No. 1042] NEW DELHI, THURSDAY, APRIL 13, 2017/CHAITRA 23, 1939 पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय अिधसूचना नई ᳰद᭨ली, 7 अᮧैल, 2017 का.आ.1174 (अ).— भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. 3328 (अ) तारीख 7 ᳰदस᭥बर, 2015, उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ ᮧितयां, िजसमᱶ यह उᲦ अिधसूचना अंतᳶवᭅ᳥ है, उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुझाव आमंिᮢत करते ᱟए एक ᮧाᱧप अिधसूचना ᮧकािशत कᳱ गई थी;

और, उᲦ ᮧाᱧप अिधसूचना के ᮧ᭜युᱫर मᱶ ᳰक᭠हᱭ ᳞िᲦयᲂ और पणधाᳯरयᲂ से कोई आᭃेप और सुᭃाव ᮧा᳙ नहᱭ ᱟए थे;
और, ᮰ीलंकामाले᳡र व᭠यजीव अभयार᭛य उᱫर 14 0 43' 12" और उᱫर अᭃांश 14 0 28' 12" और पूवᭅ 78 0 48' 00" और पूवᭅ देशा᭠तर 79° 01' 48" के बीच ि᭭थत क᲻पा िज़ले के दिᭃण पहािड़यᲂ मᱶ लंकामलाई कᳱ पहाड़ी ᮰ृंखलाᲐ मᱶ आंᮥ ᮧदेश रा᭔य के क᲻पा िज़ले क᲻पा और ᮧोदोतूर वन ᮧभाग मᱶ ि᭭थत है और लंकाम᭨ला आरिᭃत वन व᭠यजीव अभयार᭛य गᳯठत करता है तथा अभयार᭛य का कुल ᭃेᮢ 464.42 वगᭅ ᳰकलोमीटर है| जो ᳰक कडापा वन ᮧभाग के अंतगᭅत 263.92 वगᭅ ᳰकलोमीटर का ᭃेᮢफल है और ᮧोदोᱫर वन ᮧभाग के अंतगᭅत 200.50 वगᭅ ᳰकलोमीटर ᭃेᮢ मᱶ है;

और, ᮰ीलंकामाले᳡र व᭠यजीव अभयार᭛य अिधकांश संकटाप᳖ के िलए िसफᭅ एक कᱶᮤ है और जेडᲃन डबल बᱹिडज कोउरसर (कसᭅᳯरयस िबटरᲤाटस) (कालीवी कोडी), िव᳡ मᱶ ᭠यूनतम ᭄ात पᭃी है जो ᳰक आंᮥ ᮧदेश रा᭔य मᱶ ᭭थािनक है और अभयार᭛य मᱶ पᱶथेरा पाडᭅस (तᱶदुआ) (िचᱧता पुली), ᱧसा यूिनकोलर (सांभर) (कािनथी), एि᭍सस एि᭍सस (चीतल या िचᱫीदार िहरण) (डु᭡पी), कुओनलिपनस (जंगली कुᱫा या ढोल) (रे᭒कु कूका), टेᮝासरोस Ფाडᮝॉिमस (चौसᱭगा मृग) (चोऊसᱭगा) (कᲂडा गोरे) और अनेक सरीसृप और पᭃी ᮧजाितयां भी बसी ᱟई है ; और, ᭃेᮢ मᱶ अ᭜यंत ᮧचुर ᮧाणीजातीय एवं वन᭭पतीय िविवधता है और रेड सᱶडरस (पीटरोकारपस संटालीनस) (रेड सॉ᭠डसᭅ) (एररा चंदानमू) कᳱ बृहत् जीवसं᭎या, जो इस ᭃेᮢ मᱶ ᭭थानीय है ; और, ᮰ीलंकामाले᳡र व᭠यजीव अभयार᭛य मᱶ मु᭎यतः दिᭃणी उ᭬णकᳯटबंधीय शु᭬क पणᭅपाती िविवध ᮧकार 5ए/सी3 जैसा पीटरोकरपस संटालीनस (रेड सॉ᭠डसᭅ) (एररा चंदानमू), अनोगेइसस ᭭पा. (चीइᱧमनु), कैरी᭭सा कैरानडस (कालीमी चेᱫु), जीजयफस

THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ए᭍सलोफाइसेस (गोटी), डोडोनाइया बीसकोसा (बांदेडू), मैटनस इमरगीनाटा, िडयोफाइरोस कालोरोए᭍सलोन (उलᱭटा), हाडᭅिवकᳱया बीनाटा (येपी), टारेना एिशयाᳯटका (कु᭡पी पु᭪वा) और िडयोफाइरोस फेरᳯरया (िच᳖ा उᳲ᭨लंथा) इस तरह कᳱ चᱹिपयन और सेठ वगᱮकरण मᱶ ᮧजाितयां पाई जाती है;

और, अभयार᭛य मᱶ जलᮕहण के िलए मु᭎य जल िनकास का ᱧप है जो संपूणᭅ ᳯरजवᭅ के ऊपर बᱟसं᭎यक धारा ᮧवािहत होकर पे᳖ार नदी से जोड़ती है और अभयार᭛य मᱶ ऐितहािसक समय के दौरान बने अनेक सदानीर जल ᳫोत और मानव िनᳶमᭅत टᱹक भी है ; और, ᮰ीलंकामाले᳡र व᭠यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸दᭅ᳥ हᱹ, पयाᭅवरण कᳱ दृि᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष᳍ करना आव᭫यक है; अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उप धारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, आंᮥ ᮧदेश रा᭔य मᱶ ᮰ीलंकामाले᳡र व᭠यजीव अभयार᭛य कᳱ सीमा से 1 ᳰकलोमीटर तक के िव᭭ ताᳯरत ᭃेᮢ को ᮰ीलंकामाले᳡र व᭠यजीव अभयार᭛य पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया है) के ᱨप मᱶ अिधसूिचत करती है, िजसका िववरण िन᳜ानुसार है, अथाᭅत् :--

1. पाᳯरि᭭थितक संवेदी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) पाᳯरि᭭थितक संवेदी जोन का िव᭭तार ᮰ीलंकामाले᳡र व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर तक ᭃेᮢ का है और इसमᱶ क᲻पा िजले के 16 ᮕाम सि᭥मिलत हᱹ | पाᳯरि᭭थितक संवेदी जोन का कुल ᭃेᮢ 338 वगᭅ ᳰकलोमीटर है । (2) इस अिधसूचना मᱶ पाᳯरि᭭थितक संवेदी जोन मᱶ ि᭭थत ᮕामᲂ कᳱ सूची इसके िनदᱷशांकᲂ के साथ उपाबंध I मᱶ दी गई है । (3) इस अिधसूचना मᱶ अᭃांश और देशा᭠तर के साथ पाᳯरि᭭थितक संवेदी जोन सीमा का मानिचᮢ उपाबंध II के ᱧप मᱶ उपाब᳍ है ।
2. पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजनᲂ के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से, और इस अिधसूचना मᱶ ᳰदए गए अनुबंधᲂ का पालन करते ᱟए आंचिलक महायोजना तैयार करेगी । आचंिलक महायोजना का अनुमोदन रा᭔य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा ᳰकया जाएगा | (2) पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना रा᭔य सरकार ᳇ारा ऐसी रीित जैसा इस अिधसूचना मᱶ िविन᳸दᭅ᳥ है और सुसंगत के᭠ᮤीय और रा᭔य िविधयᲂ तथा के᭠ᮤीय सरकार ᳇ारा जारी मागᭅदशᭅक िस᳍ांतᲂ, यᳰद कोई हो, के अनुᱨप भी तैयार कᳱ जाएगी | (3) आंचिलक महायोजना सभी संब᳍ रा᭔य िव भागᲂ के साथ परामशᭅ से पयाᭅवरणीय और पाᳯरि᭭थितक िवचारणᲂ को उसमᱶ एकᳱकृत करने के िलए तैयार कᳱ जाएगी, अथाᭅत्:--
   (i) पयाᭅवरण ; (ii) वन और व᭠यजीव ;
   (iii) कृिष; (iv) राज᭭ व; (v) शहरी िवकास; (vi) पयᭅटन;
   (vii) ᮕामीण िवकास;
   (viii) ᳲसंचाई और बाढ़ िनयंᮢण; (ix) नगरपािलका;
   (x) पंचायती राज; (xi) लोक िनमाᭅण िवभाग ।

आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸दᭅ᳥ न हो और आंचिलक महायोजना मᱶ सभी अवसंरचना मᱶ दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी । (5) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान देना आव᭫यक है, के िलए उपबंध हᲂगे ।

आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, जनजातीय ᭃेᮢ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, आ᳸कᭅडᲂ, झीलᲂ और अ᭠य जल िनकायᲂ का मानिचᮢᲂ के साथ अ᭤यकंन करेगी और योजना को मानिचᮢᲂ मᱶ ᳰदए गए िव᳒मान तथा ᮧ᭭तािवत भूिम उपयोग सुिवधाᲐ के िववरण ᳇ारा समᳶथᭅत ᳰकया जाएगा। (7) आंचिलक महायोजना ᭭ थानीय पाᳯरि᭭ थतकᳱय जोन मᱶ िवकास को िविनियमत करेगी िजससे समुदायᲂ कᳱ जीवकोपाजᭅन कᳱ सुरᭃा के िलए पाᳯरि᭭ थितकᳱ अनुकूल िवकास का सुिन ᭫ चय ᳰकया जा सके ।
(8) आंचिलक महायोजना ᭃेᮢीय िवकास योजना के साथ सह-अंतक होगी । (9) आंचिलक महायोजना इस अिधसूचना मᱶ ᳰदए गए उपबंधᲂ के संबंध मᱶ अपने कायᲄ के बाहर ले जाने के िलए िनगरानी सिमित के िलए एक संदभᭅ द᭭तावेज तैयार करेगी । 3. रा᭔य सरकार ᳇ारा ᳰकए जाने वाले उपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय करेगी, अथाᭅत् :-- (1) भू-उपयोग – (क) पाᳯरि᭭थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :
(ख) परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष और अ᭠य भूिम का संपᳯरवतᭅन िनगरानी सिमित कᳱ िसफाᳯरश पर और ᭃेᮢीय नगर योजना अिधिनयम के तहत सᭃम ᮧािधकारी के पूवᭅ अनुमोदन के से और यथा लागू के᭠ᮤीय/रा᭔य सरकार के अ᭠य िनयमᲂ और िविनयमᲂ, जो ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए आव᭫यक हᱹ, अनु᭄ात ᳰकया जा सकेगा, जैसे:- i. िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदृढ करना तथा नई सड़कᲂ का संिनमाᭅण; ii.
बुिनयादी ढांचᲂ और नागᳯरक सुिवधाᲐ का संिनमाᭅण और नवीकरण; iii.
ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग; iv. कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण उ᳒ोग हᱹ; सुिवधाजनक भ᭛डार और ᭭थानीय सुख सुिवधाᲐ जो पाᳯरि᭭थितक पयᭅटन िजस मᱶ सहायक हो ᮕह वास; और
v.
संवᳶधᭅत ᳰᮓयाकलाप और पैरा 4 के अधीन ᳰदया गया है: (ग)
परंतु यह और ᳰक जनजातीय भूिम का उपयोग रा᭔य सरकार ᭃेᮢीय नगर योजना अिधिनयम और अ᭠य िनयमᲂ तथा िविनयमᲂ के अधीन सᭃम अिधकारी के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी है, के अनुपालन के िबना, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए अनु᭄ात नहᱭ होगा: (घ)
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट िनगरानी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना देनी होगी : (ड.) परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा : (च)
अनᮧयु᭍ त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे।

(2) ᮧाकृितक जल ᮲ोत –आंचिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ, नᳰदयᲂ और चैनलᲂ के जल ᮕहण ᭃेᮢ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुननᭅवीकरण के िलए योजना सि᭥मिलत ᳰकए जाएंगे | (3) पयᭅटन/पाᳯरि᭭थितक पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, पयᭅटन महायोजना के अनुसार हᲂगे, जो आंचिलक महायोजना का भाग हᲂगे ।
(ख) पयᭅटन महायोजना पयᭅटन िवभाग ᳇ारा रा᭔य सरकार के वन और पयाᭅवरण िवभाग के परामशᭅ से तैयार होगी ।
(ग) पयᭅटन महायोजना आंचिलक महायोजना के एक घटक के ᱨप मᱶ होगी । (घ) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :- (i) होटलᲂ और ᳯरसᲃटᲂ का नया संिनमाᭅण व᭠यजीव अभयार᭛य कᳱ सीमा से 1 ᳰकलोमीटर के भीतर या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक जो भी िनकट हो, अनु᭄ात नहᱭ ᳰकया जाएगा । तथािप, व᭠यजीव अभयार᭛य कᳱ सीमा से 1 ᳰकलोमीटर कᳱ दूरी से परे, पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक नए होटलᲂ और ᳯरसᲃटᲂ कᳱ ᭭थापना पयᭅटन महायोजना के अनुसार पाᳯरि᭭थितक पयᭅटन सुिवधाᲐ के िलए पूवᭅ सीमांᳰकत और पदािभिहत ᭃेᮢᲂ मᱶ ही अनु᭄ात कᳱ जाएगी ।; (ii) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा मागᭅदशᭅक िस᳍ांतᲂ के तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िस᳍ांतᲂ के अनुसार, पाᳯरि᭭थितकᳱ पयᭅटन पर बल देते ᱟए होगा; (iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸दᭅ᳥ संवीᭃा तथा िनगरानी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया जाएगा । (4) नैसᳶगᭅक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगᭅक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए ऐसी योजना आंचिलक महायोजना का भाग होगी । (5) मानव िनᳶमᭅत िवरासत ᭭ थल- पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(6) ᭟ विन ᮧदूषण – पयाᭅवरण (संरᭃण) अिधिनयम 1986 के अधीन ᭟विन ᮧदूषण (िविनयमन और िनयंᮢण) िनयम, 2000 मᱶ िनयत उपबंधᲂ के अनुसार मᱶ पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟विन ᮧदूषण के िनयंᮢण के िलए िविनयमᲂ को कायाᭅि᭠वत करेगा ।
(7) वायु ᮧदूषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, रा᭔य सरकार के पयाᭅवरण िवभाग वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम के उपबंधᲂ के अनुसार वायु ᮧदूषण के िनयंᮢण के िलए मानक और िविनयम कायाᭅि᭠वत करेगा ।
(8) बिह᮲ाव का िन᭭सारण - पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण पयाᭅवरण (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयमᲂ के अ᭠तगᭅत आने वाले पयाᭅवरणीय ᮧदूषण के िन᭭सारण संबंधी साधारण मानकᲂ के उपबंधᲂ के अनुसार होगा तथा पयाᭅवरण कᳱ सरंᭃण के िलए मानक ओर अिधक कठोर बनाये जा सकते हᱹ। (9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान और ᮧबंधन िन᳜िलिखत ᱨप मᱶ होगा- (क) (i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ िनपटान और ᮧबंधन, समय-समय पर संशोिधत ठोस अपिश᭬ ट ᮧबंधन िनयम, 2016, जो भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1357(अ), तारीख 8 अᮧैल, 2016 ᳇ारा ᮧकािशत ᳰकए गए थे, के अनुसार ᳰकया जाएगा ;
(ii) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा; (ख) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭭मीकरण और भूिम भराव के ᭭थापनᲂ को अनु᭄ात नहᱭ ᳰकया जाएगा ।

(10) जैव िचᳰक᭜ सीय अपिश᭬ ट- जैव िचᳰक᭜ सीय अपिश᭬ ट ᮧबंधन िन᳜िलिखत ᱨप मᱶ होगा— (क) पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 343 (अ), तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा । (ख) पाᳯरि᭭थितक संवेदी जोन मᱶ कोई सामा᭠य उपचार सुिवधा या जलाया जाना अनु᭄ात नहᱭ ᳰकया जाएगा । (11) ᭡लाि᭭टक अपिश᳥ ᮧबंधन: - पाᳯरि᭭थितक संवेदी जोन मᱶ ᭡लाि᭭टक अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 340(अ), तारीख 18 माचᭅ, 2016 ᳇ारा ᮧकािशत ᭡लाि᭭टक अपिश᳥ ᮧबंध िनयम 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा। (12) िनमाᭅण और िव᭟वंस अपिश᳥ ᮧबंधन: - पाᳯरि᭭थितक संवेदी जोन मᱶ संिनमाᭅण और िव᭟वंस अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन 317(अ), तारीख 29 माचᭅ, 2016 ᳇ारा ᮧकािशत संिनमाᭅण और िव᭟वंस ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा । (13) ई–अपिश᳥:- पाᳯरि᭭थितक संवेदी जोन मᱶ ई–अपिश᳥ ᮧबंध का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत ᳇ारा ᮧकािशत ई–अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा। (14) यानीय पᳯरवहन: - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔य सरकार के सᭃम ᮧािधकारी ᳇ारा के अनुमोᳰदत होने तक, िनगरानी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी । (15) यानीय ᮧदूषण:- लागू िविधयᲂ के अनुसार वाहन ᮧदूषण कᳱ रोकथाम और िनयंᮢण का अनुपालन ᳰकया जाएगा। ᭭व᭒छक ᲊधन के उपयोग के िलए ᳰकए गए ᮧयास उदाहरण के िलए सीएनजी, एलपीजी, आᳰद हᱹ । (16) औ᳒ोिगक ईकाइयां: - (i) राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन के प᳟ात् या ᮧकाशन को, पाᳯरि᭭थितक संवेदी जोन के भीतर कोई नए ᮧदूिषत उ᳒ोगᲂ कᳱ ᭭थापना कᳱ अनु᭄ा नहᱭ दी जाएगी।
(ii) पाᳯरि᭭थितक संवेदी जोन के कᱶᮤीय ᮧदूषण िनयंᮢण बोडᭅ ᳇ारा जारी ᳰदशािनदᱷशᲂ मᱶ केवल गैर- ᮧदूिषत उ᳒ोगᲂ कᳱ ᭭थापना के वगᱮकरण कᳱ अनुमित दी जाएगी, जब तक ᳰक इस अिधसूचना मᱶ िविन᳸दᭅ᳥ न हो । इसके अलावा, गैर-ᮧदूिषत कुटीर उ᳒ोगᲂ को ᮧितिष᳍ ᳰकया जाएगा। (17) पहाड़ी ढलानᲂ को संरᭃण: - पहाड़ी ढलानᲂ के संरᭃण िन᳜ानुसार होगा- (क)
आंचिलक महायोजना पहाड़ी ढलानᲂ पर ᭃेᮢᲂ का संकेत होगा जहां ᳰकसी भी संिनमाᭅण कᳱ अनु᭄ा नहᱭ दी जाएगी । (ख) कटाव के एक उᲬ िडᮕी के साथ िव᳒मान खड़ी पहाड़ी ढलानᲂ या ढलानᲂ पर ᳰकसी भी संिनमाᭅण कᳱ अनु᭄ा नहᱭ दी जाएगी । (18) यᳰद यह आव᭫यक समझता है, इस अिधसूचना के उपबंधᲂ को ᮧभावी करने मᱶ के᭠ᮤ सरकार और रा᭔य सरकार, अ᭠य उपायᲂ िविन᳸दᭅ᳥ करेगा। 4. पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧितिष᳍ और िविनयिमत ᳰकए जाने वाले ᳰᮓयाकलापᲂ कᳱ सूची –
पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ और तटीय िविनयमन जोन, 2011 और पयाᭅवरणीय ᮧभाव आकलन अिधसूचना, 2006 और वन (संरᭃण) अिधिनयम, 1980 (1980 के 69), भारतीय वन अिधिनयम, 1927 (1927 के 16), व᭠यजीव (संरᭃण) अिधिनयम, 1972 (1972 के 53) संशोधनᲂ सिहत ᳇ारा शािसत हᲂगे और नीचे दी गई सारणी मᱶ िविन᳸दᭅ᳥ रीित मᱶ िविनयिमत हᲂगे, अथाᭅत् :-- सारणी ᮓम सं. ᳰᮓयाकलाप टीका-ᳯट᭡पणी (1) (2) (3) क. ᮧितिष᳍ ᳰᮓयाकलाप

वािणि᭔यक खनन । (क) सभी ᮧकार के नए और िव᳒मान खनन (लघु और वृहत खिनज), प᭜थर

कᳱ खानᱶ और उनको तोड़ने कᳱ इकाइयां वा᭭तिवक ᭭थानीय िनवािसयᲂ कᳱ देशी आव᭫यकताᲐ िजसमᱶ िनजी उपयोग के िलए मकानᲂ के संिनमाᭅण या मर᭥मत के िलए धरती को खोदना और मकान बनाने के िलए देशी टाइ᭨स या ᲊटᲂ का िनमाᭅण करना भी सि᭥मिलत है, के िसवाय नहᱭ हᲂगी ; (ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के मामले मᱶ आदेश तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के अंतᳯरम आदेश के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।

जल या वायु या मृदा या ᭟ विन ᮧदूषण काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नए और िव᳒मान ᮧदूषण काᳯरत करने वाले का िव᭭तार अनु᭄ात नहᱭ होगा । हᳯरत या ᳡ेत कृिष आधाᳯरत लघु उ᳒ोगᲂ सिहत के᭠ᮤीय ᮧदूषण िनयंᮢण बोडᭅ वगᱮकरण के ᱨप मᱶ वगᱮकृत उ᳒ोगᲂ को िनयमᲂ के अनुसार िविनयिमत ᳰकया जाएगा। 3.
बृहत जल िव᳒ुत पᳯरयोजना कᳱ ᭭थापन । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे । 4.
ᳰकसी पᳯरसंकटमय पदाथᲄ का उपयोग या उ᭜पादन । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠यथा उपबंिधत के िसवाय) हᲂगे ।

ᮧाकृितक जल िनकायᲂ या भूिम ᭃेᮢ मᱶ अनुपचाᳯरत ᮧवाह के िनवᭅहन । लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे । 6.
कंपिनयᲂ, कॉपᲃरेट, कंपिनयᲂ ᳇ारा बड़े पैमाने पर वािणि᭔यक पशुᲐ और पो᭨ᮝी फामᲄ कᳱ ᭭थापना । ᭭थानीय आव᭫यकताᲐ को पूरा करने के िलए लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे। 7.
आरा िमलᲂ कᳱ ᭭थापना । पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा िमलᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।
ख. िविनयिमत ᳰᮓयाकलाप 8.
होटल और ᳯरसोटᭅ का वािणि᭔यक ᭭थापन । संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार, इनमᱶ से जो भी नजदीक हो, से 1 ᳰकलोमीटर के भीतर नए वािणि᭔यक होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना को िसवाए पाᳯरि᭭थितक के अनुकूल पयᭅटन ᳰᮓयाकलापᲂ से संबंिधत पयᭅटकᲂ के िलए अ᭭थायी आवास के िलए अनु᭄ात नहᱭ ᳰकया जाएगा : परंतु, 1 ᳰकलोमीटर से परे और पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ के िव᭭तार पयᭅटन महायोजना और रा᭬ ᮝीय बाघ संरᭃण ᮧािधकरण के ᳰदशा-िनदᱷश के अनुᱧप हᲂगे । 9.
संिनमाᭅण ᳰᮓयाकलाप । (क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन के िव᭭तार, इनमᱶ से जो भी नजदीक हो, से 1 ᳰकलोमीटर के भीतर नए वािणि᭔यक संिनमाᭅण को अनु᭄ात नहᱭ ᳰकया जाएगा: परंतु ᭭थानीय ᳞िᲦयᲂ को उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण िजसके अंतगᭅत पैरा 3 के उपपैरा (1) मᱶ सूचीब᳍ ᳰᮓयाकलाप भी हᱹ, को करने के िलए अनु᭄ात ᳰकया जाएगा : पर᭠तु यह और ᳰक ऐसे लघु उ᳒ोगᲂ जो ᮧदूषण उ᭜ प᭠ न नहᱭ करते हᱹ, से संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही ᭠ यूनतम पर रखा जाएगा ।
(ख) एक ᳰकलोमीटर से परे इसकᲂ आंचिलक महायोजना के अनुसार िविनयिमत ᳰकया जाएगा। 10.
ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग । पाᳯरि᭭ थितक संवेदी जोन मᱶ देशीय सामᮕी से उ᭜पादᲂ का उ᭜पादन करने वाले गैर ᮧदूषण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या

7 कृिष आधाᳯरत देशीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते हᱹ, अनु᭄ात ᳰकए जाएंगे ।
11.
ᲊट भᲵᲂ कᳱ ᭭थापना । लागू िविधयᲂ के अधीन िविनयिमत (अ᭠ यथा उपबंिधत के िसवाय) हᲂगे । 12.
वृᭃᲂ कᳱ कटाई । (क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कंही वृᭃᲂ कᳱ कटाई नहᱭ होगी । (ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶᮤीय या रा᭔य अिधिनयम या उसके अधीन बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
13.
वन उ᭜पादᲂ और गैर का᭬ ठ वन उ᭜पादᲂ का संᮕहण । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । 14.
इलैि᭍ᮝकल और संचार सूचना टावरᲂ को लगाना तथा िव᳒ुत लाइनᲂ को िबछाना और अ᭠य अवसंरचना । लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । भूिमगत केबल डालने का संवधᭅन ᳰकया जाए । 15.
नागᳯरक सुिवधाᲐ सिहत बुिनयादी ढांचे। लागू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।
16.
िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदृढ करना तथा नई सड़कᲂ का संिनमाᭅण । लागू िविधयᲂ के अनुसार ᭠यूनीकरण कᳱ उपायᲂ के साथ, िनयम और िविनयमन और उपल᭣ध ᳰदशािनदᱷश िविनयिमत हᲂगे।

पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु गु᭣बारᱶ, हेलीका᭡टर, ᮟोन, माइᮓोलाइटस और अ᭠य पयᭅटन ᳰᮓयाकलाप आᳰद ᳇ारा पाᳯरि᭭थितक संवेदी जोन ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप करना। 18.
पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण । 19.
रािᮢ मᱶ यािनक पᳯरवहन का संचलन । लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे । 20.
᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और बागवानी ᮧथाᲐ के साथ पशुपालन, पशुपालन कृिष, जल कृिष और मछली पालन । ᭭थानीय लोगᲂ के उपयोग के िलए लागू िविधयᲂ के अधीन िविनयिमत हᲂगे । 21.
ᮧाकृितक जल िनकायᲂ या भू ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का िन᭭सारण । लागू िविधयᲂ के अधीन उपचाᳯरत बिह᮲ाव का िन᭭सारण िविनयिमत हᲂगे । 22.
सतह और भूजल के वािणि᭔यक िन᭬कषᭅण । 23.
खुले कुआ, बोर कुआ, आᳰद के िलए कृिष और अ᭠य उपयोग । िविनयिमत और उपयुᲦ ᮧािधकारी ᳇ारा ᳰᮓयाकलापᲂ कᳱ स᭎ती से िनगरानी कᳱ जाएगी। 24.

5. िनगरानी सिमित- कᱶᮤीय सरकार, तीन साल कᳱ अविध के िलए पाᳯरि᭭थितक संवेदी जोन के ᮧभावी िनगरानी के िलए एक िनगरानी सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :- (i) िजला कल᭍टर, कड᭡पा अ᭟यᭃ; (ii) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनᲂ (िजसके अंतगᭅत िवरासत संरᭃण भी है) का ᮧ᭜येक मामले मᱶ तीन वषᭅ कᳱ अविध के िलए आंᮥ ᮧदेश रा᭔य सरकार ᳇ारा नामिन᳸दᭅ᳥ एक ᮧितिनिध सद᭭य; (iii) आंᮥ ᮧदेश सरकार ᳇ारा नामिन᳸दᭅ᭬ ट पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ ᮧ᭜येक मामले मᱶ तीन वषᭅ कᳱ अविध के िलए एक िवशेष᭄ सद᭭य; (iv) ᭃेᮢीय अिधकारी, रा᭔य ᮧदूषण िनयंᮢण बोडᭅ,
   सद᭭य; (v) नगरपािलका आयुᲦ अथवा उसका ᮧितिनिध, क᲻पा शहर सद᭭य; (vi) ᮧभागीय वन अिधकारी, ᮧोदोᱫर व᭠यजीव ᮧभाग सद᭭य; (vii) पयाᭅवरण िवभाग, आंᮥ ᮧदेश सरकार का एक ᮧितिनिध
   सद᭭य; (viii) (ix) (x) सद᭭य-सिचव/रा᭔य जैव िविवधता बोडᭅ के सद᭭य
   शहरी िवकास िवभाग, आंᮥ ᮧदेश सरकार का ᮧितिनिध
   उप वन संरᭃक/ᮧभागीय वन अिधकारी, कड᭡पा ᮧभाग सद᭭य; सद᭭य; सद᭭य-सिचव।

6. िनदᱷश शतᱸ (1) िनगरानी सिमित का कायᭅकाल तीन वषᭅ का होगा।
   (2) मािन टरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी । (3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष᳍ गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸दᭅ᳥ ᭭थलीय दशाᲐ पर आधाᳯरत िनगरानी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸दᭅ᳥ कᳱ जाएगी ।

   (5) िनगरानी सिमित का सद᭭य-सिचव या संब᳍ कल᭍टर या संरिᭃत ᭃेᮢ का ᮧभारी ऐसे ᳞िᲦ के िवᱨ᳍, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता है, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 (1986 का 29) के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा ।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 7th April, 2017 S.O.1174(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O. 3328 (E), dated the 7th December 2015, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public; AND WHEREAS, no objections and suggestions received from all persons and stakeholders in response to the draft notification; AND WHEREAS, Sri Lankamalleswara Wildlife Sanctuary is located in the Kadapa District of Andhra Pradesh

48' 00" East and 79° 01' 48" East Longitudes and the Lankamalla Reserve Forest constitute the wildlife Sanctuary and the total area of the Sanctuary is 464.42 sq.uare kilometres of which an area of 263.92 sq. km. falls in Kadapa Forest Division and an area of 200.50 sq. km. falls in Prodattur Forest Division; AND WHEREAS, the Sri Lankamalleswara Wildlife Sanctuary is the only home for one of the most endangered and least known birds in the World, the Jerdon’s Double Banded Courser (Cursorius bitorquatus) (Kalivi Kodi), which is endemic to the State of Andhra Pradesh and the Sanctuary is also inhabited by Panthera Pardus (Leopard) (Chiruta puli), Rusa unicolor (Sambar) (Kanithi), Axis Axis (Cheetal or Spotted Deer) (Duppi), Cuonalpinus (Wild Dog or Dhole) (Rechu kukka), Tetraceros quadricomis (Four Horned Antilope) (Chousingha) (Konda Gorre) and many reptilian and bird species;

AND WHEREAS, the area has very rich Faunal and Floral diversity and has the largest population of Red Sanders (Pterocarpus santallinus) (Red Saunders)( Erra Chandanamu) which is endemic to the region; AND WHEREAS, the Sri Lankamalleswara Wildlife Sanctuary has mostly Southern Tropical dry deciduous Miscellaneous Type 5A/C3 as per Champion and Seth classification having species such as Pterocarpus santallinus (Red Saunders) (Erra Chandanamu), Anogeissus sp.,(Chiirumanu) Carrissa carrandas (Kalimi Chettu), Zizyphus xylophyros (Gotti), Dodonaea viscosa (Bandedu), Maytenus emerginata, Diospyros chloroxylon (Ullinta), Hardwickia binate (Yepi), Tarenna asiatica (Kuppi Puvvu), and Diospyros ferrea (Chinna Ullintha);

AND WHEREAS, numerous streams flowing over the entire reserve join river Pennar which forms the main drainage for the catchments in the Sanctuary and that the Sanctuary has many perennial springs and manmade tanks constructed during historical times;.

AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is specified in paragraph 1 of this notification around the protected area of Sri Lankamalleswara Wildlife Sanctuary as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processed in the said Eco-sensitive Zone.

NOW THEREFORE, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub – section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of one kilometre from the boundary of Sri Lankamalleswara Wildlife Sanctuary in the State of Andhra Pradesh, as the Sri Lankamalleswara Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1.
Extent and Boundary of Eco-sensitive Zone.-(1) The extent of Eco-sensitive Zone is one kilometre from the boundary of Sri Lankamalleswara Wildlife Sanctuary and includes 16 villages in Kadapa District and the Eco-sensitive Zone area is 338 square kilometers. (2)
The list of villages along with their coordinates of the Eco-sensitive Zone is given at Annexure-I of this notification. (3)
The map of the Eco-sensitive Zone boundary together with latitudes –longitudes is appended notification as Annexure II of this notification. 2.
Zonal Master Plan for the Eco-sensitive Zone.-
(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the ecological and environmental considerations into the said plan: (i) Environment; (ii) Forest and Wildlife;
(iii) Agriculture; (iv) Revenue; (v) Urban Development;
(vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control;
(ix) Municipal; (x) Panchayati Raj ;
(xi) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

13 (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps and the Plan shall be supported by Maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by State Government.-

The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Landuse: (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco- sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities:

(b) Provided that the conversion of agricultural and other lands, for the purpose other than that within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the relevant state laws and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:

(i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and
(v) promoted activities and given under para 4.

(c) Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the relevant state laws and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

(d) Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: (e) Provided also that the correction of error referred in the above promise shall not include change of land use in any case except as provided under this sub-paragraph. (f) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.- The catchment areas of all natural springs, rivers and channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism/ Eco-tourism.-
(a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-tourism Master Plan shall be prepared by the Department of Tourism in consultation with State Departments of Environment and Forests.

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The activities of Eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer and beyond the distance of 1 km

from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the Eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism. (iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel or resort or commercial establishment construction is permitted within Eco-sensitive Zone area.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. (6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto. (8) Discharge of effluents.- Discharge of treated effluent in the Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) (i) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time. (ii) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco- sensitive Zone. (b)No burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone. (10) Bio-medical waste: Bio medical waste management shall be as under:- (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time. (b) No common treatment facility or incineration shall be permitted within the Eco- sensitive Zone. (11) Plastic Waste Management: The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and Demolition Waste Management: The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste: The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (14) Vehicular traffic: The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is

15 prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular Pollution: The prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws and efforts shall be made for use of cleaner fuel for example CNG, LPG, etc.

(16) Industrial Units: (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board, unless so specified in this notification and the non-polluting cottage industries shall be promoted. (17) Protection of Hill Slopes: The protection of hill slopes shall be as under.- (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification. 4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.-
All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and be regulated in the manner specified in the Table below, namely:- TABLE S. (b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04 August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated 21 April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012. 2.
Setting of new industries causing pollution (Water, Air, Soil, Noise, etc.). No new or expansion of polluting industries in the Eco-sensitive Zone shall be permitted. Industries categorised as Green or White in the Central Pollution Control Board Classification including agro-based small scale industries, will be regulated as per regulations.
3.
Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws. 4.
Use or production of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws. 5.
Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws. 6.
Establishment of large-scale commercial livestock and poultry farms by firms, corporate, companies.
Prohibited (except as otherwise provided) as per applicable laws except for meeting local needs. 7.
Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.

B. Regulated Activities

8.
Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the protected area or upto the extent of Eco-sensitive Zone, whichever is nearer, except for small temporary structures for Eco-tourism activities:

   Provided that, beyond one kilometre from the boundary of 

the protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. 9.
Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the protected area or upto extent of the Eco-sensitive Zone whichever is nearer:

   Provided that, local people shall be permitted to undertake 

construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building byelaws:

    Provided that the construction activity related to small scale 

industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.

Small scale industries not causing pollution. Non polluting, non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco- sensitive Zone shall be permitted by the competent Authority. 11.
Setting up of brick kilns. Regulated (except as otherwise provided) as per applicable laws. 12.
Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made thereunder. 13.
Collection of Forest produce or Non- Timber Forest Produce (NTFP). Regulated under applicable laws. 14.
Erection of electrical and communication towers and laying of cables and other infrastructures.
Regulated under applicable law. Underground cabling may be promoted.

Infrastructure including civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines. 16.
Widening and strengthening of existing roads and construction of new roads. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.
17.
Under taking other activities related to tourism like over flying the Eco- sensitive Zone area by hot air balloon, helicopter, drones, Microlites, etc.
Regulated under applicable law. 18.
Protection of Hill Slopes and river banks. Regulated under applicable laws. 19.
Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.
20.
Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted under applicable laws for use of locals. 21.
Discharge of treated effluents in natural water bodies or land area. The discharge of treated effluent shall be regulated as per applicable laws.

Commercial extraction of surface and Regulated under applicable law.

Monitoring Committee:- The Central Government may constitute a Monitoring Committee for a period of three years, for effective monitoring of the Eco-sensitive Zone, consistency of the following presence:- (i) District Collector, Kadappa

Chairman. (ii) One representative of Non-Governmental Organization
working in the field of environment to be nominated by
the Government of Andhra Pradesh for three years

Member. (iii) One expert in the area of ecology and environment to be
nominated by the Government of Andhra Pradesh for three years

Member. (iv) Regional Officer, State Pollution Control Board

Member. (v) Municipal Commissioner or his representative of Kadappa Town

Member. (vi) The Divisional Forest Officer, Proddatur Wildlife Division

6. Terms of Reference:

(1) The tenure of monitoring committee shall be for three years. (2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph ground water.

Open Well, Bore Well etc. for agriculture or other usage. Regulated and the activity should be strictly monitored by the appropriate authority. 24.
Solid Waste Management. Regulated under applicable laws. 25.
Introduction of Exotic species. Regulated under applicable laws.
26.
Eco-tourism. Regulated under applicable laws. 27.
Use of polythene bags. Regulated under applicable laws. 28.
Commercial Sign boards and hoardings. Regulated under applicable laws. C. Promoted Activities 29.

4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities. (5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification. (6)
The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at Annexure III. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
