अजधसूचना नई दिल्ली, 27 अक् तूबर, 2020 का.आ. 3881(अ).— प्रारुप अजधसूचना भारत के रािपत्र, असाधारण, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान, मंत्रालर् की अजधसूचना सं. का.आ. 653 (अ), तारीख 31 जनवरी, 2019, द्वारा प्रकाजित की गई थी जिसमें ऐसे सभी व्यजिर्ों से, जिनकी उससे प्रभाजवत होने की संभावना थी, उस तारीख से, जिसको उि अजधसूचना को अन्तर्वाष्ट करने वाले रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी गई थीं, साठ दिन की अवजध के भीतर आक्षेप और सुझाव आमंजत्रत दकए गए थे; और, उि प्रारूप अजधसूचना को अन्तर्वाष्ट करने वाले रािपत्र की प्रजतर्ां िनता को तारीख 4 फरवरी, 2019, को उपलब्ध करा िी गई थीं; और, पूवोक्त प्रारुप अजधसूचना के प्रत्र्ुतर में व्यजिर्ों और पणधाररर्ों से प्राप्त आक्षेपों और सुझावों पर केंद्रीय सरकार द्वारा जवचार दकर्ा गर्ा था; और, नमेरी राष्ट्रीय उद्यान और सोनाई-रूपाई वन्यजीव अभयारण्य असम के सोनीतपुर जजले में जथित है; िबदक नमेरी राष्ट्रीय उद्यान का वर्ष 2000 में असम सरकार की अजिसूचना सं. एफ आर डब्ल्यू-95/99/70 दिनांक 1 माचष, 2000 के द्वारा नमेरी राष्ट्रीय उद्यान (1998 में अजिसूचना सं. एफ आर डब्ल्यू II/96/81, दिनांक 13 अगथत, 1998 को सं. 3427] नई दिल्ली, बुधवार, अक् तूबर 28, 2020/ कार्ताक 6, 1942

अजिसूजचत दकया) के कोर क्षेत्र 200 वगष दकलोमीटर के अंतगषत कोर क्षेत्र के साि नमेरी बाघ ररज़वष घोजर्त दकया गया और पूवष और पजिम पर बफर क्षेत्र का 144 वगष दकलोमीटर क्षेत्र बाघ ररज़वष के कुल क्षेत्र का 344 वगष दकलोमीटर है और सोनाई-रूपाई वन्यजीव अभयारण्य (1998 में अजिसूचना सं. एफ आर डब्ल्यू–33/98/11 दिनांक 13 जसतम्बर, 1998 क्षेत्र 220 वगष दकलोमीटर के साि अजिसूजचत है) को असम सरकार अजिसूचना सं. एफ आर एम.236/2014/20 दिनांक 18 जून, 2015 के द्वारा नमेरी बाघ ररज़वष को सैटेलाइट कोर घोजर्त दकया गया िा, जजसमें सोनाई-रूपाई वन्यजीव अभयारण्य के 220 वगष दकलोमीटर क्षेत्र में से 120 वगष दकलोमीटर क्षेत्र आता है; िोनों संरजक्षत क्षेत्र उच्च जैव-जवजविता मू्य के साि अरूणाचल प्रिेश की सीमा और वन क्षेत्रों से सटे हुए हैं; और, िोनों संरजक्षत क्षेत्र पूवी जहमालय के पािजगरर में जथित हैं जजनमें नमेरी राष्ट्रीय उद्यान का 200 वगष दकलोमीटर और सोनाई-रूपाई वन्यजीव अभयारण्य का 220 वगष दकलोमीटर से क्षेत्र सजम्मजलत है जजसमें हाजियों की िनसंख्या के जलए सुरजक्षत गजलयारा साि ही बाघों की िनसंख्या के जलए संरक्षण की आवश्यकता है; और, नमेरी राष्ट्रीय उद्यान, सोनाई-रूपाई वन्यजीव अभयारण्य और नमेरी बाघ ररज़वष उत्तर पूवष भारत जैव- भौगोजलक जोन के उत्तर पूवष ब्रह्मपुत्र घाटी जैव-भौगोजलक प्रांत (9ए) से संबंजित है और इसमें असम घाटी उष्णकरटबंिीय सिाबहार वन, उप-जहमालयन लाइट जलोढ़ अिष सिाबहार वन, पूवी जलोढ़ माध्यजमक अिष-सिाबहार वन, केन ब्रेक, जनचला जलोढ़ सावाना वनथिली, पूवी हॉ्लोक वन, पूवी मौसमी िलिल वन, पूवी जड्लेजनया िलिल वन और पूवी आद्रष जलोढ़ घासभूजम है; और, संरजक्षत क्षेत्रों के मुख्र् वृक्ष प्रिाजतर्ों में लेगरोजस्ट्रजमर्ा फ्लोस-रेजिना, मंजगफेरा सयलवारटका, एम्बेजलका ऑद़िजसनाजलस, स्ट्पोंजडर्स मैन्गी़िेरा, जिमाइकापास रीमोसस, मनसोजनया िीजपकाइ, डार्सोजक्सलम जबनेक्टीफेरुम, क्रेटेवा रेजलजगओसा, टर्मानजलर्ा बेलेररका, सेजमकारपूस अनेकार्डार्म, ओरोजक्सलम इंजडकम, तरेजवया नुिीफ्लोरा, तेतरामारटस नुजडफ्लोरा,जचकराजथसया तबूलाररस, मोरूस लजवगाटा, दिप्टोकेररया एमाइडाजलमा, तालाउमा होड्गसनी, एललांिुस ग्ांजडस, फोइबे गोअलपारेंजसस, पटेरोजप्रमुम अकररफोजलयम, जड्लेजनया पंतगयाना, जमचेजलया चम्पाका, जसनोकार्डषया ओडोराटा, गमेजलना अबोरेया, प्ररेम्ना बेंगालेंजसस, नयथसा सेजथसजलफ्लोरा, मेजलया अजािीराकट, इयजगजनया इपेरकुलाटा, पटेरोथपेरमुम अकेरीफोजलयम, अिीना कॉर्डषफोजलया, टर्मषनाजलया चेबुला, केथटानोजप्सस थपा, जलटजसया पोलयांजिया, टर्मषनाजलया मायरोकारपा, सेडरला टोन, गेरूगा जपन्नाटा,एंिोसेफालुस कैिाम्बा, बाउजहजनया पुरपुररया, जमशेजलया ओबोना, जमचेजलया ओबलोंगा, जमचेजलया गलोबोसा, पो्यांजिया जेंदकजन्स, िौबांगा सोन्नेरारटओइडेस, अज्बजिया ओडोरारटजथसमा, बररिेजलया रतुसा, एरीजिना थपा, इवोदिया मेजलयाफोजलया, जथचमा वाज्लजच, मेसुआ फेरेना,

प्रवासी पक्षीजीवों की संख्या जैसे इजबस जब्ल, प्लास दफशिंग ईगल, स्ट्लेंडर जब्लेड जगद्ध, जहमालयन गररफ्फों जगद्ध, ग्रेट हॉनाजबल, रुड्डी िेल्डक, मरगेंगेर का आश्रर् प्रिान है; और संरजक्षत क्षेत्र के मुख्र् स्ट्तनधारी प्रिाजतर्ों में हाथी एजलफस मैक्सीमूस, बाघ पैंथेरा टाइगररस, तेंिुआ पैंथेरा पाडास, मजलन तेंिुआ नेओफेजलस नेबुलोस, िंगली कुत्ता कुओन अल्पाइंस, काला भालू उरसुस जिबेटनस, रीछ मेलउसुास उर्सानस, जपग्मी हॉगपोरकुला स्वाजनया (पुन:प्रथतुत), गौर बोस गौरस, सांभर रुसा र्ूनीक्लोर, कैप्ड लंगूर त्रच्र्जपथेकस जपलातुस, गो्डन जब्ली काटोपुमा टेम्मींक्की, बबंटरोंग आर्क्टाकरटस शबंटूरोंग, लाजष जसवेट जववेराष जजबेिा, भारतीय साल (माजनस क्रैजसकाउडाटा), अस्ट्सामेसे मैकक्वे मकाका अस्ट्सामेसे, आदि हैं; और संरजक्षत क्षेत्र का असीम शोि, मनोरंजनात्मक और शैजक्षक मू्य है; और, संरजक्षत क्षेत्रों के आसपास बढ़ती मानव जनसंख्या से आने वाले समय में तक संरजक्षत क्षेत्र में पयाषवासों, पशुओं, पजक्षयों और मछजलयों पर प्रजतकूल प्रभाव पडने की संभावना है; और, नमेरी राष्ट्रीय उद्यान और सोनाई-रूपाई वन्यजीव अभयारण्य के चारों ओर के क्षेत्र को, जिसका जवस्ट्तार और सीमाएं पाररजथिजतकी पयाषवरणीय से पाररजथिजतकी संवेिी जोन के रूप में पैरा 1 में जवजनर्िाष्ट हैं, जैव जवजवजिता की िृजष्ट सुरजक्षत और संरजक्षत करना और उि पाररजस्ट्थजतकी संवेिी िोन में उद्योगों र्ा उद्योगों के वगों के प्रचालन और प्रसंस्ट्करण करने को प्रजतजिद्ध करना आवश्र्क है; अतः, अब, केन्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) (जजसे इस अजिसूचना में इसके पिात पयाषवरण अजिजनयम कहा गया है) की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) तिा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, असम राज्र् के सोनीतपुर और उिलगूरी जजला के नमेरी राष्ट्रीय उद्यान और सोनाई-रूपाई वन्यजीव अभयारण्य की सीमा के चारों ओर 0 (शून्य) से 48 दकलोमीटर तक जवस्ट्ताररत क्षेत्र को नमेरी राष्ट्रीय उद्यान और सोनाई-रूपाई वन्यजीव अभयारण्य पाररजस्ट्थजतकी संवेिी िोन (जिसे इसमें इसके पश् चात् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा है) के रूप में अजधसूजचत करती है, जिसका जववरण जनम्नानुसार है, अथाात् :-

पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार और सीमाएं.-(1) पाररजस्ट्थजतकी संवेिी िोन का जवस्ट्तार नमेरी राष्ट्रीय उद्यान और सोनाई-रूपाई वन्यजीव अभयारण्य की सीमा के चारों ओर 0 (शून्य) से 48 दकलोमीटर तक जवथतृत है और पाररजस्ट्थजतकी संवेिी िोन का क्षेत्रफल 1338.62 वगा दकलोमीटर है; अरूणाचल प्रिेश सीमा के भाग पर शून्य जवथतार है जहां राज्य का ररज़र्व वन क्षेत्र और खासकर पाक्के ररज़वष वन समीपवती है। (2) नमेरी राष्ट्रीय उद्यान और सोनाई-रूपाई वन्यजीव अभयारण्य और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का वणान उपाबंध-I के रूप में संलग्न है। (3) सीमा जववरण और अक्षांि और िेिांतर के साथ पाररजस्ट्थजतकी संवेिी िोन के नमेरी राष्ट्रीय उद्यान और सोनाई- रूपाई वन्यजीव अभयारण्य का मानजचत्र उपाबंध-IIक और उपाबंध-IIख के रूप में संलग्न है। (4) पाररजस्ट्थजतकी संवेिी िोन और नमेरी राष्ट्रीय उद्यान और सोनाई-रूपाई वन्यजीव अभयारण्य की सीमा के भू- जनिेिांकों की सूची उपाबंध-III की सारणी क, सारणी ख और सारणी ग में िी गई है। (5) मुख्र् शबंिुओं के भू-जनिेिांकों के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाले ग्रामों की सूची उपाबंध-IV की सारणी क और सारणी ख के रूप में संलग्न है।

पाररजस्ट्थजतकी संवेिी िोन के जलए आंचजलक महार्ोिना– (1) राज्र् सरकार, पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो विा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और राज्य के सक्षम प्राजिकारी के अनुमोिन के जलए इस अजधसूचना में दिए गए अनुबंधों का पालन करते हुए आंचजलक महार्ोिना तैर्ार करेगी। (2) राज्र् सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत से िो इस अजधसूचना में जवजनर्िाष् ट दकए गए हैं, के अनुसार तथा सुसंगत केंरीर् और राज् र् जवजधर्ों के अनुरुप और केंरीर् सरकार द्वारा िारी मागाजनिेिों, र्दि कोई हों, द्वारा तैर्ार होगी । (3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करने के जलए राज् र् सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार होगी.- (i) पयाषवरण; (ii) वन और वन्र्िीव; (iii) कृजि; (iv) रािस्ट्व; (v) िहरी जवकास; (vi) पर्ाटन; (vii) ग्रामीण जवकास;
(viii) शसंचाई और बाढ़ जनर्ंत्रण; (ix) नगरपाजलका; (x) पंचार्ती राि;
(xi) असम राज्र् प्रिूिण जनर्ंत्रण बोडा; और (xii) लोक जन मााण जव भाग।

(4) आंचजलक महार्ोिना अनुमोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं करेगी िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िाष् ट न हो और आचंजलक महार्ोिना सभी अवसंरचना और दक्रर्ाकलापों में, िो अजधक िक्षता और पाररजस्ट्थजतकी अनुकूल हों, का संवधान करेगी ।
(5) आंचजलक महार्ोिना में अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण से संबंजधत ऐसे अन्र् पहलुओं, जिन पर ध्र्ान िेना आवश्र्क है, के जलए उपबंध होंगे । (6) आंचजलक महार्ोिना जवद्यमान और प्रथताजवत भूजम उपयोग जवशेर्ताओं के ब्लयौरों से अनुसमर्िषत मानजचत्र के साि सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, कृजि क्षेत्रों, ऊपिाऊ भूजम, हररत क्षेत्र िैसे उद्यान और उसी प्रकार के स्ट् थान, उद्यान कृजि क्षेत्र, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभ्र्कंन करेगी।
(7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन में जवकास को जवजनर्जमत करेगी और सारणी में सूचीबद्ध पैरा-4 में प्रजतजिद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन करेगी और स्ट् थानीर् समुिार्ों की जीजवका को सुरजक्षत करने के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजित और उसकी अजभवृजि भी करेगी।
(8) आंचजलक महार्ोिना प्रािेजशक जवकास र्ोिना की सह जवस्ट्तारी होगी । (9) इस प्रकार अनुमोदित आंचजलक महार्ोिना इस अजधसूचना के उपबंधों के अनुसार मानीटरी के अपने कार्ों को करने के जलए मानीटरी सजमजत के जलए एक संिभा िस्ट्तावेि तैर्ार करेगी ।

[भागII—खण् ड 3(ii)] 5

राज्र् सरकार द्वारा दकए िाने वाले उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करने के जलए जनम्नजलजखत उपार् करेगी, अथाात्:- (1) भू-उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, उद्यान कृजि क्षेत्रों, कृजि क्षेत्रों, मनोरंजन के प्रर्ोिनों के जलए जचजन्हत दकए गए पाकों और खुले स्ट्थानों का वाजणजज्र्क या आवासीय या औद्योजगक संबद्ध जवकास दक्रर्ाकलापों के जलए उपर्ोग र्ा संपररवतान नहीं होगा: परंतु पाररजस्ट्थजतकी संवेिी िोन के भीतर उपयुषक्त भाग (क) में जवजनर्िाष्ट प्रर्ोिनों से जभन्न प्रर्ोिनों के जलए कृजि और अन्र् भूजम का संपररवतान मानीटरी सजमजत की जसफाररि पर और र्था-लागू और क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्रीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन से, और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करने के जलए अनुज्ञात दकर्ा िाएगा, िैसे:- (i) जवद्यमान स़िकों को चौ़िा करना और उन्हें सुिृढ़ करना तथा नई स़िकों का संजनमााण; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रिूिण उत्पन्न न करने वाले लघु उद्योग; (iv) कुटीर उद्योगों जिनके अंतगात ग्रामीण उद्योग भी हैं; सुजवधािनक भण्डार और स्ट्थानीर् सुजवधाएं सहार्क पाररजस्ट्थजतकी पर्ाटन जजसके अन्तगषत गृह वास सजम्मजलत है; और (v) पैरा 4 के अिीन दिए गए संवर्धात दक्रर्ाकलाप:

परंतु र्ह और दक प्रािेजशक नगर र्ोिना अजिजनयम और राज्य सरकार के अन्र् जनर्मों और जवजनर्मों के अिीन सक्षम प्राजिकारी के पूवष अनुमोिन और संजवधान के अनुच्छेि 244 के उपबंिों या तत्समर् प्रवृत्त जवजध के उपबंधों के अनुपालन के जबना, जिसके अिीन अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी है, वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का उपर्ोग अनुज्ञात नहीं होगा:
परंतु र्ह और भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भू-अजभलेखों में उपसंिात कोई गलती, मानीटरी सजमजत के जवचार प्राप्त करने के पश्चात् राज्र् सरकार द्वारा प्रत्र्ेक मामले में एक बार ठीक होगी और उि गलती के सुिार की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी:
परंतु र्ह और भी दक गलती के सुधार में इस उप पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा में भू-उपर्ोग का पररवतान सजम्मजलत नहीं होगा;
(ख) वनीकरण तथा वास िीणोद्धार दक्रर्ाकलापों सजहत अनप्रर्ुक् त र्ा अनुत् पािक कृजि क्षेत्रों में पुन: वनीकरण करने के प्रर्ास दकए िाएंगे। (2) प्राकृजतक िल स्रोतों.- आचंजलक महार्ोिना में सभी प्राकृजतक झरनों के आवाह क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और नवीकरण के जलए र्ोिना सजम् मजलत होगी और राज् र् सरकार द्वारा ऐसे क्षेत्रों पर र्ा उनके जनकट जवकास दक्रर्ाकलाप प्रजतजिद्ध करने के बारे में जो ऐसे क्षेत्रों के जलए अजहतकर हो ऐसी रीजत से मागषिशषक जसद्धांत तैर्ार दकए िाएंगे। (3) पर्ाटन र्ा पाररजथिजतकी पयषटन.- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररजथिजतकी संवेिी जोन के जलए होगा।

(ख) पाररजथिजतकी पर्ाटन महार्ोिना राज्र् पर्ाटन जवभाग द्वारा राज्र् पर्ाावरण और वन जवभाग के परामिा से तैर्ार होगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना के एक घटक के रूप में होगी। (घ) पयषटन महायोजना पाररजथिजतकी संवेिी जोन की वहन क्षमता के आिार पर तैयार की जाएगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जनम्नानुसार जवजनर्जमत होंगे, अिाषत्:- (i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट है, नर्े वाजणजज्र्क होटल और ररजॉटष के सजन्नमाषण अनुज्ञात नहीं होंगे:

परंतु, यह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर की िूरी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक होटलों और ररजॉटष का स्ट्थापना केवल पूवा पररभाजित और नामजनर्िाष्ट क्षेत्रों में पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए ही अनुज्ञात होगा; (ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार केंरीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् के मागाििाक जसद्धांतों के द्वारा तथा राष् रीर् व् र्ाघ्र संरक्षण प्राजधकरण, द्वारा िारी पाररजथिजतकी–पयषटन, पाररजथिजतकी-जशक्षा और पाररजथिजतकी-जवकास पर बल िेते हुए (समर्- समर् पर र्था-संिोजधत) जारी मागाििाक जसद्धांतों के अनुसार होगा; (iii) आंचजलक महार्ोिना का अनुमोिन दकए िाने तक, पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्िाष्ट संवीक्षा और मानीटरी सजमजत की जसफाररि पर आधाररत संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नर्े होटल र्ा ररसोटष र्ा वाजणजज्र्क स्ट्थापना का संजनमााण अनुज्ञात नहीं दकर्ा िार्ेगा । (4) नैसर्गाक जवरासत.- पाररजस्ट्थजतकी संवेिी िोन में महत्वपूणा नैसर्गाक जवरासत के सभी स्ट्थलों िैसे िीन कोि आरजक्षत क्षेत्र, िैल जवरचनाएं, िल प्रपातों, झरनों, घाटी मागों, उपवनों, गुफाएं, स्ट्थलों, भ्रमण, अश्वरोहण, प्रपातों आदि की पहचान की िाएगी और जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रुप में परररक्षण और संरक्षण के जलए तैर्ार की िाएगी । (5) मानव जनर्मात जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, जिल्प-तथ्र्, ऐजतहाजसक, थिापत्य, सौंियषपूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और उपक्षेत्रों पहचान और उनके संरक्षण के जलए जवरासत र्ोिना आंचजलक महार्ोिना के भाग के रुप में तैर्ार की िाएगी।
(6) ध् वजन प्रिूिण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रिूिण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 में जनर्त उपबंधों के अनुसार में पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रिूिण के जनर्ंत्रण और जनवारण का अनुपालन दकया जाएगा।
(7) वार्ु प्रिूिण.- पाररजस्ट्थजतकी संवेिी िोन में, वार्ु प्रिूिण के जनवारण और जनर्ंत्रण का वार्ु (प्रिूिण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार अनुपालन दकर्ा िाएगा।
(8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सारण, साधारणों मानकों के उपबंिों के अनुसार पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आने वाले पर्ाावरणीर् प्रिूिण के जनस्ट्सारण के जलए साधारण मानकों र्ा राज्र् सरकार द्वारा जनर्त मानकों, िो भी अजधक कठोर हो, के उपबंधों के अनुसार होगा। (9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकर्ा िाएगा:-

(क) पाररजस्ट्थजतकी संवेिी िोन में ठोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1357(अ), तारीख 8 अप्रैल, 2016 के द्वारा प्रकाजित ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन (ईएसएम) अनुज्ञात दकर्ा जा सकेगा। (10) िैव जचदकत्सा अपजिष् ट.- िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा.- (क) पाररजस्ट्थजतकी संवेिी िोन में िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016 के द्वारा प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
(ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपयोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबंधन अनुज्ञात दकर्ा जा सकेगा। (11) प्लाजस्ट्टक अपजिष्ट प्रबंधन.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (12) जनमााण और जवध्वंस अपजिष्ट प्रबंधन.- पाररजस्ट्थजतकी संवेिी िोन में संजनमााण और जवध्वंस अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सां.का.जन 317(अ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा । (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत द्वारा प्रकाजित ई–अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) र्ानीर् यातायात.- यातायात की र्ानीर् गजतजवजधर्ां आवास के अनुकूल जवजनर्जमत होंगी और इस संबंध में आंचजलक महार्ोिना में जविेि उपबंध सजम्मजलत दकए िाएंगे और आंचजलक महार्ोिना के तैर्ार होने और राज्र् सरकार के सक्षम प्राजधकारी द्वारा अनुमोदित होने तक, मानीटरी सजमजत सुसंगत अजिजनयमों और उसके अिीन बनाए गए जनर्मों और जवजनर्मों के अनुसार र्ानीर् दियाकलापों के अनुपालन को मानीटर करेगी। (15) र्ानीर् प्रिूिण.- लागू जवजधर्ों के अनुपालन में वाहन प्रिूिण का जनवारण और जनर्ंत्रण दकर्ा िाएगा और स्ट्वच्छक ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ां.- (i) राजपत्र में इस अजिसूचना के प्रकाशन पर या उसके पिात पाररजस्ट्थजतकी संवेिी िोन के भीतर कोई नए प्रिूजित उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी।
(ii) केन्द्रीय प्रिूर्ण जनयंत्रण बोडष द्वारा फरवरी, 2016 में जारी मागषिशषक जसिान्तों में उद्योगों के वगीकरण के अनुसार, जब तक दक अजिसूचना में इस प्रकार जवजनर्िष्ट न हो; पाररजथिजतकी संवेिी जोन के भीतर केवल गैर- प्रिूर्णकारी उद्योगों को अनुज्ञात दकया जाएगा और इसके अजतररक्त, गैर प्रिूर्णकारी उद्योगों को बढ़ावा दिया जाएगा।
(17) पहा़िी ढलानों को संरक्षण.- पहा़िी ढलानों का संरक्षण जनम्नानुसार होगा:-

(क) आंचजलक महार्ोिना पहा़िी ढलानों पर क्षेत्रों का संकेत होगा िहां दकसी भी संजनमााण की अनुज्ञा नहीं िी िाएगी; (ख) कटाव के एक उच्च जडग्री के साथ जवद्यमान ख़िी पहा़िी ढलानों र्ा ढलानों पर दकसी भी संजनमााण की अनुज्ञा नहीं िी िाएगी । 4. पाररजस्ट्थजतकी संवेिी िोन में प्रजतजिद्ध और जवजनर्जमत दकए िाने वाले दक्रर्ाकलापों की सूची.- पाररजस्ट्थजतकी संवेिी िोन में सभी दक्रर्ाकलाप पर्ाावरण अजधजनर्म के उपबंधों और उसके अिीन बनाए गए जनयमों जजसके अन्तगषत तटीर् जवजनर्मन िोन, 2011 और पर्ाावरणीर् समाघात जनिाषरण अजधसूचना, 2006 और अन्र् लागू जवजियों के जिसमें वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53), सजम्मजलत हैं और दकर्े गर्े संिोधनों द्वारा िाजसत होंगे और नीचे िी गई सारणी में जवजनर्िाष्ट रीजत में जवजनर्जमत होंगे, अथाात् :-

(क) पाररजस्ट्थजतकी संवेिी िोन के अंतगात वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेलू आवश्र्कताओं जिसमें मकानों के संजनमााण र्ा मरम्मत के जलए धरती को खोिना सजम्मजलत है, के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनि), पत्थर उत्खनन और अपघिाण इकाइर्ां तत्काल प्रभाव से प्रजतजिद्ध होंगी; (ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) सं. 202 में टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले में माननीर् उच्चतम न्र्ार्ालर् के आिेश 4 अगस्ट्त, 2006 और 2012 की ररट र्ाजचका (जसजवल) सं. 435 में गोवा फाउंडेिन बनाम भारत संघ के मामले में तारीख 21 अप्रैल, 2014 के आिेि के अनुसरण में होगा । 2.

प्रिूिण (िल, वार्ु, मृिा, ध्वजन, आदि) उत्पन करने वाले उद्योगों की स्ट्थापना । पाररजस्ट्थजतकी संवेिी िोन में कोई नर्ा उद्योग लगाने और वतामान प्रिूिणकारी उद्योगों का जवस्ट्तार करने की अनुज्ञा नहीं होगी: परन्तु यह दक केन्द्रीय प्रिूर्ण जनयंत्रण बोडष द्वारा फरवरी, 2016 में जारी मागष िशषक जसिान्तों में उद्योगों के वगीकरण के अनुसार जब तक दक अजिसूचना में ऐसा जवजनर्िष्ट न हों, पाररजथिजतकी संवेिी जोन के भीतर गैर-प्रिूर्णकारी उद्योगों को अनुज्ञात दकया जाएगा और इसके अजतररक्त गैर-प्रिूर्णकारी कुटीर उद्यागों को बढ़ावा दिया जाएगा। 3. बृहत िल जवद्युत पररर्ोिना की स्ट्थापना । प्रजतजिद्ध।
4.

दकसी पररसंकटमर् पिािष का उपर्ोग र्ा उत्पािन र्ा प्रसंस्ट्करण। प्रजतजिद्ध।
5.

प्राकृजतक िल जनकार्ों र्ा क्षेत्र भूजम में अनुपचाररत बजहस्रााव का जनस्ट्सारण । प्रजतजिद्ध।
6.

नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा जमलों का जवस्ट् तार अनुज्ञात नहीं होगा ।

वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना । पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों लघु अस्ट्थार्ी संरचनाओं के जसवार् संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट है, नए वाजणजज्र्क होटल और ररसोटों को अनुज्ञात नहीं दकर्ा िाएगा: परंतु यह दक संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के परे या पाररजथिजतकी संवेिी जोन के जवथतार तक इनमें से, जो भी जनकट हो सभी नए पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान दक्रर्ाकलाप का जवस्ट्तार पर्ाटन महार्ोिना और र्था लागू मागाििी जसद्धांतों के अनुरुप होगा। 11. संजनमााण दक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवथतार तक, इनमें िो भी जनकट हो, दकसी भी प्रकार के नर्े वाजणजज्र्क संजनमााण की अनुज्ञा नहीं होगी:

  परंतु  यह दक स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत

आवश्र्कताओं को पूरा करने के जलए, पैरा 3 के उप पैरा (1) में सूचीबद्ध दक्रर्ाकलापों सजहत अपने उपर्ोग के जलए, अपनी भूजम में भवन उप- जवजधर्ों के अनुसार, संजनमााण करने की अनुज्ञा होगी: परंतु यह दक गैर–प्रिूिणकारी लघु उद्योगों से संबंजधत संजनमााण दक्रर्ाकलाप लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत से जवजनर्जमत दकए िाएंगे और वे न्र्ूनतम होंगे ।
(ख) एक दकलोमीटर क्षेत्र से परे र्े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे । 12.

प्रिूिण उत्पन्न न करने वाले लघु उद्योग । फरवरी, 2016 में केन्रीर् प्रिूिण जनर्ंत्रण बोडा द्वारा िारी उद्योगों में वगीकरण के अनुसार गैर-प्रिूिणकारी उद्योग और अपररसंकटमय में, लघु और सेवा उद्योग, कृजि, पुष्प कृजि, उद्यान कृजि र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्री से उत्पािों को उत्पन्न करने वाले कृजि आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे। 13.

वृक्षों की कटाई । (क) राज्र् सरकार में सक्षम प्राजधकारी की पूवा अनुज्ञा के जबना वन, सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर र्ा वनों में वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई संबंजधत केंरीर् र्ा राज्र् अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंध के अनुसार जवजनर्जमत होंगे । 14.

वन उत्पािों या गैर काष् ठ वन उत्पािों का संग्रहण । लागू जवजधर्ों के अनुसार जवजनर्जमत होंगे । 15.

जवद्युत और संचार टावरों का पररजनमााण और केबलों के जबछाए िाने और अन्र् बुजनर्ािी ढांचे । लागू जवजधर्ों के अधीन जवजनर्जमत होंगे (भूजमगत केबल के जबछाए िाने को बढ़ावा दिर्ा जा सकेगा)। 16.

नागररक सुख सुजवधाओं सजहत अवसंरचनाएं । न्र्ूनीकरण उपार्ों को लागू जवजधर्ों, जनर्मों और जवजनर्मनों और उपलब्ध मागाििाक जसद्धांतों के अनुसार दकर्ा िाना ।

जवद्यमान स़िकों को चौ़िा करना और उन्हें सुिृढ़ करना तथा नवीन स़िकों का संजनमााण । न्र्ूनीकरण उपार्ों को लागू जवजियों, जनर्मों और जवजनर्मनों तिा उपलब्ध मागषिशषक जसिांतों के अनुसार दकया जाएगा । 18.

पर्ाटन से संबंजधत अन्र् दक्रर्ाकलाप िैसे गमा वार्ु गुब्बारें, हेलीकाप्टर, िोन,
माइक्रोलाइटस, आदि द्वारा पाररजस्ट्थजतकी संवेिी िोन क्षेत्र के ऊपर से उ़िना िैसे दक्रर्ाकलाप करना। 19.

पहा़िी ढालों और निी तटों का संरक्षण । 20.

राजत्र में र्ाजनक र्ातार्ात का संचलन । लागू जवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत होंगे । 21.

स्ट्थानीर् समुिार्ों द्वारा चल रही कृजि और बागवानी प्रथाओं के साथ िुग्ििाला, िुग्घ उद्योग, कृजि और मछली पालन । स्ट्थानीर् लोगों के उपर्ोग के जलए लागू जवजधर्ों के अधीन अनुज्ञात । 22.

फमों, कंपजनर्ों द्वारा ब़िे पैमाने पर वाजणजज्र्क पिुओं और कुक्कुट फामों की स्ट्थापना । स्ट्थानीर् आवश्र्कताओं को पूरा करने के जलए लागू जवजधर्ों के अधीन जवजनर्जमत (अन्र्था उपबंजित के जसवाय) होंगे । 23.

प्राकृजतक िल जनकार्ों र्ा सतही क्षेत्र में उपचाररत बजहस्रााव का जनथतारण । जल जनकायों में उपचाररत अपजशष्ट जल या बजहस्रााव के जनथसारण से बचा िाएगा और उपचाररत अपजिष्ट िल के पुन:चक्रण और पुन:उपर्ोग के जलए प्रर्ास दकए िाएंगे। अन्र्था लागू जवजधर्ों के अनुसार उपचाररत बजहस्रााव के पुनचाक्रण या प्रवाह के जनवाहन को जवजनर्जमत दकर्ा िाएगा। 24.

पर्ाावरणीर् िागरुकता । 5. पाररजस्ट्थजतकी संवेिी िोन की अजधसूचना की मानीटरी के जलए मानीटरी सजमजत- केंरीर् सरकार, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 3 की उपधारा (3) के अधीन इस अजधसूचना के उपबंधों की प्रभावी मानीटरी के जलए मानीटरी सजमजत का गठन करती है, िो जनम्नजलजखत से जमलकर बनेगी, अथाात्:- क्र.स. मानीटरी सजमजत का गठन पिनाम (i)

(2) मानीटरी सजमजत का कार्ाकाल तीन विा तक र्ा राज्र् सरकार द्वारा नई सजमजत के पुन: गठन तक के जलए होगा और तत्पश्चात मानीटरी सजमजत राज्र् सरकार द्वारा गरठत की िाएगी। (3) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533 (अ), तारीख 14 जसतम्बर, 2006 की अनुसूची में सजम्मजलत हैं, और िो पाररजस्ट्थजतकी संवेिी िोन में आते हैं, जसवार् इसके िो पैरा 4 के अधीन सारणी में र्था-जवजनर्िाष्ट प्रजतजिद्ध दक्रर्ाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण अनापजत्त के जलए केरींर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को जनर्िाष्ट दकर्ा िाएगा। (4) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533 (अ) तारीख 14 जसतंबर, 2006 की अनुसूची में सजम्मजलत नहीं है, और िो पाररजस्ट्थजतकी संवेिी िोन में आते हैं, जसवार् इसके पैरा 4 के अधीन सारणी में र्थाजवर्नाष्ट प्रजतजिद्ध दक्रलाकलापों के मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उसे संबंद्ध जवजनर्ामक प्राजधकरणों को जनर्िाष्ट दकर्ा िाएगा।
(5) मानीटरी सजमजत का सिस्ट्र्-सजचव र्ा संबद्ध उपार्ुि ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लंघन करता है, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के अधीन पररवाि फाइल करने के जलए सक्षम होगा।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 27th October, 2020 S.O. 3881(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 653 (E), dated the 31st January, 2019, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the public on the 4th February, 2019;

AND WHEREAS, objections and suggestions received from persons and stakeholders in response to the aforesaid draft notification were duly considered by the Central Government; AND WHEREAS, Nameri National Park and Sonai-Rupai Wildlife Sanctuary located in Sonitpur District of Assam; whereas Nameri National Park was declared as Nameri Tiger Reserve in the year 2000 vide Government of Assam Notification No. FRW-95/99/70, dated the 1st March, 2000, with a core area comprising of 200 square kilometers of Nameri National Park (notified in 1998 vide notification No. No. FRW-II/96/81 dated the 13th August, 1998) as core area and a buffer area on east and west of the core having an area of 144 square kilometers, making the total area of the Tiger Reserve 344 square kilometers and Sonai-Rupai Wildlife Santuary (notified in 1998 vide Notification No. FRW-33/98/11, dated the 4th September, 1998 with an area of 220 square kilometers was declared as Satellite Core of Nameri Tiger Reserve vide Government of Assam Notification No. FRM.236/2014/23, dated the 18th June, 2015 comprising of 120 square kilometers out of 220 square kilometers of the Sonai-Rupai Wildlife Sanctuary; both the Protected Areas are contiguous with the boundary and forested areas of Arunachal Pradesh with high biodiversity value; AND WHEREAS, both the Protected Areas are situated at the foothills of Eastern Himalaya comprising area of 200 square kilometers of Nameri National Park and 220 square kilometers of Sonai-Rupai Wildlife Sanctuary which needs secure corridor for Elephant population as well as needs proper biomass for the tiger population;
AND WHEREAS, the Nameri National Park and Sonai-Rupai Wildlife Sanctuary belongs to the North East Brahmaputra Valley Bio-geographic Province (9A) of North East India Bio-geographic Zone and contains Assam Valley Tropical Evergreen Forests, Sub Himalayan Light Alluvial Semi-Evergreen Forests, Eastern Alluvial Secondary Semi Evergreen Forests, Cane Brakes, Low Alluvial Savanna Woodland, Eastern Hollock Forests, Eastern Seasonal Swamp Forests, Eastern Dillenia Swamp Forests and Eastern Alluvial Grassland; and AND WHEREARS, major tree species of the Protected Areas are Lagerstroemia flos-regina, Mangifera sylvatica, Emblica officinalis, Spondius mangifera, Drimycarpus reamosus, Mansonia dipikae, Dysoxylum binectiferum, Crataeva religiosa, Terminalia belerica, Semicarpus anacardium, Oroxylum indicum, Trewia nudiflora, Tetramatis nudiflora, Chikrassia tabularis, Morus lavigata, Cryptocaria amydalima, Talauma hodgsonii, Ailanthus grandis, Phoebe goalparensis, Pterosprmum acrifolium, Dillenia pentagyna, Michelia Champaca, Cynocardia odorata, Gmelina arborea, Premna bengalensis, Nyssa sessiliflora, Melia azadiract, Euginia eperculata, Pterospermum acerifolium, Adina cordifolia, Terminalia chebula, Castanopsis spp, Litsia polyanthia, Terminalia myrocarpa, Cedrala toona, Geruga pinnata, Anthocephalus cadamba, Bauhinia purpurea, Michelia oblonga, Machilus globosa, Polyanthia jenkinsii, Duabanga sonneratioides, Albizzia odoratissima, Bridelia retusa, Erythrina spp, Evodia meliaefolia, Schima wallichii, Mesua ferrea, Dillenia indica, Kydia calycina, Michelia montana, Alstonia scholoris, Lagerstroemia parviflora, Cassia fistula, Sapium Baccatum, Bischofia javanica; while shrubs and grasses of the Protected Areas are Clerodendron siphonanthus, Morinda angustifolia, Leca acuminata, Alpinia molloucinensis, Adhatoda vasica, Coffia bengalensis, Clerodendron infortunatium, Wrightia tomentosa, Phyrium parviflora, Saccharum spontaneum, Neyrandia reynandiana, Typha elephantina, Arundo donax, Dalhonsis bracteata, Melostoma malabaricum, Phlogocanthus thysiflorus, Themi caudata and Alpinia alughas and Calamus latifolius, Calamus floribundus, Calamus flagellum, Dorris oblonga, Derris eliptica, Spatholobus roxburghii, Vitis latiflora, Tinospora cardifolia, Milletia condata, Dalbergia rimosa, etc are canes and climbers found in the Protected Areas; AND WHEREAS, the Nameri National Park and Sonai-Rupai Wildlife Sanctuary are home to eight globally threatened species, eleven threatened species and five near threatened species; and the Protected Areas besides supporting large diversity of resident and migrant avian population such as Ibis bill, Pallas's fishing eagle, slender billed vulture, Himalayan Griffon vulture, great hornbill, ruddy Shelduck, Margenger; and major mammal species of the Protected Areas are elephant Elephus maximus, tiger Panthera tigris, leopard Panthera pardus, clouded leopard Neofelis nebulosa, wild dog Cuon alpinus, black bear Ursus thibetanus, sloth bear Melursus ursinus, pigmy hog Porcula salvania (Re-Introduced), gaur Bos gaurus, samber Rusa unicolor, capped langur Trachypithecus pileatus, goldan cat Catopuma temmincki, Binturong Arctictis binturong, large civet Viverra zibetha, Indian pangolin Manis crassicaudata, Assamese Macaque Macaca assamensis, etc; and the Protected Areas has immense research, recreational and educational values;
AND WHEREAS, the increasing human population surrounding the Protected Areas is likely to have an adverse impact on the habitat, animals, birds and fishes of the Protected Areas in the long run; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1, around the Protected Area of Nameri National Park and Sonai-Rupai Wildlife Sanctuary as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 0 (zero) to 48 kilometres

around the boundary of Nameri National Park and Sonai-Rupai Wildlife Sanctuary, in Sonitpur and Udalguri Districts in the State of Assam as the Nameri National Park and Sonai-Rupai Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: -

Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 0 (zero) to 48 kilometres around the boundary of Nameri National Park and Sonai-Rupai Wildlife Sanctuary and the area of the Eco-sensitive Zone is 1338.62 square kilometres; zero extent is on the side of the Arunachal Pradesh border where Reserved Forest areas of the State and especially the Pakke Tiger Reserve are adjoining. (2) The boundary description of Nameri National Park and Sonai-Rupai Wildlife Sanctuary and its Eco-sensitive Zone is appended in Annexure-I. (3) The maps of the Nameri National Park and Sonai-Rupai Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA and Annexure-IIB. (4) Lists of geo-coordinates of the boundary of Nameri National Park and Sonai-Rupai Wildlife Sanctuary and Eco-sensitive Zone are given in Table A, Table B and Table C of Annexure-III.
(5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Table A and Table B of Annexure-IV.
Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco- sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj;
(xi) Assam State Pollution Control Board; and (xii) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, fishing areas, cattle rearing spots (khuti), lakes and other water bodies with supporting maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than those specified in clause (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as.- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including home stay; and (v) promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:-

(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the Protected Area or upto the extent of the Eco-sensitive Zone whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the Protected Area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.- Disposal and management of Solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management (ESM) of solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.

(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012. 2.
Setting of industries causing pollution (Water, Air, Soil, Noise, etc.). New industries and expansion of existing polluting industries in the Eco-sensitive Zone shall not be permitted: Provided that non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries

in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification and in addition the non-polluting cottage industries shall be promoted.
3.
Establishment of major hydro-electric project. Prohibited. 4.
Use or production or processing of any hazardous substances. Prohibited. 5.
Discharge of untreated effluents in natural water bodies or land area. Prohibited. 6.
Setting up of new saw mills, veneer mills or other wood based industries. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone. 7.
Setting up of brick kilns. Prohibited. 8.
Commercial use of firewood. Prohibited. 9.
Use of polythene bags. Prohibited. B. Regulated Activities 10.
Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for eco-tourism activities: Provided that, beyond one kilometer from the boundary of the Protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. 11.
Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents: Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.
12.
Small scale non polluting industries. Non polluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco- sensitive Zone shall be permitted by the competent authority. 13.
Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior

permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 14.
Collection of Forest Produce or Non- Timber Forest Produce. Regulated as per the applicable laws. 15.
Erection of electrical and communication towers and laying of cables and other infrastructures. Regulated under applicable laws (underground cabling may be promoted).

Infrastructure including civic amenities. Taking measures of mitigation as per the applicable laws, rules and regulations available guidelines. 17.
Widening and strengthening of existing roads and construction of new roads. Taking measures of mitigation as per the applicable laws, rules and regulation and available guidelines.
18.
Undertaking other activities related to tourism like flying over the Eco- sensitive Zone area by hot air balloon, helicopter, drones, microlites, etc. 19.
Protection of hill slopes and river banks. 20.
Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
21.
Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted as per the applicable laws for use of locals. 22.
Establishment of large-scale commercial livestock and poultry farms by firms, corporates and companies. Regulated (except otherwise provided) as per the applicable laws except for meeting local needs. 23.
Discharge of treated waste water or effluents in natural water bodies or land area. The discharge of treated waste water or effluents shall be avoided to enter into the water bodies and efforts shall be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water or effluent shall be regulated as per the applicable laws.

Environmental awareness. 5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S. Divisional Forest Officer, Western Assam Wildlife Division Member-Secretary. 6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures.- The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.
