पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् (उदर्पुर वन्र्जीव अभर्यरण्र्, बिहयर) अबिसूचनय नई ददल्ली, 28 जून, 2017 कय.आ. 2030(अ).—भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अबिसूचनय सं. कय. आ. 3547 (अ), र्यरीख 30 ददसम्िर, 2015 द्वयरय उन सभी व्यबिर्ों से, बजनके उससे प्रभयबवर् होने की संभयवनय थी, उस र्यरीख से, बजसको उि अबिसूचनय से र्ुि रयजपत्र की प्रबर्र्यं जनर्य को, उपलब्ि करय दी गई थीं, सयठ ददन की अवबि के भीर्र आक्षेप और सुक्षयव आमंबत्रर् करर्े हुए एक प्रयरुप अबिसूचनय भयरर् के रयजपत्र, असयियरण में प्रकयबिर् की गई थी;

और, उि प्रयरुप अबिसूचनय के उत्तर में व्यबिर्ों और पणियररर्ों से टीकय-रटप्पणी आक्षेप और सुक्षयव प्रयप्त नहीं हुए थे; और, उदर्पुर वन्र्जीव अभर्यरण्र्, बिहयर के पबिम चम्पयरण ब़िलय में िेत्तइहय के अक्षयंि 26o 47’52.5” और 26o 48’47.1” उ. और देियंर्र 84o 24’24” और 84o 25’88” पू. के िीच बथथर् है और इस क्षेत्र कय बवथर्यर 887 हेक्टेर्र है ; और, इस अभर्यरण्र् के भयग में ऑक्सिॉ सयरयर्मन झील के वन और आर्द्ा भूबम 319 हेक्टेर्र और 3.19 वगा दकलोमीटर में फैली है, इसकी वनथपर्ीर् एवं जीवजंर्ु की पयररबथथबर्क प्रजयबर्र्यं महत्वपूणा है, चंर्द्यवर्, हरहय और गंडक नदी के र्टों के सयथ बमबिर् पणापयर्ी वन संकीणा फैले है और बिहयर रयज्र् में आर्द्ा भूबम के सयथ वन पयररबथथबर्क प्रणयली इस अभर्यरण्र् की झील और भू-दृश्र् एकमयत्र है और इस जगह में महत्वपूणा जल-वैज्ञयबनक आर्द्ा भूबम पयररबथथबर्क र्ंत्र के कयर्ा भी प्रदयन है ; और, उदर्पुर वन्र्जीव अभर्यरण्र् में बचत्तीदयर बहरण(रूसय थप), मुंजक(मुटींकस थप), पयढय(एबक्स पोदकनस), ब्लू िुल(िोसेलयफूस थ प), भयरर्ीर् खरगोि(लेपुस नीगरूबल् ल स), बसर्यर(केबन स ऑरर र्र्), लोमडी(वोलपेस वोलपेस), िनैलय सूअर(सूस थ कोफय), सयही(हयर्थ टबक्स),मॉनीटर बिपकली (वयरनस), अजगर(पयर्थन थप.), और िोंबिल(अनयसटूमुस), लयलसर(बनट्टय रूदफनय), गडवल (मयरेकय थरेपेरय),मबलन हंस(अरदेअ पुरपुरेअ), पक्षी की प्रजयबर्र्यं में से महत्वपूणा जंगली जीवजंर्ु है, पयढय, मुंजक और अजगर संकटयपन्न और असुरबक्षर् जीव है ;

THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, उदर्पुर वन्र्जीव अभर्यरण्र् के चयरों ओर के क्षेत्र को, बजसकय बवथर्यर और सीमयएं इस अबिसूचनय के पैरय 1 में बवबनर्दाष्ट हैं, पर्यावरण की दृबष्ट से पयररबथथबर्क संवेदी जोन के रूप में सुरबक्षर् और संरबक्षर् करनय र्थय उि पयररबथथबर्क संवेदी जोन में उद्योगों र्य उद्योगों के वगो के प्रचयलन र्थय प्रसंथकरण करने को प्रबर्बिद्ध करनय आवश्र्क है; अर्ः, अि, केन्र्द्ीर् सरकयर, पर्यावरण (संरक्षण) बनर्म, 1986 के बनर्म 5 के उपबनर्म (3) और पर्यावरण (संरक्षण) अबिबनर्म, 1986 (1986 कय 29) की ियरय 3 की उपियरय (2) के खंड (v) और खंड (xiv) और उपियरय (3) के सयथ परठर् और उपियरय (1) द्वयरय प्रदत्त िबिर्ों कय प्रर्ोग करर्े हुए, उदर्पुर वन् र्जीव अभर्यरण्र् पयररबथ थबर्क संवेदी जोन के रुप में (बजसे इसमें इसके पश् चयर् पयररबथ थबर्क संवेदी जोन कहय गर्य है) बिहयर रयज्र् के उदर्पुर वन्र्जीव अभर्यरण्र् की सीमय के 1 दकलोमीटर से 3.5 दकलोमीटर सीमय क्षेत्र को अबिसूबचर् करर्ी है, बजसकय बववरण बनम्नयनुसयर है, अथयार् :--

1. पयररबथथबर्क संवेदी जोन कय बवथर्यर और उसकी सीमयएं--(1) पयररबथथबर्क संवेदी जोन कय बवथर्यर उदर्पुर वन्र्जीव अभर्यरण्र् की सीमय 1 दकलोमीटर से 3.5 दकलोमीटर र्क है और पयररबथथबर्क संवेदी जोन कय क्षेत्र 3759.0 हेक्टेर्र है |
   (2) उदर्पुर वन्र्जीव अभर्यरण्र् के सीमयंकन के भू-बनदेियंक के सयथ पयररबथथबर्क संवेदी जोन कय मयनबच त्र उपयिंि I के रूप में उपयिद्ध है । (3) पयररबथथबर्क संवेदी जोन के भीर्र आने वयले ग्रयमों की सूची प्रमुख बिन्दुओं के बनदेियंक उपयिंि II के रुप में उपयिद्ध है ।
2. पयररबथथबर्क संवेदी जोन के बलए आंचबलक महयर्ोजनय –(1) रयज्र् सरकयर, पयररबथ थबर्क संवेदी जोन के प्रर्ोजन के बलए रयजपत्र में इस अबिसूचनय के अंबर्म प्रकयिन की र्यरीख से दो विा की अवबि के भीर्र, थथयनीर् व्यबिर्ों के परयमिा से, इस अबिसूचनय में संलग् न अनुिंिों के सयमंजथ र् से आंचबलक महयर्ोजनय र्ैर्यर करेगी । (2) आंचबलक महयर्ोजनय के द्वयरय र्ैर्यर दकए गए अबिसूचनय में उल्लेबखर् िर्ा के अनुरूप होंगे और पर्यावरणीर् प्रभयव भी ियबमल होंगे। (3) आचंबलक महयर्ोजनय रयज् र् सरकयर में सक्षम प्रयबिकयरी द्वयरय अनुमोददर् होगी ।
   (4) पयररबथ थबर्क संवेदी जोन के बलए आचंबलक महयर्ोजनय इस अबिसूचनय में बवबनर्दाष् ट रूप में ससी रीबर् से रयज् र् सरकयर र्थय सुसंगर् केंर्द्ीर् और रयज् र् बवबिर्ों के सयमंजथ र् में भी र्थय केंर्द्ीर् सरकयर द्वयरय जयरी मयगाबनदेि कय बसद्धयंर्, र्दद कोई हों, द्वयरय र्ैर्यर होगी । (5)
   आंचबलक महयर्ोजनय, पर्यावरणीर् और पयररबथथबर्क बवचयरों को समयकबलर् करने के बलए रयज् र् सरकयर के सभी संिद्ध बवभयगों के परयमिा से र्ैर्यर होगी, अथयार् :-- i. पर्यावरण ; ii. वन ;
   iii. नगर बवकयस ; iv. पर्ाटन ; v. नगरपयबलकय ; vi. रयजथ व ;
   vii. कृबि ; viii. पिुिन और मत्थर् संसयिन; और ix. बिहयर रयज् र् प्रदूिण बनर्ंत्रण िोडा।

आंचबलक महयर्ोजनय अनुमोददर् बवद्यमयन भू-उपर्ोग, अवसंरचनय और दिर्यकलयपों पर कोई बनिंिन अबिरोबपर् नहीं करेगी जि र्क दक इस अबिसूचनय में बवबनर्दाष् ट न हो और आचंबलक महयर्ोजनय सभी अवसंरचनय और दिर्यकलयपों में और अबिक दक्षर्य और पयररबथथबर्क अनुकूलर्य कय संविान करेगी ।
(7) आंचबलक महयर्ोजनय में अनयच्ियददर् क्षेत्रों के जीणोद्धयर, बवद्यमयन जल बनकयर्ों के संरक्षण, आवयह क्षेत्रों के प्रिंिन, जल-संभरों के प्रिंिन, भूर्ल जल के प्रिंिन, मृदय और नमी संरक्षण, थथयनीर् समुदयर्ों की आवश्र्कर्यओं र्थय पयररबथथबर्क और पर्यावरण से संिंबिर् ससे अन्र् पहलूओं, बजन पर ध्र्यन देनय आवश्र्क है, के बलए उपिंि होंगे । (8)
आंचबलक महयर्ोजनय सभी बवद्यमयन पूजय थ थलों, ग्रयमों और नगरीर् िंदोिथर्ों, वनों के प्रकयर और दकथ मों, कृबि क्षेत्रों, ऊपजयऊ भूबम, हररर् क्षेत्र जैसे उद्ययन और उसी प्रकयर के थ थयन, उद्ययन कृबि क्षेत्र, फलोउद्ययन, झीलों और अन्र् जल बनकयर्ों कय अभ्र्कंन करेगी और इस र्ोजनय के मयनबचत्र द्वयरय बवद्यमयन और प्रथर्यबवर् भूबम के उपर्ोग कय बववरण दकर्य जयएगय ।

II (ii) 3 (9)
आंचबलक महयर्ोजनय थ थयनीर् समुदयर्ों की जीवकोपयजान को सुबनबश् चर् करने के बलए, पयररबथथबर्क संवेदी जोन में बवकयस को पयररबथथबर्क अनुकूल बवकयस के बलए बवबनर्बमर् करेगी ।
(10) आंचबलक महयर्ोजनय इस अबिसूचनय में ददए गए उपिंिों के संिंि में अपने कयर्ों के ियहर ले जयने के बलए बनगरयनी सबमबर् के बलए एक संदभा दथर्यवेज र्ैर्यर करेगी ।

3. रयज्र् सरकयर द्वयरय दकए जयने वयले उपयर्- रयज्र् सरकयर इस अबिसूचनय के उपिंिों को प्रभयवी करने के बलए बनम्नबलबखर् उपयर् करेगी, अथयार् :-- (1) भू-उपर्ोग - पयररबथ थबर्क संवेदी जोन में वनों, उद्ययन-कृबि क्षेत्रों, कृबि क्षेत्रों, आमोद-प्रमोद के प्रर्ोजन के बलए बचबन्हर् दकए गए पयकों और खुले थथयनों कय वयबणबज्र्क और औद्योबगक संिद्ध बवकयस दिर्यकलयपों के बलए उपर्ोग र्य संपररवर्ान नहीं होगय :
   परंर्ु पयररबथथबर्क संवेदी जोन के भीर्र कृबि भूबम कय संपररवर्ान, मयनीटरी सबमबर् की बसफयररि पर और रयज्र् सरकयर के पूवा अनुमोदन से, थथयनीर् बनवयबसर्ों की आवयसीर् जरूरर्ों को पूरय करने के बलए और पैरय 4 की सयरणी के थर्ंभ (2) के अिीन मद सं0 20, 24, 32 और 37 के सयमने सूचीिद्ध दिर्यकलयपों को पूरय करने के बलए अनुज्ञयर् होंगे, अथयार् :-
   (i) िुबनर्यदी ढयंचों और नयगररक सुबवियओं कय संबनमयाण और नवीकरण; (ii) पयररबथथबर्क अनुकूल पर्ाटन दिर्यकलयपों के बलए पर्ाटकों के अथ थयर्ी आवयसन के बलए पयररबथथबर्क अनुकूल आरयमगयह जैसे टेंट, लकडी के मकयन आदद ; (iii) विया जल संचर्; और (iv) कुटीर उद्योग, बजसके अंर्गार् ग्रयमीण बिल्पकयर भी हैं :

परंर्ु र्ह और भी दक क्षेत्रीर् नगर र्ोजनय अबिबनर्म और अन्र् बनर्मों और बवबनर्मों के अंर्गार् रयज्र् सरकयर के पूवा अनुमोदन र्थय संबवियन के अनुच्िेद 244 और र्त्समर् प्रवृत्त बवबि के उपिंिों के अनुपयलन के बिनय, बजसके अंर्गार् अनुसूबचर् जनजयबर् और अन्र् परंपरयगर् वन बनवयसी (वन अबिकयरों की मयन्र्र्य) अबिबनर्म, 2006 (2007 कय 2) भी है, वयबणबज्र्क र्य उद्योग बवकयस दिर्यकलयपों के बलए जनजयर्ीर् भूबम कय उपर्ोग अनुज्ञयर् नहीं होगय:
परंर्ु र्ह और भी दक पयररबथ थबर्क संवेदी जोन के भीर्र भू-अबभलेखों में उपसंजयर् कोई त्रुरट, मयनीटरी सबमबर् के बवचयर प्रयप्त करने के पियर् रयज्र् सरकयर द्वयरय प्रत्र्ेक मयमले में एक ियर संिोबिर् होगी और उि त्रुरट के संिोिन की सूचनय केंर्द्ीर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् को देनी होगी ।
परंर्ु र्ह और भी दक उपर्ुाि त्रुरट कय संिोिन में इस उप पैरय के अिीन र्थय उपिंबिर् के बसवयर् दकसी भी दिय में भू-उपर्ोग कय पररवर्ान सबम्मबलर् नहीं होगय ।
परंर्ु र्ह और भी दक बजससे हररर् क्षेत्र में जैसे वन क्षेत्र, कृबि क्षेत्र आदद में कोई पयररणयबमक कटौर्ी नहीं होगी और अनप्रर्ुक् र् र्य अनुत् पयदक कृबि क्षेत्रों में पुन: वनीकरण करने के प्रर्यस दकए जयएंगे ।
(2) प्रयकृबर्क जल स्रोर् -- आचंबलक महयर्ोजनय में सभी प्रयकृबर्क जल स्रोर्ों की पहचयन की जयएगी और उनके संरक्षण और पुनरुद्भूर्करण के बलए र्ोजनय सबम् मबलर् होगी और रयज् र् सरकयर द्वयरय ससे क्षेत्रों पर र्य उनके बनकट बवकयस दिर्यकलयप प्रबर्बिद्ध करने के बलए ससी रीबर् से मयगाबनदेि र्ैर्यर दकए जयएंगे । (3) पयररबथथबर्क/पर्ाटन – (क) पयररबथथबर्क संवेदी जोन के भीर्र पर्ाटन संिंिी दिर्यकलयप पयररबथथबर्क पर्ाटन महयर्ोजनय के अनुसयर होंगे जो दक आंचबलक महयर्ोजनय के भयग रूप में होगी ।
(ख) पयररबथथबर्क पर्ाटन महयर्ोजनय पर्ाटन बवभयग, बिहयर सरकयर द्वयरय पर्यावरण और वन बवभयग के परयमिा से र्ैर्यर होगी ।
(ग) पर्ाटन महयर्ोजनय आंचबलक महयर्ोजनय के एक िटक के रूप में जयनय जयर्ेगय । (ि) पर्ाटन संिंिी दिर्यकलयप बनम् नबलबखर् के अिीन बवबनर्बमर् होंगे, अथयार् :- (i) पयररबथथबर्क अनुकूल पर्ाटन दिर्यकलयप से संिंबिर् पर्ाटकों के अथथयर्ी अबिभोग के बलए वयस सुबविय के बसवयर् संरबक्षर् क्षेत्र की सीमय से एक दकलोमीटर र्क र्य पयररबथथबर्क संवेदी जोन के बवथर्यर र्क इनमें जो भी बनकट है, नर्े वयबणबज्र्क होटल

और ररसोटा अनुज्ञयर् नहीं होंगे। परंर्ु, जहयाँ पयररबथथबर्क संवेदी जोन कय बवथर्यर एक दकलोमीटर से ज्र्यदय है वहयाँ, एक दकलोमीटर से परे और पयररबथथबर्क संवेदी जोन के बवथर्यर र्क सभी नए पर्ाटक दिर्यकलयप र्य बवद्यमयन दिर्यकलयप कय बवथर्यर पर्ाटन महयर्ोजनय के अनुसयर होगय; (ii) पयररबथथबर्क संवेदी जोन के भीर्र सभी नए पर्ाटन दिर्यकलयपों र्य बवद्यमयन पर्ाटन दिर्यकलयपों कय बवथर्यर केंर्द् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् के मयगादिाक बसद्धयंर्ों के द्वयरय र्थय रयष् रीर् ा र्यघ्र स संरक्षण प्रयबिकरण, द्वयरय जयरी पयररबथथबर्क पर्ाटन (समर्-समर् पर र्थय संिोबिर्) मयगादिाक बसद्धयंर्ों के अनुसयर, पयररबथथबर्क पर्ाटन, पयररबथथबर्क बिक्षय और पयररबथथबर्क बवकयस को महत्व देर्े हुए पयररबथथबर्क संवेदी जोन की वहन क्षमर्य के अध्र्र्न पर आियररर् होगय;

(iii) आंचबलक महयर्ोजनय कय अनुमोदन दकए जयने र्क, पर्ाटन के बलए बवकयस और बवद्यमयन पर्ाटन दिर्यकलयपों के बवथर्यर को वयथर्बवक थथल बवबनर्दाष्ट संवीक्षय र्थय मयनीटरी सबमबर् की बसफयररि पर आियररर् संिंबिर् बवबनर्यमक प्रयबिकरणों द्वयरय अनुज्ञयर् दकर्य होगय । (4) नैसर्गाक बवरयसर् -- पयररबथथबर्क संवेदी जोन में महत्वपूणा नैसर्गाक बवरयसर् के सभी थथलों जैसे सभी जीन कोि आरबक्षर् क्षेत्र, िैल बवरचनयएं, जल प्रपयर्ों, झरनों, ियटी मयगों, उपवनों, गुफयएं, थथलों, भ्रमण, अश्वरोहण, प्रपयर्ो आदद की पहचयन की जयएगी और उन्हें संरबक्षर् दकर्य जयएगय र्थय उनकी सुरक्षय और संरक्षय के बलए इस अबिसूचनय के प्रकयिन की र्यरीख से िह मयस के भीर्र, उपर्ुि र्ोजनय िनयएगी और ससी र्ोजनय आंचबलक महयर्ोजनय कय भयग होगय । (5) मयनव बनर्मार् बवरयसर् थ थलों - पयररबथ थबर्क संवेदी जोन में भवनों, संरचनयओं, बिल्प-र्थ्र्, सबर्हयबसक, कलयत्मक और सयंथकृबर्क महत्व के क्षेत्रों की पहचयन करनी होगी और इस अबिसूचनय के प्रकयिन की र्यरीख से िह मयह के भीर्र उनके संरक्षण की र्ोजनयएं र्ैर्यर करनी होगी र्थय आंचबलक महयर्ोजनय में सबम्मबलर् की जयएगी ।
(6) ध् वबन प्रदूिण – पयररबथथबर्क संवेदी जोन में ध् वबन प्रदूिण के बनर्ंत्रण के बलए रयज् र् सरकयर कय पर्यावरण बवभयग र्य रयज् र् प्रदूिण बनर्ंत्रण िोडा ध्वबन प्रदूिण (बवबनर्मन और बनर्ंत्रण) बनर्मों के अनुसयर पर्यावरणीर् (संरक्षण) अबिबनर्म, 1986, 2000 अंर्गार् र्ैर्यर करेगय ।
(7) वयर्ु प्रदूिण - पयररबथथबर्क संवेदी जोन में, वयर्ु प्रदूिण के बनर्ंत्रण के बलए रयज्र् सरकयर कय पर्यावरण बवभयग र्य रयज् र् प्रदूिण बनर्ंत्रण िोडा वयर्ु (प्रदूिण बनवयरण और बनर्ंत्रण) अबिबनर्म, 1981 (1981 कय 14) और उसके अिीन िनयए गए बनर्मों के उपिंिों के अनुसयर में मयगादिाक बसद्धयंर् और बवबनर्म र्ैर्यर करेगय ।
(8) िबहस्रयव कय बनथसयरण - पयररबथथबर्क संवेदी जोन में उपचयररर् िबहस्रयव कय बनथसयरण सयमयन्र् मयनकों के बलए पर्यावरणीर् प्रदूबिर् आच्ियददर् के बनथसयरण के अंर्गार् पर्यावरणीर् (संरक्षण) अबिबनर्म, 1986 और उसके अिीन िनयए गए बनर्मों के उपिंिों के अनुसयर होगय । (9) ठोस अपबिष्ट -- ठोस अपबिष्टों कय बनपटयन बनम्नबलबखर् रूप में होगय-- (i) पयररबथथबर्क संवेदी जोन में उपचयररर् िबहस्रयव कय बनथसयरण, समर्-समर् पर संिोबिर् ठोस अपबिष् ट प्रिंिन बनर्म, 2016, जो भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की अबिसूचनय सं. कय.आ. 1357(अ) र्यरीख 8 अप्रैल, 2016 द्वयरय प्रकयबिर् दकए गए थे, के उपिंिों के अनुसयर दकर्य जयएगय ;
(ii) अकयिाबनक सयमग्री कय बनपटयन पयररबथथबर्क संवेदी जोन के ियहर पहचयन दकए गए थ थल पर दकसी पर्यावरणीर् थवीकृर् रीबर् में होगय और पयररबथथबर्क संवेदी जोन में ठोस अपबिष् टों को जलयनय र्य भष् मीकरण अनुज्ञयर् नहीं होगय।
(iii) थथयनीर् प्रयबिकरण जैव बनम्नीकरणीर् और अजैव बनम्नीकरणीर् संिटकों में ठोस अपबिष्टों के संपृथक्कन के बलए र्ोजनयएं र्ैर्यर करेंगे ;
(10) जैव बचदकत् सीर् अपबिष् ट- पयररबथथबर्क संवेदी जोन में जैव बचदकत्सीर् अपबिष्टों कय बनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थयसंिोबिर् अबिसूचनय सं.कय.बन 343 (अ), र्यरीख 28 मयचा, 2016 द्वयरय प्रकयबिर् जैव बचदकत्सीर् अपबिष्ट प्रिंि बनर्म, 2016 के उपिंिों के अनुसयर दकर्य जयएगय । (i) पयररबथथबर्क संवेदी जोन में कोई सयमयन्र् उपचयर सुबविय र्य जलयर्य जयनय अनुज्ञयर् नहीं दकर्य जयएगय ।

II (ii) 5 (ii) पयररबथथबर्क संवेदी जोन के अंर्गार् पहले से ही बवद्यमयन व्यबिगर् अथपर्यलों र्य बनजी थवयथथ्र् केंर्द्ों को संरबक्षर् क्षेत्र पर प्रबर्कूल प्रभयव से िचने के बलए पर्याप्त उपचयर प्रणयली प्रदयन करनी चयबहए।

(11) प्लयबथटक अपबिष्ट प्रिंिन: - पयररबथथबर्क संवेदी जोन में प्लयबथटक अपबिष्ट प्रिंि कय बनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थयसंिोबिर् अबिसूचनय सं.कय.बन 340(अ), र्यरीख 18 मयचा, 2016 द्वयरय प्रकयबिर् प्लयबथटक अपबिष्ट प्रिंि बनर्म 2016 के उपिंिों के अनुसयर दकर्य जयएगय। (12) बनमयाण और बवध्वंस अपबिष्ट प्रिंिन: - पयररबथथबर्क संवेदी जोन में संबनमयाण और बवध्वंस अपबिष्ट प्रिंि कय बनपटयन भयरर् सरकयर के पर्यावरण, वन और जलवयर्ु पररवर्ान मंत्रयलर् की समर्-समर् पर र्थयसंिोबिर् अबिसूचनय सं.कय.बन 317(अ), र्यरीख 29 मयचा, 2016 द्वयरय प्रकयबिर् संबनमयाण और बवध्वंस प्रिंि बनर्म, 2016 के उपिंिों के अनुसयर दकर्य जयएगय । (13) र्यनीर् र्यर्यर्यर्- पररवहन की र्यनीर् गबर्बवबिर्यं आवयस के अनुकूल बवबनर्बमर् होंगी और इस संिंि में आंचबलक महयर्ोजनय में बविेि उपिंि अबिकबथर् दकए जयएंगे और आंचबलक महयर्ोजनय के र्ैर्यर होने और रयज् र् सरकयर के सक्षम प्रयबिकयरी के द्वयरय अनुमोददर् होने र्क, मयनीटरी सबमबर् प्रवृत्त बनर्मों और बवबनर्मों के अनुसयर र्यनीर् गबर्बवबिर्ों के अनुपयलन को मयनीटर करेगी । (14). अगर र्ह आवश्र्क समझर्य है, इस अबिसूचनय के प्रयवियनों को प्रभयवी करने में केन्र्द् सरकयर और रयज्र् सरकयर, अन्र् उपयर्ों बनर्दाष्ट करेगय।

4. पयररबथथबर्क संवेदी जोन में प्रबर्बिद्ध और बवबनर्बमर् दकए जयने वयले दिर्यकलयपों की सूची - पयररबथथबर्क संवेदी जोन में सभी दिर्यकलयप पर्यावरण (संरक्षण) अबिबनर्म, 1986 (1986 कय 29) के उपिंिों द्वयरय ियबसर् होंगे और नीचे दी गई र्यबलकय में बवबनर्दाष्ट रीबर् में बवबनर्बमर् होंगे, अथयार् :-- सयरणी िम सं. दिर्यकलयप टीकय-रटप्पणी (1) (2) (3) प्रबर्बिद्ध दिर्यकलयप

वयबणबज्र्क खनन, पत्थर उत्खनन, ईंट-भट्ठय, बमट्टी खुदयई, रेर् खनन और उनको र्ोडने की इकयइर्यं । (क) सभी प्रकयर के नए और बवद्यमयन खनन (लिु और वृहर् खबनज), पत्थर उत्खनन और उनको र्ोडने की इकयइर्यं वयथर्बवक थथयनीर् बनवयबसर्ों की िरेलू आवश्र्कर्यओं के बसवयर् नहीं होंगी ; (ख) खनन संदिर्यएं, मयननीर् उच्चर्म न्र्यर्यलर् की ररट र्यबचकय (बसबवल) सं. 1995 कय 202 टी.एन. गौडयिमान बथरुमूलपयद िनयम भयरर् सरकयर के मयमले में आदेि र्यरीख 4 अगथर्, 2006 और ररट र्यबचकय (सी) सं. 2012 कय 435 गोवय फयउंडेिन िनयम भयरर् सरकयर के मयमले में र्यरीख 21 अप्रैल, 2014 के अंर्ररम आदेि के अनुसरण में सवादय प्रचयलन होगय ।

उद्योगों पर आधाररत आरा मीलों, अनु काष्ठों पर परत चढाने वाली मीलों की स्थापना। पाररस्स्थततक संवेदी जोन के भीतर नई और ववद्यमान आरा मशीनों का ववस् तार अनुञातात नं ीं ं ोगा ।
3.
जल या वायु या मृदा या ध् वतन ्रददषण
काररत करने वाले उद्योगों की स् थापना । (क) ककसी भी नए या पाररस्स्थततक संवेदी जोन में ्रददषण
फैलाने वाले उद्योगों के ववस्तार की अनुमतत नं ीं दी जाएगी । (ख) ं ररत या श्वेत कृवण आधाररत लघु उद्योगों सहं त केन्द्रीय ्रददषण तनयंत्र बोर्ड वगीकर के रूप में वगीकृत उद्योगों को तनयमों के अनुसार ववतनयममत ककया जाएगा।

जलावन लकडी का वाण स्ययक उपयोग । लागष ववधधयों के अनुसार ्रदततवणद्ध (अन्द् यथा उपबंधधत के मसवाय) ं ोंगे । 5.
नए बृं त जल ववद्युत पररयोजना और मसंचाई पररयोजना की स् थापना । लागष ववधधयों के अनुसार ्रदततवणद्ध (अन्द् यथा उपबंधधत के मसवाय) ं ोंगे । 6.
प्लास्स्िक के थैलों का उपयोग। लागष ववधधयों के अनुसार ्रदततवणद्ध (अन्द् यथा उपबंधधत के मसवाय) ं ोंगे । 7.
्रदाकृततक जल तनकायों या सतं ी क्षेत्र में अनुपचाररत बहं स्रावड और ठोस अपमशष्िों का तनस्तार । लागष ववधधयों के अनुसार ्रदततवणद्ध (अन्द् यथा उपबंधधत के मसवाय) ं ोंगे । 8.
खतरनाक पदाथों का उपयोग या
उत्पादन । लागष ववधधयों के अनुसार ्रदततवणद्ध (अन्द् यथा उपबंधधत के मसवाय) ं ोंगे । विनियमित क्रियाकलाप 9.

वृक्षों की किाई । (क) रायय सरकार में सक्षम ्रदाधधकारी की पषवड अनुमतत के बबना वन, सरकारी या राजस्व या तनजी भषमम पर या वनों में ककंं ी वृक्षों की किाई नं ीं ं ोगी । (ख) वृक्षों की किाई संबंधधत केंरीय या रायय अधधतनयम या उसके अधीन बनाए गए तनयमों के उपबंध के अनुसार ववतनयममत ं ोगी ।

वाण स्ययक जल संसाधन स्जसके अंतगडत भष-जल संचयन भी ं ै । (क) भषमम के अधधभोगी के वास्तववक कृवण और घरेलष खपत के मलए जल का तनष्कणड सतं ी और भषममगत जल अनुञातात ं ोगा ।
(ख) औद्योधगक, वाण स्ययक उपयोग के मलए सतं ी और भषममगत जल का तनष्कणड के मलए संबंधधत ववतनयामक ्रदाधधकर पषवड मलणखत अनुञाता अपेक्षक्षत ं ोगी स्जसके अंतगडत ककतने परर ाम में वं तनष्कणड करेगा, भी ं ै ।
(ग) सतं ी या भषजल का ववक्रय अनुञातात नं ीं ं ोगा ।
(घ) जल के संदषण या ्रददषण , स्जसके अंतगडत कृवण भी ं ै, को रोकने के मलए सभी उपाय ककए जाएंगे ।

कृवण ्रद ाली में ्रदबल बदलाव। लागष ववधधयों के अधीन ववतनयममत ं ोंगे । 12.
ववद्युत केबलों, दषरसंचार िावरों का पररतनमाड और केबल बबछाना और अन्द्य बुतनयादी ढांचे । लागष ववधधयों के अधीन ववतनयममत ं ोंगे । भषममगत केबल को बढावा हदया जाएगा। 13.
ं ोिलों और लॉज के ववद्यमान पररसरों में बार् लगाना । 14.
ववद्यमान सडकों को चौडा करना और उन्द्ं ें सुदृढ करना तथा नई सडकों का संतनमाड । उधचत पयाडवर समाघात तनधाडर और न्द् यषनीकर उपाय यथा लागष अनुसार ं ोंगे । 15.
राबत्र में यातनक यातायात का संचलन । लागष ववधधयों के अधीन वाण स्ययक ्रदयोजन के मलए ववतनयममत ं ोंगे । 16.
ववदेशी ्रदजाततयों को लाना ।

उद्योग । पाररस्स् थततक संवेदी जोन से गैर ्रददषण , गैर पररसंकिमय, लघु और सेवा उद्योग, कृवण उद्यान, कृवण या कृवण आधाररत देशीय माल से औद्योधगक उत्पादों का उत्पादन उद्योग और जो पयाडवर पर कोई ववपरीत ्रदभाव नं ीं र्ालते ं ैं, अनुञातात ककए जाएंगे ।
21.
वन उत्पादों और गैर काष्ठ वन उत्पादों का संग्रं । 22.
सुरक्षा बलों के कैम्प । 23.
नए काष्ठ आधाररत उद्योग । पाररस्स् थततक संवेदी जोन की सीमाओं के भीतर नए काष् ठ आधारर त उद्योग की स् थापना को अनुञातात नं ीं कक या जाएगा:

परंतु पाररस्स् थततक संवेदी जोन में नए काष् ठ आधाररत उद्योग स्थावपत ककए जाएंगे स्जसमें 100 ्रदततशत आयाततत काष् ठ का उपभोग ं ोगा । 24.
पाररस्स्थततक अनुकषल पयडिन कक्रयाकलापों के मलए पयडिकों के अस् थायी आवासन के मलए पाररस्स्थततक अनुकषल आरामगां
जैसे िेंि, लकडी के मकान आहद
25.
नहदयों और ्रदाकृततक जल तनकायों में मत्स्य ग्रं । 26. ं ोिल और ररसोिड का वाण स्ययक
स्थापन । (क) संरक्षक्षत क्षेत्र या पाररस्स्थततक संवेदी जोन जो भी तनकि ं ो की सीमा से एक ककलोमीिर के भीतर ककसी भी ्रदकार का वाण स्ययक संतनमाड अनुञातात नं ीं ककया जाएगा:

परंतु स्थानीय व्यस्ततयों को उनके आवासीय उपयोग के मलए उनकी भषमम में संतनमाड स्जसके अंतगडत आंचमलक मं ायोजना के अनुसार पैरा 6 के उपपैरा (1) में सषचीबद्ध कक्रयाकलाप भी ं ैं, को करने के मलए अनुञातात ककया जाएगा ।

परन्द्तु यं और कक ऐसे लघु उद्योगों जो ्रददषण
उत् पन्द् न नं ीं करते ं ैं, से संबंधधत संतनमाड कक्रयाकलाप ववतनयममत ककए जाएंगे और लागष तनयमों और ववतनयमों, यहद कोई ं ों, के अनुसार सक्षम ्रदाधधकारी की पषवड अनुमतत से ं ी न्द् यषनतम पर रखे जाएंगे ।
(ख) एक ककलोमीिर से आगे आंचमलक मं ायोजना की

अनुसार ववतनयममत ं ोंगे । 27. पयडिन से संबंधधत कक्रयाकलाप जैसे गमड वायु गुब्बारों आहद द्वारा राष्रीय उद्यान क्षेत्र के ऊपर से उडना जैसे कक्रयाकलाप करना। 28. ठोस अपमशष्ि ्रदबंधन । 29. पाररस्स् थततक-पयडिन कक्रयाकलाप । 30. संतनमाड कक्रयाकलाप । (क) संरक्षक्षत क्षेत्र या पाररस्स्थततक संवेदी जोन जो भी तनकि ं ो, की सीमा से एक ककलोमीिर के भीतर ककसी भी ्रदकार का वाण स्ययक संतनमाड अनुञातात नं ीं ककया जाएगा:

परंतु स् थानीय लोगों को पैरा 6 के उप पैरा (1) में सषचीबद्ध कक्रयाकलापों सहं त उनके आवासीय उपयोग के मलए उनकी भषमम में संतनमाड करने की अनुमतत भवन उपववधधयों के अनुसार दी जाएगी । (i) ववद्यमान सडकों को चौडा करना और उन्द्ं ें सुदृढ करना तथा नई सडकों का संतनमाड ; (ii) बुतनयादी ढांचों और नागररक सुववधाओं का संतनमाड
और नवीकर ; (iii) केंरीय ्रददषण तनयंत्र बोर्ड द्वारा जारी हदशातनदेशों में फरवरी, 2016 के भीतर मसफड गैर- ्रददषवणत उद्योगों की स्थापना के वगीकर ; (iv) कुिीर उद्योगों स्जसके अंतगडत ग्रामी उद्योग ं ैं; सुववधाजनक भण्र्ार और स्थानीय सुख सुववधाओं जो पाररस्स्थततक पयडिन स्जस में सं ायक ं ो ग्रं वास; और
(v) इस अधधसषचना में संवधधडत कक्रयाकलापों की सषची : परन्द्तु यं और कक ऐसे लघु उद्योगों जो ्रददषण उत् पन्द् न नं ीं करते ं ैं, से संबंधधत संतनमाड कक्रयाकलाप ववतनयममत ककए जाएंगे और लागष तनयमों और ववतनयमों, यहद कोई ं ों, के अनुसार सक्षम ्रदाधधकारी की पषवड अनुमतत से ं ी न्द् यषनतम पर रखे जाएंगे ।
(ख) एक ककलोमीिर से आगे आंचमलक मं ायोजना की अनुसार ववतनयममत ं ोंगे । संिर्धित क्रियाकलाप 31. स्थानीय समुदायों द्वारा चल रं ी कृवण और बागवानी ्रदथाओं के साथ पशुपालन, पशुपालन कृवण और मछली पालन । लागष ववधधयों के अधीन अनुञातात ं ोंगे । 32. वणाड जल संचयन । सकक्र य रूप से बढावा हदया जाएगा । 33. जैववक खेती।
34. सभी गततववधधयों के मलए ं ररत ्रदौद्योधगकी को ग्रं करना ।

5. पारिस्थिनतक संिेदी जोि िािीटिी समिनत- (1) केंरीय सरकार, पाररस्स्थततक संवेदी जोन के ्रदभावी मानीिरी के मलए एक मानीिरी सममतत का गठन करेगी जो तनम्नमलणखत से ममलकर बनेगी, अथाडत् :- (क)
   आयुतत, ततरं ि, राजस्व खंर्, मुजफ्फरपुर -अध्यक्ष; (ख)

राजस्व ववभाग का एक ्रदतततनधध, बबं ार सरकार
-सदस्य; (ग)
जल संसाधन ववभाग का एक ्रदतततनधध, बबं ार सरकार
-सदस्य; (घ)
क्षेत्रीय अधधकारी, बबं ार रायय ्रददषण तनयंत्र बोर्ड, पिना -सदस्य; (ङ)
पयाडवर के क्षेत्र में कायड करने वाले गैर सरकारी संगठनों (स्जसके अंतगडत ववरासत संरक्ष भी ं ै) का ्रदत्येक मामले में तीन वणड की अवधध के मलए बबं ार रायय सरकार द्वारा नामतनहदडष्ि एक ्रदतततनधध -सदस्य; (च)

निदेश निबंधि - (1) सममतत का कायडकाल तीन वणड की अवधध के मलए ककया जाएगा। (2) पाररस्स्थततक संवेदी जोन सममतत इस अधधसषचना के उपबंधों के अनुपालन को मानीिर करेगी । (3) पाररस्स्थततक संवेदी जोन में भारत सरकार के तत् कालीन पयाडवर और वन मंत्रालय की अधधसषचना सं. का.आ. 1533(अ) तारीख 14 मसतंबर, 2006 की अनुसषची में के अधीन सस्म्ममलत कक्रयाकलापों और इस अधधसषचना के पैरा 4 के अधीन ्रदततवणद्ध गततववधधयों के मसवाय आने वाले ऐसे कक्रयाकलापों की दशा में वास्तववक ववतनहदडष्ि स्थलीय दशाओं पर आधाररत मानीिरी सममतत द्वारा संवीक्षा की जाएगी और उतत अधधसषचना के उपबंधों के अधीन पषवड पयाडवर तनकासी के मलए केन्द्रीय सरकार के पयाडवर , वन और जलवायु पररवतडन मंत्रालय को तनहदडष्ि की जाएगी ।
(4) इस अधधसषचना के पैरा 4 के अधीन यथा ववतनहदडष्ि ्रदततवणद्ध कक्रयाकलापों के मसवाय, भारत सरकार के तत् कालीन पयाडवर और वन मंत्रालय की अधधसषचना संखयांक का.आ. 1533(अ) तारीख 14 मसतंबर, 2006 की अधधसषचना के अनुसषची के अधीन ऐसे कक्रयाकलापों, स्जन्द्ं ें सस्म्ममलत नं ीं ककया गया ं ै, परंतु पाररस्स्थततक संवेदी जोन

में आते ं ैं, ऐसे कक्रयाकलापों की वास्तववक ववतनहदडष्ि स्थलीय दशाओं पर आधाररत मानीिरी सममतत द्वारा संवीक्षा की जाएगी और उसे संबद्ध ववतनयामक ्रदाधधकर ों को तनहदडष्ि ककया जाएगा ।
(5) मानीिरी सममतत का सदस्य-सधचव या संबद्ध कलतिर या संरक्षक्षत क्षेत्र का ्रदभारी ऐसे व्यस्तत के ववरूद्ध, जो इस अधधसषचना के ककसी उपबंध का उल्लंघन करता ं ै, पयाडवर (संरक्ष ) अधधतनयम, 1986 की धारा 19 के अधीन पररवाद फाइल करने के मलए सक्षम ं ोगा । (6) मानीिरी सममतत मुद्दों के आधार पर अपेक्षाओं पर तनभडर रं ते ं ुए संबद्ध ववभागों के ्रदतततनधधयों या ववशेणञातों, औद्योधगक संगमों या संबद्ध प धाररयों के ्रदतततनधधयों को अपने ववचार-ववमशड में सं ायता के मलए आमंबत्रत कर सकेगी । (7) मानीिरी सममतत ्रदत्येक वणड की 31 माचड तक की अपनी वावणडक कारडवाई ररपोिड रायय के मुखय वन्द्यजीव वार्डन को उपाबंध III में उपबंधधत रूप ववधान के अनुसार उत त वणड के 00 जषन तक ्रदस्तुत करेगी । (8) केन्द्रीय सरकार का पयाडवर , वन और जलवायु पररवतडन मंत्रालय मानीिरी सममतत को अपने कृत्यों के ्रदभावी तनवडं न के मलए समय-समय पर ऐसे तनदेश दे सकेगा, जो वं ठीक समझे । 6.
इस अधधसषचना के उपबंधों को ्रदभाव देने के मलए केंरीय सरकार और राय य सरकार अततररत त उपाय, यहद कोई ं ों, ववतनहदडष् ि कर सकेंगे ।

II (ii) 15 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE (Udaipur Wildlife Sanctuary, Bihar) NOTIFICATION New Delhi, 28th JUNE, 2017 S.O. 2030(E).— WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 3547(E), dated the 30th December, 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, no comments or objections and suggestions were received from persons and stakeholders in response to the draft notification; AND WHEREAS, the Udaipur Wildlife Sanctuary, Bettiah lies between Latitudes 26°47’52.5” N and 26°48’47.1” N and Longitude 84°24’24”E and 84°25’88” E in the West Champaran District of Bihar and extends over an area of 887 hectares; AND WHEREAS, the forests and the wetland ox-bow Sarayaman Lake spread in 319 hectares or 3.19 square kilometres part of this sanctuary have ecologically important species of flora and fauna, with narrow stretch of mixed deciduous forest along the banks of the river Chandrawat, river Harha and Gandak feed the lake and the landscape of this sanctuary is unique wetland with forests eco-system in the State of Bihar and the same also provided significant hydrological wetland eco-system functions in this locality; AND WHEREAS, the Spotted deer (Rusa sp.), Barking deer (Muntiacus sp.), Hog deer (Axis porcinus), Blue bull (Boselaphus sp.), Indian Hare (Lepus nigrollis), Jackal (Canis aureus), Fox (Vulpes vulpes), Wild boar (Sus scrofa), Porcupine (Hystrix indica), Monitor Lizard (Varanus), Python (Python sp.), and Open billed Stork (Anastomus), Red crested Pochard (Netta rufina), Gadwal (Mareca strepera), Purple Heron (Ardea purpurea) among bird species are the wild fauna of importance in Udaipur Wildlife Sanctuary, with Hog deer, Barking deer and Python being endangered or vulnerable. AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of the Udaipur Wildlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; Now, therefore, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from one kilometre to3.5 kilometre from the boundary of the Udaipur Wildlife Sanctuary in the State of Bihar as the Udaipur Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone), details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone.-(1)The extent of Eco-sensitive Zone varies from 1 kilometre to 3.5 kilometres from the boundary of the Udaipur Wildlife Sanctuary and the area of Eco- sensitive Zone is 3759.0 hectare. (2) The map of Udaipur Wildlife Sanctuary demarcating the Eco-sensitive Zone along with the geo co-ordinates are appended as Annexure I.
(3) The list of villages falling within Eco-sensitive Zone along with geo coordinates of the prominent points is appended as Annexure II. 2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final

notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The Zonal Master Plan so prepared shall commensurate with the stipulation specified in the Notification and include the environmental implications. (3) The Zonal Master Plan shall be approved by the Competent Authority in the State Government. (4) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (5) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment; (ii) Forest; (iii) Urban Development; (iv) Tourism; (v) Municipal; (vi) Revenue; (vii) Agriculture; (viii) Livestock and Fishery Resources; and (ix) Bihar State Pollution Control Board (6)
The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(7) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(8) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes, wetlands and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features.

(9) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and shall follow prohibited, regulated and promoted activities specified in the Notification so as to ensure Eco-friendly development for livelihood security of local communities. (10) The Zonal Master Plan shall be a reference document for the Monitoring Committee for carrying out its functions with respect to the provisions given in this notification. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Landuse.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the

II (ii) 17 residential needs of local residents, and for the activities listed at item numbers 20, 24, 32 and 37 in column (2) of the Table in paragraph 4, namely:- (i)
Small scale industries not causing pollution; (ii)
Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for Eco-friendly tourism activities; (iii) Rainwater harvesting; and (iv)
Cottage industries including village artisans: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural Springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the catchment management plan shall be drawn up by the State Government in such a manner as to prohibit or restrict the development activities within the catchment areas. (3) Eco-Tourism.-(a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Eco-Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Eco-Tourism Master Plan shall be prepared by the Department of Tourism, Government of Bihar in consultation with Department of Revenue and Forests, Government of Bihar.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities relating to tourism shall be regulated as under, namely.-
(i) the new construction of hotels and resorts shall not be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer: Provided that, beyond the distance of 1 km from the boundary of the Wildlife Sanctuary till the extent of the Eco-Sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Bihar State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986. (7) Air pollution.- Regulations for the control of air pollution in the Eco-Sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder shall be complied with. (8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under Environmental (Protection) Act, 1986 and rules made therein. – (9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco- sensitive Zone; (iii) the burning or incineration of solid wastes and establishment of landfills shall not be permitted in the Eco-sensitive Zone. (10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016, as amended from time to time. (i) the common treatment facility or incineration shall not be permitted within the Eco Sensitive Zone; (ii) Individual hospitals or private health centres already existing within the Eco Sensitive Zone should provide adequate treatment system to avoid adverse impact on the Protected Area. (11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 340 (E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 317(E), dated the 29th March, 2016, as amended from time to time. (13) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (14) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification. 4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the Table below, namely:-

Setting up of industries causing water or air or soil or noise pollution. (a) No new or expansion of polluting industries in the Eco-sensitive zone shall be permitted. (b) Industries categorized as Green or White in the Central Pollution Control Board Classification including agro-based small scale industries will be regulated as per regulations. No Red category of industries shall be allowed within the Eco Sensitive Zone. 4.

Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws. 5.

Establishment of new major hydroelectric projects. Prohibited (except as otherwise provided) as per applicable laws. 6. Uses of plastic carry bags.

Prohibited (except as otherwise provided) as per applicable laws. 7.

Discharge of untreated effluents and solid waste in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws. 8.

Felling of trees. (a) There shall be no felling of trees on the forest land or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under. 10.

Commercial water resources including ground water harvesting. (a)The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land. (b) The extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted shall require prior written permission from the concerned Regulatory Authority. (c) No sale of surface water or ground water shall be permitted. (d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture. 11.

(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.

Construction activities

(a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws to meet the residential needs of the local residents such as: (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including home stays; and (v) promoted activities listed in this Notification: Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan. Promoted Activities 31.

Eco-sensitive Zone Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:- (a) the Commissioner of Tirhut, Revenue Division, Muzaffarpur

• Chairman; (b) a representative of Department of Revenue, Government of Bihar
• Member; (c) a representative of Department of Water Resource, Government of Bihar
• Member; (d) Regional Officer, Bihar State Pollution Control Board, Patna
  -Member;
  (e) a representative of Non-governmental Organizations working in the field of
  environment (including heritage conservation) to be nominated by the Government of Bihar for a term of three years – Member; (f) a representative of Department of Livestock and Fishery Resources,
  Government of Bihar
  – Member; (g) District Magistrate, West Champaran – Member;

(h) One expert in the area of ecology and environment to be nominated by the
Government of Bihar, and - Member;
(i) Member-Secretary or Member, Bihar State Biodiversity Board - Member; (j) Divisional Forest Officer or Valmiki Tiger Project, Division-I - Member Secretary. Terms of Reference: (1) The tenure of the Monitoring Committee shall be for a period of three years from the date of issue of notification. (2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification. (6)
The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State per proforma appended at Annexure III. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 6.
