पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय अिधसूचना नई िदल्ली, 8 जून, 2017 का.आ. 1868(अ).—ᮧारुप अिधसूचना, भारत के राजपᮢ, असाधारण, मᱶ भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना संख्यांक का.आ. 250 (अ), तारीख 15 जनवरी, 2016, ᳇ारा ᮧकािशत की गई थी, िजसमᱶ उन सभी ᳞िᲦयᲂ से िजनके उससे ᮧभािवत होने की संभावना थी, उस तारीख से, िजसको भारत के राजपᮢ मᱶ ᮧकािशत अिधसूचना की ᮧितयां जनता को उपलब्ध कराई गई थᱭ, साठ िदन की समाि᳙ के पूवर् आक्षेप और सुझाव आमंिᮢत िकए गए थे; और, ᮧारुप अिधसूचना के ᮧत्युᱫर मᱶ िकन्ही ᳞िᲦयᲂ और पणधािरयᲂ से कोई आक्षेप और सुक्षाव ᮧा᳙ नहᱭ हुआ है; नेलापट्टू पक्षी अभयारण्य आंᮥ ᮧदेश राज्य के नेल्लौर िजले के डोरावरीसᮢम मंडल के नेलापट्टू ᮕाम के मᱶ िस्थत है और इसका क्षेᮢफल लगभग 4.58 वगर् िकलोमीटर है तथा अक्षांश 13º51’ से 13º59’ उ. उᱫर और देशांतर 79º57’ से 79º59’ पूवर् के बीच िस् थ त है; और, अभयारण् य व् यापक िविवधता वाली पक्षी ᮧजाितयᲂ के िलए ᮧजनन और बसेरा दोनᲂ ᮧयोजनो हेतु एक स् वगर् है और यह दिक्ष ण–पूवर् एिश या मᱶ सबसे बड़ा पेलीकन के वास स् थान मᱶ से एक है; और, इस अभयारण् य मᱶ बहुत से शीत ᮧवासी पिक्ष यां आते हᱹ और यह ᮕे पेलीकन(पेलेकनअस िफलीप्पेनिसस), ओपन िबल सारस(अनासटोमुस ओससकिटनस), छोटा जलकाग (मेᮓोᮓाबो नीगर), स्पून िबल (पलाटालेइअ), सफेद

सारस के सदृश जलपक्षी (यूडोिकमीस अलबस), रागी बगुला(नयिसिटकोरक्स नयिसटोᮓोस), आिद कुछ इस तरह की दुलर्भ और संकटापन् न ᮧजाितयᲂ के िलए एक ᮧजनन भूिम है;

और, नेलापट्टू पक्षी अभयारण्य, सीमा से दो िकलोमीटर के क्षेᮢ को, पािरिस्थितक और पयार्वरण की दृि᳥ से पािरिस्थितक संवेदी जोन के रूप मᱶ सुरिक्षत करने के िलए संरक्षण आवश्यक है ; अतः, अब, केन्ᮤीय सरकार, पयार्वरण (संरक्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (2) के खंड (v) और खंड (xiv) के साथ पिठत और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते हुए, आंᮥ ᮧदेश राज् य मᱶ नेलापट्टू पक्षी अभयारण्य की सीमा 2 िकलोमीटर के साथ से 29.21 वगर् िकलोमीटर तक िवस् तृत क्षेᮢ को नेलापट्टू पक्षी अभयारण्य, पािरिस् थितक संवेदी जोन (िजसे इसमᱶ इसके पश् चात् पािरिस् थितक संवेदी जोन कहा गया है) के रूप मᱶ अिधसूिचत करती है, िजसका िववरण िन᳜ानुसार है, अथार्त् :--

  1. पािरिस्थितक संवेदी जोन का िवस्तार और उसकी सीमाएं--(1) पािरिस्थितक संवेदी जोन आंᮥ ᮧदेश राज् य के नेल्लौर िजले मᱶ नेल्लापट्टू पक्षी अभयारण्य की सीमा से 2 िक लोमीटर तक के क्षेᮢ मᱶ फैला हुआ है िजसमᱶ आंᮥ ᮧदेश राज्य के नेल्लोर िजले के कुछ ᮕाम भी शािमल है। (2) पािरिस्थितक संवेदी जोन की सीमा का िव वरण उपाबंध-I के रुप मᱶ उपाब᳍ है और ᮕामᲂ की सूची उपाबंध-II मᱶ दी गई है ।
    (3) इस अिधसूचना के साथ पािरिस्थितक संवेदी जोन का मानिच ᮢ अक्षांश और देशान्तर के साथ उपाबंध-III के रूप मᱶ उपाब᳍ है ।
  2. पािरिस्थितक संवेदी जोन के िलए आंचिलक महायोजना – (1) राज्य सरकार, पािरिस्थितक संवेदी जोन के िलए राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन की तारीख से दो वषर् की अविध के भीतर, स्थानीय ᳞िᲦयᲂ के परामशर् से और इस अिधसूचना मᱶ संलग् न अनुबंधᲂ के सामंजस् य राज्य सरकार मᱶ सक्षम ᮧािधकारी के िलए, आंचिलक महायोजना तैयार करेगी । (2) राज्य सरकार ᳇ारा पािरिस् थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना मᱶ िविन᳸दर्ष् ट रूप तथा सुसंगत कᱶᮤीय और राज् य िविधयᲂ के सामंजस् य और कᱶᮤीय सरकार ᳇ारा जारी मागर्िनदᱷशᲂ, यिद कोई हᲂ, ᳇ारा तैयार होगी । (3) आंचिलक महायोजना, उᲦ योजना मᱶ पयार्वरणीय और पािरिस्थितक िवचारᲂ को समाकिलत करने के िलए राज् य सरकार के िन᳜िलिखत िवभागᲂ के परामशर् से तैयार होगी, अथार्त्:-- (i) पयार्वरण; (ii) वन और वन्यजीव;
    (iii) कृिष ; (iv) राजस् व; (v) नगर िवकास; (vi) पयर्टन;
    (vii) ᮕामीण िवकास;
    (viii) िसंचाई और बाढ़ िनयंᮢण;

(ix) नगरपािलका;
(x) पंचायती राज;
(xi) लोक िन मार्ण िव भाग। (4)
आंचिलक महायोजना अनुमोिदत िव᳒मान भू-उपयोग, अवसंरचना और िᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक िक इस अिधसूचना मᱶ िविन᳸दर्ष् ट न हो और आचंिलक महायोजना सभी अवसंरचना और िᮓयाकलापᲂ मᱶ और अिधक दक्षता और पािरिस्थितक अनुकूलता का संवधर्न करेगी ।
(5) आंचिलक महायोजना मᱶ अनाच्छािदत क्षेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरक्षण, आवाह क्षेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरक्षण, स्थानीय समुदायᲂ की आवश्यकताᲐ तथा पािरिस्थितक और पयार्वरण से संबंिधत ऐसे अन्य पहलूᲐ, िजन पर ध्यान देना आवश्यक है, के िलए उपबंध हᲂगे । (6)
आंचिलक महायोजना सभी िव᳒मान पूजा स् थलᲂ, ᮕामᲂ और नगरीय बंदोबस्तᲂ, वनᲂ के ᮧकार और िकस् मᲂ, कृिष क्षेᮢᲂ, ऊपजाऊ भूिम, हिरत क्षेᮢ जैसे उ᳒ान और उसी ᮧकार के स् थान, उ᳒ान कृिष क्षेᮢ, फलोउ᳒ान, झीलᲂ और अन्य जल िनकायᲂ का अभ्यकंन करेगी और इस योजना के मानिचᮢ ᳇ारा िव᳒मान और ᮧस्तािवत भूिम के उपयोग का िववरण िकया जाएगा । (7)
आंचिलक महायोजना पािरिस्थितक संवेदी जोन मᱶ िवकास को िविनयिमत करेगी और सारणी मᱶ सूचीब᳍ ᮧितिष᳍, िविनयिमत िᮓयाकलापᲂ का पालन करेगा और स्थानीय समुदायᲂ की जीिवकोपाजर्न सुरक्षा के िलए िविनयिमत करगी ।
(8) आंचिलक महायोजना क्षेᮢीय िवकास योजना के साथ सह-अंतक होगी । (9) आंचिलक महायोजना इस अिधसूचना मᱶ िदए गए उपबंधᲂ के अनुसार अपने कायᲄ को करने के िलए मानीटरी सिमित के िलए एक संदभर् दस्तावेज तैयार करेगी । 3. राज्य सरकार ᳇ारा िकए जाने वाले उपाय-- राज्य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथार्त्:-- (1) भू-उपयोग – (क) पािरिस् थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष क्षेᮢᲂ, कृिष क्षेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचिन्हत िकए गए पाकᲄ और खुले स्थानᲂ का वािणिज्यक और औ᳒ोिगक संब᳍ िवकास िᮓयाकलापᲂ के िलए उपयोग या संपिरवतर्न नहᱭ होगा:
परंतु पािरिस्थितक संवेदी जोन के भीतर कृिष भूिम का संपिरवतर्न मानीटरी सिमित की िसफािरश पर और सुसंगत राज्य अिधिनयमᲂ और अन्य िनयमᲂ तथा केन्ᮤीय या राज्य सरकार के अन्य िनयमᲂ और िविनयमᲂ और इस अिधसूचना के उपबंधᲂ के अधीन सक्षम ᮧािधकारी के पूवर् अनुमोदन के साथ स्थानीय िनवािसयᲂ की आवासीय जरूरतᲂ को पूरा करने के िलए अनुज्ञात िकया जा सकेगा। जैसे:- (i) िव᳒मान सड़कᲂ को चौड़ा करना और उन्हᱶ सुदृढ़ करना तथा नई सड़कᲂ का संिनमार्ण; (ii) बुिनयादी ढांचᲂ और नागिरक सुिवधाᲐ का संिनमार्ण और नवीकरण; (iii) ᮧदूषण उत्प᳖ न करने वाले लघु उ᳒ोग; (iv) कुटीर उ᳒ोगᲂ िजसके अंतगर्त ᮕामीण उ᳒ोग भी हᱹ; सुिवधाजनक भण्डार और स्थानीय सुिवधाᲐ सहायक

पािरिस्थितक पयर्टन सिहत ᮕह वास; और
(v) संविधर्त िᮓयाकलाप और अनुच्छेद 4 के अंतगर्त िदया गया है:

परंतु यह और भी िक सुसंगत राज्य िविधयᲂ और राज्य सरकार के अन्य िनयमᲂ और िविनयमᲂ के अधीन सक्षम ᮧािधकारी के पूवर् अनुमोदन तथा संिवधान के अनुच्छेद 244 और तत्समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगर्त अनुसूिचत जनजाित और अन्य परंपरागत वन िनवासी (वन अिधकारᲂ की मान्यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणिज्यक या उ᳒ोग िवकास िᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनुज्ञात नहᱭ होगा:
परंतु यह और भी िक पािरिस् थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुिट, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् राज्य सरकार ᳇ारा ᮧत्येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुिट के संशोधन की सूचना कᱶᮤीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय को देनी होगी ।
परंतु यह और भी िक उपयुर्Ღ ᮢुिट के संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय िकसी भी दशा मᱶ भू-उपयोग का पिरवतर्न सिम्मिलत नहᱭ होगा ।
(ख) परंतु यह और भी अनᮧयुक् त या अनुत् पादक कृिष क्षेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास िकए जाएंगे ।
(2) ᮧाकृितक जल िनकाय -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ, निदयᲂ, चैनलᲂ की पहचान की जाएगी और उनके संरक्षण और पुनरुद्भूतकरण के िलए योजना सिम् मिलत होगी । (3) पयर्टन/ पािरिस्थितक-पयर्टन – (क) पािरिस्थितक संवेदी जोन के भीतर नए पयर्टन या िव᳒मान पािरिस्थितक पयर्टन संबंधी िᮓयाकलापᲂ का िवस्ता महायोजना के अनुसार हᲂगे ।
(ख) पािरिस्थितक-पयर्टन महायोजना पयर्टन िवभाग, ᳇ारा राज्य पयार्वरण और वन िवभाग के परामशर् से तैयार होगी ।
(ग) पािरिस्थितक-पयर्टन महायोजना आंचिलक महायोजना के एक घटक के रूप मᱶ जाना जायेगा । (घ) पािरिस्थितक-पयर्टन संबंधी िᮓयाकलाप िनम् निलिखत के अधीन िविनयिमत हᲂगे, अथार्त् :- (i) नेलापट्टू पक्षी अभयारण्य की सीमा से एक िकलोमीटर तक या पािरिस्थितक संवेदी जोन के िवस्तार तक इनमᱶ जो भी िनकट है, नये वािणिज्यक होटल और िरसोटर् अनुज्ञात नहᱭ हᲂगे ।
तथािप नेलापट्टू पक्षी अभयारण्य की सीमा से एक िकलोमीटर की दूरी मᱶ आगे तक नये होटल और िरसोटर् का स्थापन पयर्टन महायोजना के अनुसार पािरिस्थितक पयर्टन सुिवधाᲐ के िलए पूवर् पिरभािषत और पदािभिहत क्षेᮢो के िलए अनुज्ञात िकया जाएगा; (ii) पािरिस्थितक संवेदी जोन के भीतर सभी नए पयर्टन िᮓयाकलापᲂ या िव᳒मान पयर्टन िᮓयाकलापᲂ का िवस्तार कᱶᮤ सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय के मागर्दशर्क िस᳍ांतᲂ के ᳇ारा तथा राष् ᮝीय व् याᮖ संरक्षण ᮧािधकरण, ᳇ारा जारी पािरिस्थितक पयर्टन मागर्दशर्क िस᳍ांतᲂ के अनुसार, पािरिस्थितक पयर्टन, पािरिस्थितक िशक्षा और पािरिस्थितक िवकास को महत्व देते हुए पािरिस्थितक संवेदी जोन की वहन क्षमता के अध्ययन पर आधािरत होगा;

(iii) आंचिलक महायोजना का अनुमोदन िकए जाने तक, पयर्टन के िलए िवकास और िव᳒मान पयर्टन िᮓयाकलापᲂ के िवस्तार को वास्तिवक स्थल िविन᳸दर᳥् संवीक्षा तथा मानीटरी सिमित की िसफािरश पर आधािरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनुज्ञात िकया जाएगा और पािरिस्थितक संवेदी जोन के भीतर नए होटल, िरसोटर् या वािणिज्यक स्थापनᲂ का िविनयिमत अनुज्ञात नहᱭ िकया जाएगा । (4) नैसिगर्क िवरासत - पािरिस्थितक संवेदी जोन मᱶ महत्वपूणर् नैसिगर्क िवरासत के सभी स्थलᲂ जैसे सभी जीन कोश आरिक्षत क्षेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, स्थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आिद की पहचान की जाएगी और उन्हᱶ संरिक्षत िकया जाएगा तथा उनकी सुरक्षा और संरक्षा के िलए उपयुᲦ योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा । (5) मानव िनिमर्त िवरासत स् थल - पािरिस् थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िशल्प-तथ्य, ऐितहािसक, कलात्मक और सांस्कृितक महत्व के क्षेᮢᲂ की पहचान करनी होगी और उनके संरक्षण की योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सिम्मिलत की जाएगी ।
(6) ध् विन ᮧदूषण - पािरिस्थितक संवेदी जोन मᱶ ध् विन ᮧदूषण की रोकथाम और िनयंᮢण ध्विन ᮧदूषण (िविनयमन और िनयंᮢण) िनयमᲂ 2000 के अनुसार पयार्वरणीय (संरक्षण) अिधिनयम, 1986, के और उसमᱶ िकए गए संशोधनᲂ के अधीन तैयार करेगा ।
(7) वायु ᮧदूषण - पािरिस्थितक संवेदी जोन मᱶ, वायु ᮧदूषण की रोकथाम और िनयंᮢण वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) के उपबंधᲂ और उसके अधीन बनाए गए िनयमᲂ और उसमᱶ िकए गए संशोधनᲂ के अनुसार तैयार करेगा ।
(8) बिह᮲ाव का िनस्सारण -- पािरिस्थितक संवेदी जोन मᱶ उपचािरत बिह᮲ाव का िनस्सारण सामान्य मानकᲂ के िलए पयार्वरणीय ᮧदूिषत आच्छािदत के िनस्सारण के अंतगर्त पयार्वरणीय (संरक्षण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ राज्य सरकार ᳇ारा िनयत मानकᲂ, जो भी अिधक कठोर हो के उपबंधᲂ के अनुसार होगा। (9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान और ᮧबंधन िन᳜िलिखत रूप मᱶ होगा-- (क) पािरिस्थितक संवेदी जोन मᱶ उपचािरत बिह᮲ाव का िनस्सारण, ठोस अपिशष् ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत िकए गए थे, के उपबंधᲂ के अनुसार िकया जाएगा ;
अकाबर्िनक सामᮕी का िनपटान पािरिस्थितक संवेदी जोन के बाहर पहचान िकए गए स् थल पर िकसी पयार्वरणीय स्वीकृत रीित मᱶ होगा; (ख) पािरिस्थितक संवेदी जोन मᱶ ठोस अपिशष् टᲂ को जलाना या भष् मीकरण और भूिम भराव के स्थापनᲂ को अनुज्ञात नहᱭ िकया जाएगा ।
(10) जैव िचिकत् सीय अपिशष् ट- जैव िचिकत् सीय अपिशष् ट ᮧबंधन िन᳜िलिखत रूप मᱶ होगा— (क) पािरिस्थितक संवेदी जोन मᱶ जैव िचिकत्सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं.का.िन 343 (अ), तारीख 28 माचर्, 2016 ᳇ारा ᮧकािशत जैव िचिकत्सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा ।

(ख) पािरिस्थितक संवेदी जोन मᱶ कोई सामान्य उपचार सुिवधा या भष् मीकरण अनुज्ञात नहᱭ िकया जाएगा । (11) प्लािस्टक अपिश᳥ ᮧबंधन: - पािरिस्थितक संवेदी जोन मᱶ प्लािस्टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं.का.िन 340(अ), तारीख 18 माचर्, 2016 ᳇ारा ᮧकािशत प्लािस्टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार िकया जाएगा। (12) िनमार्ण और िवध्वंस अपिश᳥ ᮧबंधन: - पािरिस्थितक संवेदी जोन मᱶ संिनमार्ण और िवध्वंस अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं.का.िन 317(अ), तारीख 29 माचर्, 2016 ᳇ारा ᮧकािशत संिनमार्ण और िवध्वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा। (13) ई–अपिश᳥:- पािरिस्थितक संवेदी जोन मᱶ ई–अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय ᳇ारा ᮧकािशत ई–अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा। (14) यानीय पिरवहन: - पिरवहन की यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत िकए जाएंगे और आंचिलक महायोजना के तैयार होने और राज्य सरकार के सक्षम ᮧािधकारी ᳇ारा के अनुमोिदत होने तक, मानीटरी सिमित सुसंगत अिधिनयमᲂ और उसके अधीन बनाए गए िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी । (15) यानीय ᮧदूषण:- लागू िविधयᲂ के अनुसार वाहन ᮧदूषण की रोकथाम और िनयंᮢण का अनुपालन िकया जाएगा और स्वच्छक ईंधन के उपयोग के िलए िकए गए ᮧयास उदाहरण के िलए सीएनजी, एलपीजी, आिद हᱹ । (16) औ᳒ोिगक ईकाइयां: - (i) सरकारी राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन पर या ᮧकाशन के प᳟ात, पािरिस्थितक संवेदी जोन के भीतर कोई नए ᮧदूिषत उ᳒ोगᲂ की स्थापना की अनुमित नहᱭ दी जाएगी।
(ii) पािरिस्थितक संवेदी जोन के कᱶᮤीय ᮧदूषण िनयंᮢण बोडर् ᳇ारा जारी मागर्दशर्क िस᳍ातᲂ मᱶ फरवरी, 2016 के भीतर िसफर् गैर- ᮧदूिषत उ᳒ोगᲂ की स्थापना के वगᱮकरण की अनुमित दी जाएगी, जब तक िक इस अिधसूचना मᱶ ऐसा िविन᳸दर᳥् न हो। इसके अलावा, गैर-ᮧदूिषत कुटीर उ᳒ोगᲂ को ᮧो᳖त िकया जाएगा। (17) पहाड़ी ढलानᲂ को संरक्षण: - पहाड़ी ढलानᲂ के संरक्षण के अधीन: (क) आंचिलक महायोजना पहाड़ी ढलानᲂ पर क्षेᮢᲂ पर संकेत होगा जहां िकसी भी संिनमार्ण की अनुमित नहᱭ दी जाएगी । (ख) कटाव के एक उᲬ िडᮕी के साथ िव᳒मान खड़ी पहाड़ी ढलानᲂ या ढलानᲂ पर िकसी भी संिनमार्ण की अनुमित नहᱭ दी जाएगी । (18) अगर यह आवश्यक समझता है, इस अिधसूचना के उपबंधᲂ को ᮧभावी करने मᱶ केन्ᮤीय सरकार और राज्य सरकार, अन्य उपायᲂ िन᳸दर᳥् करेगा। 4. पािरिस्थितक संवेदी जोन मᱶ ᮧितिष᳍ और िविनयिमत िकए जाने वाले िᮓयाकलापᲂ की सूची - पािरिस्थितक संवेदी जोन मᱶ सभी िᮓयाकलाप पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ और तटीय िविनयमन जोन (सीआरजेड), 2011 और पयार्वरणीय ᮧभाव आकलन (ईआईए ) अिधसूचना, 2006 और वन (संरक्षण) अिधिनयम, 1980 (1980 के 69), भारतीय वन अिधिनयम, 1927 (1927 के 16), वन्यजीव (संरक्षण) अिधिनयम, 1972 (1972 के 53) संशोधनᲂ सिहत ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ

िविन᳸दर᳥् रीित मᱶ िविनयिमत हᲂगे, अथार्त् :-- सारणी ᮓम सं. िᮓयाकलाप टीका-िटप्पणी (1) (2) (3) क.ᮧितिष᳍िᮓयाकलाप 1. वािणिज्यक खनन ।
(क) सभी ᮧकार के खनन (लघु और वृहत खिनज), पत्थर की खानᱶ और उनको तोड़ने की इकाइयां वास्तिवक स्थानीय िनवािसयᲂ की घरेलू आवश्यकताᲐ के िसवाय नहᱭ हᲂगी िजसमᱶ मकानᲂ के संि᳖मार्ण या मरम्मत के िलए भूिम को खोदना और मकान बनाने तथा अन्य िᮓयाकलापᲂ के िलए देशी टाइलᲂ का िनमार्ण भी सिम्मिलत है;
(ख) माननीय उᲬतम न्यायालय की िरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गोिवंदरामन िथरुमूलपाद बनाम भारत सरकार के मामले मᱶ आदेश तारीख 4 अगस्त, 2006 और िरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतिरम आदेश के कठोर अनुसरण का ᮧचालन होगा ।
2. जल या वायु या मृदा या ध् विन ᮧदूषण कािरत करने वाले उ᳒ोगᲂ की स् थापना । िकसी भी नए या पािरिस्थितक संवेदी जोन मᱶ ᮧदूषण फैलाने वाले उ᳒ोगᲂ के िवस्तार की अनुमित नहᱭ दी जाएगी । हिरत या श् वेत कृिष आधािरत लघु उ᳒ोगᲂ सिहत केन्ᮤीय ᮧदूषण िनयंᮢण बोडर् वगᱮकरण के रूप मᱶ वगᱮकृत उ᳒ोगᲂ को िनयमᲂ के अनुसार िविनयिमत िकया जाएगा। 3. नए बृहत जल िव᳒ुत पिरयोजना की स् थापना । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अन् यथा उपबंिधत के िसवाय) हᲂगे । 4. िकसी पिरसंकटमय पदाथᲄ का उपयोग या उत्पादन । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अन् यथा उपबंिधत के िसवाय) हᲂगे । 5. ᮧाकृितक जल िनकायᲂ या सतही क्षेᮢ मᱶ अनुपचािरत बिह᮲ार्व । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अन् यथा उपबंिधत के िसवाय) हᲂगे । 6. फमᲄ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़े पैमाने पर वािणिज्यक पशुधन संपदा और कुक्कुट फामᲄ की स्थापना । स्थानीय जरूरतᲂ को पूरा करने के िलए लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अन् यथा उपबंिधत के िसवाय) हᲂगे। 7. नई आरा िमलᲂ की स्थापना। पािरिस्थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िवस् तार अनुज्ञात नहᱭ होगा ।
8. तटीय जलीय कृिष। पािरिस्थितक संवेदी जोन के भीतर कोई जलीय कृिष या ताजे पानी की जलᮧपात की अनुमित नहᱭ है। 9. बड़े पैमाने पर ᳞ावसाियक िᮓयाकलाप के रूप मᱶ गैर परंपरागत तरीके से ᮝालरᲂ ᳇ारा मत्स्य पालन। लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अन् यथा उपबंिधत के िसवाय) हᲂगे ।

होटल और िरसोटर् का वािणिज्यक स्थापन । पािरिस्थितक अनुकूल पयर्टन िᮓयाकलाप से संबंिधत पयर्टकᲂ के अस्थायी अिधभोग के िलए वास सुिवधा के िसवाय संरिक्षत क्षेᮢ की सीमा से एक िकलोमीटर तक या पािरिस्थितक संवेदी जोन के िवस्तार तक इनमᱶ जो भी िनकट है, नये वािणिज्यक होटल और िरसोटर् अनुज्ञात नहᱭ हᲂगे।

परंतु, जहाँ संरिक्षत िवस्तार एक िकलोमीटर से ज्यादा है वहाँ, एक िकलोमीटर से परे और पािरिस्थितक संवेदी जोन के िवस्तार तक सभी नए पयर्टक िᮓयाकलाप या िव᳒मान िᮓयाकलाप का िवस्तार पयर्टन महायोजना और यथा लागू मागर्दशर्क िस᳍ांतᲂ के अनुसार होगा। 11. संिनमार्ण िᮓयाकलाप । (क) संरिक्षत क्षेᮢया पािरिस्थितक संवेदी जोन जो भी िनकट हो की सीमा से एक िकलोमीटर के भीतर िकसी भी ᮧकार का वािणिज्यक संिनमार्ण अनुज्ञात नहᱭ िकया जाएगा:

  परंतु स्थानीय ᳞िᲦयᲂ को उनके उपयोग के िलए उनकी

भूिम मᱶ संिनमार्ण िजसके अंतगर्त भवन िनमार्ण संबंधी उपिविधयᲂ के अनुसार पैरा 3 के उपपैरा (1) मᱶ सूचीब᳍ िᮓयाकलाप भी हᱹ, को करने के िलए अनुज्ञात िकया जाएगा ।

परन्तु ऐसे लघु उ᳒ोगᲂ जो ᮧदूषण उत्पन् न नहᱭ करते हᱹ, से संबंिधत संिनमार्ण िᮓयाकलाप िविनयिमत िकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यिद कोई हᲂ, के अनुसार सक्षम ᮧािधकारी की पूवर् अनुमित से ही न् यूनतम पर रखे जाएंगे ।
(ख) एक िकलोमीटर से आगे आंचिलक महायोजना की अनुसार िविनयिमत हᲂगे । 12. ᮧदूषण उत्प᳖ न करने वालेलघु उ᳒ोग । पािरिस् थितकसंवेदीजोनमᱶ देशीय माल से उत्पादᲂ का उत्पादन करने वाले गैर ᮧदूषण, गैर पिरसंकटमय, लघु और सेवा उ᳒ोग, पुष्पकृिष, कृिष उ᳒ान, कृिष या कृिष आधािरत देशीय माल से औ᳒ोिगक उत्पादᲂ का उत्पादन उ᳒ोग जो पयार्वरण पर कोई िवपरीत ᮧभाव नहᱭ डालते हᱹ, अनुज्ञात िकए जाएंगे ।
13. ईंट भᲵᲂ की स्थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अन् यथा उपबंिधत के िसवाय) हᲂगे ।
14. वृक्षᲂ की कटाई । (क) राज्य सरकार मᱶ सक्षम ᮧािधकारी की पूवर् अनुज्ञा के िबना वन, सरकारी या राजस्व या िनजी भूिम पर वृक्षᲂ की कटाई नहᱭ होगी । (ख) वृक्षᲂ की कटाई संबंिधत कᱶᮤीय या राज्य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार

िविनयिमत होगी । 15. वन उत्पादᲂ और गैर काष् ठ वनउत्पादᲂ (एन टी एफ पी) का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमतहᲂगे । 16. िव᳒ुत केबलᲂ और दूरसंचार टावरᲂ का पिरिनमार्ण और केबल िबछाना और अन्य बुिनयादी ढांचे । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । भूिमगत केबल को बढ़ावा िदया जाएगा। 17. नागिरक सुिवधाᲐ सिहत बुिनयादी ढांचे। लागू िविधयᲂ िनयमᲂ और िविनयमनᲂ और उपलब्ध मागर्दशर्क िस᳍ांतᲂ के अनुसार न्यूनीकरण उपायᲂ के साथ िकया जाएगा ।
18. िव᳒मान सड़कᲂ को चौड़ा करनाऔर उन्हᱶ सुदृढ़ करना । लागू िविधयᲂ िनयमᲂ और िविनयमनᲂ और उपलब्ध मागर्दशर्क िस᳍ांतᲂ के अनुसार न्यूनीकरण उपायᲂ के साथ िकया जाएगा । 19. पयर्टन से संबंिधत िᮓयाकलाप जैसे गमर् वायु गुब्बारᱶ, हेलीकाप्टर, ᮟोन,
माइᮓोलाइटस और अन्य पयर्टन िᮓयाकलाप आिद ᳇ारा पािरिस्थितक संवेदी जोन क्षेᮢ के ऊपर से उड़ना जैसे िᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । 20. पहाड़ी ढालᲂ और नदी तटᲂ का संरक्षण । 21. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणिज्यक ᮧयोजन के िलए िविनयिमत हᲂगे । 22. स्थानीय समुदायᲂ ᳇ारा चलरही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष और मछली पालन । स्थानीयलोगᲂकेउपयोगकेिलएलागू िविधयᲂ के अधीन िविनयिमत हᲂगे । 23. ᮧाकृितक जल िनकायᲂ या सतही क्षेᮢ मᱶ उपचािरत बिह᮲ार्व का िनस्सारण । उपचािरत बिह᮲ार्व का िनस्सारण लागू िविधयᲂ के अधीन के िविनयिमत िकया जाएगा। 24. सतह और भूजल के वािणिज्यक िनष्कषर्ण । 25. खुले कुआ, बोर कुआ, आिद के िलए कृिष और अन्य उपयोग । िविनयिमतऔरउपयुᲦᮧािधकारी ᳇ारा िᮓयाकलापᲂ की सख्ती से मानीटरी की जाएगी। 26. ठोस अपिशष् ट ᮧबंधन। 27. िवदेशी ᮧजाितयᲂ को लाना । 28. पािरिस्थितक-पयर्टन। 29. पोिलथीन बैगᲂ का उपयोग । 30. वािणिज् यक साइनबोडर् और होिडᲈग ।

ग.संविधर्त िᮓयाकलाप 31. वषार् जल संचयन । सिᮓ य रूप से बढ़ावा िदया जाएगा । 32. जैिवक खेती। सिᮓयरूपसेबढ़ावािदयाजाएगा । 33. सभी िᮓयाकलापᲂ के िलए हिरत ᮧौ᳒ोिगकी को ᮕहण करना । सिᮓयरूपसेबढ़ावािदयाजाएगा । 34. कुटीर उ᳒ोगᲂ िजसके अंतगर्त ᮕामीण कारीगर आिद भी हᱹ। सिᮓयरूपसेबढ़ावािदयाजाएगा । 35. नवीकरणीय ऊजार् ᮲ोत का उपयोग। सिᮓय रुप से बायो गैस, सौर ᮧकाश आिद को बढ़ावा िदया जाएगा ।
36. कृिष वािनकी । सिᮓयरूपसेबढ़ावािदयाजाएगा । 37. कौशल िवकास । सिᮓयरूपसेबढ़ावािदयाजाएगा । 38. िन᳜ीकृत भूिम या वन या आवासकी बहाली । सिᮓयरूपसेबढ़ावािदयाजाएगा । 39. पयार्वरणीय जागरुकता । सिᮓ य रूप से बढ़ावा िदया जाएगा । 5. मानीटरी सिमित- (1) कᱶᮤीय सरकार, पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 के 29) की धारा 3 की उप-धारा (3) के अधीन, पािरिस्थितक संवेदी जोन की ᮧभागी मानीटरी के िलए तीन वषर् की अविध हेतु एक मानीटरी सिमित का गठन करती है, जो िन᳜िलिखत से िमलकर बनेगी, अथार्त्:-- (i) िजला कलक् टर, नेल्लौर अध् यक्ष; (ii) पयार्वरण के क्षेᮢ मᱶ कायर् करने वाले गैर सरकारी संगठनᲂ का आंᮥ ᮧदेश सरकार ᳇ारा ᮧत् येक मामले मᱶ तीन वषर् के िल ए नामिन᳸दर᳥् एक ᮧितिनिध - सदस्य; (iii) पािर िस् थ ित की और पयार्वरण के क्षेᮢ मᱶ आंᮥ ᮧदेशसरकार᳇ारातीन वषर् के िल ए नामिन᳸दर᳥् एक ᮧितिनिध
सदस्य; (iv) राज्य जैव िविवधता बोडर् का सदस्य-सिचव/सदस्य सदस्य; (v) क्षेᮢीय अिधकारी, राज्य ᮧदूषण िनयंᮢण बोडर् सदस्य; (vi) राजस्व ᮧभागीय अिधकारी, गुडूर का ᮧितिनिध सदस्य; (vii) ᮧभागीय वन अिधकारी, वन्यजीव ᮧबन्ध ᮧभाग, सुल्लौरपेट सदस्य; (viii) उप वन संरक्षक (ᮧादेिशक), नेल्लौर

सदस्य- सिचव। 6. िनदᱷश - िनबंधन (1) पािरिस्थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी।
(2) पािरिस्थितक संवेदी जोन मᱶ भारत सरकार के तत् कालीन पयार्वरण और वन मंᮢालय की अिधसूचना सं. का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 की अनुसूची मᱶ के अधीन सिम्मिलत िᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष᳍ गितिविधयᲂ के िसवाय आने वाले ऐसे िᮓयाकलापᲂ की दशा मᱶ वास्तिवक िविन᳸दर᳥् स्थलीय दशाᲐ पर आधािरत मानीटरी सिमित ᳇ारा संवीक्षा की जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवर् पयार्वरण िनकासी के िलए केन्ᮤीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय को िन᳸दर᳥् की जाएगी ।

(3) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸दर᳥् ᮧितिष᳍ िᮓयाकलापᲂ के िसवाय, भारत सरकार के तत् कालीन पयार्वरण और वन मंᮢालय की अिधसूचना संख्यांक का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 की अिधसूचना के अनुसूची के अधीन ऐसे िᮓयाकलापᲂ, िजन्हᱶ सिम्मिलत नहᱭ िकया गया है, परंतु पािरिस्थितक संवेदी जोन मᱶ आते हᱹ, ऐसे िᮓयाकलापᲂ की वास्तिवक िविन᳸दर᳥् स्थलीय दशाᲐ पर आधािरत मानीटरी सिमित ᳇ारा संवीक्षा की जाएगी और उसे संब᳍ िविनयामक ᮧािधकरणᲂ को िन᳸दर᳥् िकया जाएगा ।
(4) मानीटरी सिमित का सदस्य-सिचव या संब᳍ कलक्टर या संरिक्षत पाकर् का उपवन्यजीव संरक्षक, ऐसे ᳞िᲦ के िवरू᳍, जो इस अिधसूचना के िकसी उपबंध का उल्लंघन करता है, पयार्वरण (संरक्षण) अिधिनयम, 1986 की धारा 19 के अधीन पिरवाद फाइल करने के िलए सक्षम होगा । (5) मानीटरी सिमित मु᳎ा दर मु᳎ा के आधार पर अपेक्षाᲐ पर िनभर्र रहते हुए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या िवशेषज्ञᲂ, औ᳒ोिगक संगमᲂ या संब᳍ पणधािरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशर् मᱶ सहायता के िलए आमंिᮢत कर सकेगी । (6) मानीटरी सिमित ᮧत्येक वषर् की 31 माचर् तक की अपनी वािषर्क कारर्वाई िरपोटर् राज्य के मुख्य जीव वाडर्न उपबंध IV मᱶ उपबंिधत रूप िवधान के अनुसार उक् त वषर् के 30 जून तक ᮧस्तुत करेगी । (7) केन्ᮤीय सरकार का पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय मानीटरी सिमित को अपने कृत्यᲂ के ᮧभावी िनवर्हन के िलए समय-समय पर ऐसे िनदेश दे सकेगा, जो वह ठीक समझे । 7.
इस अिधसूचना के उपबंधᲂ को ᮧभाव देने के िलए कᱶᮤीय सरकार और राज् य सरकार अितिरक् त उपाय, यिद कोई हᲂ, िविन᳸दर्ष् ट कर सकᱶगे ।
8. भारत के माननीय उᲬतम न्यायालय या माननीय उᲬ न्यायालय या माननीय राष् ᮝीय हिरत ᮧािधकरण ᳇ारा पािरत कोई आदेश या पािरत होने वाले िकसी आदेश, यिद कोई हᲂ, के अधीन, इस अिधसूचना के उपबंध

के साथ दिक्ष णी िदशा की ओर जाती है और स् टेशन सं. 7 मᱶ िमलती है । इसके बाद रेखा कल् लूर आरिक्ष त वन की पिश् च मी सीमा के साथ दिक्ष णी िदशा की ओर जाती है और स् टेशन सं. 8 मᱶ िमलती है । इसके बाद रेखा दिक्ष ण पिश् च म िदशा को पार करके जाती है । कल् लूर आरिक्ष त वन और ब् लैकटॅाप सड़क मᱶ िमलती है जो स् टेशन सं. 9 है। वहॉ से रेखा दिक्ष णी िदशा की ओर जाती है और स् टेशन सं. 10 को छूती है।

दिक्ष ण – वहॉ से रेखा पिश् च मी िदशा मᱶ 94.3 िकलोमीटर मᱶ रेलवे लाइन को पार करके जाती है और स् टेशन सं. 11 मᱶ िमलती है। इसके बाद रेखा पिश् च मी िदशा की ओर जाती है और एन.एच. 5 के िनकट स् टेशन सं. 12 मᱶ िमलती है। इसके बाद रेखा उत् तर पिश् च म िदशा मᱶ 91.7 िकलोमीटर एन.एच. 5 को पार करके जाती है और कूप् पारेडी पालेम ᮕाम की िसंचाई टᱹक मᱶ िमलती है जो स् टेशन सं. 13 है।

पिश् च म - वहॉ से रेखा उत् तर पिश् च म िदशा की ओर जाती है और स् टेशन सं. 14 मᱶ िमलती है। वहॉ से रेखा उत् तर पिश् च म िदशा की ओर जाती है और इकोल् लू आरिक्ष त वन मᱶ स् टेशन सं. 15 मᱶ िमलती है। इसके बाद रेखा उत् तर िदशा की ओर जाती है और रोसानूर संरिक्ष त वन मᱶ स् टेशन सं. 16 मᱶ िमलती है। वहॉ से रेखा उत् तर पूवर् िदशा की ओर जाती है और पत् थर की रेलवे लाइन 101 िकलोमीटर को पार करके और स् टेशन सं. 1 मᱶ िमलती है, जो आरंिभ क स् टेशन है।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, 8th June, 2017 S.O. 1868(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 250(E), dated the 15th January 2016, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; And whereas, no objections and suggestions received from persons and stakeholders in response to the draft notification; Whereas, Nelapattu Bird Sanctuary is situated in Nelapattu Villlage of Doravarisatram Mandal in Nellore District in the state of Andhra Pradesh and has an area of about 4.58 square kilo meters and it is situated between Latitude 13°51’ to 13°59’ North and longitude 79° 57’ to 79° 59’ East;
And whereas, the Nelapattu Bird Sanctuary Sanctuary is a heaven for a wide variety of bird species for both breeding and roosting purpose and it is one of the largest Pelicanry in South–East Asia; And whereas, many winter migratory birds visit this sanctuary and it is a breeding ground for some of the rare and endangered species like Grey Pelican (Pelecanus philippensis), Open Bill Stork (Anastomus oscitans), Little Cormorant (Microcarbo niger), Spoon bill (Plataleinae), White ibis (Eudocimus albus), Night heron (Nycticorax nycticorax )etc;
And whereas, it is necessary to conserve to protect the area up to two kilometers from the boundary of the Protected area of Nelapattu Bird Sanctuary as Eco-sensitive Zone from ecological and environmental point of view. Now, therefore, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub – section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area of 29.21 square kilometres with an extent of upto two kilometres from the boundary of the Nelapattu Bird Sanctuary in the State of Andhra Pradesh, as the Eco- sensitive Zone (herein after called as the Eco-sensitive Zone) details of which are as under, namely:-
1.
Extent and Boundary of Eco-sensitive Zone.-(1) The extent of Eco-sensitive Zone varies up to two kilometres from the boundary of the Nelapattu Bird Sanctuary and includes certain villages in Nellore District in the state of Andhra Pradesh.
(2)
The boundary description of the Eco-sensitive Zone is appended as Annexure I and the list of villages are given in Annexure-II. (3)
The map of the Eco-sensitive Zone boundary together with latitudes –longitudes is appended with this notification as Annexure III. 2.
Zonal Master Plan for the Eco-sensitive Zone.-
(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan: (i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture; (iv) Revenue; (v) Urban Development;
(vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;

(xi) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

  1. Landuse.- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities.

Provided that the conversion of agricultural and other lands, for the purpose other than that specified within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under relevant State Acts and other rules and regulations of Central or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities and given under para 4.

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under relevant State Laws and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.- The catchment areas of all natural springs,rivers,channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3)Tourism/ Eco-tourism.-
(a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b)The Eco-tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The activities of Eco-tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be allowed within 1 km. from the boundary of the and nelapattu bird Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer. However, beyond the distance of 1 km. from the boundary of the nelapattu bird Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the Eco-tourism guidelines issued by the National Tiger Conservation Authority with emphasis on eco- tourism; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel or resort or commercial establishment construction is permitted within Eco- sensitive Zone area.

(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.

(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents.- Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and the rules made thereunder or standards stipulated by State Government.

(9) Solid wastes.- Disposal and Management of solid wastes shall be as under.-
(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; and
the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;

(b) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.

(10) Bio-medical waste.- Bio medical waste management shall be as under:- (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number G.S.R. 343(E), dated the 28th March, 2016. (b) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone.

(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016.

(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016.

(13) E-waste.- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change.

(14) Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular Pollution.- Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws and efforts to be made for use of cleaner fuel for example CNG, LPG, etc.

(16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted.

(17) Protection of Hill Slopes.- The protection of hill slopes shall be as under: (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.

(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.

List of activities prohibited or to be regulated within the Eco-sensitive Zone.-
All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), Notification 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:-

Setting of new industries causing pollution (Water, Air, Soil, Noise, etc.). No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted. Industries categorised as Green or White in the Central Pollution Control Board Classification including agro-based small scale industries, will be regulated as per regulations.
3.
Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws. 4.
Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws. 5.
Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws. 6.
Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs. 7.
Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone. 8.
Coastal Aquaculture. No aqua culture either brackish water of fresh water aquaculture is permitted within the Eco-sensitive Zone. 9.
Fishing by trawlers in untraditional manner as a large scale commercial activity. Prohibited (except as otherwise provided) as per applicable laws. B. Regulated Activities 10.
Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco- sensitive Zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. 11.
Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:

 Provided that, local people shall be permitted to undertake construction

in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building byelaws: Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.

Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority. 13.
Setting up of brick kilns. Regulated (except as otherwise provided) as per applicable laws 14.
Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 15.
Collection of Forest produce or Non-Timber Forest Produce (NTFP). Regulated under applicable laws.

Erection of electrical and communication towers and laying of cables and other infrastructures . Regulated under applicable law. Underground cabling may be promoted.

Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines. 18.
Widening and strengthening of existing roads and construction of new roads. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.

Under taking other activities related to tourism like over flying the Eco-sensitive Zone area by
hot air balloon, helicopter, drones, Microlites, etc.
Regulated under applicable law. 20.
Protection of Hill Slopes and river banks. Regulated under applicable laws. 21.
Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
22.
Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted under applicable laws for use of locals. 23.
Discharge of treated effluents in natural water bodies or land area. The discharge of treated effluent shall be regulated as per applicable laws.
24.
Commercial extraction of surface and ground water.
Regulated under applicable law.

Open Well, Bore Well etc. for agriculture or other usage. Regulated and the activity should be strictly monitored by the appropriate authority. 26.
Solid Waste Management. Regulated under applicable laws. 27.
Introduction of Exotic species. Regulated under applicable laws.

Eco-tourism. Regulated under applicable laws. 29.
Use of polythene bags. Regulated under applicable laws. 30.
Commercial Sign boards and hoardings. Regulated under applicable laws. C. Promoted Activities 31.

  1. Monitoring Committee.—(1) In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of, namely:- (i)
    District Collector, Nellore

Chairman (ii)
One representative of Non Governmental Organisation working in the field of environment to be nominated by the Government of Andhra Pradesh for three years -Member (iii)
one expert in the area of ecology and environment to be nominated by the Government of Andhra Pradesh for three years

– Member (iv) Member-Secretary/Member of the State Bio-diversity Board - Member
(v)
Regional Officer,
State Pollution Control Board –
Member. (vi)
Representative of Revenue Divisional Officer, Gudur – Member. (vii)
Divisional Forest Officer, Wildlife Management Division, Sullurpet- Member. (viii)
Deputy Conservator of Forests (Territorial), Nellore - Member Secretary.

(2) Terms of Reference: (a) The Monitoring Committee shall monitor the compliance of the provisions of Gazette Notification.
(b) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (c) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (d) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (e)
The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (f) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per proforma given in Annexure IV. (g) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of the notification.

The provisions of this Notification are subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or the National Green Tribunal (NGT).

Boundary description of Eco-sensitive Zone of Nelapattu Bird Sanctuary

North: - Eco- sensitive Zone boundary around 2 Km. of Nelapattu Bird Sanctuary boundary starts at 101 Km. stone of Railway line which is station 1 and proceeds towards North east direction and touches at station No. 2. Thence the line runs towards easterly direction and crosses the Northern point of Nelaballi RF and joins at station No. 3. Thence the line runs towards easterly direction and joins at station No. 4. Thence the line runs towards easterly direction and joins at western boundary of Pudur RF which is station No. 5.

East: - Thence the line proceeds towards South East direction and crosses the Pudur RF and joins at Western boundary of Kallur RF which is Station No. 6. Then the line proceeds towards southern direction with in the Western boundary of Kalluru RF and joins at Station No. 7. Then the line runs towards southern direction along the Western boundary of Kalluru RF and joins at station No. 8. Then the line runs towards South west direction crosses. The Kalluru RF and joins at Blacktop Road which is station No. 9. From there the line proceeds towards southern direction and touches at station No.10

South: Thence Line precedes towards Western direction crosses the Railway line at 94.3 Km. and joins at station No. 11.Then the line proceeds towards western direction and joins at station No. 12 near NH5. Then the line runs towards North West direction crosses the NH 5 at 91.7 Km. and joins at Irrigation tank of Kuppareddy palem Village which is Station No.13.

West:- Thence the line proceeds towards North west direction and joins at station No. 14. From there the line proceeds towards North West direction and joins at station No. 15 in Ekollu RF. Then the line proceeds towards northerly direction and joins at station No. 16 in the Rosanur protected Forest. From there, the line proceeds towards North East direction and crosses the Railway line at 101 Km. stone and joins at station 1, which is closed station.
