पाए जाते ह5 । वयजीव अभयारCय म: प ी जीवजंतु, सरीसृप&, उभयचर& और क ड़े मकोड़े क िव+तृत िविवधता पाई जाती है ।

और, अभयारCय गुवाहाटी शहर क पूव\ सीमा पर अवि+थत है तथा सीमांत े1& म: जैिवक दबाव म: वृि? से अभयारCय का पया वास भािवत हो सकता है । अतः, इसिलए, केीय सरकार, पया वरण (संर ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प ठत पया वरण (संर ण) अिधिनयम, 1986 (1986 का 29) क धारा 3 क उप-धारा (3) और उप-धारा (2) के खंड (v) और खंड (xiv) और उप-धारा (1) "ारा द# शि%य& का योग करते )ए, असम राE य म: अमचांग व यजीव अभयारC य क सीमा से 170 मीटर से 8.1 कलोमीटर तक के िव+ तार तक के े1 को अमचांग व यजीव अभयारC य पा रि+थितक संवेदी जोन (िजसे इसम: इसके प] चात् पा रि+थितक संवेदी जोन कहा गया है) के प म: अिधसूिचत करती है, िजसका िववरण िन ानुसार है,

पारिथितक पारिथितक पारिथितक पारिथितक संवेदी संवेदी संवेदी संवेदी जोन जोन जोन जोन केकेकेके िलए िलए िलए िलए आंचिलक आंचिलक आंचिलक आंचिलक महायोजना महायोजना महायोजना महायोजना – (1) राEय सरकार, पा रि+ थितक संवेदी जोन के िलए राजप1 म: अंितम अिधसूचना के काशन क तारीख से दो वष क अविध के भीतर, +थानीय 9ि%य& के परामश से और इस अिधसूचना म: संलf न अनुबंध& के सामंज+ य से आंचिलक महायोजना तैयार करेगी । (2) आंचिलक महायोजना राE य सरकार म: स म ािधकारी "ारा अनुमोदत होगी ।
(3) राEय सरकार "ारा पा रि+ थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना म: िविन@दg ट प तथा सुसंगत क:ीय और राE य िविधय& के सामंज+ य और क: ीय सरकार "ारा जारी माग िनदhश&, यद कोई ह&, "ारा तैयार होगी । (4)
आंचिलक महायोजना, पया वरणीय और पा रि+थितक िवचार& को समाकिलत करने के िलए राE य सरकार के सभी संब? िवभाग& के परामश से तैयार होगी, अथा त्:- (i) पया वरण; (ii) वन;
(iii) शहरी िवकास; (iv) पय टन; (v) नगरपािलका; (vi) राज+ व;
(vii) कृिष;
(viii) असम राE य दूषण िनयं1ण बोड ;

(ix) lसचाई; और
(x) लोक िनमा ण िवभाग ।

आंचिलक महायोजना अनुमोदत िवmमान भू-उपयोग, अवसंरचना और nयाकलाप& पर कोई िनबoधन अिधरोिपत नहp करेगी जब तक क इस अिधसूचना म: िविन@दg ट न हो और आचंिलक महायोजना सभी अवसंरचना और nयाकलाप& म: और अिधक द ता और पा रि+थितक अनुकूलता का संवध न करेगी ।
(6) आंचिलक महायोजना म: अना[छादत े1& के जीणq?ार, िवmमान जल िनकाय& के संर ण, आवाह े1& के बंधन, जल-संभर& के बंधन, भूतल जल के बंधन, मृदा और नमी संर ण, +थानीय समुदाय& क आव]यकताI तथा पा रि+थितक और पया वरण से संबंिधत ऐसे अय पहलूI, िजन पर rयान देना आव]यक है, के िलए उपबंध ह&गे । (7)
आंचिलक महायोजना सभी िवmमान पूजा + थल&, dाम& और नगरीय बंदोब+त&, वन& के कार और क+ म&, कृिष

े1&, ऊपजाऊ भूिम, ह रत े1 जैसे उmान और उसी कार के + थान, उmान कृिष े1, फलोधान, झील& और अय जल िनकाय& का अuयकंन करेगी । (8)
आंचिलक महायोजना + थानीय समुदाय& क जीवकोपाज न को सुिनि] चत करने के िलए, पा रि+थितक संवेदी जोन म: िवकास को पा रि+थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।
3. राय राय राय राय सरकार सरकार सरकार सरकार ारा ारा ारा ारा कए कए कए कए जाने जाने जाने जाने वाले वाले वाले वाले उपाय उपाय उपाय उपाय-------- राEय सरकार इस अिधसूचना के उपबंध& को भावी करने के िलए िन िलिखत उपाय करेगी, अथा त् :- (1) भूभूभूभू-उपयोग उपयोग उपयोग उपयोग - पा रि+ थितक संवेदी जोन म: वन&, उmान-कृिष े1&, कृिष े1&, आमोद-मोद के योजन के िलए िचिहत कए गए पाकv और खुले +थान& का वािणिEयक और औmोिगक संब? िवकास nयाकलाप& के िलए उपयोग या संप रवत न नहp होगा :
परंतु पा रि+थितक संवेदी जोन के भीतर कृिष भूिम का संप रवत न, मानीटरी सिमित क िसफा रश पर और राEय सरकार के पूव अनुमोदन से, +थानीय िनवािसय& क आवासीय जरत& को पूरा करने के िलए और पैरा 4 क सारणी के +तंभ (2) के अधीन मद सं0 10, 20, 26, 31, और सं. 32 के सामने सूचीब? nयाकलाप& को पूरा करने के िलए अनुVात ह&गे,
अथा त् :- (i) पा रि+ थितक अनुकूल पय टन nयाकलाप& के िलए पय टक& के अ+ थायी आवासन के िलए पा रि+ थितक अनुकूल आरामगाह जैसे ट:ट, लकड़ी के मकान आद; (ii) िवmमान सड़क& को चौड़ा और सुदृढ़ बनाना; (iii) दूषण उXपx न करने वाले लघु उmोग;
(iv) कुटीर उmोग, िजसके अंतग त dामीण उmोग, सुिवधाजनक भCडार और + थानीय सुिवधाएं भी ह5;
(v) वषा जल संचयन । परंतु यह और क जनजातीय भूिम का उपयोग राEय सरकार के पूव अनुमोदन और संिवधान के अनु[ छेद 244 या तXसमय वृ# िविध के उपबंध& के अनुपालन के िबना, िजसके अंतग त अनुसूिचत जनजाित और अय परंपरागत वन िनवासी (वन अिधकार& क मायता) अिधिनयम, 2006 (2007 का 2) भी है, वािणिEयक या उmोग िवकास nयाकलाप& के िलए अनुVात नहp होगा :

परंतु यह और भी क पा रि+ थितक संवेदी जोन के भीतर भू-अिभलेख& म: उपसंजात कोई 1ु ट, मानीटरी सिमित के िवचार ा6 करने के प7ात् राEय सरकार "ारा Xयेक मामले म: एक बार संशोिधत होगी और उ% 1ु ट के संशोधन क

सूचना क: ीय सरकार के पया वरण, वन और जलवायु प रवत न मं1ालय को देनी होगी ।
परंतु यह और भी क उपयु % 1ु ट का संशोधन म: इस उप पैरा के अधीन यथा उपबंिधत के िसवाय कसी भी दशा म: भू-उपयोग का प रवत न सिyमिलत नहp होगा ।
परंतु यह और भी क िजससे ह रत े1 म: जैसे वन े1, कृिष े1 आद म: कोई पा रणािमक कटौती नहp होगी और अनयुz त या अनुX पादक कृिष े1& म: पुन: वनीकरण करने के यास कए जाएंगे ।
(2) ाकृितक जल ोत! ाकृितक जल ोत! ाकृितक जल ोत! ाकृितक जल ोत! -- आंचिलक महायोजना म: सभी ाकृितक जल {ोत& क पहचान क जाएगी और उनके संर ण और पुन|}भूतकरण के िलए योजना सिy मिलत होगी और राE य सरकार "ारा ऐसे े1& पर या उनके िनकट िवकास nयाकलाप ितिष? करने के िलए ऐसी रीित से माग िनदhश तैयार कए जाएंगे । (3) पयटन पयटन पयटन पयटन – (क) पा रि+थितक संवेदी जोन के भीतर पय टन संबंधी nयाकलाप पय टन महायोजना के अनुसार ह&गे जो क आंचिलक महायोजना के भाग प म: होगी ।

(ख) पय टन महायोजना असम सरकार के पय टन िवभाग "ारा वन और पया वरण िवभाग के परामश से तैयार होगी ।
(ग) पय टन संबंधी nयाकलाप िनy निलिखत के अधीन िविनयिमत ह&गे, अथा त् :- (i) पा रि+थितक संवेदी जोन के भीतर सभी नए पय टन nयाकलाप& या िवmमान पय टन nयाकलाप& का िव+तार क: ीय सरकार, पया वरण, वन और जलवायु प रवत न मं1ालय "ारा जारी माग िनदेश& के अनुसार होगा िजसम: पा रि+थितक पय टन, पा रि+थितक िश ा और पा रि+थितक िवकास को महXव दया जाएगा और पा रि+थितक संवेदी जोन क वहन मता के अrययन पर आधा रत होगा ; (ii) पा रि+थितक अनुकूल पय टक nयाकलाप& के संबंध म: अ+थायी अिधभोग के िलए वास सुिवधा के िसवाय अमचांग वयजीव अभयारCय क सीमा से एक कलोमीटर भीतर होटल& और रसोटv का नया संिनमा ण अनुVात नहp होगा । परंतु संरि त े1& क सीमा से एक कलोमीटर क दूरी से परे पा रि+थितक संवेदी जोन क सीमा तक नए होटल और रसोट क +थापना पय टन महायोजना के अनुसार पा रि+थितक पय टन सुिवधा के िलए पूव प रभािषत और िविन@द< +थान म: ही अनुVात कया जाएगा । (iii) आंचिलक महायोजना का अनुमोदन कए जाने तक, पय टन के िलए िवकास और िवmमान पय टन nयाकलाप& के िव+तार को वा+तिवक +थल िविन@द< संवी ा तथा मानीटरी सिमित क िसफा रश पर आधा रत संबंिधत िविनयामक ािधकरण& "ारा अनुVात कया होगा । (4) नैस$गक नैस$गक नैस$गक नैस$गक िवरासत िवरासत िवरासत िवरासत -------- पा रि+थितक संवेदी जोन म: महXवपूण नैस;गक िवरासत के सभी +थल& जैसे सभी जीन कोश आरि त े1, शैल िवरचनाएं, जल पात&, झरन&, घाटी मागv, उपवन&, गुफाएं, +थल&, मण, अरोहण, पात& आद क

पहचान क जाएगी और उह: संरि त कया जाएगा तथा उनक सुर ा और संर ा के िलए इस अिधसूचना के अंितम काशन क तारीख से छह मास के भीतर, उपयु% योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । (5) मानव िन$मत िव मानव िन$मत िव मानव िन$मत िव मानव िन$मत िवरासत थ रासत थ रासत थ रासत थल ल ल ल - पा रि+ थितक संवेदी जोन म: भवन&, संरचनाI, िशप-तय, ऐितहािसक, कलाXमक और सां+कृितक महXव के े1& क पहचान करनी होगी और इस अिधसूचना के अंितम काशन क तारीख से छह माह के भीतर उनके संर ण क योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना म: सिyमिलत क जाएगी ।

(6) & व & व & व & विन दूषण िन दूषण िन दूषण िन दूषण -- पा रि+थितक संवेदी जोन म: r विन दूषण के िनयं1ण के िलए राE य सरकार का पया वरण िवभाग, वायु (दूषण िनवारण और िनयं1ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम& के उपबंध& के अनुसरण म: माग दश क िस?ांत और िविनयम तैयार करेगा ।
(7) वायु वायु वायु वायु दूषण दूषण दूषण दूषण -- पा रि+थितक संवेदी जोन म:, वायु दूषण के िनयं1ण के िलए राEय सरकार का पया वरण िवभाग, वायु (दूषण िनवारण और िनयं1ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम& के उपबंध& के अनुसरण म: माग दश क िस?ांत और िविनयम तैयार करेगा ।
(8) बिहाव बिहाव बिहाव बिहाव का का का का िनसारण िनसारण िनसारण िनसारण -- पा रि+थितक संवेदी जोन म: उपचा रत बिह{ाव का िन+सारण, जल (दूषण िनवारण तथा िनयं1ण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयम& के उपबंध& के अनुसार होगा । (9) ठोस ठोस ठोस ठोस अपिश. अपिश. अपिश. अपिश. -------- ठोस अपिश<& का िनपटान िन िलिखत प म: होगा - (i) पा रि+थितक संवेदी जोन म: ठोस अपिश<& का िनपटान भारत सरकार के तXकालीन पया वरण और वन मं1ालय क समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 908(अ), तारीख 25 िसतंबर, 2000 नगरपािलक ठोस अपिश< (बंध और हथालन) िनयम, 2000 के उपबंध& के अनुसार कया जाएगा ; (ii) +थानीय ािधकरण जैव िन ीकरणीय और अजैव िन ीकरणीय संघटक& म: ठोस अपिश<& के संपृथन के िलए योजनाएं तैयार कर:गे ;
(iii) जैव िन ीकरणीय सामdी को अिधमानतः खाद बनाकर या कृिम खेती के माrयम से पुनःचnत कया जाएगा ;
(iv) अकाब िनक सामdी का िनपटान पा रि+थितक संवेदी जोन के बाहर पहचान कए गए + थल पर कसी पया वरणीय +वीकृत रीित म: होगा और पा रि+थितक संवेदी जोन म: ठोस अपिशg ट& को जलाना या भg मीकरण अनुVात नहp होगा।

(2) आरा मील& क +थापना । पा रि+थितक संवेदी जोन के भीतर नई और िवmमान आरा मील& का िव+ तार अनुVात नहp होगा ।
(3) कसी प रसंकटमय पदाथv का उपयोग या उXपादन । लागू िविधय& के अनुसार ितिष? (अ यथा उपबंिधत के
िसवाय) । (4) जल या वायु या मृदा या r विन दूषण का रत करने वाले उmोग&, िजसके अंतग त तेल और गैस क नई खोज भी है, क

थापना। पा रि+थितक संवेदी जोन के भीतर कसी नए और दूषण का रत करने वाले िवmमान उmोग& का िव+ तार अनुVात नहp होगा । (5) नए ताप और मुQय जल िवmुत प रयोजनाI क +थापना । लागू िविधय& के अनुसार ितिष? (अ यथा उपबंिधत के
िसवाय) । (6) जलावन लकड़ी का वािणिEयक
उपयोग । लागू िविधय& के अनुसार ितिष? (अ यथा उपबंिधत के
िसवाय) । (7) पय टन से संबंिधत nयाकलाप जैसे गम वायु गु2 बार& आद "ारा राीय उmान के ऊपर से उड़ना जैसे nयाकलाप करना। लागू िविधय& के अनुसार ितिष? (अ यथा उपबंिधत के

NOTIFICATION New Delhi, the 18th March, 2016 S.O.1166(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forests and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Aliganj, New Delhi-110003, or send it to the e-mail address of the Ministry at esz-mef@nic.in Draft Notification Whereas, the Amchang Wildlife Sanctuary situated in Kamrup District of State of Assam consists of Amchang Reserve Forest, South Amchang Reserve Forest and Khanapara Reserve Forest and located within the geographical limits of 26o 13′N to 26o 06′ N latitude and 91o 50′ E to 91o 58′ longitude and is spread over an area of 78.64 square kilometers; And whereas, major portion of the sanctuary is undulating and covered by hillocks which forms a unique geomorphologic feature with unique wildlife habitat. The Amchang Wildlife Sanctuary represents one of the rich and ecologically diverse habitat for the wide variety of animals and plant species. Hollockgibbon, Chinese pangolin, Flying squirrel, Assamese Macaque, Capped languor, Slow loris, Leopard, Elephant, Sambar, Barking Deer, Gaur etc., are the principal animals found in the wildlife sanctuary. In addition to these a wide variety of avian fauna, reptiles, amphibians and insects are found in the wildlife sanctuary;

And whereas, the sanctuary is located on the eastern limit of Guwahati city and the increase in biotic pressure in the fringe areas can affect the habitat of the sanctuary;

   Now therefore, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-

section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby
notifies an area to an extent varying from 170 meters to 8.1 kilometre around the boundary of Amchang Wildlife Sanctuary in the State of Assam as Eco-sensitive Zone of Amchang Wildlife Sanctuary (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-

Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone is spread over an area of 109.99 square kilometres with an extent varying from 170 meters to 8.1 kilometre around the boundary of
Amchang Wildlife Sanctuary and boundary description of Zone of such is given in Annexure-I. (2) The list of 37 villages falling with the Eco-sensitive Zone is appended as Annexure-II.
(3) The map of the Eco-sensitive Zone along with latitude and latitude is appended as Annexure-III.
Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2)
The Zonal Master Plan shall be approved by the competent authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i)
Environment; (ii)
Forest; (iii)
Urban Development; (iv)
Tourism; (v)
Municipal;
(vi)
Revenue; (vii)
Agriculture; (viii) Assam State Pollution Control Board; (ix)
Irrigation; and (x)
Public Works Department,
for integrating environmental and ecological considerations into it.
(5)
The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco- friendly development for livelihood security of local communities.

Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government,

to meet the residential needs of local residents, and for the activities listed against serial numbers 10, 20, 26, 31 and 32 in column (2) of the Table in paragraph 4, namely:- (i)
Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities; (ii)
widening and strengthening of existing roads and construction of new roads; (iii)
small scale industries not causing pollution;
(iv)
rainwater harvesting; and
(v) cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by Department of Tourism of the State Government in consultation with Department of Forests and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i)
all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco- development and based on carrying capacity study of the Eco-sensitive Zone; (ii)
new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Amchang Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(iii)
till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc., shall be identified and presented and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for

their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Assam State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder. (7) Air pollution.- The Environment Department of the State Government or Assam State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- No discharge of untreated effluent shall be permitted. The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder. (9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into Bio-degradable and non- Bio-degradable components; (iii) the Bio-degradable material shall be recycled preferably through composting or vermiculture; (iv) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone. (10) Bio-medical waste.- The Bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time. (11) Vehicular traffic.-The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Industrial units.-(a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the law. (b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco- sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the table below, namely:-

Union of India in Writ Petition (Civil) No. 435 of 2012. 2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws. 4. Setting up of industries including new oil and gas exploration causing water or air or soil or noise pollution. No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted.
5. Establishment of major thermal and hydro-electric projects.
Prohibited (except as otherwise provided) as per applicable laws. 6. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws. 7. Undertaking activities related to tourism like over-flying the national park area by aircraft, hot-air balloons. Prohibited (except as otherwise provided) as per applicable laws. 8. Discharge of untreated effluents and solid waste in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws.

Use of plastic bags. Prohibited (except as otherwise provided) as per applicable laws.

Regulated Activities 10. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area except for accommodation for temporary occupation of tourists related to Eco- friendly tourism activities. However, beyond one kilometer and up to the extent of the Eco-sensitive

Zone all new tourism activities or expansion of existing activities would be in conformity with the Tourism Master Plan and National Tiger Conservation Authority guidelines. 11. Construction activities.

(a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the protected area: Provided that local people shall be permitted to undertake construction in their land for residential use including the activities listed in sub-paragraph (1) of paragraph 3.
(b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum with the prior permission from the competent authority as per applicable rules and regulations, if any.
(c) beyond one kilometre up to the extent of Eco- sensitive Zone construction for bona fide local needs shall be permitted and other commercial construction activities shall be regulated as per Zonal Master Plan.
(d) construction activity in the Eco-sensitive Zone shall be as per Zonal Master Plan.
12. Air and vehicular pollution. Regulated under applicable laws. 13. Noise pollution.
14. Extraction of ground water. 15. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government;
(b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made there under; (c) in case of reserve forests and protected forests the Working Plan prescriptions shall be followed. 16. Discharge of treated effluents and solid waste in natural water bodies or land area. 17. Erection of electric cables and telecommunication towers.

Promote underground cabling. All existing electric lines passing through the Eco-sensitive Zone shall be adequately insulated in the time frame prescribed under the Zonal Master Plan.
18. Setting up of security camps.

Construction of ropeways. 20. Widening and strengthening of existing roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable. 21. Fencing of existing premises of hotels and lodges.

Sign boards and hoardings. 23. Movement of vehicular traffic at night. Regulated for commercial the applicable laws. 24. Drastic change of agriculture systems or land use pattern. 25. Commercial water resources including ground water harvesting. (a) The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land; (b) extraction of surface water and ground water for industrial or commercial use including the
amount that can be extracted, shall require prior written permission from the concerned regulatory authority; (c) no sale of surface water or ground water shall be permitted;
(d) steps shall be taken to prevent contamination or pollution of water from any sources including agriculture. 26. Small scale industries not causing pollution. Non-polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the Eco- sensitive Zone, and which do not cause any adverse impact on environment shall be permitted. 27. Introduction of exotic species. Permitted Activities 28. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, cattle rearing, aquaculture.

Terms of Reference.- (1)The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (3) The activities that are not covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (4) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned Park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (5)
The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (6) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at Annexure-IV. (7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7.
The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

ANNEXURE – I BOUNDARY DESCRIPTION OF PROPOSAL ECO-SENSITIVE ZONE OF AMCHANG WILDLIFE SANCTUARY North : Northern boundary of the proposed Eco-sensitive Zone of Amchang Wildlife Sanctuary starts from Eco-sensitive Zone point No. 1 located on the level crossing of Railway tract at Panikhaiti at the northern side of the tract (GPS Co-ordinate N 26o 12′ 14.7″ E 91o 51′ 29.4″) and crosses the River Brahmaputra and meets point No. 2 at a distance of 7415 mtrs. (GPS Co-ordinate N 26o 16′ 15.7″ E 91o 51′ 26.4″). Then it runs towards north east direction. From Eco-sensitive Zone point No. 2 to Eco-sensitive Zone point No. 3 for a distance of 6454 metres. The boundary runs
along the north bank of river Brahmaputra and meet Eco-sensitive Zone point
No. 3 (GPS Co-ordinate N 26o 16′ 56.7″ E 91o 55′ 14.6″). From Eco-sensitive Zone point No. 3 to Eco-sensitive Zone point No. 4 it runs towards south east
direction and crosses the River Brahmaputra and reaches the ESZ point No. 4 at a distance of 4983 mtrs. (GPS Co-ordinates N 26o 15′ 05.3″ E 91o 57 25.0″) to the south bank where it meets the Kolong River. From Eco-sensitive Zone point No. 4 to ESZ point No. 5 it runs up to the south- east corner of Kolong river bridge
on the SH-3 at a distance of 856 mtrs. (GPS Co-ordinate N 26o 14′ 38.2″ E 91o 57′ 31.9″). From Eco-sensitive Zone point No. 5 to Eco-sensitive Zone point No. 6 the boundary line runs for a distance of 2454 meter. (GPS Co-ordinate N 26o 14′ 0.6″ E 91o 56′ 31.9″) passes through near Chandrapur Digaru PWD road. From Eco-sensitive Zone point No. 6 to Eco-sensitive Zone point No. 7 the boundary line runs towards south for a distance of 977 meter. (GPS Co-ordinate N 26o 13′ 28.9″
E 91o 56′ 16.1″) on the same road after crossing the railway tract. East :

From Eco-sensitive Zone point No. 7 to Eco-sensitive Zone point No. 8
the boundary line runs towards east for a distance of 2412 meters (GPS Co-ordinate N 26o13′11.2″ E 91o57′ 40.8″) on the north edge of the same road and west ward of the railway tract. From Eco-sensitive Zone point No. 8 to Eco-sensitive Zone point No. 9 the Boundary line runs towards south for a distance of 626 meters. (GPS
Co-ordinate N 26o12′50.9″ E 91o 57′ 39.5″) on the eastern side of Chandrapur- Digaru Public Works Department road. From Eco-sensitive Zone point No. 9 to Eco-sensitive Zone point No. 10 the boundary line runs towards south east direction for a distance of 455 meters. (GPS Co-ordinate N 26o12′39.6″ E 91o 57′ 50.1″) and meets the western bank of Digaru River after crossing the railway tract. From
Eco-sensitive Zone point No. 10 to Eco-sensitive Zone point No. 11 the boundary line runs towards south for a distance of 890 meters. (GPS Co-ordinate N 26o12′11.4″ E 91o 57′ 57.3″) on the south edge of Chandrapur Digaru Public Works Department road after crossing the railway tract. From Eco-sensitive Zone point No. 11 to Eco-sensitive Zone point No. 12 the boundary line runs towards south for a distance of 409 mtrs. From Eco-sensitive Zone point No. 14 to Eco-sensitive Zone point No. 15 the boundary line runs towards south for a distance of 1106 meters. From Eco-sensitive Zone point No. 15 to Eco-sensitive Zone point No. 16 the boundary lines runs towards south for a distance of 1717 meters. From Eco-sensitive Zone point No. 16 to Eco-sensitive Zone point No. 17 the boundary line runs towards south for a distance of 723 meters. point No. 18 the boundary line runs towards south for a distance of 1208 meters.

From Eco-sensitive Zone point No. 18 to Eco-sensitive Zone point No. 19 the boundary line runs towards south west direction for a distance of 736 meters. (GPS Co-ordinate N 26o07′26.0″ E 91o 56′ 03.9″) to the south of Lalmati Village. From Eco-sensitive Zone point No. 19 to Eco-sensitive Zone point No. 20 the boundary line runs towards west for a distance of 478 meters. (GPS Co-ordinate N 26o07′20.7″ E 91o 55′ 47.7″) in the northern side of NH-37 at Nazirakhat area. From Eco-sensitive Zone point No. 20 to Eco-sensitive Zone point No. 21 the boundary line runs towards west for a distance of 766 meters. (GPS Co-ordinate N 26o07′21.3″ E 91o 55′ 20.1″) to the north of NH-37 in Nazirakhat area. E 91o 54′ 52.6″) and meets the northern side of NH-37 in Tepesia area. From Eco- sensitive Zone point No. 22 to Eco-sensitive Zone point No. 23 the boundary line runs towards south-west direction and crosses the NH-37 at a distance of 649 meters. From Eco-sensitive Zone point No. 23 to Eco-sensitive Zone point No. 24 the boundary line runs towards west for a distance of 1517 meters. From Eco-sensitive Zone point No. 23 to Eco-sensitive Zone point No. 26 the distance in between the protected area boundary and the Eco-sensitive Zone boundary is 300 meter.
West : From Eco-sensitive Zone point No. 29 to Eco-sensitive Zone point No. 30 the boundary line runs towards north for a distance of 1083 meters. (GPS Co-ordinate N 26o07′42.5″ E 91o49′08.3″) and runs behind the Veterinary College Hostel, Khanapara. From Eco-sensitive Zone point No. 30 to Eco-sensitive Zone point No. 31 the boundary line runs towards north for a distance of 566 meters. Kalakhetra then meets the southern side of Six Mile- Panjabari Public Works Department road. From Eco-sensitive Zone point No. 31 to Eco-sensitive Zone point No. 32 the boundary line runs along the Six mile Pannjabari road till it meet Army gate for a distance of 1141 meters. From Eco-sensitive Zone point No. 36 to Eco-sensitive Zone point No. 37 the boundary line runs along the eastern side of Khanapara–Narengi VIP express Highway for a distance of 1842 meters. From Eco-sensitive Zone point No. 37 to Eco-sensitive Zone point No. 38 the boundary line runs towards north up to Vidyarthi Bhaban after crossing the Railway tract near Narengi Tiniali for a distance of 1081 meters.
