नइ ददल्ली, 15 मइ , 2017
कय.अ. 1563(ऄ).—प्रयरुप ऄधधसूचनय, भयरत के रयजपत्र, ऄसयधयरण में भयरत सरकयर के पययावरण, वन
और जलवययु पररवतान मंत्रयलय की ऄधधसूचनय संखययंक कय.अ. 436 (ऄ), तयरीख 4 फरवरी, 2016, को प्रकयधित
की गइ थी, धजसमें ईन सभी व्यधियों से धजनके ईससे प्रभयधवत होने की संभयवनय थी, ईस तयरीख से, धजसकी ईि
रयजपत्र की प्रधतययं जनतय को ईपलब्ध करयइ गइ थीं, सयठ ददन की ऄवधध के भीतर अक्षेप और सुझयव अमंधत्रत
दकए गए थे;
और, ईि रयजपत्र की प्रधतययं जनतय को 4 फरवरी, 2016, को ईपलब्ध करय दी गइ थी;
और, पूवोि प्रयरुप ऄधधसूचनय के ईत्तर में दकसी व्यधि और पणधयरी से कोइ अक्षेप और सुक्षयव प्रयप्त नहीं
हुअ थय;
और, रयजीव गयंधी रयष्ट्रीय ईद्ययन, अंध्र प्रदेि के कडप्पय धजले में पेन्नयर नदी के दकनयरे प्रोद्यतूर धथथत है और
यह क्षेत्र 2.3952 वगा दकलोमीटर में फैलय हुअ है;
और, रयजीव गयंधी रयष्ट्रीय ईद्ययन में बयलू के टीलों कय पयररधथथधतक तंत्र टीकोमय प्रजयधत (टीकोमय)
(सुवरनयगन्नेरू), डयलबरधजययधससो (आंधडयनद टेकवुड) (धससो), आईकयलयआपट्स (जैम ओआल ट्री)(नीलधगरी),
पयल्मीरय (तयली) के वृक्षों दक प्रजयधतयों को थवयभयधवक रूप से मदत करतय है और ऄन्य वृक्ष प्रजयधतययं, धजसमें
ब्लैक नप्पी हरे (लेपधसधनगररकोधलस) (कुंडेलू), पीकॉक (पोकोदकधथटटयस) (नेमेलली), परयकेट (धपत्तयकुलकररयमरी)
(धचलुकय) और ऄन्य प्रजयधतयों को अश्रय देते हैं;

और, रयजीव गयंधी रयष्ट्रीय ईद्ययन, के चयरों ओर के क्षेत्र को, धजसकय धवथतयर और सीमयएं आस ऄधधसूचनय के
पैरय 1 में धवधनर्ददष्ट हैं, पययावरण की दृधष्ट से पयररधथथधतक संवेदी जोन के रूप में सुरधक्षत और संरधक्षत करनय तथय
ईि पयररधथथधतक संवेदी जोन में ईद्योगों यय ईद्योगों के वगों कय प्रचयलन तथय प्रसंथकरण करने को प्रधतधिद्ध करनय
अवश्यक है;
ऄतः, ऄब, केन्रीय सरकयर, पययावरण (संरक्षण) धनयम, 1986 के धनयम 5 के ईपधनयम (3) के सयथ परठत
पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 29) की धयरय 3 की ईपधयरय (3) और ईपधयरय (2) के खंड (v)
और खंड (xiv) और ईपधयरय (1) द्वयरय प्रदत्त िधियों कय प्रयोग करते हुए, अंध्र प्रदेि रयज् य में रयजीव गयंधी रयष्ट्रीय
ईद्ययन की सीमय से 500 मीटर तक के धवथ तयर तक के क्षेत्र को रयजीव गयंधी रयष्ट्रीय ईद्ययन पयररधथथधतक संवेदी
जोन (धजसे आसमें आसके पश् चयत् पयररधथथधतक संवेदी जोन कहय गयय है) के रूप में ऄधधसूधचत करती है, धजसकय
धववरण धनम्नयनुसयर है, ऄथयात् :--
- पयररधथथधतक संवेदी जोन कय धवथतयर और ईसकी सीमयएं-
(1) पयररधथथधतक संवेदी जोन कय धवथतयर रयजीव गयंधी रयष्ट्रीय ईद्ययन की सीमय से लगभग 500 मीटर और
कुल 4.1506 वगा दकलोमीटर तक कय क्षेत्र है और आसमें कड्डपय धजले के 4 ग्रयम सधममधलत हैं |
(2) पयररधथथधतक संवेदी जोन में अने वयले ग्रयमों की सूची धनदेियंकों के सयथ ईपयबंध I में ददयय गयय है । (3) पयररधथथधतक संवेदी जोन की सीमय कय मयनधचत्र आसके ऄक्षयंिों और देियंतरों के सयथ ईपयबंध- II के रूप में ईपयबद्ध है।
(4) सीमय धववरण के धनदेियंकों के द्वयरय ईपयबंध IIक के रूप में ईपयबद्ध है। (5) पयररधथथधतक संवेदी जोन के धनदेियंक और रयजीव गयंधी रयष्ट्रीय ईद्ययन के धनदेियंक ईपयबंध- III के रूप में ईपयबद्ध है। - पयररधथथधतक संवेदी जोन के धलए अंचधलक महययोजनय – (1) रयज्य सरकयर, पयररधथथधतक संवेदी जोन के धलए
रयजपत्र में आस ऄधधसूचनय के प्रकयिन की तयरीख से दो विा की ऄवधध के भीतर, थथयनीय व्यधियों के परयमिा से
और आस ऄधधसूचनय में संलग् न ऄनुबंधों के सयमंजथ य से अंचधलक महययोजनय तैययर करेगी ।
(2) रयज्य सरकयर द्वयरय पयररधथ थधतक संवेदी जोन के धलए अचंधलक महययोजनय आस तरह, आस ऄधधसूचनय में
धवधनर्ददष् ट रूप तथय सुसंगत केंरीय और रयज् य धवधधयों के सयमंजथ य और केंरीय सरकयर द्वयरय जयरी मयगाधनदेिों,
यदद कोइ हों, द्वयरय तैययर होगी ।
(3) अंचधलक महययोजनय, पययावरणीय और पयररधथथधतक धवचयरों को समयकधलत करने के धलए रयज् य सरकयर के
सभी संबद्ध धवभयगों के परयमिा से तैययर होगी, ऄथयात्:--
(i)
पययावरण;
(ii)
वन और वन्यजीव;
(iii) कृधि ; (iv) रयजथ व; (v) नगर धवकयस; (vi) पयाटन;
(vii) ग्रयमीण धवकयस;
(viii) ससचयइ और बयढ़ धनयंत्रण;

नगरपयधलकय;
(x)
पंचययती रयज;
(xi)
लोक धन मयाण धव भयग।
(4)
अंचधलक महययोजनय ऄनुमोददत धवद्यमयन भू-ईपयोग, ऄवसंरचनय और दिययकलयपों पर कोइ धनबंधन
ऄधधरोधपत नहीं करेगी जब तक दक आस ऄधधसूचनय में धवधनर्ददष् ट न हो और अचंधलक महययोजनय सभी ऄवसंरचनय
और दिययकलयपों में और ऄधधक दक्षतय और पयररधथथधतक ऄनुकूलतय कय संवधान करेगी ।
(5)
अंचधलक महययोजनय में ऄनयच्छयददत क्षेत्रों के जीणोद्धयर, धवद्यमयन जल धनकययों के संरक्षण, अवयह
क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भूतल जल के प्रबंधन, मृदय और नमी संरक्षण, थथयनीय समुदययों की
अवश्यकतयओं तथय पयररधथथधतक और पययावरण से संबंधधत ऐसे ऄन्य पहलूओं, धजन पर ध्ययन देनय अवश्यक है, के
धलए ईपबंध होंगे ।
(6)
अंचधलक महययोजनय सभी धवद्यमयन पूजय थ थलों, ग्रयमों और नगरीय बंदोबथतों, वनों के प्रकयर और
दकथ मों, कृधि क्षेत्रों, उपजयउ भूधम, हररत क्षेत्र जैसे ईद्ययन और ईसी प्रकयर के थ थयन, ईद्ययन कृधि क्षेत्र, फलोईद्ययन,
झीलों और ऄन्य जल धनकययों कय ऄभ्यकंन करेगी और आस योजनय के मयनधचत्र द्वयरय धवद्यमयन और प्रथतयधवत भूधम
के ईपयोग कय धववरण दकयय जयएगय ।
(7) अंचधलक महययोजनय पयररधथथधतक संवेदी जोन में धवकयस को धवधनयधमत करेगय और सयरणी में सूचीबद्ध
प्रधतधिद्ध, धवधनयधमत दिययकलयपों कय पैरय 4 है और थथयनीय समुदययों की अजीधवकय सुरक्षय के धलए पययावरण-
ऄनुकूल धवकयस सुधनधित करनय और बढ़यवय देनय।
(8) अंचधलक महययोजनय आस ऄधधसूचनय में ददए गए ईपबंधों के संबंध में ऄपने कययों के बयहर ले जयने के धलए
धनगरयनी सधमधत के धलए एक संदभा दथतयवेज तैययर करेगी ।
3. रयज्य सरकयर द्वयरय दकए जयने वयले ईपयय-- रयज्य सरकयर आस ऄधधसूचनय के ईपबंधों को प्रभयवी करने के धलए
धनम्नधलधखत ईपयय करेगी, ऄथयात्:--
(1) भू-ईपयोग – पयररधथ थधतक संवेदी जोन में वनों, ईद्ययन-कृधि क्षेत्रों, कृधि क्षेत्रों, अमोद-प्रमोद के प्रयोजन के
धलए धचधन्हत दकए गए पयकों और खुले थथयनों कय वयधणधज्यक यय अवयसीक कयमपलेक्स यय औद्योधगक संबद्ध
धवकयस दिययकलयपों के धलए ईपयोग यय संपररवतान नहीं होगय।
परंतु पयररधथथधतक संवेदी जोन के भीतर कृधि भूधम और ऄन्य भूधम कय संपररवतान मयनीटरी सधमधत की
धसफयररि पर और रयज्य सरकयर के पूवा ऄनुमोदन से, थथयनीय धनवयधसयों की अवयसीय जरूरतों और दिययकलयपों
को पूरय करने के धलए है, जैसे:-
(i) धवद्यमयन सड़कों को चौड़य करनय और ईन्हें सुदृढ़ करनय तथय नइ सड़कों कय संधनमयाण;
(ii) बुधनययदी ढयंचों और नयगररक सुधवधयओं कय संधनमयाण और नवीकरण;
(iii) प्रदूिण ईत्पन्न न करने वयले लघु ईद्योग;
(iv) कुटीर ईद्योगों धजसके ऄंतगात ग्रयमीण कयरीगर हैं; सुधवधयजनक भण्डयर और थथयनीय सुधवधयओं सहययक
पयररधथथधतक पयाटन में सधममधलत गृह वयस; और
(v) संवर्धधत दिययकलयप जो पैरय 4 के ऄधीन ददयय गयय है:

परंतु यह और भी दक रयज्य सरकयर के पूवा ऄनुमोदन से तथय संधवधयन के ऄनुच्छेद 244 और तत्समय प्रवृत्त
धवधध के ईपबंधों के ऄनुपयलन के धबनय, धजसके ऄंतगात ऄनुसूधचत जनजयधत और ऄन्य परंपरयगत वन धनवयसी (वन
ऄधधकयरों की मयन्यतय) ऄधधधनयम, 2006 (2007 कय 2) भी है, वयधणधज्यक यय ईद्योग धवकयस दिययकलयपों के
धलए जनजयतीय भूधम कय ईपयोग ऄनुज्ञयत नहीं होगय:
परंतु यह और भी दक पयररधथ थधतक संवेदी जोन के भीतर भू-ऄधभलेखों में ईपसंजयत कोइ त्रुरट, मयनीटरी
सधमधत के धवचयर प्रयप्त करने के पियत् रयज्य सरकयर द्वयरय प्रत्येक मयमले में एक बयर संिोधधत होगी और ईि त्रुरट
के संिोधन की सूचनय केंरीय सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय को देनी होगी ।
परंतु यह और भी दक ईपयुाि त्रुरट कय संिोधन में आस ईप पैरय के ऄधीन यथय ईपबंधधत के धसवयय दकसी
भी दिय में भू-ईपयोग कय पररवतान सधममधलत नहीं होगय ।
परंतु यह और भी दक धजससे हररत क्षेत्र में जैसे वन क्षेत्र, कृधि क्षेत्र अदद में कोइ पयररणयधमक कटौती नहीं
होगी और ऄनप्रयुक् त यय ऄनुत् पयदक कृधि क्षेत्रों में पुन: वनीकरण करने के प्रययस दकए जयएंगे ।
(2) प्रयकृधतक जल स्रोत - अंचधलक महययोजनय में सभी प्रयकृधतक जल स्रोतों की पहचयन की जयएगी और ईनके
संरक्षण और पुननावीकरण के धलए योजनय सधम मधलत होगी और रयज् य सरकयर द्वयरय ऐसे क्षेत्रों पर यय ईनके धनकट
धवकयस दिययकलयप प्रधतधिद्ध करने के धलए ऐसी रीधत से मयगाधनदेि तैययर दकए जयएंगे धजससे दक ईन क्षेत्रों में यय
आसके समीप धवकयस दिययकलयप को रोकय जय सके जो ऐसे क्षेत्र के धलए हयधनकयरक हैं ।
3. पयाटन – (क) पयररधथथधतक संवेदी जोन के भीतर पयाटन संबंधी दिययकलयप, पयाटन महययोजनय के
ऄनुसयर होंगे, जो अंचधलक महययोजनय कय भयग होंगे ।
(ख) पयाटन महययोजनय पयाटन धवभयग द्वयरय रयज्य सरकयर के वन और पययावरण धवभयग के परयमिा से तैययर
होगी ।
(ग) पयाटन महययोजनय अंचधलक महययोजनय के एक घटक के रूप में होगी ।
(घ) पयाटन संबंधी दिययकलयप धनम नधलधखत के ऄधीन धवधनयधमत होंगे, ऄथयात् :-
(i) होटलों और ररसोटों कय नयय संधनमयाण रयजीव गयंधी रयष्ट्रीय ईद्ययन की सीमय से एक दकलोमीटर के भीतर यय
पयररधथथधतक संवेदी जोन के धवथतयर तक जो भी धनकट हो, ऄनुज्ञयत नहीं दकयय जयएगय । तथयधप, वन्यजीव
ऄभययरण्य की सीमय से एक दकलोमीटर की दूरी से परे, पयररधथथधतक संवेदी जोन के धवथतयर तक नए होटलों और
ररसोटों की थथयपनय पयाटन महययोजनय के ऄनुसयर पयररधथथधतक पयाटन सुधवधयओं के धलए पूवा सीमयंदकत और
ऄधभधहत क्षेत्रों में ही ऄनुज्ञयत की जयएगी ।
(ii) पयररधथथधतक संवेदी जोन के भीतर सभी नए पयाटन दिययकलयपों यय धवद्यमयन पयाटन दिययकलयपों कय धवथतयर
रयष् ट्रीय ा ययघ्र स संरक्षण प्रयधधकरण, पययावरण, वन और जलवययु पररवतान मंत्रयलय द्वयरय जयरी (समय-समय पर यथय
संिोधधत) पयररधथथधतक पयाटन मयगाधनदेिों के ऄनुसयर होगय धजसमें पयररधथथधतक पयाटन, पयररधथथधतक धिक्षय और
पयररधथथधतक धवकयस को महत्व ददयय जयएगय और पयररधथथधतक संवेदी जोन की वहन क्षमतय के ऄध्ययन पर
अधयररत होगय;
(iii) अंचधलक महययोजनय कय ऄनुमोदन दकए जयने तक, पयाटन के धलए धवकयस और धवद्यमयन पयाटन दिययकलयपों
के धवथतयर को वयथतधवक थथल धवधनर्ददष्ट संवीक्षय तथय मयनीटरी सधमधत की धसफयररि पर अधयररत संबंधधत
धवधनययमक प्रयधधकरणों द्वयरय ऄनुज्ञयत दकयय जयएगय ।

(4) नैसर्धगक धवरयसत -- पयररधथथधतक संवेदी जोन में महत्वपूणा नैसर्धगक धवरयसत के सभी थथलों जैसे सभी जीन
कोि अरधक्षत क्षेत्र, िैल धवरचनयएं, जल प्रपयतों, झरनों, घयटी मयगों, ईपवनों, गुफयएं, थथलों, भ्रमण, ऄश्वरोहण,
प्रपयतों अदद की पहचयन की जयएगी और ईन्हें संरधक्षत दकयय जयएगय तथय ईनकी सुरक्षय और संरक्षय के धलए
अंचधलक महययोजनय बनयएगी ।
(5) मयनव धनर्धमत धवरयसत थ थल - पयररधथ थधतक संवेदी जोन में भवनों, संरचनयओं, धिल्प-तथ्य, ऐधतहयधसक, क्षेत्रों
और प्रसीमयओं कलयत्मक सौंदया और सयंथकृधतक महत्व के क्षेत्रों की पहचयन करनी होगी और ईनके संरक्षण के धलए
धवरयसत संरक्षण योजनय आस ऄधधसूचनय के प्रकयिन की तयरीख से छह मयस के भीतर तैययर करनी होगी तथय ऐसी
योजनय अंचधलक महययोजनय कय भयग होगय ।
(6) ध् वधन प्रदूिण - पयररधथथधतक संवेदी जोन में ध् वधन प्रदूिण के धनवयरण और धनयंत्रण के धलए पययावरण (संरक्षण)
ऄधधधनयम, 1986 और ईसके संिोधनों के ऄधीन ध्वधन प्रदूिण (धवधनयमन और धनयंत्रण), 2000 के ऄनुसयर तैययर
करेगय।
(7) वययु प्रदूिण -- पयररधथथधतक संवेदी जोन में, वययु प्रदूिण के धनयंत्रण के धलए रयज्य सरकयर कय पययावरण
धवभयग वययु (प्रदूिण धनवयरण और धनयंत्रण) ऄधधधनयम, 1981 (1981 कय 14) और ईसके ऄधीन बनयए गए
धनयमों के ईपबंधों के ऄनुसयर मयगादिाक धसद्धयंत और धवधनयम तैययर करेगय ।
(8) बधहस्रयव कय धनथसयरण -- पयररधथथधतक संवेदी जोन में ईपचयररत बधहस्रयव कय धनथसयरण जब (प्रदूिण
धनवयरण तथय धनयंत्रण) ऄधधधनयम, 1974 (1974 कय 6) और ईसके ऄधीन बनयए गए धनयमों के ईपबंधों के
ऄनुसयर होगय ।
(9) ठोस ऄपधिष्ट - ठोस ऄपधिष्टों कय धनपटयन धनम्नधलधखत रूप में होगय -
क.
पयररधथथधतक संवेदी जोन में ठोस ऄपधिष्टों कय धनपटयन और प्रबंधन भयरत सरकयर के पययावरण,
वन और जलवययु पररवतान मंत्रयलय की समय-समय पर यथय संिोधधत ऄधधसूचनय सं. कय.अ.
1357(अ), तयरीख 8 ऄप्रैल, 2016 द्वयरय प्रकयधित ठोस ऄपधिष्ट प्रबंध धनयम, 2016 के ईपबंधों
के ऄनुसयर दकयय जयएगय ;
ख.
थथयनीय प्रयधधकयरी जैव धनम्नीकरणीय और ऄजैव धनम्नीकरणीय संघटकों में ठोस ऄपधिष्टों के
संपृथक्कन के धलए योजनयएं तैययर करेंगे ;
ग.
जैव धनम्नीकरणीय सयमग्री को ऄधधमयनतः खयद बनयकर यय कृधम खेती के मयध्यम से पुनःचदित
दकयय जयएगय ;
घ.
ऄकयबाधनक सयमग्री कय धनपटयन पयररधथथधतक संवेदी जोन के बयहर पहचयन दकए गए थ थल पर
दकसी पययावरणीय थवीकृत रीधत में होगय और पयररधथथधतक संवेदी जोन में ठोस ऄपधिष् टों को
जलयनय यय भष् मीकरण ऄनुज्ञयत नहीं होगय।
(10) जैव धचदकत् सीय ऄपधिष् ट- जैव धचदकत् सीय ऄपधिष् ट प्रबंधन धनम्नधलधखत रूप में होगय—
(क) पयररधथथधतक संवेदी जोन में जैव धचदकत्सीय ऄपधिष्टों कय धनपटयन भयरत सरकयर के पययावरण, वन और
जलवययु पररवतान मंत्रयलय की समय-समय पर यथयसंिोधधत ऄधधसूचनय सं.कय.धन 343 (ऄ), तयरीख 28 मयचा
2016 द्वयरय प्रकयधित जैव धचदकत्सीय ऄपधिष्ट प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय ।
(ख) पयररधथथधतक संवेदी जोन में कोइ सयमयन्य ईपचयर सुधवधय यय जलययय जयनय ऄनुज्ञयत नहीं दकयय जयएगय ।

(11) प्लयधथटक ऄपधिष्ट प्रबंधन: - पयररधथथधतक संवेदी जोन में प्लयधथटक ऄपधिष्ट प्रबंध कय धनपटयन भयरत सरकयर
के पययावरण, वन और जलवययु पररवतान मंत्रयलय की समय-समय पर यथयसंिोधधत ऄधधसूचनय सं.कय.धन 340(ऄ),
तयरीख 18 मयचा, 2016 द्वयरय प्रकयधित प्लयधथटक ऄपधिष्ट प्रबंध धनयम 2016 के ईपबंधों के ऄनुसयर दकयय
जयएगय।
(12) धनमयाण और धवध्वंस ऄपधिष्ट प्रबंधन: - पयररधथथधतक संवेदी जोन में संधनमयाण और धवध्वंस ऄपधिष्ट
प्रबंध कय धनपटयन भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की समय-समय पर
यथयसंिोधधत ऄधधसूचनय सं.कय.धन 317(ऄ), तयरीख 29 मयचा, 2016 द्वयरय प्रकयधित संधनमयाण और धवध्वंस प्रबंध
धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय ।
(13) इ–ऄपधिष्ट:- पयररधथथधतक संवेदी जोन में इ–ऄपधिष्ट प्रबंध कय धनपटयन भयरत सरकयर के पययावरण,
वन और जलवययु पररवतान मंत्रयलय की समय-समय पर यथयसंिोधधत द्वयरय प्रकयधित इ–ऄपधिष्ट प्रबंध धनयम,
2016 के ईपबंधों के ऄनुसयर दकयय जयएगय।
(14) ययनीय पररवहन:- पररवहन की ययनीय गधतधवधधययं अवयस के ऄनुकूल धवधनयधमत होंगी और आस संबंध
में अंचधलक महययोजनय में धविेि ईपबंध ऄधधकधथत दकए जयएंगे और अंचधलक महययोजनय के तैययर होने और
रयज्य सरकयर के सक्षम प्रयधधकयरी द्वयरय के ऄनुमोददत होने तक, मयनीटरी सधमधत प्रवृत्त धनयमों और धवधनयमों के
ऄनुसयर ययनीय गधतधवधधयों के ऄनुपयलन को मयनीटर करेगी ।
(15) ययनीय प्रदूिण:- लयगू धवधधयों के ऄनुसयर वयहन प्रदूिण की रोकथयम और धनयंत्रण कय ऄनुपयलन दकयय
जयएगय।
(16) औद्योधगक आकयइययं - (i) पयररधथथधतक संवेदी जोन के भीतर कोइ नए प्रदूधित ईद्योगों की थथयपनय की
ऄनुमधत नहीं दी जयएगी।
(ii) पयररधथथधतक संवेदी जोन के केंरीय प्रदूिण बोडा द्वयरय जयरी मयगादिी धसद्धयंतों में ईद्योगों के वगीकरण के
ऄनुसयर पयररधथथधतक संवेदी जोन के भीतर धसफा गैर- प्रदूधित ईद्योगों की थथयपनय की ऄनुमधत दी जयएगी और
आसके ऄधतररि गैर-प्रदूधित कुटीर ईद्योगों को संवर्धधत दकयय जयएगय ।
(17) पहयड़ी ढलयनों को संरक्षण: - पहयड़ी ढलयनों के संरक्षण के ऄंतगात:
(क) अंचधलक महययोजनय पहयड़ी ढलयनों पर क्षेत्रों कय संकेत होगय जहयं दकसी भी संधनमयाण की ऄनुमधत नहीं
दी जयएगी ।
(ख) कटयव के एक ईच्च धडग्री के सयथ धवद्यमयन खड़ी पहयड़ी ढलयनों यय ढलयनों पर दकसी भी संधनमयाण की
ऄनुमधत नहीं दी जयएगी ।
4. पयररधथथधतक संवेदी जोन में प्रधतधिद्ध यय धवधनयधमत, संवर्धधत प्रवताक दिययकलयपों की सूची -
पयररधथथधतक संवेदी जोन में सभी दिययकलयप पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 29) के ईपबंधों
द्वयरय ियधसत होंगे और नीचे दी गइ सयरणी में धवधनर्ददष्ट रीधत में धवधनयधमत होंगे, ऄथयात् :--

गौडयबमान धथरुमूलपयद बनयम भयरत सरकयर के मयमले
में अदेि तयरीख 4 ऄगथत, 2006 और ररट ययधचकय
(सी) सं. 2012 कय 435 गोवय फयईंडेिन बनयम भयरत
सरकयर के मयमले में तयरीख 21 ऄप्रैल, 2014 के
ऄंतररम अदेि के ऄनुसरण में सवादय प्रचयलन होगय ।
2.
जल, वययु, मृदय, ध् वधन अदद प्रदूिण
कयररत करने वयले ईद्योगों की थ थयपनय ।
(क) दकसी भी नए यय पयररधथथधतक संवेदी जोन में
प्रदूिण फैलयने वयले ईद्योगों के धवथतयर की ऄनुमधत नहीं
दी जयएगी ।
(ख) हररत यय श्वेत कृधि अधयररत लघु ईद्योगों सधहत
केन्रीय प्रदूिण धनयंत्रण बोडा वगीकरण के रूप में
वगीकृत ईद्योगों को धनयमों के ऄनुसयर धवधनयधमत
दकयय जयएगय।
3.
बृहत जल धवद्युत पररयोजनय की थथयपन ।
लयगू धवधधयों के ऄनुसयर प्रधतधिद्ध (ऄन् यथय ईपबंधधत के
धसवयय) होंगे ।
4.
दकसी पररसंकटमय पदयथों कय ईपयोग यय
ईत्पयदन ।
लयगू धवधधयों के ऄनुसयर प्रधतधिद्ध (ऄन् यथय ईपबंधधत के
धसवयय) होंगे ।
5.
प्रयकृधतक जल धनकययों यय भूधम क्षेत्र में
ऄनुपचयररत प्रवयह के धनवाहन ।
लयगू धवधधयों के ऄनुसयर प्रधतधिद्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे । 6. फमों, कंपधनयों, अदद द्वयरय बड़े पैमयने पर वयधणधज्यक पिुओं और पोल्ट्री फयमों की थथयपनय । थथयनीय जरूरतों को पूरय करने के धलए लयगू धवधधयों के ऄनुसयर प्रधतधिद्ध (ऄन् यथय ईपबंधधत के धसवयय) होंगे। 7. नइ अरय धमलों की थथयपनय। पयररधथथधतक संवेदी जोन के भीतर नइ और धवद्यमयन अरय धमलों कय धवथ तयर ऄनुज्ञयत नहीं होगय ।

होटलों और ररसोटों की वयधणधज्यक
थथयपनय ।
पयररधथथधतक पयाटन दिययकलयपों संबंधी पयाटकों की
लघु संरचनयओं के धलए संरधक्षत क्षेत्र की सीमय से एक
दकलोमीटर तक यय पयररधथथधतक संवेदी जोन के धवथतयर
तक, आनमें जो भी धनकट है, नए वयधणधज्यक होटल और
ररसोटा ऄनुज्ञयत होंगे, ऄन्यथय नहीं ।
परंतु, जहयाँ पयररधथथधतक संवेदी जोन कय धवथतयर एक
दकलोमीटर से ज्ययदय है वहयाँ, एक दकलोमीटर से परे
और पयररधथथधतक संवेदी जोन के धवथतयर तक सभी नए
पयाटक दिययकलयप यय धवद्यमयन दिययकलयप कय
धवथतयर पयाटन महययोजनय और यथय लयगू मयगादिी
धसद्धयंतों के ऄनुरुप होगय।
9.
संधनमयाण दिययकलयप ।
(क) संरधक्षत क्षेत्र यय पयररधथथधतक संवेदी जोन जो भी
धनकट हो की सीमय से एक दकलोमीटर के भीतर दकसी
भी प्रकयर कय वयधणधज्यक संधनमयाण ऄनुज्ञयत नहीं
दकयय जयएगय:
परंतु थथयनीय व्यधियों को ईनके अवयसीय ईपयोग के
धलए ईनकी भूधम में संधनमयाण धजसके ऄंतगात अंचधलक
महययोजनय के ऄनुसयर पैरय 3 के ईपपैरय (1) में
सूचीबद्ध दिययकलयप भी हैं, को करने के धलए ऄनुज्ञयत
दकयय जयएगय ।
(ख) परन्तु यह और दक ऐसे लघु ईद्योगों जो प्रदूिण
ईत् पन् न नहीं करते हैं, से संबंधधत संधनमयाण दिययकलयप
धवधनयधमत दकए जयएंगे और लयगू धनयमों और
धवधनयमों, यदद कोइ हों, के ऄनुसयर सक्षम प्रयधधकयरी
की पूवा ऄनुमधत से ही न् यूनतम पर रखे जयएंगे ।
(ग) एक दकलोमीटर से अगे अंचधलक महययोजनय की
ऄनुसयर धवधनयधमत होंगे ।
10. प्रदूिण ईत्पन्न न करने वयले लघु ईद्योग ।
पयररधथ थधतक संवेदी जोन से गैर प्रदूिण, गैर
पररसंकटमय, लघु और सेवय ईद्योग कृधि, पुष् प कृधि,
ईद्ययन कृधि, यय कृधि अधयररत ईद्योग देिीय मयल से
औद्योधगक ईत्पयदों कय ईत्पयदन ईद्योग और जो
पययावरण पर कोइ प्रधतकूल प्रभयव नहीं डयलते हैं,
ऄनुज्ञयत होंगे।
11. ईंट भट्टों की थथयपनय करनय।
लयगू धवधधयों के ऄनुसयर धवधनयधमत (ऄन् यथय ईपबंधधत
के धसवयय) होंगे ।
12. वृक्षों की कटयइ ।
(क) रयज्य सरकयर में सक्षम प्रयधधकयरी की पूवा ऄनुमधत
के धबनय वन, सरकयरी यय रयजथव यय धनजी भूधम पर यय
वनों में ककही वृक्षों की कटयइ नहीं होगी ।
(ख) वृक्षों की कटयइ, संबंधधत केंरीय यय रयज्य
ऄधधधनयम यय ईसके ऄधीन बनयए गए धनयमों के
ईपबंधों के ऄनुसयर धवधनयधमत होगी ।

- वन ईत्पयदों और गैर-कयष्ठ वन ईत्पयदों (एन.टी.एफ.टी) कय संग्रहण । लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
- धवद्युत केबलों और दूरसंचयर टयवरों कय पररधनमयाण और केबल धबछयनय और ऄन्य बुधनययदी ढयंचे। लयगू धवधधयों के ऄधीन धवधनयधमत होंगे( भूधमगत केबल को बढ़यवय ददयय जयएगय)।
- नयगररक सुधवधयओं सधहत बुधनययदी ढयंचे। लयगू धवधधयों के ऄनुसयर न्यूनीकरण की ईपययों के सयथ, धनयम और धवधनयमन और ईपलब्ध ददियधनदेि धवधनयधमत होंगे।
- धवद्यमयन सड़कों को चौड़य करनय और ईन्हें
सुदृढ करनय ।
लयगू धवधधयों के ऄनुसयर न्यूनीकरण की ईपययों के सयथ,
धनयम और धवधनयमन और ईपलब्ध ददियधनदेि धवधनयधमत होंगे। - पयाटन से संबंधधत दिययकलयप जैसे गमा
वययु
गुब्बयरें,
हेलीकयप्टर,
ड्रोन,
मयआिोलयआटस और ऄन्य पयाटन दिययकलयप अदद द्वयरय पयररधथथधतक संवेदी जोन क्षेत्र के उपर से ईड़नय जैसे दिययकलयप करनय। - पहयड़ी ढयलों और नदी तटों कय संरक्षण ।
- रयधत्र में ययधनक ययतयययत कय संचलन । लयगू धवधधयों के ऄधीन वयधणधज्यक प्रयोजन के धलए धवधनयधमत होंगे ।
- थथयनीय समुदययों द्वयरय चल रही कृधि और बयगवयनी प्रथयओं के सयथ पिुपयलन, पिुपयलन कृधि और मछली पयलन । थथयनीय लोगों के ईपयोग के धलए लयगू धवधधयों के ऄधीन धवधनयधमत होंगे ।
- प्रयकृधतक जल धनकययों यय सतही क्षेत्र में ईपचयररत बधहस्रयाव कय धनथसयरण । लयगू धवधधयों के ऄधीन ईपचयररत बधहस्रयव कय धनथसयरण धवधनयधमत होंगे ।

5. पयररधथथधतक संवेदी जोन मयनीटरी सधमधत- (1) केंरीय सरकयर, आस ऄधधसूचनय के ईपयबंधों के प्रभयवी
मयनीटरी के धलए एक मयनीटरी सधमधत कय गठन करेगी जो धनम्नधलधखत से धमलकर बनेगी, ऄथयात्
(i)
धजलय कलेक्टर, कडप्पय
-ऄध् यक्ष;
(ii) पययावरण के क्षेत्र में कयया करने वयले गैर सरकयरी संगठनों कय अंध्र प्रदेि रयज्य सरकयर
द्वयरय प्रत् येक मयमले में तीन विा के धल ए नयमधनर्ददष्ट एक प्रधतधनधध -
सदथय;
(iii) अंध्र प्रदेि रयज्य सरकयर द्वयरय तीन विा की ऄवधध के धलए नयमधनर्ददष् ट पयररधथ थधतक और
पययावरण क्षेत्र कय एक धविेिज्ञ
-सदथय;
(iv) क्षेत्रीय ऄधधकयरी, रयज्य प्रदूिण धनयंत्रण बोडा,
-सदथय;
(v)
प्रभयगीय वन ऄधधकयरी, प्रोदोत्तर वन्यजीव संभयग
-सदथय;
(vi) पययावरण धवभयग, अंध्र प्रदेि सरकयर कय प्रधतधनधध
-सदथय;

6.धनदेि धनबंधन
(1) पयररधथथधतक संवेदी जोन सधमधत आस ऄधधसूचनय के ईपबंधों के ऄनुपयलन को
मयनीटर करेगी ।
(2) सधमधत कय कययाकयल तीन विा की ऄवधध के धलए दकयय जयएगय।
(3) पयररधथथधतक संवेदी जोन में भयरत सरकयर के तत् कयलीन पययावरण और वन मंत्रयलय
की ऄधधसूचनय सं. कय.अ. 1533(ऄ) तयरीख 14 धसतंबर, 2006 की ऄनुसूची में के ऄधीन
सधममधलत दिययकलयपों और आस ऄधधसूचनय के पैरय 4 के ऄधीन प्रधतधिद्ध गधतधवधधयों के
धसवयय अने वयले ऐसे दिययकलयपों की दिय में वयथतधवक धवधनर्ददष्ट थथलीय दियओं पर
अधयररत मयनीटरी सधमधत द्वयरय संवीक्षय की जयएगी और ईि ऄधधसूचनय के ईपबंधों के
ऄधीन पूवा पययावरण धनकयसी के धलए केन्रीय सरकयर के पययावरण, वन और जलवययु
पररवतान मंत्रयलय को धनर्ददष्ट की जयएगी ।

(4) आस ऄधधसूचनय के पैरय 4 के ऄधीन यथय धवधनर्ददष्ट प्रधतधिद्ध दिययकलयपों के
धसवयय, भयरत सरकयर के तत् कयलीन पययावरण और वन मंत्रयलय की ऄधधसूचनय संखययंक
कय.अ. 1533(ऄ) तयरीख 14 धसतंबर, 2006 की ऄधधसूचनय के ऄनुसूची के ऄधीन ऐसे
दिययकलयपों, धजन्हें सधममधलत नहीं दकयय गयय है, परंतु पयररधथथधतक संवेदी जोन में अते
हैं, ऐसे दिययकलयपों की वयथतधवक धवधनर्ददष्ट थथलीय दियओं पर अधयररत मयनीटरी
सधमधत द्वयरय संवीक्षय की जयएगी और ईसे संबद्ध धवधनययमक प्रयधधकरणों को धनर्ददष्ट दकयय
जयएगय ।
(5) मयनीटरी सधमधत कय सदथय-सधचव यय संबद्ध कलक्टर यय संरधक्षत क्षेत्र कय
प्रभयरी ऐसे व्यधि के धवरूद्ध, जो आस ऄधधसूचनय के दकसी ईपबंध कय ईल्लंघन करतय है,
पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 29) की धयरय 19 के ऄधीन पररवयद
फयआल करने के धलए सक्षम होगय ।
(6) मयनीटरी सधमधत मुद्दों के अधयर पर ऄपेक्षयओं पर धनभार रहते हुए संबद्ध
धवभयगों के प्रधतधनधधयों यय धविेिज्ञों, औद्योधगक संगमों यय संबद्ध पणधयररयों के
प्रधतधनधधयों को ऄपने धवचयर-धवमिा में सहययतय के धलए अमंधत्रत कर सकेगी ।
(7) मयनीटरी सधमधत प्रत्येक विा की 31 मयचा तक की ऄपनी वयर्धिक कयरावयइ ररपोटा
रयज्य के मुखय वन्यजीव वयडान को ईपयबंध IV में ईपबंधधत रूप धवधयन के ऄनुसयर ईक् त
विा के 30 जून तक प्रथतुत करेगी ।
(8) केन्रीय सरकयर कय पययावरण, वन और जलवययु पररवतान मंत्रयलय मयनीटरी
सधमधत को ऄपने कृत्यों के प्रभयवी धनवाहन के धलए समय-समय पर ऐसे धनदेि दे सकेगय,
जो वह ठीक समझे ।
7.
आस ऄधधसूचनय के ईपबंधों को प्रभयव देने के धलए केंरीय सरकयर और रयज् य
सरकयर ऄधतररक् त ईपयय, यदद कोइ हों, धवधनर्ददष् ट कर सकेंगे ।
8.
भयरत के मयननीय ईच्चतम न्ययययलय यय ईच्च न्ययययलय यय रयष् ट्रीय हररत
प्रयधधकरण द्वयरय पयररत कोइ अदेि यय पयररत होने वयले दकसी अदेि, यदद कोइ हों, के
ऄधीन, आस ऄधधसूचनय के ईपबंध होंगे ।

MINISTRY OF ENVIRONMENT, FORESTS AND CLIMATE CHANGE NOTIFICATION New Delhi, the 15th May, February, 2017 S.O. 1563(E).–– WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 436 (E), dated the 4th February, 2016, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;
And Whereas, copies of the Gazette were made available to the public the said notification were made
available to the public 4th February, 2016, ;
AND WHEREAS, no objections and suggestions were received from persons and stakeholders in
response to the aforesaid draft notification;
AND WHEREAS, Rajiv Gandhi National Park is located in the Kadapa District of Andhra Pradesh on
the banks of River Pennar near Proddatur town and is spread over an area of 2.3952 square kilometres;
AND WHEREAS, the Rajiv Gandhi National Park has sand dune ecosystem which supports naturally
occurring Tecoma species (tekoma) (SuvarnaGanneru), Dalbergiasissoo (Indian Teakwood) (Sissoo),
Eucalyptus (Jam Oil Tree) (Nilagiri), Palmyrah (Tali) species and other plant species which also harbours
fauna like Black napped Hare (Lepusnigricollis) (Kundelu),Peacock (Pavocristatus)(Nemali), Parakket
(Psittaculakrameri) (Chiluka) and other reptiles;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are
specified in paragraph 1 of this notification, around the protected area of Rajiv Gandhi National Park as Eco-
sensitive Zone from ecological and environmental point of view and to prohibit industries or class of
industries and to prohibit their operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub-section (1) read with clause (v)
and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986
(29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central
Government hereby notifies an area to an extent of 500 meters from the boundary of Rajiv Gandhi National
Park in the State of Andhra Pradesh, as the Rajiv Gandhi National Park Eco-sensitive Zone (hereinafter
referred to as the Eco-sensitive Zone), details of which are as under, namely:-
1.
Extent and boundary of Eco-sensitive Zone.-(1) The extent of Eco-sensitive Zone is 500 Metres
all around the boundary of Rajiv Gandhi National Park and covers an area of 4.1506 square kilometres and
includes four villages in Kadapa District.
(2)
The list of villages falling within Eco-sensitive Zone along with coordinates is given at Annexure-I.
(3)
The map of Eco-sensitive Zone boundary together with latitude–longitude is appended as
Annexure II.

(5) The co-ordinates of Rajiv Gandhi National Park and co-ordinates of Eco-sensitive Zone is appended as
Annexure-III.
2.
Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of
the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of
publication of this notification in the Official Gazette, in consultation with local people and adhering to the
stipulations given in this notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in
such manner as is specified in this notification and also in consonance with the relevant Central and
State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for
integrating the ecological and environmental considerations into the said plan:
(i)
Environment;
(ii)
Forest and Wildlife;
(iii)
Agriculture;
(iv)
Revenue;
(v)
Urban Development;
(vi)
Tourism;
(vii)
Rural Development;
(viii)
Irrigation and Flood Control;
(ix)
Municipal;
(x)
Panchayati Raj ;
(xi)
Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use,
infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall
factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing
water bodies, management of catchment areas, watershed management, groundwater management,
soil and moisture conservation, needs of local community and such other aspects of the ecology and
environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban
settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and
like places, horticultural areas, orchards, lakes and other water bodies with supporting maps and the
Plan shall be supported by maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited,
regulated activities listed in Table is paragraph 4 and also ensure and promote eco-friendly
development for livelihood security of local communities.
(8) The Zonal Master Plan shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-
- Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential complex or industrial activities.

Provided that the conversion of agricultural and other lands, within the Eco-sensitive Zone may be
permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State
Government to meet the residential needs of the local residents, and for the activates such as:
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-
tourism including home stay; and
(v) promoted activities given under is paragraph 4.
Provided further that no use of tribal land shall be permitted for commercial and industrial
development activities without the prior approval of the State Government and without compliance of the
provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled
Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be
corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case
and the correction of said error shall be intimated to the Central Government in the Ministry of
Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case
except as provided under this sub-paragraph.
Provided also that there shall be no consequential reduction in green area, such as forest area and
agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas with
afforestation and habitat restoration activities.
(2) Natural water bodies.- The catchment areas of all natural springs, rivers and channels shall be identified
and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the
guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities
at or near these areas which are detrimental to such areas.
(3) Tourism.- (a) All new tourism activities or expansion of existing tourism activities within the Eco-
Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Tourism Master Plan shall be prepared by Department of Tourism in consultation with State
Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within one kilometer m from the boundary of
the Rajiv Gandhi National Park or upto the extent of the Eco-sensitive Zone whichever is nearer, however,
beyond the distance of one kilometer from the boundary of the Wildlife Sanctuary till the extent of the
Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and
designated areas for eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall
be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest
and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as
amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on
carrying capacity study of the Eco-sensitive Zone;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool
reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall
be identified and preserved and plan shall be drawn up for their preservation and conservation of the Zonal
Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation
plan for their conservation shall be prepared within six months from the date of publication of this notification
and such plan shall form part of the Zonal Master Plan.
(6) Noise pollution.- Prevention and control of noise pollution in the Eco-sensitive Zone shall be in
accordance with the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment
(Protection) Act, 1986 and amendments thereto.
(7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and
regulations for the control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with
the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made
thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance
with the provisions the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974)and the rules made
thereunder..
(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance
with the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in
the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the
8th April, 2016 as amended from time to time.
(b) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non- biodegradable components; (c) the biodegradable material shall be recycled preferably through composting or vermiculture; (d) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.. (10) Bio-medical waste.- Bio medical waste management shall be as under: (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time. (b) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.
(11) Plastic Waste Management.-The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste.- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.

(14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and
specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal
Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring
Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and
regulations made thereunder.
(15) Vehicular pollution: Prevention and control of vehicular pollution shall be with done in accordance with
applicable laws.
(16) Industrial Units: (i) No new polluting industries shall be allowed to be set up within the Eco-sensitive
Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone. as per classification of
Industries in the Guidelines issued by Central Pollution Control Board and in addition, non-polluting cottage
industries shall be promoted.
(17) Protection of hill slopes: The protection of hill slopes shall be as under:
(a)
The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b)
No construction on existing steep hill slopes or slopes with a high degree of erosion shall be
permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco
sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986)
and the rules made thereunder and be regulated in the manner specified in the Table below, namely:-

kilometre of the boundary of the Protected Area or upto the extent of
Eco-sensitive zone, whichever is nearer, except for small temporary
structures for eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the
Protected Area or upto the extent of Eco-sensitive zone whichever is
nearer, all new tourist activities or expansion of existing activities
shall be in conformity with the Tourism Master Plan and guidelines
as applicable.
9.
Construction activities
(a) No new commercial construction of any kind shall be permitted
within one Kilometre from the boundary of the Protected Area or
upto extent of the Eco-sensitive Zone whichever is nearer:
Provided that, local people shall be permitted to undertake
construction in their land for their use including the activities listed
in sub paragraph (1) of paragraph 3 as per building byelaws.
(b) Construction activity related to small scale industries not causing
pollution shall be regulated and kept at the minimum, with the prior
permission from the competent authority as per applicable rules and
regulations, if any.
(c) Beyond one kilometre it shall be regulated as per the Zonal
Master Plan.
10.
Small scale industries not
causing pollution.
Non-polluting, non-hazardous, small-scale and service industry,
agriculture, floriculture, horticulture or agro-based industry
producing products from indigenous materials from the Eco-
sensitive Zone shall be permitted by the Competent Authority.
11.
Setting up of brick kilns.
Regulated (except as otherwise provided) as per applicable laws.
12.
Felling of trees.
(a) There shall be no felling of trees on the forest or Government or
revenue or private lands without prior permission of the competent
authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the

thereunder.

- Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this notification which shall comprise of the following, namely:-
(i) District Collector, Kadappa
-Chairman;
(ii) One representative of Non Governmental Organisation working in the field of environment to be nominated by the Government of Andhra Pradesh for three years
- Member;
(iii) One expert in the area of ecology and environment to be nominated by the Government of Andhra
Pradesh for three years - Member;
(iv) Regional Officer, State Pollution Control Board – Member;
(v) The Divisional Forest Officer, Proddatur Wildlife Division – Member;
(vi)
Representative
of
the
Department
of
Environment,
Government
of
Andhra
Pradesh
– Member; (vii) Member-Secretary/Member of the State Biodiversity Board - Member; (viii) Representative of the Department Of Urban Development, Government of Andhra Pradesh
– Member;
(ix) Deputy Conservator of Forests/ Divisional Forest Officer, Kadapa Division – Member Secretary.
- Terms of reference.-
(1)
The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The tenure of the Monitoring Committee shall be three years. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.

(6)
The Monitoring Committee may invite representatives or experts from concerned Departments,
representatives from Industry Associations or concerned stakeholders to assist in its deliberations
depending on the requirements on issue to issue basis.
(7)
The Monitoring Committee shall submit the annual action taken report of its activities as on 31st
March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro
forma appended at Annexure IV.
(8)
The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7.
The Central Government and State Government may specify additional measures, if any, for giving
effect to the provisions of this notification.
8.
The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by
the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal.
