पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय अिधसूचना नई ᳰद᭨ली, 15 जनवरी, 2016 का.आ. 250(अ).—िन᳜िलिखत ᮧाᱨप अिधसूचना, िजसे के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पᳯठत उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, जारी करने का ᮧ᭭ताव करती है, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) कᳱ अपेᭃानुसार, जनसाधारण कᳱ जानकारी के िलए ᮧकािशत कᳱ जाती है; िजनके उससे ᮧभािवत होने कᳱ संभावना है ; और यह सूचना दी जाती है ᳰक उᲦ ᮧाᱨप अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना वाले भारत के राजपᮢ कᳱ ᮧितयां जनसाधारण को उपल᭣ध करा दी जाती हᱹ, साठ ᳰदन कᳱ अविध कᳱ समाि᳙ पर या उसके प᳟ात् िवचार ᳰकया जाएगा ;

ऐसा कोई ᳞िᲦ, जो ᮧाᱨप अिधसूचना मᱶ अंतᳶव᳥ ᮧ᭭तावᲂ के संबंध मᱶ कोई आᭃेप या सुझाव देने मᱶ िहतब᳍ है, इस ᮧकार िविन᳸द᳥ अविध के भीतर, के᭠ᮤीय सरकार ᳇ारा िवचार ᳰकए जाने के िलए, आᭃेप या सुझाव सिचव, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय, इंᳰदरा पयाᭅवरण भवन, जोर बाग रोड, अलीगंज, नई ᳰद᭨ली-110003 या ई-मेल पते: esz- mef@nic.in पर िलिखत ᱨप मᱶ भेज सकेगा ।
ᮧाᱨप अिधसूचना नेलाप᭗टू पᭃी अभयार᭛य आंᮥ ᮧदेश के ने᭨लौर िजले के डोरावरीसᮢम मंडल मᱶ ि᭭थत है और इसका ᭃेᮢफल लगभग 458.92 हे᭍टेर है तथा 13051’ से 13059’ उ. और 79057’ से 79059’ पू. के बीच ि᭭ थ त है; और, अभयार᭛ य ᭪ यापक िविवधता वाली पᭃी ᮧजाितयᲂ के ᮧजनन और बसेरा दोनᲂ ᮧयोजनᲂ के िलए एक ᭭ वगᭅ है और यह दिᭃ ण – पूवᭅ एिश या मᱶ सबसे बड़े पेलीकन के वास ᭭ थान मᱶ से एक है।

और, इस अभयार᭛ य मᱶ बᱟत से शीत ᮧवासी पिᭃ यां आते है और यह ᮕे पेलीकन, घᲂिघ ल, छोटा जलकाग, चमचा, सफेद बु᭔ जा, वाक बगुला, आᳰद कुछ इस तरह कᳱ दुलᭅभ और संकटाप᭠ न ᮧजाितयᲂ के िलए एक ᮧजनन भूिम है ।
और, नेलाप᭗टू पᭃी अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ हᱹ, पयाᭅवरण कᳱ दृि᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष᳍ करना आव᭫यक है;
अतः, इसिलए, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (3) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, आंᮥ ᮧदेश रा᭔ य मᱶ नेलाप᭗टू पᭃी अभयार᭛य कᳱ सीमा से 2 मीटर तक के िव᭭ तार तक के ᭃेᮢ को नेलाप᭗टू पᭃी अभयार᭛य पाᳯरि᭭थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭थितक संवेदी जोन कहा गया है) के ᱨप मᱶ अिधसूिचत करती है, िजसका िववरण िन᳜ानुसार है, अथाᭅत् :--

1. पाᳯरि᭭थितक संवेदी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) पाᳯरि᭭थितक संवेदी जोन ने᭨लाप᭗टू पᭃी अभयार᭛य कᳱ सीमा से 2 ᳰक लोमीटर तक के ᭃेᮢ मᱶ फैला ᱟआ है और इसमे आंᮥ ᮧदेश के ने᭨लौर िजले के कुछ ᮕाम शािमल है ।
   (2) पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का िव वरण उपाबंध – I के ᱧप मᱶ उपाब᳍ है और ᮕामᲂ कᳱ सूची उपाबंध-II मᱶ दी गई है ।
   (3) पाᳯरि᭭थितक संवेदी जोन का मानिच ᮢ अᭃांश और देशा᭠तर के साथ उपाबंध III के ᱨप मᱶ उपाब᳍ है ।
2. पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के िलए राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ संल᭏ न अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी । (2) आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
   (3) रा᭔य सरकार ᳇ारा पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप तथा सुसंगत कᱶᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य और कᱶᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार होगी । (4)आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭ थितकᳱय िवचारᲂ को समाकिलत करने के िलए रा᭔ य सरकार के सभी संब᳍ िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत्:-- (i) पयाᭅवरण; (ii) वन;
   (iii) नगर िवकास; (iv) पयᭅटन; (v) नगरपािलक; (vi) राज᭭ व;
   (vii) कृिष;
   (viii) रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ;
   (ix) ᳲसचाई; और
   (x) लोक िनमाᭅण िवभाग,

महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᳥ न हᲂ और आचंिलक महायोजना मᱶ सभी अवसंरचना ᳰᮓयाकलापᲂ मᱶ दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी । (6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान देना आव᭫यक है, के िलए उपबंध हᲂगे । (7)
आंचिलक महायोजना सभी िव᳒मान एवं ᮧ᭭तािवत पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, आ᳸कडᲂ, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी । (8) आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭ थितक अनुकूल िवकास और ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करते ᱟए िविनयिमत होगी ।
3. रा᭔य सरकार ᳇ारा ᳰकए जाने वाले उपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :-- (1) भू-उपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद सं 12, 18, 24, 30 और सं. 33 के सामने सूचीब᳍ ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ से संबंिधत पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए िलए पाᳯरि᭭थितक अनुकूल कुटीर जैसे टᱹट, लकड़ी के मकान आᳰद ।
(ii) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदृढ करना, (iii) ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग, (iv) वषाᭅ जल संचय, और
(v) कुटीर उ᳒ोगᲂ मᱶ ᮕाम उ᳒ोग, भंडारण कᳱ सुिवधा और ᭭थानीय सुख-सुिवधाएं सि᭥मिलत हᱹ :: परंतु यह और भी ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन तथा संिवधान के अनु᭒छेद 244 और त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा :
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना देनी होगी ।
परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा : परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु᭍ त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।

(2) ᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुननᭅवीकरण के िलए योजना को सि᭥ मिलत ᳰकया जाएगा और रा᭔ य सरकार ᳇ारा ऐसी रीित से मागᭅदशᭅक िस᳍ांत बनाए जाएंगे िजससे ᳰक उन ᭃेᮢᲂ मᱶ या इसके समीप िवकास ᳰᮓयाकलाप को रोका जा सके जो ऐसे ᭃेᮢ के िलए हािनकारक हᱹ । (3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, जो पयᭅटन महायोजना के अनुसार हᲂगे, आंचिलक महायोजना का भाग ᱨप मᱶ हᲂगे ।
(ख) पयᭅटन महायोजना पयᭅटन िवभाग, ᳇ारा आ᭠ᮥ ᮧदेश रा᭔य सरकार के वन और पयाᭅवरण िवभाग के परामशᭅ से तैयार होगी ।
(ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :- (i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िस᳍ांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण के पाᳯरि᭭थितक पयᭅटन मागᭅदशᭅक ᳇ारा जारी (समय-समय पर यथा संशोिधत) िस᳍ांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व देते ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(ii) पाᳯरि᭭थितक अनुकूल पयᭅटक ᳰᮓयाकलापᲂ के संबंध मᱶ अ᭭ थायी अिधभोग के िलए वास सुिवधा के िसवाय नेलाप᭗टू पᭃी अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर भीतर होटल और ᳯरसोटᲄ का नया संिनमाᭅण अनु᭄ात नहᱭ होगा; परंतु संरिᭃत ᭃेᮢᲂ कᳱ सीमा से एक ᳰकलोमीटर कᳱ दूरी से परे पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक नए होटल और ᳯरसोटᭅ कᳱ ᭭थापना पयᭅटन महायोजना के अनुसार पाᳯरि᭭थितक पयᭅटन सुिवधा के िलए पूवᭅ पᳯरभािषत और िविन᳸द᳥ ᭭थान मᱶ ही अनु᭄ात ᳰकया जाएगा । (iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकाᳯरयᲂ ᳇ारा अनु᭄ात ᳰकया जाएगा । (4) नैसᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । (5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदूषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदूषण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग, वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।
(7) वायु ᮧदूषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदूषण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग, वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।

(8) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, जल (ᮧदूषण िनवारण तथा िनयंᮢण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा । (9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा – (i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण और वन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 908(अ), तारीख 25 िसतंबर, 2000 नगरपािलक ठोस अपिश᳥ (ᮧबंध और हथालन) िनयम, 2000 के उपबंधᲂ के अनुसार ᳰकया जाएगा ; (ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा ।
(10) जैव िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण और वन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं. का.आ. 630 (अ) तारीख 20 जुलाई, 1998 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ (ᮧबंध और हथालन) िनयम, 1998 के उपबंधᲂ के अनुसार ᳰकया जाएगा । (11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध सि᭥मिलत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔य सरकार के सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होने तक, मानीटरी सिमित सुसंगत अिधिनयमᲂ और ᮧवृᱫ िनयमᲂ और इसके अ᭟यधीन बनाए गए िविनयमᲂ के अधीन यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
(12) औ᳒ोिगक इकाइयां –
(क) ᮧ᭭तािवत पाᳯरि᭭थितक संवेदी जोन के भीतर नए का᳧ आधाᳯरत उ᳒ोगᲂ कᳱ ᭭थापना िविध के अनुसार ᭭थािपत िव᳒मान का᳧ आधाᳯरत उ᳒ोग के िसवाय अनु᭄ात नहᱭ ᳰकए जाएंगे ।

(ख) ᮧ᭭तािवत पाᳯरि᭭थितक संवेदी जोन के भीतर जल, वायु, मृदा, ᭟विन ᮧदूषण के कोई नए उ᳒ोग कᳱ ᭭थापना अनु᭄ात नहᱭ होगी ।
4. पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧितिष᳍ और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सूची - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ और इसके अ᭟यधीन बनाए गए िनयमᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत् :--

सारणी ᮓम सं. ᳰᮓयाकलाप टीका-ᳯट᭡पणी (1) (2) (3) ᮧितिष᳍ ᳰᮓयाकलाप: 1. वािणि᭔यक खनन, प᭜थर उ᭜खनन और उनको तोड़ने कᳱ इकाइयां | (क) सभी नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर उ᭜खनन और उनको तोड़ने कᳱ इकाइयां वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ घरेलू आव᭫यकताᲐ के िसवाय नहᱭ हᲂगी िजसमᱶ िनजी

उपयोग के िलए मकानᲂ के संि᳖माᭅण या मर᭥मत के िलए भूिम को खोदना और मकान बनाने के िलए देशी टाइलᲂ एवं ईटᲂ का िनमाᭅण भी सि᭥मिलत है ; (ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदेश तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदेश के अनुसरण मᱶ सवᭅदा ᮧचालन होगा । 2. आरामीलो कᳱ᭭थापना। पाᳯरि᭭थितकसंवेदीजोनके भीतर नई और िव᳒मान आरा मीलो का िव᭭ तार अनु᭄ात नहᱭ होगा । 3. जल या वायु या मृदा या ᭟ विन ᮧदूषण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितकसंवेदीजोनके भीतर नए और िव᳒मान ᮧदूषण काᳯरत करने वाले उ᳒ोग का िव᭭ तार अनु᭄ात नहᱭ होगा । 4. जलावनलकड़ीकावािणि᭔यकउपयोग। लागू िविधयᲂके अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । 5. नए बृहत जल िव᳒ुत, िसचाᲊ पᳯरयोजनाᲐ और थमᭅल पᳯरयोजना का ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । 6. खतरनाक पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । 7. ᮧाकृितकजलिनकायᲂयासतहीᭃेᮢमᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । 8. पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे वायुयान, गमᭅ वायु गु᭣बारᲂ का रा᳦ीय पाकᭅ ᭃेᮢ के ऊपर से उड़ना । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । 9. नए का᭬ ठआधाᳯरत उपयोग। पाᳯरि᭭ थितकसंवेदीजोनकᳱ सीमाᲐ के भीतर नए का᭬ ठआधाᳯरत उ᳒ोग कᳱ ᭭ थापना को अनु᭄ात नहᱭ ᳰकया जाएगा : परंतु िव᳒मान का᳧ आधाᳯरत उ᳒ोग लागू िविध के अनुसार िनरंतर बने रहᱶगे ; 10. तटीय जलकृिष । कोई जल कृिष जो ᭭व᭒छ जल कृिष को नुनᱧरा करती हो तो पाᳯरि᭭थितक संवेदी जोन मᱶ अनुमत नहᱭ है । 11. जलपोत ᳇ारा वािणि᭔यक ᳰᮓयाकलापᲂ के ᱧप गैर पांरपᳯरक रीित मᱶ मछली पकड़ना । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । िविनयिमत ᳰᮓयाकलाप 12. होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना। पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ को अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय संरिᭃत ᭃेᮢ सीमा से एक ᳰकलोमीटर के भीतर कोई नया वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ हᲂगे । तथािप, एक ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक, सभी पयᭅटन ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना और रा᳦ीय ᳞ाᮖ संरᭃण ᮧािधकरण के मागᭅ-दशᭅक िस᳍ांतᲂ के अनुᱧप ᳰकया जाएगा । 13. संिनमाᭅणᳰᮓयाकलाप। (क)नेलाप᭗टू पᭃी अभयार᭛य कᳱ सीमा से ऊपर पाᳯरि᭭थितक संवेदी जोन मᱶ 100 मीटर कᳱ दूरी के िलए, ᳰकसी भी तरह का कोई नया संिनमाᭅण 1000 से अिधक घन इंच आयाम के नलकूप चᱹबर ᭭ वीकार

कᳱअनुमित नहᱭदी जाएगी। (ख)पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ मᱶ नेलाप᭗टू पᭃी अभयार᭛य कᳱ सीमा से 100 से 500 मीटर के बीच के अंतगᭅत ᳰकसी भी बᱟमंिजल (25 फुट ) संिनमाᭅण कᳱ अनुमित नहᱭ दी जाएगी। (ग) संरिᭃत ᭃेᮢ कᳱ सीमा से 500 ᳰकलोमीटर से परे पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक वा᭭तिवक ᭭थानीय लोगᲂ के िलए संिनमाᭅण कायᭅ अनु᭄ात ᳰकया जाना आव᭫यक होगा और अ᭠य वािणि᭔यक संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनुसार िविनयिमत हᲂगे । (घ) पाᳯरि᭭थितक संवेदी जोन मᱶ संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनुसार हᲂगे ।

14. वृᭃᲂकᳱकटाई। (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳰक᭠ही वृᭃᲂ कᳱ कटाई नहᱭ होगी;
    (ख) वृᭃᲂ कᳱ कटाई संबंिधत के᭠ᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी;
    (ग) आरिᭃत वन और संरिᭃत वन कᳱ दशा मᱶ िनधाᭅᳯरत कायᭅ योजना का अनुपालन ᳰकया ᳰकया जाएगा ।
15. वािणि᭔यकजलसंसाधनिजसकेअंतगᭅत भू-जल संचयन भी है । (क) भूिम के अिधभोगी के वा᭭तिवक कृिष और घरेलू खपत के िलए जल का िन᭬कषᭅण (सतही और भूिमगत जल) अनु᭄ात होगा ।
    (ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भूिमगत जल का िन᭬कषᭅण के िलए संबंिधत िविनयामक ᮧािधकरण पूवᭅ िलिखत अनु᭄ा अपेिᭃत होगी िजसके अंतगᭅत ᳰकतने पᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी है ।
    (ग) सतही जल या भूजल का िवᮓय अनु᭄ात नहᱭ होगा ।
    (घ) जल के संदूषण या ᮧदूषण, िजसके अंतगᭅत कृिष भी है, को रोकने के िलए सभी उपाय ᳰकए जाएंगे ।
16. िव᳒ुत केबलᲂ और दूरसंचार टावरᲂ का पᳯरिनमाᭅण। (क) नेलाप᭗टू पᭃी अभयार᭛य कᳱ सीमा से 500 मीटर कᳱ दूरी तक पाᳯरि᭭थितक संवेदी जोन मᱶ उᲬ शिᲦ िव᳒ुत पारेषण केबलᲂ को डालना अनु᭄ात नहᱭ होगा । (ख) भूिमगत केबलᲂ को ᮧो᭜ साहन देना ।
17. होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
18. िव᳒मानसड़कᲂकोचौड़ाकरनाऔर उ᭠हᱶ सुदृढ करना । उिचतपयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपाययथा लागू अनुसार हᲂगे ।
19. रािᮢमᱶयािनकयातायातकासंचलन। लागू िविधयᲂ के अधीन वािणि᭔यकᮧयोजनकेिलएिविनयिमत हᲂगे।
20. िवदेशी ᮧजाितयᲂ को लाना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
21. पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे।
22. ᮧाकृितकजलिनकायᲂयासतहीᭃेᮢमᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरतबिह᮲ाᭅवकेपुनचᮓणकोᮧो᭜सािहतकरनाऔरअबमलया ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा ।
23. वािणि᭔ यक साइनबोडᭅऔरहोᳺडग। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

24. ᮧदूषणउ᭜प᳖नकरनेवालेलघुउ᳒ोग। पाᳯरि᭭ थितक संवेदी जोन से गैर ᮧदूषण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत देशीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग और जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते हᱹ, अनु᭄ात ᳰकए जाएंगे ।
25. वनउ᭜पादᲂऔरगैरका᭬ ठवनउ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
26. वायु और यानीय ᮧदूषण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
27. पोिलथीन के थैलᲂ का उपयोग । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
28. कृिष ᮧणाली मᱶ ᮧबल बदलाव । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । संवᳶधत ᳰᮓयाकलाप
29. ᭭थानीयसमुदायᲂ᳇ाराचलरहीकृिष और बागवानी ᮧथाᲐ के साथ दु᭏धशाला, डेयरी उ᳒ोग, एᲤाक᭨चर और मछली पालन । लागू िविधयᲂ के अधीन अनु᭄ातहᲂगे ।

32. सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना ।

34. नवीकरणीयऊजाᭅ᮲ोतकाउपयोग। बायो गैस, सौर लाइट, आᳰद का संवधᭅन ᳰकया जाएगा।
35. मानीटरी सिमित - कᱶᮤीय सरकार पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :-

(1) मानीटरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी। (2) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 सारणी मᱶ िविन᳸द᳥ ᮧितिष᳍ गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी।
(3) इस अिधसूचना के पैरा 4 के अधीन सारणी मᱶ यथा िविन᳸द᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के

पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं᭎यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया है, परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते हᱹ, ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब᳍ िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(4) मानीटरी सिमित का सद᭭य-सिचव या संबंिधत कल᭍टर या संबंिधत उ᳒ान के उप-वन संरᭃक, कोई ᳞िᲦ जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता है, उसके िवᱧ᳍ पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा । (5) मानीटरी सिमित मु᳎ᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब᳍ पणधाᳯरयᲂ के ᮧितिनिध ᮧित मु᳎े कᳱ अपेᭃाᲐ के अनुसार िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी । (6) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ रा᭔य के मु᭎य व᭠यजीव वाडᭅन को अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ उपाबंध IV पर उपाब᳍ ᮧाᱨप पर 30 जून तक ᮧ᭭तुत करेगी । (7) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदेश दे सकेगा, जो वह ठीक समझे । 7.
इस अिधसूचना के उपबंधᲂ को ᮧभाव देने के िलए कᱶᮤीय सरकार और रा᭔ य सरकार अितᳯर᭍ त उपाय, यᳰद कोई हᲂ, िविन᳸द᭬ ट कर सकᱶगे ।

NOTIFICATION New Delhi, the 15th January, 2016 S.O.250(E).— The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Aliganj, New Delhi-110003, or send it to the e-mail address of the Ministry at esz- mef@nic.in Draft Notification WHEREAS, Nelapattu Bird Sanctuary is situated in Nelapattu Villlage of Doravarisatram Mandal in Nellore District of Andhra Pradesh and has an area of about 458.92 hectare and it is situated between Latitude 13°51’ to 13°59’ North, longitude 79° 57’ to 79° 59’ East;
AND WHEREAS, the said Sanctuary is a heaven for a wide variety of bird species for both breeding and roosting purpose and it is one of the largest Pelicanry in South – East Asia; AND WHEREAS, many winter migratory birds visit this sanctuary and it is a breeding ground for some of the rare and endangered species like Grey Pelican, Open Bill Stork, Little Cormorant, Spoon bill, White ibis, Night heron etc;
AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification up to two kilometers from the boundary of the Protected area of Nelapattu Bird Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or and their operations and processes in the said Eco-sensitive Zone; Now therefore, in exercise of the powers conferred by sub-section (1) and with clauses (v) and (xiv) of sub– section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of upto two kilometer from the boundary of Nelapattu Bird Sanctuary in the State of Andhra Pradesh as the Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1.
Extent and boundary of Eco-sensitive Zone.-(1) The extent of Eco-sensitive Zone varies up to two kilometers from the boundary of Nelapattu Bird Sanctuary and includes certain villages in Nellore District of Andhra Pradesh.
(2)
The boundary description of the Eco-sensitive Zone is appended as Annexure I and the list of villages are given in Annexure-II. (3)
The map of Eco-sensitive Zone boundary together with latitudes –longitudes is appended as Annexure III; 2. Zonal Master Plan for the Eco-sensitive Zone.-(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2)
The said Plan shall be approved by the competent authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments for integrating environmental and ecological considerations into it, including the following State Departments, namely:- (i) Environment; (ii) Forest; (iii) Urban Development; (iv) Tourism; (v) Municipal; (vi) Revenue; (vii) Agriculture; (viii) State Pollution Control Board; (ix) Irrigation; and (x) Public Works Department;

The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification; and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure eco-friendly development for livelihood security of local communities.

Measures to be taken by State Government.-The State Governments shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 12, 18, 24, 30 and 33 in column (2) of the Table in paragraph 4, namely:- (i) Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities; (ii) Widening and strengthening of existing roads; (iii) Small scale industries not causing pollution; (iv) Rainwater harvesting; and
(v)
Cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. Provided also that there shall be no consequential reduction in green area, including forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan; (b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment, Government of Government of Andhra Pradesh.
(c) The activity of tourism shall be regulated as under, namely:-
(i)
all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority from time to time, with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone; (ii)
new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Nelapattu Bird Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities;

Provided that, beyond the distance of one kilometer from the boundary of the protected areas upto the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre- defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(iii)
till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of final notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of final notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder. (7) Air pollution.- The Environment Department of the State Government or State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974) and the rules made thereunder. (9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September 2000 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non- biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone (10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number
S.O. 630(E), dated the 20th July, 1998 as amended from time to time. (11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Industrial units.- (a) no establishment of new wood based industries within the proposed Eco-sensitive Zone, this shall be apply to the existing legal wood based industries; (b) no establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the table below, namely:- TABLE S.No. Activity Remarks (1) (2) (3) Prohibited activities 1. Godavarman Thirumulpad Vs. Union Of India in Writ Petition (Civil) No.202 of 1995 and order of the Hon’ble Supreme Court dated 21st April, 2014 in the matter of Goa Foundation Vs. Union Of

India in Writ Petition (Civil) No.435 of 2012. 2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone. 3. Setting up of industries causing water or air or soil or noise pollution. No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted.
4. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws. 5. Establishment of new major hydroelectric projects and irrigation projects. Prohibited (except as otherwise provided) as per applicable laws. 6. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws. 7. Discharge of untreated effluents and solid waste in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws. 8. Undertaking activities related to tourism like over-flying the National Park Area by aircraft, hot-air balloons. Prohibited (except as otherwise provided) as per applicable laws. 9 New wood based industry.
Establishment of new wood based industry shall not be permitted within the limits of Eco-sensitive Zone: Provided the existing wood-based industry may continue as per law. 10 Coastal Aquaculture. No aquaculture either brackish water of fresh water aquaculture is permitted within the Eco-sensitive Zone.
11 Fishing by trawlers in un traditional manner as a large scale commercial activity.
Prohibited (except as otherwise provided) as per applicable laws. Regulated activities 12. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within One Kilometer of the boundary of the protected area except for accommodation for temporary occupation of tourists related to eco- friendly tourism activities. However beyond one kilometre and upto the extent of the Eco-sensitive Zone all new tourism activities would in conformity and Tourism Master Plan and National Tiger Conservation Authority guidelines. 13. Construction activities. (i) From the boundary of Nelapattu Bird Sanctuary up to a distance of 100 metres in the Eco-Sensitive Zone, no new construction of any kind shall be allowed accept tubewell chamber of dimension not more than 1000 cubic inches; (ii) the construciton any building more than two stories (25 Ft) shall not be allowed in the Eco- Sensitive Zone area falling between 100 to 500 metres from the boundary of the Nelapattu Bird Sanctuary (iii) beyond 500 metre upto the extent of Eco sensitive Zone construction for bona fide local needs shall be allowed and other construction activities shall be regulated as per Zonal Master Plan; (iv) construction activity in the Eco sensitive Zone

shall be as per Zonal Master Plan.
14. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government;
(b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. (c) in case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed. 15. Commercial water resources including ground water harvesting. (a) The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land; (b) extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned regulatory authority; (c) no sale of surface water or ground water shall be permitted;
(d) steps shall be taken to prevent contamination or pollution of water from any source including agriculture. 16. Erection of electrical cables and telecommunication towers. (a) The laying of new high tension transmission wires shall be not be allowed from the boundary of Nelapattu Bird Sanctuary to a distance of 500 mtrs in the Eco-Sensitive Zone.
(b) promote underground cabling. 17. Fencing of existing premises of hotels and lodges. Regulated under applicable laws. 18. Widening and strengthening of existing roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable. 19. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws. 20. Introduction of exotic species.
Regulated under applicable laws. 21. Protection of hill slopes and river banks. Regulated under applicable laws. 22. Discharge of treated effluents in natural water bodies or land area. Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed.
23. Commercial sign boards and hoardings. Regulated under applicable laws. 24. Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted. 25. Collection of Forest produce or Non- Timber Forest Produce (NTFP). Regulated under applicable laws. 26. Air and vehicular pollution. Regulated under applicable laws. 27. Use of polythene bags by shopkeepers. Regulated under applicable laws. 28. Drastic change of agriculture Regulated under applicable laws.

Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:- (a)
District Collector, Nellore

        –     Chairman

One representative of Non Governmental Organisation working in the field of environment to be nominated by the Government of Andhra Pradesh for a term of one year in each case – Member
(c)

(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(3) The activities that are not covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(4) The Member-Secretary of the Monitoring Committee or the concerned collector or the concerned Park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.

The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. systems. Promoted activities 29. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted under applicable laws. 30. Rain water harvesting. Shall be actively promoted. 31. Organic farming. Shall be actively promoted. 32. Adoption of green technology for all activities. Shall be actively promoted. 33. Cottage industries including village artisans, etc. Regulated for commercial purpose under applicable laws. 34. Use of renewable energy sources. Bio gas, solar light and such other energy scansion to be promoted.

(6) The Monitoring Committee shall submit the annual action taken report of its activities as on
31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per proforma appended at Annexure IV. (7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F. No. 25/59/2014-ESZ-RE] Dr. T. CHANDINI, Scientist ‘G’ Annexure I
Boundary description of Eco-Sensitive Zone:

North: - Eco- Sensitive Zone boundary around 2 Kilometre of Nelapattu Bird Sanctuary boundary starts at 101 Kilometre stone of Railway line which is station 1 and proceeds towards North east direction and touches at station No.2. Thence the line runs towards easterly direction and crosses the Northern point of Nelaballi RF and joins at station No.3. Thence the line runs towards easterly direction and joins at station No. 4. Thence the line runs towards easterly direction and joins at western boundary of pudur RF which is station No.5. East: - Thence the line proceeds towards South East direction and crosses the Pudur RF and joins at Western boundary of Kallur RF which is Station No 6. Then the line proceeds towards southern direction with in the Western boundary of Kalluru RF and joins at Station No 7. Then the line runs towards southern direction along the Western boundary of Kalluru RF and joins at station No 8. Then the line runs towards South west direction crosses. The Kalluru RF and joins at Blacktop Road which is station No.9. From there the line proceeds towards southern direction and touches at station No.10 South: Thence Line precedes towards Western direction crosses the Railway line at 94.3 Kilometre and joins at station No.11.Then the line proceeds towards western direction and joins at station No12 near NH5. Then the line runs towards North West direction crosses the NH 5 at 91.7 Kilometre and joins at Irrigation tank of Kuppareddy Palem Village which is Station No.13. West:- Thence the line proceeds towards North west direction and joins at station No 14. From there the line proceeds towards North West direction and joins at station No 15 in Ekollu RF. Then the line proceeds towards northerly direction and joins at station No.16 in the Rosanur protected Forest. From there, the line proceeds towards North East direction and crosses the Railway line at 101 km. stone and joins at station 1, which is closed station.
