पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय अिधसूचना नई ᳰद᭨ली, 23 फरवरी, 2016 का.आ. 572(अ).--िन᳜िलिखत ᮧाᱨप अिधसूचना, िजसे के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पᳯठत उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, जारी करने का ᮧ᭭ताव करती है, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) कᳱ अपेᭃानुसार, जनसाधारण कᳱ जानकारी के िलए ᮧकािशत कᳱ जाती है; िजनके उससे ᮧभािवत होने कᳱ संभावना है ; और यह सूचना दी जाती है ᳰक उᲦ ᮧाᱨप अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना वाले भारत के राजपᮢ कᳱ ᮧितयां जनसाधारण को उपल᭣ध करा दी जाती हᱹ, साठ ᳰदन कᳱ अविध कᳱ समाि᳙ पर या उसके प᳟ात् िवचार ᳰकया जाएगा ;

ऐसा कोई ᳞िᲦ, जो ᮧाᱨप अिधसूचना मᱶ अंतᳶव᳥ ᮧ᭭तावᲂ के संबंध मᱶ कोई आᭃेप या सुझाव देने मᱶ िहतब᳍ है, इस ᮧकार िविन᳸द᳥ अविध के भीतर, के᭠ᮤीय सरकार ᳇ारा िवचार ᳰकए जाने के िलए, आᭃेप या सुझाव सिचव, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय, इंᳰदरा पयाᭅवरण भवन, जोर बाग रोड, अलीगंज, नई ᳰद᭨ली-110003 या ई-मेल पते: esz- mef@nic.in पर िलिखत ᱨप मᱶ भेज सकेगा ।
ᮧाᱨप अिधसूचना अᱨणाचल ᮧदेश रा᭔ य के अपर िसयांग िजले मᱶ ि᭭थ त माउᳲलग रा᭬ ᮝीय उ᳒ान, पूवᱮ िहमाचल बायोडायवᳶसटी हॉट᭭ पाट का भाग है, िजसका घेरा लगभग 483 वगᭅ ᳰकलोमीटर है। ᭃेᮢ का िव᭭ तृत वन ᮧकार उ᭬ णकᳳटबंधी और अ᳍ᭅ सदाबहार, उपो᭬ ण कᳯटबंधी चौड़ी प᭜ ती वाला वन और उपशीता᭬ ण चौड़ी प᭜ ती वाला वन है। मु᭎ य वन᭭ पित उपो᭬ ण कᳯटबंधी वन, तरशीतो᭬ ण वन, िमि᮰त शंकुवृᭃ वन और बांस वन हᱹ।

और, अभयार᭛ य मᱶ लगभग 115 पिᭃ यो कᳱ ᮧजाितयॉ जैसे ᮕे-हेिडड कठफोड़वा, ᭭ वणᭅ बबलर, पवᭅती मचना लॉᳰफग ᮣश, मीनल फेजᱶट, ᮕेबसंता, पहाडी गᱨड़, बुलबुल, पवती तीतर, बबलर मᱹगपाई रॉिबन, पपीहा, ᮕे अंगारक वृᭃ पाइ, हाᳯरल, पंडुक, जंगली मुगᱮ, तोता आᳰद पाए जाते हᱹ। और, अभयार᭛ य मᱶ सरीसृप जैस अजगर, वाइन सांप, कोबरा, अिध क जहरीला सांप, वृᭃ सृप, ᮝीनकेट सांप करैत सांप, वन टोपी, ᭭ कᳱनक, येलो मॉनीटर आᳰद पाए जाते हᱹ और जलीय िनकाय मछिलयᲂ मᱶ जैसे सचीजोथेᳯर᭍ स रीचाडᭅसोनी, बारालीयस बोला, टोर पुतीटोरा, गारा मचेलानड़ी होते है और उभयचरो मᱶ जैसे राना कुहली, रहाकोफोरस ᭭ पा, माइᮓोहयला ऑरनाटे आᳰद हᱹ।

और, अभयार᭛ य मᱶ उभयचरो मᱶ जैसे राना कुहली, राना मे᭍ सीमस, राना लीमनोकारीस, राना मेकुलेटस, राना साइनाफासेलयसटीक, राना टे᭥ पोरारीया, राना टाइगरीना, राना ᮩेवीपस, फोकोफोरस िलयोकोमे᭭ ट᭍ स, बूफो ᭭ टोमेटी᭍ स, हयला अ᭠ नेसडस, ए᭍ सोफाइरस परवा, माइᮓोफाइला ऑर नाटे, होपलोबाᮝाचस ᮓेशहस, आ᭍ कᳱडोजयगा बोरेलीस, ᱟमेराना ᱟमेरालीस, टायलो–टोᮝीटोन वेरᱨकासस, गेगेनेओफरीस फु᭨ लर और िततिलयᲂ मᱶ जैसे अᮓाइआ वोिलया, कटोपसीला करोसेले, डोनाओइस गेनुᳯटया, डोनाओइस लीमनीएक, लीसटेᳯरया ᭭ पा, गराᳰफयम अगामेमनोन, मेलािनटीसलेडा, डीकोफोरा ᭭ पा, डेिलयस इयोकारीस आᳰद पाए जाते हᱹ।
और, माउᳲलग रा᭬ ᮝीय उ᳒ान के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ हᱹ, पयाᭅवरण कᳱ दृि᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲄ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष᳍ करना आव᭫यक है;

अतः, इसिलए, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (3) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, अᱨणाचल ᮧदेश के माउᳲलग रा᭬ ᮝीय उ᳒ान कᳱ सीमा से 5.6 ᳰकलोमीटर तक के िव᭭ तार तक के ᭃेᮢ को माउᳲलग रा᭬ ᮝीय उ᳒ान पाᳯरि᭭थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭थितक संवेदी जोन कहा गया है) के ᱨप मᱶ अिधसूिचत करती है, िजसका िववरण िन᳜ानुसार है, अथाᭅत् :--

1. पाᳯरि᭭थितक संवेदी जोन का िव᭭तार और उसकᳱ सीमाएं.--(1) पाᳯरि᭭ थितक संवेदी जोन का िव᭭ तार माउᳲलग रा᭬ ᮝीय उ᳒ान से 5.6 ᳰकलोमीटर तक िव᭭ तार के साथ 236 वगᭅ ᳰकलोमीटर ᭃेᮢ मᱶ फैला ᱟआ है और पाᳯरि᭭ थितक संवेदी जोन के भीतर कोई गांव नही है तथा ᭏ लोबल पोजीशन िस᭭ टम, माउᳲलग रा᭬ ᮝीय उ᳒ान कᳱ सीमाᲐ के साथ साथ ᳲबदुओ के सम᭠ वय करता है उपाबंध I के ᱨप मᱶ संलᲨ है
2. पाᳯरि᭭ थितक संवेदी जोन का मानिचᮢ, सीमा ᭣ यौरᲂ, अᭃांश और रेखांश के साथ उपाबंध II के ᱨप मᱶ संलᲨ है ।

2. पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना.--(1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के िलए राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ संल᭏ न अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी । (2) आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
   (3) रा᭔य सरकार ᳇ारा पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप तथा सुसंगत कᱶᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य और कᱶᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार होगी । (4)
   आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭ थितक िवचारᲂ को समाकिलत करने के िलए रा᭔ य सरकार के सभी संब᳍ िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत्:-- (i) पयाᭅवरण ; (ii) वन ;
   (iii) शहरी िवकास ; (iv) पयᭅटन ; (v) नगरपािलक ; (vi) राज᭭ व ;
   (vii) कृिष ;
   (viii) अᱧणाचल ᮧदेश रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ । (ix) ᳲसचाई ; और
   (x) लो क िन माᭅण िव भाग। (5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।
   (6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलूᲐ,िजन पर ᭟यान देना आव᭫यक है, के िलए उपबंध हᲂगे । (7) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलो, ᮕामᲂ और नगरीय बंदोब᭭ तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलो᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी । (8) आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करने के िलए, पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।

रा᭔य सरकार ᳇ारा ᳰकए जाने वाले उपाय.--रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :-- (1) भू-उपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद सं. 12, 21, 32, 36 और सं. 37 के सामने सूचीब᳍ ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-

(i) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭थितक अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद; (ii) िव᳒मान सड़कᲂ को चौड़ा और सुदृढ़ बनाना । (iii) ᮧदूषण काᳯरत न करने वाले लघु उ᳒ोग ; (iv) वषाᭅ जल संचयन, और (v) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग, सुिवधा भंडार और ᭭ थानीय सुख-सुिवधाएं हᱹ :
परंतु यह और ᳰक जनजातीय भूिम का उपयोग रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए अनु᭄ात नहᱭ होगा :
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ सूचना भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को देनी होगी ।
परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा ।
परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अᮧयु᭍ त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक जल ᮲ोतᲂ.--आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष᳍ करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे । (3) पयᭅटन.–(क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप पयᭅटन महायोजना के अनुसार हᲂगे जो ᳰक आंचिलक महायोजना के भाग ᱨप मᱶ होगी ।
(ख) पयᭅटन महायोजना पयᭅटन िवभाग, रा᭔ य राज᭭ व और वन िवभाग के परामशᭅ से तैयार होगी ।
(ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :- (i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िस᳍ांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िस᳍ांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व देते ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(ii) पाᳯरि᭭ थितक अनुकूल पयᭅटक ᳰᮓयाकलापᲂ के संबंध मᱶ अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय माउᳲलग रा᭬ ᮝीय उ᳒ान कᳱ सीमा से एक ᳰकलोमीटर भीतर होटल और ᳯरसोटᲄ का नया संिनमाᭅण अनु᭄ात नहᱭ होगा ;

परंतु संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर कᳱ दूरी से परे पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक नए होटल और ᳯरसोटᭅ के ᭭थापना पयᭅटन महायोजना के अनुसार पाᳯरि᭭थितकय पयᭅटन सुिवधा के िलए पूवᭅ पᳯरभािषत और िविन᳸द᳥ ᭭थान मᱶ ही अनु᭄ात ᳰकया जाएगा । (iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।

(4) नैसᳶगक िवरासत.--पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । (5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदूषण - ᭟ विन ᮧदूषण.--पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदूषण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या अᱧणाचल ᮧदेश रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ, वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।
(7) वायु ᮧदूषण.--पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदूषण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या अᱧणाचल ᮧदेश रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ, वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण.--पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, जल (ᮧदूषण िनवारण तथा िनयंᮢण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा । (9) ठोस अपिश᳥.--ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा - (i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण और वन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 908(अ), तारीख 25 िसतंबर, 2000 नगरपािलक ठोस अपिश᳥ (ᮧबंध और हथालन) िनयम, 2000 के उपबंधᲂ के अनुसार ᳰकया जाएगा ; (ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा।
(10) जैव िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण और वन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.आ.630 (अ) तारीख 20 जुलाई, 1998 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ (ᮧबंध और हथालन) िनयम, 1998 के उपबंधᲂ के अनुसार ᳰकया जाएगा। (11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होने तक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी । (12) औ᳒ोिगक इकाईयां - (क) ᮧ᭭ तािव त पाᳯरि᭭थितक संवेदी जोन मᱶ िव िध के अनुसार ᭭ थािप त िव ᳒मान का᭬ ठ आधाᳯर त उ᳒ोगᲂ के िस वाए नए का᭬ ठ आधाᳯर त उ᳒ोगᲂ कᳱ ᭭ थापना को अनु᭄ात नहᱭ ᳰक या जाएगा । (ख) जल, वायु, मृदा, ᭟ विन ᮧदूषण काᳯर त करने वाले ᳰक सी नए उ᳒ोग कᳱ ᮧ᭭ तािव त पाᳯरि᭭थितक संवेदी जोन मᱶ ᭭ थापना को अनु᭄ात नहᱭ ᳰक या जाएगा ।

4. पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧितिष᳍ और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सूची - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ और त᳍ीन बनाए गए िनयमᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत् :-- ᮓम सं. ᳰᮓयाकलाप टीका-ᳯट᭡पणी (1) (2) (3) अ. ᮧितिष᳍ ᳰᮓयाकलाप : (1) वािणि᭔यक खनन, प᭜थर कᳱ खदान और उनको तोड़ने कᳱ इकाइयां ।
   (क) सभी नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर उ᭜ खनन और उनको तोड़ने कᳱ इकाइयां ᮧितिष᳍ हᱹ िसवाय, िनवािसयᲂ कᳱ स᳊ावपूणᭅ घरेलू आव᭫यकताᲐ के नहᱭ हᲂगी िजसके अंतगᭅत गृहᲂ के संिनमाᭅण या मर᭥ मत के िलए िमᲵी कᳱ खुदाई और ᭪ यिᲦक उपभोग के िलए गृहᲂ के िनमाᭅणके िलए देशी टाइलᲂया ᲊटᲂ का संिनमाᭅणभी है ;
   (ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदेश तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदेश के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।
   (2) आरा िमलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
   (3) ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । (4) जल या वायु या मृदा या ᭟ विन ᮧदूषण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर ᳰकसी नए और ᮧदूषण काᳯरत करने वाले िव᳒मान उ᳒ोगᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा । (5) नई बृहत ताप और जल िव᳒ुत पᳯरयोजना कᳱ ᭭थापना । (6) जलावन लकड़ी का वािणि᭔यक उपयोग । (7) ᭡ लाि᭭ टक के थैलᲂ का उपयोग । (8) नᳰदयᲂ को रोकना । (9) िव᭭ फोटकᲂ का उपयोग ।

(10) पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣ बारᲂ आᳰद ᳇ारा रा᳦ीय उ᳒ान ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना!
(11) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण ।

िविनयिमत ᳰᮓयाकलाप (12) होटलो और ᳯरसोटᲃ कᳱ ᭭ थापना। पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के संबंध मᱶ पयᭅटकᲂ के अ᭭ थायी वास- सुिवधा के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा के 1 ᳰकलोमीटर के भीतर कोई नया वािणि᭔ यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ ᳰकया जाएगा ।

तथािप, एक ᳰकलोमीटर से परे और पाᳯरि᭭ थितक संवेदी जोन के िव᭭ तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭ तार पयᭅटन महायोजना और रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण के मागᭅदशᭅक िस᳍ांतᲂ कᳱ अनुᱨपता मᱶ होगा ।
(13) संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃ त ᭃेᮢ कᳱ सीमा के 1 ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का कोई नया वािणि᭔ यक संिनमाᭅण अनु᭄ात नही ᳰकया जायेगा:
पर᭠ तु यह कᳱ ᭭ थानीय िनवािसयᲂ को उनकᳱ घरेलू आव᭫ यकताᲐ, िजसके अंतगᭅत पैरा 3 के उप पैरा (1) मᱶ सूचीब᳍ ᳰᮓयाकलाप भी हᱹ, के िलए अनु᭄ात ᳰकया जाएगा ᮧदूषण काᳯरत न करने वाले लघु उ᳒ोगᲂ से संबंिधत सि᭠ नमाᭅण ᳰᮓयाकलाप यथा लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हो, के अनुसार िविनयिमत होगे और ᭠ यून᭜ तम पर रखे जाएंगे।
एक ᳰकलोमीटर से परे पाᳯरि᭭थितक संवेदी जोन के िव᭭ तार तक वा᭭ तिवक ᭭ थानीय आव᭫ यकताᲐ के िलए संिनमाᭅण अनु᭄ात ᳰकया जाएगा और अ᭠ य संिनमाᭅण ᳰᮓयाकलापᲂ आंचिलक महायोजना के अनुसार अनु᭄ात ᳰकया जाएगा।
(14) ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण ।

(15) वायु और यािनक ᮧदूषण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । (16) ᭟ विन ᮧदूषण ।

(17) भूिमगत जल का िन᭬ कषᭅण।
(18) वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳰक᭠ हᱭ वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई, संबंिधत कᱶᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार िविनयिमत होगी ।
(ग) आरिᭃ त वनᲂ और संरिᭃ त वनᲂ के मामलᲂ मᱶ कायᭅकरण योजना िनदᱷशᲂ का अनुसरण ᳰकया जाएगा। (19) िव᳒मान ᭭ थापना ।
(20) िव᳒मान लाइनᲂ का िव᳒ुत रोधन ।
भूिमगत केबलᲂ कᳱ अिभ वृि᳍ । पाᳯर ि᭭थितक संवेदी जोन से गुजरने वाली सभी िव᳒मान लाईनो को आंचिलक महायोजना के अधीन िविहत समय सीमा मᱶ पयाᭅ᭡ त ᱨप से िव᳒ुत रोधी बनाया जाएगा । (21) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदृढ करना। यथा लागू उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपाय के साथ ᳰकया जाएगा । (22) होटलᲂ और लॅाजो के िव᳒मान पᳯरसरᲂ मᱶ बाड़ लगाना ।
व᭠ य जीवᲂ को मु᭍ त िवचरण करने देने के िलए पाᳯर ि᭭थितक संवेदी जोन के भीतर होटलᲂ और अ᭠ य वािण ि᭔यक ᭭ थापनᲂ कᳱ संपि᭜ तयᲂ मᱶ कंटीले तारो कᳱ बाड़ नही लगाई जाएगी और कोई भी बाड़ एक मीटर से ऊची नहᱭ होगी । इस अनुबंध के अनुᱨप नहᱭ होने वाली ᳰकसी भी िव ᳒मान बाड़ को आंचिलक महायोजना मᱶ उि᭨लिख त समय सीमा के अनुसार पᳯरवᳶतत ᳰकया जाएगा।
(23) लोक अिध कार । (24) लघु चारे का संᮕहण । (25) सभी रा᭭ ते और िव᳒मान सड़के उसी ᮧकार बनी रहᱶगी।
(26) कृिष ᮧ᳍ित मᱶ कठोर पᳯरवतᭅन । (27) ᮧाकृितक जल ᮲ोतᲂ का वािण ि᭔यक उपयᲂग िज सके अंतगᭅत भू- जल संचयन भी है।
(28) रािᮢ मᱶ यािनक यातायात का संचलन ।
लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे । (29) िवदेशी ᮧजाितयᲂ को लाना । (30) साइनबोडᭅ और होᳺडग ।

(31) पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । जब तक आंचिलक महायोजना के अधीन अनु᭄ात न कर ᳰदया 1 से 10 से अिध क ढलान वाली पहाड़ी पर और ᳰकसी नदी और ᮧाकृितक नाले के ᳰकनारे से 100 मीटर तक भी कोई सि᳖माᭅण ᳰᮓयाकलाप नहᱭ ᳰकया जाएगा ।
(32) ᮧदूषण उ᭜ प᭠ न न करने वाले लघु उ᳒ोग ।
पाᳯरि᭭ थ ितक संवेदी जोन से गैर ᮧदूषण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष आधाᳯरत देशीय माल से औ᳒ोिगक उ᭜ पादᲂ का उ᭜ पादन उ᳒ोग और जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते है, को अनु᭄ात ᳰकया जाएगा।
संवᳶधत ᳰᮓयाकलाप : (33) ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष, जल कृिष और मछली पालन। लागू िविधयᲂ के अधीन अनुमत हᲂगे । (34) जैिवक खेती । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा ।
(35) सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ का अंगीकरण ।
सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । (36) वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । (37) कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी हᱹ ।
सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । (38) नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । सᳰᮓ य ᱨप से बढावा ᳰदया जाएगा । 5. पाᳯरि᭭थितक संवेदी जोन मानीटरी सिमित- (1) कᱶᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :-
(i) उपायु᭍ त, अपर िसयांग िजला, ᳲयग᭍ यᲂग -अ᭟यᭃ ; (ii) अᱧणाचल ᮧदेश सरकार ᳇ारा नामिन᳸द᭬ ट पाᳯरि᭭ थितक और
पयाᭅवरण ᭃेᮢ ᮧ᭜येक मामले मᱶ एक वषᭅ कᳱ अविध के िलए एक िवशेष᭄. –सद᭭य; (iii) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनᲂ
(िजसके अंतगᭅत िवरासत संरᭃण भी है) का ᮧ᭜येक मामले मᱶ
एक वषᭅ कᳱ अविध के िलए अᱧणाचल ᮧदेश रा᭔य सरकार ᳇ारा
नामिन᳸द᳥ एक ᮧितिनिध. –सद᭭य; (iv) कायᭅकारी इंजीिनयर, अᱧणाचल ᮧदेश ᮧदूषण बोडᭅ. –सद᭭ य ; (v) िजला पयᭅटन अिधकारी (अपर िसयांग)
-सद᭭य ; (vi) िजला कृिष अिधकारी, (अपर िसयांग)
-सद᭭य ;

(vii) ᮧभागीय वन अिधकारी (अपर िसयांग) -सद᭭ य-सिचव । 6. िनदᱷश का िनबंधन :-
(1) पाᳯरि᭭थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी । (2) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष᳍ गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।
(3) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं᭎यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया है, परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते हᱹ, ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब᳍ िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(4) मानीटरी सिमित का सद᭭य-सिचव या संब᳍ उपायु᭍ त, ऐसे ᳞िᲦ के िवᱨ᳍, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता है, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा । (5) मानीटरी सिमित मु᳎ा दर मु᳎ा के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब᳍ पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी । (6) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ रा᭔ य के मु᭎ य व᭠ यजीव वाडᭅन को अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ उपाबंध III पर उपाब᳍ ᱨप िवधान के अनुसार उ᭍ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी । (7) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदेश दे सकेगा, जो वह ठीक समझे । 7.

NOTIFICATION New Delhi, the 23rd February, 2016 S.O. 572(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Aliganj, New Delhi-110003, or send it to the e-mail address of the Ministry at:-esz-mef@nic.in. Draft Notification Whereas, the Mouling National Park located in Upper Siang District in the State of Arunachal Pradesh is part of Eastern Himalaya Biodiversity Hotspot encompassing about 483 square kilometres. The broad forest type of the area are tropical and semi evergreen, sub-tropical broad leaved forest and sub temperate broad- leaved forest. The major vegetations are subtropical forest, wet temperate forests, mix coniferous forests and bamboo forests. And whereas, the flora and fauna represent rich biological significance of this Sanctuary.
And whereas, the important trees Terminalia myriocarpa, Altingia excelsa, Cinnamomum Spp. Magnolia spp.,
Terminalia bellerica, Bambax ceiba, , Castanopsis indicam, Mesua ferrea,, Phoebe goalparensis, Bamboo species include Dendrocalamus hamiltonii, Pseudostrachyum polymorphum. Cane species include Calamus floribundus, C. flagellum are found in the Sanctuary.

And whereas, the main species of animals found in the sanctuary are Panthera tigris, Neofelis nebulosa, Felis viverrina, Panthera pardus, Macaca assamensis, Mumtiacus muntjak, Vuloes bengalensis, Lutra lutra, Herpestes edwardsi, Selenarctos thibetanus, Caprolagus hispidus, Canis lupus, Hystrix indica Canis aureus, Felis chaus, Budorcas taxicolor, Sus scrofa, capriconrnis sumatraensis, Nycticebus coucang, Macaca mulatta, Ailurus fulgens, Moschus moschifeus, etc.
And whereas, about 115 species of birds like Grey-headed woodpecker, Golden babbler, Hill Myna, Laughing thrush, Monal pheasant, Great Barbet, Mountain eagle, Bulbul, Hill partridge, Babbler, Magpie Robin, Cuckoo, Grey Drongo, Tree pie, Green pigeon, Dove, Wild fowl, parakeet etc. are known to occur in the sanctuary.
And whereas, the reptiles like Python, Vine snake, Cobra, Pit viper, Tree snake, Kukri snake, Trinket snake, , Krait snake, forest Calotes, Skink, Yellow monitor, etc. are known to occur in the sanctuary and the aquatic bodies consists of fishes like Schizothorax richardsonii, Baralius bola, Tor putitora, Garra machellandi and the Amphibians like Rana kuhlii, Rhacophorus sp., Microhyla ornate etc. And whereas, Amphibians like Rana kuhlii, Rana maximus, Rana limnocharis, Rana maculates, Rana Cyanophycelyctis, Rana temporaria, Rana tigerina, RAna breviaps, phocophorus leucomastyx, Bufo himalayanum, Nannophrys ceylonersis, Salea spp. Bufo stomaticus, Hyla annecdus, Xenophrys parva, Microphyla ornate, Hoplobatrachus crashus, Occidozyga borealis, Humerana humeralis, Tylototriton verrucasus, Gegeneophris fuller and Butterflies like Acraea violae, Catopsilla crocale, Donaoes genutia, Donaoes limniace, Listeria Spp, Graphium Agamemnon, Melanitis Leda, Dicophora Spp, Delias eucharis etc are found in the Sanctuary. And whereas, it is necessary to conserve and protect the area surrounding the protected area of Mouling National Park as Eco-sensitive Zone from ecological, environmental and biodiversity point of view. Now therefore, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent upto 5.6 kilometer around the boundary of Mouling National Park in the State of Arunachal Pradesh as the Mouling National Park Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.—(1) The Eco-sensitive Zone shall be of 236 Square Kilometres
with an extent upto 5.6 kilo meter around the protected Area. There is no village inside the Eco-sensitive Zone and the GPS Co-ordinates of points along the boundary of Mouling National Park are given at Annexure-I. (2) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-II. 2.
Zonal Master Plan for the Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The said Plan shall be approved by the competent authority in the State Government. (3) The said Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The said Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment; (ii) Forest; (iii) Urban Development; (iv) Tourism; (v) Municipal;
(vi) Revenue; (vii) Agriculture; (ix) Arunachal Pradesh State Pollution Control Board; (x) Irrigation; and (xi) Public Works Department.

(5) The said Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The said Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention. (7) The said Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The said Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly development for livelihood security of local communities. (9) The State Government of Arunachal Pradesh shall prepare separate Zonal Master Plans for area under their jurisdiction. 3. Measures to be taken by State Government.—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.—Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities in column (2) of the Table in paragraph 4, namely:- (i)
Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities; (ii)
Widening and strengthening of existing roads and construction of new roads; (iii)
Small scale industries not causing pollution; (iv)
Rainwater harvesting; and
(v)
Cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural springs.—The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3) Tourism.—(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forest and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i)
all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the

Eco-sensitive Zone; (ii)
new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Mouling National Park except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities: (iii)
till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4)
Natural heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.—The Environment Department of the State Government or Arunachal Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder. (7) Air pollution.—The Environment Department of the State Government or Arunachal Pradesh State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.—The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder. (9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908(E), dated the 25th September, 2000 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco- sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone. (10) Bio-medical waste.—The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time. (11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Industrial units.—(a) No establishment of new wood based industries within the proposed
Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the law. (b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed
Eco-sensitive Zone shall be permitted.
4.
List of activities prohibited or to be regulated within the Eco-sensitive Zone.—All activities in the Eco- sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the table below, namely:-

3. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws. 4. Setting up of industries causing water or air or soil or noise pollution. No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted.
5. Establishment of new major thermal and hydro-electric projects. Prohibited (except as otherwise provided) as per applicable laws. 6. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws. 7. Use of plastic bags. Prohibited (except as otherwise provided) as per applicable laws. 8. River poising. Prohibited (except as otherwise provided) as per applicable laws. 9. Use of explosives. Prohibited (except as otherwise.
10. Undertaking activities related to tourism like over-flying the National Park Area by aircraft, hot-air balloons. Prohibited (except as otherwise provided) as per applicable laws. 11. Discharge of untreated effluents and solid waste in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws. Regulated activities 12. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities.
However, beyond one kilometre and upto the extent of Eco-sensitive Zone all new tourism activities or expansion of existing activities could be in conformity Tourism Master Plan guidelines of National Tiger Conservation Authority. 13. Construction activities.

a) No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the protected area: Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. Beyond 1 kilometre up to the extent of Eco-sensitive Zone construction for bona fide local needs shall be permitted and other commercial construction activities shall be regulated as per Zonal Master Plan. 14. Discharge of treated effluents and solid waste in natural water bodies or land area. Regulated under applicable laws.

Air and vehicular pollution.
16. Noise pollution.
17. Extraction of ground water. 18. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder. (c) In case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed. 19. Existing establishments.

Insulation of electric lines. Promote underground cabling. All existing electric lines passing through the Eco- sensitive Zone shall be adequately insulated in the time frame prescribed under the Zonal Master Plan.
21. Widening and strengthening of existing roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable. 22. Fencing of existing premises of hotels and lodges. In order to allow free movement of wildlife, hotels or other commercial establishments within the Eco-sensitive Zone shall not fence their properties with barbed wire and no fence shall be higher than 1 meter. Any existing fence not complying with this stipulation shall be modified as per the time lines mentioned in the Zonal Master Plan. 23. Public rights. 24. Collection of small fodder. 25. All the way and existing roads will remain as its. 26. Drastic change of agriculture system. 27. Commercial use of natural water resource including ground water harvesting. 28. Movement of vehicular traffic at night. 29. Introduction of exotic species. 30. Sign board and hoardings. 31. Protection of hill slopes and river banks. No construction activity unless otherwise permitted by under the Zonal Master Plan shall be undertaken on the hill with slopes more than 1 to 10 and also upto 100 meters from the banks of any river, and natural nallah.

Small scale industries not causing pollution. Non-polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.
Promoted activities 33. On going agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Shall be actively promoted. 34. Organic farming. Shall be actively promoted. 35. Adoption of green technology for all activities. Shall be actively promoted. 36. Cottage industries including village artisans. Shall be actively promoted. 37. Rain water harvesting. Shall be actively promoted. 38. Use of renewable energy sources. Shall be actively promoted.

5. Monitoring Committee.—The Central Government for effective monitoring of the Eco-sensitive Zone, hereby constitutes a Committee for the State of Arunachal Pradesh to be called the Monitoring Committee, as under:- (i) Deputy Commissioner, Upper Siang, Yingkiong.
   -Chairman (ii) An expert in the area of ecology and environment to be nominated by -Member the Government of Arunachal Pradesh for a period of one year.
   (iii) One representatives of Non-governmental Organisation (working in the
   -Member field of environment including heritage conservation) to be nominated
   by the Government of India for a period of one year. (iv) Executive Engineer, Arunachal Pradesh Pollution Control Board. -Member (v) District Tourism Officer (Upper Siang). -Member (vi) District Agriculture Officer (Upper Siang). -Member (vii) Divisional Forest Officer (Upper Siang).
   -Member-Secretary

Terms of Reference.—(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (3) The activities that are not covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 butare falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (4) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Park in- charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Central Government in the Ministry of Environment, Forests and Climate Change as per pro forma given in Annexure III. (7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
8.The provisions of this notification are subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F.
