No. 2649] NEW DELHI, THURSDAY, DECEMBER 10, 2015/AGRAHAYANA 19, 1937 पयावरण, वन और जलवायु परवतन मंालय अधसूचना नई दल, 9 दस बर, 2015 का.आ. 3335(अ).—न नलखत ाप अ धसूचना, िजसे के%&य सरकार, पया(वरण (संर-ण) अ धनयम, 1986 (1986 का 29) क2 धारा 3 क2 उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पठत उपधारा (1) 9वारा द:त शि<तय= का योग करते हुए, जार करने का Cताव करती है, पया(वरण (संर-ण) नयम, 1986 के नयम 5 के उपनयम (3) क2 अपे-ानुसार, जनसाधारण क2 जानकार के लए काशत क2 जाती है; िजनके उससे भाGवत होने क2 संभावना है, ; और यह सूचना द जाती है Hक उ<त ाप अ धसूचना पर, उस तारख से, िजसको इस अ धसूचना वाले भारत के राजपJ क2 तयां जनसाधारण को उपलKध करा द जाती हL, साठ दन क2 अव ध क2 समािMत पर या उसके पN चात् Gवचार Hकया जाएगा ; 2. ऐसा कोई Rयि<त, जो ाप अ धसूचना मS अंतGव(Tट Cताव= के संबंध मS कोई आ-ेप या सुझाव देने मS हतबX है, इस कार Gवनद(Tट अव ध के भीतर, के%&य सरकार 9वारा Gवचार Hकए जाने के लए, आ-ेप या सुझाव स चव, पया(वरण, वन और जलवायु पYरवत(न मंJालय, इंदरा पया(वरण भवन, जोर बाग रोड, अलगंज, नई दल- 110003 या ई-मेल पते: esz-mef@nic.in पर लखत प मS भेज सकेगा ।

और, नमेर राT \य उ9यान के चार= ओर के -ेJ को, िजसका GवCतार और सीमाएं इस अ धसूचना के पैरा 1 मS Gवनद(Tट हL, पया(वरण क2 tिTट से पारि%थ'तक संवेद* जोन के प मS सुरg-त और संरg-त करना तथा उ<त पारि%थ'तक संवेद* जोन मS उ9योग= या उ9योग= के वगu के चालन तथा संCकरण करने को तGषX करना आवNयक है ;

अतः, अब, के%&य सरकार, पया(वरण (संर-ण) नयम, 1986 के नयम 5 के उपनयम (3) और पया(वरण (संर-ण) अ धनयम, 1986 (1986 का 29) क2 धारा 3 क2 उपधारा (2) के खंड (v) और खंड (xiv) के साथ पठत और उपधारा (1) 9वारा द:त शि<तय= का योग करते हुए, असम मS नमेर राT \य उ9यान क2 सीमा से 5 Hकलोमीटर तक के GवC ताYरत -ेJ को नमेर राT \य उ9यान पाYरिC थतक2य संवेद जोन (िजसे इसमS इसके पN चात् पाYरिC थतक संवेद जोन कहा गया है) के प मS अ धसू चत करती है, िजसका Gववरण न नानुसार है, अथा(त् :--
1. पारि%थ'तक संवेद* जोन का ,व%तार और उसक. सीमाएं--(1) पाYरिC थतक संवेद जोन का GवCतार नमेर राT \य उ9यान क2 सीमा से 5 Hकलोमीटर तक पिNचमी, दg-णी और पूव^ सीमा तक है, नमेर राT \य उ9यान क2 पूव^ सीमा असम और अ]णाचल देश क2 अंतरा(xयीय सीमा है ।
(2) पाYरिC थतक संवेद जोन के भीतर आने वाले qाम= क2 सूची उपाबंध –I पर द गई हL । (3) नमेर राT \य उ9यान क2 सीमा के साथ जीपीएस सम%वयक उपाबंध II पर दए गए हL।
(4) पाYरिCथतक संवेद जोन का मान चJ अ-ांश और देशा%तर के साथ उपाबंध III पर उपाबX है ।
2. पारि%थ'तक संवेद* जोन के 4लए आंच4लक महायोजना –(1) राxय सरकार, पाYरिC थतक संवेद जोन के योजन के लए राजपJ मS इस अ धसूचना के अंतम काशन क2 तारख से दो वष( क2 अव ध के भीतर, Cथानीय Rयि<तय= के परामश( से, इस अ धसूचना मS संलy न अनुबंध= के सामंजC य से आंचलक महायोजना तैयार करेगी । (2) उ< त योजना राx य सरकार मS स-म ा धकार 9वारा अनुमोदत Hकया जाएगा ।

(3) पाYरिC थतक संवेद जोन के लए आंचलक महायोजना राx य सरकार 9वारा इस अ धसूचना मS यथाGवनद(T ट रत मS और सुसंगत कS &य और राx य Gव धय= और कS &य सरकार 9वारा जार माग(दश(क सXांत=, यद कोई ह=, के सामंजCय से तैयार क2 जाएगी । (4) आंचलक महायोजना संबं धत राx य Gवभाग= के साथ परामश( से तैयार क2 जाएगी, अथा(त्:-- (i) पया(वरण; (ii) वन;
(iii) शहर Gवकास; (iv) पय(टन; (v) नगरपालक; (vi) राजC व;
(vii) कृGष;
(viii) असम राx य दूषण नयंJण बोड(; (ix) संचाई; और
(x) लोक नमा(ण Gवभाग । (5)
आंचलक महायोजना अनुमोदत Gव9यमान भू-उपयोग, अवसंरचना और H{याकलाप= पर कोई नबkधन अ धरोGपत नहं करेगी जब तक Hक इस अ धसूचना मS इस कार Gवनद(T ट न Hकया जाए और उ< त आंचलक महायोजना सभी अवसंरचना और काय(कलाप= मS द-ता और पाYरिC थतक2य अनुकूलता का सुधार करेगी । (6) आंचलक महायोजना मS अनाjछादत -ेJ= के जीणuXार, Gव9यमान जल नकाय= के संर-ण, आवाह -ेJ= के बंधन, जल-संभर= के बंधन, भूतल जल के बंधन, मृदा और नमी संर-ण, Cथानीय समुदाय= क2 आवNयकताओं तथा पाYरिCथतक2 और पया(वरण से संबं धत ऐसे अ%य पहलुओं, िजन पर |यान देना आवNयक है, के लए उपबंध ह=गे । (7)
आंचलक महायोजना सभी Gव9यमान पूजा C थल=, qाम= और नगरय बंदोबCत=, वन= के कार और HकC म=, जनजातीय -ेJ, कृGष -ेJ=, ऊपजाऊ भूम, हYरत -ेJ जैसे उ9यान और उसी कार के C थान, उ9यान कृGष -ेJ, आHक( ड=, झील= और अ%य जल नकाय= का अ~यकंन करेगी । (8)
आंचलक C थानीय समुदाय= क2 जीवकोपाज(न को सुनिN चत करने का सुनN चय करेगी ।
3. रा6य सरकार 7वारा 8कए जाने वाले उपाय-- राxय सरकार इस अ धसूचना के उपबंध= को भावी करने के लए न नलखत उपाय करेगी, अथा(त् :-- (1) भू-उपयोग - पाYरिC थतक संवेद जोन मS वन=, उ9यान-कृGष -ेJ=, कृGष -ेJ=, आमोद-मोद के योजन के लए

चि%हत Hकए गए पाक और खुले Cथान= का वाणिxयक और औ9यो गक संबX Gवकास H{याकलाप= के लए उपयोग या संपYरवत(न नहं होगा : परंतु पाYरिCथतक संवेद जोन के भीतर कृGष भूम का संपYरवत(न, मानीटर समत क2 सफाYरश पर और राxय सरकार के पूव( अनुमोदन से, Cथानीय नवासय= क2 आवासीय जरत= को पूरा करने के लए और पैरा 4 क2 सारणी के Cतंभ (2) के सामने सूचीबX H{याकलाप= को पूरा करने के लए अनु€ात ह=गे, अथा(त् :-
(i) पाYरिC थतक2य अनुकूल पय(टन H{याकलाप= के लए पय(टक= के अC थायी आवासन के लए पाYरिC थतक2य अनुकूल आरामगाह जैसे टSट, लकड़ी के मकान आद ; (ii) Gव9यमान सड़क= को चौड़ा और सुtढ़ बनाना तथा नई सड़क= का सि% नमा(ण; (iii) दूषण उ:प%न न करने वाले लघु उ9योग;
(iv) वषा( जल संचयन; और

(v) कुटर उ9योग, िजसके अंतग(त qामीण उ9योग, सुGवधाजनक Cटोर और C थानीय सुGवधाएं भी हL : परंतु यह और Hक राxय सरकार के पूव( अनुमोदन और संGवधान के अनुj छेद 244 या त:समय वृ:त Gव ध के उपबंध= के अनुपालन के mबना, िजसके अंतग(त अनुसू चत जनजात और अ%य परंपरागत वन नवासी (वन अ धकार= क2 मा%यता) अ धनयम, 2006 (2007 का 2) भी है, वाणिxयक या उ9योग Gवकास H{याकलाप= के लए जनजातीय भूम का उपयोग अनु€ात नहं होगा :
परंतु यह और भी Hक पाYरिC थतक संवेद जोन के भीतर भू-अभलेख= मS पाई जाने वाल कोई Jुट मानीटर समत के Gवचार ाMत करने के पN चात् राxय सरकार 9वारा :येक मामले मS एक बार संशो धत होगी और उ<त Jुट के संशोधन क2 भारत सरकार के पया(वरण, वन और जलवायु पYरवत(न मंJालय को सूचना देनी होगी :
परंतु यह और भी Hक उपयु(<त Jुट के संशोधन मS इस उप पैरा के अधीन यथा उपबं धत के सवाय Hकसी भी दशा मS भू-उपयोग का पYरवत(न सि मलत नहं होगा :
परंतु यह और भी Hक हYरत -ेJ जैसे वन -ेJ, कृGष -ेJ आद मS कोई पाYरणामक कटौती नहं होगी और अयु< त या अनु: पादक कृGष -ेJ= मS पुन: वनीकरण करने के यास Hकए जाएंगे ।
(2) "ाकृ'तक जल-=ोत -- आंचलक महायोजना मS सभी ाकृतक ‚ोत= क2 पहचान क2 जाएगी और उनके संर-ण और पुनन(वीकरण के लए योजना सि मलत होगी और राx य सरकार 9वारा ऐसे -ेJ= पर या उनके नकट Gवकास H{याकलाप तGषX करने के लए ऐसी रत से माग(नदƒश तैयार Hकए जाएंगे । (3) पयटन – (क) पाYरिCथतक संवेद जोन के भीतर पय(टन संबंधी H{याकलाप, पय(टन महायोजना के अनुसार ह=गे, जो आंचलक महायोजना का भाग प ह=गे ।
(ख) पय(टन महायोजना असम सरकार के पय(टन Gवभाग 9वारा वन और पया(वरण Gवभाग के परामश( से तैयार होगी ।
(ग) पय(टन संबंधी H{याकलाप न नलखत के अधीन Gवनयमत ह=गे, अथा(त् :- (i) पाYरिCथतक संवेद जोन के भीतर सभी नए पय(टन H{याकलाप= या Gव9यमान पय(टन H{याकलाप= का GवCतार कS &य सरकार, पया(वरण, वन और जलवायु पYरवत(न मंJालय 9वारा जार माग(नदेश= के अनुसार होगा िजसमS पाYरिCथतक पय(टन, पाYरिCथतक श-ा और पाYरिCथतक Gवकास को मह:व दया जाएगा और पाYरिCथतक संवेद जोन क2 वहन -मता के अ|ययन पर आधाYरत होगा ;
(ii) पाYरिC थतक अनुकूल पय(टन H{याकलाप= के संबं धत पय(टक= के अC थायी नवास के लए आवासन के सवाय पाYरिCथतक संवेद जोन के भीतर होटल और Yरसाट( के नए संनमा(ण नमेर राT \य उ9यान क2 सीमा के 1 Hकलोमीटर के भीतर अनु€ात नहं ह=गे ।

परंतु राT \य उ9यान क2 सीमा के 1 Hकलोमीटर के परे पाYरिCथतक संवेद जोन के GवCतार तक नए होटल= और Yरसाट के Cथापना को पाYरिCथतक2य अनुकूल पय(टन सुGवधाओं के लए पूव( निNचत और नामनद(Tट -ेJ= मS और पय(टन महायोजना के अनुसार अनु€ात Hकया जाएगा ।
(iii) आंचलक महायोजना का अनुमोदन Hकए जाने तक, पय(टन के लए Gवकास और Gव9यमान पय(टन H{याकलाप= के GवCतार को वाCतGवक Cथल Gवनद(Tट संवी-ा तथा मानीटर समत क2 सफाYरश पर आधाYरत संबं धत Gवनयामक ा धकाYरय= 9वारा अनु€ात Hकया होगा । (4) नैसगक ,वरासत -- पाYरिCथतक संवेद जोन मS मह:वपूण( नैस ग(क Gवरासत के सभी Cथल= जैसे सभी जीन कोश आरg-त -ेJ, शैल Gवरचनाएं, जल पात=, झरन=, घाट माग, उपवन=, गुफाओं, Cथल=, „मण, अN वरोहण, पातो आद क2 पहचान क2 जाएगी और उ%हS पYररg-त Hकया जाएगा तथा उनक2 सुर-ा और संर-ा के लए इस अ धसूचना के काशन क2 तारख से छह मास के भीतर, उपयु<त योजना बनाई जाएगी और ऐसी योजना आंचलक महायोजना का भाग होगा ।

(5) मानव 'न4मत ,वरासत % थल - पाYरिC थतक संवेद जोन मS भवन=, संरचनाओं, शप-त य, ऐतहासक, कला:मक और सांCकृतक मह:व के -ेJ= और अहात= क2 पहचान क2 जाएगी और इस अ धसूचना के काशन क2 तारख से छह मास के भीतर उनके संर-ण क2 योजनाएं तैयार क2 जाएंगी तथा आंचलक महायोजना मS सि मलत क2 जाएगी ।
(6) @ व'न "दूषण -- पाYरिCथतक संवेद जोन मS | वन दूषण के नयंJण के लए राx य सरकार का पया(वरण Gवभाग या पंजाब राx य दूषण नयंJण बोड(, वायु (दूषण नवारण और नयंJण) अ धनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए नयम= के उपबंध= के अनुसरण मS माग(दश(क सXांत और Gवनयम तैयार करेगा ।
(7) वायु "दूषण -- पाYरिCथतक संवेद जोन मS, वायु दूषण के नयंJण के लए राx य सरकार का पया(वरण Gवभाग या पंजाब राx य दूषण नयंJण बोड(, वायु (दूषण नवारण और नयंJण) अ धनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए नयम= के उपबंध= के अनुसरण मS माग(दश(क सXांत और Gवनयम तैयार करेगा ।
(8) बBह=ाव का 'न%सारण -- पाYरिCथतक संवेद जोन मS उपचाYरत बह‚ाव का नCसारण जल (दूषण नवारण तथा नयंJण) अ धनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए नयम= के उपबंध= के अनुसार होगा । (9) ठोस अप4शEट -- ठोस अपशTट= का नपटान न नलखत प मS होगा - (i) पाYरिCथतक संवेद जोन मS ठोस अपशTट= का नपटान भारत सरकार के त:कालन पया(वरण और वन मंJालय क2 समय-समय पर यथा संशो धत अ धसूचना सं. का.आ. 908(अ), तारख 25 सतंबर, 2000 को काशत नगरपालक ठोस अपशTट (बंध और हथालन) नयम, 2000 के उपबंध= के अनुसार Hकया जाएगा ;
(ii) Cथानीय ा धकरण जैव न नीकरणीय और अजैव न नीकरणीय संघटक= मS ठोस अपशTट= के संपृथ<कन के लए योजनाएं तैयार करSगे ;
(iii) जैव न नीकरणीय सामqी को अ धमानतः खाद बनाकर या कृम खेती के मा|यम से पुनःचH{त Hकया जाएगा ;
(iv) अकाब(नक सामqी का नपटान पाYरिCथतक संवेद जोन के बाहर पहचान Hकए गए C थल पर Hकसी पया(वरणीय Cवीकृत रत मS होगा और पाYरिCथतक संवेद जोन मS ठोस अपशT ट= को जलाना या भC मीकरण अनु€ात नहं होगा ।
(10) जैव च8कF सीय अप4शE ट- पाYरिCथतक संवेद जोन मS जैव चHक:सीय अपशTट= का नपटान भारत सरकार के त:कालन पया(वरण और वन मंJालय क2 समय-समय पर यथासंशो धत अ धसूचना सं.का.आ.630 (अ) तारख 20 जुलाई, 1998 9वारा काशत जैव चHक:सीय अपशTट (बंध और हथालन) नयम, 1998 के उपबंध= के अनुसार Hकया जाएगा । (11) यानीय परवहन - पYरवहन क2 यानीय गतGव धयां आवास के अनुकूल Gवनयमत ह=गी और इस संबंध मS आंचलक महायोजना मS Gवशेष उपबंध अ धक थत Hकए जाएंगे और आंचलक महायोजना के तैयार होने और पया(वरण, वन और जलवायु पYरवत(न मंJालय मS स-म ा धकार 9वारा अनुमोदत होने तक, मानीटर समत वृ:त नयम= और Gवनयम= के अनुसार यानीय गतGव धय= के अनुपालन को मानीटर करेगी । (12) औ7योगक इकाइयां - (क) C ताGवत पाYरिC थतक संवेद जोन मS नए काT ठ आधाYरत उ9योग= क2 C थापना को सवाए Gव ध के अनुसार C थाGपत काT ठ आधाYरत उ9योग= के अनु€ात नहं Hकया जाएगा ।
(ख) जल, वायु, मृदा, | वन दूषण काYरत करने वाले Hकसी नए उ9योग क2 C ताGवत पाYरिC थतक संवेद जोन मS C थापना को अनु€ात नहं Hकया जाएगा ।

4. पारि%थ'तक संवेद* जोन मI "'त,षJ और ,व'नय4मत 8कए जाने वाले 8KयाकलापL क. सूची - पाYरिCथतक संवेद जोन मS सभी H{याकलाप पया(वरण (संर-ण) अ धनयम, 1986 (1986 का 29) के उपबंध= 9वारा शासत ह=गे और नीचे द गई तालका मS Gवनद(Tट रत मS Gवनयमत ह=गे, अथा(त् :-- सारणी Kम सं. 8Kयाकलाप ट*का-BटMपणी (1) (2) (3) "'त,षJ 8Kयाकलाप : (1) वाणिxयक खनन, प:थर क2 खदान और उनको तोड़ने क2 इकाइयां ।
(क) सभी कार के खनन (लघु और वृहत खनज), प:थर क2 खानS और उनको तोड़ने क2 इकाइयां वाCतGवक Cथानीय नवासय= क2 घरेलू आवNयकताओं िजसमS नजी उपयोग के लए मकान= के संनमा(ण या मर मत के लए भूम को खोदना और मकान बनाने के लए देशी टाइ स या †ट= का नमा(ण करना भी सि मलत है, के सवाय नहं ह=गी ; (ख) खनन संH{याएं, माननीय उjचतम %यायालय क2 Yरट या चका (सGवल) सं. 1995 का 202 ट.एन. गौडाबम(न थ]मूलपाद बनाम भारत सरकार के मामले मS आदेश तारख 4.8.2006 और Yरट या चका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मS तारख 21.04.2014 के अंतYरम आदेश के अनुसरण मS सव(दा चालन होगा ।
(2) आरा मशीन= क2 Cथापना । पाYरिCथतक संवेद जोन के भीतर नई और Gव9यमान आरा मशीन= का GवC तार अनु€ात नहं होगा ।
(3) Hकसी पYरसंकटमय पदाथ का उपयोग या उ:पादन । लागू Gव धय= के अनुसार तGषX (अ% यथा उपबं धत के सवाय) । (4) जल या वायु या मृदा या | वन दूषण काYरत करने वाले उ9योग= क2 C थापना ।

(14) खाई-C थल ।

कोई नई खाई C थल C थाGपत नहं क2 जाएगी । पुराने खाई C थल लागू Gव धय= के अधीन Gवनयमत ह=गे ।

NOTIFICATION New Delhi, the 9th December, 2015 S.O. 3335(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Aliganj, New Delhi-110003, or send it to the e-mail address of the Ministry at: - esz-mef@nic.in. Draft Notification WHEREAS, the Nameri National Park is situated between the northern part of Sonitpur District of Assam and lies along the foothills of Eastern Himalayas of Arunachal Pradesh spread over an area of 200 square kilometre. AND WHEREAS, the flora and fauna represent rich biological significance of this Sanctuary. AND WHEREAS, the habitat of Nameri is made up of tropical evergreen, semi-evergreen, moist deciduous forests with cane brakes and narrow strips of open grassland along rivers. Grassland comprise less than 10 percent of the total area of the park while the semi-evergreen and moist deciduous species dominate the area. Forest types available within the reserve are: Assam Valley Tropical Evergreen Forests, Sub Himalayan Light Alluvial Semi- Ever- green Forests, Eastern Alluvial Secondary Semi Evergreen Forests, Cane Brakes, Low Alluvial Savanna Woodland, Eastern Hollock Forests, Eastern Seasonal Swamp Forests, Eastern Dillenia Swamp Forests and Eastern Wet Alluvial Grassland. AND WHEREAS, The list of fauna includes more than 25 species of mammals: Asian elephant, Tiger, Leopard, Clouded Leopard, Sloth Bear, Himalayan Black Bear, Indian Bison, Wild dog (Dhole), Sambar, Barking Deer, Hog Deer, Hispid Hare, Indian Hare, Capped Langur, Slow Loris, Assamese Macaque, Rhesus Macaque, Himalayan Yellow throated Martin, Malayan Giant Squirrel, Flying Squirrel, Wild boar, Large Indian civet, small Indian civet, leopard cat etc. Nameri has also got rich and varied bird diversity that includes 374 species recorded so far. Of the 374 species, eight species are globally threatened ( White-winged wood Duck, Rufous-necked Hornbill, Pallash Fish Eagle, White- rumped Vulture, Slender billed Vulture, Greater Spotted Eagle, Lesser Adjutant Stork, Jerdon's Babbler) and five species are of near threatened category ( Whitecheeked Patridge, Black-bellied Tern, White-tailed Eagle, Lesser Fish Eagle and Red-headed Vulture). Reptile check-list includes: Reticulated Python, Burmese Python, Monitor lizard, Indian cobra, King cobra, Banded krait, pit viper, Common blind snake, flying snake and few other species. River Jia- Bhoreli and other tributaries harbour a variety of species and important ones are Golden Masher, Rou, Kandhuli, Bhakua, Bato, Lasim, Ari, Borali, Xinghi, Magur, Xol, Goroi, Kawoi and Kholihiona. Amongst invertebrates, eighty species of butterflies and moths have been listed. AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which specified in paragraph 1 of this notification, around the Nameri Wildlife Sanctuary as Eco sensitive zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the power conferred by sub- section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent upto 5.0 kilometre around the boundary of Nameri National Park in the State of Assam as the Nameri National Park Eco- sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and Boundaries of Eco-sensitive Zone.- (1) The Eco-Sensitive Zone
shall be with an extent upto 5.0 kilometre around the boundary of Nameri National Park in Western, Southern and Eastern Side, Northern boundary of Nameri National Park is the interstate border of Assam and Arunachal Pradesh.
(2) The list of villages falling in Eco-sensitive Zone are given at Annexure-I.
(3) The Global Positioning System Co-ordinates of points along the boundary of Nameri National Park are given at Annexure-II.

(4) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as Annexure-III. 2.
Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2)
The said Plan shall be approved by the Competent Authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment,
(ii) Forest,

for integrating environmentally and ecologically consideration into it.

The Zonal Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies. (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development for livelihood security of local communities. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1)
Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the activities listed against serial numbers 12, 23, 34, 35 and 36 in column (2) of the Table in paragraph 4, namely:- (i)
Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly tourism activities, (ii)
Widening and strengthening of existing roads and construction of new roads. (iii)
Small scale industries not causing pollution,
(iv)
Rainwater harvesting, and

(v)
Cottage industries including village industries, convenience stores and local amenities: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas. (2)
Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.
(3)
Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan, which shall form part of the Zonal Master Plan. (b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i)
all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be based on carrying capacity study of the Eco-sensitive Zone in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate Change and the Eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time) with emphasis on Eco-tourism, Eco-education and Eco-development.; (ii)
new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the Nalsarovar Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities:

Provided that beyond the distance of one kilometer from the boundary of the protected areas till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated areas for Eco-tourism facilities as per the Tourism Master Plan.
(iii)
till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee. (4)
Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Assam State Pollution Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made there under. (7)
Air pollution.- The Environment Department of the State Government or Assam State Pollution Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made there under. (9)
Solid wastes. - Disposal of solid wastes shall be as under:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September, 2000 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) the inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco- sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone (10) Bio-medical waste.- The Bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20th July, 1998 as amended from time to time. (11)
Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made there under. (12) Industrial Units.- (a) No establishment of new wood based Industries within the proposed Eco-sensitive zone shall be permitted except the existing wood based Industries set up as per the Law. (b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco-sensitive zone shall be permitted.
4.
List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the Table below, namely:-

UOI in W.P.(C) No.202 of 1995 and order of the Hon’ble Supreme Court dated 21.04.2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012. 2. Setting up of saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.
3. Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws. 4. Setting up of industries causing water or air or soil or noise pollution. No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted.
5. Establishment of new major thermal and hydro-electric projects
Prohibited (except as otherwise provided) as per applicable laws. 6. Commercial use of firewood. Prohibited (except as otherwise provided) as per applicable laws. 7. Use of plastic bags Prohibited (except as otherwise provided) as per applicable laws. 8. Undertaking activities related to tourism like over-flying the National Park Area by aircraft, hot-air balloons Prohibited (except as otherwise provided) as per applicable laws.

9 Discharge of untreated effluents and solid waste in natural water bodies or land area Prohibited (except as otherwise provided) as per applicable laws. 10 Mobile Towers Prohibited (except as otherwise provided) as per applicable laws. 11 Cattle herds Cattle herds shall not be kept within 500 m from the boundary of the National Park. Regulated Activities 12 Establishment of hotels and resorts No new commercial hotels and resorts shall be permitted within one kilometer of the boundary of the Protected Area except for accommodation for temporary occupation of tourists related to Eco-friendly tourism activities.
However, beyond one kilometer and upto the extent of the Eco- sensitive Zone all new tourism activities or expansion of existing activities would in conformity with the Tourism Master Plan. 13 Construction activities

No new commercial construction of any kind shall be permitted within one kilometer from the boundary of the Protected Area: Provided that, local people shall be permitted to undertake construction in their land for their residential use including the activities listed in sub-paragraph (1) of paragraph 3:
Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the Competent Authority as per applicable rules and regulations, if any. Further, beyond one kilometer and upto the extent of the Eco- sensitive Zone all new tourism activities or expansion of existing activities would in conformity with the Tourism Master Plan. 14 Trenching ground Establishing of new trenching ground is prohibited. Old trenching grounds are to be regulated under applicable laws. 15 Discharge of treated effluents and solid waste in natural water bodies or land area. Regulated under applicable laws. 16 Air and Vehicular Pollution
Regulated under applicable laws. 17 Noise pollution
Regulated under applicable laws. 18 Extraction of ground water Regulated under applicable laws. 19 Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government;
(b) the felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder. (c) in case of Reserve Forests and Protected Forests the Working Plan prescriptions shall be followed. 20 Migratory graziers Regulated under applicable laws and as per Zonal Master Plan.

23 Widening and strengthening of existing roads and construction of new roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable. 24 Fencing of existing premises of hotels and lodges. Regulated under applicable laws. In order to allow free movement of wildlife, hotels or other commercial establishments within the ESZ shall not fence their properties with barbed wire and no fence shall be higher than 1 meter. 5.  Monitoring Committee.- (1) The Central Government  hereby constitutes a Monitoring Committee for effective 
   

monitoring of the Eco-sensitive Zone, which shall comprise of following namely :-
i) Deputy Commissioner, Sonitpur

ii) An expert in the area of ecology and environment

Member to be nominated by the Government of Assam
for a period of one year.

iii) One representatives of Non-governmental Organization

Member (working in the field of environment including heritage
conservation) to be nominated by the Government of
India for a period of one year). iv) Regional Officer, Assam State Pollution Control Board - Member v) District Forest Officer, Sonitpur

(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14th September, 2006 but are falling in the Eco-sensitive Zone, except the prohibited activities as specified in Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. 27 Movement of vehicular traffic at night Regulated for commercial vehicles under applicable laws 28 Introduction of exotic species Regulated under applicable laws 29 Sign Board and Hoardings Regulated under applicable laws 30 Protection of hill slopes and river banks No construction activity unless otherwise permitted by under the Zonal Master Plan shall be undertaken on the hill with slopes more than 1 to 10 and also upto 100 meters from the banks of any river, and natural nallah. (5) The Member Secretary of the Monitoring Committee or the concerned Collector or the concerned park in- charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6)
The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Central Government in the Ministry of Environment, Forest and Climate Change as per pro forma given in Annexure IV. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 6. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 7.
The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F.
