पयावरण, वन और जलवायु परवतन मंालय अधसूचना नई दल, 7 जनवर, 2016 का.आ. 62(अ).— ननलखत ाप अ धसूचना, िजसे के%&य सरकार, पया(वरण (संर,ण) अ धनयम, 1986 (1986 का 29) क1 धारा 3 क1 उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) के साथ पठत उपधारा (1) 8वारा द9त शि;तय< का योग करते हुए, जार करने का Bताव करती है, पया(वरण (संर,ण) नयम, 1986 के नयम 5 के उपनयम (3) क1 अपे,ानुसार, जनसाधारण क1 जानकार के लए काशत क1 जाती है; िजनके उससे भाHवत होने क1 संभावना है, और यह सूचना द जाती है Iक उ;त ाप अ धसूचना पर, उस तारख से, िजसको इस अ धसूचना वाले भारत के राजपK क1 तयां जनसाधारण को उपलLध करा द जाती हM, साठ दन क1 अव ध क1 समािNत पर या उसके पOचात् Hवचार Iकया जाएगा;

ऐसा कोई Rयि;त, जो ाप अ धसूचना मS अंतHव(Tट Bताव< के संबंध मS कोई आ,ेप या सुझाव देने मS हतबY है, इस कार Hवनद(Tट अव ध के भीतर, के%&य सरकार 8वारा Hवचार Iकए जाने के लए, आ,ेप या सुझाव स चव, पया(वरण, वन और जलवायु पZरवत(न मंKालय, इंदरा पया(वरण भवन, जोर बाग रोड, अलगंज, नई दल- 110003 या ई-मेल पते: esz-mef@nic.in पर लखत प मS भेज सकेगा ।

और, ,ेK मS ाणी-जात क1 बहुत HवHवधता है िजसमS तSदुआ, भालू, जंगल भालू, सांभर, बाIकm ड gडयर, माउस gडयर, चतकबरा हरण, सयार और जंगल कु9 ता शामल हM ।
और, इस ,ेK का पZरर,ण और संर,ण करना है तथा िजसक1 सीमाओं को इस अ धसूचना के पैरा 1 मS कांबलक<डा व%यजीव अभयार^य के चार< और पाZरिBथतक संवेद जोन के प मS Hवनद(Tट Iकया गया है और पाZरिBथतक और पया(वरण क1 nिTट से पाZरिBथतक संवेद जोन के प मS कांबलक<डा व%यजीव अभयार^य , Hवशाखापटनम के संरj,त ,ेK क1 सीमाओं के चार< ओर के ,ेK को Hवनद(Tट Iकया गया है और उ8योग या उ8योग< के वगo को तथा उनक1 संIpयाओं और Ipयाओं को उ;त पाZरिBथतक1य संवेद जोन मS तHषY करना आवOयक है ; अतः, अब, के%&य सरकार, पया(वरण (संर,ण) नयम, 1986 के नयम 5 के उपनयम (3) और पया(वरण (संर,ण) अ धनयम, 1986 (1986 का 29) क1 धारा 3 क1 उपधारा (2) के खंड (v) और खंड (xiv) के साथ पठत उपधारा (1) 8वारा द9त शि;तय< का योग करते हुए, आं_ देश राय मS कांबलक<डा व%यजीव अभयार^य पाZरिBथतक1य संवेद जोन (िजसे इसमS इसके पOचात् पाZरिBथतक1य संवेद जोन कहा गया है) कांबलक<डा अभयार^य क1 सीमा से 4.33 Iकलोमीटर तक के HवBतार सीमा ,ेK को अ धसू चत करती है, िजसका Hववरण ननानुसार है, अथा(त् :- 1. पारि%थ'तक संवेद* जोन का ,व%तार और उसक. सीमाएं--(1) आ%_ देश राय के िजला Hवशाखापटनम मS पाZरिBथतक संवेद जोन 30.51 वग( Iकलोमीटर ,ेK तक फैला हुआ है और िजसमS 2 मंडल यान आन%दापुरम और छनांग धल िजला Hवशाखापटनम के 14 tाम सिमलत हM ।
(2) पाZरिBथतक संवेद जोन का HवBतार 4.33 Iकलोमीटर क1 सीमा तक कांबलक<डा व%यजीव अभयार^य तक फैला हुआ है । (3) पाZरिBथतक संवेद जोन क1 सीमा का वण(न उपाबंध I के प मS उपाबY है और tाम< क1 सूची उपाबंध II मS वण(त है ।
(4) पाZरिBथतक संवेद जोन सीमा के साथ अ,ांश-देशांतर का मान चK उपाबंध III के प मS उपाबY है । 2. पारि%थ'तक संवेद* जोन के 3लए आंच3लक महायोजना – (1) राय सरकार, पाZरिB थतक संवेद जोन के योजन के लए राजपK मS अ धसूचना के अंतम काशन क1 तारख से दो वष( क1 अव ध के भीतर, Bथानीय Rयि;तय< के परामश( से, इस अ धसूचना मS संलv न अनुबंध< के सामंजB य से आंचलक महायोजना तैयार करेगी । (2) उ;त योजना राय सरकार मS स,म ा धकार 8वारा अनुमोदत होगी ।
(3) पाZरिB थतक संवेद जोन के लए आचंलक महायोजना इस अ धसूचना मS Hवनद(T ट प मS ऐसी रत मS रा य सरकार तथा सुसंगत कS &य और रा य Hव धय< के सामंजB य मS भी तथा कS &य सरकार 8वारा जार माग(नदwश, यद कोई ह<, 8वारा तैयार होगी । (4) आंचलक महायोजना सभी संबY रा` य सरकार के Hवभाग< के परामश( से तैयार होगी, अथा(त्:-- (i) पया(वरण ; (ii) वन ;
(iii) नगर Hवकास ; (iv) पय(टन ; (v) नगरपालक ; (vi) राजB व ;
(vii) कृHष ;

¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 (viii) रा य दूषण नयंKण बोड( ; (ix) संचाई ; और (x) लोक नमा(ण Hवभाग, इसमS पया(वरणीय और पाZरिB थतक1 Hवचार< को समाकलत करने के लए ह<गे। (5) महायोजना अनुमोदत Hव8यमान भू-उपयोग, अवसंरचना9 मक और Ipयाकलाप< पर कोई नबmधन अ धरोHपत नहं करेगी जब तक Iक इस अ धसूचना मS Hवनद(Tट न ह< और आचंलक महायोजना मS सभी अवसंरचना Ipयाकलाप< मS द,ता और पाZरिBथतक1य अनुकूलता का संवध(न करेगी । (6) आंचलक महायोजना मS अनाyछादत ,ेK< के जीणzYार, Hव8यमान जल नकाय< के संर,ण, आवाह ,ेK< के बंधन, जल-संभर< के बंधन, भूतल जल के बंधन, मृदा और नमी संर,ण, Bथानीय समुदाय< क1 आवOयकताओं तथा पाZरिBथतक1 और पया(वरण से संबं धत ऐसे अ%य पहलूओं, िजन पर {यान देना आवOयक है, के लए उपबंध ह<गे । (7) आंचलक महायोजना सभी Hव8यमान एवं BताHवत पूजा B थल<, tाम< और नगरय बंदोबBत<, वन< के कार और IकB म<, कृHष ,ेK<, ऊपजाऊ भूम, हZरत ,ेK जैसे उ8यान और उसी कार के B थान, उ8यान कृHष ,ेK, आIक( ड<, झील< और अ%य जल नकाय< का अ}यकंन करेगी । (8) आंचलक महायोजना पाZरिB थतक संवेद जोन मS Hवकास को पाZरिB थतक अनुकूल Hवकास और B थानीय समुदाय< क1 जीवकोपाज(न को सुनिO चत करते हुए Hवनयमत होगी । 3. रा6य सरकार 7वारा 8कए जाने वाले उपाय-- राय सरकार इस अ धसूचना के उपबंध< को भावी करने के लए ननलखत उपाय करेगी, अथा(त् :-- (1) भू-उपयोग - पाZरिB थतक संवेद जोन मS वन<, उ8यान-कृHष ,ेK<, कृHष ,ेK<, आमोद-मोद के योजन के लए

चि%हत Iकए गए पाकo और खुले Bथान< का वाणियक और औ8यो गक संबY Hवकास Ipयाकलाप< के लए उपयोग या संपZरवत(न नहं होगा : परंतु पाZरिBथतक संवेद जोन के भीतर कृHष भूम का संपZरवत(न मानीटर समत क1 सफाZरश पर और राय सरकार के पूव( अनुमोदन से, Bथानीय नवासय< क1 आवासीय जरत< को पूरा करने के लए और पैरा 4 क1 सारणी के Bतंभ (2) के अधीन pम सं0 10, 16, 22, 28 और 31 के सामने सूचीबY Ipयाकलाप< को पूरा करने के लए अनु~ात ह<गे, अथा(त् :-
(i) पाZरिBथतक अनुकूल पय(टन Ipयाकलाप< से संबं धत पय(टक< के अBथायी अ धभोग के लए लए पाZरिBथतक अनुकूल कुटर जैसे टMट, लकड़ी के मकान आद ।
(ii) Hव8यमान सड़क< को चौड़ा करना और उ%हS सुnढ करना, (iii) दूषण उ9प%न न करने वाले लघु उ8योग, (iv) वषा( जल संचय, और
(v) कुटर उ8योग< मS tाम उ8योग, भंडारण क1 सुHवधा और Bथानीय सुख-सुHवधाएं सिमलत हM : परंतु यह और भी Iक राय सरकार के पूव( अनुमोदन तथा संHवधान के अनुyछेद 244 और त9समय वृ9त Hव ध के उपबंध< के अनुपालन के aबना, िजसके अंतग(त अनुसू चत जनजात और अ%य परंपरागत वन नवासी (वन अ धकार< क1 मा%यता) अ धनयम, 2006 (2007 का 2) भी है, वाणियक या उ8योग Hवकास Ipयाकलाप< के लए जनजातीय भूम का उपयोग अनु~ात नहं होगा :
परंतु यह और भी Iक पाZरिB थतक संवेद जोन के भीतर भू-अभलेख< मS उपसंजात कोई Kुट मानीटर समत के Hवचार ाNत करने के पOचात् रा`य सरकार 8वारा 9येक मामले मS संशो धत होगी और उ;त Kुट के संशोधन क1 के%&य सरकार के पया(वरण, वन और जलवायु पZरवत(न मंKालय को सूचना देनी होगी ।

परंतु यह और भी Iक उपयु(;त Kुट का संशोधन मS इस उप पैरा के अधीन यथा उपबं धत के सवाय Iकसी भी दशा मS भू-उपयोग का पZरवत(न सिमलत नहं होगा : परंतु यह और भी Iक िजससे हZरत ,ेK मS जैसे वन ,ेK, कृHष ,ेK मS कोई पाZरणामक कटौती नहं होगी और अनयु; त या अनु9 पादक कृHष ,ेK< मS पुन: वनीकरण करने के यास Iकए जाएंगे ।
(2) "ाकृ'तक जल =ोत -- आचंलक महायोजना मS सभी ाकृतक जल ‚ोत< क1 पहचान क1 जाएगी और उनके संर,ण और पुनन(वीकरण के लए योजना को सि मलत Iकया जाएगा और रा य सरकार 8वारा ऐसी रत से माग(दश(क सYांत बनाए जाएंगे िजससे Iक उन ,ेK< मS या इसके समीप Hवकास Ipयाकलाप को रोका जा सके जो ऐसे ,ेK के लए हानकारक हM । (3) पयटन – (क) पाZरिBथतक संवेद जोन के भीतर पय(टन संबंधी Ipयाकलाप, जो पय(टन महायोजना के अनुसार ह<गे, आंचलक महायोजना का भाग प मS ह<गे । (ख) पय(टन महायोजना पय(टन Hवभाग, 8वारा आ%_ देश राय सरकार के वन और पया(वरण Hवभाग के परामश( से तैयार होगी ।
(ग) पय(टन संबंधी Ipयाकलाप न नलखत के अधीन Hवनयमत ह<गे, अथा(त् :- (i) पाZरिBथतक संवेद जोन के भीतर सभी नए पय(टन Ipयाकलाप< या Hव8यमान पय(टन Ipयाकलाप< का HवBतार के%&य सरकार के पया(वरण, वन और जलवायु पZरवत(न मंKालय के माग(दश(क सYांत< के 8वारा तथा राT ƒय R या„ संर,ण ा धकरण के पाZरिBथतक पय(टन माग(दश(क 8वारा जार (समय-समय पर यथा संशो धत) सYांत< के अनुसार, पाZरिBथतक पय(टन, पाZरिBथतक श,ा और पाZरिBथतक Hवकास को मह9व देते हुए पाZरिBथतक संवेद जोन क1 वहन ,मता के अ{ययन पर आधाZरत होगा;
(ii) पाZरिBथतक1य अनुकूल पय(टक Ipयाकलाप< के संबंध मS अB थायी अ धभोग के लए वास सुHवधा के सवाय कांबलक<डा व%यजीव अभयार^य क1 सीमा से एक Iकलोमीटर भीतर होटल और Zरसोटo का नया संनमा(ण अनु~ात नहं होगा; परंतु संरj,त ,ेK< क1 सीमा से एक Iकलोमीटर क1 दूर से परे पाZरिBथतक1य संवेद जोन क1 सीमा तक नए होटल और Zरसोट( क1 Bथापना पय(टन महायोजना के अनुसार पाZरिBथतक1य पय(टन सुHवधा के लए पूव( पZरभाHषत और Hवनद(Tट Bथान मS ह अनु~ात Iकया जाएगा । (iii) आंचलक महायोजना का अनुमोदन Iकए जाने तक, पय(टन के लए Hवकास और Hव8यमान पय(टन Ipयाकलाप< के HवBतार को वाBतHवक Bथल Hवनद(Tट संवी,ा तथा मानीटर समत क1 सफाZरश पर आधाZरत संबं धत Hवनयामक ा धकाZरय< 8वारा अनु~ात Iकया जाएगा । (4) नैसगक ,वरासत -- पाZरिBथतक संवेद जोन मS मह9वपूण( नैस ग(क Hवरासत के सभी Bथल< जैसे सभी जीन कोश आरj,त ,ेK, शैल Hवरचनाएं, जल पात<, झरन<, घाट मागo, उपवन<, गुफाएं, Bथल<, मण, अOवरोहण, पातो आद क1 पहचान क1 जाएगी और उ%हS संरj,त Iकया जाएगा तथा उनक1 सुर,ा और संर,ा के लए इस अ धसूचना के काशन क1 तारख से छह मास के भीतर, उपयु;त योजना बनाएगी और ऐसी योजना आंचलक महायोजना का भाग होगा । (5) मानव 'न3मत ,वरासत % थल@ - पाZरिB थतक संवेद जोन मS भवन<, संरचनाओं, शप-त†य, ऐतहासक, कला9मक और सांBकृतक मह9व के ,ेK< क1 पहचान करनी होगी और इस अ धसूचना के काशन क1 तारख से छह माह के भीतर उनके संर,ण क1 योजनाएं तैयार करनी ह<गी तथा आंचलक महायोजना मS सिमलत क1 जाएगी ।

5 (6) A व'न "दूषण -- पाZरिBथतक संवेद जोन मS { वन दूषण के नयंKण के लए रा य सरकार का पया(वरण Hवभाग या राय दूषण नयंKण बोड(, वायु (दूषण नवारण और नयंKण) अ धनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए नयम< के उपबंध< के अनुसरण मS माग(दश(क सYांत और Hवनयम तैयार करेगा ।
(7) वायु "दूषण -- पाZरिBथतक संवेद जोन मS वायु दूषण के नयंKण के लए रा य सरकार का पया(वरण Hवभाग या राय दूषण नयंKण बोड(, वायु (दूषण नवारण और नयंKण) अ धनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए नयम< के उपबंध< के अनुसरण मS माग(दश(क सYांत और Hवनयम तैयार करेगा ।
(8) बCह=ाव का 'न%सारण -- पाZरिBथतक संवेद जोन मS उपचाZरत बह‚ाव का नBसारण जल (दूषण नवारण तथा नयंKण) अ धनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए नयम< के उपबंध< के अनुसार होगा । (9) ठोस अप3शFट -- ठोस अपशTट< का नपटान ननलखत प मS होगा –
(i) पाZरिBथतक संवेद जोन मS ठोस अपशTट< का नपटान भारत सरकार के त9कालन पया(वरण और वन मंKालय क1 समय-समय पर यथा संशो धत अ धसूचना सं. का.आ. 908(अ), तारख 25 सतंबर, 2000 नगरपालक ठोस अपशTट (बंध और हथालन) नयम, 2000 के उपबंध< के अनुसार Iकया जाएगा ; (ii) Bथानीय ा धकरण जैव ननीकरणीय और अजैव ननीकरणीय संघटक< मS ठोस अपशTट< के संपृथ;कन के लए योजनाएं तैयार करSगे ;
(iii) जैव ननीकरणीय सामtी को अ धमानतः खाद बनाकर या कृम खेती के मा{यम से पुनःचIpत Iकया जाएगा ;
(iv) अकाब(नक सामtी का नपटान पाZरिBथतक संवेद जोन के बाहर पहचान Iकए गए B थल पर Iकसी पया(वरणीय Bवीकृत रत मS होगा और पाZरिBथतक संवेद जोन मS ठोस अपशT ट< को जलाना या भT मीकरण अनु~ात नहं होगा ।
(10) जैव च8कG सीय अप3शF ट- पाZरिBथतक संवेद जोन मS जैव चIक9सीय अपशTट< का नपटान भारत सरकार के त9कालन पया(वरण और वन मंKालय क1 समय-समय पर यथासंशो धत अ धसूचना सं. का.आ. 630(अ), तारख
20 जुलाई, 1998 8वारा काशत जैव चIक9सीय अपशTट (बंध और हथालन) नयम, 1998 के उपबंध< के अनुसार Iकया जाएगा । (11) यानीय परवहन - पZरवहन क1 यानीय गतHव धयां आवास के अनुकूल Hवनयमत ह<गी और इस संबंध मS आंचलक महायोजना मS Hवशेष उपबंध सिमलत Iकए जाएंगे और आंचलक महायोजना के तैयार होने और रा`य सरकार के स,म ा धकार 8वारा अनुमोदत होने तक, मानीटर समत सुसंगत अ धनयम< और वृ9त नयम< और इसके अ{यधीन बनाए गए Hवनयम< के अधीन यानीय गतHव धय< के अनुपालन को मानीटर करेगी ।
(12) औ7योगक इकाइयां –
(क) BताHवत पाZरिBथतक संवेद जोन के भीतर नए काTठ आधाZरत उ8योग< क1 Bथापना Hव ध के अनुसार BथाHपत Hव8यमान काTठ आधाZरत उ8योग के सवाय अनु~ात नहं Iकए जाएंगे ।

(ख) BताHवत पाZरिBथतक संवेद जोन के भीतर जल, वायु, मृदा, {वन दूषण के कोई नए उ8योग क1 Bथापना अनु~ात नहं होगी ।

थ‰मूलपाद बनाम भारत सरकार के मामले मS आदेश तारख 4 अगBत 2006 और Zरट या चका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मS तारख 21.अैल 2014 के अंतZरम आदेश के अनुसरण मS सव(दा चालन होगा ।

(ङ) Hवशाखापटनम शहर Hवकास ा धकरण ,ेK के Hवकास योजना मS आंचलक महायोजना को समाकलत करेगा । (12) वृ,< क1 कटाई । (क) राय सरकार मS स,म ा धकार क1 पूव( अनुमत के aबना वन, सरकार या राजBव या नजी भूम पर या वन< मS Iक%ह वृ,< क1 कटाई नहं होगी; (ख) वृ,< क1 कटाई संबं धत के%&य या राय अ धनयम या उसके अधीन बनाए गए नयम< के उपबंध के अनुसार Hवनयमत होगी;

sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Aliganj, New Delhi-110 003, or send it to the e-mail address of the Ministry at esz-mef@nic.in Draft Notification WHEREAS, the Kambalakonda Wildlife Sanctuary is situated in the heart of Visakhapatnam Mega City in Andhra Pradesh and is spread over an area of 7139 hectares between 83.04’ to 83.20’ Longitudes and 17.34’ to 17.47’ Latitudes; AND WHEREAS, the Sanctuary maintains very rich bio-diversity comprising 73 tree species, 39 species of herbs and shrubs, and 18 species of climbers, 2 species of Bamboos and 7 species of grasses, 23 mammal species,
7 species of reptiles and more than 90 species of birds have been documented from the Sanctuary; AND WHEREAS, the Sanctuary harbours large variety of flora and is characterised by a scrub jungle the major tree species of the area are Ficus banghlensis, Acacia lucophloea, Acacia chundra, Sapindus emarginatas, and Wrightia tinctoria etc; AND WHEREAS, the area harbours a rich faunistic diversity which includes, Panther, Bear, Wild Boar, Sambhar, Barking Deer, Mouse Deer, Spotted Deer, Jackal, and Wild Dog; AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the boundary of the protected area of Kambalakonda Wildlife Sanctuary, Visakhapatnam as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries or/and their operations and processes in the said Eco-sensitive Zone ; NOW THEREFORE, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub – section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of up to 4.33 kilometers from the boundary of the Kambalakonda Wildlife Sanctuary in the State of Andhra Pradesh, as the Kambalakonda Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:—
1.
Extent and Boundary of Eco-sensitive Zone.—(1) The Eco-sensitive Zone is spread over an area of 30.51 square kilometers in Visakhapatnam District of Andhra Pradesh and includes 14 villages of 2 Mandals viz. Anandapuram and Chinagadhili in Visakhapatnam District.
(2)
The extent of Eco-sensitive Zone varies up to 4.33 kilometer from the boundary of Kambalakonda Wildlife Sanctuary. (3)
The boundary description of the Eco-sensitive Zone is appended as Annexure I and the list of villages are given in Annexure-II. (4)
The map of Eco-sensitive Zone boundary together with latitudes –longitudes is appended as Annexure III; 2.
Zonal Master Plan for the Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the
Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final

notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2)
The said Plan shall be approved by the competent authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i)
Environment,
(ii) Forest,
(iii) Urban Development,
(iv) Tourism,
(v) Municipal,
(vi) Revenue, (vii) Agriculture (viii) State Pollution Control Board, (ix) Irrigation, and (x) Public Works Department, for integrating environmental and ecological considerations into it.
(5)
The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, need of local community and such other aspects of the ecology and environment that need attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure eco-friendly development for livelihood security of local communities. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 10, 16, 22, 28 and 31 in column (2) of the Table in paragraph 4, namely:- (i)
Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities, (ii)
Widening and strengthening of existing roads. (iii)
Small scale industries not causing pollution,
(iv)
Rainwater harvesting, and
(v)
Cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

15 Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural springs.—The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas in such a manner as which are detrimental to such areas which are detrimental to such areas. (3) Tourism.—(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment, Government of Andhra Pradesh.
(c) The activity of tourism shall be regulated as under, namely:—
(i)
all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco- sensitive Zone; (ii)
new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Kambalakonda Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to eco- friendly tourism activities:

Provided that beyond the distance of one kilometer from the boundary of the protected areas till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for eco-tourism facilities as per the Tourism Master Plan;
(iii)
till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4)
Natural heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6)
Noise pollution.- The Environment Department of the State Government or State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder. (7)
Air pollution.- The Environment Department of the State Government or State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder. (9)
Solid wastes. - Disposal of solid wastes shall be as under:—
(i)
the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forest vide notification number S.O. 908 (E), dated the 25th September 2000 as amended from time to time; (ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non- biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture;

(iv) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the
Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone (10) Bio-medical waste.—The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forest vide notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time. (11)
Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12)
Industrial units.—(a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the law. (b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone shall be permitted. 4.
List of activities prohibited or to be regulated within the Eco-sensitive Zone.—All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and be regulated in the manner specified in the table below, namely:— TABLE S.No. Activity Remarks (1) (2) (3) Prohibited activities 1. (a) New and existing mining (minor and major minerals), stone quarrying, crushing units, oil drilling and dredging shall be prohibited within 1 kilometer from the boundary of the protected area: Provided that mining, oil drilling and dredging may be permitted beyond 1 kilometer upto the extent of Eco- sensitive Zone in a regulated manner. (b) The mining operations shall strictly be in accordance with the interim order of the Hon’ble Supreme Court dated 4th August, 2006 in the matter of T.N. Godavarman Thirumalpad Vs. Union of India in Writ Petition (Civil) No.202 of 1995 and order of the Hon’ble Supreme Court dated 21st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.435 of 2012. 2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Setting up of industries causing water or air or soil or noise pollution. No new or expansion of polluting industries in the Eco- sensitive Zone shall be permitted.
4. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws. 5. Establishment of new major hydroelectric projects and irrigation projects. Prohibited (except as otherwise provided) as per applicable laws. 6. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws. 7. Discharge of untreated effluents and solid waste in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws. 8. Undertaking activities related to tourism like over-flying the national park area by aircraft, Prohibited (except as otherwise provided) as per applicable

17 hot-air balloons. laws.

9 New wood based industry.
Establishment of new wood based industry shall not be permitted within the limits of Eco-sensitive Zone: Provided the existing wood-based industry may continue as per applicable laws. Regulated activities 10. Establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the protected area except for accommodation for temporary occupation of tourists related to eco-friendly tourism activities.
Provided that beyond one kilometre and upto the extent of the Eco-sensitive Zone all new tourism activities or expansion of existing activities would in conformity with Tourism master Plan and national Tiger Conservation authority.
11 Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometer from the boundary of the protected area: Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub - paragraph (1) of paragraph 3.
(b) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any: Provided further that existing multistoried and non-multistoried buildings, as on date of notification, under construction may be allowed as per applicable rules and regulations .
(c) Beyond one kilometer from the boundary of the protected area upto the extent of Eco sensitive Zone, construction for bona fide local needs shall be permitted and other commercial construction activities shall be regulated as per Zonal Master Plan. (d) construction activity in the Eco-sensitive Zone shall be as per Zonal Master Plan (e) The Visakhapatnam Urban Development Authority shall integrate the Zonal master Plan into the development plan of the area.
12. Felling of trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. (c) In case of Reserve Forests and protected forests, the working plan prescriptions shall be followed. 13. Commercial water resources including ground water harvesting. (a) The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land. (b) Extraction of surface water and ground water for

Monitoring Committee:- The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:— (a)
District Collector, Visakhapatnam

—Chairman industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned regulatory authority. (c) No sale of surface water or ground water shall be permitted.
(d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture. 14. Erection of electrical cables and telecommunication towers. (a) Promote underground cabling. 15. Fencing of existing premises of hotels and lodges. Regulated under applicable laws. 16. Widening and strengthening of existing roads. Widening and strengthening of existing roads shall be done as per plans of Visakhapatnam Urban Development Authority, with proper Environment Impact Assessment and mitigation measures, as applicable. 17. Movement of vehicular traffic at night. Regulated for commercial purpose, under applicable laws. 18. Introduction of exotic species.
19. Protection of hill slopes and river banks. 20. Discharge of treated effluents in natural water bodies or land area. Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed.
21. Commercial Sign boards and hoardings. 22. Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro- based industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted. 23. Collection of Forest produce or Non- Timber Forest Produce (NTFP). 24 Air and vehicular pollution
25 Use of polythene bags

—Member-Secretary. 6. Terms of Reference:-
(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (4) The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (5)
The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure IV. (7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7.
The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8.

Boundary description of Eco-Sensitive Zone:
A to B:
Starting from a point with co-ordinates N 17.879530 E 83.316650 E on the North- East of Mindivanipalem Village. A line runs along the SH-38 and passes behind hillocks adjacent to Gambhiram Reservoir and touches the station ‘B’ with co ordinates N 17.87368 E 83.36599. The total distance from A to B station is 6.985 Kms. The Range of radius of the Eco-Sensitive zone is 200-780

mtrs on along the length. The proposed Eco-sensitive zone distance is 200 mtrs surrounding the protected area excluding the present existing State and National highways road.
B to C:
The line runs along the NH-5 passing through Paradesipalem Village and along Sanctuary boundary upto station no ‘C’ with co-ordinates N 17.857000 E 83.366420. The total distance from B to C station is 1.854 Kms. The Range of radius of the Eco-Sensitive zone is 140-308 mtrs on along the length. The proposed Eco-sensitive zone distance is 100 mtrs surrounding the protected area.
C to D:
The line runs South westerly direction behind Boravaniapalem Village and runs around the Devimetta and reaches at station ‘D’ with co-ordinates N17.833200 E 83.327710 near Sri Chaitanya Engineering College behind Kommadi Village. The total distance from C to D station is 5.469 Kms. The Range of radius of the Eco-Sensitive zone is 100-690 mtrs on along the length. The proposed Eco-sensitive zone distance is 100 mtrs surrounding the protected area.
D to E:
The line runs South Easterly direction runs through patta lands and vacant lands of Kommadi, Revallapalem Villages which includes Police Training Centre and Baba Institute of Technology and Sciences and passes through Housing Board Colony and Private layouts with co-ordinates N 17.792580 E 83.355850. The total distance from D to E station is 5.121 Kms. The Range of radius of the Eco- Sensitive zone is 100-286 mtrs on along the length. The proposed distance is 100 mtrs surrounding the protected area.
E to F:
The line runs north along NH-5 Southerly and runs along the boundary of Seethakonda Reserve Forest which includes Indira Gandhi Zoological Park, Visakhapatnam and passes through outskirts of Endada Village at station ‘F’ with co-ordinates N 17.753520 E 83.352580. The total distance from E to F station is 6.335 Kms. The Range of radius of the Eco-Sensitive zone is 100-1360 mtrs on along the length. The proposed distance is 100 mtrs surrounding the protected area excluding the area of Reserve Forest.
F to G:
The line runs Westerly direction all along the Southern boundary of Seethakonda RF Ravindranagar, Aarilova Colonies and reaches at station ‘G’ at Mudasarlova Reservoir with co-ordinates N 17.766220 E 83.301010. The total distance from F to G station is 6.692 Kms. The Range of radius of the Eco- Sensitive zone is 127-1280 mtrs on along the length. The proposed distance is 300 mtrs surrounding the protected area.
G to H:
The line runs Westerly direction behind Pineapple colony and Darapalem and touches Pata Adavivaram Junction covering BRTS roads and touches station H with co-ordinates N 17.778810 E 83.255460. The total distance from G to H station is 3.375 Kms. The Range of radius of the Eco- Sensitive zone is 240-418 mtrs on along the length. The proposed distance is 300 mtrs surrounding the protected area.
H to I:
The line runs Northerly direction touching Yerrakonda RF boundary and runs along the Western boundary Kambalakonda Extn RF boundary which includes Dabbanda, Mannepalem, Gollalapalem, Malapalli, Appikondapalem Villages and touches Station I which is station no.1 of Kambalakonda Extn., RF with co-ordinates N 17.844620 E 83.271270. The total distance from H to I station is 8.513 Kms. The Range of radius of the Eco-Sensitive zone is 178-2386 mtrs on along the length. The mean distance is 200 mtrs surrounding the protected area excluding the area of Reserve Forest.
I to J:
The line runs Easterly direction along the Kambalakonda Extn RF boundary upto Station no.7 leaving Mamidilova Village behind and touches Station J at over head tank of Dibbameedipalem Village with co-ordinates N 17.850740 E 83.300300. The total distance from I to J station is 3.190 Kms. The Range of radius of the Eco-Sensitive zone is 604-2003 mtrs on along the length. The proposed distance is 300 mtrs surrounding the protected area excluding the area of Reserve Forest.
J to A:
The line runs Northerly direction almost all parallel to Kambalakonda Wildlife Sanctuary Boundary along the foothills reaches Station A with co-ordinates N 17.879530 E 83.316650. The total distance from J to A station is 3.80 Kms. The Range of radius of the Eco-Sensitive zone is 216-578 mtrs on along the length.
