पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय अिधसूचना नई िदल्ली, 28 अᮧैल, 2017 का.आ.1366(अ).—भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना संख्यांक का.आ. 62(अ), तारीख 7 जनवरी, 2016, ᮧारुप अिधसूचना, भारत के राजपᮢ, असाधारण, मᱶ ᮧकािशत की गई थी, िजसमᱶ उन सभी ᳞िᲦयᲂ से िजनके उससे ᮧभािवत होने की संभावना थी, उस तारीख से, िजसको उस िजसमᱶ अिधसूचना अन्तिव᳥ है राजपᮢ की ᮧितयां, जनता को उपलब्ध कराई गई थᱭ, साठ िदन की समाि᳙ के पूवर् आक्षेप और सुझाव आमंिᮢत िकए गए थे; और, उᲦ ᮧारुप अिधसूचना के उᱫर मᱶ ᳞िᲦयᲂ और पणधािरयᲂ से कोई आक्षेप और सुक्षाव ᮧा᳙ नही हुए हᱹ; और कांबलकᲂडा वन्यजीव अभयारण्य, आंᮥ ᮧदेश राज्य के िवशाखापटनम मेगा शहर के केन्ᮤ मᱶ अविस्थत है और 83.04´ से 83.20´ देशांतर और 17.34´ से 17.47´ अक्षांश के बीच 71.39 वगर् िकलोमीटर के क्षेᮢ मᱶ फैला हुआ है; और, कांबलकᲂडा वन्यजीव अभयारण्य की जैव-िविवधता समृ᳍ हᱹ िजसमᱶ 73 वृक्ष ᮧजाितयां, जड़ी-बूिटयᲂ तथा झािडयᲂ की 39 ᮧजाितयᲂ और लताᲐ की 18 ᮧजाितयᲂ तथा बांस की 2 ᮧजाितयां और घासᲂ की 7 ᮧजाितयᲂ, 23 स् तनपायी ᮧजाितयᲂ, सरीसृपᲂ की 7 ᮧजाितयᲂ सिहत पिक्षयᲂ की 90 से अिधक ᮧजाितयां समािव᳥ की गई हᱹ ; और, कांबलकᲂडा वन्यजीव अभयारण् य मᱶ अनेक िकस्मᲂ की वनस् पितजात है और झाड़ी वाले जंगल, फाइकस बᱶघालेिन्सस (बनयान)(मारᱮ), अकेिशया ल्यूकोफोिलया (वाइट ᮩेक अकेिशया)(तेल्ला तुम्मा), अकेिशया सुन्ᮤा (कुच्छ ᮝी)(सुन्ᮤा), सैिपन्डस इमिजनेटस (सोअफुट वृक्ष)(कुनकुदु), और राइिटया ᳳटक्टोिरया (पाला इनदीगो)(रेप्पआला), आिद इस क्षेᮢ की ᮧमुख वृक्ष ᮧजाितयां हᱹ ;
और, क्षेᮢ ᮧाणी-जात िविवधता से समृ᳍ है िजसमᱶ तᱶदुआ (पᱶथेरा पाडर्स) (िचरुता पुली), रीछ (मेलयूरूस अरिसनस), बनैला सूअर (सूस स्ᮓोफा)(इलुगु), सांभर(रुसा यूिनकोलर) (कािनथी), काकड़ िहरण (मुनतअकस मुनतंजक)(मोिरग डूिप्प), िपसूरी (तरागुसलुस मेिम᳖ा)(कुिमदी डुिप्प), िचᱫीदार िहरण (ऐिक्सस ऐिक्सस)(डूिप्प), िसयार(किनस अयरेस)(नᲥा) और जंगली कुᱫा (कुओन अलिपनेस)(रेछू रूᲥा), आिद सिम्मिलत हᱹ ;

और, कांबलकᲂडा वन्यजीव अभयारण्य, िवशाखापटनम के सुरिक्षत क्षेᮢ के चारᲂ ओर के क्षेᮢ को, िजसका िवस्तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ हᱹ, पयार्वरण की दृि᳥ से पािरिस्थितक संवेदी जोन के रूप मᱶ सुरिक्षत और संरिक्षत करना तथा उᲦ पािरिस्थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ को तथा उनके ᮧचालन तथा ᮧसंस्करण को ᮧितिष᳍ करना आवश्यक है ;

अतः, अब, केन्ᮤीय सरकार, पयार्वरण (संरक्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पिठत पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (2) के खंड (v) और खंड (xiv) के साथ पिठत और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते हुए, आंᮥ ᮧदेश राज्य मᱶ कम्बलकᲂडा वन्यजीव अभयारण्य की सीमा से 4.33 िकलोमीटर की दूरी तक उᱫरी िदशा पर उᱫरी सीमा से गुजरने वाली रा᳦ीय राजमागर् की वजह से) शून्य से गुजरने वाले क्षेᮢ को कंबलकᲂडा वन्यजीव अभयारण्य पािरिस् थितक संवेदी जोन (िजसे इसमᱶ इसके पश् चात् पािरिस् थितक संवेदी जोन कहा गया है) के रूप मᱶ अिधसूिचत करती है, िजसका िववरण िन᳜ानुसार है, अथार्त् :--
1.
पािरिस्थितक संवेदी जोन का िवस्तार और उसकी सीमाएं.— (1) आन्ᮥ ᮧदेश राज्य के िवशाखापटनम िजला मᱶ पािरिस्थितक संवेदी जोन 30.51 वगर् िकलोमीटर क्षेᮢ तक फैला हुआ है और इसमᱶ मᱶ 2 मंडलो अथार्त् आनन्दापुरम और िछनांगिधली िजला िवशाखापटनम मᱶ 14 ᮕाम सिम्मिलत हᱹ ।

(2) पािरिस्थितक संवेदी जोन की सीमा शून्य से उᱫरी िदशा पर (उᱫरी िदशा पर रा᳦ीय राजमागर् के गुजरने के कारण) 4.33 िकलोमीटर की दूरी पर कम्बलकᲂडा वन्यजीव अभयारण्य की सीमा से िभ᳖ हो रही है। (3) पािरिस्थितक संवेदी जोन की सीमा का वणर्न उपाबंध I के रूप मᱶ उपाब᳍ है और ᮕामᲂ की सूची उपाबंध II मᱶ दी गई है ।
(4) अक्षांश-देशांतर के साथ पािरिस्थितक संवेदी जोन की सीमा का मानिचᮢ उपाबंध III के रूप मᱶ उपाब᳍ है । 2. पािरिस्थितक संवेदी जोन के िलए आंचिलक महायोजना.— (1) राज्य सरकार, पािरिस्थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन की तारीख से दो वषर् की अविध के भीतर, स्थानीय ᳞िᲦयᲂ के परामशर् से और इस अिधसूचना मᱶ राज्य सरकार के सक्षम ᮧािधकारी अनुमोदन के िलए िदए गए अनुबंधᲂ के अनुसरण मᱶ आंचिलक महायोजना तैयार करेगी । (2) राज्य सरकार ᳇ारा पािरिस् थितक संवेदी जोन के िलए आचंिलक महायोजना ऐसी रीित मᱶ जो इस अिधसूचना मᱶ िविन᳸दष् ट की जाए तथा सुसंगत कᱶᮤीय और राज् य िविधयᲂ और कᱶᮤीय सरकार ᳇ारा जारी मागर्िनदᱷशᲂ, यिद कोई हᲂ, अनुरूप भी तैयार की जाएगी । (3)
आंचिलक महायोजना, पयार्वरणीय और पािरिस्थितक िवचारᲂ को समाकिलत करने के िलए राज् य सरकार के सभी संब᳍ िवभागᲂ के परामशर् से तैयार की जाएगी,:-- (i) पयार्वरण; (ii) वन और वन्यजीव;
(iii) कृिष ; (iv) राजस् व; (v) शहरी िवकास; (vi) पयर्टन;
(vii) ᮕामीण िवकास;
(viii) िसचाई और बाढ़ िनयंᮢण; (ix) नगरपािलका;
(x) पंचायती राज;
(xi) लोक िन मार्ण िव भाग। (4)
आंचिलक महायोजना मᱶ तब तक अनुमोिदत िव᳒मान भू-उपयोग, अवसंरचना और िᮓयाकलापᲂ पर कोई िनबᲈधन तब तक अिधरोिपत नहᱭ िकया जाएगा जब तक िक इस अिधसूचना मᱶ ऐसा िविन᳸दष् ट न हो और आचंिलक महायोजना सभी अवसंरचना और िᮓयाकलापᲂ को सुधारने और अिधक दक्ष और पािरिस्थितक बनाने के िलए एक कारक होगा ।

(5) आंचिलक महायोजना मᱶ अनाच्छािदत क्षेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरक्षण, आवाह क्षेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरक्षण, स्थानीय समुदायᲂ की आवश्यकताᲐ तथा पािरिस्थितक और पयार्वरण से संबंिधत ऐसे अन्य पहलूᲐ, िजन पर ध्यान देना आवश्यक है, के िलए उपबंध िकया जाएगा । (6)
आंचिलक महायोजना मᱶ सभी िव᳒मान पूजा स् थलᲂ, ᮕामᲂ और नगरीय बंदोबस्तᲂ, वनᲂ के ᮧकार और िकस् मᲂ, कृिष क्षेᮢᲂ, ऊपजाऊ भूिम, हिरत क्षेᮢ जैसे उ᳒ान और उसी ᮧकार के स् थान, उ᳒ान कृिष क्षेᮢ, फलोउ᳒ान, झीलᲂ और अन्य जल िनकायᲂ को समथर्कारी मानिचᮢᲂ के साथ अभ्यांिकत िकया जाएगा योजना िव᳒मान और ᮧस्तािवत भूिम के उपयोग का िववरण देते हुए मानिचᮢो ᳇ारा समिथत होगी । (7)
आंचिलक महायोजना मᱶ, पािरिस्थितक संवेदी जोन के िवकास िकया जाएगा और सारणी मᱶ सूचीब᳍ ᮧितिष᳍ िविनयिमत िᮓयाकलापᲂ का पालन िकया जाएगा और स्थानीय समुदायᲂ के सुरिक्षत जीव को ᮧाजर्न के िलए पािरिस्थितक अनुकूल िवकास को भी सुिनि᳟त और सुरिक्षत िकया जाएगा ।
(8) आंचिलक महायोजना क्षेᮢीय िवकास योजना के साथ सह-िवस्तार होगी । (9) इस ᮧकार अनुमोिदत आंचिलक महायोजना मानीटरी सिमत के िलए इस अिधसूचना मᱶ िदए गए उपबंधᲂ के अनुसार मानीटरी करने
उसके कायᲄ के कायार्न्वयन के िलए एक संदभर् दस्तावेज तैयार होगी । 3. राज्य सरकार ᳇ारा िकए जाने वाले उपाय.— राज्य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथार्त्:-- (1) भू-उपयोग.- (क) पािरिस् थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष क्षेᮢᲂ, कृिष क्षेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िच᳖ािकत िकए गए पाकᲄ और खुले स्थानᲂ का मुख्य वािणज्यक या मुख्य आवािसक काम्पेल्कस या औ᳒ोिगक िᮓयाकलापᲂ के िलए उपयोग या संपिरवतर्न नहᱭ होगा: परंतु पािरिस्थितक संवेदी जोन के भीतर कृिष भूिम और अन्य भूिम का संपिरवतर्न, इसमᱶ िविन᳸द᳥ ᮧयोजन से िभ᳖ ᮧयोजन के िलए मानीटरी सिमित की िसफािरश पर और सुसंगत राज्य िविधयᲂ और केᮤीय सरकार / राज्य सरकारो के ऐसी अन्य िनयमᲂ और िविनयमᲂ के अधीन जो लागू हो, सक्षम ᮧािधकारी के पूवर् अनुमोदन से, और इस अिधसूचना के उपबंधो ᳇ारा स्थानीय िनवािसयᲂ की िन᳜िलिखत आवासीय आवश्यकताᲐ को पूरा करने के िलए अनुज्ञात िकया जा सकेगा है, जैसे:- (i) िव᳒मान सड़कᲂ को चौड़ा करना और उन्हᱶ सुदृढ करना तथा नई सड़कᲂ का संिनमार्ण; (ii) बुिनयादी ढांचᲂ और नागिरक सुख सुिवधाᲐ का संिनमार्ण और नवीकरण; (iii) ᮧदूषण उत्प᳖ न करने वाले लघु उ᳒ोग; (iv) कुटीर उ᳒ोगᲂ िजसके अंतगर्त ᮕामीण उ᳒ोग हᱹ; सुिवधाजनक भण्डार और पैरा 4 मᱶ िदए गए स्थानीय िᮓयाकलाप भी है:

परंतु यह और िक सुंसगत राज्य िविधयᲂ और राज्य सरकार के अन्य िनयमᲂ और िविनयमᲂ के अधीन सक्षम ᮧािधकारी राज्य सरकार के पूवर् अनुमोदन तथा संिवधान के अनुच्छेद 244 और तत्समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगर्त अनुसूिचत जनजाित और अन्य परंपरागत वन िनवासी (वन अिधकारᲂ की मान्यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणिज्यक या उ᳒ोग िवकास िᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनुज्ञात नहᱭ होगा:
परंतु यह भी िक पािरिस् थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपदिशत, मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् राज्य सरकार ᳇ारा ᮧत्येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुिट के संशोधन की सूचना कᱶᮤीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय को देनी होगी ।
परंतु यह भी िक उपयुर्Ღ ᮢुिट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय िकसी भी दशा मᱶ भू-उपयोग का पिरवतर्न सिम्मिलत नहᱭ होगा ।
(ख) वनीकरण और ᮧाकृितक वास सम्बधी िᮓयाकलापᲂ को पुन:स्थािपत करन के िलए और अनᮧयुक् त या अनुत् पादक कृिष क्षेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास िकए जाएंगे ।

(2) ᮧाकृितक जल ᮲ोत -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ निदयᲂ और जलांतरालो की पहचान की जाएगी और उनके संरक्षण और पुनरुद्भूतकरण के िलए योजना सिम् मिलत होगी । (3) पािरिस्थितक पयर्टन – (क) पािरिस्थितक संवेदी जोन के भीतर सभी नए पयर्टन संबंधी िᮓयाकलाप या िव᳒मान पयर्टन सम्बधी िᮓयाकलापो का िवस्तार पयर्टन महायोजना के अनुसार हᲂगे ।
(ख) पािरिस्थितक पयर्टन महायोजना पयर्टन िवभाग, ᳇ारा पयार्वरण और वन िवभाग के परामशर् से तैयार की जाएगी ।
(ग) पयर्टन महायोजना आंचिलक महायोजना के एक घटक के रूप मᱶ होगा । (घ) पािरिस्थितक पयर्टन संबंधी िᮓयाकलाप िनम् निलिखत के अधीन िविनयिमत हᲂगे, अथार्त् :- (i) वन्यजीव अभयारण्य की सीमा से एक िकलोमीटर के भीतर या पािरिस्थितक संवेदी जोन के िवस्तार तक इनमᱶ जो भी िनकट है, िकसी नये वािणिज्यक होटल और िरसोटर्, का संि᳖माणर् अनुज्ञात नहᱭ होगा। और वन्यजीव अभयारण्य की सीमा से एक िकलोमीटर से परे और पािरिस्थितक संवेदी जोन के िवस्तार तक सभी नए होटलो और िरसोटर् की स्थापना पयर्टन महा योजना के अनुसार केवल पािरिस्थितक पयर्टन सुिवधाᲐ के िलए पूवर् पिरभािषत और अिभिचि᳖त क्षेᮢो मᱶ ही अनुज्ञात होगी; (ii) पािरिस्थितक संवेदी जोन के भीतर सभी नए पयर्टन िᮓयाकलापᲂ या िव᳒मान पयर्टन िᮓयाकलापᲂ का िवस्तार कᱶिᮤय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय के मागर्दशर्क िस᳍ांतᲂ के ᳇ारा तथा राष् ᮝीय व् याᮖ संरक्षण ᮧािधकरण, ᳇ारा पािरिस्थितक पयर्टन पर बल देते हुए जारी पािरिस्थितक पयर्टन मागर्दशर्क िस᳍ांतᲂ के अनुसार, होगा; (iii) आंचिलक महायोजना का अनुमोदन िकए जाने तक, पयर्टन के िलए िवकास और िव᳒मान पयर्टन िᮓयाकलापᲂ के िवस्तार वास्तिवक स्थल िविन᳸द᳥ संवीक्षा तथा मानीटरी सिमित की िसफािरश पर आधािरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनुज्ञात िकया होगा और पािरिस्थितक संवेदी जोन के भीतर िकसी नए होटल या िरसोटर् या वािणिज्यक स्थापना का सि᳖मार्ण
अनुज्ञात नहᱭ होगा । (4) नैसिगक िवरासत -- पािरिस्थितक संवेदी जोन मᱶ महत्वपूणर् नैसिगक िवरासत के सभी स्थलᲂ जैसे सभी जीन कोश आरिक्षत क्षेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, स्थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आिद की पहचान की जाएगी और उनकी सुरक्षा और संरक्षा के िलए योजना आंचिलक महायोजना के भाग रूप िवरासत संरक्षण योजना बनाई जाएगी । (5) मानव िनिमत िवरासत स् थल - पािरिस् थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िशल्प-तथ्य, ऐितहािसक, कलात्मक और सांस्कृितक महत्व के क्षेᮢᲂ और की पहचान की जाएगी और उनके संरक्षण की िवरासत संरक्षण योजना तैयार की जाएगी आंचिलक महायोजना का भाग रूप होगी ।
(6) ध् विन ᮧदूषण -- पािरिस्थितक संवेदी जोन मᱶ ध् विन ᮧदूषण के िनवारण और िनयंᮢण के िलए पयार्वरण (संरक्षण) अिधिनयम, 1986 के अधीन ध्विन ᮧदूषण (िविनयम और िनयंᮢण) िनयम, 2000 का पालन िकया जाएगा।
(7) वायु ᮧदूषण -- पािरिस्थितक संवेदी जोन मᱶ, वायु ᮧदूषण के िनवारण और िनयंᮢण वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार िकया जाएगा ।
(8) बिह᮲ाव का िनस्सारण -- पािरिस्थितक संवेदी जोन मᱶ उपचािरत बिह᮲ाव का िनस्सारण पयार्वरणीय (संरक्षण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ सामान्य मानकᲂ या राज्य सरकार ᳇ारा िनयत मानको के अंतगर्त आने वाले पयार्वरणीय ᮧदूषको के िनस्सारण से सम्बिधत उपबंधो के अनुसार होगा। (9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान और ᮧबंधन िन᳜िलिखत रूप मᱶ होगा-- (क) पािरिस्थितक संवेदी जोन मᱶ उपचािरत बिह᮲ाव का िनस्सारण, ठोस अपिशष् ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं. का.आ. 1357(अ) तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत िकए गए थे, के उपबंधᲂ के अनुसार िकया जाएगा ; और अकाबर्िनक सामᮕी का िनपटान पािरिस्थितक संवेदी जोन के बाहर पहचान िकए गए स् थल पर िकसी पयार्वरणीय स्वीकृत रीित मᱶ िकया जा सकेगा; (ख) पािरिस्थितक संवेदी जोन मᱶ ठोस अपिशष् टᲂ को जलाना या भष् मीकरण और भूिम भराव के स्थापनᲂ को अनुज्ञात नहᱭ िकया जाएगा ।

(10) जैव िचिकत् सीय अपिशष् ट.- जैव िचिकत् सीय अपिशष् ट ᮧबंधन िन᳜िलिखत रूप मᱶ होगा— (क) पािरिस्थितक संवेदी जोन मᱶ जैव िचिकत्सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं.का.िन. 343(अ), तारीख 28 माचर् 2016 ᳇ारा ᮧकािशत जैव िचिकत्सीय अपिश᳥ ᮧबंध िनयम, 2016 के अनुसार िकया जाएगा । (ख) पािरिस्थितक संवेदी जोन मᱶ कोई सामान्य उपचार सुिवधा या जलाया जाना अनुज्ञात नहᱭ िकया जाएगा । (11) प्लािस्टक अपिश᳥ ᮧबंधन - पािरिस्थितक संवेदी जोन मᱶ प्लािस्टक अपिश᳥ ᮧबंध भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं.का.िन 340(अ), तारीख 18 माचर्, 2016 ᳇ारा ᮧकािशत प्लािस्टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार िकया जाएगा। (12) िनमार्ण और िवध्वंस अपिश᳥ ᮧबंधन: - पािरिस्थितक संवेदी जोन मᱶ संिनमार्ण और िवध्वंस अपिश᳥ ᮧबंध भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय की अिधसूचना सं.का.िन 317(अ), तारीख 29 माचर्, 2016 ᳇ारा ᮧकािशत संिनमार्ण और िवध्वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा। (13) ई–अपिश᳥:- पािरिस्थितक संवेदी जोन मᱶ ई–अपिश᳥ ᮧबंध भारत सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय ᳇ारा ᮧकािशत ई–अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार िकया जाएगा। (14) यानीय पिरवहन: - पिरवहन की यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध सिम्मिलत िकए जाएंगे और आंचिलक महायोजना के तैयार होने और राज्य सरकार के सक्षम ᮧािधकारी ᳇ारा के अनुमोिदत होने तक, मानीटरी सिमित सुंसगत अिधिनयमᲂ और उसके अधीन बनाए गए िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी । (15) यानीय ᮧदूषण:- लागू िविधयᲂ के अनुसार वाहन ᮧदूषण की रोकथाम और िनयंᮢण का अनुपालन िकया जाएगा जैसे सीएनजी, एलपीजी, आिद स्वच्छक ईंधन के उपयोग ᮧयास िकया जाएगा । (16) औ᳒ोिगक ईकाइयां: - (i) राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन पर या उसके प᳟ात पािरिस्थितक संवेदी जोन के भीतर कोई नए ᮧदूिषत उ᳒ोगᲂ की स्थापना की अनुमित नहᱭ दी जाएगी।
(ii) पािरिस्थितक संवेदी जोन के भीतर कᱶᮤीय ᮧदूषण िनयंᮢण बोडर् ᳇ारा फरवरी, 2016 मᱶ जारी िदशािनदᱷशᲂ मᱶ केवल उ᳒ोगो के वगᱮकरण के अनुसार जब तक िक इस अिधसूचना मᱶ िविन᳸द᳥ न हो गैर- ᮧदूिषत उ᳒ोगᲂ की स्थापना की अनुमित दी जाएगी
इसके अितिरᲦ, गैर-ᮧदूिषत कुटीर उ᳒ोगᲂ का संवधर्न िकया जाएगा। (17) पहाड़ी ढलानᲂ को संरक्षण: - पहाड़ी ढलानᲂ के संरक्षण के अंतगर्त: (क) आंचिलक महायोजना पहाड़ी ढलानᲂ पर क्षेᮢᲂ उपदिशत िकया जाएगा जहां संिनमार्ण की अनुमित नहᱭ होगी । (ख)कटाव के एक उᲬ िडᮕी के साथ िव᳒मान खड़ी पहाड़ी ढलानᲂ या ढलानᲂ पर िकसी भी संिनमार्ण की अनुमित नहᱭ होगी । (18) यिद यह आवश्यक समझा जाता है,तो इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए केᮤीय सरकार और राज्य सरकार, अन्य
अितिरᲦ उपायᲂ िविन᳸द᳥ होगी। 4. पािरिस्थितक संवेदी जोन मᱶ ᮧितिष᳍ और िविनयिमत िकए जाने वाले िᮓयाकलापᲂ की सूची.- पािरिस्थितक संवेदी जोन मᱶ सभी िᮓयाकलाप पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) और उसके अधीन बनाए गए िनयमᲂ िजसके अंतगर्त तटीय िविनयमन जोन (सीआरजेड), अिधसूचना 2011 भी है और पयार्वरणीय समाघात िनधार्रण (ईआईए) अिधसूचना, 2006 और वन (संरक्षण) अिधिनयम, 1980 (1980 के 69), भारतीय वन अिधिनयम, 1927 (1927 के 16), वन्यजीव (संरक्षण) अिधिनयम, 1972 (1972 के 53) के उपबंधो और उसके िकए गए संशोधनᲂ सिहत ᳇ारा शािसत हᲂगे और नीचे दी गई सारणी मᱶ िविन᳸द᳥ रीित से िविनयिमत हᲂगे, अथार्त् :--

(ख) खनन संिᮓयाए माननीय उᲬतम न्यायालय के िरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गोदावमर्मन िथरुमूलपाद बनाम भारत संघ के मामले मᱶ तारीख 4 अगस्त, 2006 के आदेशो के अनुसार और िरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत संघ के मामले मᱶ तारीख 21 अᮧैल, 2014 के आदेश के अनुसार होगी ।
2. जल या वायु या मृदा या ध् विन आिद ᮧदूषण कािरत करने वाले नए उ᳒ोगᲂ की स् थापना । पािरिस्थितक संवेदी जोन मᱶ ᮧदूषण फैलाने वाले उ᳒ोगᲂ के िवस्तार की अनुमित नहᱭ दी जाएगी । केन्ᮤीय ᮧदूषण िनयंᮢण बोडर् वगᱮकरण मᱶ हिरत या ᳡ेत कृिष रूप मᱶ वगᱮकृत उ᳒ोगᲂ को िजसके अन्तगर्त कृिष आधािरत उ᳒ोग भी है िविनयमᲂ के अनुसारिविनयिमतिकयाजाएगा। 3. ᮧमुख पनिबजली पिरयोजना की स्थापना। लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अन् यथा उपबंिधत के िसवाय) हᲂगे । 4. िकसी पिरसंकटमय पदाथᲄ का उपयोगया उत्पादन । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अन् यथा उपबंिधत के िसवाय) हᲂगे । 5. ᮧाकृितक जल िनकायᲂ या सतही क्षेᮢ मᱶ अनुपचािरत बिह᮲ार्व का िनस्सारण । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अन् यथा उपबंिधत के िसवाय) हᲂगे । 6. फमᲄ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़े पैमाने पर वािणिज्यक पशुधन संपदा और कुक्कुट फामᲄ की स्थापना । स्थानीय जरूरतᲂ को पूरा करने के िलए लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अन् यथा उपबंिधत के िसवाय) हᲂगे। 7. नई आरा िमलᲂ की स्थापना। पािरिस्थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िवस् तार अनुज्ञात नहᱭ होगा ।
ख. िविनयिमत िᮓयाकलाप 8. होटलᲂ और िरसोटᲄ की वािणज्यक स्थापना । पािरिस्थितक अनुकूल पयर्टन िᮓयाकलापᲂ से संबंिधत लघु को अस्थायी संरचना के िसवाय संरिक्षत क्षेᮢ सीमा के एक िकलोमीटर के भीतर या पािरिस्थितक संवेदी जोन की सीमा तक जो भी िनकटतम हो कोई नया वािणिज्यक होटल और िरसोटर् अनुज्ञात नहᱭ हᲂगे । परन्तु संरिक्षत क्षेᮢ सीमा से एक िकलोमीटर के प᳟ात और पािरिस्थितक संवेदी जोन के िवस्तार तक जो भी िनकटतम हो, सभी नए पयर्टन िᮓयाकलापᲂ या िव᳒मान िᮓयाकलापᲂ का िवस्तार पयर्टन महायोजना और ऐसे मागर्दशर्क िस᳍ांत जो लागू हो, के अनुरूप होगा । 9. संिनमार्ण िᮓयाकलाप । (क) संरिक्षत क्षेᮢ की सीमा से एक िकलोमीटर के भीतर या पािरिस्थितक संवेदी जोन के िवस्तार तक जो भी िनकट हो िकसी भी ᮧकार का काई नया वािणिज्यक संिनमार्ण अनुज्ञात नहᱭ िकया जाएगा:

परंतु स्थानीय ᳞िᲦयᲂ को उनके आवासीय उपयोग के िलए उनकी भूिम मᱶ संिनमार्ण िजसके अंतगर्त भवन उपिवधयᲂ के पैरा 3 के उपपैरा (1) मᱶ सूचीब᳍ िᮓयाकलाप भी हᱹ, करने के िलए अनुज्ञात िकया जाएगा ।

परन्तु यह और िक ऐसे लघु उ᳒ोगᲂ जो ᮧदूषण उत्पन नहᱭ करते हᱹ, से संबंिधत संिनमार्ण िᮓयाकलाप िविनयिमत िकए जाएंगे और लागू िनयमᲂ और

िविनयमᲂ, यिद कोई हᲂ, के अनुसार सक्षम ᮧािधकारी की पूवर् अनुमित से ही न् यूनतम पर रखे जाएंगे ।
(ख) एक िकलोमीटर के प᳟ात आंचिलक महायोजना की अनुसार िविनयिमत हᲂगे । 10. ᮧदूषण उत्प᳖ न करने वाले लघु उ᳒ोग । पािरिस् थितक संवेदी जोन मᱶ देशीय माल से उत्पादᲂ का उत्पादन करने वाले गैर ᮧदूषण, गैर पिरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधािरत देशीय माल से औ᳒ोिगक उत्पादᲂ का उत्पादन उ᳒ोग जो पयार्वरण पर कोई िवपरीत ᮧभाव नहᱭ डालते हᱹ, अनुज्ञात िकए जाएंगे ।
11. ईंट भᲵᲂ की स्थापना करना। लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अन् यथा उपबंिधत के िसवाय) हᲂगे । 12. वृक्षᲂ की कटाई । (क) राज्य सरकार मᱶ सक्षम ᮧािधकारी की पूवर् अनुमित के िबना वन, सरकारी या राजस्व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृक्षᲂ की कटाई नहᱭ होगी । (ख) वृक्षᲂ की कटाई संबंिधत कᱶᮤीय या राज्य अिधिनयम या उसके अधीन बनाएगएिनयमᲂकेउपबंधकेअनुसारिविनयिमत होगी । 13. वन उत्पादᲂ और गैर काष् ठ वन उत्पादᲂका संᮕहण । लागू िविधयᲂ के अधीन िविनयिमतहᲂगे । 14. िव᳒ुत केबलᲂ और दूरसंचार टावरᲂ का पिरिनमार्ण और केबल िबछाना और अन्य बुिनयादी ढांचे । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।भूिमगत केबल को बढ़ावा िदया जाएगा। 15. नागिरक सुिवधाᲐ सिहत बुिनयादी ढांचे। लागूिविधयᲂ केअनुसार न्यूनीकरणकीउपायᲂ के साथ, िनयमऔर िविनयमनऔरउपलब्धिदशािनदᱷश िविनयिमत हᲂगे।
16. िव᳒मान सड़कᲂ को चौड़ा करना औरउन्हᱶ सुदृढ करना । लागूिविधयᲂ केअधीन िविनयिमत हᲂगेऔर भूिमगत केबल िबछाने को बढावा िदया जाएगा । 17. पयर्टन से संबंिधत िᮓयाकलाप जैसे गमर् वायु गुब्बारᱶ, हेलीकाप्टर, ᮟोन, माइᮓोलाइटस और अन्य पयर्टन िᮓयाकलाप आिद ᳇ारा पािरिस्थितक संवेदी जोन क्षेᮢ के ऊपर से उड़ना जैसे िᮓयाकलाप करना। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । 18. पहाड़ी ढालᲂ और नदी तटᲂ का संरक्षण । 19. रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणिज्यकᮧयोजनके िलए िविनयिमत हᲂगे। 20. स्थानीय समुदायᲂ ᳇ारा चल रही कृिषऔर बागवानी ᮧथाᲐ के साथ पशुपालन, दुग्ध उ᳒ोग कृिष और मछली पालन । स्थानीयलोगᲂकेउपयोगकेिलएलागू िविधयᲂ के अधीन अनुज्ञात होगा । 21. ᮧाकृितक जल िनकायᲂ या सतही क्षेᮢमᱶ उपचािरत बिह᮲ार्व का िनस्सारण । उपचािरतबिह᮲ार्वकेपुनचर्ᮓणकोलागू िविधयᲂ के अधीन िविनयिमत िकया जाएगा। 22. सतह और भूजल केवािणिज्यक िनष्कषर्ण । 23. खुले कुआ, बोर जल, आिद के िलए कृिष और अन्य उपयोग । िविनयिमत और उपयुᲦ ᮧािधकारी ᳇ारा िᮓयाकलापᲂ की सख्ती से मानीटरी की जाएगी। 24. ठोस अपिशष् ट ᮧबंधन। 25. िवदेशी ᮧजाितयᲂ को लाना । 26. पािरिस्थितक-पयर्टन। 27. पोिलथीन बैगᲂ का उपयोग । 28. वािणिज् यक साइनबोडर् और होिडग । ग. संविधत िᮓयाकलाप 29. वषार् जल संचयन । सिᮓ य रूप से बढ़ावा िदया जाएगा । 30. जैिवक खेती। सिᮓयरूपसेबढ़ावािदयाजाएगा । 31. सभी गितिविधयᲂ के िलए हिरत ᮧौ᳒ोिगकी को ᮕहण करना । सिᮓयरूपसेबढ़ावािदयाजाएगा ।

कुटीर उ᳒ोगᲂ िजसके अंतगर्त ᮕामीण कारीगर आिद भी हᱹ। सिᮓयरूपसेबढ़ावािदयाजाएगा । 33. नवीकरणीय ऊजार् ᮲ोत का उपयोग। सिᮓय रुप से बायो गैस, सौर ᮧकाश आिद को बढ़ावा िदया जाएगा। 34. कृिष वािनकी । सिᮓ य रूप से बढ़ावा िदया जाएगा । 35. कौशल िवकास । सिᮓयरूपसेबढ़ावािदयाजाएगा । 36 िन᳜ीकृत भूिम या वन या आवास की बहाली । सिᮓ य रूप से बढ़ावा िदया जाएगा । 37. पयार्वरणीय जागरुकता । सिᮓयरूपसेबढ़ावािदयाजाएगा ।

5. मानीटरी सिमित.— केᮤीय सरकार, पयार्वरण (संरक्षण) अिधिनयम, 1986 की धारा 3 की उप-धारा (3) ᳇ारा ᮧदन्त शिᲦयᲂ को उपयोग करते हुए पािरिस्थतक संवेदी जोन की ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करती है, जो िन᳜िलिखत से िमलकर बनेगी, अथार्त्:-- (i) िजला कलक्टर, िवशाखापटनम - अध्यक्ष; (ii) गैर सरकारी संगठन का एक ᮧितिनिध जो पयार्वरण के क्षेᮢ मᱶ
   कायर् कर रहा है िजसे आन्ᮥ ᮧदेश सरकार ᳇ारा तीन वषर् की अविध के िलए
   नाम िन᳸द᳥ िकया जाएगा – सदस्य ; (iii) पािरिस्थितक और पयार्वरण के क्षेᮢ मᱶ एक िवशेषज्ञ िजसे आन्ᮥ ᮧदेश
   सरकार ᳇ारा ᮧत्येक मामले मᱶ तीन वषर् की अविध के िलए नाम िन᳸द᳥ िकया जाएगा - सदस्य ;
   (iv) सदस्य-सिचव / राज्य जैव िविवधता बोडर् का सदस्य - सदस्य ; (v) क्षेᮢीय अिधकारी, राज्य ᮧदूषण िनयंᮢण बोडर्, मेडक – सदस्य ; (vi) क्षेᮢ का ज्ये᳧ नगर योजनाकार/मुख्य शहरी योजनाकार/नगरी योजनाकार - सदस्य; (vii)उप-वन संरक्षक (अभयारण्य का भारसाधक), िवशाखापटनम – सदस्य सिचव। (2) िनदᱷश - िनबंधन (क) पािरिस्थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी।
   (ख) पािरिस्थितक संवेदी जोन मᱶ भारत सरकार के तत् कालीन पयार्वरण और वन मंᮢालय की अिधसूचना संख्याक का.आ 1533 (अ) तारीख 14 िसतंबर, 2006 की अनुसूची मᱶ आते है और जो पािरिस्थितक संवेदी जोन के अंतगर्त आते है इसके पैरा 4 के अधीन
   सारणी मᱶ यथा िविन᳸द᳥ ᮧितिष᳍ िᮓयाकलापᲂ की वास्तिवक िविन᳸द᳥ स्थलीय दशाᲐ पर आधािरत यथािविन᳸द᳥ मानीटरी िसिमत ᳇ारा संवीक्षा की जाएगी और उᲦ अिधसूचना के उपबंधो के अधीन पूवर् पयार्वरण अनापिᱫ के िलए केन्ᮤीय सरकार के पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय को िन᳸द᳥ की जाएगी ।
   (ग) ऐसे िᮓयाकलाप, जो भारत सरकार के तत् कालीन पयार्वरण और वन मंᮢालय की अिधसूचना संख्यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 की अिधसूची मᱶ नहᱭ आते है, ᳴कतु पािरिस्थितक संवेदी जोन के अंतगर्त आते है, इसके पैरा 4 के अधीन
   सारणी मᱶ यथािविन᳸द᳥ ᮧितिष᳍ िᮓयाकलापᲂ के िसवाय सभी िᮓयाकलापो की वास्तिवक िविन᳸द᳥ स्थलीय दशाᲐ पर आधािरत
   यथािविन᳸द᳥ मानीटरी सिमित ᳇ारा संवीक्षा की जाएगी और संबिधत िविनयामक ᮧािधकािरयᲂ को िन᳸द᳥ िकए जाएंगे।
   (घ) मानीटरी सिमित का सदस्य-सिचव या संब᳍ कलक्टर या सम्बिधत पाकर् का वनपालक, ऐसे ᳞िᲦ के िवरू᳍, जो इस अिधसूचना के िकसी उपबंध का उल्लंघन करता है, पयार्वरण (संरक्षण) अिधिनयम, 1986 की धारा 19 के अधीन पिरवाद फाइल करने के िलए सक्षम हᲂगे । (ड.) मानीटरी सिमित मु᳎ा दर मु᳎ा के आधार पर अपेक्षाᲐ पर िनभर्र रहते हुए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या िवशेषज्ञᲂ, औ᳒ोिगक संगमᲂ या संब᳍ पणधािरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशर् मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।

(च) मानीटरी सिमित ᮧत्येक वषर् की 31 माचर् तक की अपनी वािषक कारर्वाई िरपोटर् राज्य के मुख्य जीव वाडर्न उपाबंध IV मᱶ उपबंिधत रूप िवधान के अनुसार उक् त वषर् के 30 जून तक ᮧस्तुत करेगी । (छ) केन्ᮤीय सरकार का पयार्वरण, वन और जलवायु पिरवतर्न मंᮢालय मानीटरी सिमित को उसके कृत्यᲂ के ᮧभावी िनवर्हन के िलए समय-समय पर ऐसे िनदेश दे सकेगा, जो वह ठीक समझे । 6.
इस अिधसूचना के उपबंधᲂ को ᮧभाव देने के िलए कᱶᮤीय सरकार और राज् य सरकार अितिरक् त उपाय, यिद कोई हᲂ, िविन᳸दष् ट कर सकेगी ।
7. इस अिधसूचना के उपबंध भारत के माननीय उᲬतम न्यायालय या उᲬ न्यायालय या राष् ᮝीय हिरत ᮧािधकरण ᳇ारा पािरत कोई आदेश या पािरत िकए जाने वाले िकसी आदेश, यिद कोई हᲂ, के अध्यधीन, हᲂगे । [फा.सं. 25/53/2014-ईएसजेड-आरई] लिलत कपूर, वैज्ञािनक ‘जी’
उपाबंध-I पािरिस्थितक-संवेदी जोन का सीमा िववरण: क से ख: यह िमडीवानीपलेम ᮕाम के उᱫर-पूवर् मᱶ 17.8795300 उत् तरी ओर 83.316650 पूवᱮ िनदᱷशांकᲂ से लगे स् थल से शुरु होता है। यह सीमा रेखा एनएच-38 के िकनारे से जाती है और गंभीरम िरजवार्यर के समीप िदलोक्स के पीछे से गुजरकर 17.87368 उत् तरी और 83.36599 पूवᱮ िनदᱷशांक से लगे स्टेशन 'ख' को छूती है। क से ख स्टेशन की कुल दूरी 6.985 िक.मी. है। इस पािरिस्थितक-संवेदी जोन की पिरिध 200-780 मीटर लंबी है। वतर्मान मᱶ राज्य राजमागर् और रा᳦ीय राजमागर् सड़कᲂ को छोड़कर संरिक्षत क्षेᮢ के चारᲂ ओर ᮧस्तािवत पािरिस्थितक-संवेदी जोन की दूरी 200 मीटर है।
ख से ग: यह रेखा पारादेसीपलेम ᮕाम से होकर एनएच-5 और उत् तर 17.857000 पूवᱮ 83.366420 के िनदᱷशांकᲂ से स्टेशन सं. ग तक अभयारण्य सीमा के साथ साथ गुजरती है। स्टेशन ख से ग की दूरी िक.मी 1.854 है इस पािरिस्थितक संवेदी जोन की परिध की लम्बाई 140-308 मीटर है। ᮧस्तािवत पािरिस्थितक संवेदी जोन के संरिक्षत क्षेᮢ के चारᲂ ओर की सीमा 100 मीटर है।
ग से घ: यह सीमा रेखा बोरा वनीयापलेम गांव के पीछे से होकर दिक्षण पि᳟म ᳴दशा की ओर जाती है और देवीमेᲵा के चारो तरफ होकर उᱫर 17.833200 पूवर् 83.327710 िनदᱷशांको के साथ स्टेशन घ पर पहुंचती है जो कोमाडी गांव के पीछे िस्थत चैतन्य इंजीिनयᳳरग काँलेज के पास िस्थत है ग से घ स्टेशन की कुल दूरी 5.469 िकलोमीटर है पािरिस्थितक संवेदी जोन क्षेᮢ की िवत लम्बाई 100-690 मीटर है ᮧस्तािवत पािरिस्थितक संवेदी जोन के संरिक्षत के चारᲂ ओर की सीमा 100 मीटर है। घ से ङ:
यह रेखा पᲵा भूिमयᲂ से होकर दिक्षण पूवᱮ मᱶ और कोमाडी, रेवालापलेम ᮕामᲂ की खाली भूिमयᲂ से होकर जाती है िजसमᱶ पुिलस ᮧिशक्षण केᮤ और बाबा ᮧौ᳒ोिगक एवं िवज्ञान संस्थान शािमल है तथा यह उᱫर 17.792580 पू 83.355850 िनदᱷशांको से हाऊिसग बोडर् कॉलोनी एवं ᮧाईवेट लेआइट्स से होकर गुजरती है: घ से ङ स्टेशन की कुल दूरी 5.121 िकलोमीटर है । पािरिस्थितक संवेदी जोन की पिरिध की लंबाई 100-286 मीटर है संरिक्षत क्षेᮢ के चारᲂ ओर ᮧस्तािवत दूरी 100 मीटर है।
ङ से च: रेखा एनएच-5 के दिक्षण की ओर से उᱫर िदशा की ओर गुजरती है और सीथाकᲂडा आरिक्षत वन की सीमा से होकर गुजरती है िजसमᱶ इंिदरा गांधी ᮧाणी उ᳒ान, िवशाखापटनम शािमल है, और उ. 17.753520पू. 83.352580 के

िनदᱷशांकᲂ से स्टेशन 'च' मᱶ इंडाडा ᮕाम के पिरसर से होकर गुजरती है । पािरिस्थितक संवेदी जोन की पिरिध की सीमा लंबाई 100-1360 मीटर है । िरजवर् वन के क्षेᮢ को छोड़कर संरिक्षत क्षेᮢ के चारᲂ ओर की ᮧस्तािवत दूरी 100 मीटर है । च से छ: यह रेखा सीथाकᲂडा आरएफ रिवन्ᮤ नगर, आरीलोवा कॉलोिनयᲂ के दिक्षण मᱶ पि᳟मी िदशा की ओर जाती है और उ. 17.766220 पू.83.301010 के िनदᱷशांको से मुडासरलोवा िरजवार्यर मᱶ स्टेशन 'छ' पर पहुंचती है। स् टेशन च से छ की कुल दूरी िक.मी 6697 है। इस पािरिस्थितक संवेदी जोन की पिरिध की सीमा लंबाई 127-1280 मीटर है। संरिक्षत क्षेᮢ के चारᲂ ओर ᮧस्तािवत दूरी 300 मीटर है ।
छ से ज: यह रेखा, पाईन एप्पल कॉलोनी और दारापलेय के पीछे पि᳟मी िदशा की ओर जाती है और बीआरटीएस को कवर करते हुए पाटा अडािववरम जंक्शन को छूती है तथा उ.17.778810 पू. 83.255460 के िनदᱷशांकᲂ से स्टेशन ज को छूती है। ज से झ स्टेशन की कुल दूरी 3.375 िक.मी. है। इस पािरिस्थितक-संवेदी जोन की पिरिध की सीमा लंबाई 240-418 मीटर है। संरिक्षत क्षेᮢ के चारᲂ ओर ᮧस्तािवत दूरी 300 मीटर है । ज से झ: रेखा, येराकᲂडा आरएफ सीमा को छूते हुए उᱫरी िदशा की ओर जाती है। और पि᳟म सीमा कंबलाकᲂडा एक्सटᱶशन आरएफ सीमा से गुजरते है िजसमᱶ दब्बांद, म᳖ेपलेम, गोल्लालापलेम, मालापल्ली, अप्पीकᲂडापलेम ᮕाम शािमल हैँ और उ. 17.844620 पू.83.271270 के िनदᱷशांको पर स्टेशन –I को छूती है जो कांबलकᲂडा एक्सटेशन, आरएफ का स्टेशन सं. 2 है स्टेशन ज से की कुल दूरी 8.513 िकलोमीटर है। इस पािरिस्थितक संवेदी जोन की पिरिध की सीमा की लम्बाई – 1782386 मीटर है । िरजवर् वन के क्षेᮢ को छोडकर संरिक्षत क्षेᮢ के चारᲂ ओर की औसत मध्य दूरी 200 मीटर है । झ से ञ: यह रेखा, मिमिडलोवा ᮕाम को पीछे छोड़ते हुए स्टेशन सं. 7 तक कांबलकᲂडा एक्सटᱶशन आरएफ सीमा के साथ-साथ पूवᱮ िदशा की ओर जाती है और उ.17.850740 पू.83.300300 के िनदᱷशांकᲂ पर िडब्बामीिडपलेम ᮕाम के ओवर हेड टᱹक पर स्टेशन ञ को छूती है। झ से ञ स्टेशन तक की कुल दूरी-3.190 मीटर है। इस पािरिस्थितक-संवेदी जोन की पिरिध की सीमा लंबाई 604-2003 मीटर है। िरजवर् वन के क्षेᮢ को छोड़कर संरिक्षत क्षेᮢ के चारᲂ ओर की ᮧस्तािवत दूरी 300 मीटर है । ट से क: यह रेखा, फूटिहल्स के साथ-साथ के कांबलकᲂडा वन्यजीव अभयारण्य सीमा के लगभग समानांतर उᱫरी िदशा मᱶ जाती है और उ. 17.879530 पू. 83.316650 के िनदᱷशांकᲂ पर स् टेशन क पर पहुंचती है । ट से क स्टेशन तक की कुल दूरी 3.80 िकलोमीटर है । इस पारिस्थितक-संवेदी जोन की पिरिध की सीमा लंबाई 216-578 मीटर है । संरिक्षत क्षेᮢ के चारᲂ ओर ᮧस्तािवत दूरी 300 मीटर है । उपाबंध-II

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 28th April, 2017 S.O. 1366(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 62 (E), dated the 7th January 2016, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, no objections and suggestions received from persons and stakeholders in response to the draft notification;

AND WHEREAS, the Kambalakonda Wildlife Sanctuary is situated in the heart of Visakhapatnam Mega City in Andhra Pradesh and is spread over an area of 71.39 square kilometres between 83.04’ to 83.20’ Longitudes and 17.34’ to 17.47’ Latitudes; AND WHEREAS, the Kambalakonda Wildlife Sanctuary maintains very rich bio-diversity comprising 73 tree species, 39 species of herbs and shrubs, and 18 species of climbers, 2 species of Bamboos and 7 species of grasses, 23 mammal species, 7 species of reptiles and more than 90 species of birds have been documented from the said Wildlife Sanctuary; AND WHEREAS, the Kambalakonda Wildlife Sanctuary harbours large variety of flora and is characterised by a scrub jungle the major tree species of the area are Ficus banghlensis (Banyan) (Marri), Acacia lucophloea (White Bark Acacia) (Tella tumma), Acacia chundra (Cutch Tree) (Sundra), Sapindus emarginatas (Soapnut Tree) (Kunkudu), and Wrightia tinctoria (Pala indigo) (Reppala) etc; AND WHEREAS, the area harbours a rich faunal diversity which includes, Leopard (Panthera pardus) (Chiruta Puli), Sloth Bear (Melurus ursinus), Wild Boar (Sus scrofa) (Elugu), Sambar (Rusa unicolor) (Kanithi), Barking Deer (Muntiacus muntjak) (Morige duppi), Mouse Deer (Tragulus meminna) (Kumidi duppi), Spotted Deer (Axis axis ) (Duppi), Jackal (Canis aureus),(Nakka) and Wild Dog (Cuon alpines) (Rechu Kukka), etc; AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the boundary of the protected area of the Kambalakonda Wildlife Sanctuary, Visakhapatnam as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries or and their operations and processes in the said Eco-sensitive Zone. NOW THEREFORE, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub- section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of zero on Northern Side (due to National Highway passing on Northern side) kilometres upto 4.33 kilometres from the boundary of the Kambalakonda Wildlife Sanctuary in the State of Andhra Pradesh, as the Kambalakonda Wildlife Sanctuary Eco- sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1.
Extent and Boundary of Eco-sensitive Zone.—(1) The Eco-sensitive Zone is spread over an area of 30.51 square kilometres in Visakhapatnam District in the state of Andhra Pradesh and includes 14 villages of 2 Mandals viz. Anandapuram and Chinagadhili in Visakhapatnam District.
(2)
The extent of the Eco-sensitive Zone varying from zero on Northern Side (due to National Highway passing on Northern side) to 4.33 kilo meters from the boundary of the Kambalakonda Wildlife Sanctuary. (3)
The boundary description of the Eco-sensitive Zone is appended as Annexure I and the list of villages are given in Annexure-II. (4)
The map of Eco-sensitive Zone boundary together with latitudes –longitudes is appended as Annexure III. 2.
Zonal Master Plan for the Eco-sensitive Zone.—
(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan:- (i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture; (iv) Revenue;
(v) Urban Development;
(vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by State Government.— The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

1. Landuse.- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco- sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:

   Provided that the conversion of agricultural and other lands, for the purpose other than that specified within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the relevant state laws and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:- i. widening and strengthening of existing roads and construction of new roads; ii. construction and renovation of infrastructure and civic amenities; iii. small scale industries not causing pollution;
   iv. cottage industries including village industries; convenience stores and local p activities and given under para 4:

   Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the relevant state laws and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

   Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.—The catchment areas of all natural springs, rivers and channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.

3. Tourism/ Eco-tourism.—
   (a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
   (b) The Eco-tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The activities of Eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1 km. from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer and beyond the distance of 1 km. from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by The National Tiger Conservation Authority with emphasis on eco- tourism; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel or resort or commercial establishment construction is permitted within Eco- sensitive Zone area.
(4) Natural Heritage.— All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.— Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. (6) Noise pollution.— Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986. (7) Air pollution.— Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder. (8) Discharge of effluents.— Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government. (9) Solid wastes.— Disposal and Management of solid wastes shall be as under.-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; and the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) No burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone. (10) Bio-medical waste.— Bio medical waste management shall be as under.- (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016. (b) No common treatment facility or incineration shall be permitted within the Eco Sensitive Zone. (11) Plastic Waste Management.— The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016. (12) Construction and Demolition Waste Management.— The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016. (13) E-waste.— The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change. (14) Vehicular traffic.— The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is

prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular Pollution.— Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws and efforts to be made for use of cleaner fuel for example CNG, LPG, etc.

(16) Industrial Units.— (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification and in addition, non-polluting cottage industries shall be promoted.
(17) Protection of Hill Slopes.— The protection of hill slopes shall be as under:- (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.

4. List of activities prohibited or to be regulated within Eco-sensitive Zone.—
   All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), notification 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S No Activity Description A. Prohibited Activities

Commercial Mining.

(a) All new and existing (minor and major minerals), stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bona fide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities. (b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No. 202 of 1995 and dated 21st 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No. 435 of 2012. 2.
Setting of new industries causing pollution (Water, Air, Soil, Noise, etc.). No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted. Industries categorised as Green or White in the Central Pollution Control Board classification including agro-based small scale industries, will be regulated as per regulations.
3.
Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws. 4.
Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws. 5.
Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws. 6.
Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs. 7.
Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.

B. Regulated Activities 8.
Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or upto the extent of Eco- sensitive Zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:
Provided that, beyond one kilometre from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. 9.
Construction activities. (a) No new commercial construction of any kind shall be permitted within one kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub- paragraph (1) of paragraph 3 as per building byelaws: Provided Further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.
10.
Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority. 11.
Setting up of brick kilns. Regulated (except as otherwise provided) as per applicable laws. 12.
Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 13.
Collection of Forest produce or Non-Timber Forest Produce (NTFP). Regulated under applicable laws. 14.
Erection of electrical and communication towers and laying of cables and other infrastructures . Regulated under applicable law. Underground cabling may be promoted.

Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines. 16.
Widening and strengthening of existing roads and construction of new roads. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
17.
Under taking other activities related to tourism like over flying the Eco-sensitive Zone area by
hot air balloon, helicopter, drones, Microlites, etc.
Regulated under applicable law 18.
Protection of Hill Slopes and river banks. Regulated under applicable laws. 19.
Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
20.
Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted under applicable laws for use of locals. 21.
Discharge of treated effluents in natural water bodies or land area. The discharge of treated effluent shall be regulated as per applicable laws.

5.  Monitoring Committee.— (1) In exercise of the powers conferred by sub-section (3) of section 3 of the 
   

Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, which shall comprise of, namely:- (i)
District Collector, Visakhapatnam —Chairman (ii)
One representative of Non Governmental Organisation
working in the field of environment to be nominated by
the Government of Andhra Pradesh for three years —Member (iii)
One expert in the area of ecology and environment to be
nominated by the Government of Andhra Pradesh for three years —Member
(iv) Member- Secretary/ Member of the State Biodiversity Board —Member (v)
Regional Officer, State Pollution Control Board, Medak —Member (vi) Senior Town Planner of the area/Chief Urban Planner/City Planner —Member (vii) Deputy Conservator of Forests (In Charge of the Sanctuary), Visakhapatnam —Member Secretary. (2) Terms of Reference.- (a) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (b) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to 22.
Commercial extraction of surface and ground water.
Regulated under applicable law.

Open Well, Bore Well etc. for agriculture or other usage. Regulated and the activity should be strictly monitored by the appropriate authority. 24.

the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (c) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (d) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (e)
The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (f) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure IV. (g) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F. Annexure I
Boundary description of Eco-Sensitive Zone: A to B: Starting from a point with co-ordinates N 17.879530 E 83.316650 E on the North East of Mindivanipalem Village. A line runs along the SH-38 and passes behind hillocks adjacent to Gambhiram Reservoir and touches the station ‘B’ with co ordinates N 17.87368 E 83.36599. The total distance from A to B station is 6.985 Kms. The Range of radius of the Eco-sensitive Zone is 200-780 metres on along the length. The proposed Eco-sensitive Zone distance is 200 metres surrounding the protected area excluding the present existing State and National highways road.
B to C:
The line runs along the NH-5 passing through Paradesipalem Village and along Sanctuary boundary upto station no ‘C’ with co-ordinates N 17.857000 E 83.366420. The total distance from B to C station is 1.854 Kms. The Range of radius of the Eco-sensitive Zone is 140-308 metres on along the length. The proposed Eco-sensitive Zone distance is 100 metres surrounding the protected area.
C to D:
The line runs South westerly direction behind Boravaniapalem Village and runs around the Devimetta and reaches at station ‘D’ with co-ordinates N17.833200 E 83.327710 near Sri Chaitanya Engineering College behind Kommadi Village. The total distance from C to D station is 5.469 Kms. The Range of

radius of the Eco-sensitive Zone is 100-690 metres on along the length. The proposed Eco-sensitive Zone distance is 100 metres surrounding the protected area.
D to E:
The line runs South Easterly direction runs through patta lands and vacant lands of Kommadi, Revallapalem villages which includes Police Training Centre and Baba Institute of Technology and Sciences and passes through Housing Board Colony and Private layouts with co-ordinates N 17.792580 E 83.355850. The total distance from D to E station is 5.121 Kms. The Range of radius of the Eco- sensitive Zone is 100-286 metres on along the length. The proposed distance is 100 metres surrounding the protected area.
E to F:
The line runs north along NH-5 Southerly and runs along the boundary of Seethakonda Reserve Forest which includes Indira Gandhi Zoological Park, Visakhapatnam and passes through outskirts of Endada Village at station ‘F’ with co-ordinates N 17.753520 E 83.352580. The total distance from E to F station is 6.335 Kms. The Range of radius of the Eco-sensitive Zone is 100-1360 mtrs on along the length. The proposed distance is 100 metres surrounding the protected area excluding the area of Reserve Forest.
F to G:
The line runs Westerly direction all along the Southern boundary of Seethakonda RF Ravindranagar, Aarilova Colonies and reaches at station ‘G’ at Mudasarlova Reservoir with co-ordinates N 17.766220 E 83.301010. The total distance from F to G station is 6.692 Kms. The Range of radius of the Eco- sensitive Zone is 127-1280 metres on along the length. The proposed distance is 300 mtrs surrounding the protected area.
G to H:
The line runs Westerly direction behind Pineapple colony and Darapalem and touches Pata Adavivaram Junction covering BRTS roads and touches station H with co-ordinates N 17.778810 E 83.255460. The total distance from G to H station is 3.375 Kms. The Range of radius of the Eco- sensitive Zone is 240-418 mtrs on along the length. The proposed distance is 300 mtrs surrounding the protected area.
H to I:
The line runs Northerly direction touching Yerrakonda RF boundary and runs along the Western boundary Kambalakonda Extn RF boundary which includes Dabbanda, Mannepalem, Gollalapalem, Malapalli, Appikondapalem Villages and touches Station I which is station no.1 of Kambalakonda Extn., RF with co-ordinates N 17.844620 E 83.271270. The total distance from H to I station is 8.513 Kms. The Range of radius of the Eco-sensitive Zone is 178-2386 metres on along the length. The mean distance is 200 metres surrounding the protected area excluding the area of Reserve Forest.
I to J:
The line runs Easterly direction along the Kambalakonda Extn RF boundary upto Station no.7 leaving Mamidilova Village behind and touches Station J at over head tank of Dibbameedipalem Village with co-ordinates N 17.850740 E 83.300300. The total distance from I to J station is 3.190 Kms. The Range of radius of the Eco-sensitive Zone is 604-2003 metres on along the length. The proposed distance is 300 metres surrounding the protected area excluding the area of Reserve Forest.
J to A:
The line runs Northerly direction almost all parallel to Kambalakonda Wildlife Sanctuary Boundary along the foothills reaches Station A with co-ordinates N 17.879530 E 83.316650. The total distance from J to A station is 3.80 Kms. The Range of radius of the Eco-sensitive Zone is 216-578 metres on along the length. The proposed distance is 300 metres surrounding the protected area.
