पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय अिधसूचना नई ᳰद᭨ली, 30 ᳰदस᭥ बर, 2015 का. आ. 3547(अ)-- िन᳜िलिखत ᮧाᱨप अिधसूचना, िजसे के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पᳯठत उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, जारी करने का ᮧ᭭ताव करती है, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) कᳱ अपेᭃानुसार, जनसाधारण कᳱ जानकारी के िलए ᮧकािशत कᳱ जाती है, िजनके उससे ᮧभािवत होने कᳱ संभावना है ; और यह सूचना दी जाती है ᳰक उᲦ ᮧाᱨप अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना वाले भारत के राजपᮢ कᳱ ᮧितयां जनसाधारण को उपल᭣ध करा दी जाती हᱹ, साठ ᳰदन कᳱ अविध कᳱ समाि᳙ पर या उसके प᭫ चात् िवचार ᳰकया जाएगा ; ऐसा कोई ᳞िᲦ, जो ᮧाᱨप अिधसूचना मᱶ अंतᳶव᳥ ᮧ᭭तावᲂ के संबंध मᱶ कोई आᭃेप या सुझाव देने मᱶ िहतब᳍ है, इस ᮧकार िविन᳸द᳥ अविध के भीतर, के᭠ᮤीय सरकार ᳇ारा िवचार ᳰकए जाने के िलए, आᭃेप या सुझाव सिचव, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय, इंᳰदरा पयाᭅवरण भवन, जोर बाग रोड, अलीगंज, नई ᳰद᭨ली-110003 या ई-मेल पते: esz-mef@nic.in पर िलिखत ᱨप मᱶ भेज सकेगा ।
ᮧाᱨप अिधसूचना उदयपुर व᭠यजीव अभयार᭛य, िबहार के पि᳟म च᭥पारण िज़ला मᱶ बेᱫइहा के उᱫरी अᭃांश 26o 47’52.5” और 26o 48’47.1” उ. और पूवᱮ देशांतर 84o 24’24” और 84o 25’88” पू. के बीच ि᭭थत है और इस ᭃेᮢ का िव᭭तार 887 हे᭍टेयर है । और, वन और आᮤᭅ भूिम आँ᭍सबॉ सारायमन झील इस अभयार᭛य के 319 हे᭍टेयर और 3.19 वगᭅ ᳰक.मी. के भाग मᱶ फेला है, िजसमे पाᳯरि᭭थितकᳱय महᱬव कᳱ वन᭭पतीय एवं जीवजंतु ᮧजाितयां के साथ चंᮤावत, नदी के तटᲂ के साथ फैले िमि᮰त पणᭅपाती वन कᳱ संकᳱणᭅ कतार कᳱ है, हरहा और गंडक नᳰदया झील का भरण करती है और िबहार रा᭔य मᱶ इस अभयार᭛य कᳱ आᮤᭅ भूिम के साथ वन
पाᳯरि᭭थितकᳱ ᮧणाली अनूठी है जो इस जगह मᱶ मह᭜वपूणᭅ जल-वै᭄ािनक आᮤᭅ भूिम पाᳯरि᭭थितकᳱ तंᮢ कायᭅ भी ᮧदान करती है ।

THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, उदयपुर व᭠यजीव अभयार᭛य मᱶ चीतल, मुंजक, पाढ़ा, नील गाय, भारतीय खरगोश, सीयार, लोमड़ी, बनैला सूअर, साही, गोह, अजगर और धᲂिघल, लालसर, मिलन हंस, नीललोिहत बगुला मह᭜वपूणᭅ जंगली जीवजंतु मᱶ से पᭃी कᳱ ᮧजाितयां है, पाढ़ा, मुंजक और अजगर संकटाप᳖ और असुरिᭃत जीव है ।
और, उदयपुर व᭠यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ हᱹ, पयाᭅवरण कᳱ दृि᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष᳍ करना आव᭫यक है; अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) के साथ पᳯठत और उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, उदयपुर व᭠ यजीव अभयार᭛य पाᳯरि᭭ थितकᳱय संवेदी जोन के ᱧप मᱶ (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया है) िबहार रा᭔य के उदयपुर व᭠यजीव अभयार᭛य कᳱ सीमा के 1 ᳰकलोमीटर से 3.5 ᳰकलोमीटर सीमा ᭃेᮢ को अिधसूिचत करती है, िजसका िववरण िन᳜ानुसार है, अथाᭅत् :--

1. पाᳯरि᭭थितक संवेदी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) पाᳯरि᭭थितक संवेदी जोन का िव᭭तार उदयपुर व᭠यजीव अभयार᭛य कᳱ सीमा एक ᳰकलोमीटर से 3.5 ᳰकलोमीटर तक है और पाᳯरि᭭थितकᳱ संवेदी जोन का ᭃेᮢ 3759 हे᭍टेयर है |
   (2) पाᳯरि᭭थितक संवेदी जोन पूवᭅ कᳱ ओर (उपाबंध-I के िब᭠दु सं.7); 26o 48’10.931” उ. अᭃांश और 84o 28’27.795” पू. देशा᭠तर; पि᳟म कᳱ ओर (उपाबंध-I मानिचᮢ के िब᭠दु सं.17) 26o47’53.760” उ. अᭃांश और 84o23’33.467” पू. देशांतर; उᱫर कᳱ ओर (उपाबंध-I के िब᭠दु सं.4) 26o 50’9.213” उ. अᭃांश और 84o26’57.403” पू. देशांतर और दिᭃण कᳱ ओर (उपाबंध-I के िब᭠दु सं.13) 26o 46’14.639” उ. अᭃांश और 84o25’39.483” पू. देशांतर से िघरा ᱟआ है |
   (3) पाᳯरि᭭थितकᳱ संवेदी जोन के मानिच ᮢ के साथ इसके अᭃांश और देशा᭠तर उपाबंध I के ᱧप मᱶ उपाब᳍ है । (4) पाᳯरि᭭थितक संवेदी जोन के भीतर आने वाले ᮕामᲂ कᳱ सूची ᮧमुख िब᭠दुᲐ के िनदᱷशांक उपाबंध II के ᱧप मᱶ उपाब᳍ है ।
2. पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से, और इस अिधसूचना मᱶ संलᲨ अनुबंधᲂ के सामंज᭭य से आंचिलक महायोजना तैयार करेगी । (2) आचंिलक महायोजना रा᭔य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा का अनुमोᳰदत होगी | (3) पाᳯरि᭭थितकᳱ संवेदी जोन के िलए आंचिलक महायोजना इस अिधसूचना मᱶ िविन᳸द᳥ ᱧप मᱶ ऐसी रीित मᱶ रा᭔य सरकार तथा सुसंगत के᭠ᮤीय और रा᭔य िविधयᲂ के सामंज᭭य मᱶ भी तथा के᭠ᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷश, यᳰद कोई हो, ᳇ारा तैयार होगी | (4) आंचिलक महायोजना िन᳜िलिखत सभी संब᳍ रा᭔य सरकार के िवभागᲂ के परामशᭅ से तैयार होगी अथाᭅत्:-- (i) पयाᭅवरण ; (ii) वन ;
   (iii) नगर िवकास ; (iv) पयᭅटन ; (v) नगरपािलका ; (vi) राज᭭ व ;
   (vii) कृिष ; और (viii) िबहार रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ, इसमᱶ पयाᭅवणीय और पाᳯरि᭭थितकᳱ िवचारᲂ के समाकिलत करने के िलए हᲂगे ।

(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार िविन᳸द᳥ न हो और आंचिलक महायोजना सभी अवसंरचना और कायᭅकलापᲂ मᱶ दᭃता और पाᳯर ि᭭ थ ितकᳱय अनुकूलता का संव᳍ᭅन करेगी
(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितकᳱ और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान देना आव᭫यक है, के िलए उपबंध हᲂगे । (7) आंचिलक महायोजना सभी िव᳒मान एवं ᮧ᭭तािवत पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, आ᳸कडᲂ, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी। (8) आंचिलक महायोजना पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭थितक अनुकूल िवकास और ᭭थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᳟त करते ᱟए िविनयिमत होगी। 3. रा᭔य सरकार ᳇ारा ᳰकए जाने वाले उपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :- (1) भू-उपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
परंतु पाᳯरि᭭थितकᳱ संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद सं0 23, 27, 30 और 35 के सामने सूचीब᳍ ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-
(i) ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग; (ii) पाᳯरि᭭ थितकᳱय अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭ थितकᳱय अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद; (iii) वषाᭅ जल संचय; और (iv) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण कारीगर सि᭥मिलत हᱹ : परंतु यह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और संिव धान के अनु᭒ छेद 244 तथा त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा :
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना देनी होगी ।
परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा ।
परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु᭍ त या अनु᭜पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।
(2) ᮧाकृितक ᮲ोतᲂ -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुननᭅवीकरण के िलए योजना को सि᭥ मिलत ᳰकया जाएगा और रा᭔ य सरकार ᳇ारा ऐसी रीित से मागᭅदशᭅक िस᳍ांत बनाए जाएंगे िजससे ᳰक उन ᭃेᮢᲂ मᱶ या इसके समीप िवकास ᳰᮓयाकलाप को रोका जा सके जो ऐसे ᭃेᮢ के िलए हािनकारक हᱹ । (3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, जो आंचिलक महायोजना के अनुसार हᲂगे, आंचिलक महायोजना का भाग ᱨप मᱶ हᲂगे ।
(ख) पयᭅटन महायोजना पयᭅटन िवभाग, िबहार सरकार ᳇ारा राज᭭ व और वन िवभाग, िबहार सरकार के परामशᭅ से तैयार होगी ।

(ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :- (i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िस᳍ांतᲂ के ᳇ारा तथा पाᳯरि᭭थितक पयᭅटन रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िस᳍ांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व देते ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा ;
(ii) पाᳯरि᭭ थितकᳱय अनुकूल पयᭅटक ᳰᮓयाकलापᲂ के संबंध मᱶ अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय उदयपुर व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर भीतर होटल और ᳯरसोटᲄ का नया संिनमाᭅण अनु᭄ात नहᱭ होगा ;

परंतु संरिᭃत ᭃेᮢᲂ कᳱ सीमा से एक ᳰकलोमीटर कᳱ दूरी से परे पाᳯरि᭭थितकᳱय संवेदी जोन कᳱ सीमा तक नए होटल और ᳯरसोटᭅ के ᭭थापन पयᭅटन महायोजना के अनुसार पाᳯरि᭭थितकᳱय पयᭅटन सुिवधा के िलए पूवᭅ पᳯरभािषत और िविन᳸द᳥ ᭭थान मᱶ ही अनु᭄ात ᳰकया जाएगा । (iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकाᳯरयᲂ ᳇ारा अनु᭄ात ᳰकया जाएगा । (4) नैसᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना जोनल मा᭭टर ᭡लान का भाग होगा । (5) मानव िनᳶमत िवरासत ᭭ थलᲂ - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदूषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदूषण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।
(7) वायु ᮧदूषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदूषण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।
(8) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण जल (ᮧदूषण िनवारण तथा िनयंᮢण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा । (9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा - (i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण और वन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 908(अ), तारीख 25 िसतंबर, 2000 नगरपािलक ठोस अपिश᳥ (ᮧबंध और हथालन) िनयम, 2000 के उपबंधᲂ के अनुसार ᳰकया जाएगा ; (ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए योजनाएं तैयार करᱶगे ;
(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ
होगा ।

(10) जैव िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन ᳇ारा पयाᭅवरण और वन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.आ.630 (अ) तारीख 20 जुलाई, 1998 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ (ᮧबंध और हथालन) िनयम, 1998 के उपबंधᲂ के अनुसार ᳰकया जाएगा । (11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत होगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध सि᭥मिलत ᳰकए जाएंगे और रा᭔य सरकार के सᭃम ᮧािधकारी ᳇ारा आंचिलक महायोजना के तैयार होने और अनुमोᳰदत होने तक, मानीटरी सिमित सुंसगत अिधिनयमᲂ और ᮧवृᱫ िनयमᲂ िनयमᲂ और इसके अ᭟यधीन बनाए गए िविनयमᲂ के अधीन यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी । 4. पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧितिष᳍ और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सूची - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ और इसके अ᭟यधीन बनाए गए िनयमᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ िविन᳸द᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत् :-

उ᳒ोगᲂ पर आधाᳯरत आरा मीलᲂ, अन्. का᳧ᲂ पर परत चढ़ाने वाली मीलᲂ कᳱ ᭭थापना। पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा मशीनᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।

जल या वायु या मृदा या ᭟ विन ᮧदूषण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नए और िव᳒मान ᮧदूषण काᳯरत करने वाले का िव᭭ तार अनु᭄ात नहᱭ होगा । 4.
होटल और ᳯरसाटᭅ का वािणि᭔यक ᭭थापन ।
पाᳯरि᭭थितक संवेदी जोन के भीतर कोई नए या िव᳒मान वािणि᭔यक ᭭थाप᳖ जैसे होटल और ᳯरसाटᭅ अनु᭄ात नहᱭ हᲂगे । 5.
जलावन लकड़ी का वािणि᭔यक उपयोग । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । 6.
नए बृहत जल िव᳒ुत पᳯरयोजना का ᭭थापना । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । 7.
पयᭅटन से संबंिधत रᲯुमागᭅ के भांित ᳰᮓयाकलाप जैसे गमᭅ वायु गुबारᲂ आᳰद ᳇ारा अभयार᭛य ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । 8.
᭡लाि᭭टक के थैलᲂ का उपयोग। लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । 9.
ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ावᭅ और ठोस अपिश᳥ᲂ का िन᭭तारण । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) । 10.
खतरनाक पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠यथा उपबंिधत के िसवाय) ।

संिनमाᭅण ᳰᮓयाकलाप A पैरा 3 के उप पैरा (1) मᱶ सूचीब᳍ ᳰᮓयाकलापᲂ सिहत ᭭ थानीय िनवािसयᲂ कᳱ घरेलू आव᭫ यकताᲐ के िसवाय पाᳯरि᭭थितकᳱ संवेदी जोन के भीतर ᳰकसी ᳰक᭭म का कोई नया संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा ।
ᮧदूषण न करने वाले और ᮧदूषण कम करने वाले लघु उ᳒ोगᲂ से संबंिधत संिनमाᭅण ᳰᮓयाकलापᲂ के मामले िविनयिमत ᳰकए जाएंगे । िविनयिमत ᳰᮓयाकलाप 12.
वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत केᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
13.
वािणि᭔यक जल संसाधन िजसके अंतगᭅत भू-जल संचयन भी है । (क) भूिम के अिधभोगी के वा᭭तिवक कृिष और घरेलू खपत के िलए जल का िन᭬कषᭅण सतही और भूिमगत जल अनु᭄ात होगा ।
(ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भूिमगत जल का िन᭬कषᭅण के िलए संबंिधत िविनयामक ᮧािधकरण पूवᭅ िलिखत अनु᭄ा अपेिᭃत होगी िजसके अंतगᭅत ᳰकतने पᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी है ।
(ग) सतही या भूजल का िवᮓय अनु᭄ात नहᱭ होगा ।
(घ) जल के संदूषण या ᮧदूषण, िजसके अंतगᭅत कृिष भी है, को रोकने के िलए सभी उपाय ᳰकए जाएंगे ।
14.
कृिष ᮧणाली मᱶ ᮧबल बदलाव। लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । 15.
िव᳒ुत केबलᲂ और दूरसंचार टावरᲂ का पᳯरिनमाᭅण । भूिमगत केबलᲂ को ᮧो᭜साहन देना ।
16.
होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड लगाना । 17.
िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदृढ करना तथा नई सड़कᲂ का संिनमाᭅण । उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूिनकरण उपाय यथा लागू अनुसार हᲂगे । 18.
रािᮢ मᱶ यािनक यातायात का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे । 19.
िवदेशी ᮧजाितयᲂ को लाना । 20.
पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । 21.
वािणि᭔ यक साइनबोडᭅ और होᳺडग । 22.
ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण । उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करना और अवमल या ठोस अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा ।
23.
ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन से गैर ᮧदूषण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत देशीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग और जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते हᱹ, अनु᭄ात ᳰकए जाएंगे ।
24.
वन उ᭜पादᲂ और गैर का᭬ ठ वन उ᭜पादᲂ का संᮕहण (एन.टी.पी.एफ) । 25.
सुरᭃा बलᲂ के कै᭥प । 26.
नए का᳧ आधाᳯरत उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन कᳱ सीमाᲐ के भीतर नए का᭬ ठ आधाᳯर त उ᳒ोग कᳱ ᭭ थापना को अनु᭄ात नहᱭ ᳰक या जाएगा:

᭭थािपत ᳰकए जाएंगे िजसमᱶ 100 ᮧितशत आयाितत का᭬ ठ का उपभोग होगा । 27.
पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए, पयᭅटकᲂ के अ᭭थायी आवासन के िलए पाᳯरि᭭थितकᳱय अनुकूल कुटीर, जैसे तंबू, लकड़ी के घर आᳰद। 28.
नᳰदयᲂ और ᮧाकृितक जल िनकायᲂ मᱶ म᭜᭭य ᮕहण । संवᳶधत ᳰᮓयाकलाप 29. ᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष और मछली पालन । 30. वषाᭅ जल संचयन । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।
31. जैिवक खेती । सᳰᮓ य ᱨप से बढावा ᳰदया जाए । 32. सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ को ᮕहण करना । सᳰᮓ य ᱨप से बढावा ᳰदया जाए । 33. नवीकरणीय ऊजाᭅ ᮲ोत का उपयोग । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे । 34. वान᭭पितक बाड़ । लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे | 35. कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण कारीगर आᳰद भी हᱹ । सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।

5. पाᳯरि᭭थितक संवेदी जोन मानीटरी सिमित- (1) कᱶᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :— (क)
   आयुᲦ, ितरहट, राज᭭व खंड, मुज᭢फरपुर -अ᭟यᭃ; (ख) राज᭭व िवभाग का एक ᮧितिनिध, िबहार सरकार
   -सद᭭य; (ग)
   जल संसाधन िवभाग का एक ᮧितिनिध, िबहार सरकार
   -सद᭭य; (घ)
   ᭃेᮢीय अिधकारी, िबहार रा᭔य ᮧदूषण िनयंᮢण बोडᭅ, पटना -सद᭭य; (ङ)
   पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनᲂ (िजसके अंतगᭅत िवरासत संरᭃण भी है) का ᮧ᭜येक मामले मᱶ एक वषᭅ कᳱ अविध के िलए िबहार रा᭔य सरकार ᳇ारा नामिन᳸द᳥ एक ᮧितिनिध -सद᭭य; (च) िबहार सरकार ᳇ारा नामिन᳸द᭬ ट पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ ᮧ᭜येक मामले मᱶ एक वषᭅ कᳱ अविध के िलए एक िवशेष᭄ -सद᭭य; (छ) संभागीय वन अिधकारी/बा᭨मीᳰक ᳞ाᮖ पᳯरयोजना, खंड 1
   -सद᭭य-सिचव ।

6. िनदᱷश िनबंधन - (1) मािन टरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी । (2) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष᳍ गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।
(3) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं᭎यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया है, परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते हᱹ, ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब᳍ िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।
(4) मानीटरी सिमित का सद᭭य-सिचव या संब᳍ कल᭍टर या संरिᭃत ᭃेᮢ का ᮧभारी ऐसे ᳞िᲦ के िवᱧ᳍, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता है, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 (1986 का 29) के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा । (5) मानीटरी सिमित मु᳎ᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब᳍ पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी । (6) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मु᭎य व᭠यजीव वाडᭅन को उपाबंध III मᱶ उपबंिधत ᱨप िवधान के अनुसार उ᭍ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी । (7) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए समय-समय पर ऐसे िनदेश दे सकेगा, जो वह ठीक समझे । 7. इस अिधसूचना के उपबंधᲂ को ᮧभाव देने के िलए कᱶᮤीय सरकार और रा᭔ य सरकार अितᳯर᭍ त उपाय, यᳰद कोई हᲂ, िविन᳸द᭬ ट कर सकᱶगे ।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 30th December, 2015 S.O. 3547(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Ali Ganj, New Delhi-110003, or send it to the e-mail address of the Ministry at esz-mef@nic.in Draft Notification
WHEREAS, the Udaipur Wildlife Sanctuary, Bettiah located between Latitudes 26°47’52.5” N and 26°48’47.1” N and Longitude 84°24’24”E and 84°25’88” E in the West Champaran District of Bihar and extends over an area of 887 hectares; AND WHEREAS, the forest and the wetland -ox-bow Sarayaman Lake spread in 319 hectare or 3.19 square kilometre part of this sanctuary have ecologically important species of flora and fauna, with narrow stretch of mixed deciduous forest along the banks of the river Chandrawat, river Harha and Gandak feed the lake and the landscape of this sanctuary is unique wetland with forests eco-system in the State of Bihar and the same also provided significant hydrological wetland eco-system functions in this locality; AND WHEREAS, the Spotted deer, Barking deer, Hog deer, Blue bull, Indian Hare, Jackal, Fox, Wild boar, Porcupine, Monitor Lizard, Python, and Open billed Stork, Red crested Pochard, Gadwal, Purprle Heron among bird species are the wild fauna of importance in Udaipur Wildlife Sanctuary, with Hog deer, Barking deer and Python being endangered or vulnerable; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in paragraph one of this notification around the protected area of the Udaipur Wildlife Sanctuary as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; Now, therefore, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from one kilometre to 3.5 kilometre from the boundary of the Udaipur Wildlife Sanctuary in the State of Bihar as the Udaipur Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to asthe Eco-sensitive Zone), details of which are as under, namely:- 1. Extent and boundaries of Eco-sensitive Zone.—(1)The extent of Eco-sensitive Zone is varies from one kilometre to 3.5 kilometre from the boundary of the Udaipur Wildlife Sanctuary and the area of Eco- sensitive Zone is 3759 hectares. (2) The Eco-sensitive Zone is bounded by 26º48’10.931"N latitude and 84º28’27.795"E longitude towards east (point No.7 of Annexure I map); 26º47’53.760"N latitude and 84º23’33.467"E longitude towards west (point No.17 of Annexure I map); 26º50’9.213"N latitude and 84º26’57.403"E longitude towards north (point No. 4 of Annexure I map) and 26º46’14.639"N latitude and 84º25’39.483"E longitude towards south (point No.13 of Annexure I map). (3) The map of Eco-sensitive Zone boundary together with its latitude and longitude is appended asAnnexure I.
(4) The list of villages falling within Eco-sensitive Zone along with coordinates of the prominent points is appended as Annexure II. 2. Zonal Master Plan for the Eco-sensitive Zone. —(1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The Zonal Master Plan shall be approved by the competent authority in the State Government.

(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment; (ii) Forest; (iii) Urban Development; (iv) Tourism; (v) Municipal; (vi) Revenue; (vii) Agriculture; and (viii) Bihar State Pollution Control Board, for integrating environmental and ecological considerations into it. (5)
The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (7) The Zonal Master Plan shall demarcate all the existing and proposed worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly development and livelihood security of local communities. 3. Measures to be taken by State Government.—The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed at item numbers 23, 27, 30 and 35 in column (2) of the Table in paragraph 4, namely:- (i)
Small scale industries not causing pollution; (ii)
Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, for eco-friendly tourism activities; (iii) Rainwater harvesting; and (iv)
Cottage industries including village artisans: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph: Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2) Natural springs.—The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism.— (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Bihar in consultation with Department of Revenue and Forests, Government of Bihar.

(c) The activity of tourism shall be regulated as under, namely.-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the eco-tourism guidelines issued by the National Tiger Conservation Authority, Ministry of Environment, Forest and Climate Change (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone; (ii) new construction of hotels and resorts shall not be permitted within one kilometre from the boundary of the Udaipur Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities; Provided that beyond the distance of one kilometre from the boundary of the protected Area till the extent of the eco- sensitive Zone, the establishment of new hotels and resorts shall be permitted only in the pre-defined and designated areas for Eco-tourism facilities as pertourism Master Plan; (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4) Natural heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of final notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of final notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.—The Environment Department of the State Government shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder. (7) Air pollution.—The Environment Department of the State Government shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.—The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974)and the rules made thereunder. (9) Solid wastes.—Disposal of solid wastes shall be as under.- (i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment, Forests and Climate Change vide notification number
S.O. 908 (E), dated the 25th September, 2000 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) the inorganic material shall be disposed of in an environmentally acceptable manner at site identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.—The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment, Forests and Climate Change vide notification number S.O. 630(E), dated the 20th July, 1998as amended from time to time. (11) Vehicular traffic.—The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved by the Ministry of Environment, Forest and Climate Change, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.—All activities in the Eco- sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder and shall be regulated in the manner specified in the table below, namely:-

Setting up of industries causing water or air or soil or noise pollution. No new or expansion of existing polluting industries shall be permitted within the Eco-sensitive Zone.
4.

Commercial establishment of hotels and resorts.

No new or expansion of existing commercial establishments such as hotels and resorts shall be permitted within the Eco-sensitive Zone. 5.

Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws. 6.

Establishment of new major hydroelectric projects. Prohibited (except as otherwise provided) as per applicable laws. 7.

Undertaking activities related to tourism like rope ways, over-flying the sanctuary area by hot- air balloons, etc. Prohibited (except as otherwise provided) as per applicable laws. 8. Uses of plastic carry bags.

Prohibited (except as otherwise provided) as per applicable laws. 9.

Discharge of untreated effluents and solid waste in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws. 10.

Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws. 11.

Construction activities.

(a) No new construction of any kind shall be permitted within one kilometre from the boundary of the protected area; Provided that, local people shall be permitted to undertake construction in their land for their residential use including the Eco-sensitive Zone, except for the domestic needs of local residents including the activities listed in sub-paragraph (1) of paragraph 3. (b) the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the Competent authority as per applicable rules and regulations, if any.
(c) Beyond one kilometre upto the extent of Eco- sensitive Zone construction for bonafide local needs shall be as per Zonal Master Plan. (d) construction activity in the Eco-senstive Zone shall be as per Zonal Master Plan.

Regulated activities 12.

Felling of trees. (a) There shall be no felling of trees on the forest land or Government or revenue or private lands without prior permission of the competent authority in the State Government.
(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder. 13.

Commercial water resources including ground water harvesting. (a) The extraction of surface water and ground water shall be permitted only for bona fide agricultural use and domestic consumption of the occupier of the land. (b) The extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned regulatory authority. (c) No sale of surface water or ground water shall be permitted. (d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture. 14.

Drastic change of agriculture system. Regulated under applicable laws. 15.

Erection of electrical cables,Transmission lines and telecommunication towers. Promote underground cabling. 16.

Fencing of existing premises of hotels and lodges. 17.

Widening and strengthening of existing roads and construction of new roads, rail tract. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable. 18.

New wood based industry. No establishment of new wood based industry shall be permitted within the limits of Eco-sensitive Zone: Provided that new wood based industry may be set up in the Eco-sensitive using 100% imported wood stock. 27.

Eco-friendly cottages for temporary occupation of tourists such as tents, wooden houses, etc. for eco-friendly tourism activities. 28.

Fishing in rivers and natural water bodies. Promoted activities 29.

Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming and fisheries. Permitted under applicable laws 30.

5. Eco-sensitive Zone Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:- (a) The Commissioner of Tirhut, Revenue Division, Muzaffarpur

• Chairman; (b) A representative of Department of Revenue, Government of Bihar

• Member; (c) A representative of Department of Water Resource, Government of Bihar

• Member; (d) Regional Officer, Bihar State Pollution Control Board, Patna

-Member;
(e) A representative of Non-governmental Organisations working in the field of environment (including heritage conservation) to be nominated by the Government of Bihar for a term of one year

– Member; (f) One expert in the area of ecology and environment to be nominated by the
Government of Bihar

  - Member; and 

(g) Divisional Forest Officer / Valmiki Tiger Project, Division-I

      - Member- Secretary. 

Terms of Reference.- (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(2) The activities that are covered in the schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (3) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (4) The Member-Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification. (5)
The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wild Life Warden of the State per proforma appended at Annexure III. (7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
