मॉ>लग रा?ीय उ@ान (िजसे इसम& इसके पBात रा?ीय उ@ान कहा गया है) 28°35′उ अ:ांश और 94°52′पू देशांतर म& िCथत है और अDणाचल देश म& ऊपरी िसयांग और िसयांग िजल- म& िCथत है। इसम& पूवH िहमालयी जैव-िविवधता हॉट- Cपॉट का एक भाग शािमल है और यह दीहंग-दबांग जैवमंडल रजव का पिBमी भाग है; और और और और, यह रा?ीय उ@ान िविभK कार के वन :े#- का ितिनिध9व करता है िजनम& उLणक टबंधीय और अध सदाबहार उप-उLणक टबंधीय बड़ी पि4य- वाले वन और उप-समशीतोLण बड़ी पि4य- वाले वन सिNमिलत हO और यहां क$ मुख वनCपित उपोLणक टबंधीय वन, , , , आP समशीतोLण वन, , , , शंकुधारी वन और बांस वन हO; और और और और, इस रा?ीय उ@ान के पा रिCथितक$य, वानCपितक, जीवजQतु सNबQधी और ाकृितक मह9व को देखते <ए इसे राSय क$ राजप# अिधसूचना सं. एफओआर/55/जीईएन/81, तारीख 30 दसंबर, 1986 के %ारा अिधसूिचत कया था और इसका :े#फल 483 वग कलोमीटर है और यह उ@ान ज&>गग म& िCथत संभागीय वन कायालय के शासिनक अिधकार :े# म& आता है और अलॉग एवं पासीघाट शहर इसके िनकटतम शहर हO जो इससे Yमशः लगभग 130 कलोमीटर और 185 कलोमीटर क$ दूरी पर है;

   (3) भू-मoडलीय िCथित णाली िनदsशांक- क$ दृिy म& मॉ>लग राyीय उ@ान और इसके पा रिCथितक$ संवेदी जोन के भू-िनदsशांक उपाबंध उपाबंध उपाबंध उपाबंध-II के प म& संल„ हO। (4) पा रिCथितक$ संवेदी जोन का गूगल पृ वी मानिच# उपाबंध उपाबंध उपाबंध उपाबंध-III के प म& संल„ है। (5) भू-िनदsशांक- के साथ मॉ>लग रा?ीय उ@ान पा रिCथितक$ संवेदी जोन का मानिच# उपाबंध उपाबंध उपाबंध उपाबंध-IV के प म& संल„ हO। (6) अDणाचल देश राSय म& मॉ>लग रा?ीय उ@ान क$ अविCथित को दशाने वाला राSय मानिच# उपाबंध उपाबंध उपाबंध उपाबंध-V के प म& संल„ हO।
2. पारिथितक पारिथितक पारिथितक पारिथितक संवेदी संवेदी संवेदी संवेदी जोन जोन जोन जोन केकेकेके िलए िलए िलए िलए आंचिलक आंचिलक आंचिलक आंचिलक महायोजना महायोजना महायोजना महायोजना.–(1) राSय सरकार, पा रिCथितक$ संवेदी जोन के योजन के िलए, राजप# म& अंितम अिधसूचना के काशन क$ तारीख से दो वष क$ अविध के भीतर, Cथानीय +ि,य- के परामश से और इस अिधसूचना म& दए गए अनुबंध- का पालन करते <ए, राSय सरकार के स:म ािधकारी के अनुमोदनाथ, एक आंचिलक महायोजना बनाएगी। (2) राS य सरकार %ारा पा रिCथितक$ संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना म& िविनxदL ट रीित से तथा ासंिगक क& Pीय और राS य िविधय- के अनु प तथा क&Pीय सरकार %ारा जारी दशा िनदsश-, यद कोई ह-, के अनुसार बनायी जाएगी । (3)
   आंचिलक महायोजना उ, योजनाय& पा रिCथितक$ और पयावरण संबंधी सरोकार- को सिNमिलत करने के िलए इसे राS य सरकार के िनƒिलिखत िवभाग- के परामश से बनाया जाएगा, अथात्:-- (i) पयावरण; (ii) वन और वQयजीव;
   (iii) कृिष और बागवानी;

(iv) राजC व; (v) शहरी िवकास; (vi) पयटन;
(vii) ]ामीण िवकास;
(viii)

सचाई और बाढ़ िनयं#ण; (ix) नगरपािलका;
(x) पंचायती राज; और
(xi) लोक िन माण िव भाग। (4)
जब तक इस अिधसूचना म& िविनxदy न हो, आंचिलक महायोजना म& वतमान म& अनुमोदत भू-उपयोग, अवसंरचना और Yयाकलाप- पर कोई ितबंध नह7 लगाया जाएगा और आचंिलक महायोजना म& सभी अवसंरचनाv और Yयाकलाप- म& सुधार करके उQहे अिधक द: और पा रिCथितक$-अनुकूल बनाने क$ +वCथा क$ जाएगी।
(5) आंचिलक महायोजना म& वनरिहत और अवYिमत :े#- के सुधार, िव@मान जल िनकाय- के संर:ण, आवाह :े#- के बंधन, जल-संभर- के बंधन, भू-जल के बंधन, मृदा और नमी के संर:ण, Cथानीय जनता क$ आव{यकताv तथा पा रिCथितक$ एवं पयावरण के ऐसे अQय पहलुv क$ +वCथा क$ जाएगी िजन पर ‡यान दया जाना आव{यक है।

आंचिलक महायोजना म& सभी िव@मान पूजा C थल-, ]ाम- एवं शहरी बिCतय-, वन- क$ \ेिणय- एवं कC म-, कृिष :े#-, ऊपजाऊ भूिम, उ@ान- एवं उ@ान- क$ तरह के ह रत :े#-, बागवानी :े#-, बगीच-, झील- और अQय जल िनकाय- क$ सीमा का िनधारण कया जाएगा तथा सहायक मानिच# भी दया जाएगा और इस महायोजना म& िव@मान और Cतािवत भू- उपयोग क$ िवशेषताv का 1यौरा देने वाले मानिच# भी दए जाएंगे। (7) आंचिलक महायोजना म& पा रिCथितक$ संवेदी जोन म& होने वाले िवकास का िविनयमन कया जाएगा और पैरा]ाफ 4 म& सारणी म& सूचीबh ितिषh एवं िविनयिमत Yयाकलाप- का पालन कया जाएगा और इसम& C थानीय जनता क$ आजीिवका क$ सुर:ा के िलए पा रिCथितक$-अनुकूल िवकास का भी सुिनBय एवं संवधन कया जाएगा।
(8) आंचिलक महायोजना, :े#ीय िवकास योजना क$ सह-कािलक होगी । (9) आंचिलक महायोजना पा रिCथितक$ संवेदी जोन म& िवकास को िविनयिमत कया जाएगा ताक C थानीय समुदाय- क$ आजीिवका सुर:ा के िलए, पा रिCथितक$ अनुकूल िवकास सुिनि{ चत कया जा सके।

3. रा य रा य रा य रा य सरकार सरकार सरकार सरकार ारा ारा ारा ारा कए कए कए कए जाने जाने जाने जाने वाले वाले वाले वाले उपाय उपाय उपाय उपाय.- राSय सरकार इस अिधसूचना के उपबंध- को भावी बनाने के िलए िनƒिलिखत उपाय करेगी, अथात्:-- (1) भूभूभूभू-उपयोग. उपयोग. उपयोग. उपयोग.– (क) पा रिCथितक$ संवेदी जोन म& वन-, बागवानी :े#-, कृिष :े#-, मनोरंजन के िलए िचिQहत उ@ान- और खुले Cथान- का वृहद वािणिSयक या आवासीय प रसर- या औ@ोिगक Yयाकलाप- के िलए योग या संप रवतन अनु‰ात नह7 कया जाएगा: परंतु पा रिCथितक$ संवेदी जोन के भीतर भाग (क) म& िविनxदy योजन से िभK योजन के िलए कृिष और अQय भूिम का संप रवतन, िनगरानी सिमित क$ िसफा रश पर और स:म ािधकारी के पूव अनुमोदन से, :े#ीय नगर योजना अिधिनयम तथा यथा लागू केQPीय या राSय सरकार के अQय िनयम- एवं िविनयम- के अधीन तथा इस अिधसूचना के उपबंध- के अनुसार Cथानीय िनवािसय- क$ िनƒिलिखत आवासीय ज रत- को पूरा करने के िलए अनु‰ात कया जाएगा- (i) िव@मान सड़क- को चौड़ा करना, उQह& सुदृढ करना और नई सड़क- का संिनमाण करना; (ii) बुिनयादी ढांच- और नाग रक सुिवधाv का संिनमाण और नवीकरण; (iii) दूषण उ9पK न करने वाले लघु उ@ोग;
   (iv) कुटीर उ@ोग एवं ]ाम उ@ोग; पा रिCथितक$ पयटन म& सहायक सुिवधा भoडार, Cथानीय सुिवधाएं तथा ]ह वास; और
   (v) बढ़ावा दए गए और पैरा-4 म& उिलिखत Yयाकलाप:

5 परंतु यह भी क :े#ीय शहरी िनयोजन अिधिनयम के अधीन स:म ािधकारी के पूव अनुमोदन के िबना तथा राSय सरकार के अQय िनयम- एवं िविनयम- एवं संिवधान के अनुŒछेद 244 के उपबंध- तथा त9समय वृ4 िविध, िजसके अंतगत अनुसूिचत जनजाित और अQय परंपरागत वन िनवासी (वन अिधकार- क$ माQयता) अिधिनयम, 2006 (2007 का 2) भी आता है, का अनुपालन कए िबना वािणिSयक या औ@ोिगक िवकास Yयाकलाप- के िलए जनजातीय भूिम का योग अनु‰ात नह7 होगा:
परंतु यह भी क पा रिC थितक$ संवेदी जोन के अंतगत आने वाली भूिम के अिभलेख- म& <ई कसी #ु ट को, िनगरानी सिमित के िवचार ा; करने के पBात राSय सरकार %ारा 9येक मामले म& एक बार सुधारा जाएगा और उ, #ु ट को सुधारने क$ सूचना क& Pीय सरकार के पयावरण, वन और जलवायु प रवतन मं#ालय को दी जाएगी:
परंतु यह भी क उपयु, #ु ट को सुधारने म&, इस उप-पैरा म& यथा उपबंिधत के िसवाय, कसी भी दशा म& भू-उपयोग का प रवतन सिNमिलत नह7 होगा ।
(ख) अनु युp त या अनु9 पादक कृिष :े#- म& पुन: वनीकरण तथा पयावास- और जैव- िविवधता क$ बहाली के यास कए जाएंगे ।

(ख) पा रिCथितक$ पयटन महायोजना राSय सरकार के पयावरण और वन िवभाग- के परामश से पयटन िवभाग %ारा बनायी जाएगी;
(ग) पयटन महायोजना आंचिलक महायोजना का घटक होगी । (घ) पा रिCथितक$ पयटन संबंधी Yयाकलाप िनN नानुसार िविनयिमत कए जाएंगे, अथात् :- (i) रा?ीय उ@ान क$ सीमा से एक कलोमीटर के भीतर या पा रिCथितक$ संवेदी जोन क$ सीमा तक, इनम& जो भी अिधक िनकट हो, कसी होटल या रसोट का नया सिKमाण अनु‰ात नह7 कया जाएगा।

परQतु, पा रिCथितक$ पयटन सुिवधाv के िलए रा?ीय उ@ान क$ सीमा से एक कलोमीटर क$ दूरी से परे पा रिCथितक$ संवेदी जोन क$ सीमा तक पूव प रभािषत और अभीिहत :े#- म& पयटन महायोजना के अनुसार, नए होटल- और रसोट क$ Cथापना अनु‰ात होगी। (ii) पा रिCथितक संवेदी जोन के भीतर सभी नए पयटन Yयाकलाप- या िव@मान पयटन Yयाकलाप- का िवCतार पा रिCथितक$ पयटन पर जोर देते <ए क& Pीय सरकार के पयावरण, वन और जलवायु प रवतन मं#ालय के मागदशक िसhांत- के %ारा तथा राL bीय ` या संर:ण ािधकरण, %ारा जारी पा रिCथितक पयटन (समय-समय पर यथा संशोिधत) मागदशक िसhांत- के अनुसार होगा; (iii) आंचिलक महायोजना का अनुमोदन कए जाने तक पयटन के िलए िवकास और िव@मान पयटन Yयाकलाप- के िवCतार वाCतिवक Cथल िविनxदy संवी:ा तथा मानीटरी सिमित क$ िसफा रश पर सNबh िविनयामक ािधकारी %ारा अनु‰ात कया जाएगा और कसी नए होटल, रस8ट या वािणिSयक Cथापन- के संिनमाण क$ अनु‰ा नह7 दी जाएगी। (4) ाकृितक िवरासत ाकृितक िवरासत ाकृितक िवरासत ाकृितक िवरासत.– पा रिCथितक$ संवेदी जोन के अंतगत आने वाले ब<मूय ाकृितक िवरासत के सभी Cथल- जैसे क जीन पूल रजव :े#, शैल संरचना, जल पात, झरने, दरs, उपवन, गुफाएं, Cथल, वनपथ, रोहण माग, उ9 पात आद क$ पहचान क$ जाएगी और उनक$ सुर:ा एवं संर:ण के िलए आंचिलक महायोजना के भाग के प म& एक िवरासत संर:ण योजना बनायी जाएगी।

(6)  व  व  व  विन दूषण िन दूषण िन दूषण िन दूषण.- पयावरण अिधिनयम के अधीन ‡विन दूषण (िविनयमन और िनयं#ण) िनयम, 2000 म& िनयत उपबंध- के अनुसरण म& पा रिCथितक$ संवेदी जोन म& ‡विन दूषण के िनयं#ण के िलए िविनयम- और उसके अधीन समय समय पर बनाए गए संशोिधत िनयम- को कायािQवत करेगा।
(7) वायु वायु वायु वायु दूषण दूषण दूषण दूषण .- पा रिCथितक$ संवेदी जोन म& वायु दूषण क$ रोकथाम और िनयं#ण, वायु ( दूषण िनवारण और िनयं#ण) अिधिनयम, 1981 (1981 का 14) के उपबंध- और उसके अधीन बनाए गए िनयम- और उनम& कए गए संशोधन- के अनुसार कया जाएगा।
(8) बिहाव बिहाव बिहाव बिहाव का का का का िनसारण िनसारण िनसारण िनसारण.- पा रिCथितक$ संवेदी जोन म& उपचा रत बिहाव का िनCसारण, पयावरण अिधिनयम और उसके अधीन बनाए गए िनयम- के अधीन सिNमिलत कए गए पयावरणीय दूषण के िनCसारण संबंधी साधारण मानक- या राSय सरकार %ारा िनयत मानक-, इनम& जो भी अिधक कठोर ह-, के अनुसार कया जाएगा।
(9) ठोस ठोस ठोस ठोस अपिश( अपिश( अपिश( अपिश(.- ठोस अपिशy का िनपटान एवं बQधन िनƒानुसार कया जाएगा:- (i) पा रिCथितक$ संवेदी जोन म& ठोस अपिशy का िनपटान और बंधन भारत सरकार के पयावरण, वन और जलवायु प रवतन मं#ालय क$ अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अ ैल, 2016 के अधीन कािशत ठोस अपिशy बंधन िनयम, 2016 के उपबंध- के अनुसार कया जाएगा; अकाबिनक पदाथ‘ का िनपटान पा रिCथितक$ संवेदी जोन से बाहर िचिQहत कए गए Cथान- पर पयावरण-अनुकूल रीित से कया जाएगा; (ii) पा रिCथितक$ संवेदी जोन म& माQय ौ@ोिगकय- (ई एस एम) का योग करते <ए िव@मान िनयम- और िविनयम- के अनु प ठोस अपिशy का सुरि:त और पयावरण-अनुकूल बंधन अनु‰ात कया जाएगा। (10) जैव िचक+सा अपिश, ट जैव िचक+सा अपिश, ट जैव िचक+सा अपिश, ट जैव िचक+सा अपिश, ट.- जैव िचक9सा अपिशL ट का बंधन िनƒानुसार कया जाएगा:- (i) पा रिCथितक$ संवेदी जोन म& जैव िचक9सा अपिशy का िनपटान भारत सरकार के पयावरण, वन और जलवायु प रवतन मं#ालय क$ अिधसूचना सं.सा.का.िन 343 (अ), तारीख 28 माच, 2016 के अधीन कािशत जैव िचक9सा अपिशy बंधन िनयम, 2016 के उपबंध- के अनुसार कया जाएगा;
(ii) पा रिCथितक$ संवेदी जोन म& माQय ौ@ोिगकय- (ई एस एम) का योग करते <ए िव@मान िनयम- और िविनयम- के अनु प ठोस अपिशy का सुरि:त और पयावरण-अनुकूल बंधन अनु‰ात कया जाएगा। (11) -लािटक अपिश( का बंधन -लािटक अपिश( का बंधन -लािटक अपिश( का बंधन -लािटक अपिश( का बंधन. - पा रिCथितक$ संवेदी जोन म& ^लािCटक अपिशy का बंधन, भारत सरकार के पयावरण, वन और जलवायु प रवतन मं#ालय क$ समय-समय पर यथा संशोिधत अिधसूचना सं.सा.का.िन 340(अ), तारीख 18 माच, 2016 के अधीन कािशत ^लािCटक अपिशy बंधन िनयम, 2016 के उपबंध- के अनुसार कया जाएगा। (12) िनमाण और िववंस अपिश( का बंधन िनमाण और िववंस अपिश( का बंधन िनमाण और िववंस अपिश( का बंधन िनमाण और िववंस अपिश( का बंधन.- पा रिCथितक$ संवेदी जोन म& िनमाण और िव‡वंस अपिशy का बंधन, भारत सरकार के पयावरण, वन और जलवायु प रवतन मं#ालय क$ समय-समय पर यथा संशोिधत अिधसूचना सं.सा.का.िन 317(अ), तारीख 29 माच, 2016 के अधीन कािशत संिनमाण और िव‡वंस अपिशy बंधन िनयम, 2016 के उपबंध- के अनुसार कया जाएगा। (13) ई–अपिश(. अपिश(. अपिश(. अपिश(.- पा रिCथितक$ संवेदी जोन म& ई–अपिशy का बंधन, भारत सरकार के पयावरण, वन और जलवायु प रवतन मं#ालय %ारा कािशत तथा समय-समय पर यथा संशोिधत ई–अपिशy बंधन िनयम, 2016 के उपबंध- के अनुसार कया जाएगा। (14) यानीय परवहन. यानीय परवहन. यानीय परवहन. यानीय परवहन.- वाहन-यातायत का संचलन आवास-अनुकूल तरीके से िविनयिमत कया जाएगा और इस संबंध म& आंचिलक महायोजना म& िवशेष उपबंध सिNमिलत कए जाएंगे तथा आंचिलक महायोजना के तैयार होने और राSय सरकार के स:म ािधकारी %ारा अनुमोदत कए जाने तक, िनगरानी सिमित ासंिगक अिधिनयम- और उनके तहत बनाए गए िनयम- एवं िविनयम- के अनुसार वाहन- क$ आवाजाही के अनुपालन क$ िनगरानी करेगी।

(ii) जब तक इस अिधसूचना म& िविनxदy न हो, पा रिCथितक$ संवेदी जोन म& क&Pीय दूषण िनयं#ण बोड %ारा फरवरी, 2016 म& जारी दशािनदsश- म& कए गए उ@ोग- के वगHकरण के अनुसार केवल गैर- दूषणकारी उ@ोग- क$ Cथापना अनु‰ात होगी और इसके अित र,, गैर- दूषणकारी कुटीर उ@ोग- को बढ़ावा दया जाएगा। (17)

2. दूषण (जल, वायु, मृदा, ‡विन आद) उ9पK करने वाले उ@ोग- क$ Cथापना । पा रिCथितक$ संवेदी जोन म& कोई नया उ@ोग लगाने और वतमान दूषणकारी उ@ोग- का िवCतार करने क$ अनु‰ा नह7 दी जाएगी: परQतु यह क जब तक क इस अिधसूचना म& िविनxदy न हो, पा रिCथितक$ संवेदी जोन म& फरवरी, 2016 म& क&Pीय दूषण िनयं#ण बोड %ारा जारी दशािनदsश- म& कए गए उ@ोग- के वगHकरण के अनुसार केवल गैर- दूषणकारी उ@ोग- क$ Cथापना होगी। इसके अित र,, गैर- दूषणकारी कुटीर उ@ोग- को ो9साहन दया जाएगा।

5. ाकृितक जल िनकाय- या भूिम :े# म& अनुपचा रत बिहाव- का िनCसारण । लागू िविधय- के अनुसार ितिषh (अQयथा उपबंिधत के िसवाय) ह-गे। 6. नई आरा िमल- क$ Cथापना। पा रिCथितक$ संवेदी जोन म& नई आरा िमल- क$ Cथापना और िव@मान आरा िमल- का िवCतार अनु‰ात नह7 होगा ।
7. •ट भ˜- क$ Cथापना । लागू िविधय- के अनुसार ितिषh (अQयथा उपबंिधत के िसवाय) ह-गे। 8. जलावन लकड़ी का वािणिSयक उपयोग। लागू िविधय- के अनुसार ितिषh (अQयथा उपबंिधत के िसवाय) ह-गे। ख. िविनयिमत <याकलाप िविनयिमत <याकलाप िविनयिमत <याकलाप िविनयिमत <याकलाप 9. होटल- और रसोट‘ क$ वािणिSयक Cथापना । पा रिCथितक$ पयटन Yयाकलाप- हेतु लघु अCथायी संरचनाv के िनमाण को छोड़कर संरि:त :े# क$ सीमा से एक कलोमीटर के भीतर या पा रिCथितक$ संवेदी जोन क$ सीमा तक, इनम& जो भी अिधक िनकट हो, नए वािणिSयक होटल- और रसोट क$ Cथापना अनु‰ात नह7 होगी: परंतु यह क संरि:त :े# क$ सीमा से एक कलोमीटर के बाहर या पा रिCथितक$ संवेदी जोन क$ सीमा तक, इनम& जो भी अिधक िनकट हो, सभी नए पयटन Yयाकलाप करने या िव@मान Yयाकलाप- का िवCतार पयटन महायोजना और लागू दशािनदsश- के अनुसार अनु‰ात होगी । 10. संिनमाण Yयाकलाप । (क) संरि:त :े# क$ सीमा से 1.0 कलोमीटर के भीतर या पा रिCथितक$ संवेदी जोन क$ सीमा तक, इनम& जो भी अिधक िनकट हो, कसी भी नये वािणिSयक संिनमाण क$ अनु‰ा नह7 होगी: परंतु Cथानीय लोग- को अपनी आवास सNबQधी िनƒिलिखत आव{यकताv को पूरा करने के िलए, पैरा 3 के उप पैरा (1) म& सूचीबh Yयाकलाप- सिहत अपने योग के िलए, अपनी भूिम म& भवन उप- िविधय- के अनुसार, संिनमाण करने क$ अनु‰ा होगी: परQतु गैर– दूषणकारी लघु उ@ोग- से संबंिधत संिनमाण Yयाकलाप लागू िनयम- और िविनयम-, यद कोई ह-, के अनुसार स:म ािधकारी क$ पूव अनुमित से िविनयिमत कए जाएंगे और वे Qयूनतम
ह-गे ।
(ख) एक कलोमीटर से आगे ये आंचिलक महायोजना के अनुसार िविनयिमत ह-गे । 11. गैर दूषणकारी लघु उ@ोग। फरवरी, 2016 म& केQPीय दूषण िनयं#ण बोड %ारा जारी उ@ोग- के वगHकरण के अनुसार गैर- दूषणकारी उ@ोग तथा अप रसंकटमय लघु और सेवा उ@ोग, कृिष, पुLप कृिष, बागबानी या कृिष आधा रत उ@ोग, जो पा रिCथितक$ संवेदी जोन से देशी सामि]य- से उ9पाद बनाते हO, स:म ािधकारी %ारा अनु‰ात ह-गे।

9 12. फम‘, कारपोरेट, कंपिनय- %ारा बड़े पैमाने पर वािणिSयक पशुधन संपदा और कुpकुट फाम‘ क$ Cथापना । Cथानीय जनता के योग के िलए लागू िविधय- (अQ यथा उपबंिधत के िसवाय) के अधीन अनु‰ात होगा । 13. वृ:- क$ कटाई । (क) राSय सरकार के स:म ािधकारी क$ पूव अनुमित के िबना वन भूिम या सरकार भूिम या राजCव भूिम या िनजी भूिम पर वृ:- क$ कटाई क$ अनु‰ा नह7 होगी । (ख) वृ:- क$ कटाई क& Pीय या संबंिधत राSय के अिधिनयम- और उनके अधीन बनाए गए िनयम- के उपबंध- के अनुसार िविनयिमत होगी। 14. वन उ9पाद- और गैर का™ वन उ9पाद- का सं]ह । लागू िविधय- के अधीन िविनयिमत होगा । 15. िव@ुत और संचार टॉवर लगाने, तार-िबछाने तथा अQय बुिनयादी ढांचे क$ +वCथा । लागू िविधय- के अधीन िविनयिमत होगा (भूिमगत केबल िबछाने को बढ़ावा दया जाएगा)। 16. नाग रक सुिवधाv सिहत बुिनयादी ढांचे क$ +वCथा। यह +वCथा लागू िविधय-, िनयम-, िविनयम- और मौजूदा दशािनदsश- के अनुसार उपशमन उपाय- के साथ क$ जाएगी।
17. िव@मान सड़क- को चौड़ा करना, उQह& सुदृढ बनाना और नई सड़क- का िनमाण करना। यह +वCथा लागू िविधय-, िनयम-, िविनयम- और मौजूदा दशािनदsश- के अनुसार उपशमन उपाय- के साथ क$ जाएगी। 18. पयटन से संबंिधत अQय Yयाकलाप जैसे क पा रिCथितक$ संवेदी जोन :े# के ऊपर से गम वायु के गु1बारे, हेलीका^टर, kोन, माइYोलाइtस उडाना आद। 19. पवतीय ढलान- और नदी तट- का संर:ण । 20. राि# म& सड़क यातायात का संचलन। लागू िविधय- के अधीन वािणिSयक योजन के िलए िविनयिमत होगा । 21. Cथानीय जनता %ारा अपनायी जा रही वतमान कृिष और बागवानी पhितय- के साथ डेय रयां, दुjध उ9पादन, जल कृिष और म9Cय पालन। Cथानीय जनता के योग के िलए लागू िविधय- के अधीन अनु‰ात ह-गे। 22. ाकृितक जल िनकाय- या भू :े# म& उपचा रत अपिशy जल या बिहाव का िनCसारण । जल िनकाय- म& उपचा रत अपिशy जल या बिहाव के िनCसारण से बचा जाएगा। उपचा रत अपिशy जल के पुनचYण और पुन:उपयोग के यास कए जाएंगे अQयथा उपचा रत अपिशy जल/बिहाव का िनCसारण लागू िविधय- के अनुसार िविनयिमत कया जाएगा। 23. सतही और भूजल का वािणिSयक योग एवं िनLकषण । 24. कृिष या अQय उपयोग के िलए खुले कुएं, बोर कुएं आद का िनमाण । समुिचत ािधकारी %ारा िविनयिमत कया जाएगा तथा Yयाकलाप क$

NOTIFICATION New Delhi, the 3rd June, 2019 S.O. 1918(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 2114 (E), dated 24th May, 2018, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, the copies of the Gazette containing the said draft notification were made available to the public on the 30th May, 2018; AND WHEREAS, no objections and suggestions were received from all persons and stakeholders in response to the aforesaid draft notification; WHEREAS, the Mouling National Park (herein after referred to as the National Park) is located at 28°35′N latitude and 94°52′E longitude and situated at Upper Siang and Siang Districts in Arunachal Pradesh, and it covers a part of Eastern Himalayan Biodiversity Hotspot and form the western part of the Dihang- Dibang Biosphere Reserve; AND WHEREAS, the National Park is represented by various types of forest areas including tropical and semi evergreen sub-tropical broad leaved forest and sub temperate broad leaved forest, and the major vegetations are subtropical forest, wet temperate forests, mix coniferous forests and bamboo forest;
AND WHEREAS, the National Park considering its ecological, floral, faunal and natural significance was notified vide State Gazette notification No. FOR/55/Gen/81, dated the 30th December, 1986, and it is spread over an area of 483 square kilometers, and the Divisional Forest Office situated in Jengging is having the jurisdiction of administration of the said Park and the towns of Along and Pasighat are the nearest towns at distances of 130 kilometers and 185 kilometers, respectively; AND WHEREAS, the National Park conserves the floral and faunal biodiversity and supports 34 important species of fauna, 29 species of flora, 25 avifaunal species, 5 species of amphibians, 15 species of reptiles and 11 species of fishes, and the 34 species of flora include Altingia excela (Jutli), Tetrameles

AND WHEREAS, the National Park conserves and support 20 important species of amphibians and reptiles and the 15 reptile species are Pyxidea mouhoti (Keelbox turtle), Gekko gecko (Tockay), Ptyctolaemus gularis (Blue throated forest lizard), Mubaya carinata (Common sunskink), Takydromus sexlineatus (Asian long tailed grass lizard), Varanus bengalensis (Monitor lizard), Typhlops diardi (Diard’s blind snake), Python molurus bivittatus (Burmese python), Coeloganthus radius (Copperhead snake), Pareas monticola (Assam snail eater), Ptyas korros (Indo-Chinese rat snake), Dendrolaphis pictus (Painted bronzeback), Boiga gokool (Eastern gamma), Ophiophagus hannah (King cobra) and Trimerusurus yunanensis- (Green pit viper), and the 5 amphibian species are Duttaphrynus melanostictus (Common toad), Hyla annectans (Indian hylid frog), Microhyla ornate (Ornamental pigmy frog), Amolops assamensis (Assamese cascade frog) and Rhacophorus maximus (Large tree frog); AND WHEREAS, the National Park also supports 11 fish species including Anguilla bengalensis (Long fin eel), Salmastoma bacaila (Large razor belly minnow), Danio aequipinnatus (Dorikana), Barilius barna (Barna braila), Punticus sarana (Chiniputhi), Chagunius chagunio (Kentahputhi), Labeo pangisia (Silghoria), Tor tor (Tor mahseer), Tor putitora (Golden Mahseer), Gara gotyla (Gara) and Wallago attu (Borali); AND WHEREAS, the National Park also conserves, protect and provides shelter to one rare and one endangered floral species Psilotum nudum and Paris polyphylla, respectively, and the National Park provides shelter to rare faunal species including Sambar and Bear, and endangered faunal species including Sarow, Goral, Takin, Clouded Leopard, Black Bear and Red Panda;

19 AND WHEREAS, the National Park is home to a variety of flora, fauna and avifauna, and provides protection to rare and endangered species of wildlife endemic, and hence, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1, around the National Park as Eco-sensitive Zone from ecological and environmental point of view to protect and propagate the biodiversity therein and its environment, and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area of 252.0 square kilometers to an extent varying from 0.5 Kilometers to 5.6 Kilometers around the boundary of Mouling National Park in the State of Arunachal Pradesh as Mouling National Park Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be 252.0 square kilometers with an extent varying from 0.5 to 5.6 kilometers around the boundary of Mouling National Park. (2) The boundary description of the Eco-sensitive Zone around the Mouling National Park is appended as Annexure-I. (3) Geo-coordinates of the Mouling National Park and its Eco-sensitive Zone in terms of Global Positioning System coordinates are appended as Annexure-II. (4) The Google earth map of Eco-sensitive Zone is appended as Annexure-III. (5) Map of the Mouling National Park Eco-sensitive Zone along with geo-coordinates is appended as Annexure-IV. (6) State map showing the location of Mouling National Park in the State of Arunachal Pradesh is appended as Annexure-V.
2. Zonal Master Plan for Eco-sensitive Zone. - (1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority of State.
   (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment;
   (ii) Forest and Wildlife;
   (iii) Agriculture and Horticulture;
   (iv) Revenue;
   (v) Urban Development;
   (vi) Tourism;
   (vii) Rural Development; (viii) Irrigation and Flood Control;
   (ix) Municipal;
   (x) Panchayati Raj; and (xi) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use. – (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purpose other than that specified at clause (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

21 (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometres from the boundary of the National Park or upto the extent of the Eco-sensitive zone whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the National Park till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco- sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco- sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco- sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco- sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents. - Discharge of treated effluent in Eco- sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes. - Disposal and management of solid wastes shall be as under:-
(i) the solid waste disposal and management in the Eco- sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;

(ii) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco- sensitive Zone. (10) Bio-medical waste. – Bio-Medical Waste Management shall be as under:- (i) the Bio-Medical Waste disposal in the Eco- sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management, Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016; (ii) safe and Environmentally Sound Management (ESM) of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco- sensitive Zone. (11) Plastic Waste Management. - The Plastic Waste Management in the Eco- sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and Demolition Waste Management. - The Construction and Demolition Waste Management in the Eco- sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-Waste. - The E-Waste Management in the Eco- sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic. – The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution. - Prevention and control of vehicular pollution shall be in compliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units. – (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco- sensitive Zone. (ii) Only non-polluting industries shall be allowed within Eco- sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes. - The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction shall not be permitted on existing steep hill slopes or slopes with a high degree of erosion. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco- sensitive Zone shall be governed by the provisions of the Environment Act and the rules made thereunder including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment
Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:-

Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012. 2.
Setting of industries causing pollution (Water, Air, Soil, Noise, etc.). New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted:
Provided that, non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification and in addition the, non-polluting cottage industries shall be promoted.
3.
Establishment of major thermal and major hydroelectric project. Prohibited (except as otherwise provided) as per the applicable laws. 4.
Use or production or processing of any hazardous substances. Prohibited (except as otherwise provided) as per the applicable laws. 5.
Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per the applicable laws. 6.
Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone. 7.
Setting up of brick kilns. Prohibited (except as otherwise provided) as per the applicable laws. 8.
Commercial use of fire wood. Prohibited (except as otherwise provided) as per the applicable laws.

B. Regulated Activities 9.
Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities:
Provided that, beyond one kilometer from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

10.
Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents:

Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
11.
Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent authority. 12.
Establishment of large-scale commercial livestock and poultry farms by firms, corporate and companies. Regulated (except as otherwise provided) as per applicable laws except for meeting local needs. 13.
Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under. 14.
Collection of Forest Produce or Non-Timber Forest Produce. Regulated as per the applicable laws. 15.
Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws (underground cabling may be promoted).

Infrastructure including civic amenities. Taking measures of mitigation, as per applicable laws, rules, regulations and available guidelines. 17.
Widening and strengthening of existing roads and construction of new roads. Taking measures of mitigation, as per applicable laws, rules, regulations and available guidelines. 18.
Undertaking other activities related to tourism like over flying over the Eco-sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc. Regulated as per the applicable laws.

Protection of hill slopes and river banks. Regulated as per the applicable laws. 20.
Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
21.
Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted as per the applicable laws for use of locals.

Discharge of treated waste water or effluents in natural water bodies or land area. The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water or effluent shall be regulated as per the applicable laws.
23.
Commercial extraction of surface and ground water. Regulated under applicable laws.

Open Well, Bore Well, etc. for agriculture or other usage. Regulated under applicable laws and the activity shall be strictly monitored by the concerned authority. 25.
Use of polythene bags. Use of polythene bags are permitted within the Eco-sensitive Zone: Provided that, based on specific requirement, it shall be regulated as per the applicable laws. 26.
Introduction of exotic species. Regulated as per the applicable laws.
27.
Eco-tourism. Regulated as per the applicable laws. 28.
Commercial sign boards and hoardings. Regulated as per the applicable laws. C. Promoted Activities 29.
Rain water harvesting. Shall be actively promoted. 30.

5. Monitoring Committee for Monitoring Eco-Sensitive Zone Notification. - For effective monitoring of the provisions of this notification, the Central Government, under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, hereby constitutes a Monitoring Committee, comprising of the following, namely: - S.No. Constituent of Monitoring Committee Designation 1.

6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per performa given in Annexure VI.

27 (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional Measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8. Supreme Court, etc. orders.-The provisions of this notification are subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
